The aim of this article is to shed light on an understudied aspect of Giordano Bruno's intellectual biography, namely, his career as a mathematical practitioner. Early interpreters, especially, have criticized Bruno's mathematics for being “outdated” or too “concrete”. However, thanks to developments in the study of early modern mathematics and the rediscovery of Bruno's first mathematical writings (four dialogues on Fabrizio's Mordente proportional compass), we are in a position to better understand Bruno's mathematics. In particular, this article aims (...) to reopen the question of whether Bruno anticipated the concept of infinitesimal quantity. It does so by providing an analysis of the dialogues on Mordente's compass and of the historical circumstances under which those dialogues were written. (shrink)

The concept of corporate social responsibility has been the subject of several academic contributions, but in the health sector the development of an interest in this subject is very recent. Although many practices in healthcare are already socially responsible, progressing from a series of socially responsible behaviours to a socially responsible organization entails a more consolidated awareness of the health sector’s mission and the needs of its participants. In this paper, we will review the different studies published that address the (...) relationship between the healthcare sector’s corporate responsibility and society, with the aims of individuating the prevailing foci that are emerging and categorizing the proposed contributions according to these foci: social responsibility and organization; social responsibility and social impact; social responsibility and competitiveness. In contemporary discussions of abortion, both sides argue well-worn positions, particularly concerning the question, When does human life begin? Though often invoked by the Catholic Church for support, Thomas Aquinas in fact held that human life begins after conception, not at the moment of union. But his overall thinking on questions of how humans come into being, and cease to be, is more subtle than either side in this polarized debate imagines. Fabrizio Amerini--an internationally renowned scholar of medieval philosophy--does (...) justice to Aquinas's views on these controversial issues. Some pro-life proponents hold that Aquinas's position is simply due to faulty biological knowledge, and if he knew what we know today about embryology, he would agree that human life begins at conception. Others argue that nothing Aquinas could learn from modern biology would have changed his mind. Amerini follows the twists and turns of Aquinas's thinking to reach a nuanced and detailed solution in the final chapters that will unsettle familiar assumptions and arguments. Systematically examining all the pertinent texts and placing each in historical context, Amerini provides an accurate reconstruction of Aquinas's account of the beginning and end of human life and assesses its bioethical implications for today. This major contribution is available to an English-speaking audience through translation by Mark Henninger, himself a noted scholar of medieval philosophy. (shrink)

In this paper a theoretical definition that helps to explain how the logical structure of legal presumptions is constructed by applying the Carneades model of argumentation developed in artificial intelligence. Using this model, it is shown how presumptions work as devices used in evidentiary reasoning in law in the event of a lack of evidence to assist a chain of reasoning to move forward to prove or disprove a claim. This book analyzes the uses of emotive language and redefinitions from pragmatic, dialectical, epistemic and rhetorical perspectives, investigating the relationship between emotions, persuasion and meaning, and focusing on the implicit dimension of the use of a word and its dialectical effects. It offers a method for evaluating the persuasive and manipulative uses of emotive language in ordinary and political discourse. Through the analysis of political speeches and legal arguments, the book offers a systematic study of emotive language in argumentation, rhetoric, (...) communication, political science and public speaking. We discuss the semantic significance of a puzzle concerning ‘ought’ and conditionals recently discussed by Kolodny and MacFarlane. We argue that the puzzle is problematic for the standard Kratzer-style analysis of modality. In Kratzer’s semantics, modals are evaluated relative to a pair of conversational backgrounds. We show that there is no sensible way of assigning values to these conversational backgrounds so as to derive all of the intuitions in Kolodny and MacFarlane’s case. We show that the appropriate verdicts can be (...) derived by extending Kratzer’s framework to feature a third conversational background and claiming that the relevant reading of ‘ought’ is sensitive to this parameter. Starting from two paintings by Salvador Dalì (The Enigma of William Tell and Autumnal Cannibalism), the article explores Sigmund Freud and Carl Gustav Jung’s idea of erotic cannibalism. The fear of being eaten is an archetype of the collective unconscious, as fairy tales clearly reveal. Following Jacques Derrida’s reflections, the author suggests that the fear of being eaten is not limited to anthropophagic cultures, because there is a sort of symbolic cannibalism which has to do with the capacity for annihilation. (...) The petrifying gaze of Medusa, described by Jean Paul Sartre, is a good example of this symbolic cannibalism. On the opposite side of the spectrum, compared to the petrifying gaze, we find the recognizing look of a mother toward her child. For the child, the mother embodies the good subject, which is reassuring and nonthreatening (the fairy who stands in contrast to the devouring ogre in fairy tales). Sara Ruddick explicitly refers to this motherhood model in her book Maternal Thinking, where she lays out the methodology for the ethics of care. The maternal, or recognizing gaze, as the opposite of Medusa’s gaze portrayed by Sartre, is well described in a compelling text by the Italian novelist Luigi Pirandello. At the same time, it plays an important role in Georg Wilhelm Friedrich Hegel’s The Phenomenology of the Spirit. Finally, the article returns to Salvador Dalì, showing how in his life, the artist experienced the Other’s gaze in both forms: the objectifying one, represented by the artist’s father (portrayed in The Enigma of William Tell), and the recognizing one, embodied by his partner Gala (portrayed in Autumnal Cannibalism). This monograph offers a novel, neurocognitive theory concerning words and language. It explores the distinction between inferential and referential semantic competence. The former accounts for the relationship of words among themselves, the latter for the relationship of words to the world. The author discusses this distinction at the level of the human brain on both theoretical and neuroscientific grounds. In addition, this investigation considers the relation between the inf/ref neurocognitive theory and other accounts of semantic cognition proposed in the field (...) of neurosemantics, as well as some potential implications of the theory for clinical neuroscience and the philosophy of semantics. Overall, the book offers an important contribution to the debate about lexical semantic competence. It combines a strong philosophical and linguistic background with a comprehensive and critical analysis of neurosemantic literature. The evolution of boundedly rational rules for playing normal form games is studied within stationary environments of stochastically changing games. Rules are viewed as algorithms prescribing strategies for the different normal form games that arise. It is shown that many of the “folk results” of evolutionary game theory, typically obtained with a fixed game and fixed strategies, carry over to the present environments. The results are also related to some recent experiments on rules and games.

The principle of autonomy, through various court rulings, gradually became part of medical practice and tradition in the second half of the 1800s, notably when the emergence of surgical anaesthesia began to raise serious questions regarding informed consent. In fact, surgical anaesthesia was initially used not only to avoid pain but also to combat patients’ resistance to operations.

The representation and classification of the structure of natural arguments has been one of the most important aspects of Aristotelian and medieval dialectical and rhetorical theories. This traditional approach is represented nowadays in models of argumentation schemes. The purpose of this article is to show how arguments are characterized by a complex combination of two levels of abstraction, namely, semantic relations and types of reasoning, and to provide an effective and comprehensive classification system for this matrix of semantic and quasilogical (...) connections. To this purpose, we propose a dichotomous criterion of classification, transcending both levels of abstraction and representing not what an argument is but how it is understood and interpreted. The schemes are grouped according to an end-means criterion, which is strictly bound to the ontological structure of the conclusion and the premises. On this view, a scheme can be selected according to the intended or reconstructed purpose of an argument and the possible strategies that can be used to achieve it. (shrink)

What is the origin and meaning of our aesthetic sense? Is it genetically encoded or is it culturally inherited? The aim of the essay is to answer to such issues by defining the emergent and meta-functional character of the aesthetic attitude. First, I propose to include the faculty of desire in the free play of the cognitive faculties at the center of Kant’s Critique of Judgment. The following step is given by a brief analysis of Darwin’s controversial remarks on the (...) pre-human birth of aesthetics and its relationship with sexual selection (§§ 1-2). The point of discontinuity between a mere animal aesthetic sense and a proto-human one is then found to become indeterminate of desire in the correlative diversification of aesthetic attractors (§§ 3-4). Successively, I deal with the supervenience character of the aesthetic and its anticipatory value. After a short genealogy of the notion of supervenience, I then develop its affinity with that of epigenesis (§§ 5-6). Afterwhich follows a review of two contemporary evolutionary perspectives on aesthetics: T. Deacon’s essay on the “aesthetic faculty” and J. Tooby and L. Cosmides thesis on the evolutionary meaning of the aesthetic-fictional activities (§§ 7-8). Conclusively, the epigenesis of an aesthetic mind is considered as the unity between the breath of aísthesis and the breath of linguistic sign (§§ 9-10). (shrink)

The purpose of this paper is to provide a basis for a systematic development of signaling theory on CSR initiatives. The paper proposes signaling theory as a framework supportive of a strategic CSR approach; maps extant research on signaling through CSR initiatives; offers a comprehensive assessment of the most diffused CSR initiatives and discusses their eligibility as signaling devices; and outlines a research agenda to further develop and test signaling theory in business ethics. The chapter provides a response to Patrick Toner, “Critical Study of Fabrizio Amerini’s Aquinas on the Beginning and End of Human Life,” Oxford Studies in Medieval Philosophy 2, 211–28. The chapter corrects two misrepresentations in Toner’s review. First, it proves that, given Aquinas’ assumptions on substantial form and human soul, Aquinas could not give up his preference for delayed hominization of the embryo even if he were acquainted with contemporary embryology. Aquinas takes as the starting point of his embryology (...) Aristotle’s characterization of the human soul as the act of an organic physical body having life potentially, and this characterization leads him to the conviction that the human soul can enter into the human body only after the principal vital organs are formed. Second, the chapter corrects Toner’s unusual interpretation of the clause “organic” in the Aristotelian characterization of the human soul, by specifying the different senses of potentiality in Aquinas’ embryology. The chapter reaffirms the core idea that establishing when the hominization of the human embryo begins is not decisive for rejecting abortion. The chapter suggests relating the question of abortion to the identity or continuity of the human embryo rather than to the beginning of hominization. (shrink)

In this paper we describe the impact that Walton’s conception of argumentation schemes had on AI and Law research. We will discuss developments in argumentation in AI and Law before Walton’s schemes became known in that community, and the issues that were current in that work. We will then show how Walton’s schemes provided a means of addressing all of those issues, and so supplied a unifying perspective from which to view argumentation in AI and Law.

This book shows how research in linguistic pragmatics, philosophy of language, and rhetoric can be connected through argumentation to analyze a recognizably common strategy used in political and everyday conversation, namely the distortion of another’s words in an argumentative exchange. Straw man argumentation refers to the modification of a position by misquoting, misreporting or wrenching the original speaker’s statements from their context in order to attack them more easily or more effectively. Through 63 examples taken from different contexts (including political (...) and forensic discourses and dialogs) and 20 legal cases, the book analyzes the explicit and implicit types of straw man, shows how to assess the correctness of a quote or a report, and illustrates the arguments that can be used for supporting an interpretation and defending against a distortion. The tools of argumentation theory, a discipline aimed at investigating the uses of arguments by combining insights from pragmatics, logic, and communication, are applied to provide an original account of interpretation and reporting, and to describe and illustrate tactics and procedures that can be used and implemented for practical purposes.. This book will appeal to scholars in the fields of political communication, communication in general, argumentation theory, rhetoric and pragmatics, as well as to people working in public speech, speech writing, and discourse analysis. Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...) studies, and law. Modeling arguments with argumentation schemes has proven useful in attempts to refine the analyst’s understanding of not only the logical structures that shape the backbone of the argument itself, but also the logical underpinning of strategies for evaluating it, strategies based on the semantic categories of genus and relevance. By clarifying the distinction between argument from example and argument from analogy, it is possible to advance a useful proposal for the treatment of argument from analogy in law. (shrink)

There are many benefits of using argumentation-based techniques in multi-agent systems, as clearly shown in the literature. Such benefits come not only from the expressiveness that argumentation-based techniques bring to agent communication but also from the reasoning and decision-making capabilities under conditions of conflicting and uncertain information that argumentation enables for autonomous agents. When developing multi-agent applications in which argumentation will be used to improve agent communication and reasoning, argumentation schemes (reasoning patterns for argumentation) are useful in addressing the requirements (...) of the application domain in regards to argumentation (e.g., defining the scope in which argumentation will be used by agents in that particular application). In this work, we propose an argumentation framework that takes into account the particular structure of argumentation schemes at its core. Metaphorical meaning can be analyzed as triggered by an apparent communicative breach, an incongruity that leads to a default of the presumptive interpretation of a vehicle. This breach can be solved through contextual renegotiations of meaning guided by the communicative intention, or rather the presumed purpose of the metaphorical utterance. This paper addresses the problem of analyzing the complex process of reasoning underlying the reconstruction of metaphorical meaning. This process will be described as a type of abductive argument, aimed at (...) explaining how the vehicle can best contribute to the purpose of the utterance. This type of reasoning involves the analysis of the possible predicates that can be and usually are attributed to the vehicle, and the selection of the one that can support the implicit conclusion constituting the communicative goal of the metaphorical utterance. Metaphorical meaning, in this perspective, becomes the outcome of a complex process of meaning reconstruction aimed at providing the best explanation of the function of the vehicle within a discourse move. To be both a clinician and a scientist—what is usually called a clinician scientist or clinical investigator—is easy neither from an ethical nor from a methodological standpoint. On the one hand, it requires care, cure of the patients, and good ethical practice. On the other, excellent skills in experimental design and data analysis are necessary. In addition, the correct choice of a disease as a model to be studied is very often hampered by the obvious ethical constraints of working with (...) human beings, thus limiting the experimental armamentarium in the hands of the clinician scientist. Il saggio propone un confronto tra l’ultima filosofia di Walter Benjamin e l’opera di Anselm Kiefer. Sullo sfondo della questione del rapporto tra passato, memoria e identità, che in entrambi assume una forma drammatica, tale confronto riguarda in particolare l’opera di Kiefer, Der Engel der Geschichte. Mohn und Gedächtnis (L’Angelo della storia: papavero e memoria; piombo, vetro, fili metallici e papaveri, 1989, The Israel Museum, Jerusalem) e l’Angelus Novus di PaulKlee, al centro delle Tesi sul concetto di storia, vero e (...) proprio testamento filosofico di Benjamin. Il confronto tra l’arte di Kiefer e la filosofia di Benjamin si sviluppa sul filo del contrappunto anziché della consonanza. Il tentativo è quello di mostrare come opera d’arte e testo filosofico possono dialogare, in quanto espressione di posizioni e linguaggi differenti e autonomi. Il terreno problematico comune, nel nostro caso, è quello offerto dalle catastrofi della memoria e dall’amnesia del presente. (shrink)

Ich versuche zu zeigen, daß Sleigh bei seiner Argumentation gegen die Ansicht, daß Leibniz Superessentialist gewesen sei, den entscheidenden Unterschied übersieht zwischen individuellen und allgemeinen essentiellen Eigenschaften und er sich auf eine eindeutig falsche Interpretation der relevanten Texte stützt; außerdem, daß Sleighs Zuordnung der Lehre der , superintrinsicalness' zu Leibniz sowohl textlich nicht begründet als auch formal mehrdeutig ist, und daß Sleighs Analyse der Begriffe (...) Kompossibilität und Akkomodation zu wünschen läßt. Ich versuche auch -im Gegensatz zu dem, was eine Anzahl von Leibniz-Interpreten in letzter Zeit behauptet hat -zu zeigen, daß sich Leibniz auf possibilia vor allem mit der Absicht bezog, eine Interpretation von kontrafaktischen Aussagen und Kontingenz zur Verfügung zu stellen. This paper compares current ways of modeling the inferential structure of practical reasoning arguments, and proposes a new approach in which it is regarded in a modular way. Practical reasoning is not simply seen as reasoning from a goal and a means to an action using the basic argumentation scheme. Instead, it is conceived as a complex structure of classificatory, evaluative, and practical inferences, which is formalized as a cluster of three types of distinct and interlocked argumentation schemes. Using two (...) real examples, we show how applying the three types of schemes to a cluster of practical argumentation allows an argument analyst to reconstruct the tacit premises presupposed and evaluate the argumentative reasoning steps involved. This approach will be shown to overcome the limitations of the existing models of practical reasoning arguments within the BDI and commitment theoretical frameworks, providing a useful tool for discourse analysis and other disciplines. In particular, applying this method brings to light the crucial role of classification in practical argumentation, showing how the ordering of values and preferences is only one of the possible areas of deep disagreement. Cet article se propose de décrire le projet épistémique des sciences des systèmes complexes. Domaine interdisciplinaire fondé par le Santa Fe Institute en 1984 aux États-Unis, il a été décrit par ses représentants comme un champ d’étude interdisciplinaire, post-laplacien, holiste et antiréductionniste. Des journalistes populaires et des sociologues intéressés et qui ont soutenu ce domaine en ont repris les discours, en annonçant l’avènement d’un nouveau paradigme révolutionnaire pour tous les savoirs. Dans ce texte, on montrera que le projet épistémique des (...) sciences de la complexité est moins pluraliste, antipositiviste et antiréductionniste que ce que l’on en dit. Je tâcherai de montrer en quoi le cadre épistémologique et ontologique de ce champ d’études reste analytique et réductionniste dans un sens physicaliste, computationnaliste, mathématique et biologisant. The 26 essays collected in this volume explore some crucial aspects of the philosophical and scientific traditions of the Middle Ages and the Renaissance. Using a historical-philological approach, the volume brings to light unpublished documents and offers new reconstructions of the intellectual paths of authors such as Meister Eckhart, Nicole Oresme, John Buridan, Siger of Brabant, William of Ockham, Peter Pomponazzi, and Giovanni Pico della Mirandola.

In this paper my objective is two-fold. First, I will try to provide further arguments in favour of the view defended in my earlier paper¹. In particular, I will try to show (in § 1) that a plausible understanding of the notion of a complete concept, coupled with (what I take to be) a reasonable interpretation of Leibniz's intriguing talk of severa “possible Adams” (§ 2), leads quite naturally to the view that Leibniz was committed to the doctrine of world-bound (...) individuals. Second, I will try to show (in § 3) that a suggestive way of saving contingency in the framework of Leibniz's theory of complete concepts is bound to fail : and the reasons for this failure will provide further evidence in favour of the view under present discussion. The remaining sections of the paper (§§ 4-6), will be concerned with fixing and making precise some of the loose ends of the previous three sections. Thus §§ 4 and 5 will be devoted to an analysis of Leibniz's use and understanding of the notions of contingency and necessity, and essence and accident, respectively. It will be shown that Leibniz's use and understanding of those notions is perfectly consistent with his commitment to the doctrine of world-bound individuals. In § 6, finally, I will try to indicate exactly how David Lewis' Counterpart Theory can be brought to bear upon Leibniz's theory of complete concepts, and, specifically, how it ought to be interpreted in that context. The problem of establishing the best interpretation of a speech act is of fundamental importance in argumentation and communication in general. A party in a dialogue can interpret another’s or his own speech acts in the most convenient ways to achieve his dialogical goals. In defamation law this phenomenon becomes particularly important, as the dialogical effects of a communicative move may result in legal consequences. The purpose of this paper is to combine the instruments provided by argumentation theory with the (...) advances in pragmatics in order to propose an argumentative approach to meaning reconstruction. This theoretical proposal will be applied to and tested against defamation cases at common law. Interpretation is represented as based on a hierarchy of interpretative presumptions. On this view, the development of the logical form of an utterance is regarded as the result of an abductive pattern of reasoning in which various types of presumptions are confronted and the weakest ones are excluded. Conflicts of interpretations and equivocation become essentially interwoven with the dialectical problem of fulfilling the burden of defeating a presumption. The interpreter has a burden of explaining why a given presumption is subject to default, assuming that the speaker is reasonable and acting based on a set of shared expectations. (shrink)
