Clinical ethics consultation service remains undeveloped in developing countries. It is recognised that its introduction poses challenges. Malaysia, a multicultural society with diverse religions, values and perceptions further complicate the introduction of formal clinical ethics consultation service. Clinicians attending a national congress workshop completed a Strengths–Weaknesses–Opportunities–Threats analysis. The aim was to gain insight into clinician’s expectations and promote initiatives leading to the introduction of clinical ethics consultation service. He argues that it cannot deliver what it promises—and if it could, no one would want what it is selling.”—David Cole, _New York Review of Books__ Originalism, the view that the meaning of a constitutional provision is fixed when it is adopted, was once the fringe theory of a few extremely conservative legal scholars but is now (...) a well-accepted mode of constitutional interpretation. Three of the Supreme Court’s nine justices explicitly embrace the originalist approach, as do increasing numbers of judges in the lower courts. Noted legal scholar Erwin Chemerinsky gives a comprehensive analysis of the problems that make originalism unworkable as a method of constitutional interpretation. He argues that the framers themselves never intended constitutional interpretation to be inflexible and shows how it is often impossible to know what the “original intent” of any particular provision was. Perhaps worst of all, though its supporters tout it as a politically neutral and objective method, originalist interpretation tends to disappear when its results fail to conform to modern conservative ideology. The European Union is working towards harmonizing legislation across Europe, in order to improve cross-border interchange of legal information. This goal is supported for instance via standards such as the European Law Identifier and the European Case Law Identifier, which provide technical specifications for Web identifiers and suggestions for vocabularies to be used to describe metadata pertaining to legal documents in a machine readable format. Notably, these ECLI and ELI metadata standards adhere to the RDF data format which forms the (...) basis of Linked Data, and therefore have the potential to form a basis for a pan-European legal Knowledge Graph. Unfortunately, to date said specifications have only been partially adopted by EU member states. In this paper we describe a methodology to transform the existing legal information system used in Austria to such a legal knowledge graph covering different steps from modeling national specific aspects, to population, and finally the integration of legal data from other countries through linked data. We demonstrate the usefulness of this approach by exemplifying practical use cases from legal information search, which are not possible in an automated fashion so far. (shrink)

Parmenides advances four arguments against becoming. Two of these are sound. Plato's and Aristotle's attempt to refute them fail. They react to Parmenides' challenge by differentiating and grading being and existence. Thus they deviate from Parmenides' strict concept of existence which is the only reasonable one. What's wrong with Parmenides' train of thought is a decisive premise: that becoming is a transition from non-existence to existence. The reality of becoming can be maintained if this premise is given up. One has (...) to see that becoming is a purely temporal affair not involving existence and that existence is timeless. The aim of this article is to free Aristotle's Metaphysics, especially book XII (Lambda), frome some metaphysical and theological presuppositions by detecting their inappropriate conceptual framwork, which once was progressive, but now holds an obsolete position. Ousia, being (not substance, a much later concept, construed to solve other problems than Aristotle's), stand for a question, not for an answer. Book Lambda develops a highly speculative argument for this queston. The famous noesis noeseos says that empirical being and knowledge is the (...) realization of a noetic structure (noesis), laid down in our most fundamental opinioons about being. (shrink)

Background Care-dependency constitutes an important issue with regard to the approval of end-of-life decisions, yet attitudes towards assisted suicide and euthanasia are understudied among care-dependent older adults. We assessed attitudes towards assisted suicide and euthanasia and tested empirical correlates, including socio-demographics, religiosity, physical illness, psychological distress and social isolation. Methods A nationwide cross-sectional survey among older care allowance recipients in private households in Austria was conducted in 2016. In computer-assisted personal interviews, 493 respondents were asked whether or not they approved (...) of the availability of assisted suicide and euthanasia in case of long-term care dependency and whether or not they would consider using assisted suicide or euthanasia for themselves. Multiple logistic regression analysis was used to assess the impact of potential determinants of attitudes towards assisted suicide and euthanasia. Results About a quarter of the sampled care-dependent older adults approved of the availability of assisted suicide and euthanasia respectively indicated the will to make use of assisted suicide or euthanasia. Attitudes towards assisted suicide were most favourable among care-dependent older adults living in urban areas, those who did not trust physicians, those who reported active suicide ideation, and individuals with a strong fear of dying. With regard to euthanasia, living alone, religiosity and fear of dying were the central determinants of acceptance. Conclusions Positive attitudes towards and will to use assisted suicide and euthanasia were expressed by a substantial minority of care-dependent older adults in Austria and are driven by current psychological suffering and fear of the process of dying in the future. Community-based psychosocial care should be expanded to address psychological distress and fears about end-of-life issues among care-dependent older adults. (shrink)

This volume offers a comparative analysis of the challenges facing center-left parties in the United States, United Kingdom, France, Germany, the European Union, Poland, and Russia. Among the questions addressed are: -If the traditional social bases of left parties are now too limited for winning in majoritarian politics, what kind of coalitions and ideas, which reach beyond those bases and yet retain them, may be effective? - If the answer to the first question is that such umbrella coalitions are too (...) torn to be workable, what is the alternative? What is gained and lost in moves toward the center or further to the left? - Is coalition politics sufficient for governance in terms of both policy and the long-term political health of a party, or must there be a central, guiding set of ideas around which coalitions are formed? - What are the inherent weaknesses of market-oriented parties against which democratic center-left parties might appeal and win? - To what extent do national histories and political cultures both provide resources for, and set constraints and limits on, what parties may creatively do with political appeals and policies? The center of political gravity differs in these countries, with the United States and United Kingdom to the right and France and Germany to the left. Neither Poland nor Russia has been able to develop a party of this kind with any political strength. These essays explore how center-left parties, positioned as they are in the electoral spectrum, cope with the challenge of establishing an ideology to distinguish themselves from center-right parties and, while remaining both moderate and progressive, or even radical, try also to capture the center of politics. Scholars have cited the influence of Lucretius on Machiavelli as important to framing Machiavelli’s position on the freedom of political agents. Some scholars like Roecklin and Rahe argue that Machiavelli was a determinist based on Machiavelli’s rejection of the clinamen; others argue with Brown and Morfino that Machiavelli’s affirmation of Lucretian natural principles left room for the freedom of agents. However, this paper takes a different approach by arguing that Machiavelli successfully resists identification with either of these positions. I argue (...) here that Machiavelli affirms a notion of agency that reflects the influence of the Lucretian notion of mixed bodies where human actions emerge from an irreducible multiplicity of subjective and objective factors. I also argue that Machiavelli structures the narratives describing the actions of his agents in a way that supports interpreting their actions as both contingent and necessary. (shrink)

A Nobel prize winner, a great man and a great scientist, Erwin Schrödinger has made his mark in physics, but his eye scans a far wider horizon: here are two stimulating and discursive essays which summarize his philosophical views on the nature of the world. Schrödinger's world view, derived from the Indian writings of the Vedanta, is that there is only a single consciousness of which we are all different aspects. He admits that this view is mystical and metaphysical (...) and incapable of logical deduction. But he also insists that this is true of the belief in an external world capable of influencing the mind and of being influenced by it. ABSTRACT An ontological analysis of time and of serial order is offered within the framework of a comprehensive ontology wherein the category of facts plays a crucial role. It is applied to distinguish them while various ways and contexts in which both have been mixed up in past and in present philosophy are discussed. The good reasons for that mix-up and the astonishing difficulty of keeping them apart are considered. The focus is more on the ontology of order than on (...) the ontology of time. The latter is too wide a subject. It turns out that order has not really been grounded even in set theory. The ontology of serial order expounded is new. It is also needed for the adequate ontological analysis of relational facts. (shrink)

This belief in the survival of the soul already existed in the earliest Greek writings, but when and from where did it originate? In Volume 1 Rohde examines (...) belief in the soul as it appears in Homeric poetry and within local cults, and finds that the idea of an afterlife is already represented in different forms in the works of Hesiod and Aeschylus. He also discusses burial rites and the Eleusinian Mysteries. Psyche, reissued here in the 1898 edition, remains a standard reference work on this topic. (shrink)
