Mackie drew attention to the distinct semantic and metaphysical claims made by metaethical realists, arguing that although our evaluative discourse is cognitive and objective, there are no objective evaluative facts. This distinction, however, also opens up a reverse possibility: that our evaluative discourse is antirealist, yet objective values do exist. I suggest that this seemingly farfetched possibility merits serious attention; realism seems committed to its intelligibility, and, despite appearances, it isn‘t incoherent, ineffable, inherently implausible or impossible to defend. I argue (...) that reflection on this possibility should lead us to revise our understanding of the debate between realists and antirealists. It is not only that the realist‘s semantic claim is insufficient for realism to be true, as Mackie argued; it‘s not even necessary. Robust metaethical realism is best understood as making a purely metaphysical claim. It is thus not enough for antirealists to show that our discourse is antirealist. BackgroundExisting clinical ethics support (CES) instruments are considered useful. However, users report obstacles in using them in daily practice. Including end users and other stakeholders in developing CES instruments might help to overcome these limitations. This study describes the development process of a new ethics support instrument called CURA, a low-threshold four-step instrument focused on nurses and nurse assistants working in palliative care. MethodWe used a participatory development design. We worked together with stakeholders in a Community of Practice throughout the (...) study. Potential end users (nurses and nurse assistants in palliative care) used CURA in several pilots and provided us with feedback which we used to improve CURA.ResultsWe distinguished three phases in the development process. Phase one, Identifying Needs, focused on identifying stakeholder and end user needs and preferences, learning from existing CES instruments, their development and evaluation, and identify gaps. Phase two, Development, focused on designing, developing, refining and tailoring the instrument on the basis of iterative co-creation. Phase three, Dissemination, focused on implementation and dissemination. The instrument, CURA, is a four-step low-threshold instrument that fosters ethical reflection.ConclusionsParticipatory development is a valuable approach for developing clinical ethics support instruments. Collaborating with end users and other stakeholders in our development study has helped to meet the needs and preferences of end users, to come up with strategies to refine the instrument in order to enhance its feasibility, and to overcome reported limitations of existing clinical ethics instruments. In recent times, there has been a surge of interest in, and enthusiasm for, contextualist views about prudential discourse — thought and talk about what has prudential value or contributes to someone’s well-being. In this paper I examine and reject two cases for radical forms of prudential contextualism, proposed by Anna Alexandrova and Steve Campbell. Alexandrova holds that the semantic content of terms like ‘well-being’ and ‘doing well’ varies across contexts. Campbell proposes that there are plural prudential concepts at play (...) in prudential discourse (and in philosophical reflection upon such discourse) and that we find evidence of this in the conflicting commitments of prudential discourse. ​The negative aim of the paper is to show that Alexandrova and Campbell have not given us a good case for ambitious forms of contextualism about prudential discourse. The positive aim of the paper is to provide alternative, aspectualist, explanations of the features of prudential discourse that their discussions highlight. (shrink)

This paper examines implicaturist hybrid theories by examining how closely attitude expression by moral utterances fits with the varieties of implicature (conventional, particular conversational, generalized conversational) using five standard criteria for implicature: indeterminacy (§3), reinforceability (§4), non-detachability (§5), cancellability (§6), and calculability (§7). I argue (1) that conventional implicature is a clear non-starter as a model of attitude expression by moral utterances (2) that generalised conversational implicature yields the most plausible implicaturist hybrid but (3) that a non-implicaturist, and non-hybrid, alternative (...) might in fact be superior. In healthcare practice, care providers are confronted with decisions they have to make, directly affecting patients and inevitably harmful. These decisions are tragic by nature. This study investigates the role of Moral Case Deliberation in dealing with tragic situations. In MCD, caregivers reflect on real-life dilemmas, involving a choice between two ethical claims, both resulting in moral damage and harm. One element of the reflection process is making explicit the harm involved in the choice. How harmful are our decisions? We (...) investigated how facilitators of MCD experience the importance of addressing harm in MCD and what participants learn from reflecting on harm. The study was qualitative, focusing on the views and experiences of the facilitators of MCD. Semi-structured interviews were conducted with facilitators of MCD. The research focuses on the subjective experiences of facilitators. Grounded Theory was used for analysis. The results show two main categories. The first concerns the awareness of tragedy. Within this category, five themes were discerned: making explicit that there is no solution, visualizing consequences, uncovering pain, focusing on emotion, and exploring perspectives on harm. The second category concerns the support for healthcare professionals in dealing with the tragedy of the choices they face. In this category, five themes came forward: acknowledging, offering comfort, managing harm, consideration through dialogue and repairing harm. Our study shows that addressing harm in MCD in tragic situations provides an important moral learning opportunity for participants. By formulating and becoming aware of harm, MCD aids healthcare professionals in the task they are faced with, namely making difficult and painful choices. MCD helps healthcare professionals to repair moral damage, making clear at the same time that harm cannot be undone. (shrink)

Judgments concerning animals have arisen across a variety of established practice areas. There is, however, no publicly available repository of judgments concerning the emerging practice area of animal protection law. This has hindered the identification of individual animal protection law judgments and comprehension of the scale of animal protection law made by courts. Thus, we detail the creation of an initial animal protection law repository using natural language processing and machine learning techniques. This involved domain expert classification of 500 judgments (...) according to whether or not they were concerned with animal protection law. 400 of these judgments were used to train various models, each of which was used to predict the classification of the remaining 100 judgments. The predictions of each model were superior to a baseline measure intended to mimic current searching practice, with the best performing model being a support vector machine (SVM) approach that classified judgments according to term frequency—inverse document frequency (TF-IDF) values. Investigation of this model consisted of considering its most influential features and conducting an error analysis of all incorrectly predicted judgments. This showed the features indicative of animal protection law judgments to include terms such as ‘welfare’, ‘hunt’ and ‘cull’, and that incorrectly predicted judgments were often deemed marginal decisions by the domain expert. The TF-IDF SVM was then used to classify non-labelled judgments, resulting in an initial animal protection law repository. Inspection of this repository suggested that there were 175 animal protection judgments between January 2000 and December 2020 from the Privy Council, House of Lords, Supreme Court and upper England and Wales courts. The first part of this paper asks why we need, or what would motivate, ameaningful expansion of epistemology. It answers with three critical arguments found in the recent literature, which each purport to move us some distance beyond the preoccupations of ‘post-Gettier era’ analytic epistemology. These three—the ‘epistemic luck,’ ‘epistemic value’ and ‘epistemic reconciliation’ arguments associated with D. Pritchard, J. Kvanvig, and M. Williams, respectively—each carry this implication of needed expansion by functioning as forceful ‘internal critiques’ of the tradition. The (...) second part of the paper asks what specific directions an expanded field of epistemology should take. While this is taken as an open question for debate, the expansion suggested here remains continuous with the analytic tradition, while also underlining the centrality of the acquired or ‘reflective’ intellectual virtues in meeting the burdens of the three arguments. Responsibilism, as here understood, is not a philosophical thesis so much as an orientation of commitment to clearing away philosophical assumptions that systematically obstruct recognition of the importance of empirically-informed research programs into the reflective virtues. Although most people believe that it is morally wrong to intentionally create children who have an impairment, it is widely held that we cannot criticize such procreative choices unless we find a solution to Parfit’s non-identity problem. I argue that we can. Jonathan Glover has recently argued that, in certain circumstances, such choices would be self-defeating even if morally permissible. I argue that although the scope of Glover’s argument is too limited, it nevertheless directs attention to a moral defect in (...) the attitudes that could motivate such procreative choices, attitudes that, properly characterized, turn out to be person-affecting in character. I conclude by arguing that prospective parents who want to create a child with an impairment face a dilemma. If they want to avoid the charge that their aim is morally defective, they must deny that the desired impairment is harmful. But this would commit them to endorsing the controversial claim that it is morally permissible or even required to turn normal children into impaired ones. (shrink)

Successful interaction with the environment requires predictions of everything from millisecond-accurate motor timing to far future events. The hierarchical framework seems appropriate for timing.

Labor law was traditionally a domestic project, defined on the basis of a geographic territory or a synthetic community; its norms were determined by the state and applied to employers and workers who resided within the state. Commonly, labor law is administered on a territorial basis, applies to incoming workers, and stops at the borders in respect of other states' sovereignty when capital migrates. Globalization affects the background in which labor law operates, including the increased interdependence of markets, the constitution (...) of communities that transcend national borders, and the development of institutions outside and within the nation-state, which displace the locus of regulation from the traditional state level. De-territoriality claims that territory and sovereignty should be understated within the dominion of labor law in order to correct a deep structural imbalance in labor markets. This imbalance was not created by globalization, and as long as it appeared in a consistent yet bounded manner in each and every state, labor law's project was rendered possible by territorial arrangements. With the process of globalization, the territorial solutions previously created within labor law are no longer adequate. When territoriality is adhered to, migrating workers receive partial protection, while migrating capital can easily choose its most convenient forum as a means, inter alia, of undermining labor law's protection to workers. De-territorialization seeks to restore the original intent of labor law's project, which is to level off the distinct strategies that are available to labor and capital in a globalized labor market. This book aims to re-evaluate the relations between two major ideologies that have been increasingly contested in recent years, yet continue to be invoked or rejected as foundational systems for political thought or action. With socialism conceiving of itself as an alternative to economic liberalism, the two systems of thought emerged partially in opposition to each other. However, this book seeks to redefine their specificities and the way in which they have not only opposed each other but drew on common (...) notions or paradigms to become both competing and complementary systems of thought and practices. Segundo MacIntyre, representante importante dessa teoria, o estoicismo favoreceu o desenvolvimento da ética moderna e contemporânea, ao destacar noções como vontade, assentimento e lei natural ou divina. Por conseguinte, o desenvolvimento do próprio agente moral foi negligenciado. No século XII, Abelardo apresenta uma ética híbrida, que mantém, ao mesmo tempo, a teoria aristotélica da virtude e elementos da moral (...) estoica. No presente estudo, consideramos a crítica feita por MacIntyre da ética abelardiana, estimada ser na origem das concepções morais modernas e contemporâneas. (shrink)

Peter Abelard and William of Ockham represent the two main figures of the nominalism of the Middle Ages. Both share the fundamental thesis of that doctrine, according to which only individual entities exist. The repercussions of nominalism are quite evident in relation to the question of universals, which constitutes a subject that, until now, won the attention of the majority of contemporary studies on the two most important logicians of their time. Nevertheless the nominalism of each of these two protagonists (...) apparently diverges in a significant manner, especially in respect to the role exercised by the mind in the semantic process. Ockham seems to distance himself definitely from his predecessors, including Abelard, when he transfers grammar and semantic functions of conventional language to the level of mental language. In the present article, the chief intention is to expound the theory of sign and signification of each of the authors under consideration. The ultimate objective is to compare their respective semantic positions and indicate the principal points of agreement and disagreement, keeping in mind the hypothesis according to which these two medieval nominalists should have more theoretical elements in common than not. Expenditures on health in many developing countries are being disproportionately spent on health services that have a low overall health impact, and that disproportionately benefit the rich. Without explicit consideration of priority setting, this situation is likely to remain unchanged: resource allocation is too often dictated by historical patterns, and maintains vested interests. This paper explores how prioritization between different health interventions can be rationalised by the use of clearly defined criteria.
