The Ethics of Dust: Doge's Palace, Venice, is an installation resulting from the experimental preservation of the pollution accumulated on the Doge's Palace of Venice. Traditionally, only the intentional products of human labor, such as art or architecture, have been considered part of our cultural heritage. Pollution is a formless byproduct that was never intentionally shaped; yet it is perhaps our civilization's most significant cultural product. With regard to current debates on the ethical implementation of AI, especially two demands are linked: the call for explainability and for ultimate human responsibility. In the medical field, both are condensed into the role of one person: It is the physician to whom AI output should be explainable and who should thus bear ultimate responsibility for diagnostic or treatment decisions that are based on such AI output. In this article, we argue that a black box AI indeed creates a (...) rationally irresolvable epistemic situation for the physician involved. Specifically, strange errors that are occasionally made by AI sometimes detach its output from human reasoning. Within this article it is further argued that such an epistemic situation is problematic in the context of ultimate human responsibility. Since said strange errors limit the promises of explainability and the concept of explainability frequently appears irrelevant or insignificant when applied to a diverse set of medical applications, we deem it worthwhile to reconsider the call for ultimate human responsibility. Can the evidence provided by software systems meet the standard of proof for civil or criminal cases, and is it individualized evidence? Or, to the contrary, do software systems exclusively provide bare statistical evidence? In this paper, we argue that there are cases in which evidence in the form of probabilities computed by software systems is not bare statistical evidence, and is thus able to meet the standard of proof. First, based on the case of State v. Loomis, we investigate (...) recidivism predictions provided by software systems used in the courtroom. Here, we raise problems for software systems that provide predictions that are based on bare statistical evidence. Second, by examining the case of People v. Chubbs, we argue that the statistical evidence provided by software systems in cold hit DNA cases may in some cases suffice for individualized evidence, on a view on which individualized evidence is evidence that normically supports the relevant proposition (Smith, in Mind 127:1193–1218, 2018). (...) They appear in your mind when you walk by the hospital room they occupied or when someone mentions their name. There is [End Page 19] something about the narrative of their life and illness that makes you hold on to them. Lily is one such patient for me.Lily was a 45-year-old paraplegic woman who was well known to many providers in the hospital. She had a complex trauma history (childhood physical and sexual abuse, intimate partner violence, domestic violence), homelessness, and multiple psychiatric admissions. In addition, she had a complex medical history, including chronic pain issues and substance use disorder. Many providers considered her to be a "very difficult" or "challenging" patient because she would "dictate" her care, had low distress tolerance and would have explosive angry outbursts requiring frequent visits from Police and Security. To top it off, after months of a challenging stay on a unit, she would eventually leave against medical advice. Everyone involved in her care felt that discharge to a safe setting such as a skilled nursing facility would be her best option. Yet, she was a very "hard" sell to any facility because of her behavioral issues, relatively young age, extensive history of drug use, and medication non-compliance. Even though the unit I worked in was familiar with "difficult" patients like Lily, the floor staff was anxious and concerned about the effect Lily would have on patients, staff, and providers. The combined anticipatory anxiety worsened after we were told that Lily left against medical advice three days before her admission to our unit as a reaction to the staff's attempt to develop a behavioral plan.I remember the day I met Lily. I was working as the clinical social worker on the floor, helping patients with adjustment to coping with hospitalization, addressing mental health issues that usually exacerbate in the acute care setting, and providing support to the staff caring for a psychosocially complex patient population. It was the second day after Lily arrived on the floor, and Police and Security had already come up three times. As I walked out of another patient's room, a bedside nurse stopped me in the hallway. "Can you please talk to her? … Please, just talk to her, or sit with her. I just need a break. I have been in that room since I started my shift. I am exhausted." The nurse had an exasperated and pleading look, and even though I was rushing to a meeting, I decided to meet with Lily instead. When I walked into her room, I saw a thin, small-framed woman with brown hair pulled back into a tight bun. She had freckles peppered all over her round face, neck, and chest. Her features were delicate and small, and her almond-shaped green eyes were her most prominent feature. She was wearing a white tee and jeans. She was sitting in her wheelchair; her makeup bag was lying on the table next to her. I introduced myself and my role on the team, trying not to stumble under a very heavy glare. "Tell them to leave me alone. That nurse is always in my room. Spying. I might not be able to walk, but I can still use my hands. I can call if I need help."And so I did. And when I came back, Lily and I talked a little about her life. And the next day, we talked a little more. And then again. This article joins in and extends the contemporary debate on the right to privacy. We bring together two strands of the contemporary discourse on privacy. While we endorse the prevailing claim that norms of informational privacy protect the autonomy of individual subjects, we supplement it with an argument demonstrating that privacy is an integral element of the dynamics of all social relationships. This latter claim is developed in terms of the social role theory and substantiated by an analysis of the (...) role of privacy in intimate relationships, in professional relationships and in social interactions between strangers in public. We conclude by arguing that it is not always reasonable to assume a conflict between individual privacy on the one hand and society on the other. Legislators and participants in public debate also have to take into account the consequences of limiting privacy on social interaction and the integration of the society. (shrink)

An erotetic calculus for a given logic constitutes a sequent-style proof-theoretical formalization of the logic grounded in Inferential Erotetic Logic ). In this paper, a new erotetic calculus for Classical Propositional Logic ), dual with respect to the existing ones, is given. We modify the calculus to obtain complete proof systems for the propositional part of paraconsistent logic CLuN and its extensions CLuNs and mbC. The method is based on dual resolution. Moreover, the resolution rule is non-clausal. According to the (...) authors knowledge, this is the first account of resolution for mbC. Last but not least, as the method is grounded in IEL, it constitutes an important tool for the so-called question-processing. (shrink)

This article examines how corporate social responsibility (CSR) can serve as an external source of rents for governments that depend on foreign financing for state-building and development. The strategic, instrumental use of CSR has been overlooked in previous research on governments and CSR, especially in the Global South. To understand how CSR can serve as a lever for rents, the concept of “extraversion” is introduced to describe the way in which rent-seeking African governments instrumentalize their asymmetric external relations for political (...) and private benefit. The connection between CSR and rent-seeking is analyzed through a case study of large gas investments in Tanzania. The article finds that the government has set up regulation that enables local and central government authorities to appropriate, mediate, reclaim, or possibly trick CSR practices to gain rents. Based on the study, two contributions are made to the literature on CSR and governments. First, the instrumental use of CSR in the Global South is added to the variety of perspectives that can be taken when studying government agency. Second, CSR is conceptualized as a potential stream of rents for governments to exploit. The article ends with discussing that the outcome of CSR in a rent-seeking environment depends on whether the leveraged resources are managed well to support peaceful and locally beneficial economic development or whether they serve private accumulation through corruption. The goal of this paper is to propose correspondence analysis as a technique for generating the so-called erotetic calculi which constitute the method of Socratic proofs by Andrzej Wiśniewski. As we explain in the paper, in order to successfully design an erotetic calculus one needs invertible sequent-calculus-style rules. For this reason, the proposed correspondence analysis resulting in invertible rules can constitute a new foundation for the method of Socratic proofs. Correspondence analysis is Kooi and Tamminga's technique for designing proof systems. (...) BackgroundResearch using data from medical care promises to advance medical science and improve healthcare. Academia is not the only sector that expects such research to be of great benefit. The research-based health industry is also interested in so-called ‘real-world’ health data to develop new drugs, medical technologies or data-based health applications. While access to medical data is handled very differently in different countries, and some empirical data suggest people are uncomfortable with the idea of companies accessing health information, this paper (...) aims to advance the ethical debate about secondary use of medical data generated in the public healthcare sector by for-profit companies for medical research (ReuseForPro).MethodsWe first clarify some basic concepts and our ethical-normative approach, then discuss and ethically evaluate potential claims and interests of relevant stakeholders: patients as data subjects in the public healthcare system, for-profit companies, the public, and physicians and their healthcare institutions. Finally, we address the tensions between legitimate claims of different stakeholders in order to suggest conditions that might ensure ethically sound ReuseForPro.ResultsWe conclude that there are good reasons to grant for-profit companies access to medical data if they meet certain conditions: among others they need to respect patients’ informational rights and their actions need to be compatible with the public’s interest in health benefit from ReuseForPro. The Hungarian Nominal Functional Sequence combines the methods of syntactic cartography with evidence from compositional semantics in a comprehensive exploration of the structure of Noun Phrases. Proceeding from the lexical core to the top of DP, it uses Hungarian as a window on the underlying universal functional hierarchy of Noun Phrases, but it also regularly complements and supports the analysis with cross-linguistic evidence. The book works out a minimal map of the extended NP in the sense that the proposed hierarchy (...) only has projections which host overt material and it does not draw on semantically empty word order projections. Topics which receive special attention include the syntax of classifiers, demonstratives, proper names, possessive NPs and plural pronouns. (shrink)

One will not be able to categorize and understand Gödel’s philosophical notebooks unless one considers them in the context of the tradition of notebook writing. This tradition produced a type of text with specific characteristics. For an appropriate reading of the notes, one should keep in mind those characteristics as well as the function of notebooks for an author’s thinking and for their creative process. This helps to avoid misinterpretations as well as rash (mis)judgments and (mis)readings.

In our target article, “Learning and the evolution of conscious agents” we outlined an evolutionary approach to consciousness, arguing that the evolution of a form of open-ended, representational, and generative learning (unlimited associative learning, UAL) drove the evolution of consciousness. Our view highlights the dynamics and functions of consciousness, delineates its taxonomic distribution and suggests a framework for exploring its developmental and evolutionary modifications. The approach we offer resonates with biosemioticians’ views, but as the responses to our target article show, (...) our proposal also faces challenges and has led to suggestions that extend, develop and qualify it. Our response to the 14 varied and rich commentaries starts with the recurring and deep question raised by many of them – the relation between life and sentience. We explore this question by introducing and expanding on “vivaciousness”, a term we coined to describe the turbulent, flexible exploration-stabilization processes inherent in the living condition, as well as addressing the related concepts of Umwelt and selfhood. We then consider the question of the adequacy of unlimited associative learning (UAL) as an evolutionary transition marker (ETM) of minimal consciousness (rather than as a marker of a complex form of sentience), and the possible precursors of sentience. The engagement with these broad themes is entangled with a discussion of evolutionary transitions, constitutive emergence and the function/s of consciousness. The suggestions of our commentators, urging us to explore new concepts and new avenues of research within the framework of a richer view of evolution are then discussed. We end by briefly considering what we regard as a conceptual lacuna, which is leading to the indiscriminate use of the term “sentience” and which awaits further investigation. (shrink)

The concept of cooperative question-responses as an extension of cooperative behaviours used by interfaces for databases and information systems is proposed. A procedure to generate question-responses based on question dependency and erotetic search scenarios is presented. The procedure is implemented in Prolog.

Bodies in China uses Chinese philosophy to reframe Western scholarship on gender, body, and aesthetics. Does Confucianism rule out the capacity of women as moral subjects and hence as aesthetic subjects? Do forms of Chinese philosophy contribute or correspond to patriarchal Confucian culture? Can Chinese philosophy provide alternative perspectives for Western feminist scholars? The first section considers theoretical and philosophical discussions of Western traditions and how the ideas offered by Confucians and Daoists can provide alternative body ontologies for critical feminist (...) practices. The second section reviews female aesthetical representations ranging from The Book of Songs to the work of the controversial body artist He Chengyao. The third section traces changing perceptions of femininity from imperial to its current cosmopolitan era using a range of case studies including Ming dynasty literature, Hong Kong women's fashion in the 1960s, and the 2008 Summer Olympics in Beijing. Overall, this book discusses new conceptual models that feminist scholars are using to displace dualism and emancipate notions of the body from Cartesian models and metaphors. (shrink)

Die Entscheidung für oder gegen lebensverlängernde Behandlungsmaßnahmen geht inzwischen der Hälfte aller Todesfälle in Europa voraus. Sie wird im klinischen Alltag häufig als ethische Herausforderung wahrgenommen, zudem sind unter Klinikern juristische Unsicherheiten und Fragen der korrekten Vorgehensweise verbreitet. Die hier vorgestellte Münchner Leitlinie zu Entscheidungen am Lebensende soll rechtliche Unsicherheit reduzieren, Klinikumsmitarbeiter für die ethische Dimension von Therapieentscheidungen am Lebensende sensibilisieren und ethisch begründete Entscheidungen fördern. Aus organisationsethischer Perspektive soll mit der Leitlinie eine Reflexion und Meinungsbildung zu einem ethisch relevanten (...) Themenbereich erfolgen und ein Beitrag zur Qualitätssicherung der Patientenversorgung und damit auch zur Patientenzufriedenheit geleistet werden. Die Prozesse der Leitlinienentwicklung, -aktualisierung und -implementierung werden vorgestellt. Die wesentlichen inhaltlichen Elemente der Leitlinie mit Darstellung der Rechtslage, der Definition zentraler Begriffe und Klärung medizinischer Entscheidungskriterien werden an Hand eines Entscheidungsalgorithmus dargestellt. Inhalt und Prozess der Leitlinienentwicklung werden auf die folgenden organisationsethischen Qualitätskriterien hin überprüft: deliberativer Prozess, inhaltliche Transparenz, repräsentative Zusammensetzung der Arbeitsgruppe, Implementierung und Evaluation der Leitlinie. Institutionen, die diese Leitlinie übernehmen wollen, sollten diese von einem autorisierten Gremium überprüfen lassen und auf die spezifischen Bedürfnisse ihrer Institution adaptieren. Hierfür ist eine vorgeschaltete Bedarfserhebung hilfreich. In dem Gremium sollten all diejenigen vertreten sein, die in der Folge mit der Leitlinie arbeiten werden. (shrink)

The paper discusses the normative grounds for recognizing a watchdog role to the news media as concerns the dissemination of information about an institutional failure menacing a well-ordered society. This is, for example, the case of the news media’s role in the diffusion of whistleblowers’ disclosures. We argue that many popular justifications for the watchdog role of the news media (as a ‘fourth estate’; a trustee of the people’s right to know; expert communicator) fail to ground that role in some (...) unique feature that makes the news media special as concerns the performance of the role. We offer an alternative argument that shows how the watchdog role of the news media shares a justificatory ground with the role that any member of a well-ordered society has in terms of a general duty of answerability in the face of institutional failures. Although this duty does not bear only on the news media, we concede that in some contingent circumstances the news media might be better positioned to discharge it and, therefore, to initiate corrective actions of institutional failures effectively and conscientiously. However, the establishment of the news media’s responsibility in this sense is an empirical, not a conceptual or a normative matter. (shrink)

Die Ausführungen zum Begriff der Liebe in Hegels Ästhetik lassen sich als Spuren der Auseinandersetzung Hegels mit der Vereinigungsphilosophie lesen. Nach der These dieses Aufsatzes enthält die Ästhetik diese Spuren also noch, obgleich Hegels Abschied von der Vereinigungsphilosophie längst vollzogen war, als die Vorlesungen zur Ästhetik entstanden sind. Die Begriffe Philosophie der Vereinigung und Vereinigungsphilosophie bezeichnen Positionen in der Philosophie des 18. Jahrhunderts, die sich mit der Selbstwerdung des Subjekts oder des Bewußtseins befassen und mit der für die Selbstwerdung erforderlichen (...) Hingabe an ein Äußeres, Anderes. Infolge der Hingabe an ein Äußeres, Anderes werden dem Selbst die Grenzen und der Grund seines Selbst bewußt. Das Selbst benötigt demnach das Andere, um zu sich selbst zu kommen. Die Hingabe an das Endliche außer uns, die erforderlich ist, um in Abgrenzung zum Anderen zu einem Selbst zu werden, wird als Liebe im Sinne des Eros bestimmt. Diese Liebe ist der Antrieb, die Vereinigung mit dem Erstrebten zu suchen und die Erkenntnis des Wahren zu fin Für die Selbstwerdung oder Selbsterkenntnis werden dabei, je nach philosophischer Konzeption, unterschiedliche Bereiche als Ort der Vereinigung angenommen: Der Bereich der Religion, der auf die Erkenntnis Gottes und der Seele abhebt, die nur in der Wiedervereinigung der Seele mit Gott im Jenseits zu erlangen ist. Oder der Bereich des Schönen, der für Hölderlins Philosophie der Vereinigung zentral ist. Die allen Formen der Vereinigungsphilosophie zugrundeliegende Frage ist die nach dem Verhältnis zwischen dem Selbst (oder der Seele) und dem Begehrten, das zur Selbstwerdung gebraucht wird. Das Projekt der Selbstwerdung stellt aber nicht nur das erklärte Anliegen der Vereinigungsphilosophie dar, sondern auch das der romantischen Kunst, die, so Hegel, zur reinen unendlichen Identität mit sich selbst führt und nur noch einen Gott, einen Geist, eine absolute Selbstständigkeit kennt. Es ist für diese Periode nach Hegel geradezu die Aufgabe der Kunst, den Prozeß hin zur Subjektivität darzustellen. (shrink)

>Anger shame< are exemplary emotions in the ancient reflections concerning the relation between emotions, the good and the just as well as the relation between emotions and reason. It is shown that these emotions have a regulative function for the community in the ancient world. But they have also quite an important function for becoming an autonomous self and even for the change in character of a self. It is then shown in interpreting the notions of anger and shame in (...) Augustine's writings in how far this changes for late antiquity. Emotions have still a function in relation to the just but only a marginal one to the good, and none for the developing of a self or for reasonable actions. They also do regain a cognitive function in the Middle Ages as is shown in an exemplary way in Thomas Aquinas' writings on emotions, the function they had in relation to the just is of no great importance anymore. It is then interesting to see that also a theory of emotions, as Thomas Aquinas developed is a theory that might be compared with modern theories of emotions, one has to look back to the ancient reflections on shame and the good in order to understand more fully what an author like Imre Kertész being a survivor of German concentration camps writes on shame and the good in his novels. In this article, we analyse the global consensus on the UN’s partnership approach to businesses through an agonistic lens. In doing so, we seek to understand the positioning of states, particularly those in the Global South, towards the partnership approach. We draw on Mouffe’s conceptualisation of ‘the political’, in which the appearance of consensus is always an expression of hegemony accompanied by exclusion and dissensus. First, we show that the partnership approach was initially promoted by the Global North, in particular (...) European states together with UN leadership, against fears and criticism raised by Global South states. Second, we show that Global South states have not fundamentally challenged the idea of engaging in partnerships with businesses, but they have questioned how these partnerships should be designed to shape a more equally beneficial global economy. With this article, we contribute to the literature on the UN and business ethics by identifying how the evolution of the consensus on business partnerships has been a hegemonic arrangement since the 2000s. Furthermore, we illustrate the role that states have had in forming this consensus. We also contribute to business ethics studies engaging with dissensus by problematising the potential of ‘agonistic deliberation’ at the UN level in supporting the interests of the Global South. Hobbes’s theory of authorisation poses numerous puzzles to scholars. The weightiest of these conundrums is a supposed contradiction between chapter 17 of Leviathan, that calls for unconditional submission to the sovereign, and chapter 21, that defends the liberties of the subject. This article offers a fresh perspective on the theory’s consistency, function and addressees. While existing research doubts the theory’s consistency, focuses on its immunisation function and on the subjects as the theory’s main addresses, the paper argues that Hobbes’s theory (...) of authorisation is consistent with the doctrine of the liberty of subjects, and that it serves the dual purpose of immunising the sovereign against criticism and disciplining the sovereign via a counsel of memento mori: A hitherto underexplored element of authorisation theory is a reminder of the mortality of sovereignty directed at the sovereign to convince him to make restricted use of his absolute right to rule. Hobbes’s theory of authorisation can thus be read as part of a complex argumentative strategy for peace, rooted in a ‘liberal absolutism’ which is not as paradoxical as it sounds, and which is reflected in the frontispiece by the friendly smile of the sovereign. Jean Vanier is the founder of two major international community-based organizations for people with intellectual disabilities: the L’Arche Communities and the “Faith & Light” movement. He is a great Catholic and a teacher of merciful love. His life is a message to the world that each person is an infinite value for who they are, not for what they can do, and that each person is unique and sacred, no matter of their health condition, disability or fragility. Each person is (...) created in God’s image and each one has an inner beauty, a capacity to love and to be loved, and possesses inherent qualities of belonging, bonding, friendship and spirituality. Persons with intellectual disabilities are a gift for the society. Thanks to the testimony of his life, Jean Vanier has developed the international network of L’Arche Communities all over the world. The communities are based on family-like residential communities, where people with and without intellectual disabilities share life together in the spirit of faith, dignity of every human being, understanding, love and joy. The L’Arche homes and communities are rooted in the ideas of “living with,” and not just “doing for” those with mental disabilities. Weakness carries a secret power within, it can open up the hearts to God’s grace. Our contemporary world strongly needs the weak, as they evangelize us, transform us and help us to be more human. They help us discover that the good news of Jesus is announced not to those who serve the poor, but to those who are themselves poor and need God’s merciful love and forgiveness. (shrink)

Log-linear analysis is a practical tool for examining relationships, successfully applied in many fields of science. This paper discusses the topic of estimation of the chance of getting pregnant in couples that underwent ART insemination. The authors focus on finding significant interactions between variables, on the basis of which statistical models are built. With the use of results of log-linear analysis, a model predicting the chances of achieving a clinical pregnancy that contained interactions was successfully built. Construido a modo de una arquitectura viviente de ciencias, el rey sabio aparece dominando la paleta de saberes, que va desde la episteme hasta los conocimientos más prácticos. Teoría y práctica se encuentran, así, en la base de su construcción de lo político. Pero ¿en qué medida la autora se consagra a brindar una explicación del pasaje (...) de las ciencias, sobre todo, aquel que va de las especulativas al registro práctico de la ciencia política? Si el rey se distingue por ser un sabio al tiempo que un experto en las diversas ciencias, cabe preguntarse si acaso la autora teoriza sobre dicho pasaje de lo teórico a lo práctico que constituye la esencia de su pensamiento. ¿Cuál es el canal para volcar la episteme al servicio del Estado? Al respecto, sostengo la hipótesis de que tanto la prudencia como el entendimiento o intelecto parecen ser los dos componentes de la sabiduría perfecta que la escritora aúna en una perfecta díada; operación, esta, que le permite explicar el pasaje de todas las ciencias al plano de lo contingente. ¿Acaso no es, gracias a esta operación, que el rey sabio de Christine de Pizan aparece como el intelecto supremo de la comunidad política, encarnada en el reino de Francia? ¿No son las ciencias, de este modo, redituables en servicio del Estado? W artykule omówiony został stosunek Reymonta do Łodzi, wobec której przejawiał pisarz zrazu ambiwalentne emocje. Krótkotrwała fascynacja żywiołem spektakularnego rozrostu miasta przerodziła się rychło w jawną niechęć wyeksponowaną w intymistyce oraz dziełach artystycznych. Poprzez gruntowną analizę łodzian Reymonta: _Ziemi obiecanej_ i późniejszych nowel oraz notatek diariuszowych i korespondencji wydobywa się symptomy wskazujące na odrazę pisarza wobec przestrzeni zurbanizowanych i industrialnych i próbuje się wykazać, że stosunek ten wynikał prawdopodobnie z usposobienia Reymonta i przywiązania do natury. Pierwsze spotkanie z Łodzią kojarzące (...) się Reymontowi z porażką edukacyjną oraz późniejsze, z tajemnymi schadzkami z kochanką, nie pozostawiły w nim dobrych wspomnień. Wzmocnił je antyestetyzm miasta i stosunki społeczne panujące w Łodzi, w której Reymont mieszkał z przerwami w roku 1896, przygotowując się do pisania _Ziemi obiecanej_. W powieści oddał Łódź jako „złe miasto”, oznakowane figurami labiryntu, otchłani, piekła, a fabryki ukazał jako potwory czyhające na człowieka. Uznawszy Łódź jako miejsce nieprzychylne człowiekowi, siedlisko demoralizacji i degrengolady, kontynuował Reymont krytykę tej przestrzeni w innych utworach, eskalując negatywne emocje (_Pewnego dnia, Cmentarzysko_).
