Dans ce texte, je propose d’adapter la théorie de l’agentivité collective de List et Pettit de manière à considérer les nations comme des agents. Cet exercice pourrait ainsi conférer un argument supplémentaire aux théories des droits collectifs s’intéressant aux groupes nationaux puisque ces derniers pourront véritablement être reconnus comme des sujets de droits, capables d’autodétermination et de revendications morales. La théorie des droits collectifs de Seymour sera utilisée comme modèle à cet égard. Bien que le libéralisme politique dans lequel s’inscrit (...) Seymour refuse de se prononcer sur des problèmes métaphysiques, il est intéressant d’ouvrir la possibilité conceptuelle que des groupes nationaux soient des agents à part entière. Pour ce faire, il faudra déterminer comment un agent national peut prendre des décisions et comment il peut subir des actions, en plus d’étudier ce que cela pourrait impliquer pour la responsabilité collective des nations. Cet article explore les conséquences pour le libéralisme politique de considérer l’existence d’un pluralisme raisonnable au sujet des différentes conceptions du juste. Comment une conception publique de la justice peut se développer malgré un désaccord raisonnable et profond sur les termes mêmes de cette justice ? En comparant le libertarisme, la justice comme équité et l’égalitarisme strict, il sera montré que les concepts fondamentaux de ces conceptions du juste sont essentiellement contestés. En guise de solution, deux conditions seront suggérées afin (...) de faire en sorte que la conception publique de la justice en soit une de tolérance politique : premièrement, elle devra se baser sur une liste de droits minimaux reconnus par les différentes conceptions raisonnables du juste; et deuxièmement, si la conception publique de la justice a pour ambition de se développer au-delà du dénominateur commun, elle devra offrir des mesures compensatoires à ceux supportant des conceptions du juste plus restrictives. Le rapport Sarr-Savoy sur la restitution du patrimoine africain a provoqué controverses et crispations. Quels peuvent être les critères de restitution des objets? Les modes d’acquisition, les usages dans le contexte culturel d’origine, les modalités de retour en Afrique? Il s’agit ici de faire un pas de côté par rapport au débat sur le devenir des musées détenteurs de collections coloniales, particulièrement euro centré. La restitution n’est pas seulement le déplacement physique d’un artefact d’un musée à un autre, elle (...) est un geste symbolique. Ainsi, dans les angles morts de la restitution formelle, cette Mineure recherche des formes alternatives de restitution de basse intensité, à partir desquels pourrait s’ouvrir de nouveaux horizons d’appropriation. Ce texte offre quelques réflexions épistémologiques et méthodologiques en réponse au texte d’Antoine Boudreau LeBlanc qui plaide pour une bioéthique renouvelée, capable de faire le lien entre science et politique afin de relever les défis majeurs auxquels l’humanité est actuellement confrontée. Cette proposition apparait nécessaire, compte tenu du paradoxe qui émerge du fait que l’expertise et la spécialisation grandissante ne se traduisent pas toujours par des solutions aux problèmes complexes qui affligent l’humanité. Il apparaît nécessaire de réfléchir à la (...) nature même de ces problèmes et de reconnaitre qu’ils se situent à une échelle qui dépasse l’individu. De même, il apparait nécessaire de considérer la dimension pratique de mise en oeuvre des solutions proposées. L’ouverture épistémique de la bioéthique semble être un atout important à cet égard. Toutefois, on peut se demander si le potentiel d’hybridation entre les savoirs défendu par Boudreau LeBlanc risque d’être atténué par la professionnalisation et la centralisation de la médiation entre ceux-ci. De même, il importe de préserver le caractère distinctif de la bioéthique. (shrink)

La philosophie médiévale du langage présente deux séries d’affinités remarquables avec les approches contemporaines. L’une se situe du côté des sémantiques formelles et, plus généralement, des analyses logiques des conditions de vérité des énoncés. L’autre relève plutôt de la pragmatique, notamment des perspectives contextuelles sur les actes de langage. Les logiciens, grammairiens et théologiens du Moyen Âge étaient, de fait, pleinement conscients qu’ils avaient à leur disposition deux types d’approche des énoncés, selon qu’ils prenaient en compte les seules propriétés (...) sémantiques de leurs composants ou qu’ils intégraient des considérations extralinguistiques allant de l’intention des auteurs / locuteurs à leur statut, en passant par le contexte d’énonciation. Chacune de ces perspectives a bénéficié d’un certain nombre d’études récentes ; la question que je voudrais aborder est plutôt celle de leur frontière en logique, de son emplacement, ses déplacements, sa porosité éventuelle. La complexité des matériaux en jeu ne permettra pas de proposer plus que quelques points de repères, qui peuvent toutefois aider à évaluer l’hypothèse d’un « projet formel » en sémantique médiévale. Présentation d'une nouvelle traduction de la Bible publiée chez Bayard, sous la direction de Frédéric Boyer, Jean-Pierre Prévost et Marc Sevin, et réalisée conjointement par vingt écrivains et vingt-sept exégètes. Ecrite dans une langue résolument contemporaine, elle rend des couleurs aux mots de la Bible et cherche à honorer les différents styles qui y sont représentés. On regrette cependant que les droits de l'intertextualité biblique y soient souvent méconnus et que la traduction des synoptiques soit si disparate. Le travail (...) d'exégèse des textes est parfois poussé très loin. Cette nouvelle traduction vient combler un vide parmi la production francophone, à côté des bibles d'étude , qu'elle ne remplace pas. (shrink)

Although an invasive medical intervention, Deep Brain Stimulation (DBS) has been regarded as an efficient and safe treatment of Parkinson’s disease for the last 20 years. In terms of clinical ethics, it is worth asking whether the use of DBS may have unanticipated negative effects similar to those associated with other types of psychosurgery. Clinical studies of epileptic patients who have undergone an anterior temporal lobectomy have identified a range of side effects and complications in a number of domains: psychological, (...) behavioural, affective and social. In many cases, patients express difficulty adjusting from being chronically ill to their new status as ‘treated’ or ‘seizure free’. This postoperative response adjustment has been described in the literature on epilepsy as the ‘Burden of Normality’ (BoN) syndrome. Most of the discussion about DBS postoperative changes to self is focused on abnormal side effects caused by the intervention (ie, hypersexuality, hypomania, etc). By contrast, relatively little attention is paid to the idea that successfully ‘treated’ individuals might experience difficulties in adjusting to becoming ‘normal’. The purpose of this paper is (1) to articulate the postoperative DBS psychosocial adjustment process in terms of the BoN syndrome, (2) to address whether the BoN syndrome illustrates that DBS treatment poses a threat to the patient’s identity, and (3) to examine whether the current framework for rehabilitation after DBS procedures should be updated and take into account the BoN syndrome as a postoperative self-change response. Le Prince est de toutes les oeuvres de la pensée politique la seule qui ait durablement accroché l'intérêt des hommes de gouvernement : Charles-Quint en avait fait un de ses livres de chevet, Frédéric II s'efforça de le réfuter, Napoléon voulut qu'il fût dans ses bibliothèques successives, Mussolini en écrivit une préface. Staline l'annota. Hitler dit l'avoir lu et (...) relu. Du côté des écrivains et philosophes, la liste est longue et prestigieuse : Bodin, Bacon, Marlowe, Spinoza, Montesquieu, Rousseau, Hegel, Nietzsche... Mais qu'y a-t-il donc dans ce livre ambigu, écrit avec brio et semé de contradictions? Pour tenter d'y voir clair, Philippe Bénéton mène une vaste enquête sur l'art d'écrire du Florentin : des explications de texte serrées, une analyse systématique des sources, la confrontation du témoin Machiavel avec l'histoire de son temps. D'étape en étape, les brouillards se dissipent. Machiavel apparaît comme un maître dans l'art de la rhétorique. Quant à son intention profonde, il s'avère qu'elle n'est guère au diapason de ce que dit la doxa contemporaine. Il y avait une énigme Machiavel : voilà sa solution machiavélique. (shrink)

The traditional international law of self-defense provides little indication about how far states should be willing to defend. That choice is better understood as constrained, beyond the jus in bello and the jus ad bellum, by human rights norms that implicate responsibilities of the sovereign vis-à-vis its own population. Different conceptions of human rights, however, underscore different possible theories of the extent of self-defense. The main polarity is between a conception of self-defense as protecting bare life and a conception of (...) self-defense as protecting collective self-determination. In the practice of justifying particular uses of self-defense, these foundations are constantly and dynamically rearticulated to justify fighting on, surrendering, or negotiating. This raises questions about the impact of conditions of uncertainty, different conceptions of agency, and the role of the international community. Ultimately, the article suggests that self-defense radicalizes anxieties about the foundation and finality of rights. (shrink)

Trois nouvelles catégories semblent nécessaires à côté du sublime et du beau, pour rendre compte de la manière dont les expériences privées façonnent les discours esthétiques : le mignon qui renvoie à Adorno et à la consommation, le zinzin qui renvoie à Nietzsche et à la production, l’intéressant qui renvoie à Frédéric Schlegel et à la circulation.

Building on Merleau-Ponty’s recognition of the mutually expressive relation between the body and the space it occupies, I borrow from queer and feminist phenomenologies to reflect on the spatiality of subjects constrained to heterosexuality – a constraint that functions as a common ground, always already present, of the kind that Merleau-Ponty argued was constitutive of subject/world relations. If it is the case, as many feminist theorists after Adrienne Rich argued, that the patriarchal norm orients us early on toward the opposite (...) gender, then there is much to be learned from studying the notion of feminine space and the erasure of the subject in this space -an erasure that has been largely discussed within recent feminist phenomenological work, notably in relation to the contrasting extension of men in space –, particularly as both are established in relation to male desire. Our aim is to argue that because it is temporal, and because it involves sedimentation and habit, the study of this orientational constraint through the lens of Merleau-Ponty could allow us to open up the future of gendered norms, and, through this, of gendered practices of sharing space. It is argued that, despite the neglect which Heidegger’s writings on science have generally received, the “fundamental ontology” of Being and Time reveals certain structures of experience crucial for our understanding of science; and that, as these insights cast considerable doubt upon the validity of the empiricist/positivist conception of science, Heidegger deserves considerably better treatment as an incipient philosopher of science than has been the case thus far. His arguments for the distortive effects of the alleged “change over” from praxis (...) to theoria, for the circularity of all human understanding (including scientific understanding), for the necessity of interpreting scientific method in terms of the hermeneutic circle, and for viewing scientific “crises” in ontological terms, are examined and evaluated. The article concludes with some reflections on the later Heidegger’s views on the limits of his earlier idea of science. (shrink)

According to Thagard and Stewart :1–33, 2011), creativity results from the combination of neural representations, and combination results from convolution, an operation on vectors defined in the holographic reduced representation framework. They use these ideas to understand creativity as it occurs in many domains, and in particular in science. We argue that, because of its algebraic properties, convolution alone is ill-suited to the role proposed by Thagard and Stewart. The semantic pointer concept allows us to see how we can apply (...) the full range of HRR operations while keeping the modal representations so central to Thagard and Stewart’s theory. By adding another combination operation and using semantic pointers as the combinatorial basis, this modified version overcomes the limitations of the original theory and perhaps helps us explain aspects of creativity not covered by the original theory. While a priori reasons cast doubts on the use of HRR operations with modal representations :5039–5054, 1987) such as semantic pointers, recent models point in the other direction, allowing us to be optimistic about the success of the revised version. In sum, major critics of the twentieth century continually insist that poetry's unique value lies in its ability to convey meanings for which there are no public criteria whatsoever. But there are no such meanings, and to praise a poem for conveying them is empty. Again, these critics assume that what we understand by emotion is to be identified simply with an inner experience or state of mind and that this state of mind is what is conveyed by, or gives (...) meaning and definition to, words which are used to refer to our emotional life. The emotions or qualities of emotions supposedly communicated by poetry alone, moreover, are said to elude public language altogether; they can be neither defined nor discussed but only embodied in images. But whatever the status these private experiences have for us, they as yet play no part in our language, even our poetic language, and reference to them certainly contributes nothing to our criticism of poetry. Criticism can play a central role in interpreting and shaping our lives, but it will only be worth writing if its vocabulary has content. En nous basant sur une théorie de la réception des œuvres, nous proposerons une lecture des appréhensions habituelles des modalités courantes au Japon par le renvoi aux formules de Nishida concernant l’acte artistique. Dès lors se croisent deux notions de marginalité. Surveillance programs supporting the management of One Health issues such as antibiotic resistance are complex systems in themselves. Designing ethical surveillance systems is thus a complex task (retroactive and iterative), yet one that is also complicated to implement and evaluate (e.g., sharing, collaboration, and governance). The governance of health surveillance requires attention to ethical concerns about data and knowledge (e.g., performance, trust, accountability, and transparency) and empowerment ethics, also referred to as a form of responsible self-governance. Ethics in reflexive governance (...) operates as a systematic critical-thinking procedure that aims to define its value: What are the “right” criteria to justify how to govern “good” actions for a “better” future? The objective is to lay the foundations for a methodological framework in empirical bioethics, the rudiments of which have been applied to a case study to building reflexive governance in One Health. This ongoing critical thinking process involves “mapping, framing, and shaping” the dynamics of interests and perspectives that could jeopardize a “better” future. This paper proposes to hybridize methods to combine insights from collective deliberation and expert evaluation through a reflexive governance functioning as a community-based action-ethics methodology. The intention is to empower individuals and associations in a dialogue with society, which operation is carried out using a case study approach on data sharing systems. We based our reasoning on a feasibility study conducted in Québec, Canada (2018–2021), envisioning an antibiotic use surveillance program in animal health for 2023. Using the adaptive cycle and governance techniques and perspectives, we synthesize an alternative governance model rooted in the value of empowerment. The framework, depicted as a new “research and design (R&D)” practice, is linking operation and innovation by bridging the gap between Reflexive, Evaluative, and Deliberative reasonings and by intellectualizing the management of democratizing critical thinking locally (collective ethics) by recognizing its context (social ethics). Drawing on the literature in One Health and sustainable development studies, this article describes how a communitarian and pragmatic approach can broaden the vision of feasibility studies to ease collaboration through public-private-academic partnerships. The result is a process that “reassembles” the One Health paradigm under the perspective of global bioethics to create bridges between the person and the ecosystem through pragmatic ethics. (shrink)

The personhood of the physician is a crucial element in accomplishing the goals of medicine. We review claims made on behalf of the humanities in guiding professional identity formation. We explore the dichotomy that has evolved, since the Renaissance, between the humanities and the natural sciences. The result of this evolution is an historic misconstrual, preoccupying educators and diverting them from the moral development of physicians. We propose a curricular framework based on the recovery of Aristotelian concepts that bridge identity (...) and activity. The humanities and the natural sciences, jointly and severally, can fulfill developmental, characterological and instrumental purposes. (shrink)

Potterian bioethics plays a proactive role, when carried out in collaboration with multidisciplinary teams with a mandate to operationalize public policy, as highlighted in the Canadian Journal of Bioethics in 2022 where several articles on Van Rensselaer Potter’s thinking appeared on the 50th anniversary of the first publication of the term bioethics in the North American literature. This global perspective, which is still insufficiently detailed, critically reflects on the place, the role and the imperative of bioethics as an adaptive management (...) of the environment; and it aims to accompany empirical projects in the operation of their scientific, political and public visions, which are sometimes synergistic, and other times conflicting. In order to specify the operationalization of this global perspective of bioethics, it is pertinent to mobilize theoretical notions from sociology and philosophy of science, in particular the Latourian concept of Hybrid Forum and the Paradigm associated to Thomas Kuhn. To illustrate this, the argument presented here mobilizes the empirical case of a project to design a monitoring of antibiotic use in Quebec, Canada (2018-2022), and expands on the importance of being aware of context (technological, sociological and anthropological) in order to deepen and pose constructive criticism. This article presents an alternative perspective to the act of governing by proposing a proactive process of governance. (shrink)

By taking account of people's understandings, Professor Schick is able to expand the current theory of decision and action. The author provides a perspective on the topic by outlining its history. He defends his new theory against criticism, considers its formal structure, and shows (...) at length how it resolves many currently debated problems: the problems of conflict and weakness of will, Allais' problem, Kahneman and Tversky's problems, Newcomb's problem, and others. This paper studies welfare tradeoffs in two-sided, one-to-one matching markets. We begin by providing theoretical upper bounds on a utilitarian price of stability, and show that these bounds vary with the composition of participants’ ordinal preference lists. We then turn to simulation experiments to describe how changes in basic characteristics of agents’ preferences can increase or decrease the average price of stability as measured by both utilitarian and Rawlsian welfare criteria. Our results indicate that markets featuring moderate degrees of correlation (...) and positive intercorrelation in the preferences of participants exhibit the steepest tradeoffs between stability and utilitarian welfare and between stability and Rawlsian welfare. Phronesis is often described as a ‘practical wisdom’ adapted to the matters of everyday human life. Phronesis enables one to judge what is at stake in a situation and what means are required to bring about a good outcome. In medicine, phronesis tends to be called upon to deal with ethical issues and to offer a critique of clinical practice as a straightforward instrumental application of scientific knowledge. There is, however, a paucity of empirical studies of phronesis, including in medicine. (...) Using a hermeneutic and phenomenological approach, this inquiry explores how phronesis is manifest in the stories of clinical practice of eleven exemplary physicians. The findings highlight five overarching themes: ethos (or character) of the physician, clinical habitus revealed in physician know-how, encountering the patient with attentiveness, modes of reasoning amidst complexity, and embodied perceptions (such as intuitions or gut feeling). The findings open a discussion about the contingent nature of clinical situations, a hermeneutic mode of clinical thinking, tacit dimensions of being and doing in clinical practice, the centrality of caring relations with patients, and the elusive quality of some aspects of practice. This study deepens understandings of the nature of phronesis within clinical settings and proposes ‘Clinical phronesis’ as a descriptor for its appearance and role in the daily practice of (exemplary) physicians. Van Rensselaer Potter (1911-2001), le biologiste à l’origine du terme « bioéthique » dans les écrits nord-américains, considère que « real bioethics falls in the context of the ideals of […] Aldo Leopold », un forestier, philosophe et poète ayant marqué le XXe siècle. Associer Leopold à Potter a pour effet de placer la bioéthique dans la famille des éthiques de l’environnement, ce qui la différencie du sens conventionnel retenu en médecine et en recherche depuis le Rapport Belmont (1979), une (...) déclaration ayant propulsé l’institutionnalisation de la bioéthique en Amérique du Nord. Cependant, diviser la bioéthique entre le médical et l’environnemental est réducteur. Potter propose au contraire une bioéthique globale s’intéressant aux enjeux situés à leur interface, dont ceux concernant la terre, la vie sauvage, la surpopulation, la consommation, etc. Cet article vise à amorcer un nouveau chantier d’analyse de la pensée de Potter en s’appuyant sur l’héritage de Leopold en biologie. Une synthèse de cette vision potterienne est proposée de manière à considérer son œuvre comme un tout cohérent s’intégrant aux grands débats qui transcendent les XXe et XXIe siècles. Sa vision apparaît comme une sagesse collective et prospective sous la forme d’une science de la survie et d’un code de bioéthique. Dépassant l’éthique de l’environnement, son association avec Leopold offre un modèle de la complexité s’imposant comme cas indissociable du contexte qui l’englobe, en améliorant nos façons d’intervenir en pratique dans un monde en constante transformation, à titre de gouvernance adaptative et de sagesse de la responsabilité. Peut-on être blâmé pour ses croyances? Bien qu’il s’agisse d’une pratique courante et en apparence légitime, le blâme doxastique entre en conflit avec deux thèses intuitivement plausibles. D’un côté, il semble que nous puissions seulement être blâmés pour ce qui est sous notre contrôle volontaire. Mais de l’autre, il est largement admis que la croyance est un état fondamentalement passif et involontaire. Il s’ensuit que nous ne pouvons jamais être blâmés pour nos croyances. Le présent article examine la réponse (...) que propose Christoph Jäger à cet argument. Sa stratégie consiste à invoquer le rejet, par Harry Frankfurt, du principe des possibilités alternatives contre la thèse voulant que nous puissions seulement être blâmés pour nos croyances si elles sont sous notre contrôle volontaire. J’aimerais montrer que l’argument de Jäger n’est pas concluant et, plus généralement, que la stratégie qu’il adopte aboutit inévitablement à un dilemme. (shrink)
