The challenges that normative redundancies and normative conflicts pose to legal theory have been traditionally addressed by either altering the rules that trigger them, or by including preference rules that deactivate them. As an alternative to these routes, this paper argues that the problems with both redundancies and conflicts only arise as a consequence of a mistaken understanding of legal reasoning that ignores the material relations between the rules at issue. This book presents a comprehensive and detailed exploration of the relationship between the thought of G.W.F. Hegel and that of John McDowell, the latter of whom is widely considered to be one of the most influential living analytic philosophers. It serves as a point of entry in McDowell’s and Hegel’s philosophy, and a substantial contribution to ongoing debates on perceptual experience and perceptual justification, naturalism, human freedom and action. The chapters gathered in this volume, as well as McDowell’s responses, make (...) it clear that McDowell’s work paves the way for an original reading of Hegel’s texts. His conceptual framework allows for new interpretive possibilities in Hegel’s philosophy which, until now, have remained largely unexplored. Moreover, these interpretations shed light on various aspects of continuity and discontinuity between the philosophies of these two authors, thus defining more clearly their positions on specific issues. In addition, they allow us to see Hegel’s thought as containing a number of conceptual tools that might be useful for advancing McDowell’s own philosophy and contemporary philosophy in general. The papers collected in this volume are based on the best contributions to the conference of the Italian Society for Logic and Philosophy of Science (SILFS) that took place in Milan on 8-10 October 2007. The aim of the Society, since its foundation in 1952, has always been that of bringing together scholars - working in the broad areas of Logic, Philosophy of Science and History of Science - who share an open-minded approach to their disciplines and regard them as (...) essentially requiring continuous confrontation and bridge-building to avoid the danger of over-specialism. In this perspective, logicians and philosophers of science should not indulge in inventing and cherishing their own "internal problems" - although these may occasionally be an opportunity for conceptual clarification - but should primarily look at the challenging conceptual and methodological questions that arise in any genuine attempt to extend our objective knowledge. As Ludovico Geymonat used to put it: " good] philosophy should be sought in the folds of science itself." Although acoustic frequency is not a spatial property of physical objects, in common language, pitch, i.e., the psychological correlated of frequency, is often labeled spatially (i.e., “high in pitch” or “low in pitch”). Pitch-height is known to modulate (and interact with) the response of participants when they are asked to judge spatial properties of non-auditory stimuli (e.g., visual) in a variety of behavioral tasks. In the current study we investigated whether the modulatory action of pitch-height extended to the haptic estimation (...) of height of a virtual step. We implemented a HW/SW setup which is able to render virtual 3D objects (stair-steps) haptically through a PHANTOM device, and to provide real-time continuous auditory feedback depending on the user interaction with the object. The haptic exploration was associated with a sinusoidal tone whose pitch varied as a function of the interaction point’s height within (i) a narrower and (ii) a wider pitch range, or (iii) a random pitch variation acting as a control audio condition. Explorations were also performed with no sound (haptic only). Participants were instructed to explore the virtual step freely, and to communicate height estimation by opening their thumb and index finger to mimic the step riser height, or verbally by reporting the height in centimeters of the step riser. We analyzed the role of musical expertise by dividing participants into non musicians and musicians. Results showed no effects of musical pitch on high-realistic haptic feedback. Overall there is no difference between the two groups in the proposed multimodal conditions. Additionally, we observed a different haptic response distribution between musicians and non musicians when estimations of the auditory conditions are matched with estimations in the no sound condition. This monograph uses deconstruction—a philosophical movement originated by Jacques Derrida—to read the most authoritative book in Judaism: the Talmud. Examining deconstruction in comparison with Kant’s and Hegel’s philosophies, the volume argues that the movement opens an innovative debate on Jewish Law. -/- First, the monograph interprets deconstruction within the major streams of continental philosophy; then, it criticizes many aspects of Foucault’s and Agamben’s philosophy, rejecting their notion of law. On these premises, the research delivers a close examination of many fundamental (...) aspects of the Talmud. Consequently, it provides a short history of Rabbinic literature, a history of the dissemination of the Talmud from Babylon to Northern France, and an analysis of Talmudic vocabulary from a deconstructive perspective. Each key concept of the Talmud is analysed according to the deconstructive dialectics between orality and writing. Closing with a comparison between the Talmud and Derrida’s most enigmatic text, Glas, the study argues that deconstruction dismantles the traditional notion of the Talmud to outline a new approach to Jewish Law. -/- Reading the Talmud through deconstruction, this new angle makes the volume an essential resource for students and scholars interested in Jewish studies, continental philosophy, and the Middle East. Since the advent of drug regulation in 1962, regulatory agencies have been in the practice of using strict standards to test the safety and efficacy of medical treatments and products. Regulatory agencies, such as the FDA, demand two full-fledged Randomized Clinical Trials demonstrating the safety and effectiveness of drugs to grant its marketing authorization. On the contrary, surgical treatments are left completely unregulated. There are several reasons explaining this difference, and all of them point to the difficulty of conducting well-designed (...) RCTs in surgery. However, we argue that none of these arguments is decisive and that, under certain conditions, surgical RCTs can be morally justified and methodologically sound. Although ethical constraints restrict the number of testable surgical procedures, and surgical trials might not be as dependable as pharmaceutical RCTs, our analysis suggests that, in certain cases, it is possible to obtain high-quality evidence about the safety and efficacy of surgical procedures. Untested surgical treatments may prove to be ineffective and harm patients. Therefore, regulation of surgical procedures seems not only morally acceptable and able to provide reliable scientific evidence, but also desirable and justified from an ethical-political standpoint. Degrowth is the literal translation of ‘décroissance’, a French word meaning reduction. Launched by activists in 2001 as a challenge to growth, it became a missile word that sparks a contentious debate on the diagnosis and prognosis of our society. ‘Degrowth’ became an interpretative frame for a new (and old) social movement where numerous streams of critical ideas and political actions converge. It is an attempt to re-politicise debates about desired socio-environmental futures and an example of an activist-led science now (...) consolidating into a concept in academic literature. This article discusses the definition, origins, evolution, practices and construction of degrowth. The main objective is to explain degrowth's multiple sources and strategies in order to improve its basic definition and avoid reductionist criticisms and misconceptions. To this end, the article presents degrowth's main intellectual sources as well as its diverse strategies (oppositional activism, building of alternatives and political proposals) and actors (practitioners, activists and scientists). Finally, the article argues that the movement's diversity does not detract from the existence of a common path. (shrink)

Relational quantum mechanics is an interpretation of quantum theory which discards the notions of absolute state of a system, absolute value of its physical quantities, or absolute event. The theory describes only the way systems affect each other in the course of physical interactions. State and physical quantities refer always to the interaction, or the relation, between two systems. Nevertheless, the theory is assumed to be complete. According to the received view in epistemology, inferential knowledge from non-knowledge is impossible – that is, in order for a subject to know the conclusion of their inference, they must know the essential premises from which that conclusion is drawn. In this book, Federico Luzzi critically examines this view, arguing that it is less plausible than intuition suggests and that it can be abandoned without substantial cost. In a discussion that ranges across inference, testimony and memory he analyses the (...) full range of challenges to the view, connecting them to epistemological cases that support those challenges. He then proposes a defeater-based framework which allows the phenomenon of knowledge from non-knowledge across these three epistemic areas to be better understood. The focus of this paper is the prima facie plausible view, expressed by the principle of Counter-Closure, that knowledge-yielding competent deductive inference must issue from known premises. I construct a case that arguably falsifies this principle and consider five available lines of response that might help retain Counter-Closure. I argue that three are problematic. Of the two remaining lines of response, the first relies on non-universal intuitions and forces one to view the case I construct as exhibiting a justified, true (...) belief to which none of the usual diagnoses of knowledge failure in Gettier cases apply. The second line involves claiming that Fake Barns and its ilk are misdiagnosed by epistemological orthodoxy as Gettier cases. We are thus confronted by a trilemma: either the case I discuss undermines the first-blush plausible principle of Counter-Closure; or the case I discuss instantiates a novel kind of Gettier case; or a popular conception of a key range of alleged Gettier cases must be rejected. No matter which horn we choose, the case points to a philosophically curious conclusion. (shrink)

ABSTRACTWe will present 12 different mixed metainferential consequence relations. Each one of them is specified using two different inferential Tarskian or non-Tarskian consequence relations: or. We will show that it is possible to obtain a Tarskian logic with non-Tarskian inferential logics, but also a non-Tarskian logic with Tarskian inferential logics. Moreover, we will show how some of these metainferential logics work better than the corresponding inferential rivals. Epistemic diversity is the ability or possibility of producing diverse and rich epistemic apparati to make sense of the world around us. In this paper we discuss whether, and to what extent, different conceptions of knowledge—notably as ‘justified true belief’ and as ‘distributed and embodied cognition’—hinder or foster epistemic diversity. We then link this discussion to the widespread move in science and philosophy towards monolingual disciplinary environments. We argue that English, despite all appearance, is no Lingua Franca, and we give (...) reasons why epistemic diversity is also deeply hindered is monolingual contexts. Finally, we sketch a proposal for multilingual academia where epistemic diversity is thereby fostered. (shrink)

According to a widespread view, the Bell theorem establishes the untenability of so-called ‘local realism’. On the basis of this view, recent proposals by Leggett, Zeilinger and others have been developed according to which it can be proved that even some non-local realistic theories have to be ruled out. As a consequence, within this view the Bell theorem allows one to establish that no reasonable form of realism, be it local or non-local, can be made compatible with the (experimentally tested) (...) predictions of quantum mechanics. In the present paper it is argued that the Bell theorem has demonstrably nothing to do with the ‘realism’ as defined by these authors and that, as a consequence, their conclusions about the foundational significance of the Bell theorem are unjustified. As a result of advances in healthcare, the worldwide average life expectancy is steadily increasing. However, this positive trend has societal and individual costs, not least because greater life expectancy is linked to higher incidence of age-related diseases, such as dementia. Over the past few decades, research has isolated various protective “healthy lifestyle” factors argued to contribute positively to cognitive aging, e.g., healthy diet, physical exercise and occupational attainment. The present article critically reviews neuroscientific evidence for another such factor, i.e., (...) speaking multiple languages. Moreover, with multiple societal stakeholders in mind, we contextualize and stress the importance of the research program that seeks to uncover and understand potential connections between bilingual language experience and cognitive aging trajectories, inclusive of the socio-economic impact it can have. If on the right track, this is an important line of research because bilingualism has the potential to cross-over socio-economic divides to a degree other healthy lifestyle factors currently do not and likely cannot. A Second level Master in “Clinical Bioethics Consultation” has been organized in Italy to offer an opportunity to offer an adequate training to carry out an ethics consultation in different health fields. The master has been promoted and realized by different institutions: Catholic University of Sacred Hearth in Rome, Insubria University in Varese, “Federico II” University in Naples, Lanza Foundation in Padua and the Local Health and Social Care Unit n.7 in Veneto Region. The aim of the master is (...) train ethics consultants to offer help regarding a correct decision, which will take by others. The choice must be as much as possible shared between patient, family and health care team. Ethics consultation can be primarily request by the physicians, nurses and health care staff such as support about a choice that wants to be the most appropriate and to clarify a dilemma between different options. Secondly an ethics consultation can be demand by the patient and the family members to find a clarification about their dilemmas and future choices. Also the administrative staff could ask the consultation, when it need to better explain ad example about a specific clinical case or a question concerned the health policy. (shrink)

How are we to understand the intentionality of desire? According to the two classical views, desire is either a positive evaluation or a disposition to act. This essay examines these conceptions of desire and argues for a deontic alternative, namely the view that desiring is representing a state of affairs as what ought to be. Three lines of criticism of the classical pictures of desire are provided. The first concerns desire’s direction of fit, i.e. the intuition that the world should (...) conform to our desires. The second concerns the “death of desire” principle, i.e. the intuition that one cannot desire what one represents as actual. The last pertains to desire’s role in psychological explanations, i.e. the intuition that desires can explain motivations and be explained by evaluations. Following these criticisms, three positive arguments in favor of the deontic conception are sketched. (shrink)

Recent work has demonstrated how data-driven AI methods can leverage consumer protection by supporting the automated analysis of legal documents. However, a shortcoming of data-driven approaches is poor explainability. We posit that in this domain useful explanations of classifier outcomes can be provided by resorting to legal rationales. We thus consider several configurations of memory-augmented neural networks where rationales are given a special role in the modeling of context knowledge. Our results show that rationales not only contribute to improve the (...) classification accuracy, but are also able to offer meaningful, natural language explanations of otherwise opaque classifier outcomes. The relational interpretation of quantum mechanics (RQM) has received a growing interest since its first formulation in 1996. Usually presented as an interpretational layer over the usual quantum mechanics formalism, it appears as a philosophical perspective without proper mathematical counterparts. This state of affairs has direct consequences on the scientific debate on RQM which still suffers from misunderstandings and imprecise statements. In an attempt to clarify those debates, the present paper proposes a radical reformulation of the mathematical framework of quantum (...) mechanics which is relational from the start: fact-nets. The core idea is that all statements about the world, facts, are binary entities involving two systems that can be symmetrically thought of as observed and observer. We initiate a study of the fact-nets formalism and outline how it can shed new relational light on some familiar quantum features. (shrink)

There is evidence indicating that the Capgras delusion is grounded in some kind of anomalous experience. According to the endorsement model, the content of the delusion is already encoded in the Capgras subject's experience, and the delusion is formed simply by endorsing that content as veridical. Elisabeth Pacherie and Sam Wilkinson have in different ways attempted to articulate a comprehensive defence of this strategy, but here I argue that the endorsement model cannot be defended along the lines envisioned by either (...) of them. I then offer a more promising way of spelling out the model, according to which the anomalous experience implicated in Capgras is metaphorical in character. (shrink)

We propose a new interpretation of the equation E=mc² in special relativity by generalizing ideas of ontological emergence to fundamental physics. This allows us to propose that mass, as a property, can be considered to emerge from energy, using a well-known definition of weak ontological emergence. Einstein’s famous equation gains in this way a clearer philosophical interpretation, one that avoids the problems of previous attempts, and is fully consistent with the kinematic properties of special relativity, while yielding fresh insights concerning (...) the nature of mass. Observables have a dual nature in both classical and quantum kinematics: they are at the same time quantities, allowing to separate states by means of their numerical values, and generators of transformations, establishing relations between different states. In this work, we show how this twofold role of observables constitutes a key feature in the conceptual analysis of classical and quantum kinematics, shedding a new light on the distinguishing feature of the quantum at the kinematical level. We first take a look (...) at the algebraic description of both classical and quantum observables in terms of Jordan–Lie algebras and show how the two algebraic structures are the precise mathematical manifestation of the twofold role of observables. Then, we turn to the geometric reformulation of quantum kinematics in terms of Kähler manifolds. A key achievement of this reformulation is to show that the twofold role of observables is the constitutive ingredient defining what an observable is. Moreover, it points to the fact that, from the restricted point of view of the transformational role of observables, classical and quantum kinematics behave in exactly the same way. Finally, we present Landsman’s general framework of Poisson spaces with transition probability, which highlights with unmatched clarity that the crucial difference between the two kinematics lies in the way the two roles of observables are related to each other. Human cerebral organoids are three-dimensional biological cultures grown in the laboratory to mimic as closely as possible the cellular composition, structure, and function of the corresponding organ, the brain. For now, cerebral organoids lack blood vessels and other characteristics of the human brain, but are also capable of having coordinated electrical activity. They have been usefully employed for the study of several diseases and the development of the nervous system in unprecedented ways. Research on human cerebral organoids is proceeding at (...) a very fast pace and their complexity is bound to improve. This raises the question of whether cerebral organoids will also be able to develop the unique feature of the human brain, consciousness. If this is the case, some ethical issues would arise. In this article, we discuss the necessary neural correlates and constraints for the emergence of consciousness according to some of the most debated neuroscientific theories. Based on this, we consider what the moral status of a potentially conscious brain organoid might be, in light of ethical and ontological arguments. We conclude by proposing a precautionary principle and some leads for further investigation. In particular, we consider the outcomes of some very recent experiments as entities of a potential new kind. (shrink)

En esta disciplina, la bibliografía sobre discurso de odio ha centrado su análisis en los efectos que este produce en los grupos oprimidos. La idea central del presente trabajo será presentar una nueva noción, el discurso influenciado, que permita explicar lo que el grupo opresor es llevado a afirmar en base a la opresión sistemática. Así, el discurso influenciado permitirá tanto explicar la reproducción social (...) de los discursos de odio como enmarcar teóricamente las afirmaciones discriminatorias realizadas por los programas informáticos previamente mencionados.
