An argument can be taken as an operation of justification or as the product of this operation. But what about a counter-argument? This article is based on the hypothesis that there exists an operation of argumentative negation, which is both the argumentative and the negative equivalent of the operation of justification. Justification and argumentative negation necessarily act on assertions, for they are active at the level of the epistemic modalities of statements. As an operation, a counter-argument can thus be described, (...) as the application of an argumentative negation; as a product, it can be described as an argument the conclusion of which shows traces of negative modality. Two uses of argumentative negation are distinguished here: counter-argumentation and calling into question. The former can lead only to assertive conclusive statements, but the latter can also lead to directives or commissives. This leads the authors to introduce the notion of pseudo-argument, besides those of argument and counter-argument. It is shown in particular that when a pseudo-argument is rejected, argumentative negation has the effect of making evident an underlying argument. With respect to the latterit functions as a counter-argumentation, whereas with respect to the illocutionary act accomplished by the conclusive statement, it functions as a calling into question of a condition of satisfaction for this act. This article also defines certain characteristics of argument, proposes criteria for identifying argumentative negation in polemical conversations, and distinguishes four modes of counter-argumentation. Cognitive test batteries are widely used in diverse research fields, such as cognitive training, cognitive disorder assessment, or brain mechanism understanding. Although they need flexibility according to their usage objectives, most test batteries are not available as open-source software and are not be tuned by researchers in detail. The present study introduces an open-source cognitive test battery to assess attention and memory, using a javascript library, p5.js. Because of the ubiquitous nature of dynamic attention in our daily lives, it is (...) crucial to have tools for its assessment or training. For that purpose, our test battery includes seven cognitive tasks, common in cognitive science literature. By using the test battery, we conducted an online experiment to collect the benchmark data. Results conducted on 2 separate days showed the high cross-day reliability. Specifically, the task performance did not largely change with the different days. Besides, our test battery captures diverse individual differences and can evaluate them based on the cognitive factors extracted from latent factor analysis. Since we share our source code as open-source software, users can expand and manipulate experimental conditions flexibly. Our test battery is also flexible in terms of the experimental environment, i.e., it is possible to experiment either online or in a laboratory environment. (shrink)

Qu'y a-t-il de commun entre l'Univers, l'animal, la machine et la ville? A priori pas grand-chose si l'on prend en considération les différences d'échelle ou encore le fait que l'on cherche à rapprocher deux concepts "naturels", l'Univers et l'animal, à deux types de "constructions" humaines, la machine et la ville. Le propos de cet ouvrage est précisément de démontrer le contraire : des constatations identiques ou analogues peuvent s'appliquer à chacun d'eux. Notre appréhension de ces différentes entités a progressé de (...) façon considérable au cours du temps et notoirement au cours des dernières années. Les quatre termes deviennent de plus en plus complexes en même temps que nos analyses deviennent plus performantes. Chacun d'eux est constitué de structures emboîtées : ils sont en mosaïques, ensembles faits d'éléments distincts qui se juxtaposent, mais qui sont toujours plus que la simple somme de leurs éléments. Ils évoluent au cours du temps, et cette évolution est darwinienne : ils s'adaptent, cherchent l'équilibre, et seules subsistent les structures les plus robustes. Et ce qui est le plus réussi, le plus adapté, est aussi bien souvent ce que nous trouvons le plus beau... Mettre en parallèle les regards d'un astrophysicien, d'un biologiste, d'un architecte et d'un roboticien permet à chacune de ses disciplines d'apporter un éclairage nouveau sur les trois autres : un bel exercice de dialogue. Présenter un aperçu de la « mystique chrétienne médiévale » n’est possible qu’en la situant brièvement dans l’histoire de la « mystique » en Occident. Le terme n’est pas dénué d’ambiguïté. Apparaissant dans le contexte des religions à mystères, la mystique évolue vers une expérience silencieuse que les mots ne peuvent capter, avant de désigner des phénomènes anormaux décrits dans une rhétorique de l’étrange. Par rapport à la littérature moderne, les textes médiévaux sont très sobres. Faisant à écho à la (...) théologie mystique de Denys l’Aréopagite (ve-vie s.), ils présentent une voie d’union à l’Un en deçà des mots et des concepts. Il ne suffit pas de connaître (mathein) Dieu par un savoir notionnel, il faut en faire l’expérience, « en pâtir » (pathein). Ce « pâtir Dieu » sera repris par Maître Eckhart (1260-1328), le chef de file de la mystique rhénane. (shrink)

Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Public insurance is commonly assimilated with redistributive tools mobilized by the welfare state in the pursuit of an egalitarian ideal. This view contains some truth, since the result of insurance, at a given moment, is the redistribution of resources from the lucky to unlucky. However, Joseph Heath considers that the principle of efficiency provides a better normative explanation and justification of public insurance than the egalitarian account. According to this view, the fact that the state is involved in the provision (...) of specific insurance is explained and justified by the greater efficiency of the state, in comparison with markets, in addressing market failures such as moral hazard or adverse selection. Our argument is that while insurance, intrinsically and idealistically, may diverge from a redistributive scheme, it is nevertheless difficult to deny that insurance has nothing to do with equality. More precisely, we argue that insurance may be understood as an egalitarian tool if our understanding of equality is broadened to include relational equality. Our paper aims to briefly recap the debates surrounding public insurance as a redistributive tool, advancing the idea that public insurance may be a relational egalitarian tool. It then presents a number of relational arguments in favor of the involvement of the state in the provision of specific forms of insurance, arguments that have been overlooked given the domination of luck egalitarian approaches in these debates. In the literature on medical ethics, it is generally admitted that vulnerable persons or groups deserve special attention, care or protection. One can define vulnerable persons as those having a greater likelihood of being wronged – that is, of being denied adequate satisfaction of certain legitimate claims. The conjunction of these two points entails what we call the Special Protection Thesis. It asserts that persons with a greater likelihood of being denied adequate satisfaction of their legitimate claims deserve special attention, (...) care or protection. Such a thesis remains vague, however, as long as we do not know what legitimate claims are. This article aims at dispelling this vagueness by exploring what claims we have in relation to health care – thus fleshing out a claim-based conception of vulnerability. We argue that the Special Protection Thesis must be enriched as follows: If individual or group X has a greater likelihood of being denied adequate satisfaction of some of their legitimate claims to physical integrity, autonomy, freedom, social provision, impartial quality of government, social bases of self-respect or communal belonging, then X deserves special attention, care or protection. With this improved understanding of vulnerability, vulnerability talk in healthcare ethics can escape vagueness and serve as an adequate basis for practice. (shrink)

While seeking novel food sources to feed the increasing population of the globe, several alternatives have been discussed, including algae, fungi or in vitro meat. The increasingly propagated usage of farmed insects for human nutrition raises issues regarding food safety, consumer information and animal protection. In line with law, insects like any other animals must not be reared or manipulated in a way that inflicts unnecessary pain, distress or harm on them. Currently, there is a great need for research in (...) the area of insect welfare, especially regarding species-specific needs, health, farming systems and humane methods of killing. Recent results from neurophysiological, neuroanatomical and behavioral sciences prompt caution when denying consciousness and therefore the likelihood of presence of pain and suffering or something closely related to it to insects. From an animal protection point of view, these issues should be satisfyingly solved before propagating and establishing intensive husbandry systems for insects as a new type of mini-livestock factory farming. In the paper is analyzing the process of the institutionalization of Islamic Studies in Ukraine on the period of independence (1991–2013). The centers of Islamic Studies, its histories, particularities of the activity and publications are studied. The author argues about the existence of three centers of Islamic Studies in Ukraine: 1) as the substructure of the Institutes of Academy of Sciences of Ukraine; 2) as the substructure inside the universities; 3) inside the non-government organizations. Three main spheres of the activity (...) of Islamic Studies centers are specified: research, organizational and educational. In recent years "British" Idealism has been subject to sweeping re-evaluation and rehabilitation. The essays collected here by Will Sweet compare Bernard Bosanquet's ideas and arguments with those of Idealists and non-Idealists alike, and establish that Bosanquet was far more clear-headed and insightful than denunciations of the "Idealist school" by Moore, Russell, C. D. Broad, Harold Prichard, and A. J. Ayer suggest. Sweet observes in his introduction that Bosanquet has long remained in the shadows of T. H. Green and F. (...) H. Religiosity of Ukrainian population through the lenses of the secularization paradigm. The article of D.V. Shestopalets reviews the various aspects of Ukrainian population’s religiosity. Using numerous social surveys, the author analyses religious beliefs, religious practices and religious values of Ukrainians through the lenses of the secularization paradigm as it was developed by P. Berger, B. Wilson, K. Dobbelaere and others. The article finds that despite the high level of declarative religiosity of the respondents which in often perceived as a definite (...) sign of a religious revival, Ukrainian society in many respects appears to be rather secular. Progress in psychiatry depends on accurate definitions of disorders. As long as there are no known biologic markers available that are highly specific for a particular psychiatric disorder, clinical practice as well as scientific research is forced to appeal to clinical symptoms. Currently, the nosology of obsessive-compulsive disorder is being reconsidered in view of the publication of DSM-V. Since our diagnostic entities are often simplifications of the complicated clinical profile of patients, definitions of psychiatric disorders are imprecise and always indeterminate. (...) This urges researchers and clinicians to constantly think and rethink well-established definitions that in psychiatry are at risk of being fossilised. The proposition that the existence of God is demonstrable by rational argument is doubted by nearly all philosophical opinion today and is thought by most Christian theologians to be incompatible with Christian faith. This book argues that, on the contrary, there are reasons of faith why in principle the existence of God should be thought rationally demonstrable and that it is worthwhile revisiting the theology of Thomas Aquinas to see why this is so. The book further suggests that philosophical objections (...) to proofs of God's existence rely upon an attenuated and impoverished conception of reason which theologians of all monotheistic traditions might wish to reject. Denys Turner proposes that on a broader and deeper conception of it, human rationality is open to the 'sacramental shape' of creation as such and in its exercise of rational proof of God it in some way participates in that sacramentality of all things. The development of the theory of deliberative democracy is connected to the completion of two tasks. The first is to combine broad political participation with the rationality of the political process. The second is to ensure the political unity of modern societies, which are characterized by a pluralism of often incompatible values, norms, and lifestyles. Within the framework of this theory, the key democratic procedure is rational deliberation open to all interested parties. The purpose of this procedure is to reach (...) an agreement, as stated in the theory of Jurgen Habermas. However, experimental studies of deliberative practices show that they may result not in agreement but in the radicalization of positions. Unlike Habermas, John Rawls believes that a consensus on values and norms is unattainable. His theory of political liberalism attempts to answer the question of how political unity is possible in practically insoluble conflict, that is, in a situation of disagreement. He proposes the ideal of a well-ordered society with the assumption that a just society is one in which there is no agreement on comprehensive doctrines, but there is a consensus on the basic principles of justice. However, Rawls’s theory, in turn, faces a number of significant problems. For example, he was forced to admit that the democratic culture of society is a prerequisite for the formation of basic principles of justice in a well-ordered society. Rawls’s idea about the connections among disagreement, political freedom, and democracy influenced the further development of the theory of democracy, stimulating the search for different models of decision-making and the formation of political will without rational agreement. After all, the possibility of democracy lies in the conflict of ideas about justice and good. (shrink)

Ураховано значення системи захисту прав інтелектуальної власності в реалізації науково-освітніх стратегій Китаю.

Human suicide presents a fundamental problem for the scientific analysis of behavior. This problem has been neither appreciated nor confronted by research and theory. Almost all other behavior exhibited by humans and nonhumans can be viewed as supporting the behaving organism's biological fitness and advancing the welfare of its genes. Yet suicide acts against these ends, and does so more directly and unequivocally than any other form of maladaptive behavior. Four heuristic models are presented here to account for suicide in (...) an evolutionary and sociobiological framework. The first model attributes suicide to the extraordinary development of learning and cultural evolution in the human species. Learning may make human behavior so independent of biological constraints that it can occasionally assume a form entirely contrary to the principles of biological evolution. The second model attributes suicide to a breakdown of adaptive mechanisms in extremely stressful novel environments. The third model involves kin and group selection, arguing that in limited circumstances suicide may occur because of beneficial effects it has on other, surviving individuals who share the suicidal individual's genes. The last model suggests that suicide should be tolerated by evolution when it has no effect on the gene pool. This model holds particular promise in accounting for aspects of suicide not attributable to culture. The evidence indicates that suicide is most common in individuals who are unlikely to reproduce and unable to engage in productive activity; such individuals are least capable of promoting their genes. A complete explanation of suicide may derive only from an analysis of its biological significance. (shrink)

For centuries readers have comfortably accepted Julian of Norwich as simply a mystic. In this astute book, Denys Turner offers a new interpretation of Julian and the significance of her work. Turner argues that this fourteenth-century thinker's sophisticated approach to theological questions places her legitimately within the pantheon of other great medieval theologians, including Thomas Aquinas, Bernard of Clairvaux, and Bonaventure. Julian wrote but one work in two versions, a Short Text recording the series of visions of Jesus Christ (...) she experienced while suffering a near-fatal illness, and a much expanded Long Text exploring the theological meaning of the "showings" some twenty years later. Turner addresses the apparent conflict between the two sources of Julian's theology: on the one hand, her personal revelation of God's omnipotent love, and on the other, the Church's teachings on and her own witnessing of evil in the world that deserves punishment, even eternal punishment. Offering a fresh and elegant account of Julian's response to this conflict—one that reveals its nuances, systematic character, and originality—this book marks a new stage in the century-long rediscovery of one of the English language's greatest theological thinkers. Problems of methodology are among the most acute in the modern scientific study of religion. As a result of the crisis of classical rationality, which, in particular, is a crisis of monologism and universalism of the mind, before the scientific research of religion, there was a need for the development of new paradigms and the problem of the unity of the methodology of religious studies. It should be noted the tendency to overcome the sociological regulations of religious studies, the search (...) for new approaches to comprehend the essence of religion. Using the terminology of T. Kuhn, we can say that the process of forming a new scientific paradigm is now under way, which is aimed at understanding not only the external forms of religion, or the solution of the problem of the functioning of religion in different cultures and in society, as much as religion as one of the essential structural elements of human existence. As you know, the foundations of modern historiography of religion were laid by Hegel. "Lectures on the Philosophy of Religion," which he read at the University of Berlin, represent not only a unique system of philosophy of religion, but, equally important, is also an example of a profound historiosophical study of the religious phenomenon. However, unfortunately, this part of the Hegelian heritage remains largely unexplored in the national philosophic and religious studies literature.

The study of the Hegelian understanding of religious consciousness has never been carried out in the domestic philosophy, although this topic is extremely important, as the philosopher shows the gradual formation of religious consciousness as a special gestalt of self-knowledge of a spirit that is different from other forms of consciousness, and therefore has its own, inherent only to him, specifics.
