In this article, we develop the concept of Transparency by Design that serves as practical guidance in helping promote the beneficial functions of transparency while mitigating its challenges in automated-decision making environments. With the rise of artificial intelligence and the ability of AI systems to make automated and self-learned decisions, a call for transparency of how such systems reach decisions has echoed within academic and policy circles. The term transparency, however, relates to multiple concepts, fulfills many functions, and holds different (...) promises that struggle to be realized in concrete applications. Indeed, the complexity of transparency for ADM shows tension between transparency as a normative ideal and its translation to practical application. To address this tension, we first conduct a review of transparency, analyzing its challenges and limitations concerning automated decision-making practices. We then look at the lessons learned from the development of Privacy by Design, as a basis for developing the Transparency by Design principles. Finally, we propose a set of nine principles to cover relevant contextual, technical, informational, and stakeholder-sensitive considerations. Transparency by Design is a model that helps organizations design transparent AI systems, by integrating these principles in a step-by-step manner and as an ex-ante value, not as an afterthought. We prove that there is no Borel connection for non-trivial pairs of unsplitting relations. This was conjectured in [3].

Recently some bioethicists and neuroscientists have argued for an imperative of chemical cognitive enhancement. This imperative is usually based on consequentialist grounds. In this paper, the topic of cognitive self-enhancement is discussed from a Kantian point of view in order to shed new light on the controversial debate. With Kant, it is an imperfect duty to oneself to strive for perfecting one’s own natural and moral capacities beyond one’s natural condition, but there is no duty to enhance others. A Kantian (...) approach does not directly lead to a duty of chemical cognitive self-enhancement, but it also does not clearly rule out that this type of enhancement can be an appropriate means to the end of self-improvement. The paper shows the benefits of a Kantian view, which offers a consistent ideal of self-perfection and teaches us a lesson about the crucial relevance of the attitude that underlies one’s striving for cognitive self-improvement: the lesson of treating oneself as an end in itself and not as mere means to the end of better output. Direct to consumer genetic testing has given rise to much controversy, especially in relation to testing for health diagnostic purposes. This paper will consider whether consumers' use of DTC genetic testing should be understood as predominantly recreational. It will be argued that recreational testing can encompass all information domains, including most kinds of predictive health risk information. In relation to recreational testing the potential identity implications for the consumer become a significant concern, more so than the risks more traditionally associated (...) with genetic testing. It will be concluded that while the DTC genetic testing sector is beset by numerous problems and an increase in consumers' genetic literacy is highly desirable, consumers' engagement with DTC genetic testing may be less problematic than sometimes assumed. We consider morphisms between binary relations that are used in the theory of cardinal characteristics. In [8] we have shown that there are pairs of relations with no Borel morphism connecting them. The reason was a strong impact of the first of the two functions that constitute a morphism, the so-called function on the questions. In this work we investigate whether the second half, the function on the answers' side, has a similarly strong impact. The main question is: Does the (...) nonexistence of a Borel morphism imply the non-existence of a morphism that is only Borel on the answers' side? We give sufficient conditions for an affirmative answer. The results are applied to the unsplitting relations where it has been open whether there is a morphism that is Borel on the answers' side. Since the introduction of photography by commercial studio photographers and the colonial state in Kenya, this global medium has been intensely debated and contested among Muslims on the cosmopolitan East African coast. This book does not only explore the making, circulation, and consumption of popular photographs, but also the other side, their rejection and obliteration, an essential aspect of a medium's history that should not be neglected. It deals with various »social spaces of refusal« in the local Muslim milieu and (...) in that of »traditional« spirit mediums in which visibility was contested in various and creative ways. It focuses on the »aesthetics of withdrawal«: the various ways and techniques that process the photographic act as well as the photographic image to theatricalize the surface of the image in new ways by veiling, masking, and concealing. In a fragmented historical perspective, Heike Behrend seeks to complement, decenter, and counter the history of photography as it has been told by the West and to narrate another history beginning with preceding local media such as textiles and spirit possession. Needs play a key role in many fields of social sciences and humanities, ranging from normative theories of distributive justice to conceptions of the welfare state. Over time, different conceptions of what counts as a need (i. e., what is considered a normatively relevant need) have been proposed. Many of them include (in one way or the other) needs for survival, decency, belonging, and autonomy. Little work has been done on how these kinds of needs are evaluated in terms of (...) their significance for distributive justice. To begin closing this gap, we investigate the role of the four aforementioned kinds of needs for impartial observers. We do so in two empirical studies. The first study asks participants to evaluate the importance of each of the four kinds of needs separately. We find that different levels of importance are attributed to the kinds of needs, which places them in a hierarchy. The second study asks participants to make distributive decisions. Results further support the hierarchy found in the first study and, additionally, reveal that participants tend to make coherent allocation decisions. (shrink)

Feminist scholars reacted to news of Beauvoir's death in 1986 by initiating a reevaluation of her life's work, a task encouraged by Sylvie Le Bon de Beauvoir, her adopted daughter, who edited for posthumous publication many of Beauvoir's personal notebooks and letters to Sartre. Some of the most exciting new interpretations of Beauvoir's philosophy that have resulted are brought together here for the first time; many of them, indeed, were written expressly for this first volume of essays on Beauvoir's philosophy (...) written since her death. We show that there may be a Milliken-Taylor ultrafilter with infinitely many near coherence classes of ultrafilters in its projection to ω, answering a question by López-Abad. We show that k -colored Milliken-Taylor ultrafilters have at least k +1 near coherence classes of ultrafilters in its projection to ω. We show that the Mathias forcing with a Milliken-Taylor ultrafilter destroys all Milliken-Taylor ultrafilters from the ground model.

The article takes Helmuth Plessner’s Political Anthropology from 1931 as a postfoundationalist theory of society avant la lettre - which is very similar to the later works of Claude Lefort, Ernesto Laclau, and Chantal Mouffe. Or, the article takes Plessner’s essay as an ‘ontology’ of the Political. After introducing remarks on the historical debates, in which Plessner aimed to intervene, his theory of the Political is reconstructed, within the three categories of ‘unfathomability’, of the constitutive outside, and of the vulnerability (...) of the human body. In a third and last step, Plessner’s most central and most problematic category for the Political - the ‘popular existence’ - is discussed: The ‘people’ is made visible as being a key notion of postfoundational theories of modern democracy, for it is - beneath the ‘Individual’ - one of the imaginary foundations, one of the foundational outsides of a democratically instituted collective. Die Philosophische Fakultat der Berliner Universitat stellte im Jahr 1828 eine Preisaufgabe, an deren Losung alle Studenten der Universitat teilnehmen konnten. Einem Vorschlag Hegels folgend ging es um eine Auseinandersetzung mit den "Prinzipien des Schonen" bei Kant. Nach anonymer Bewertung der eingegangenen Arbeiten wurde die von Bruno Bauer mit dem Preis geehrt. Wahrend die im Laufe der Jahre gestellten Aufgaben und erteilten Gutachten fast vollstandig erhalten sind, ist das Vorhandensein der von Bauer handschriftlich in lateinischer Sprache verfaten Arbeit (...) eine wissenschaftliche Raritat. Diese Schrift, deren Original sich im Archiv der Humboldt-Universitat zu Berlin befindet, wird hier erstmals publiziert. Eingeleitet durch eine philosophiegeschichtliche Betrachtung der Quelle (D. Moggach) und eine historische Einordnung der Preisschrift (W. Schultze) gestattet die synchrone Gegenuberstellung von lateinischem und deutschem Text dem Leser ein kritisches Studium der Quelle. Dieser Band soll den Auftakt fur weitere Publikationen wissenschaftlich und wissenschaftshistorisch interessanter Quellen des Archivs der Humboldt-Universitat bilden. (shrink)

Based on Moscovici’s classical study on the cultivation of psychoanalytic ideas in France in the 1950’s and our own research on modern biotechnology, we propose a paradigm for researching social representations. Following a consideration of the nature of representations and of the ‘iconoclastic suspicion’ that haunts them, we propose a model of the emergence of meaning relating three elements: subjects, objects, and projects. The basic unit of analysis is the elongated triangle of mediation : subject 1, object, project, and subject (...) 2, captured in the image of a ‘Toblerone’. Such social units cultivate, that is produce, circulate and receive representation which may be embodied in four modes–habitual behaviour, individual cognition, informal communication and formal communication–and in three mediums–words, visual images or non-linguistic sounds. We propose an operational definition of a ‘social representation’ as the comparison of four characteristics of communication systems: the content structures , the typified processes , and their functions , within the context of segmented social milieus. Seven implications for research on social representations are outlined: content and process; segmentation by social milieus rather than taxonomies; cultivation studies within social milieus; multi-method analysis; time structures and longitudinal data; the crossover of cultural projects and trajectories; the disinterested research attitude. This ideal type paradigm leads to an operational clarification to identify new research questions, and to guide the design and evaluation of studies on social representations. (shrink)

For about five decades the phrase “sanctity-of-life“ has been part of the Anglo-American biomedical ethical discussion related to abortion and end-of-life questions. Nevertheless, the concept’s origin and meaning are unclear. Much controversy is based on the mistaken assumption that the concept denotes the absolute value of human life and thus dictates a strict prohibition on euthanasia and physician-assisted suicide. In this paper, I offer an analysis of the religious and philosophical history of the idea of “sanctity-of-life.” Drawing on biblical texts (...) and interpretation as well as Kant’s secularization of the concept, I argue that “sanctity” has been misunderstood as an ontological feature of biological human life, and instead locate the idea within the historical virtue-ethical tradition, which understands sanctification as a personal achievement through one’s own actions. The article explores the underlying reasons for patients’ self‐perception of being a burden (SPB) in family settings, including its impact on relationships when wishes to die (WTD) are expressed. In a prospective, interview‐based study of WTD in patients with advanced cancer and non‐cancer disease (organ failure, degenerative neurological disease, and frailty) SPB was an important emerging theme. In a sub‐analysis we examined (a) the facets of SPB, (b) correlations between SPB and WTD, and (c) SPB as a relational phenomenon. We (...) analyzed 248 interviews with 62 patients, their family caregivers, and professionals using grounded theory and interpretive phenomenological analysis. SPB appeared as important empathic concern in care situations. Patients expressed many sorts of concerns for others, but also perceived an altered self‐understanding that did not meet mutual expectations within relationships. In SPB associated with WTD three constellations were found: (a) WTD to unburden others; (b) patients decided against hastening death to prevent being a further burden to others (in these cases, the SPB counteracted the wish to die); and (c) both wishes for and against dying were sustained by SPB. These patients often felt paralyzed and suffered deeply. Family caregivers felt emotionally touched by SPB and tried to unburden patients by caring and compassion. We concluded that the impact of SPB on a WTD and the various meanings the facets of SPB have in balancing relationships need to be worked out individually. An early palliative and narrative approach is warranted. (shrink)

Ever since Schopenhauer ́s accusation, it has been disputed whether Kant ́s few remarks concerning the ethical human-animal-relationship in the Lectures and in the Doctrine of Virtue fail to support ethical arguments on behalf of animals. One critique that plays a central role is whether Kant would have forbidden cruelty to brutes for educational purposes. In addition to these old objections, Kant ́s ethics is charged to be speciesistic by animal ethicists and animal rights philosophers at present.The following article examines (...) especially §17 of the Doctrine of Virtue, which is the only animal ethical text authorized by Kant himself. The interpretation starts by taking the context of §17 into account, particularly the “Episodic Section on an Amphiboly in Moral Concepts”. The systematic output of the cruelty-account and of the duty classes is then analyzed. Central for the understanding of Kant ́s argumentation relating to animals are the perfect duties to oneself, which are linked to Kant ́s foundation of human dignity. Finally the roles of the physical and emotional needs of brutes and humans in Kant ́s ethics are compared with each other. Some conclusions are then drawn concerning human and animal rights in relation to a duty-based argumentation. The article therefore appreciates Kant ́s integration of animal suffering into the very core of his virtue ethics, an integration that may be able to open the door for an enlightened animal ethics based on human responsibility. We discuss other recent studies on the acquisition of the German plural that do not support the dual-mechanism model. The attested overgeneralizations are not by default only, nor completely random, but predictable from subregularities based on the grammatical gender and the phonology of the noun. In addition, the dual-mechanism model creates a number of problems for acquisition (theory) rather than solving existing ones.

In this article I examine the architecture and architectural thinking of Finnish Academician Reima Pietilä in relation to his design methodology. Pietilä was an architect with an original, creative, artistic personality, who set out early in his career to develop the form language, and theory of modern architecture, moving it towards an organic expressionism. Finnish nature mysticism was a source of inspiration for him, and ‘nature architecture’ one of his key concepts.

In lieu of an abstract, here is a brief excerpt of the content:Response To June Boyce-Tillman, “Towards an Ecology of Music Education”Elizabeth BauerJune Boyce-Tillman explores the values implicit in the Western musical traditions that also dominate music education. She examines the five interlocking areas of materials, expression, construction, values, and spirituality and how these areas create a more holistic way of conceptualizing the musical experience within music education. By describing the divide between the values of system A and system B, (...) Boyce-Tillman reminds us that these issues are persistent and demand our constant attention as music educators. She supports the conviction that music [End Page 186] curricula should not be dictated by a national curriculum. Instead, education should be a powerful way of supporting the dominant value system of a culture. As an educator focusing on the population of students with special needs, I find myself agreeing with her advocacy of holistic education and suggest that she look at the model of special education to implement this ecology of music education. Boyce-Tillman's proposal evokes a number of responses, of which I will mention two.My first response is to her belief in the individual within the community. This is often problematic in current educational circles. States and countries are being held to standardized curricula. While in and of themselves standards are not bad because they set educational expectations, dictated curricula do not allow for individuality and creativity. Special education addresses this problem by the use of an individualized education plan (IEP). This plan is devised to meet the abilities and capabilities of each individual student. An IEP states the educational goals for the student with special needs for one academic year. Although the IEP contains year-long educational goals, it also contains the methods for how a student will meet those goals. No two students with special needs will have the same educational curriculum. This idea is supported by humanistic ideas in that the individual child is more important than a fixed curriculum. Furthermore, the IEP is developed by all teachers working with the child. For example, a child with Down syndrome normally works with a speech therapist, physical therapist, occupational therapist, general education teacher, and several other subject specific teachers (music, art, physical education, and so on). During the creation of the IEP, all therapists and teachers work together to devise the best educational plan for the student. This helps to ensure continuity between therapies and teaching methods.Currently, many music teachers are excluded from the process of devising the IEP. This also supports Boyce-Tillman's ideas on how national curricula often support the dominant value systems and reinforce the notion of subjugating other value systems. However, I propose that the inclusion of the music teacher in the IEP process because music class is one of the easiest ways to make the student with special needs feel part of a community. The music classroom supports the idea of working together to accomplish a common goal.My second response relates to the valuing of process. While Western culture has typically placed value on product, the converse is true in special education. Throughout the devising of the IEP, the process of learning is valued. Although special education teachers have an ultimate goal for what the student is to accomplish, it is more important to examine the process of how the student achieves that goal. Furthermore, students with special needs are not given rigid time-lines in which they have to accomplish a goal. Instead, a student is allowed to move at his or her own pace. [End Page 187]Moreover, while the students with special needs are moving at their own pace, they are also nurtured by the teacher. In the United States it is common for students with special needs to be educated in the classroom with their nondisabled peers. This is referred to as inclusion. For certain parts of the day, the students with special needs may leave the regular classroom and receive tutoring in certain subject areas by the special education teacher. Many teachers who do not have experience in teaching students with special needs have noticed how the students with special needs achieve more when they are with their special education... (shrink)

Von einer Theorie des objektiven Geistes in der Nachfolge von Moritz Lazarus ausgehend, (...) entwickelt Simmel eine Kulturphilosophie, in deren Zentrum die Frage nach dem Verhältnis zwischen dem individuellen Lebensvollzug des Einzelnen und den ihn umgebenden und herausfordernden kulturellen Objektivationen steht.
