Political encounters between settler governments and indigenous communities are freighted with the unresolved issues of indigenous independence asserted under ongoing conditions of colonial domination. Within political science, these encounters have been primarily theorised and analysed as struggles of indigenous communities for political recognition from settler states. Further, the politics of recognition is widely understood as colonising by indigenous scholars, with some arguing for an alternative politics of resurgence and refusal, a ‘turning away’ from the state. In this article, we argue (...) that in the case of Māori in Aotearoa ‘turning up’ is the ethical and correct practice of politics, a practice stemming from the relational ontology of the Māori world. Thus ‘turning up’ rather than ‘turning away’ can, for Māori, itself be a practice of refusal. We outline the centrality of the embodied, face-to-face encounter within Māori politics, and identify the ongoing presence of the sovereign’s body and embodiment more broadly within the Westminster tradition, as symbolised in the concept of the Crown. Building on these compatibilities within distinct political ontologies, we argue for the potential and productivity of face-to-face political encounters, and call on the New Zealand Crown to also prioritise ‘turning up’ in its engagement with indigenous communities. Early discussions of ?climate justice? have been dominated by economists rather than political philosophers. More recently, analytical liberal political philosophers have joined the debate. However, the philosophical discussion of climate justice remains in its early stages. This paper considers one promising approach based on human rights, which has been advocated recently by several theorists, including Simon Caney, Henry Shue and Tim Hayward. A basic argument supporting the claim that anthropogenic climate change violates human rights is presented. Four objections to this (...) argument are examined: the ?future persons? objection; the ?risk? objection; the ?collective causation? objection; and the ?demandingness? objection. This critical examination leads to a more detailed specification and defence of the claim that anthropogenic climate change violates human rights. (shrink)

From the early 1960s until his death, French philosopher Gilles Deleuze wrote many influential works on philosophy, literature, film, and fine art. One of Deleuze's main philosophical projects was a systematic inversion of the traditional relationship between identity and difference. This Deleuzian philosophy of difference is the subject of Jeffrey A. Bell's Philosophy at the Edge of Chaos. Bell argues that Deleuze's efforts to develop a philosophy of difference are best understood by exploring both Deleuze's claim to be (...) a Spinozist, and Nietzsche's claim to have found in Spinoza an important precursor. Beginning with an analysis of these claims, Bell shows how Deleuze extends and transforms concepts at work in Spinoza and Nietzsche to produce a philosophy of difference that promotes and, in fact, exemplifies the notions of dynamic systems and complexity theory. With these concepts at work, Deleuze constructs a philosophical approach that avoids many of the difficulties that linger in other attempts to think about difference. Bell uses close readings of Plato, Aristotle, Spinoza, Nietzsche, Heidegger, Derrida, and Whitehead to illustrate how Deleuze's philosophy is successful in this regard and to demonstrate the importance of the historical tradition for Deleuze. Far from being a philosopher who turns his back on what is taken to be a mistaken metaphysical tradition, Bell argues that Deleuze is best understood as a thinker who endeavoured to continue the work of traditional metaphysics and philosophy. In this Article we explore the evolution of property law and examine the applicability of the prevailing accounts according to which property institutions oscillate between the extreme points of open access and private property. We show that the evolution of property is a much more nuanced process, shaped by the interplay of the following three dimensions: number of owners, extent of dominion and asset configuration. Accordingly, property institutions can assume a myriad of positions along the aforementioned dimensions in response to (...) the constant change in exclusion and management costs. Research on the nature of science and science education enjoys a longhistory, with its origins in Ernst Mach's work in the late nineteenthcentury and John Dewey's at the beginning of the twentieth century.As early as 1909 the Central Association for Science and MathematicsTeachers published an article – ‘A Consideration of the Principles thatShould Determine the Courses in Biology in Secondary Schools’ – inSchool Science and Mathematics that reflected foundational concernsabout science and how school curricula should be informed by them. Sincethen (...) a large body of literature has developed related to the teaching andlearning about nature of science – see, for example, the Lederman and Meichtry reviews cited below. As well there has been intensephilosophical, historical and philosophical debate about the nature of scienceitself, culminating in the much-publicised ‘Science Wars’ of recent time. Thereferences listed here primarily focus on the empirical research related to thenature of science as an educational goal; along with a few influential philosophicalworks by such authors as Kuhn, Popper, Laudan, Lakatos, and others. Whilenot exhaustive, the list should prove useful to educators, and scholars in otherfields, interested in the nature of science and how its understanding can berealised as a goal of science instruction. This article explores what might happen to the concept of performativity within arguments that are understood as ‘topological’. It argues that we might ‘decline’ performativity, which is to say, elaborate the concerns that are expressed in the concept, but inclining it more boldly towards the complexities of a world whose elements are always in process of constitution, of reiterative enfolding. Taking a cue from Isabelle Stengers’ recent work in which she posits the notion of ecologies of practice, on the one (...) hand, and Whitehead’s concept of concern, on the other, the paper argues that emergent entities have differential requirements – not least according to the disciplines to which they appeal – and subtend different modes of implied obligation. An adherence to these requirements needs to be accompanied by persuasive presentation that obliges a community to affirm any entity. On many levels of abstraction, ecologies need to show concern for an entity to facilitate its emergence and to sustain its mode of being. In an expanded vision, then, human and non-human entities at all levels enter into multifarious relational modes of becoming, but these become of sustained consequence only through persuasion of communities, sometimes organized into disciplines. The survival of entities requires forms of differentiation, division and of value. The paper relates these arguments to forms of sociological enquiry that give glimpses of how sociology might respond. It ends with a hesitation around the radical anti-anthropomorphism of the stance developed, and argues that this does not entirely eclipse the importance of political hope. (shrink)

As scholars integrate empirical approaches to ethical questions in healthcare, relational autonomy theory must inform research design and change practice. Qualitative approaches are well suited to issues where patient values play a central role, and they can be combined with relational autonomy theory to investigate the factors influencing autonomy-rich experiences. This paper draws upon my experience conducting bioethics research related to clinical trial decision-making to develop a systematic method for applying relational autonomy as a theoretical lens to qualitative health research. Reading feminist theory as a complex imaginative achievement, Feminist Imagination considers feminist commitment through the interrogation of its philosophical, political and affective connections with the past, and especially with the `race' trials of the twentieth century. The book looks at: the 'directionlessness' of contemporary feminist thought; the question of essentialism and embodiment; the racial tensions in the work of Simone de Beauvoir; the totalitarian character in Hannah Arendt; the 'mimetic Jew' and the concept of mimesis in the work of Judith (...) Butler. Vikki Bell provides a compelling rethinking of feminist theory as bound up with attempts to understand oppression outside a focus on 'women'. She affirms feminism as a site and mode of making these connections. What emerges is a profound work brimming with insight that will be required reading for anyone who is seriously interested in feminist theory and, more generally, contemporary social theory. Focusing on Judith Butler's highly influential work on gender, this article draws attention to a certain feminist inheritance of an emphasis on mimesis and imitation that resonates with the ways in which theoreticians responded to the calamitous events of essentialist politics and versions of belonging that were central to the political vision of Hitler's National Socialism and to the events of the Second World War. The intention is to point to this trajectory, to give Butler's work a genealogy that traces (...) the notion of mimesis back into work which employed the concept within socio-theoretical responses to anti-Semitism, in order to initiate a discussion of mimesis in a new contemporary agenda. The question of mimesis in this new agenda is significant in its reutilization of the concept in a way that moves the focus away from assumptions of the repressed natural process that underpinned Adorno and Horkheimer's thesis, and towards the complex manoeuvres of continued performances and continued `tradition', away from judgements of authenticity and towards the reasons why people maintain certain embodied subjectivities. Such a perspective raises the questions of generational relations, of foreclosed possibilities and of affective attachments to identity that reach beyond the Nietzschean sense of a wounded attachment. A focus on the responsibilities and pressures of `cultural survival' seems fruitful as a guiding concept in this exploration of the connections between identification, affiliation and the power contexts within which mimesis, as a form of repetition or `citation', occurs. Much contemporary discussion of mercy has focused on what I call ‘beneficent mercy’: compassionately sparing a person from harsh treatment that she deserves. Drawing on Seneca’s discussion of mercy, I articulate a different concept of mercy which I call ‘critical mercy’: treating a person justly when unjust social rules call for harsher treatment. Whereas beneficent mercy is grounded in recognition of imperfection in human individuals, critical mercy is grounded in recognition of imperfection in human institutions. I argue that political communities (...) have reason to authorize judges to grant critical mercy in criminal law. I contend with the objection that critical mercy appears to violate the ideal of the rule of law. I argue that where certain constraints are met, rule of law values in fact provide positive reason to authorize judges to grant critical mercy in criminal law. (shrink)

Its various parts focus on the connected theme that some sensible component is essential to the production and comprehension of art. Each part, however, investigates a different aspect of the theme and (...) could stand on its own.
