Researchers are required to seek consent from Indigenous communities prior to conducting research but there is inadequate information about how Indigenous people understand and become fully engaged with this consent process. Few studies evaluate the preference or understanding of the consent process for research with Indigenous populations. Lack of informed consent can impact on research findings. The Picture Talk Project was initiated with senior Aboriginal leaders of the Fitzroy Valley community situated in the far north of Western Australia. Aboriginal people (...) were interviewed about their understanding and experiences of research and consent processes. Transcripts were analysed using NVivo10 software with an integrated method of inductive and deductive coding and based in grounded theory. Local Aboriginal interpreters validated coding. Major themes were defined and supporting quotes sourced. Interviews with Aboriginal leaders were facilitated by a local Aboriginal Community Navigator who could interpret if necessary and provide cultural guidance. Participants were from all four major local language groups of the Fitzroy Valley; aged 31 years and above; and half were male. Themes emerging from these discussions included Research—finding knowledge; Being respectful of Aboriginal people, Working on country, and Being flexible with time; Working together with good communication; Reciprocity—two-way learning; and Reaching consent. The project revealed how much more there is to be learned about how research with remote Aboriginal communities should be conducted such that it is both culturally respectful and, importantly, meaningful for participants. In this w a y , all human aspirations are co n v er ted - or can be co n v e r ted- into "rights", w hich is the peculiar linguistic manner that modernity o f fers to ind i viduals to talk about their aspirations. Marion titulada, dedicada a la unión de alma y cuerpo, y cuya tesis principal es: los problemas que esta unión suscita confunden dos términos, cuerpo y mi cuerpo. Esta confusión lleva a que se apliquen al primero categorías propias del segundo. Se examinan las "paradojas ónticas" que mi cuerpo (la carne) inaugura (a); se despeja la tesis de dos interpretaciones de las meditaciones primera y sexta (b); se discute la (...) "excepción a la metafísica" instaurada por el conocimiento de mi cuerpo (c); se arriesga, siguiendo una indicación del autor, la apertura a una dimensión ética que exige examinar ya no la unión de cuerpo y alma, sino la unión por el amor a un semejante y a la comunidad de semejantes (d). The article carries out a critical examination of J.-L. Marion's latest work, "Sur la pensée passive de Descartes", whose main thesis is that the problems posed by the union of body and soul confuse two terms: body and my body. This confusion leads to the application to the former of categories inherent to the latter. The paper examines the "ontic paradoxes" that my body (the flesh) gives rise to (a); it clarifies the thesis of two interpretations of the First and Sixth Meditations (b); it discusses the "exception to metaphysics" established by the knowledge of my body (c); and, following an indication by the author, it proposes an opening to the ethical dimension, which demands an examination of the union, through love, with a fellow human being and with the community of human beings, rather than of the union of body and soul (d). Ita La recensione presenta la prospettiva enattivista difesa da Alva Noë, e ne discute alcuni aspetti specifici. Il pensiero, la coscienza e la cognizione non sono pienamente comprensibili, secondo l’enattivismo di Noë, senza un’adeguata considerazione del ruolo ricoperto dal corpo e dall’ambiente. Sarebbe quindi sbagliato continuare a pensare che il cervello da solo sia responsabile dei processi cognitivi umani: il programma che ricerca i correlati neurali della coscienza sarebbe quindi destinato al fallimento dal principio, perché tralascia in partenza corpo e (...) ambiente; i programmi di ricerca nel campo dell’intelligenza artificiale sarebbero ugualmente compromessi, non solo con una concezione computazionalista della cognizione, ma anche con la vecchia idea che un cervello artificiale sia sufficiente alla cognizione quanto un cervello naturale. Di seguito si prendono in esame due prospettive sperimentali su cui Noë fa grande affidamento: gli studi sulla plasticità neurale dei furetti svolti da Mriganka Sur e altri, e la realizzazione di un sistema di sostituzione visuo-tattile da parte di Paul Bach-Y-Rita. Per Noë si tratta di elementi cruciali in supporto alla propria prospettiva: in realtà, come emerge dalla breve analisi, l’attribuire loro un significato così chiaro e univoco pro-enattivismo è qualcosa di molto meno scontato. Infine, segue un breve bilancio del libro di Noë, dove gli elementi d’interesse del volume sono presentati insieme all’individuazione di alcuni punti deboli, che il testo condivide con la gran parte degli studi che in vario modo fanno leva sull’intuizione legata all’embodiement: da un lato una difficoltà strutturale riguarda la possibilità di identificare con chiarezza gli elementi costitutivi del mentale; dall’altro lato, il riferimento a forme di esternalismo radicale sembra ugualmente comportare diversi problemi. -/- Abstract Eng The review presents Alva Noë’s enactivist view, and aims at discussing some of its ideas. Thought, consciousness, and cognition are not understandable, Noë claims, without taking into proper consideration the role played by the body and the environment. It would be wrong indeed to go on thinking that our brain alone is responsible for human cognitive processes: the program searching for the neural correlates of consciousness is hopeless in principle, because it neglects from the beginning the body and the environment; research programs in artificial intelligence are as well compromised, not only with a computationalist view of cognition, but also with the old idea that an artificial brain will suffice for cognition just like a natural one. Thereafter, two experimental perspectives, that Noë uses to support his view, are examined: Mriganka Sur’s studies on neural plasticity of ferrets, and Paul Bach-Y-Rita’s tactile-visual substitution system. Noë argues that these results are crucial in supporting his view, but, as the discussion highlights, their pro-enactivism meaning is not so clear and unambiguous. Finally, a balance of the book follows, where the many elements of interest are presented together with the acknowledgment of some weak points, that the book shares with the majority of the proposals that deal with the embodiment’s insight: on the one hand, a structural difficulty concerns the possibility to identify clearly the constitutive elements of the mental; on the other hand, the reference to radical versions of externalism seems to entail many difficulties as well. Conceptos como naturalismo y cientificismo serán contrastados a la luz de la investigación filosófica, defendiendo un cientificismo crítico que, más que sostener que la ciencia es la única fuente de conocimiento fiable, sostiene que la actividad científica es una excelente creación cultural humana para adquirir conocimiento y que la filosofía que la desprecia o ignora, no es productiva. In its present incarnation, OSCAR is a fully implemented programmable architecture for a rational agent. If we just focus upon the epistemic reasoning in OSCAR, we have a powerful general-purpose defeasible reasoner. The purpose of this paper is to describe that reasoner. OSCAR's defeasible reasoner is based upon seven fundamental ideas. These are (1) an argument-based account of defeasible reasoning, (2) an analysis of defeat-status given a set of interrelated arguments, (3) a general adequacy criterion for automated (...) defeasible reasoners, called “d.e.-adequacy”, (4) the claim that a generalpurpose defeasible reasoner must have the kind of structure I have called “flag-based”, (5) an algorithm for computing defeat-status, (6) an interest-driven monotonic reasoner, and (7) an account of degrees of justification, degrees of interest, and their interactions. According to what Clark and Chalmers [1998] call active externalism, the environment can drive and so partially constitute cognitive processes. (...) Where does the mind stop and the rest of the world begin? If active externalism is right, then the boundary cannot be drawn at the skull. This paper investigates the idea that perception can be, at once, a mode of direct awareness of the world and an encounter, in the first instance, with mere appearances. In developing this point, I introduce a sensorimotor account of perception according to which the senses are ways of exploring the environment mediated by different patterns of sensorimotor contingency (i.e. by the distinctive ways in which what the perceiver does affects how things appear).

Almost more than any other sport, baseball has long attracted the interest of writers and intellectuals. Relatively few of them have been philosophers however. Alva Noe, a celebrated philosopher, here proposes to collect and rework his short articles and blog posts (many of which first appeared on npr.org) on baseball into a cohesive and accessible book that tries to tease out its deeper meanings - and to advance a view of what baseball ultimately is all about. A basic theme will (...) run through the book, which is that fundamentally baseball is concerned with questions of responsibility and liability - i.e. who gets credit or blame for a play. It is starting from this fundamental insight that Noe then ranges over diverse topics like the slowness of baseball and the virtues of boredom, why fans write down box scores, the meaning of the no-hitter, television replays, the aesthetics of ballparks, how we learn to 'see' baseball like we learn to look at art, the ethics of performance enhancing drugs, the nature of fandom, and reflections on rules and umpires. Noe's writing voice is informal and personal, and always puts the details of the sport before the ideas. Ultimately, his essays are part of a larger view of baseball as fundamentally a game about values - and not simply, as some would have it, a numbers game. (shrink)

An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. Many philosophers take mental causation to be required for free will. But it has also been argued that the most popular view of the nature of mental states, i.e. non-reductive physicalism, excludes the existence of mental causation, due to what is known as the ‘exclusion argument’. In this paper, I discuss the difference-making account of mental causation proposed by [List, C., and Menzies, P. 2017. “My Brain Made Me Do It: The Exclusion Argument Against Free Will, and What’s Wrong with (...) It.” In H. Beebee, C. Hitchcock, & H. Price (eds.), Making a Difference: Essays on the Philosophy of Causation. Oxford Scholarship Online: Oxford University Press], who argue that their account not only solves the problem of causal exclusion but also saves free will. More precisely, they argue that it rebuts what they call ‘the Neurosceptical Argument’, the argument that if actions are caused by neural states and processes unavailable to us, there is no free will. I argue that their argument fails for two independent reasons. The first reason is that they fail to show that difference-makers are independent causes. The second reason is that physical realizers of mental states can be individuated in a way that makes both mental states and their realizers difference-makers. (shrink)

Este artigo apresenta um quadro conceitual para examinar a questão do especismo. Começa definindo-o como a consideração ou tratamento desfavorável injustificado daqueles que não pertencem a uma determinada espécie. A seguir, esclarece alguns dos mal-entendidos comuns acerca do que é e do que não é o especismo. Depois disso, argumenta contra a confusão entre (1) os diferentes modos em que se pode defender o especismo; e (2) as diferentes posições que assumem o especismo como uma de suas premissas. Dependendo se (...) essas últimas aceitam ou não outros critérios para a consideração moral à parte do especismo, podem ser posições especistas simples ou combinadas. Mas o especismo segue sendo em todos os casos a mesma ideia. Finalmente, este artigo examina o conceito de antropocentrismo, que define como o tratamento ou consideração desfavorável daqueles que não são membros da espécie humana. O conceito de antropocentrismo difere do de especismo e do de misoteria (animadversão para com os animais não humanos). Não obstante, pode-se concluir que o antropocentrismo é uma forma de especismo, à luz do que indicam, entre outros, o argumento da sobreposição de espécies e o argumento da relevância. (shrink)

OSCAR HORTA | : This paper examines the extent of the opposition between environmentalists and those concerned with wild-animal suffering and considers whether there are any points they may agree on. The paper starts by presenting the reasons to conclude that suffering and premature death prevail over positive well-being in nature. It then explains several ways to intervene in order to aid animals and prevent the harms they suffer, and claims that we should support them. In particular, the paper (...) argues in favour of carrying out more research to learn the best ways to intervene without causing more harm to other animals and to intervene first in areas significantly transformed by human action. It then examines what positions environmentalist views can have towards intervention in nature for the sake of animals. It claims that, while ecocentric and naturocentric views will strongly oppose intervention in certain circumstances, they should not do so in other cases in which the values they promote are not at stake or might be outweighed. The paper then argues that, contrary to what it might seem at first, biocentric views should strongly support intervention. It then discusses whether there may be certain practical issues about which those concerned with wild animal suffering and environmentalists may support the same approach, such as opposition to the greening of desert ecosystems. Finally, it claims that raising awareness about wild animal suffering seems to be the most urgent task now for those concerned about it. | : Le présent article examine l’étendue de l’opposition entre les environnementalistes et ceux qui se préoccupent de la souffrance des animaux sauvages, afin de déterminer s’il existe des points sur lesquels ils peuvent être en accord. L’article débute en présentant les raisons permettant de conclure que la souffrance et la mort prématurée l’emportent sur le bien-être positif dans la nature. Ensuite, il explique plusieurs façons d’intervenir afin d’aider les animaux et de prévenir les maux dont ils souffrent et plaide pour la mise en oeuvre de celles-ci. Plus précisément, l’article préconise un plus grand nombre de recherches afin de déterminer les meilleures façons d’intervenir sans causer davantage de maux à d’autres animaux ainsi que pour prioriser des interventions en des endroits que l’action humaine a significativement transformés. L’article examine par la suite les positions que les conceptions environnementalistes peuvent adopter quant aux interventions dans la nature pour le bien des animaux. L’article propose que, bien que des visions écocentriques et naturocentriques s’opposent vivement à l’intervention dans certaines circonstances, elles ne devraient cependant pas s’y opposer dans les cas où les valeurs qu’elles promeuvent n’entrent pas en jeu ou peuvent avoir moins de poids que d’autres facteurs. L’article soutient ensuite que, contrairement à ce que l’on pourrait penser à première vue, les théories biocentristes devraient fortement appuyer l’intervention. Il pose la question à savoir si certains problèmes pratiques peuvent faire l’objet d’une approche commune parmi les environnementalistes et ceux qui se soucient de la souffrance des animaux sauvages, par exemple s’opposer à l’écologisation des déserts. Enfin, l’article propose que la tâche la plus pressante pour ceux qui se préoccupent de la souffrance des animaux sauvages consiste à accroître la sensibilisation à ce problème. (shrink)

There are many circumstances in which vegans are treated or considered worse than nonvegans, both in the private and the public sphere, either due to the presence of a bias against them or for structural reasons. For instance, vegans sometimes suffer harassment, have issues at their workplace, or find little vegan food available. In many cases they are forced to contribute to, or to participate in, animal exploitation against their will when states render it illegitimate to oppose or refuse to (...) support some uses of animals. For the most part this remains socially invisible. Vegans, however, often recognize this as a form of discrimination against them. But they seldom campaign against it, as they regard it as a consequence of another and more important discrimination, i.e. speciesist discrimination against nonhuman animals. If this is correct, discrimination against vegans can be characterized as a form of second-order discrimination, that is, discrimination against those who oppose another form of discrimination. If speciesism really is unjustified and discriminatory, then discrimination against vegans will always be discriminatory and unjustified too. But even if our current attitudes towards animals were justified there would be strong reasons to claim that vegans do suffer several forms of private and public discrimination that are unjustified. En este trabajo se analizan las claves utópicas e ideológicas que atraviesan la reflexión suareciana en torno al derecho humano. En primer lugar, si bien la unidad e inmutabilidad del derecho natural en Suárez está asegurada por la capacidad que todos los humanos tienen de alcanzar racionalmente sus principios, la medida de esta racionalidad está dada por elementos específicos de la cultura europea, considerando como evidentes preceptos que son sólo creencias naturalizadas de una experiencia histórica particular. En segundo lugar, respecto (...) del derecho civil, aunque es cierto que Suárez acepta la posibilidad de comunidades políticas orientadas al bien común de forma inmanente -es decir, sin necesidad de abrazar el cristianismo-, introduce multitud de elementos que limitan esta posibilidad. En tercer lugar, respecto al derecho de gentes, si bien implica una limitación de la soberanía de todas las comunidades, a causa de la mutua ayuda que requieren para su supervivencia, su forma está dada por las fuerzas imperialistas europeas. El trabajo concluye preguntándose hasta qué punto estas dinámicas no perviven hoy en los Derechos Humanos y el derecho internacional. (shrink)
