How far should religious practices be curtailed in pursuit of other social goals, such as equality and the removal of discrimination? This book reasons that religious freedom is one of our most precious freedoms, and essential to democracy, drawing on examples from across the Western world.

The work of the later Schelling seems antithetical to that of Nietzsche: one a Romantic, idealist and Christian, the other Dionysian, anti-idealist and anti-Christian. Still, there is a very meaningful and educative dialogue to be found between Schelling and Nietzsche on the topics of reason, freedom and religion. Both of them start their philosophy with a similar critique of the Western tradition, which to them is overly dualist, rationalist and anti-organic. In response, they hope to inculcate a more (...) lively view of reality in which a new understanding of freedom takes center stage. This freedom can be revealed and strengthened through a proper approach to religion, one that neither disconnects from nor subordinates religion to reason. Religion is the dialogical other to reason, one that refreshes and animates our attempts to navigate the world autonomously. In doing so, Schelling and Nietzsche open up new avenues of thinking about freedom, reason and religion. (shrink)

In this short article, my aim is to introduce readers to some debates about religious freedom and constitutional law in the United States. I highlight a few of the enduring questions debated by political philosophers and legal scholars. For example, does the Constitution require special religious exemptions for citizens whose religious convictions put them at odds with otherwise neutral and legitimate state pol- icy? Should the Constitution be interpreted as supporting a strict secularism or a multicultural egalitarian liberal position? (...) What are the limits to religious freedom? To illustrate how these and related questions are debated I consider some recent work on religious freedom jurisprudence in the United States. (shrink)

This paper develops analogies concerning the evolution of dissipative structures in nonequilibrium thermodynamics to interpret irrational human behavior in which one finds a lack of correspondence between the invested means and the consequences observed. In an attempt to positively explain the process of cooperation between the free human person and interacting God, I use philosophical categories of Whitehead's process philosophy in an aesthetic model that opposes composition and performance in a musical symphony. Certainly, the essence of human freedom can (...) be expressed in neither thermodynamical nor aesthetic terms. The models proposed can, however, facilitate our understanding of the mutual relations between God's action in the world and the drama of human free choice of moral evil. (shrink)

_Freedom and Tradition in Hegel _stands at the intersection of three vital currents in contemporary ethics: debates over philosophical anthropology and its significance for ethics, reevaluations of tradition and modernity, and a resurgence of interest in Hegel. Thomas A. Lewis engages these three streams of thought in light of Hegel’s recently published _Vorlesungen über die Philosophie des Geistes_. Drawing extensively on these lectures, Lewis addresses an important lacuna in Hegelian scholarship by first providing a systematic analysis of Hegel’s philosophical anthropology (...) and then examining its fundamental role in Hegel’s ethical and religious thought. Lewis contends that Hegel’s anthropology seeks to account for both the ongoing significance of the religious and philosophical traditions in which we are raised and our ability to transcend these traditions. Pursuing the implications of the integral role of practice in Hegel’s anthropology, Lewis argues for a more progressive interpretation of Hegel’s ethics and a “Hegelian” critique of Hegel’s most problematic statements on political and social issues. A liberal pluralist state recognizes that its members exercise a variety of religions or hold diverse comprehensive doctrines, and strives for neutrality so that none is favored. Neutrality can come into tension with the demands of individuals to express their religion in public spaces. I focus on a display of a “finals tree,” that many regard as a Christmas tree, on the campus of a public university, a display objected to by a small minority of non-Christian faculty and students (...) who claim it makes them ‘outsiders’ and should be removed. While display of a Christmas tree doesn’t violate the First Amendment because the Court has ruled it is a secular symbol, resolving that legal issue doesn’t resolve the ethical issue of which side should accommodate the other. To address that, I turn to traditional theories of Kant and Mill, who would side with the tree displayers, who are causing no harm and restricting no one else’s liberty. Finding this resolution wanting, I develop a modified version of Jeremy Waldron’s ‘adequacy’ principle, which has us be sensitive to the aims of others when our actions keep them from adequately pursuing their legitimate aims, so long as accommodating them does not keep us from adequately pursuing our own. I depart from Waldron in arguing that in assessing each side’s claims we should sometimes conduct a limited inquiry into the sincerity of one’s religious reasons, and this inquiry would not be incompatible with liberal pluralism’s requirement that we appeal to public reason. A radical suspicion regarding the value of productivity figures centrally in the work of Herbert Marcuse. In his view, socially necessary productivity historically constituted the primary hindrance to achieving human potential. In Eros and Civilization he argues, “The work that created and enlarged the material basis of civilization was chiefly labor, alienated labor, painful and miserable—and still is.”1 He makes a similar point in One-Dimensional Man, but in more hopeful terms, when he suggests that “truth and a true human existence” (...) stand just beyond “the realm of necessity.”2 Thus, on the one hand, the technological advancement of industry opens the…. Kant’s account of “the radical evil in human nature” in the 1793 Religion within the Bounds of Reason Alone is typically interpreted as a reworking of the Augustinian doctrine of original sin. But Kant doesn’t talk about Augustine explicitly there, and if he is rehabilitating the doctrine of original sin, the result is not obviously Augustinian. Instead Kant talks about Stoic ethics in a pair of passages on either end of his account of radical evil, and leaves other clues (...) that his argument is a reworking of an old Stoic problem. “Radical evil” refers to the idea that our moral condition is — by default and yet by our own deed — bad or corrupt; and that this corruption is the root (radix) of human badness in all its variety, ubiquity, and sheer ordinariness. Kant takes as his premise a version of the Stoic idea that nature gives us “uncorrupted starting points” (Diogenes Laertius 7.89). What sense can be made of the origin of human badness, given such a premise? Kant’s account of radical evil is an answer to this old Stoic problem, which requires a conception of freedom that is not available in his Stoic sources. (shrink)

The editors of the JRE collected short essays from scholars of religion in response to a recent incident at Hamline University that made national headlines. Last fall, Hamline University administrators refused to extend a contract to an adjunct professor of art history after a Muslim student accused her of Islamophobia for showing a 14th‐century image of Mohammad in an online class. The event provoked intense conversations about issues of academic freedom, religious diversity, the status of contingent faculty, and (...) race. It is debated among open theists whether propositions about the contingent future should be regarded as straightforwardly true or false, as all false without exception, or as lacking truth-values. This article discusses some recent work on this topic and proposes a solution different than the one I have previously endorsed.

There have recently been a number of high profile political incidents, and legal cases, that raise questions about hate speech. At the same time, the tensions, and perceived conflicts, between religion and sexuality have become controversial topics. This paper considers the relationship between religious freedom, free speech and equality through an analysis of recent case law in Great Britain, Canada and the United States. The paper starts with a discussion of how conflicts between these values arise in areas (...) such as hate speech and explores the differences between the European and US approach to this issue. In Council of Europe member states there is an increasing use of the criminal law to regulate hate speech. This paper argues that criminalisation of hate speech poses a distinct risk to the values of free speech and proposes alternative non-legal responses such as a greater use of cultural policy. The paper also explores a range of cases where the religion and sexual orientation conflict has arisen in areas such as the workplace. An analysis of these cases suggests that although there is no perfect resolution of this issue, it is possible to develop a set of principles that encourage a balance between the values of religious freedom, free speech and equality even in difficult situations where there is a conflict between religion and sexuality. The paper concludes with some practical recommendations for managing the tensions or conflicts between religious freedom, free speech and equality in liberal democracies. (shrink)
