Moral perception has made something of a comeback in recent work on moral epistemology. Many traditional objections to the view have been argued to fail upon closer inspection. But it remains an open question just how far moral perception might extend. In this paper, I provide the beginnings of an answer to this question by assessing the relationship between the metaphysical structure of different normative properties and a plausible constraint on which properties are eligible for perceptual awareness which I call (...) the Counterfactual Strengthening Test. Along the way I consider and reject a few other possible constraints on perceptual awareness. I defend the view that moral perception is restricted to the perception of evaluative and pro tanto deontic properties. I conclude with a few gestures toward what this limitation on moral perception may mean for broader moral epistemology. (shrink)

The development of genomic technologies has seemed almost magical. Excitement about it, both in medicine and among the public, stems from the belief that genomic techniques will illuminate the causes of health and disease, will lead to effective interventions for both rare and common genetic conditions, and will inform reproductive decision‐making. Novel diagnostic tools, however, are often deployed before targeted therapies are developed, tested, or available and before their psychosocial implications are explored. Newer technologies such as prenatal whole exome screening (...) are seen as offering “decisional autonomy” to expectant parents, although such technologies identify information about genetic sequencing that may not have clear meaning. The “therapeutic gap” between the ability to conduct genetic sequencing and the ability to fully understand what the test results mean, much less what treatments to offer, leaves families with complex and unclear information they cannot act upon with confidence during pregnancy. In this essay, we will consider the psychosocial and ethical implications of such assumptions—and of the uncertain information produced by these technologies—for individuals and families and for societal aspects such as medical service usage and demographic inequities. Legal theory usually distinguishes only two kinds of legal realism: the American and the Scandinavian. Another school of this theoretical perspective is German legal realism, which refers to scholars like Ihering, Weber, and Schelsky. According to German legal realism, the author outlines what legal theory can do to persuade modern jurisprudence to face the social reality of law, conceived as institutionalized normative communication. The latter always occurs with reference to already valid and effectively operative legal norms which are used in (...) an established, normatively binding legal practice in a given regional society. In a recent article published in this journal, Kris McDaniel proposes a variant of Peter van Inwagen’s argument against the principle of sufficient reason that makes crucial use of plural grounding. In this response paper I object to McDaniel’s argument. I argue that there is no notion of plural grounding available that is both irreflexive in the sense required for the argument to go through and general enough to formulate the principle of sufficient reason as proposed by McDaniel.

The search for an ethics rooted in human experience is the crux of this deeply compassionate work, here translated from the 1983 German edition. Distinguished philosopher Werner Marx provides a close reading, critique, and Weiterdenken , or "further thinking," of Martin Heidegger's later work on death, language, and poetry, which has often been dismissed as both obscure and obscurantist. In it Marx seeks, and perhaps finds, both a measure for distinguishing between good and evil and a motive for preferring (...) the former. The poet Hölderlin posed the question, "Is there a measure on earth?" His own answer was emphatic, "There is none," for he was convinced that the measure for man was to be found only in the domain of the heavenly beings. Such metaphysical assumptions, as well as the attempt to found ethical conduct in the nature of man as a rational being, have been rejected by many contemporary thinkers, particularly Heidegger. Yet these thinkers have not been able to provide a satisfactory alternative to metaphysical foundations of the standards for responsible human conduct. Marx, therefore, goes beyond Heidegger in demonstrating how several of his most basic notions could be relevant to a secular morality in our age. It is death, Marx claims, that unsettles man and transforms his conduct toward his fellow man. the common experience of mortality nourishes ethical life--and leads to the measures of compassion, love, and recognition of one's fellow human beings. "It is only on the basis of these 'traditional virtues,'" Marx writes, "that we can find a motive for averting the impending dangers which have often enough been described so vividly and convincingly.". This study examines the public's and physicians' willingness to support deception of insurance companies in order to obtain necessary healthcare services and how this support varies based on perceptions of physicians' time pressures. Based on surveys of 700 prospective jurors and 1617 physicians, the public was more than twice as likely as physicians to sanction deception (26% versus 11%) and half as likely to believe that physicians have adequate time to appeal coverage decisions (22% versus 59%). The odds of public (...) support for deception compared to that of physicians rose from 2.48 to 4.64 after controlling for differences in time perception. These findings highlight the ethical challenge facing physicians and patients in balancing patient advocacy with honesty in the setting of limited societal resources. (shrink)

Advances in science and technology have added to our insights into the vulnerabilities of human agency as well as to the methods of exploiting them. This has raised the stakes for efforts to clarify the concept and ethics of manipulation. Among these efforts, Robert Noggle’s influencer-centered account of manipulation has been most significant. He defines manipulative acts as those whereby an agent intentionally influences a recipient’s attitudes so that they do not conform as closely as they otherwise would to the (...) pertinent norms and ideals endorsed by the influencer. This provides a relatively simple and in many ways clear definition of manipulation. It sidesteps thorny debates about autonomy, freedom, or practical rationality. It also promises to reveal a conceptual parallel between manipulating and lying, and thus to explain why manipulation is pro tanto wrong. In one respect, however, the account remains ambiguous: It remains unclear whether, and to what extent, it requires that influencers’ beliefs about what is ideal for their recipients to be grounded in some effort on the part of the influencer to identify with or take on the role of her recipient. This paper explains this ambiguity. It argues that influencer-centrism cannot remain indifferent to the validity of an agent’s beliefs about the ideal state of the recipient and provide an identification requirement that would render the whole account plausible and sufficiently determinate. Summary In this paper I inquire by way of a phenomenological description whether the experience of an encounter with one's own mortality could not so transform a person's ethos that the virtues of justice, compassion and neighborly love could ensue. I will concentrate on such an encounter in and through the mood of dread. This paper, in opposition to Heidegger, is only concerned with it's effect regarding our ethical comportment. I claim that the mood of dread not only destroys the (...) mood of indifference, but also sends him on a pathway of self‐transforming moods. As to the “understanding” accompanying moods in the field of ethical comportment I try to show that it has the character of a direct non‐ratiocinative insight.RésuméJe voudrais dans cet article examiner, à l'aide d'une description phénoménologique, si l'expérience que constitue la rencontre avec la perspective de sa propre mort ne peut pas transformer l'éthique d'un homme de telle manière que les vertus de justice, de pitié et de reconnaissance de la dignité humaine puissent s'y développer. Je me limite ici à une telle rencontre avec un sentiment d'horreur. Cet article n'aborde — contrairement à la manière dont Heidegger conçoit l'angoisse — que l'effet sur le comportement éthique. Je suis d'avis que le sentiment d'horreur non seulement détruit celui d'indifférence, mais dispose l'homme à vouloir se changer lui‐me̊me. Quant à la »compréhension« des sentiments accompagnant le comportement éthique, je montre qu'elle a le caractère d'une intuition immédiate et non rationnelle.ZusammenfassungIn diesem Aufsatz möchte ich auf dem Wege einer phänomenologischen Beschreibung untersuchen, ob die Erfahrung einer Begegnung mit der eigenen Sterblichkeit das Ethos eines Menschen nicht so verwandeln kann, dass sich die Tugenden von Gerechtigkeit, Mitleid und mitmenschlicher Anerkennung entwickeln können. Ich beschränke mich dabei auf eine solche Begegnung in der und durch die Gestimmtheit des Entsetzens. Dieser Aufsatz erörtert — im Gegensatz zu Heideggers Auffassung der Angst — nur die Wirkung auf unser ethisches Verhalten. Ich bin der Auffassung, dass die Gestimmtheit des Entsetzens nicht nur die Stimmung der Gleichgültigkeit zerstört, sondern den Menschen auch auf einen Weg der selbstverändernden Gestimmtheiten sendet. Was das »Verstehen« begleitender Stimmungen im Bereich des ethischen Verhaltens betrifft, so versuche ich zu zeigen, dass dies den Charakter eines unmittelbaren, nicht‐rationalen Einsehens hat. Der Band geht interdisziplinar der Frage nach, wie sich Sorge als existenzielle Grundkonstante in modernen Gegenwartsgesellschaften manifestiert. Konzeptuell liegt den Beitragen eine Unterscheidung von drei Dimensionen der Sorge zugrunde: die Sorge um sich, die Sorge um andere und die Sorge um die Umwelt. Diese Dimensionen werden dabei auch in einer genealogischen Perspektive betrachtet. Dadurch wird ein umfassendes Forschungsfeld eroffnet, in dem heterogene empirische Phanomene, komplexe gesellschaftliche Entwicklungen und zentrale ethische Fragestellungen in einer theologischen, sozialwissenschaftlichen und philosophischen Perspektive bearbeitet werden. Ziel (...) des Forschungsfeldes ist es, durch die wechselseitige Bezugnahme dieser Perspektiven Sorge als ein Schlusselkonzept zur Analyse der spatmodernen Gesellschaft zu nutzen und zu etablieren. I discuss various reactions to my article “Again, what the philosophy of science is not” [Callebaut (Acta Biotheor 53:92–122 (2005a))], most of which concern the naturalism issue, the place of the philosophy of biology within philosophy of science and philosophy at large, and the proper tasks of the philosophy of biology.

It is commonly presupposed that there are no decisive differences between empathy with fictional characters on one hand and empathy with real persons on the other. I distinguish two types of processes of affect recognition "Perceptual Affect Recognition" and "Affective Affect Recognition". The consensus view about empathy with fictional characters has to be challenged if "empathy" refers to the former or the latter process because of the significant differences between the fictional and the non-fictional scenario: firstly, readers as "empathizers" cannot (...) perceive the fictional target person directly but only the literary text. This is especially problematic for Affective State Recognition. Secondly, fictional characters do not exist, at least not in the sense that they are real people or entities with mental states which leads to relevant differences of the accuracy conditions of Affective Affect Recognition in the fictional and the nonfictional scenario. Conceptual research is interdisciplinary in two regards. On the one hand, various disciplines have developed various approaches to conceptual research. These range from conceptual analysis and conceptual history in philosophy, Begriffsgeschichte in historical and literary studies to term-related semantics in linguistics and conceptual research in psychoanalysis. On the other hand, concepts play a key role in any cooperation within interdisciplinary research projects. If they remain undiscussed and unmediated between the participating disciplines, they tend to impede productive cooperation. This contribution provides (...) an overview of different forms of conceptual research and introduces the approach of Experimental Conceptual Research as a technique of conceptual reflection, which unifies approaches of various disciplines by going back to an investigation of those criteria that become effective in the practice of concept formation and usage. As a criterial investigation, it starts at the level of conceptualizing phenomena within the course of research. In this way, premature fixations of conceptually filtered perceptions can be avoided, allowing the discovery of distinguishing features in phenomena to pave the way for forms of interdisciplinary cooperation that are deeply anchored in material content. I focus on the relationship between the coalition of ideas including constructivism and enactivism on the one side, and ontology in general on the other. Based on a certain logico-phenomenological attitude that dominated Polish philosophy in the 20th century I argue that ontology as such is not burdened with realistic or representationalist presumptions. Finally, certain more specific issues raised by the commentators are also addressed, including the very usability of the notion of cognitive niche and its role when it comes (...) to the problem of presentation. Der logische Status dessen, was in der Hegelschen Terminologie «Begriff» heisst, kann nur als seine eigene Genese zur Darstellung kommen. In ihm sind die Formen der Positivität, die durch die Subjekt-Objekt-Relation charakterisiert sind, als Momente enthalten. Die Einsicht in die einzelnen Formen der Positivität ermöglicht es, sich einen Begriff von der Sprachlichkeit des Selbstbewusstseins zu machen.

Corruption continues to be a considerable challenge for internationally active companies. In this article, we examine personal and socioenvironmental antecedents of corrupt behavior in organizations. In particular, we aim to illuminate the links between Machiavellianism, on-the-job experience with corrupt behavior at work, neutralization, and the attitude of business professionals toward corruption. The empirical analysis is based on the responses of 169 professionals. At first, a positive relationship between both Machiavellianism and on-the-job experience and the acceptance of corruption appears in the (...) model. However, an in-depth mediation analysis shows that neutralization is the keystone linking both Machiavellianism and on-the-job experience to the likelihood to condone corruption. Based on these results, we offer avenues for further research and implications for practitioners. (shrink)

In the Phaedo the character Socrates argues that suicide is morally wrong. This is in fact one of only two places in the entire Platonic corpus where suicide is discussed. It is a brief passage, and a notoriously perplexing one. In this article, I distinguish between two arguments that Socrates gives in support of his claim. I argue that one of them is not to be taken literally, while the other represents the deeper reason for the prohibition of suicide. I (...) further relate the question of suicide to the overarching concerns of the Phaedo as a whole: the nature of our incarnate “imprisonment”, the nature and purpose of philosophy, the philosophical “purification” of the soul, the human pursuit of knowledge, and the nature of the divine.
