The German word Festschrift has become the universally accepted term for a published collection of legal essays written by several authors to honour a distinguished jurist or mark a significant legal event. The genre dates back to the mid‐19th century on the Continent, but until recently it has made little impression on the literature of the common law. Less than a dozen legal Festschriften had been published in the United Kingdom up to 1968, but since then more than a (...) hundred legal Festschriften have appeared. This article traces the rise of the legal Festschrift in the United Kingdom, and attempts to account for its recent popularity. The nature of legal Festschriften, and the processes and problems of their production, are addressed. Emphasis is placed on the systemic failure to index contributions to legal Festschriften. This gap in the bibliographic resources of the common law consigns an enormous amount of scholarship to oblivion; hence the reference in the title to ‘graveyards of scholarship’. An indication of the magnitude of this problem is that the total number of contributions to legal Festschriften between 1969 and 2000 almost equals the total number of articles published in three leading British law reviews over the same period. The article concludes that the failure to index contributions to legal Festschriften by author and subject matter is lamentable, and undercuts the reasons for publishing legal Festschriften in the first place. Festschriften, when they are haphazard collections of pieces written by colleagues and well-wishers on the occasion of a major anniversary in the life of a distinguished man, tend to be tedious. One can more profitably go directly to the writings of the celebrant, as well as other, more voluntary publications of his well-wishers. However, the editors wish to claim that this Festschrift is different. This is so first of all because of the almost unique combination of interests and competence (...) of Henry Margenau. He is at once a distinguished physicist, an equally distinguished educator, and a prominent philosopher. These broad areas of his extraordinarily active and fruitful career are each represented in this volume in his honor, and this constitutes the particular interest of the collection. Without limiting themselves to paraphrases or empty compliments, the contributors to this book range over the scope of interest of Margenau's work, and, acknowledging its influence and significance, present their own viewpoints and conclusions. Since they include some of the most distinguished men in science and philosophy today, the privilege of having them speak to some broadly defined common concerns in a single volume is a rare one, for which our thanks must go to Henry Margenau, who inspired the papers. Festschriften may have gone out of style, but not out of print. The desire to pay tribute to an important thinker remains strong and no one has found a more suitable vehicle. Hence the present volume in honor of Max Fisch, who retired recently from the University of Illinois after a long and distinguished career in the academic world, which began in 1926. The volume consists of fourteen essays by former graduate students of Fisch, as well as two short (...) pieces by Fisch himself, a biographical sketch by Max Harold Fisch, a preface by D. W. Gotshalk, a chronological bibliography of Fisch's writings, and a list of theses directed by Fisch from 1947 to 1968 at the University of Illinois. The essays cover such diverse philosophers as Aristotle, Hartshorne, Merleau-Ponty, Agassiz, Harvey, Hegel, and Peirce and range from subjects like Freedom and the Justification of Morality to Logic, Frequency Theory of Probability, Language and the Self--and even beyond, to subjects such as The Origin of the Species and a Taoist Treatise on the Nourishment of Life. Curiously, despite Fisch's pioneer work in bringing Vico to the attention of American readers, none of the essays center on Vichian thought; nor do any of the theses listed in the back of the book take Vico as the subject of the dissertation.--H. Richard Popkin tells the story that once a long time ago when he asked a question at a conference that made reference to late-eighteenth-century skeptics like Maimon (...) and Platner, Myles Burnyeat turned to the audience and asked, "Does anyone else read these people that Popkin reads?" The answer, by the time we get to this, the fourth edition of a book that first appeared in 1960, is that lots of people are reading the people that Popkin reads. Now [End Page 105] Myles Burnyeat is quoted on the cover of this volume for graciously saying "I regard it as one of the seminal books in the history of ideas." In one of the three Festschriften that have been published in Popkin's honor, David Katz even reports that some of those who work in areas Popkin pioneered refer to themselves as "Popkinites" (James E. Force and David S. Katz, eds., Everything Connects [Leiden and Boston: Brill, 1999], ix).Popkin was also founding editor of this journal, and his name has been footnoted in numerous articles over the years, so it will not be unknown to many. But readers will want to know what is new in this latest version of the classic work. For openers, it is roughly fifty percent longer, now 18 chapters instead of the 12 chapters of the last version. The original book was subtitled "From Erasmus to Descartes" and the later California edition subtitle became "From Erasmus to Spinoza." This edition pushes the envelope in both directions: back to Savonarola and forward to Pierre Bayle.The Savonarola connection comes from the unlikely discovery that the famous monk collected manuscripts of Sextus Empiricus and was planning to have them translated as tools for use against pagan philosophy and in favor of revealed religion. This brings out one of Popkin's favorite points: that what we think of as philosophical skepticism was part and parcel of religious debate early on. Among other new findings in this edition, Popkin finds clues that Leone Ebreo (Judah Abravanel) may have helped Gianfrancesco Pico read anti-Aristotelian Hebrew texts. Jews could use this sort of skepticism against the dogmatic Christians who tried to refute them.The religious connection is fundamental throughout the text. In his new introduction, Popkin admits that "I am more in sympathy with those who used the sceptical and fideist views of the nouveaux pyrrhoniens for religious rather than secular purposes" (p. xxiii). He has developed this sympathy into research on millenarianism in volumes such as Popkin and David S. Katz, Messianic Revolution: Radical Religious Politics to the End of the Second Millennium (New York: Hill and Wang, 1998) and Popkin, et al., eds., Millenarianism and Messianism in Early Modern European Culture, 4 vols. (Dordrecht: Kluwer, 2001).Other new materials follow the discussion of Descartes with a chapter on Henry More, Pascal, and the Quietists and another one on Hobbes's political and practical answer to skepticism. There are new chapters on Wilkins, Boyle, and Glanvill of the Royal Society, and on late seventeenth-century metaphysics. New material on Simon Foucher and Pierre-Daniel Huet is followed by the concluding chapter on Pierre Bayle as a "super sceptic."The book has never been uncontroversial. Although they could follow the skeptical undercutting of the Bible in Spinoza, many scholars could not see how the master of the geometrical method in ethics could be anything but a dogmatist in the final analysis. The German word Festschrift is a compound of fest, which derives from the Latin festum, meaning “festival,” and schrift, an abstractum of schreiben, which means “writing.” It literally means “festival-writing,” though in keeping with an academic tradition extending back to the nineteenth century, a more appropriate translation is “celebratory volume.” And that is precisely what this is. Mark Geller is well known to everyone in his field and, unsurprisingly, his Festschrift is a bulging volume of contributions—from thirty-four scholars in a variety of different specialties. Like most Festschriften, it is of uneven quality, but there are some very fine articles, including useful text editions and offerings that raise interesting scholarly questions. Although there is nothing here on economics, there are articles that engage historical and/or anthropological questions, exegetical issues, and matters of composition of literary texts, including (...) one offering on Akkadian grammar. None of these would be expected from a volume entitled Mesopotamian Medicine and Magic, but their presence is a testimony to the very broad interests of the honoree. (shrink)

Eleven essays, on a variety of topics, most of them first given as lectures or published in periodicals and Festschriften. This is "late" Heidegger --alternately brilliant and mystifying, provocative and exasperating, at least to the uninitiated. Perhaps the best pieces in the book are the three which discuss passages in pre-Socratic philosophers--here, familiar texts are given fresh, if unorthodox, interpretations, and are made to suggest philosophical conclusions of remarkable subtlety and scope. --V. This is a collection of essays and lectures which have all been published previously. Heidegger prefaces the volume with a series of remarks, written in 1967, which elaborate upon the title Wegmarken. The path in question is what he has called on numerous occasions his Denkweg. The path is the way of thinking into the truly thought-worthy. The path goes back into what was once thought out and is now covered over, and forward into what is to be thought out (...) but is still concealed. The thinker en route to Being has had his thinking set in motion by Being itself. Thinking travels a troubled path, for it stands in constant danger of being flooded by mere information. Whether or not it can bypass this roadblock is still the essential question for our time. Three of the texts collected here were available only in journals and Festschriften. It is also interesting that Heidegger includes all three segments of Was ist Metaphysik? He does not fuse them into a single text but arranges them separately. The other selections are: Vom Wesen des Grundes; Vom Wesen der Wahrheit; Platons Lehre von der Wahrheit; Brief über den "Humanismus"; Zur Seinsfrage; Kants These über das Sein. Here we see what Heidegger himself has singled out as being representative of, and significant for, the course of his thought. The emphasis upon "path" argues strongly for those who would see in Heidegger's thought an evolving, developing growth. The unity of early and later Heidegger then is not the unity of a single doctrine but the unity of a single search or path, unified by a single object of pursuit.--J. D. C. (shrink)

This lengthy volume contains philosophical treatises by Henry Deku written over a period of some thirty years, previously published in various journals, collections of essays and Festschriften, and now collected together to mark their author’s 75th birthday.

Published as one of the issues of the quarterly periodical Continuum, this is one of those rare Festschriften which is given over to the Schriften of the man whose Fest it is. In this way, the essays represents the solidest, first-hand coming to grips with the systematic and expansive thought of a first-rate philosopher and theologian. Of particular interest is the contribution by E. M. McKinnon, "Cognitional Analysis and the Philosophy of Science," in which Lonergan's philosophy of science is (...) shown to have deep affinities with the Scientific Realism espoused by many contemporary analytical philosophers. Lonergan himself provides a whirlwind and breathtaking synoptic review of his past work in the final essay of the volume, in which he begins à la Hegel in sense certainty and ends with authentic human existence as the integration of objective knowing and dynamic intersubjectivity.
