Metabolic Bariatric Surgery (MBS) has gained significant popularity over the past decade. Legally and ethically, physicians should obtain the patient’s voluntary and informed consent before proceeding with the surgery. However, the decision to undergo MBS is often influenced by external factors, prompting questions about their impact on the patient’s ability to choose voluntarily. In addressing this issue, the study focuses on two key questions: first, which factors influence MBS candidates during the decision-making process, and second, whether these influences undermine the (...) candidates' ability to make decisions voluntarily, according to theories of autonomy. The study employed a qualitative methodology, conducting 21 in-depth semi-structured interviews with adults who had undergone bariatric surgery. The conclusions were drawn from an inductive analysis of the interview data conducted using a grounded theory approach, and by applying theories of autonomy to the empirical findings. Our study indicates that interviewees were exposed to different external influences, which had diverse effects on the interviewees' decision to undergo MBS. Category 1 influences included intentional attempts to induce people, through arguments and reason, to accept the attitudes advocated by the persuader in support of the surgery. Applying theoretical accounts of autonomy to these influences suggests that they did not compromise the interviewees’ autonomy. Category 2 influences included threats made by a physician or a family member. These influences were found to undermine autonomy. Category 3 influences included emotional manipulation, informational manipulation, and the construction of medical and social norms. Manipulations and norms were experienced differently by different interviewees, and their impact on autonomy varies depending on the theoretical framework applied. Acknowledging that the influences exerted on MBS candidates may undermine their ability to make autonomous decisions regarding surgery, we suggest reformulating the duties that apply to medical practitioners with respect to informed consent to MBS. Medical practitioners who discuss the option of MBS with candidates should be aware of the various factors that influence this choice, and actively promote the candidates’ ability to make autonomous decisions. This chapter examines the different models of citizenship associated with republicanism and argues in favor of a hybrid and composite notion of republican citizenship. It views citizenship as a means to participate in political procedures but contends that such participation does not exhaust the rights and legal status that come with citizenship. More specifically, it considers three legal modes of democratic citizens in relation to freedom, civil association, the common good and equal participation: ‘citizen agents’, ‘citizen managers’ and ‘citizen leaders’. During the 19th century, various frameworks were established in Germany for the purpose of providing Jewish students with religious education. The article deals primarily with the orthodox Congregation Adass-Isroel Religious School. Established in 1869 in Berlin, the school had a major impact on the development of supplementary religious instruction throughout Germany and served as a model in this area. The school's background, history, basic principles and method of instruction, as well as study subjects are discussed and compared to corresponding religious (...) schools. Research is based on the school's annual reports, archival material, scholarly literature, memoirs, and newspapers. (shrink)

The Jewish emancipation in Germany brought about a fundamental change in the position of Jews in state and society, leading to a rapprochement between Jews and their non-Jewish surroundings. For religious Jews, this transition into neutral society brought up fundamental theological questions: How is emancipation to be evaluated from a religious perspective? What is the appropriate relationship with the state? How should Jews interact with Gentiles? How could Jews integrate into society without denying the singularity of Israel and without neglecting (...) their religious obligations? Rabbi Elias Gutmacher was one of the religious leaders of Judaism in Germany whose scholarship was deeply concerned with such questions. Gutmacher was from Grätz in the Posen region and became primarily known as a cabbalist. Il pense, donc il est : sérieux, solitaire, méditatif et de noir vêtu, Descartes est depuis des siècles l'incarnation de la raison triomphante et du génie français. Tant de limpidité et d'éclat a éclipsé l'homme même, qui demeure très méconnu : fils d'un temps d'incertitude? père de la philosophie moderne? Qui était vraiment René Descartes et qu'en reste-t-il aujourd'hui, au-delà des idées reçues et de la référence obligée? Mettant en lumière les contradictions du philosophe, Françoise Hildesheimer brosse le portrait (...) d'un homme fort éloigné du mythe officiel. On le veut rationnel, on ne l'imagine pas rêvant ; c'est pourtant sur trois songes que Descartes a fondé son projet d'une science universelle qui devait faire de lui le nouvel Aristote. Il a côtoyé de très près les courants déviants de l'époque, avant de s'établir en Hollande en 1628 pour concevoir son système, dévoilé au fil du Discours de la méthode, des Méditations métaphysiques, des Principes de la philosophie et des Passions de l'âme. Sa vie durant, Descartes a balancé entre désir de reconnaissance officielle et soif d'incognito ; il invitait le monde entier à débattre de ses théories, mais n'aimait guère la contestation ; il affectionnait le repos, et n'a cessé de voyager, sans jamais s'établir durablement ; lui qui se tenait éloigné du pouvoir a fini ses jours, en 1650, à la cour de la reine Christine de Suède. Curieux paradoxe que cet obsédé du secret, ce maniaque du brouillage des pistes, se soit consacré corps et âme à la quête de la Vérité et à l'étude de la lumière... (shrink)

À partir de l'étude de la constitution et de l'histoire des archives du parlement de Paris et de leur traitement archivistique, ainsi que des multiples collections de copies et d'extraits dont elles ont été l'objet, cet article propose une réflexion sur la manière dont ce fonds d'archives, qui allie une exceptionnelle importance matérielle et historique et une particulière complexité, a pu être traité par les archivistes et utilisé par les chercheurs, ainsi que sur les perspectives qu'il peut ouvrir à la (...) recherche. Ces archives du Parlement illustrent en effet toute la gamme des problèmes de conservation, de traitement, de communication au public et d'exploitation et rendent particulièrement manifeste la complémentarité et l'interpénétration nécessaires, voire la confusion, des approches historique et archivistique ; elles démontrent que la connaissance par les chercheurs de l'histoire du fonds d'archives va bien au-delà de la simple pratique archivistique et contribue à la perception de la documentation comme« source» d'histoire.
