: This essay considers the implications of President George W. Bush's proposal for human embryonic stem cell research. Through the perspective of patent law, privacy, and informed consent, we elucidate the ongoing controversy about the moral standing of human embryonic stem cells and their derivatives and consider how the inconsistencies in the president's proposal will affect clinical practice and research.

: This paper presents a method of moral problem solving in clinical practice that is inspired by the philosophy of John Dewey. This method, called "clinical pragmatism," integrates clinical and ethical decision making. Clinical pragmatism focuses on the interpersonal processes of assessment and consensus formation as well as the ethical analysis of relevant moral considerations. : This response to Lynn Jansen's critique of clinical pragmatism concentrates on two themes: (1) contrasting approaches to moral epistemology and (2) the connection between theory and practice in clinical ethics. Particular attention is paid to the status of principles and the role of consensus, with some closing speculations on how Dewey might view the current state of bioethics.

There is a palpable malaise in American medicine as clinical practice veers off its moorings, swept along by a new commercialism that is displacing medical professionalism and its attendant moral obligations. Although the sociology of this phenomenon is complex and multifactorial, I argue that this move toward medical commercialism was accelerated by the abortive efforts of the Clinton Administration's Health Security Act. Through an analysis of performative speech I show that, although the Clinton plan drew on many strands of (...) speech about healthcare, it favored the discourse of health policy and health economics over that of clinical practice and professionalism. Though the Clinton plan failed, this new vocabulary of health economics has led us to imagine a new descriptive framework, which has commodified healthcare and commercialized the clinic. (shrink)

The forefront of neurological care—and the neuroethical issues and methods focal to such practice—wasn’t what I initially intended to do professionally, but I think that therein is a good lesson for young people’s career aspirations. Simply put, one doesn’t always know where they’ll end up at the beginning of the journey, and as Kierkegaard said, life is lived forward, but is understood backwards (Kierkegaard 1843).In the nineties and the early 2000s, I was trying to help improve the quality of care of people at the end of life, and I wrote a book, entitled The Palliative Ethic of Care: Clinical Wisdom at Life’s End (Fins 2006), in which I addressed notions of phronesis—practical wisdom—in integrating theory and practice toward improving how people die. I became interested in the Quinlan case (Quinlan 1976), and the right to die, and around the same time, I ran into a colleague of mine at Cornell: Dr. Nicholas D. Schiff. Dr. Schiff is a neurologist, who was a protégé of Fred Plum, who was the originator of the concept of the vegetative state with Bryan Jennett, back in 1972. Fred was both of our teachers here at Cornell. Niko (Dr. Schiff) was interested in patients with disorders of consciousness, and was beginning to envision doing work—that ultimately, we did—using deep brain stimulation (DBS) to try to treat patients in the minimally conscious state, a category that was subsequently codified in 2002.I realized that a whole population of people—with these disorders of consciousness—had been somewhat marginalized, and their neglect essentially devolves back to the considerations of the right to die. The right to die was established in the Quinlan case because Judge Hughes—the presiding chief judge of the New Jersey Supreme Court—talked about Ms. Quinlan’s loss of a cognitive, sapient state as being the moral warrant for her right to die, given the fact that it was viewed as a futile situation. El artículo pretende evaluar la crítica de Robert Talisse a la noción de democracia de John Dewey según la cual dicha noción sería incompatible con el pluralismo razonable de corte rawlsiano y devendría opresiva pues se funda en el ideal moral del crecimiento. Para ello, se reconstruye la “objeción pluralista” de Talisse. Posteriormente, se consideran los argumentos centrales con que Dewey sostiene su perspectiva, a saber: el argumento experimentalista y el argumento formativo. Recent global events demonstrate that analytical frameworks to aid professionals in healthcare ethics must consider the pervasive role of social structures in the emergence of bioethical issues. To address this, the authors propose a new sociologically informed approach to healthcare ethics that they term “social bioethics.” Their approach is animated by the interpretive social sciences to highlight how social structures operate vis-à-vis the everyday practices and moral reasoning of individuals, a phenomenon known as social discourse. As an exemplar, the (...) authors use social bioethics to reframe common ethical issues in psychiatric services and discuss potential implications. Lastly, the authors discuss how social bioethics illuminates the ways healthcare ethics consultants in both policy and clinical decision-making participate in and shape broader social, political, and economic systems, which then cyclically informs the design and delivery of healthcare. The COVID-19 pandemic that struck New York City in the spring of 2020 was a natural experiment for the clinical ethics services of NewYork-Presbyterian (NYP). Two distinct teams at NYP’s flagship academic medical centers—at NYP/ Columbia University Medical Center (Columbia) and NYP/ Weill Cornell Medical Center (Weill Cornell)—were faced with the same pandemic and operated under the same institutional rules. Each campus used time as an heuristic to analyze our collective response. The Columbia team compares consults during the pandemic with (...) the same period during the year prior. The Weill Cornell service describes the phases of the pandemic to depict its temporal evolution and subsequent ethical challenges. Both sites report that the predominant ethical challenges centered around end-of-life decision making, setting goals of care, and medical futility, all complicated by resource allocation questions and the ambiguity of state law under crisis standards of care. The Columbia campus saw a statistically significant increase in ethics consultations provided to Hispanic patients, perhaps reflective of the disproportionate burden of COVID-19 suffered by this demographic. While Weill Cornell and Columbia saw a surge in clinical ethics consultations, the two services assumed a more expansive role than one normally played in institutional life. Serving as intermediaries between frontline clinicians and senior hospital administrators, consultants provided critical intelligence to hospital leadership about the evolution of the pandemic, disseminated information to clinicians, and attended to the moral distress of colleagues who were asked to provide care under truly extraordinary circumstances. The COVID-19 surge in New York City revealed latent capabilities in ethics consultation that may prove useful to the broader clinical ethics community as it responds to the current pandemic and reconceptualizes its potential for future service. A nuestro juicio, esta obra al igual que El ser y la nada tiene como fundamento metodológico la llamada “ontología fenomenológica”. Con el fin de fundamentar esta tesis señalamos que el ego trascendente y el cogito tienen el mismo sentido ontológico que el ser-en-sí y ser-para-sí.

Dissecting Bioethics, edited by Tuija Takala and Matti Hayry, welcomes contributions on the conceptual and theoretical dimensions of bioethics. The department is dedicated to the idea that words defined by bioethicists and others should not be allowed to imprison people’s actual concerns, emotions, and thoughts. Multiple studies have been performed to identify the most common ethical dilemmas encountered by ethics consultation services. However, limited data exists comparing the content of ethics consultations requested by specific hospital specialties. It remains unclear whether the scope of ethical dilemmas prompting an ethics consultation differ between specialties and if there are types of ethics consultations that are more or less frequently called based on the specialty initiating the ethics consult. This study retrospectively assessed the incidence and content of ethics (...) consultations called by surgical vs. non-surgical specialties between January 1, 2013 to December 31, 2018 using our RedCap Database and information collected through the EMR via our Clinical and Translational Science Center. 548 total ethics consultations were analyzed. Our results demonstrate that more surgical consults originated from the ICU, as opposed to lower acuity units, and surgical patients were more likely to have a DNR in place. Surgical specialties were more likely to call about issues relating to withholding/withdrawing life-sustaining treatment, while non-surgical specialties were more likely to call about issues related to discharge planning. There appear to be morally relevant differences between consults classified as the “same” that are not entirely captured by the usual ethics consultations classification system. In conclusion, this study highlights the unique ethical issues experienced by surgical vs. non-surgical specialties. Ultimately, our data can help ethics consultation services determine how best to educate various hospital specialties to approach ethical issues commonly experienced within their field. (shrink)

Abstract:While the medical ethics literature has well explored the harm to patients, families, and the integrity of the profession in failing to disclose medical errors once they occur, less often addressed are the moral and professional obligations to take all available steps to prevent errors and harm in the first instance. As an expanding body of scholarship further elucidates the causes of medical error, including the considerable extent to which medical errors, particularly in diagnostics, may be attributable to cognitive (...) sources, insufficient progress in systematically evaluating and implementing suggested strategies for improving critical thinking skills and medical judgment is of mounting concern. Continued failure to address pervasive thinking errors in medical decisionmaking imperils patient safety and professionalism, as well as beneficence and nonmaleficence, fairness and justice. We maintain that self-reflective and metacognitive refinement of critical thinking should not be construed as optional but rather should be considered an integral part of medical education, a codified tenet of professionalism, and by extension, a moral and professional duty. Patients from religious minorities can face unique challenges reconciling their beliefs with the values that undergird Western Medical Ethics. This paper explores homologies between approaches of Orthodox Judaism and Islam to medical ethics, and how these religions’ moral codes differ from the prevailing ethos in medicine. Through analysis of religious and biomedical literature, this work examines how Jewish and Muslim religious observances affect decisions about genetic counseling, reproductive health, pediatric medicine, mental health, and end-of-life decisions. These traditions embrace a (...) theocentric rather than an autonomy-based ethics. Central to this conception is the view that life and the body are gifts from God rather than the individual and the primacy of community norms. These insights can help clinicians provide care that aligns Muslim and Jewish patients’ health goals with their religious beliefs and cultural values. Finally, dialogue in a medical context between these faith traditions provides an opportunity for rapprochement amidst geopolitical turmoil. (shrink)

El presente artículo aborda el tópico ‘racionalidad’ en la versión estándar del enfoque pragmadialéctico (PD) de argumentación, que pretende superar la dicotomía, entre los aspectos normativo y descriptivo, existente en los estudios sobre argumentación. Se señala que la pragmadialéctica asume ciertos postulados popperianos al conceptualizar su noción de racionalidad, y dado que también incluye elementos de filósofos como Searle y Grice, se indaga si las ideas de racionalidad de estos filósofos están presentes en el compromiso con la racionalidad de los (...) pragmadialécticos. Por otra parte se da cuenta de algunos nexos entre el pensamiento aristotélico y los tres filósofos señalados con el fin de aclarar la concepción que tienen los pragmadialécticos acerca de la racionalidad, estimulando así un regreso enriquecedor a las fuentes de la argumentación. Clinicians have an obligation to ensure that patients with adequate capacity can make autonomous decisions. Thus, patients who choose to forego treatment and leave hospitals “against medical advice” are typically allowed to do so. But what happens when they require clinicians’ assistance to physically leave? Is it incumbent upon clinicians to not only respect and fulfill patients’ requests with which they disagree, but to physically assist in their fulfillment? In The Healer's Power, Howard Brody placed the concept of power at the heart of medicine's moral discourse. Struck by the absence of “power” in the prevailing vocabulary of medical ethics, yet aware of peripheral allusions to power in the writings of some medical ethicists, he intuited the importance of power from the silence surrounding it. He formulated the problem of the healer's power and its responsible use as “the central ethical problem in medicine.” Through the prism of power (...) he refracted a wide range of ethical problems, from informed consent to truth-telling, from confidentiality to futility, from the physician's fantasies to the physician's virtues. At times this prism shed new light on old problems, enabling us to see from an unexpected angle the elements of which the problem was composed. Hasta ahora, Talavera es conocido sobre todo como el primer cronista de la Independencia de Chile. En el presente ensayo, abordaremos desde una perspectiva crítica la teorización sobre lo abyecto con el fin de aproximarnos a un análisis de las sociedades contemporáneas. En primer lugar, presentaremos una breve introducción en la que se perfilarán los orígenes psicoanalíticos y la influencia de estos en la comprensión de esta categoría, así como la fuerte carga política que ella arrastra desde sus inicios. En segundo lugar, se ofrecerán tres posibles criterios de satisfacción que pueden ayudar al espectador a identificar (...) cuándo se da lo abyecto en el ámbito artístico. I discuss three kinds of relationship between ends and means (or "things that promote ends") in the Aristotelian ethical theory, in order to clarify how moral virtues and phronesis are related both in adopting ends and in determining means for virtuous actions. Phronesis seems to be mainly charged with determining means for an end given by the moral virtues, but it must involve some conception of ends too. Phronesis cannot be parasitic on moral virtue concerning the conception (...) of ends, for otherwise it will lack intrinsic moral value. I argue that the intrinsic moral value of phronesis can be better understood through a certain kind of relation between means and ends that has not received much attention. (shrink)

Archival research reports that managers often use the FIN 48 uncertain tax liability accrual to manage earnings. To assess solutions to this problem, we deconstruct the ethical and psychological reasoning that leads to FIN 48 opportunistic behavior. Hence, we employ a survey of seasoned accounting managers to assess the influences of cynicism, two measures of moral disengagement, and pressure from a CFO on the propensity to engage in FIN 48 earnings management. Specifically, we manipulate the influence of the study (...) scenario supervisory CFO as either a latent bully or a transformational leader. While the CFO bully main effect condition enhances FIN 48 earnings management, the CFO transformational leader condition interacts with less cynical accounting managers to reduce FIN 48 earnings management. We also find that both dispositional trait and situational state moral disengagement factors independently mediate the relationship between the cynicism model antecedent and FIN 48 earnings management. Collectively, study findings provide implications for both theory and practice. (shrink)

De nos jours, la pensée de la mort est le lieu d'une interrogation métaphysique sur l'être ; la philosophie de l'histoire pense la fin à la lumière d'une exigence de justice ; la pensée de l'altérité est la postulation d'un dépassement du temps ; dans l'éthique de l'action, la notion d'événement introduit à une destinée de liberté ouverte sur une transcendance ; l'analyse du langage symbolique dévoile la dimension eschatologique de la raison dans sa recherche du vrai : autant d'ouvertures philosophiques sur l'espérance théologale. Is contemporaneous thought accessible to the biblical concept of the end of history ? With the help of different notions of time, universe and life-sciences have spread scenarios of the world’s end that pass on to philosophy the anguishing question of the future of humanity. In the past, gnostics elaborated a representation of broken time, which modern philosophies went about demythologizing in diverse ways : purely rationalistic morals, which at one time accept and another time refuse the idea of a moral end, utopian morals, vision of a cosmos ruled by mechanical laws, and the vision of a history empty of meaning and finality.Nevertheless, if temporality is inscribed in the heart of the real, the question of the end cannot be avoided. In our time, thinking about death leads to a metaphysical interrogation about being ; the philosophy of history thinks about the end in light of a demand for justice ; the idea of alterity postulates the overcoming of time; in the ethics of action, the notion of event introduces a destiny of freedom open to transcendence ; the analysis of symbolic language unveils the eschatological dimension of reason in its search for the true, – these are some of the philosophical openings to theological hope. The emphasis is on extensive textual analysis, concentrated mainly on the Nicomachean Ethics, but making a very generous use of all other writings of the Stagirite. After a long and interesting introduction on Aristotle's method in ethical investigations and on the evolution of his moral philosophy, comes a comprehensive treatment of his theory of happiness: happiness in general, happiness as virtue, happiness and the moral order, the realization of happiness in the practice of wisdom. If the book has (...) a general thesis, it is a kind of apology for Aristotelian ethics as a morality of activity and dynamism which, instead of only aiming at "the formal perfection" of the virtuous man of Plato, opens the way to a theological culmination, to a truly transcendent moral end. Despite an over-abundance of frequently unnecessary quotes from secondary sources, this very scholarly book is a valuable instrument for the systematic reading of the Philosopher from an ethical perspective.—M. In the second Critique, Kant claims that the moral law is given as a fact of reason. In this paper, contra the standard view, I argue that there is a non-dogmatic way of defending this claim. And Kant’s principle of morality is widely taken to be a formal principle. How then can such a formal principle be reconciled with our substantial moral end? In this paper, I also argue that Kant’s principle of morality can be construed as a (...) formal principle in the sense that it provides correctness conditions for moral laws, rather than providing specific moral laws.Dans sa deuxième Critique, Kant affirme que la loi morale se donne comme un fait de raison. Dans cet article, contrairement à la position standard, nous prétendons qu’il existe une autre façon — non dogmatique — de défendre cette affirmation. Par ailleurs, le principe de moralité de Kant est largement considéré comme étant formel. Comment un tel principe formel peut-il être réconcilié avec notre fin morale substantielle? Nous soutenons également que le principe de moralité de Kant peut être interprété comme un principe formel dans le sens où il fournit des conditions d’acceptabilité pour les lois morales, et non des lois morales spécifiques. O presente artigo visa demonstrar que os fins da política podem ser considerados como fins transpolíticos na medida em estão imbricados com o fim último do homem. O pensamento político de Tomás de Aquino (1225-1274) está exposto na sua filosofia prática ou moral, por exemplo, nas suas questões sobre as virtudes, de um modo especial quando trata da prudência e da justiça, bem como nas discussões sobre as formas de governo, as leis, o bem comum e o direito. Santo (...) Tomás, de certa forma, retoma as ideias de Aristóteles, todavia, trata da civitas ou melhor do regnum christiano, e não da polis grega. Os fins principais da política são: o bem comum, a vida virtuosa dos cidadãos e a felicidade (beatitude) na fruição divina. Demonstrar-se-á que o fim último do homem é um só, sendo os demais antecedentes ou meios para alcançar aquilo que todos desejam: a felicidade. Sem desconsiderar as diversas obras em que o autor trata de temas políticos, contudo, este artigo abordará as ideias da obra De regno. (shrink)

Este escrito plantea la complejidad sistémica del concepto crisis moral aplicada en la sociedad contemporánea, especialmente en el caso latinoamericano, lo que exige un estudio interdisciplinario para abordar el asunto. Ahora bien, se alude a una complejidad sistémica de la crisis moral por cuatro aspectos. En primer lugar, porque la moral, al ser un sistema normativo basado en el deseo de una sociedad mejor, nunca se sentirá satisfecha de la sociedad en la que se enmarca, lo que (...) provoca un permanente malestar. En segundo lugar, porque una crisis moral indica que no hay un acoplamiento entre la realidad de lo que se tiene con lo que se quiere, por lo que el acoplamiento deseado supone interrelacionar diversas variables sistémicas para que pueda suceder realmente un desarrollo moral (para lo cual se seguirá, con algunas correcciones, el modelo de desarrollo moral de Kohlberg), variables que son más complejas de lo que el sistema político cree o quiere hacer creer. En tercer lugar, porque afirmar la existencia de una crisis moral y, por tanto, la necesidad de acciones tendientes a resolverla, no implica que haya consenso sobre cuál es la moral que debe aceptarse ni sobre el camino a seguir para lograr dicho fin, para empezar porque es relativamente común que los agentes acusados de ser los causantes de la actual “crisis moral de la sociedad y del derecho” en las sociedades contemporáneas suelen ser los agentes que denuncian, como free riders, la misma crisis. Y, en cuarto lugar, porque un cambio sistémico que posibilite un salto en el desarrollo moral debe ser significativamente fuerte, y las medidas que suelen enunciarse para afrontarlo, además de no ser claras, suelen ser insuficientes o ingenuas (tales como pedir la creación o el fortalecimiento de una asignatura de ética en los planes de estudio de los futuros ciudadanos en general y abogados en especial). Finalmente, se propondrá partir de este diagnóstico sistémico e interdisciplinario para potencializar las respuestas que puedan darse para enfrentar la crisis; de lo contrario, lo rechazado permanecerá. El artículo analiza desde un punto de vista analítico las estructuras lógicas y lingüísticas del discurso moral y del discurso jurídico, en cuanto a sus códigos prescriptivos, con el fin de determinar la relación que existe entre ambos discursos. Aunque se han hecho esfuerzos a la largo de la historia por garantizar una esfera de autonomía en el sujeto moral, y por evitar la injerencia reguladora externa del brazo del Estado o el poder espiritual de alguna iglesia, no (...) se ha conseguido. Desde planteamientos diferentes se exigen conexiones entre derecho y moral, si bien las relaciones de fundamentación que se postulan entre ambos discursos son vagas y problemáticas. Vernengo rechaza una relación de subalternación del derecho con respecto a la moral. La moral más que fundamento lógico inmediato del derecho, establece un conjunto de razones, no las únicas pues existen otros ingredientes axiológicos, que justifican en los derechos positivos que instituyan deberes y derechos subjetivos. Esto implica rebajar la relación entre derecho y moral a una contingente constatación empírica. (shrink)

Según algunos intérpretes, el proceso que A. J Ayer y otros filósofos analíticos instruyeron a las pretensiones cognoscitivas de la ética no hubieran tenido lugar, al menos razonablemente, sí esos pensadores hubieran comprendido adecuadamente Ética a Nicómaco VI, 2, 1139 a 21-31, único texto en el que Aristóteles define la verdad práctica. La presente comunicación es un análisis de este texto aristotélico fundamental, del cual se desprende la existencia, no sólo de un conocimiento moral propiamente dicho, diferente del puramente (...) teórico, sino también de la verdad que le corresponde, la cual consiste en una conformidad no entre el dictum y el factum sino entre el juicio del intelecto práctico y el impulso del deseo correcto. Hay, pues, un conocimiento moral vivido, que se identifica con la deliberación sobre los medios por el fin de la acción, y una verdad práctica correspondiente, que consiste en la conformidad entre el juicio del intelecto práctico, perfeccionado por la phrónêsis, y el deseo correcto, propio del carácter perfeccionado por las virtudes morales. También hay un conocimiento moral pensado que, pese a las limitaciones de su objeto, es un conocimiento propiamente dicho. Aristóteles ha intentado superar estas limitaciones mediante una prolongada y asidua práctica del método. (shrink)

Le titre du livre éveillera sans doute la curiosité du lecteur intéressé par la critique sociale au sens large du terme, un peu moins peut-être celle du lecteur motivé par une réflexion centrée sur les problématiques épistémologiques propres aux sciences sociales; toutefois, la lecture complète pourra peut-être satisfaire la curiosité du premier; quant à celle du second, cela reste à mesurer. O Ideal do Reino dos Fins – apresentado por Kant com vistas à introdução de uma fórmula do Imperativo Categórico ‒ é muitas vezes interpretado como o elemento social do qual a teoria moral do autor careceria. Seres humanos seriam agentes morais concebidos como membros legisladores de uma ordem social possível. Contra essa interpretação argumentarei que a dimensão social introduzida pela concepção técnica desse Ideal é propriamente racional, apresentando uma exigência normativa genuinamente cosmopolita, que, não obstante, confere à teoria (...) os recursos para o tratamento moral adequado da sociabilidade de facto da agência moral, pois, afinal, as condições de nossa agência efetiva são sociais. La mort assistée par un prestataire est en passe de devenir l’une des principales causes de décès au Canada depuis l’adoption de la loi sur l’aide médicale à mourir (AMM) en 2016. Ce qui devait être exceptionnel est devenu courant; certains demandent qu’on s’y attende. De plus en plus de patients atteints de maladies chroniques non terminales sont euthanasiés. Le personnel de santé approuve et propose désormais des MAiD aux patients vulnérables qui sont dépressifs, handicapés, atteints d’une maladie chronique ou (...) appauvris. Cet article présente une justification du point de vue de la loi morale transcendante, traditionnellement appelée loi naturelle, pour expliquer pourquoi le Canada a maintenant le régime d’euthanasie le plus libéral au monde. L’acte d’euthanasie exige que le prestataire mette délibérément fin à la vie du patient en lui administrant une substance mortelle. Cette pratique est contraire à la loi morale transcendante : ne pas tuer. Dès lors qu’une culture rejette délibérément cette loi fondamentale et adopte une éthique utilitaire dépourvue de tout principe, à l’exception de la notion d’autonomie, il est inévitable que cette pratique entraîne une ambiguïté et une incertitude éthique. Au fur et à mesure que la pratique persiste et devient la norme, l’aveuglement moral se développe et conduit à des abus flagrants sur les êtres humains. Je présente un diagramme éthique, la courbe de dissociation morale, qui illustre la raison des tendances observées au Canada. Le système de santé canadien doit réaffirmer les principes de l’éthique hippocratique et la dignité inhérente de ses patients. Les professionnels de la santé doivent donner la priorité aux soins palliatifs de haute qualité, empreints de compassion, et dire « non » à l’idée de mettre délibérément fin à la vie de patients souffrants. Ce faisant, la clarté morale sera retrouvée et les plus vulnérables de la société seront protégés. (shrink)
