This paper has two main goals. The first is to defend a particular account of answerability according to which a person is (morally or criminally) answerable for their conduct if it is (morally or criminally) wrongful under the same description under which it is imputable to their agency. Negating defences in law aim to defeat criminal answerability by negating some element of the charged offence while their moral analogues aim to defeat moral answerability by defeating the aptness of the description (...) under which an action is imputed. In contrast, affirmative defences and their moral analogues aim to defeat the move from answerability to liability to sanction by offering an exculpatory explanation for the wrongful conduct. The second goal of this paper is to argue that there are important differences between the way that ignorance functions in negating defences and their moral analogues and affirmative defences and their moral analogues. Specifically, when ignorance functions to defeat answerability, it need only be sincere, but it is typically limited to matters of fact, whereas both moral and non-moral ignorance can excuse one from liability but only if non-culpable. The world contains objective causal relations and universals, both of which are intimately connected. If these claims are true, they must have far-reaching consequences, breathing new life into the theory of empirical knowledge and reinforcing epistemological realism. Without causes and universals, Professor Fales argues, realism is defeated, and idealism or scepticism wins. Fales begins with a detailed analysis of David Hume's argument that we have no direct experience of necessary connections between events, concluding that Hume was mistaken on this fundamental (...) point. Then, adopting the view of Armstrong and others that causation is grounded in a second-order relation between universals, he explores a range of topics for which the resulting analysis of causation has systematic implications. In particular, causal identity conditions for physical universals are proposed, which generate a new argument for Platonism. The nature of space and time is discussed, with arguments against backward causation and for the view that space and time can exist independently of matter or causal process. Many of Professor Fales's conclusions seem to run counter to received opinion among contemporary empiricists. Yet his method is classically empiricist in spirit, and a chief motive for these metaphysical explorations is epistemological. The final chapters investigate the perennial question of whether an empiricist, internalist and foundational epistemology can support scientific realism. (shrink)

According to the two-systems account of mindreading, our mature perspective-taking abilities are subserved by two distinct mindreading systems: a fast but inflexible, “implicit” system, and a flexible but slow “explicit” one. However, the currently available evidence on adult perspective-taking does not support this account. Specifically, both Level-1 and Level-2 perspective-taking show a combination of efficiency and flexibility that is deeply inconsistent with the two-systems architecture. This inconsistency also turns out to have serious consequences for the two-systems framework as a whole, (...) both as an account of our mature mindreading abilities and of the development of those abilities. What emerges from this critique is a conception of context-sensitive, spontaneous mindreading that may provide insight into how mindreading functions in complex social environments. This in turn offers a bulwark against skepticism about the role of mindreading in everyday social cognition. (shrink)

Kant’s late essay ‘The End of All Things’ (1794) establishes a distinctly modern field of inquiry that has fittingly been called ‘philosophical eschatology’ by asking, ‘why do human beings expect an end of the world at all?’ (AA 8:330) Interpretation of the essay’s purpose and argument have usually taken one of two routes: Kant is either understood as writing an esoteric political critique under the guise of the philosophy of religion, or as being focused largely on problems related to the (...) immortality of the soul as a postulate of pure practical reason. In contrast, I argue that the essay presents the end of all things as a cosmological idea of reason. In this essay I trace Kant’s idea of an end as its preconditions are established through the three Critiques, and finally made explicit in his late work. (shrink)

Kantian constructivists locate the source of normativity in the rational nature of valuing agents. Some further argue that accepting this premise thereby commits one to accepting the intrinsic or unconditioned value of rational nature itself. Whereas much of the critical literature on this “regress on conditions” argument has focused either on the cogency of the inference from the value-conferring capacity of the will to the unconditional value of that capacity itself or on the plausibility of the initial constructivist premise, my (...) aim is to press the argument from a different direction by asking just how Kantian the constructivist needs to be in order to support a regress on conditions argument. Specifically, I maintain that the argument succeeds only given a full-fledged Kantian moral psychology, including a presupposition of transcendental freedom. If correct, this could have implications regarding the compatibility of Kantian ethics and philosophic naturalism. (shrink)

The science of genetics is undergoing a paradigm shift. Recent discoveries, including the activity of retrotransposons, the extent of copy number variations, somatic and chromosomal mosaicism, and the nature of the epigenome as a regulator of DNA expressivity, are challenging a series of dogmas concerning the nature of the genome and the relationship between genotype and phenotype. According to three widely held dogmas, DNA is the unchanging template of heredity, is identical in all the cells and tissues of the body, (...) and is the sole agent of inheritance. Rather than being an unchanging template, DNA appears subject to a good deal of environmentally induced change. Instead of identical DNA in all the cells of the body, somatic mosaicism appears to be the normal human condition. And DNA can no longer be considered the sole agent of inheritance. We now know that the epigenome, which regulates gene expressivity, can be inherited via the germline. These developments are particularly significant for behavior genetics for at least three reasons: First, epigenetic regulation, DNA variability, and somatic mosaicism appear to be particularly prevalent in the human brain and probably are involved in much of human behavior; second, they have important implications for the validity of heritability and gene association studies, the methodologies that largely define the discipline of behavior genetics; and third, they appear to play a critical role in development during the perinatal period and, in particular, in enabling phenotypic plasticity in offspring. I examine one of the central claims to emerge from the use of heritability studies in the behavioral sciences, the principle of minimal shared maternal effects, in light of the growing awareness that the maternal perinatal environment is a critical venue for the exercise of adaptive phenotypic plasticity. This consideration has important implications for both developmental and evolutionary biology. (shrink)

Character-trait attribution is an important component of everyday social cognition that has until recently received insufficient attention in traditional accounts of folk psychology. In this paper, I consider how the case of character-trait attribution fits into the debate between mindreading-based and broadly ‘pluralistic’ approaches to folk psychology. Contrary to the arguments of some pluralists, I argue that the evidence on trait understanding does not show that it is a distinct, non-mentalistic mode of folk-psychological reasoning, but rather suggests that traits are (...) ordinarily understood as mentalistic dispositions. I also examine several ways in which trait attribution might also serve regulative, ‘mindshaping’ functions by promoting predictable norm-governed behavior, and argue that mindreading plays several important roles in these cases as well. I conclude that an appreciation of the relationship between trait attribution and mindreading is crucial to understanding the role it plays in our folk psychology. (shrink)

Groove, as a musical quality, is an important part of jazz and pop music appreciative practices. Groove talk is widespread among musicians and audiences, and considerable importance is placed on generating and appreciating grooves in music. However, musicians, musicologists, and audiences use groove attributions in a variety of ways that do not track one consistent underlying concept. I argue that that there are at least two distinct concepts of groove. On one account, groove is ‘the feel of the music’ and, (...) on the other, groove is the psychological feeling (induced by music) of wanting to move one’s body. Further, I argue that recent work in music psychology shows that these two concepts do not converge on a unified set of musical features. Finally, I also argue that these two concepts play different functional roles in the appreciative practices of jazz and popular music. This should cause us to further consider the mediating role genre plays for aesthetic concepts and provides us with reason for adopting a more communitarian approach to aesthetics which is attentive to the ways in which aesthetic discourse serves the practices of different audiences. Contributors to the latest Canadian Journal of Philosophy Supplementary Volume, _The Problem of Consciousness_, make connections regarding what is consciousness and how it is related to the natural world. The essays in this volume address this question from the perspective of phenomenological philosophy of mind, a new trend that integrates phenomenology, analytic philosophy, and cognitive science. The guiding principle of this new thinking is that precise and detailed phenomenological accounts of subjective experience are needed if significant progress is to be (...) made in understanding consciousness and its place in the natural world. From this standpoint, the essays collected here explore a variety of nuances concerning consciousness, including time consciousness, perception, schizophrenia, empathy, and intersubjectivity. In this paper we will be concerned with the interpretability logic of PA and in particular with the fact that this logic, which is denoted by ILM, does not have the interpolation property. An example for this fact seems to emerge from the fact that ILM cannot express Σ₁-ness. This suggests a way to extend the expressive power of interpretability logic, namely, by an additional operator for Σ₁-ness, which might give us a logic with the interpolation property. We will formulate (...) this extension, give an axiomatization which is modally complete and arithmetically complete (although for proofs of these theorems we refer to an earlier paper), and investigate interpolation. We argue that human rights are best conceived as norms arising from a fiduciary relationship that exists between states and the citizens and noncitizens subject to their power. These norms draw on a Kantian conception of moral personhood, protecting agents from instrumentalization and domination. They do not, however, exist in the abstract as timeless natural rights. Instead, they are correlates of the state's fiduciary duty to provide equal security under the rule of law, a duty that flows from the state's (...) institutional assumption of irresistible sovereign powers. Excellence in the care of hospital patients, particularly those in an intensive care unit, reflects esprit de corps among the care team. Esprit de corps depends on a delicate balance; each clinician must preserve a sense of personal responsibility for “my” patient and yet participate in the collaborative work essential to the care of “our” patient. A harmful imbalance occurs when a physician demands total control of the decision-making process, especially concerning end-of-life treatment options. Although emotional factors may push a (...) physician to claim decision-making exclusivity, compounded by a legal framework that overemphasizes individual responsibility, esprit de corps can be preserved through timely communication among clinicians and a recognition that optimal care for “my” patient requires effective team practice. Henry Wellman and colleagues have provided evidence of a robust developmental progression in theory-of-mind (or as we will say, “mindreading”) abilities, using verbal tasks. Understanding diverse desires is said to be easier than understanding diverse beliefs, which is easier than understanding that lack of perceptual access issues in ignorance, which is easier than understanding false belief, which is easier than understanding that people can hide their true emotions. These findings present a challenge to nativists about mindreading, and are said to (...) support a social-constructivist account of mindreading development instead. This article takes up the challenge on behalf of nativism. Our goal is to show that the mindreading-scale findings fail to support constructivism because well-motivated alternative hypotheses have not yet been controlled for and ruled out. This article identifies both prudence and antiprudence as options for rational people. Building upon Wiggins's "sensible subjectivism," the account offers an analysis of prudential emotions which are not rationally required but whose reasonableness need not be doubted. One result is that skepticism about prudence is avoidable. Another, as shown through examination of some of Parfit's worries about replication, is that prudence is autonomous from metaphysical theories of persons. It is also autonomous from morality, neither prudence nor morality being appropriately subordinated (...) to the other in a theory of rational choice. (shrink)

This paper theorizes that the effect of human rights violations on US economic aid is conditioned by the salience of US national security concerns. National security concerns will be more salient in situations where recipients contribute to maintaining US security and in temporal eras when the USA is perceived as being under increased external threat. As the relational and temporal salience of national security increases, any negative effect of human rights violations on US economic aid should decrease. I test this (...) hypothesis by examining US economic aid allocations to states from 1977 to 2005. The results show that the salience of national security concerns present in the US-recipient relationship does condition the relationship between human rights violations and US economic aid. There are also significant differences between different temporal eras of US foreign aid allocation. Future work should address how conflicts between interests and values in US foreign policy are negotiated. (shrink)

Samantha Matherne has written an excellent, timely introduction to the thought of Ernst Cassirer, the brilliant polymath who was the last representative of the “Marburg school” of neo-Kantianism, and who is well-known for wrangling a wide range of cultural phenomena into a system of “symbolic forms.” Despite Cassirer’s recent rise in prominence in the English-speaking philosophical world, there is only one other single-volume survey of his thought in English, Edward Skidelsky’s Ernst Cassirer. Matherne’s book has the merit of helping to (...) shore up this scholarly gap, and of providing a clear and succinct presentation of the philosophical system that... (shrink)

The ArgumentEugenics, in whatever form it may be articulated, is based on the idea that phenotypic characteristics of particular individuals can be predicted in advance. This paper argues that biology's capacity to predict many of the characteristics exhibited by an individual, especially behavioral or cognitive attributes, will always be very limited. This stems from intrinsic limitations to the methodology for relating genotypes to phenotypes, and from the nature of developmental processes which intervene between genotypes and phenotypes. While genetic studies may (...) generate valid population predictions for conditions which impact human health, neither genetics nor developmental biology are likely to generate useful individual predictions about variation in non-disease-related human behavioral and cognitive phenotypes in the foreseeable future. Philia (friendship) and eros (love) are topics of major philosophical interest in ancient Greek philosophy. President Trump verbally attacked human rights in his campaign rhetoric in 2016, leading many to believe that he would undermine the role of human rights in US foreign policy as President. I examine whether or not President Trump’s anti-human rights rhetoric manifested in US foreign policy by analyzing potential changes in how human rights were considered in foreign aid allocations under the Trump Administration. While President Trump had a number of executive tools at his disposal to exert control over foreign (...) aid allocation, he would still have had to overcome considerable bureaucratic and legislative inertia in order to implement his anti-human rights agenda in US foreign aid. I demonstrate that he was unsuccessful in overcoming this inertia, at least in the first 2 years of his Administration (the years for which data is currently available). If anything, human rights received more consideration under President Trump than under President Obama. (shrink)

This paper is a response to Christian Coseru, ‘The Middle Way to Reality: On Why I Am Not a Buddhist and Other Philosophical Curiosities.’ I address Coseru’s critical comments about naturalism, evolutionary psychology, scientific realism, and Madhyamaka philosophy. I argue that scientific naturalism is not the right framework for relating Buddhism to science; rather, the proper framework is the ethics of knowledge. I argue that Coseru’s defence of evolutionary psychology is unconvincing and rests on a misunderstanding of the issues concerning (...) the relations between evolutionary theory, evolutionary psychology, and Buddhist philosophy. Finally, I argue that there are considerable tensions between scientific realism and Buddhist philosophy. (shrink)

Three experiments examined the influence of argument length on plausibility judgements, in a category-based induction task. The general results were that when arguments were logically invalid they were considered stronger when they were longer, but for logically valid arguments longer arguments were considered weaker. In Experiments 1a and 1b when participants were forewarned to avoid using length as a cue to judging plausibility, they still did so. Indeed, participants given the opposite instructions did not follow those instructions either. In Experiment (...) 2 arguments came from a reliable or unreliable speaker. This manipulation affected accuracy as well as response bias, but the effects of argument length for both reliable and unreliable speakers replicated Experiments 1a and 1b. The results were analysed using receiver operating characteristic (ROC) curves and modelled using multidimensional signal detection theory (SDT). Implications for models of category-based inductive reasoning, and theories of reasoning more generally, are discussed. (shrink)

Some philosophers deny that science can investigate the supernatural - specifically, the nature and actions of God. If a divine being is atemporal, then, indeed, this seems plausible - but only, I shall argue, because such a being could not causally interact with anything. Here I discuss in detail two major attempts, those of Stump and Kretzmann, and of Leftow, to make sense of theophysical causation on the supposition that God is eternal. These views are carefully worked out, and their (...) failures are instructive for any attempt to reconcileeternality with causal efficacy. I conclude by arguing that if knowledge of God is possible, in virtue of His effects upon the world, then it is science that must play the preeminent role in producing that knowledge. (shrink)

The theme of this book is the deep continuity of life and mind. Where there is life there is mind, and mind in its most articulated forms belongs to life. Life and mind share a core set of formal or organizational properties, and the formal or organizational properties distinctive of mind are an enriched version of those fundamental to life. I take a twofold approach to these ideas in Mind in Life. On the one hand, I try to show that (...) to be a living organism is physically to realize or instantiate a certain kind of self-organization - one that entails an autonomous and normative and cognitive mode of being in relation to human mind, especially various structural features of conscious experience, are constituted by self-organizing processes of the human body engaged with its environment. In this twofold way, I hope to pro-vide new resources for addressing the explanatory gap between consciousness and nature. (shrink)
