The Article discusses the democratic backsliding after 2010 in Hungary, and how it affected the state of human rights in the country, a Member State of the European Union. The main argument of the Article is that paradoxically the non-legitimate 1989 constitution provided full-fledged protection of fundamental rights, while the procedurally legitimate 2011 constitution-making resulted in curtailment of rights and their constitutional guarantees. The Article first describes the democratic transition that occurred in 1989–1990 as a rights revolution and the results (...) of the 2011 “illiberal” constitution, called Fundamental Law, as counter-revolution. The second part of the Article illustrates the constitutional and statutory regulation of human rights protection after this “rule of law revolution,” and the activist jurisprudence of the first Constitutional Court using the concept of an “invisible constitution” to protect human rights. The third part discusses the rights provisions of the new Fundamental Law and several statutes dismantling the guarantees of human rights, with special attention to the decreased possibilities of state institutions, such as the Constitutional Court, the ordinary judiciary and ombudsmen, as well as civil society organizations to effectively protect fundamental rights. The fourth part assesses the efforts of European institutions to force the Hungarian government to comply with the human rights standards laid down in the European Convention of Human Rights and in the Treaty of the European Union. The Article concludes that neither internal nor external challenges could prevent the development of a new authoritarian regime with no guaranteed human rights. (shrink)

The paper discusses the reactions of different political and constitutional systems reactions to the pandemic and also the impact of COVID to populism, constitutionalism, and autocracy. Beyond the choice between economic and health considerations also applied in liberal democratic countries, which have lead either to “under-” or “overreaction” to the pandemic, certain illiberal regimes used the crisis situation as a pretext to strengthen the autocratic character of their systems. In some cases, this needed an “underreach,” like in Poland to insist (...) on the presidential election, which has been important to entrench the power of the governing party’s incumbent, elsewhere “overreach,” like in Hungary, where an unlimited emergency power of government has been introduced after the very first cases of contagion. These autocratic “overreactions” have breached the formerly used authoritarian legalistic approaches by openly violating their own illiberal constitutions. New “conservative” theories on “common good constitutionalism” emerged to legitimize the necessity of authoritative rule by the executive power. The paper concludes that one possibility to overcome authoritarian populism and restore constitutionalism in crisis situation such as the COVID-19 pandemic would be to rely on the involvement of the well informed public, one that is capable to understand and assess the advice of the meritocratic elite. This kind of participation would also help build up a constitutional culture necessary to preserve the values of constitutionalism. (shrink)

Here we investigate the classes RCA $^\uparrow_\alpha$ of representable directed cylindric algebras of dimension α introduced by Nemeti[12]. RCA $^\uparrow_\alpha$ can be seen in two different ways: first, as an algebraic counterpart of higher order logics and second, as a cylindric algebraic analogue of Quasi-Projective Relation Algebras. We will give a new, "purely cylindric algebraic" proof for the following theorems of Nemeti: (i) RCA $^\uparrow_\alpha$ is a finitely axiomatizable variety whenever α ≥ 3 is finite and (ii) one can obtain (...) a strong representation theorem for RCA $^\uparrow_\alpha$ if one chooses an appropriate (non-well-founded) set theory as foundation of mathematics. These results provide a purely cylindric algebraic solution for the Finitization Problem (in the sense of [11]) in some non-well-founded set theories. (shrink)

Based on the existence of polysemy (e.g., lunch can refer to both food and events), it is argued that central tenets of externalist semantics and Fodorian concept atomism, an externalist theory on which words lack semantic structure, are unsound. We evaluate the premise that these arguments rely on—that polysemous words have separate, finer‐grained senses. We survey the evidence across psychology and linguistics and argue that it shows that polysemy does not exist, at least not in this “sense”. Plato claimed that the regular solids are the building blocks of all matter. His views, commonly referred to as the geometric atomistic model, had enormous impact on human thought despite the fact that four of the five Platonic solids can not fill space without gaps. In this paper we quantify these gaps, showing that the errors in Plato’s estimates were quite small. We also develop a mean field approximation to convex honeycombs using a generalized version of Plato’s idea. This approximation (...) not only admits to view convex mosaics in$$d=3$$d=3dimensions as a continuum but we also find that it is quite accurate, showing that Plato’s geometric intuition may have been remarkable. This is a comprehensive study of the Derveni Papyrus. The papyrus, found in 1962 near Thessaloniki, is not only one of the oldest surviving Greek papyri but is also considered by scholars as a document of primary importance for a better understanding of the religious and philosophical developments in the fifth and fourth centuries BC. Gábor Betegh aims to reconstruct and systematically analyse the different strata of the text and their interrelation by exploring the archaeological context; the interpretation of rituals (...) in the first columns of the text; the Orphic poem commented on by the author of the papyrus; and the cosmological and theological doctrines which emerge from the Derveni author's exegesis of the poem. Betegh discusses the place of the text in the context of late Presocratic philosophy and offers an important preliminary edition of the text of the papyrus with critical apparatus and English translation. Continuity as appears to us immediately by intuition differs from its current formalization, the arithmetical continuum or equivalently the set of real numbers used in modern mathematical analysis. Motivated by the known mathematical and physical problems arising from this formalization of the continuum, our aim in this paper is twofold. Firstly, by interpreting Chaitin’s variant of Gödel’s first incompleteness theorem as an inherent uncertainty or fuzziness of the arithmetical continuum, a formal set-theoretic entropy is assigned to the arithmetical continuum. Secondly, (...) by analyzing Noether’s theorem on symmetries and conserved quantities, we argue that whenever the four dimensional space-time continuum containing a single, stationary, asymptotically flat black hole is modeled by the arithmetical continuum in the mathematical formulation of general relativity, the hidden set-theoretic entropy of this latter structure reveals itself as the entropy of the black hole, indicating that this apparently physical quantity might have a pure set-theoretic origin, too. The concept of the “End of History” was originally developed by G. W. F. Hegel in the Phenomenology of the spirit in 1806 (Hegel, 2018). The concept can be closely related to a utopia, the completion of the work of philosophers, and the creation of a perfect framework of the finished system of ideas. Hegel had a lot of influence on Western philosophy with the development of this idea and on Marx, who obviously thought of history in dialectic terms. However, (...) he developed the idea of “communism”, which would have been a state of humankind very similar to the concept of Hegel, with no class differences and no opiates of the people—and no place for further development (Marx & Engels, 2002). The “End of History” is based on this theoretical viewpoint that mankind has reached the final and most advanced form of societal development. However, the theorists and their intellectual followers both have to realize a painful way that the phenomenon can only be attained preliminarily. It proves to be a utopia. (shrink)

We study sincere-strategy preference-based approval voting (SP-AV), a system proposed by Brams and Sanver [1] and here adjusted so as to coerce admissibility of the votes (rather than excluding inadmissible votes a priori), with respect to procedural control. In such control scenarios, an external agent seeks to change the outcome of an election via actions such as adding/deleting/partitioning either candidates or voters. SP-AV combines the voters' preference rankings with their approvals of candidates, where in elections with at least two candidates (...) the voters' approval strategies are adjusted – if needed – to approve of their most-preferred candidate and to disapprove of their least-preferred candidate. This rule coerces admissibility of the votes even in the presence of control actions, and hybridizes, in effect, approval with pluralitiy voting. We prove that this system is computationally resistant (i.e., the corresponding control problems are NP-hard) to 19 out of 22 types of constructive and destructive control. Thus, SP-AV has more resistances to control than is currently known for any other natural voting system with a polynomial-time winner problem. In particular, SP-AV is (after Copeland voting, see Faliszewski et al. [2, 3]) the second natural voting system with an easy winner-determination procedure that is known to have full resistance to constructive control, and unlike Copeland voting it in addition displays broad resistance to destructive control (© 2009 WILEY-VCH Verlag GmbH & Co. The paper first discusses the metaphysical framework that allows the soul's integration into the physical world. A close examination of B36, supported by the comparative evidence of some other early theories of the soul, suggests that the word psuchê could function as both a mass term and a count noun for Heraclitus. There is a stuff in the world, alongside other physical elements, that manifests mental functions. Humans, and possibly other beings, show mental functions in so far as they have (...) a portion of that stuff. Turning to the physical characterization of the soul, the paper argues that B36 is entirely consistent with the ancient testimonies that say that psuchê for Heraclitus is exhalation. But exhalations cover all states of matter from the lowest moist part of atmospheric air to the fire of celestial bodies. If so, psuchê for Heraclitus is both air and fire. The fact that psuchê can manifest the whole range of physical properties along the dry-wet axis guarantees that souls can show different intellectual and ethical properties as well. Moreover, Sextus Empiricus, supported by some other sources, provides us with an answer how portions of soul stuff are individuated into individual souls. The paper closes with a brief discussion of the question whether, and if so with what qualifications, we can apply the term 'physicalism' to Presocratic theories of the soul. (shrink)

We explain the general significance of integer-based descriptors for natural shapes and show that the evolution of two such descriptors, called mechanical descriptors (the number _N_(_t_) of static balance points and the Morse–Smale graph associated with the scalar distance function measured from the center of mass) appear to capture (unlike classical geophysical shape descriptors) one of our most fundamental intuitions about natural abrasion: shapes get monotonically _simplified_ in this process. Olaf Müller’s book develops a new case for underdetermination, and, as he is focusing on theories of a ‘limited domain’, this assumes the containability of the theories. First, the paper argues that Müller’s theory of darkness is fundamentally Newtonian, but for Newton’s optical theory the type of theoretical structure Müller adopts is problematic. Second, the paper discusses seventeenth-century challenges to Newton, changes in the proof-structure of Newton’s optical theory, and how these affect Müller’s reconstruction. Müller’s book provides empirically equivalent theories, (...) yet the historical theories were not empirically equivalent, and the same experiments were used to extract different bodies of evidence to rebut the opponent. Third, Goethe’s multi-layered critique of Newton’s experimental proof is investigated, including his developmental account of prismatic colours, the role of experimental series in rejecting Newton’s observations, and his incorporation of the ‘limited domain’ of prismatic colours in a broader framework. Two key elements of Goethe’s method, polarity and strengthening are discussed in contrast to Müller, who only utilises polarity in his account. Finally Neurath’s attempts to come to grips with the optical controversies and the prism-experiments with ‘blurred edges’ are recalled. Müller also discusses in detail some of these experiments and heavily draws on Quine. Neurath developed Duhem’s and Poincaré’s conventionalist insights and had good reasons to be pessimistic about theory-containment. Their differences provide some additions to the history of the Duhem–Quine thesis. (shrink)

In recent articles in this journal Benoit Gaultier and John Biro have argued that the original Gettier cases and the ones closely modelled on them fail, and the reason for the failure is that the subject in these cases does not actually have the belief that would serve as a counterexample to the justified-true-belief analysis of knowledge. They claim that if our evidence pertains to a particular individual (as in the first case) or to the truth of one of the (...) disjuncts (as in the second case), we do not genuinely believe the existential generalization or the disjunction which logically follows. I will challenge their arguments and suggest that our unwillingness to assert the existential generalization or the disjunction under these conditions does not stem from lack of belief but from pragmatic principles. The article analyzes strategic manoeuvring within the pragmadialectical framework with respect to the selection of starting points in the opening stage to frame the arguments. The Terri Schiavo case is presented, which can provide interesting insights concerning this issue. I would like to show that resolution of the difference of opinion requires the resolution of a subordinate difference of opinion concerning how to label her medical state, and why discussants were not able to resolve this subordinate difference of opinion. After, (...) the conflict that arises between critical reasonableness and rhetorical effectiveness is examined and how strategic manoeuvring aims to resolve this conflict. In the final part of the paper I argue that the problems raised can be dealt with within the framework of pragma-dialectics. (shrink)

This commentary provides experimental data in support of the critical role of capsaicin-sensitive primary afferent fibers in the initiation and maintenance of pathological pain. The demonstration of capsaicin-induced, centrally-evoked cutaneous hyperalgesia, and of neuroplastic changes elicited by the degeneration of C-fiber primary afferent terminals following peripheral nerve damage, indicates a significant contribution of capsaicin-sensitive sensory ganglion neurons in the development of pathological pain conditions. Poland still celebrates the euphoric weeks of 1980 when a huge strike threatened to bring down the Communist government. While the euphoria is long gone, the strike's importance is unmistakable, marking as it did the beginning of the only political movement in the Eastern Bloc that was not defeated in a few days. Recent work in social and cultural studies of science and technology has shown that the ‘epistemic dependence’ of laypeople on experts is not a relation of blind trust, but typically and necessarily involves critical assessment of expert testimonies. Normative epistemologists have suggested a number of criteria, mostly of contextual nature since expert knowledge means restricted cognitive access to some epistemic domain, according to which non-experts can reliably evaluate expert claims; while science studies scholars have concentrated on how laypeople can come (...) to warranted decisions about technical matters on non-technicalgrounds. Instead of addressing the problem transcendentally (how such decisions are possible) or normatively (how such decisions should be reached), this paper contrasts the recommendations available in the literature with the empirical findings of a rough case study concerning the public reaction to the H1N1 vaccine issue. Awareness of how lay people do come to such decisions may inform and refine normative philosophical investigations. (shrink)

Current philosophical reflections on science have departed from mainstream history of science with respect to both methodology and conclusions. The article investigates how different approaches to reconstructing commitments can explain these differences and facilitate a mutual understanding and communication of these two perspectives on science. Translating the differences into problems pertaining to principles of charity, the paper offers a platform for clarification and resolution of the differences between the two perspectives. The outlined contextual approach occupies a middle ground between mainstream (...) history and sociology of science, bracketing questions of rationality, and individual coherence-maximizing, rationality-centered approaches. It can satisfy those, who believe that science is an epistemically privileged endeavor, and its epistemic content should not be neglected when reconstructing the scientists’ positions. It can also satisfy those who hold that it is naive to believe that the immediate context, e.g. the challenges to a theory, the expectations of the author about his audience, etc., does not affect the position a scientist takes. Its theoretical considerations are exemplified with a close study of the debate following the 1672 publication of Newton's theory of light and colours, also offering a novel reading of the development of his methodological views concerning the demonstrativity of the famous crucial experiment. Although we only show the capacity of the framework to analyze a direct controversy, given that it is hard to think about any scientific text as detached from an argumentative context, this approach has the potential to be a general guide for interpretation.
