The prospective introduction of autonomous cars into public traffic raises the question of how such systems should behave when an accident is inevitable. Due to concerns with self-interest and liberal legitimacy that have become paramount in the emerging debate, a contractarian framework seems to provide a particularly attractive means of approaching this problem. We examine one such attempt, which derives a harm minimisation rule from the assumptions of rational self-interest and ignorance of one’s position in a future accident. We contend, (...) however, that both contractarian approaches and harm minimisation standards are flawed, due to a failure to account for the fundamental difference between those ‘involved’ and ‘uninvolved’ in an impending crash. Drawing from classical works on the trolley problem, we show how this notion can be substantiated by reference to either the distinction between negative and positive rights, or to differences in people’s claims. By supplementing harm minimisation with corresponding constraints, we can develop crash algorithms for autonomous cars which are both ethically adequate and promise to overcome certain significant practical barriers to implementation. The prospect of creating and using human–animal chimeras and hybrids that are significantly human-like in their composition, phenotype, cognition, or behavior meets with divergent moral judgments: on the one side, it is claimed that such beings might be candidates for human-analogous rights to protection and care; on the other side, it is supposed that their existence might disturb fundamental natural and social orders. This paper tries to show that both positions are paradoxically intertwined: they rely on two kinds of species (...) arguments, “individual species arguments” and “group species arguments,” which formulate opposing demands but are conceptually interdependent. As a consequence, the existence of HACHs may challenge exactly those normative standards on which the protection of HACHs may eventually be based. This ethical paradox could constitute the ultimate source of the “moral confusion” that some authors have suspected HACHs to provoke. (shrink)

The concept of power is not restricted to the usual idea of domination, as mainly implemented in the governmental structures of society. Rather, power also occurs at other places of a com-munity, adopting highly divergent forms. This plurality often impedes its reliable identification and precise labeling. However, the classical concepts of power, potestas and auctoritas, can be widened to more comprehensive perspectives that eventually promise to embrace modern societal places of power such as the market or the media in their (...) respective peculiarities. I argue that in his aesthetics, Kant puts forward arguments that help to answer the question of whether he is a conceptualist or a non-conceptualist. The current debate on Kantian conceptualism and non-conceptualism has completely overlooked the importance of Kant’s aesthetics. There are two candidates for non-conceptuality in Kant’s aesthetics. First, non-conceptual content plays a crucial role in aesthetic evaluation. Second, non-conceptual content has a systematic explanatory function in the theory of aesthetic creation of the genius of art. Accordingly, my (...) argument proceeds in two steps: In first analyse the role of non-conceptual content in aesthetic evaluation, i.e., Kant’s claim that aesthetic experience is cognition of a special kind that does not bear on conceptual activities. In then look at the role of non-conceptual content in the genius’s creation of artwork. I argue that art production does not imply conceptual activity and therefore seems to count as a second systematic instance of Kantian non-conceptualism. If my argument is correct, then Kant’s aesthetics implies non-conceptualism with respect to aesthetic evaluation but does not in any objective sense with respect to aesthetic creation. (shrink)

Conceptualism is the view that cognizers can have mental representations of the world only if they possess the adequate concepts by means of which they can specify what they represent. By contrast, non-conceptualism is the view that mental representations of the world do not necessarily presuppose concepts by means of which the content of these representations can be specified, thus cognizers can have mental representations of the world that are non-conceptual. Consequently, if conceptualism is true then non-conceptualism must be false, (...) and vice versa. This incompatibility makes the current debate over conceptualism and non-conceptualism a fundamental controversy since the range of conceptual capacities that cognizers have certainly has an impact on their mental representations of the world, on how sense perception is structured, and how external world beliefs are justified. Conceptualists and non-conceptualists alike refer to Kant as the major authoritative reference point from which they start and develop their arguments. The appeal to Kant attempts to pave the way for a robust answer to the question of whether or not there is non-conceptual content. Since the incompatibility of the conceptualist and non-conceptualist readings of Kant indicate a paradigm case, hopes have risen that the answer to the question of whether Kant is a conceptualist or a non-conceptualist might settle the contemporary controversy across the board. As a patient approaches death, family members often are asked about their loved one’s preferences regarding treatment at the end of life. Advance care directives may provide information for families and surrogate decision makers; however, less than one-third of Americans have completed such documents. As the U.S. population continues to age, many surrogate decision makers likely will rely on other means to discern or interpret a loved one’s preferences. While many surrogates indicate that they have some knowledge of their loved (...) one’s preferences, how surrogates obtain such knowledge is not well understood. Additionally, although research indicates that the emotional burden of end-of-life decision making is diminished when surrogates have knowledge that a loved one’s preferences are honored, it remains unclear how surrogates come to know these preferences were carried out. The current study examined the ways that next of kin knew veterans’ end-of-life preferences, and their ways of knowing whether those preferences were honored in Veteran Affairs Medical Center inpatient settings. While video games have blossomed into the foremost expression of contemporary popular culture over the past decades, their critical study occupies a fringe position in American Studies. In its engagement with video games, this book contributes to their study but with a thematic focus on a particularly important subject matter in American Studies: spatiality. The volume explores the production, representation, and experience of places in video games from the perspective of American Studies. Contributions critically interrogate the use of spatial myths (...) ("wilderness," "frontier," or "city upon a hill"), explore games as digital borderlands and contact zones, and offer novel approaches to geographical literacy. Eventually, Playing the Field II brings the rich theoretical repertoire of the study of space in American Studies into conversation with questions about the production, representation, and experience of space in video games. In this article I respond to objections that Matías Oroño, Silvia del Luján di Saanza, Pedro Stepanenko and Luciana Martínez have raised against my non-conceptualist reading of Kant’s aesthetics. The objections are both, substantial and instructive. I first sketch my non-conceptualist reading of Kant’s doctrine of judgments of taste and then turn to what I take to be the most important criticisms that these authors have put forward. Two difficulties with a non-conceptualist reading of Kant’s aesthetics seem to be central: (...) the cognitive status of judgments of taste and the representationalist capacity of aesthetic feeling as non-conceptual mental content. I respond to these and additional objections and defend my overall non-conceptualist interpretation of Kant’s aesthetics against my critics. Dietmar Wetzel unternimmt eine diskurskritisch-vergleichenden Lektüre zweier Theorielinien der neueren Sozialphilosophie: identitäts- versus alteritätsorientierte Konzepte. Das Denken des Ethischen und des Politischen wird dabei anhand einer Beschäftigung mit Schlüsselbegriffen, Konstellationen und Figuren der Gegenwartsgesellschaft thematisch an Gerechtigkeit, Geschlecht, Dritte(m) und Gemeinschaft ausgerichtet. Soziologische Essays, dem Intellektuellen, der Hausfrau, dem Grenzpolizisten und dem Flüchtling gewidmet sind, komplementieren die Analysen. So kann gezeigt werden, daß differenztheoretische Positionen (Lévinas/Derrida) den Begriff der Gerechtigkeit um Aspekte der Fürsorge und der moralischen Gefühle erweitern müssen (...) Da im Übergang der Ich-Anderer-Beziehung zu "ordentlichen Bezügen" das Dritte eine grundlegende Rolle spielt, läßt sich Gemeinschaftsbildung nicht mehr im Sinne natural bzw. religiös begründeter Nachbarschaft (Kommunitarismus), sondern nur als stets neu zu legitimierende und variierende Kultivierung von Andersheit begreifen. The article tries to inquire a third way in normative ethics between consequentialism or utilitarianism and deontology or Kantianism. To find such a third way in normative ethics, one has to analyze the elements of these classical theories and to look if they are justified. In this article it is argued that an adequate normative ethics has to contain the following five elements: (1) normative individualism, i. e., the view that in the last instance moral norms and values can only (...) be justified by reference to the individuals concerned, as its basis; (2) consideration of the individuals’ concerns and interests—aims, desires, needs, strivings—insofar as they have a justificatory function; (3) a pluralism of references of these concerns and hence of moral norms and values to all possible elements of actions; (4) the necessity of a principle of aggregation and weighing with regard to these concerns; (5) finally, as a central principle of aggregation and weighing, the principle of relative reference to self and others, operating as a generalizing meta-principle that guides the application of concrete principles and decisions. We investigate the expressive power of Parikh's Game Logic interpreted in Kripke structures, and show that the syntactical alternation hierarchy of this logic is strict. This is done by encoding the winning condition for parity games of rank n. It follows that Game Logic is not captured by any finite level of the modal -calculus alternation hierarchy. Moreover, we can conclude that model checking for the -calculus is efficiently solvable iff this is possible for Game Logic.

Recent developments in neuroscience have inspired proposals to perform deep brain stimulation on psychopathic detainees. We contend that these proposals cannot meet important ethical requirements that hold for both medical research and therapy. After providing a rough overview of key aspects of psychopathy and the prospects of tackling this condition via deep brain stimulation, we proceed to an ethical assessment of such measures, referring closely to the distinctive features of psychopathic personality, particularly the absence of subjective suffering and a lack (...) of moral motivation. Scrutiny of these factors reveals that two essential bioethical criteria, individual medical benefit and voluntary informed consent, cannot be met in performing neurosurgical experiments or treatments on psychopathic inmates. Realism takes many forms. The aim of this paper is to show that the “Critique of pure Reason” is the founding document of realism and that to the present-day Kant’s discussion of realism has shaped the theoretical landscape of the debates over realism. Kant not only invents the now common philosophical term ‘realism’. He also lays out the theoretical topography of the forms of realism that still frames our understanding of philosophical questions concerning reality. The paper explores this by analysis (...) of Kant’s methodological procedure to distinguish between empirical and transcendental realism. This methodological procedure is still of great help in contemporary philosophy, although it has its limits. (shrink)

Der Aufsatz verfolgt eine doppelte Absicht: einerseits soll das Selbstverständnis der Hermeneutik gegen die verbreiteten Mißverständnisse der wissenschaftstheoretischen Diskussion verteidigt, andrerseits soll es im Rahmen einer Methodologie der Gesellschafts- und Humanwissenschaften kritisiert werden. Beides geschieht nicht von einem festen Standpunkt aus, sondern in der Bewegung des Nachdenkens der zentralen aufgeworfenen Probleme. Nach einer historischen Darstellung der zweimaligen Radikalisierung der Hermeneutik wird das hermeneutische Verständnis von Wirklichkeit, Erfahrung, Geschichte, Theorie und Praxis insbesondere durch ein Referat der wichtigsten Autoren freigelegt, die Hermeneutik (...) gesellschaftskritisch fundamentieren wollen: Gadamer, Habermas, Apel, Sandkühler. : In the early twentieth century, psychoanalysis tries to investigate a specific logic of the appearance and the incident of what is taken to be unintended in everyday communication and human behavior. What before hardly seemed to be worth systematic research, now becomes a privileged field, in which the meaningful signs of a hidden and unwelcome past appear. For representing this new field of research Freud often makes use of archaeological metaphors. But in quoting the knowledge and the techniques of (...) archaeology, he evokes imaginary landscapes of a reappearing human past, which is not depraved and repressed but glorious and precious. This contradiction or gap between the character of analytical objects and their representation gives reason for an 'archaeological' investigation of psychoanalysis itself. To this end one of the heroes of nineteenth century archaeology, Heinrich Schliemann, will be confronted with two little works of Rudolf Virchow, in which he follows up the astonishing idea of an archaeology of refuse. Relating treasure troves and rubbish dumps it can be asked whether 'archaeological' practices in the late nineteenth century constituted a type of historical knowledge which runs counter to contemporary historicism and is crucial not only for Freud but also for today's theoretical reflections on archaeological perspectives in cultural studies. Dabei konzentrierte man sich auf die Theorien Burkes und Kants, in denen das Schöne dem Erhabenen gegenübergestellt wird. Die Geschichte des Erhabenen in der Frühen Neuzeit dagegen blieb weitgehend im dunkeln. Diese Geschichte wird hier dargestellt, wobei die Studie von der These ausgeht, daß für diesen Zeitraum gerade nicht die Dichotomie von Schönem und Erhabenem zentral ist, sondern die Opposition zweier Modelle des Sublimen selbst: das (...) The central question of this book is whether the assignment of government functions to the individual jurisdictions in a federal state can ensure an optimal allocation of resources and a fair income distribution. The analysis thereby gives a new answer to the old question about the optimal degree of fiscal decentralization in a federal state. It shows that fiscal decentralization is a method to disclose the preferences of currently living and future generations for local public goods, to limit the size (...) of the government, and to avoid excessive public debt finance. While the allocative branch of the government benefits from fiscal decentralization, it is difficult to obtain a distribution of incomes that differs from the outcome that the market brings along. This article improves our understanding of the reasons underlying the intellectual migration of scientists from existing cognitive domains to nascent scientific fields. To that purpose we present, first, a number of findings from the sociology of science that give different insights about scientific migration. We then attempt to bring some of these insights together under the conceptual roof of an actor-based approach linking expected utility and diffusion theory. Intellectual migration is seen as the choice of scientists who decide under uncertainty (...) and on the base of estimations about probabilities, costs, and benefits of the migration. The resulting choice model can be used as a heuristic base for further exploration of the subject. (shrink)

Hegel’s major claim is that true philosophy provides the complete rational cognition of the absolute. Since by definition the complete cognition of the absolute cannot be cognitively exceeded, true philosophy itself must account for the completeness claim. There are three places in particular where Hegel develops this claim: in the Phenomenology of Spirit, in the Science of Logic and in the Encyclopedia of Philosophical Sciences. I explore the different ways in which Hegel elucidates the rational, non-circular explication of how to (...) philosophically conceive of the complete comprehension of philosophy itself, i.e., his philosophy of philosophy or metaphilosophy. When seeking to coordinate in a game with imperfect information, it is often relevant for a player to know what other players know. Keeping track of the information acquired in a play of infinite duration may, however, lead to infinite hierarchies of higher-order knowledge. We present a construction that makes explicit which higher-order knowledge is relevant in a game and allows us to describe a class of games that admit coordinated winning strategies with finite memory.
