Jahrhunderts mit ihrer zentralen Stellung der biblischen Schriften und ihrer Exgeses als auch die Entwicklung der in die Moderne weisenden biblischen Textkritik lassen sich ohne die Arbeiten des Erasmus kaum denken. Dennoch ist auch Erasmus in einem breiteren Zusammenhang der mannigfachen Bibel- und Text-orientierten Reformbewegung des Spätmittelalters, der (...) Renaissance und des Humanismus zu sehen. Background: More and more adults in their fifties and sixties are confronted with the need to support their ageing parents. Although many aspects of filial caregiving have been researched, a well-documented and comprehensive overview of the caregiving experience is lacking. Aim: This study aims for a better understanding of the caregiving experience of adult children by generating an overview of main themes in international research. Method: A literature review of qualitative studies, focusing on the experiences of adult children caring for (...) their ageing parents, was performed. The electronic EBSCO databases Academic Search Premier, CINAHL and PsycINFO, and Google Scholar were searched to identify relevant qualitative studies published between 2000 and 2017. The ‘SPIDER’ eligibility criteria directed the approach. The quality of studies included was screened with the assessment sheet designed by Hawker and colleagues. The experiences reported were analysed and themes were synthesized. Ethical consideration: Ethical requirements were respected in every phase of the research process. Findings: Nineteen qualitative studies met the inclusion criteria. The quality of the relationship with the parent appears to be an important determinant of the children’s caregiving experience. Within this context, three themes were found: caregiving as an emotional rollercoaster, a normatively demanding experience and an opportunity for personal development. Discussion: Children caring for their ageing parents have to deal with a wide range of contradicting and conflicting norms and values. Implications for healthcare professionals and future research have been discussed. Conclusion: Caring for ageing parents is a continuous quest for giving the best possible care and living up to one’s personal values, within the context of the parent’s declining health. Professionals who support filial caregivers should address not only practical responsibilities but also the normative questions and moral considerations caregivers are dealing with. (shrink)

Empathy is important in our digitized and polarized world and an important aspect of education. What contribution can history teachers make to develop this in their students? In this study we investigated whether a lesson unit making use of eyewitnesses and designed from six pedagogical principles, resulted in more confidence in the ability to empathize, attributed importance to empathy and understanding of empathy by 10th grade students. In addition, we investigated the differences between two conditions: the use of a guest (...) speaker versus eyewitnesses in a documentary. In this quasi-experimental intervention study, we used a pretest-posttest-follow-up design. The data were collected via questionnaires containing closed and open questions. The results showed that students (N = 97) in both conditions gained confidence in their ability to empathize and improved their ability to explain what empathy means and why it is important. After two months, progress on these items was still significant. In the condition with the guest speaker students scored significantly higher on understanding empathy than students who participated in the lesson unit with the documentary. This study contributes to the understanding of developing empathy through the use of eyewitnesses in history classes and the measurement of students’ understanding of empathy. (shrink)

The vulnerability of older hospital patients is increasingly understood in physical terms, often referred to as frailty. This reduces their vulnerability to the functioning body regardless of the psycho-socio-cultural context they are in, and it ignores the role of the hospital environment. This paper starts from a care ethical perspective on care and uses insights from empirical work that shows that hospitalization of older patients is characterized by experiences of uncertainty that give rise to feelings of vulnerability. This paper presents (...) a model that clarifies how vulnerability occurs in the interplay between the embodied subject, others, daily life and the hospital, and shows its dynamic and relational nature. Our complementary perspective of vulnerability is vital for nursing practice in that it starts from the situatedness of the older patient and not only points at what is missing but also at what is of significance to the older patient. Hospitalization significantly impacts the lives of older people, both physically and psychosocially. There is lack of observation studies that may provide an embodied understanding of older patients’ experiences in its context. The aim of this single case study was to reach a deeper understanding of one older patient’s lived experiences of hospitalization. The study followed a phenomenological embodied enquiry design and the qualitative observation method of shadowing was used. In April 2011, one older patient was shadowed for 7 days, 5–7 (...) h per day. To facilitate understanding in the reader the experiences are first presented in a story and subsequently analyzed by means of the lifeworld framework. The findings show that hospitalization is experienced as ambiguous safety, disconnected time, the feeling of being partially involved, and the struggle to re-attune to the body. (shrink)

This article develops a model first proposed in my book Jurisprudence and communication [67]. It takes as its starting point the generally conception that legal rules are valid norms, involving a normative content and expressing themselves in reality through observable conduct. This dualistic character of law is central. Law is both fiction and factual, ideal and real. But the viewpoint that a legal rule is a manifestation of validity in reality, through empirical acts, raises the question how rules as (valid) (...) fictions can be known and understood in their linguistic form. How is meaning attributed to the legal words and how do these words relate to the world of fact? Taking an institutional-pragmatic approach as a starting point, an analytical model is created that can be used as an instrument for the relationship between legal rules as thought objects existing only in the mind, and legal rules as observable conduct. This model seeks to revise the classical models of legal communication that basically focus on the unilateral flow of legal information between ‘senders and receivers’ and their claim of linear causality between rules and conduct. The model here constructed in the theoretical part is then applied to several case studies, in order to analyze the construction of meaning in actual use. Two fundamental rights—the older codified in 1798 and the more recent codified in 1983—in the Dutch Constitution have been analyzed using the model as an instrument. Further, the remarkable shifts in article 96 of the Constitution, the declaration of war, and its consequences, resulting in a new category of war—the armed conflict—have been analyzed, as well as the phenomenon of ‘peacekeeping missions’ involving actual warfare. The new war terminology has created vagueness with respect to the clear-cut division between war and peace, which has been reflected in several cases before Court, including the Eric O. case. The present analysis of the case studies indicates that the model was not in all cases completely tailored to the facts: for example, in the case study on article 96 a broad spectrum of observable legal and non-legal actors dominated the facts in such a way that the model did not fully cover it. The observations on my book by the three respondents in this special issue have contributed to the adaptation and extension of the model. Stimulating responsible conduct of research is considered important within universities and research organizations. In this contribution, we investigated if there are gender differences regarding three aspects: students’ attitudes towards integrity related issues, self-reported misconduct, and suspicions of misconduct and willingness to report fellow students. A questionnaire was sent to 1266 first year starting master students in the life sciences. Male students were significantly more likely to report not doing their fair share in group work and putting their name on work (...) without checking it. No significant differences were found regarding attitude and suspecting and reporting other students. (shrink)

Patient participation in healthcare is highly promoted for democratic reasons. Older patients make up a large part of the hospital population but their voices are less easily heard by most patient participation instruments. The client council can be seen as an important medium to represent the interests of this increasing group of patients. Every Dutch healthcare institution is obliged to have a client council and its rights are legally established. This paper reports on a case study of a client council (...) in a hospital and shows how equality as the core democratic value manifests itself in practice and marginalizes the voices of older patients. Based on the work of Joan Tronto we show that sameness is the driving force behind the functioning of the client council which leads the council to operate as part of the hospital system. Consequently, important aspects of the hospital practice remain out of sight. To be of greater value for all patients we argue that successful patient participation requires not only equal opportunities but also ‘the condition of equal voice’. (shrink)

Finally, some brief responses to the kind observations on my book by the three respondents, with a view to possible improvements of the model I have proposed. I began the outline of my analytical model by confronting it with that of Teubner, as mentioned in the response of Willem Witteveen. As Witteveen states, it is my goal and ambition to replace the flow model of communication (Teubner) with something new. Witteveen maintains that Teubner has already discarded the flow model of (...) communication. However, even Witteveen acknowledges (along with many others) that in the autopoiesis theory Teubner developed a one-sided communication model: that of the flow of legal rules between different social subsystems. The legal system is one such social subsystem, rule addressees are other social subsystems. Teubner’s model of legal messages concentrates basically on legal rules which aim to produce factual results in the form of behaviour conforming to the rules. The flow of legal messages takes pl .. Developed from a one-day symposium at the University of Tilburg, this collection of papers explores the semiotic foundations of legislation as viewed from jurisprudential, institutional and sociological perspectives. They pose such questions as: the audience of legislation; the relations between legislative and judicial discourse; the contributions of speech act theory; the effectiveness of legislation and its meaning in non-legal discourse; and the creation of a supra-national form of constitutional discourse, that of Europe.

Phenomenological healthcare research should include the lived experiences of a broad group of healthcare users. In this paper it is shown how shadowing can give a voice to people in vulnerable situations who are often excluded from interview studies. Shadowing is an observational method in which the researcher observes an individual during a relatively long time. Central aspects of the method are the focus on meaning expressed by the whole body, and an extended stay of the researcher in the phenomenal (...) event itself. Inherent in shadowing is a degree of ambivalence that both challenges the researcher and provides meaningful insights about the phenomenon. A case example of a phenomenological study on the experiences of elderly hospital patients is used to show what shadowing yields. (shrink)

In institutional legal theory, norms and facts are reciprocally operating elements: an interplay in which meaning construction is closely connected with acting: the pragmatic understanding of legal language in terms of its uses. With the semiotic elements of institutional theory, extended by the notion of ‘semiotic groups’, an analytical framework can be constructed to analyze a case study on the shifts in the concept of war which have taken place since the 1945 UN Charter and in the aftermath of 9/11. A diagnosis of dementia often comes with difficulties in understanding a conversational context and expressing how one feels. So far, research on how to facilitate advance care planning for people with dementia focused on defining relevant themes and topics for conversations, or on how to formalize decisions made by surrogate decision makers, e.g., family members. The aim of this review is to provide a better scope of the existing research on practical communication aspects related to dementia in ACP conversations. In (...) November 2020, seven databases were searched to select papers for inclusion. This search was updated in December 2021. The search strategy consisted of three tiers, intersected by using the Boolean term “AND,” and resulted in 787 studies. Two researchers followed explicit criteria for two sequential levels of screening, based on titles and abstracts and full papers. A total of 22 studies were included for data analysis. Seven topics emerged clustered around two themes. This scoping review provides practical suggestions for healthcare professionals to improve ACP communication and uncovered gaps in research on communication aspects related to dementia in ACP conversations, such as non-verbal behavior, timing and implementation, and personal preferences. Patient-reported outcomes are frequently used for medical decision making, at the levels of both individual patient care and healthcare policy. Evidence increasingly shows that PROs may be influenced by patients’ response shifts and dispositions. We identify how response shifts and dispositions may influence medical decisions on both the levels of individual patient care and health policy. We provide examples of these influences and analyse the consequences from the perspectives of ethical principles and theories of just distribution. If influences of response (...) shift and disposition on PROs and consequently medical decision making are not considered, patients may not receive optimal treatment and health insurance packages may include treatments that are not the most effective or cost-effective. We call on healthcare practitioners, researchers, policy makers, health insurers, and other stakeholders to critically reflect on why and how such patient reports are used. (shrink)

In the age of Big Data, companies and governments are increasingly using algorithms to inform hiring decisions, employee management, policing, credit scoring, insurance pricing, and many more aspects of our lives. Artificial intelligence systems can help us make evidence-driven, efficient decisions, but can also confront us with unjustified, discriminatory decisions wrongly assumed to be accurate because they are made automatically and quantitatively. It is becoming evident that these technological developments are consequential to people’s fundamental human rights. Despite increasing attention to (...) these urgent challenges in recent years, technical solutions to these complex socio-ethical problems are often developed without empirical study of societal context and the critical input of societal stakeholders who are impacted by the technology. On the other hand, calls for more ethically and socially aware AI often fail to provide answers for how to proceed beyond stressing the importance of transparency, explainability, and fairness. Bridging these socio-technical gaps and the deep divide between abstract value language and design requirements is essential to facilitate nuanced, context-dependent design choices that will support moral and social values. In this paper, we bridge this divide through the framework of Design for Values, drawing on methodologies of Value Sensitive Design and Participatory Design to present a roadmap for proactively engaging societal stakeholders to translate fundamental human rights into context-dependent design requirements through a structured, inclusive, and transparent process. A growing body of research can be found in which roboticists are designing for reciprocity as a key construct for successful human–robot interaction (HRI). Given the centrality of reciprocity as a component for our moral lives (for moral development and maintaining the just society), this paper confronts the possibility of what things would look like if the benchmark to achieve perceived reciprocity were accomplished. Through an analysis of the value of reciprocity from the care ethics tradition the richness of reciprocity (...) as an inherent value is revealed: on the micro-level, as mutual care for immediate care givers, and on the macro-level, as foundational for a just society. Taking this understanding of reciprocity into consideration, it becomes clear that HRI cannot achieve this bidirectional value of reciprocity; a robot must deceive users into believing it is capable of reciprocating to humans or is deserving of reciprocation from humans. Moreover, on the macro-level, designing social robots for reciprocity threatens the ability and willingness to reciprocate to human care workers across society. Because of these concerns, I suggest re-thinking the goals of reciprocity in social robotics. Designing for reciprocity in social robotics should be dedicated to the design of robots to enhance the ability to mutually care for those that provide us with care, as opposed to designing for reciprocity between human and robot. In this paper a corporate social responsibility audit is developed following the underlying methodology of the quality award/excellence models. Firstly the extent to which the quality awards already incorporate the development of social responsibility is examined by looking at the Malcolm Baldrige National Quality Award and the European Quality Award. It will be shown that the quality awards do not yet include ethical aspects in relation to social responsibility. Both a clear definition of social responsibility and an improved audit instrument (...) are required. A definition and an audit instrument are developed which stimulate movement in that direction and help organisations to reflect on their position in relation to social responsibility. (shrink)

What is empiricism? There can be no authoritative answer to any such question. A historian of philosophy can at best try to call what is common to philosophers who either identified themselves, or have traditionally been identified, as empiricists. But what has set those philosophers apart from others, and especially from those whom they criticized, may not be captured in common views or doctrines. The historian may, in trying to fix the label, rely tacitly on a view of what philosophical (...) positions are and how they are to be identified. Finally, it is typical of philosophers who decide to range themselves under some pre-existing banner ("empiricism", "pragmatism", "phenomenology") to change the very philosophy they take on, as much as did their historical heroes in their day. I will here try to give a sustained argument about what empiricism cannot be, and then enter upon a tentative exploration of what it should be (taken to be). (shrink)

Wellbeing describes how good life is for the person living it. Wellbeing comes in degrees. Subjective theories of wellbeing maintain that for objects or states of affairs to benefit us, we need to have a positive attitude towards these objects or states of affairs: the Resonance Constraint. In this article, we investigate to what extent subjectivism can plausibly account for degrees of wellbeing. There is a vast literature on whether preference-satisfaction theory – one particular subjective theory – can account for (...) degrees of wellbeing. This is generally taken to be problematic. However, other subjective theories – namely, desire-satisfaction, judgment- and value-fulfillment theories – do not suffer from the same difficulties. We introduce two models of degrees of wellbeing a subjectivist can employ: the Relative and the Absolute Model, and defend the claim that both models face difficulties. In particular, we argue that a subjectivist theory should describe instances of depression as instances of low degrees of wellbeing. We also argue that a reduction of desires may sometimes improve one’s degree of wellbeing, an idea we call the Epicurean Intuition. We then argue that the Relative Model fails to account for the disbenefit of certain types of depression, while the Absolute Model fails to meet a central commitment of subjectivism – the Resonance Constraint – and is unable to accommodate the Epicurean Intuition. The upshot of the paper is that subjectivist theories cannot account for degrees of well-being in a plausible way. (shrink)

Over the past years, the intersubjective dimension of psychotic disorders, including schizophrenia, has gained increasing phenomenological attention. Psychopathologists and philosophers have developed ideas on how the social aspects of psychotic symptoms and experiences could be understood, in particular in their relation to the ipseity disturbance model, namely the idea that schizophrenia is essentially a disorder of the minimal self. It provides an insightful cross-section of the current state of affairs in argumentation research. It will be of interest to all those working in the field of argumentation theory and to all scholars who are interested in recent developments in this field.

Since Kripke, philosophers have distinguished a priori true statements from necessarily true ones. A statement is a priori true if its truth can be established before experience, and necessarily true if it could not have been false according to logical or metaphysical laws. This distinction can be captured formally using two-dimensional semantics. There is a natural way to extend the notions of apriority and necessity so they can also apply to questions. Questions either can or cannot be resolved before experience, (...) and either are or are not about necessary facts. Classical two-dimensionalism has no account of question meanings, so it has to be combined with a framework for question semantics in order to capture these observations. It is shown in [14] how two-dimensional semantics can be combined with inquisitive semantics, in which questions are analyzed in terms of information. The present paper investigates the logic of two-dimensional inquisitive semantics, and provides a complete proof system. (shrink)

This paper resolves some puzzles regarding Spinoza’s appropriations and rejections of various aspects of Bacon’s methodology, and uses these solutions to resolve some long-standing puzzles concerning Spinoza’s modus operandi in the TTP. We argue first that, appearances to contrary, Spinoza takes a consistent line in his assessment of Bacon’s epistemic approach. We argue that Spinoza follows Bacon in grounding his overall epistemic method in a “historiola mentis” (a brief account or history of the mind), and that differences between Spinoza’s and (...) Bacon’s respective historiola mentis can explain Spinoza’s embrace of this inductive method for his interpretation of Scripture in the TTP, as well as his general abandonment of Bacon’s inductive method in the metaphysical investigation of the Ethics. In short, we argue that the “historiola mentis” constructed by Bacon depicts the intellect as an error-prone faculty that needs be continuously restrained by observation and experimentation—a depiction which motivates Bacon’s reformed inductive empiricism. Spinoza accepts this depiction in regard to a subset of the mind’s ideas—the ideas of the imagination, and hence sees the inductive method as suitable for interpreting Scripture. But contra Bacon, Spinoza’s “historiola mentis” also shows that the human mind includes a subset of ideas that yield true, certain knowledge of things “infinite” and sub specie aeternitatis. Spinoza finds these “intellectual” ideas to be quite useful for systematic metaphysics, but of limited use for interpreting historical texts like Scripture. (shrink)

This commentary is a response to Contextual Integrity as a General Conceptual Tool for Evaluating Technological Change by Elizabeth O’Neill (Philosophy & Technology (2022)). It argues that while contextual integrity (CI) might be an useful addition to the toolkit of approaches for ethical technology assessment, a CI approach might not be able to uncover all morally relevant impacts of technological change. Moreover, the inherent conservatism of a CI approach might be problematic in cases in which we encounter new kinds of (...) morally problematic situations, such as climate change, or when technology reinforces historically grown injustices. There are two dominant trends in the humanitarian care of 2019: the ‘technologizing of care’ and the centrality of the humanitarian principles. The concern, however, is that these two trends may conflict with one another. Faced with the growing use of drones in the humanitarian space there is need for ethical reflection to understand if this technology undermines humanitarian care. In the humanitarian space, few agree over the value of drone deployment; one school of thought believes drones can provide a (...) utility serving those in need while another believes the large scale deployment of drones will exacerbate the already prevalent issues facing humanitarian aid providers. We suggest in this paper that the strength of the humanitarian principles approach to answer questions of aid provision can be complimented by a technology-facing approach, namely that of robot ethics. We have shown that for humanitarian actors we ought to be concerned with the risks of a loss of contextualization and de-skilling. For the beneficiary, we raise three concerns associated with the threat to the principle of humanity for this group: a loss of dignity by reducing human-to-human interactions; a threat to dignity through a lack of informational transparency; and, a threat to dignity by failing to account for the physiological and behavioral impacts of the drone on human actors. Although we acknowledge the obstacles associated with understanding the physiological and behavioral impacts we insist that the moral acceptability and desirability of drones in humanitarian contexts is dependent on the findings from such studies and that tailored ethical guidelines for drone deployment in humanitarian action be created to reflect the results of such studies. ### ­ In Who shall go first? A multicriteria approach to patient selection for first clinical trials of cardiac xenotransplantation, Kögel et al recommend the inclusion of patients who (1) have a (high) medical need for an allograft, (2) have the capacity to benefit from a xenograft, (3) have a ‘real’ choice between enrolment in a first-in-human clinical trial and an alternative life-sustaining treatment option and (4) have no clear record of previous non-compliance.1 As the authors discuss, patient selection must (...) promote the goal of gaining reliable and valid knowledge about the risks and benefits of cardiac xenotransplantation. While the four criteria outlined above certainly promote this goal, we argue it is crucial to add a fifth criterion emphasising the need to include diverse populations, particularly regarding sex, age, ethnicity and socioeconomic background.i In this commentary, we present two arguments for our claim and discuss the impact of neglecting diversity from the first trials on. ### The scientific rationale for including diverse populations First, including diverse populations in the first clinical trials of cardiac xenotransplantation enhances the scientific value of the data by assessing safety and efficacy among various populations. Treatment response can differ among patient (sub)groups as a result of genetic, physiological and socioeconomic factors.2 By including diverse populations from the first trials on, researchers can identify these …. Contemporary epistemological and cognitive studies, as well as recent trends in computer science and game theory have revealed an increasingly important and intimate relationship between Information, Interaction, and Agency. Agents perform actions based on the available information and in the presence of other interacting agents. From this perspective Information, Interaction, and Agency neatly ties together classical themes like rationality, decision-making and belief revision with games, strategies and learning in a multi-agent setting. Unified by the central notions Information, Interaction, and Agency, (...) the essays in this volume provide refreshing methodological perspectives on belief revision, dynamic epistemic logic, von Neumann games, and evolutionary game theory; all of which in turn are central approaches to understanding our own rationality and that of other agents. On Anscombe's view, intentional actions are characterized by a specific type of knowledge (practical knowledge) possessed by the agents that perform them. Recently, interest in Anscombean action theory has been renewed. Sarah Paul argues that Anscombean action theory faces a serious problem: It fails to discriminate between an action’s intended aim or purpose and its foreseen side effects. Since Anscombeans conceive practical knowledge as the formal cause of intentional actions, Paul dubs this a problem of “deviant formal causation.” In this (...) paper I will show that Anscombean action theory can escape Paul’s critique by employing a sufficiently developed conception of practical knowledge. It will turn out that Anscombeans can precisely capture the difference between intended aim and foreseen side effect in terms of differences in the agent’s knowledge. (shrink)
