This article considers the attempt by a prominent fifteenth-century follower of Thomas Aquinas, Dominic of Flanders, to address John Duns Scotus’ most famous argument for the univocity of being. According to Scotus, the intellect must have a concept of being that is univocal to substantial and accidental being, and to finite and infinite being, on the grounds that an intellect cannot be both certain and doubtful through the same concept, but an intellect can be certain that something is (...) a being while doubting whether it is a substance or accident, finite or infinite. The article shows how Flandrensis’ reply in defence of analogy of being hinges on a more fundamental disagreement with Scotus over the division of the logically one. It also shows how Flandrensis’ answer to this question commits him to a position on the unity of the concept of being that lies between the positions of Scotus and of Flandrensis’ earlier Thomistic sources. Flanders will complete the migration from analog to digital terrestrial television by the end of 2008. Despite the cable dominated television landscape, the Flemish government is aiming at a smooth transition from analog to digital terrestrial television. Therefore, a multi-methodical study has been set up by order of the Flemish government to understand the specific features and needs of analog antenna viewers and their expectations for the analog switch-off. The study shows that there are three distinctive types of analog (...) antenna viewers. The results demonstrate that the antenna viewers are rather badly informed about the upcoming analog switch-off, which may lead to a negative attitude and may impede a smooth transition. Finally, antenna viewers seem to be rather conservative viewers: they wish to keep on watching the same television programs from the same channels. Moreover, digital terrestrial television is their preferred alternative. (shrink)

This article presents two case-studies that shed light on the silent yet significant role an editor might play in the reception of Renaissance texts and the place of Thomas Aquinas therein. Both studies take up texts from fifteenth-century Italy. The first addresses the scholastic philosopher, Dominic of Flanders, suggesting that Dominic’s originality as a thinker may have been ‘corrected’ by an anonymous editor in order to maintain closer accord with Aquinas’s position; inquiry into the manuscript tradition uncovers (...) instances of silent intervention. The second addresses a Latin dialogue by the physician and humanist, Antonio de Ferraris (Galateo), drawing attention to a significant suppression of the interlocutor Thomas Aquinas, this time by a twentieth century editor. We present a model for several early stages of the sensorimotor transformations involved in targeted arm movement. In psychophysical experiments, human subjects pointed to the remembered locations of randomly placed targets in three-dimensional space. They made consistent errors in distance, and from these errors stages in the sensorimotor transformation were deduced. When subjects attempted to move the right index finger to a virtual target they consistently undershot the distance of the more distal targets. Other experiments indicated that the error was (...) in the sensorimotor transformation rather than in the perception of distance. The error was most consistent when evaluated using a spherical coordinate system based at the right shoulder, indicating that the neural representation of target parameters is transformed from a retinocentric representation to a shoulder-centered representation. According to the model, the error in distance results from the neural implementation of a linear approximation in the algorithm to transform shoulder-centered target parameters into a set of arm orientations appropriate for placing the finger on the target. The transformation to final arm orientations places visually derived information into a frame of reference where it can readily be combined with kinesthetically derived information about initial arm orientations. The combination of these representations of initial and final arm orientations could give rise to the representation of movement direction recorded in the motor cortex by Georgopoulos and his colleagues. Later stages, such as the transformation from kinematic to dynamic parameters, or to levels of muscle activation, are beyond the scope of the present model. (shrink)

There is a great deal of research on the structure of narrative and its mode, and on the narrative positioning and counter positioning of the actor in legal and social contexts. In offender narratives, personal experiences are embedded for observation and analysis of particular realities that contextualize a disposition of the perpetrator being ‘an undergoer’ rather than an ‘effector’ of actions. This is evaluated in the shift from a narrated action to a speaker utterance in prospection and also in anticipation (...) of the criminal act. Using ‘grammatical logic’, it is also possible to demonstrate how the crucial event is not a cause, but an effect of a personal theme that encapsulates pattern of circumstances when the narrative outcome in criminal narrative becomes the product of its discursive practices. This is the ‘story of intentionality’ in crime narratives, characteristically embedded within the 1st the story of crime, the 2nd is the story of investigation [14, 20]. Using techniques from functional grammar and critical stylistics for discourse analysis, I intend to show an effective approach for the search of offender theme that underlies an act of crime. These disciplines provide the analyst with the linguistic material to analyse intersentential cohesion in a chain of semantically linked sentences that explore the ways in which things are ‘made to look’ in the structure and functions of the English language. As a case study, I am using an offender narrative from Tony Parker’s book Life After Life: Interviews with Twelve Murderers showing an effective approach for the search of personal themes underlying the act of crime. Offender theme analyses are also valuable for evaluating the changing nature or development of offender characteristics pre or post crime. (shrink)

Modern analytical political philosophy—characterized most notably by the work of John Rawls—has had very little to say about how punishment in particular and criminal law more generally might be justified. This is a puzzling omission, as punishment can be seen as the most serious use of coercive state power and therefore the one in greatest need of philosophical justification. With the idea of filling this gap, this chapter analyzes several major political theories of recent decades and examines how criminal justice (...) might fit into their thought. After discussing the various political theories of libertarianism, liberalism, communitarianism, Marxism, and republicanism, I offer a limited defense of one such theory, Rawls’s “political liberalism,” as offering a suitable way to approach issues of criminal justice and punishment in modern society. More broadly, my chapter invites political philosophers to speak more often and more specifically about how criminal justice fits within their theories. (shrink)

In his paper “Public Reason and the Justification of Punishment,” Zachary Hoskins develops and defends an idea of “public reason” that might be applicable to debates over punishment in the Western world. This short reply takes issue with some of Hoskins’ conclusions (while agreeing with many of his premises), and suggests that contra Hoskins, many versions of retribution are not compatible with the ideal of public reason as Rawls articulated it. Instead, debates over criminal justice and punishment should properly revolve (...) around the goods of public safety and harm reduction—rather than around any of the supposed metaphysical goods achieved by retributive punishment. The prohibition on “cruel and unusual” punishments, found in the Eighth Amendment to the U.S. Constitution, has long puzzled scholars. If punishments are cruel, why is that not sufficient to prohibit them? What does “unusual” add? Scholars have also disagreed on how to understand “cruel.” Should “cruel” refer only to those things that the authors of the Constitution believed were cruel, or does it extend to those things that are actually cruel? This chapter gives an overview of these debates and (...) describes the United States Supreme Court’s jurisprudence in the area. A concluding part takes a look at the possibility that some contemporary forms of punishment (e.g., imprisonment) are cruel and unusual, and even that punishment itself might be cruel and unusual. How has psychoanalysis developed in France in the years since Lacan so dramatically polarized the field? In this book, Dana Birksted-Breen and Sara Flanders of the British Psychoanalytical Society, and Alain Gibeault of the Paris Psychoanalytical Society provide an overview of how French psychoanalysis has developed since Lacan. Focusing primarily on the work of psychoanalysts from the French Psychoanalytical Association and from the Paris Psychoanalytical Society, the two British psychoanalysts view the evolution of theory as it appears to them (...) from the outside, while the French psychoanalyst explains and elaborates from inside the French psychoanalytic discourse. Seminal and representative papers have been chosen to illuminate what is special about French thinking. A substantial general introduction argues in favour of the specificity of 'French psychoanalysis', tracing its early influences and highlighting specific contemporary developments. Sections are made up of introductory material by Alain Gibeault, followed by illustrative papers in the following categories: the history of psychoanalysis in France the pioneers and their legacy the setting and the process of psychoanalysis phantasy and representation the body and the drives masculine and feminine sexuality psychosis. An excellent introduction to French psychoanalytical debate, _Reading French Psychoanalysis_ sheds a complementary light on thinking that has evolved differently in England and North America. It will be ideal reading for beginners and advanced students of clinical theory as well as experienced psychoanalysts wanting to know more about French Psychoanalytic theory, and how it has developed. On 24 July 2017, the long-running, deeply tragic and emotionally fraught case of Charlie Gard reached its sad conclusion. Following further medical assessment of the infant, Charlie’s parents and doctors finally reached agreement that continuing medical treatment was not in Charlie’s best interests. Life support was subsequently withdrawn and Charlie died on 28 July 2017.Box 1 ### Case summary and timeline21–23 Charlie Gard was born at full term, apparently healthy, in August 2016. At a few weeks of age his parents (...) noticed early signs of muscle weakness. At 2 months of age, he was admitted to Great Ormond Street Hospital with poor feeding, failure to thrive and respiratory failure. He was admitted to intensive care, where investigations led to the diagnosis of a rare severe mitochondrial disorder – infantile onset encephalomyopathic mitochondrial DNA depletion syndrome. The specific genetic form of MDDS in Charlie Gard had previously been reported in approximately 15 infants, with typical clinical features including early onset, rapid progression and death in infancy.24 By that point, Charlie was paralysed and unable to breathe without respiratory support. He was found to have congenital deafness, and his heart, liver and kidneys were affected by the disorder. Doctors felt that Charlie’s prognosis was extremely poor. In early 2017, Charlie’s parents identified an experimental treatment, previously used in a different form of MDDS, which they hoped might benefit Charlie. In mouse models of a myopathic form of MDDS, early supplementation with deoxypryrimidine nucleosides apparently bypasses the genetic defect and leads to a reduction in the biochemical defect and in the severity of the clinical phenotype.25 26 Doctors at GOSH initially planned to use nucleoside treatment in Charlie, but in January he developed evidence of electrical seizures, and clinicians became convinced that treatment, both continued intensive care and the requested …. [David Charles] Aristotle, it appears, sometimes identifies well-being with one activity, sometimes with several, including ethical virtue. I argue that this appearance is misleading. In the Nicomachean Ethics, intellectual contemplation is the central case of human well-being, but is not identical with it. Ethically virtuous activity is included in human well-being because it is an analogue of intellectual contemplation. This structure allows Aristotle to hold that while ethically virtuous activity is valuable in its own right, the best life available for (...) humans is centred around, but not wholly constituted by, intellectual contemplation. /// [Dominic Scott] In Nicomachean Ethics X 7-8, Aristotle distinguishes two kinds of eudaimonia, primary and secondary. The first corresponds to contemplation, the second to activity in accordance with moral virtue and practical reason. My task in this paper is to elucidate this distinction. Like Charles, I interpret it as one between paradigm and derivative cases; unlike him, I explain it in terms of similarity, not analogy. Furthermore, once the underlying nature of the distinction is understood, we can reconcile the claim that paradigm eudaimonia consists just in contemplation with a passage in the first book requiring eudaimonia to involve all intrinsic goods. In _ Psychiatry in the Scientific Image, _Dominic Murphy looks at psychiatry from the viewpoint of analytic philosophy of science, considering three issues: how we should conceive of, classify, and explain mental illness. If someone is said to have a mental illness, what about it is mental? What makes it an illness? How might we explain and classify it? A system of psychiatric classification settles these questions by distinguishing the mental illnesses and showing how they stand in relation to one (...) another. This book explores the philosophical issues raised by the project of explaining and classifying mental illness. Murphy argues that the current literature on mental illness -- exemplified by the Diagnostic and Statistical Manual of Mental Disorders -- is an impediment to research; it lacks a coherent concept of the mental and a satisfactory account of disorder, and yields too much authority to commonsense thought about the mind. He argues that the explanation of mental illness should meet the standards of good explanatory practice in the cognitive neurosciences, and that the classification of mental disorders should group symptoms into conditions based on the causal structure of the normal mind. The topic of vagueness re-emerged in the twentieth century from relative obscurity. It deals with the phenomenon in natural language that manifests itself in apparent semantic indeterminacy - the indeterminacy, for example, that arises when asked to draw the line between the tall and non-tall, or the drunk and the sober. Vagueness, Logic and Ontology explores various responses to the philosophical problems generated by vagueness and its associated paradox - the sorites paradox. Hyde argues that the theoretical space in which (...) vagueness is sometimes ontologically grounded and modelled by a truth-functional logic affords a coherent response to the problems posed by vagueness. In this paper, we explore three separate questions that are relevant to assessing the prudential value of life in infants with severe life-limiting illness. First, what is the value or disvalue of a short life? Is it in the interests of a child to save her life if she will nevertheless die in infancy or very early childhood? Second, how does profound cognitive impairment affect the balance of positives and negatives in a child’s future life? Third, if the life of (...) a child with life-limiting illness is prolonged, how much suffering will she experience and can any of it be alleviated? Is there a risk that negative experiences for such a child will remain despite the provision of palliative care? We argue that both the subjective and objective components of well-being for children could be greatly reduced if they are anticipated to have a short life that is affected by profound cognitive impairment. This does not mean that their overall well-being will be negative, but rather that there may be a higher risk of negative overall well-being if they are expected to experience pain, discomfort, or distress. Furthermore, we point to some of the practical limitations of therapies aimed at relieving suffering, such that there is a risk that suffering will go partially or completely unrelieved. Taken together, these considerations imply that some life-prolonging treatments are not in the best interests of infants with severe life-limiting illness. (shrink)

How should health professionals respond to refusals of treatment or requests for care outside normal guidelines? What are the ethical limits to autonomy? This paper examines the metaphysical status of Ezumezu logic in the direction of logical realism. While presenting Ezumezu logic as a prototype of African logic, Chimakonam makes statements that somewhat entail logical monism. Using the method of critical analysis of related literature, the paper argues that presenting Ezumezu logic as one of the prototypes of African logic while at the same time making claims that elevate it to a hegemonic status, gives rise to what is regarded in the paper as (...) the monist-pluralist paradox. Drawing lessons from Abakedi’s ID paradox, the paper argues that a monist logical foundation for African logic cannot be consistently defended without paradoxes. The paper proposes that different African philosophies should be grounded by different African logics such that one need not be trained in one particular prototype such as Ezumezu logic or argue in conformity to it to qualify as an African professional or scholar. Theatre & the Visual argues that theatre studies' preoccupation with problems arising from textual analysis has compromised a fuller, political consideration of the visual. Johnson examines the spectator's role in the theatre, exploring pleasure, difficulty and spectacle, to consider the implications for visual experience in the theatre.

In their three thoughtful commentaries on my essay, Prentice, Mahoney and Moore and Lantos reflect on the challenges that I set out: can we make sense of the notion of a good death, and can we use art and music to provide any insights into it?1–3 I was thinking about these questions again while reading this week of yet another UK legal dispute relating to life-sustaining treatment for a child. In January, the High Court heard the case of Pippa Knight, (...) a 5-year-old girl with profound brain injury who is in a persistent vegetative state, and has been ventilated in an intensive care unit for a protracted period.4 All of the experts giving evidence in the case agreed that Pippa lacks any ability to feel pain and that there is sadly no prospect of improvement. Her mother (and some of the experts) believed that, given the absence of pain, it would not be harmful and would be in Pippa’s best interests to attempt to transition her to long-term ventilation at home. Photography is probably the first art to have developed alongside and in tandem with systematic thinking about its nature. Photography theory has always been implicated in photographic creativity and appreciation. Methodological skepticism treats the skeptic's argument as a tool by taking it seriously in a rather special way. In this chapter, philosophy has been used to bring out some hidden structures in the thinking that obscure photography's range of powers. A second art of photography, exemplified by some important art made (...) since the 1980s, stands up to the assumption that thoughts cannot be expressed where there is depiction by belief‐independent feature‐tracking. Lyric photography is our third art, which questions whether photography is depiction by belief‐independent feature‐tracking, and which conceives photography as means of fashioning marked surfaces from recording events. Conservation biology has amongst its aims the conservation of the biologically valuable. As a consequence, some underlying theory of value is invoked. Clear challenges to orthodox value theory have been on the table for some time now, with some arguing for recognition of intrinsic values in nature, and some conservation biologists subsequently drawing on such a view. However, this development of value theory has recently been criticised for lacking sufficient clarity and failing to serve the needs of decision-making in conservation (...) biology. These criticisms serve to highlight confusion and difficulties in the development of a coherent and efficacious theory of intrinsic value for application in decision-making. They do not, however, count as sufficient grounds for the rejection of such a theory. Sylvan appears to offer a theory that avoids the criticisms made. The debate here is instructive in clearing away some of the misguided claims frequently encountered in this area and in seeing the value in Sylvan’s “deep green theory”. (shrink)

There is not one but many ways to picture the world--Australian "x-ray" pictures, cubish collages, Amerindian split-style figures, and pictures in two-point perspective each draw attention to different features of what they represent. Understanding Pictures argues that this diversity is the central fact with which a theory of figurative pictures must reckon. Lopes advances the theory that identifying pictures' subjects is akin to recognizing objects whose appearances have changed over time. He develops a schema for categorizing the different ways pictures (...) represent--the different kinds of meaning they have--and argues that that depiction's epistemic value lies in its representational diversity. He also offers a novel account of the phenomenology of pictorial experience, comparing pictures to visual prostheses like mirrors and binoculars. (shrink)

Is it ethical for doctors or courts to prevent patients from making choices that will cause significant harm to themselves in the future? According to an important liberal principle the only justification for infringing the liberty of an individual is to prevent harm to others; harm to the self does not suffice.In this paper, I explore Derek Parfit’s arguments that blur the sharp line between harm to self and others. I analyse cases of treatment refusal by capacitous patients and describe (...) different forms of paternalism arising from a reductionist view of personal identity. I outline an Identity Relative Paternalistic Intervention Principle for determining when we should disallow refusal of treatment where the harm will be accrued by a future self, and consider objections including vagueness and non-identity.Identity relative paternalism does not always justify intervention to prevent harm to future selves. However, there is a stronger ethical case for doing so than is often recognised. (shrink)

Heuser and colleagues' survey of obstetricians provides a valuable insight into the current management of severe fetal anomalies in the United States. Their survey reveals two striking features - that counselling for these anomalies is far from neutral, and that there is significant variability between clinicians in their approach to management. In this commentary I outline the reasons to be concerned about both of these. Directiveness in counselling arguably represents a form of paternalism, and the evident variability in practice is (...) likely the result of physician personal values. However, Heuser's survey may, by shining a light on practice, provide an important step towards a more consistent approach. (shrink)

Certain representations are bound in special ways to our sensory capacities; consider, for instance, pictures, sound recordings, and the various forms of mental sensory imagery. What do these representations have in common, and what makes them different from representations of other kinds? Dominic Gregory employs novel ideas on perceptual states and sensory perspectives to explain the special nature of the contents of distinctively sensory representations.
