Difficulty is often treated as blame-mitigating, and even exculpating. But on some occasions difficulty seems to have little or no bearing on our assessments of moral responsibility, and can even exacerbate it. In this paper, I argue that the relevance (and irrelevance) of difficulty with regard to assessments of moral responsibility is best understood via Quality of Will accounts. I look at various ways of characterising difficulty – including via sacrifice, effort, skill and ‘trying’ – and set out to demonstrate (...) that these factors are only blame-mitigating where, and to the extent that, they complicate ascriptions of insufficient concern. Matters become more complex, however, when we turn to difficult circumstances that seem to generate such objectionable attitudes. This is arguably the case with epistemic difficulty and certain instances of moral ignorance. Here I argue that certain difficult circumstances diminish the sense in which false moral beliefs are genuinely revelatory of the agents who hold them. In particular, I draw on the distinction between difficulty that generates objectionable attitudes, and objectionable attitudes that generate difficulty. I argue that the former, but not the latter, can plausibly be viewed as blame mitigating, and that this would apply to (limited) cases of moral ignorance. (shrink)

An area of consensus in debates about culpability for ignorance concerns the importance of an agent’s epistemic situation, and the information available to them, in determining what they ought to know. On this understanding, given the excesses of our present epistemic situation, we are more culpable for our morally-relevant ignorance than ever. This verdict often seems appropriate at the level of individual cases, but I argue that it is over-demanding when considered at large. On the other hand, when we describe (...) an obligation to know that avoids over-demandingness at large, it fails to be sufficiently demanding in individual cases. The first half of this paper is dedicated to setting up this dilemma. In the second half, I show that it cannot be easily escaped. Finally, I suggest that this dilemma impedes our ability to morally appraise one another’s ignorance, and even our own. (shrink)

The idea that conscious control, or more specifically akratic wrongdoing, is a necessary condition for blameworthiness has durable appeal. This position has been explicitly championed by volitionist philosophers, and its tacit influence is broadly felt. Many responses have been offered to the akrasia requirement espoused by volitionists. These responses often take the form of counterexamples involving blameworthy ignorance: i.e., cases where an agent didn’t act akratically, but where they nevertheless seem blameworthy. These counterexamples have generally led to an impasse in (...) the debate, with volitionists maintaining that the ignorant agents are blameless. In this paper, I explore a different sort of counterexample: I consider agents who have acted akratically, but whose very conscious awareness of their wrongdoing complicates their blameworthiness. I call these cases of “complex akrasia,” and I suggest that they are a familiar aspect of moral life. I interpret these cases as supporting non-volitionist accounts, and particularly Quality of Will accounts. (shrink)

A variety of mental disorders—including ASD, ADHD, major depression, and anxiety disorder, among others—may directly impact what an agent notices or fails to notice. A recent debate has emphasised the potential significance of such “impairment-derived ignorance,” and argued that failure to account for certain compelling cases would seriously undermine theories which intend to establish the conditions for blameworthy ignorance. In this comment we argue, contra a recent challenge, that Quality of Will (QW) accounts are able to explain the normative significance (...) of impairment-derived ignorance. The plausible, ambivalent results QW accounts yield in difficult cases of impairment-derived ignorance further reveals the explanatory power of such accounts when it comes to blameworthy ignorance. Within debates concerning responsibility for ignorance the distinction between moral and factual ignorance is often treated as crucial. Many prominent accounts hold that while factual ignorance routinely exculpates, moral ignorance never does so. The view that there is an in-principle distinction between moral and factual ignorance has been referred to as the “Asymmetry Thesis.” This view stands in opposition to the “Parity Thesis,” which holds that moral and factual ignorance are in-principle similar. The Parity Thesis has been closely aligned with (...) volitionist accounts of moral responsibility, whereas the Asymmetry Thesis has been closely aligned with Quality of Will accounts. Two central questions are at work here: how ignorance excuses, and whether it excuses in the same way for both moral and factual ignorance. I will argue that these questions have often been confused in the present debate, and once we have distinguished more clearly between them, it seems that Quality of Will accounts are compatible with the Parity Thesis. And more generally: that the distinction between moral and factual ignorance is far less important in debates about responsibility for ignorance than it has often appeared. (shrink)

The notion of uncommandability has been central to how we perceive our emotional lives, and particularly romantic love. According to this notion, while we can control how we treat people, we have little control over how we feel about them. The argument from uncommandability is often evoked as a way of sidestepping moral obligations regarding our romantic emotions. One challenge to uncommandability is the potential to manipulate our emotions through psychopharmaceuticals. Much of the debate on so-called ‘love drugs’ has concerned (...) the permissibility and worth of these interventions. By comparison, there has been less exploration of their implications for moral obligation and responsibility. How might the emergence of these interventions change what can be emotionally demanded of us? We ultimately suggest that it is necessary to view the complex morality of our emotional lives through different evaluative paradigms: one concerning moral duty and obligation, where we have no claim to each other's romantic love irrespective of its commandability, and the other concerning the appropriateness of our reactive attitudes, where we are at times justified in feeling morally injured by another person on account of their failure to love us, regardless of whether they had control in the matter. Exemption from blameworthiness is often bound to implicit or explicit claims of diminished agency, or even non-agency. This poses a dilemma in navigating moral relationships affected by mental illness. While it is crucial for assessments of responsibility to be responsive to the significance of mental illness, must this responsiveness come at a cost to symmetrical moral relations? In this paper we argue, contra recent critiques, that Strawsonian accounts of responsibility are able to navigate this dilemma, and can accommodate significant exculpation (...) on the basis of mental illness while maintaining symmetrical relations. We understand this to be part of the larger recognition that while we have certain fundamental entitlements within our moral relationships, it is also possible to be over-entitled, and to expect too much of others. Our account draws, in particular, on the moral significance of difficulty. Difficulty is inherently scalar, and in drawing on this explanatory framework we explicate a theory of both excuse and exemption by degree. We argue for a significant realm of excuse on the basis of mental illness that is fully compatible with symmetrical relations. However, we also acknowledge the limits of this accommodation on Strawsonian grounds, and argue that these limits are justified and appropriate. (shrink)

I seek to re-approach the longstanding debate concerning the moral relevance of physical distance by emphasising the important distinction between evaluations of wrongdoing and evaluations of blameworthiness. Drawing in particular on Quality of Will accounts of blameworthiness, I argue that proximity can make an important difference to what qualifies as sufficient moral concern between strangers, and therefore to evaluations of blameworthiness for failures to assist. This implies that even if two individuals (one distant, one proximate) commit an equivalent wrong in (...) ignoring preventable suffering, it can still be the case that the proximate individual is more blameworthy insofar as their disregard expresses a more reprehensible attitude. I argue that emphasising this distinction allows us to make sense of a range of conflicting intuitions with regards to the effects of physical distance on our obligations to assist. (shrink)

This paper proposes a premise-based approach to the truth of the foundational principle—the requirement to take actions to benefit one’s life. Ayn Rand’s choice-based foundation as “the single choice: to live” has equivalent consequences for ethical theory, but the premise-based approach and proof firmly anchor the foundation of ethics to the facts of reality. This article demonstrates that in order to be true and consistent, a particular set of premises requires (...) the taking of beneficial action for one’s life, and that provides proof of the truth of the Objectivist ethics. We routinely take diminished capacity as diminishing moral responsibility (as in the case of immaturity, senility, or particular mental impairments). The prospect of enhanced capacity therefore poses immediate questions with regard to moral responsibility. Of particular interest are those capacities that might allow us to better avoid serious harms or wrongdoing. We can consider questions of responsibility with regards to enhancement at various removes. In the first instance: where such (safe and effective) interventions exist, do we have an obligation to (...) undergo such enhancement? Secondly: once enhanced, would the ambit of our responsibility therefore increase? Some philosophers have argued that enhanced capacities potentially generate “hyperresponsibility.” Hyperresponsible people would be held to a different and higher moral standard than those of us with more ordinary human capacities, and are liable to be more blameworthy for wrongdoing than ordinary agents. This chapter discusses the implications of enhancement for three central views of responsibility, namely: capacity-based, control-based and revelation-based views. Debates around moral responsibility have primarily concerned diminished capacities; as such the prospect of enhancement introduces new terrain—and potentially new fault-lines and complexities—in which to interrogate our theoretical conceptions of the foundations (and limits) of moral responsibility. This paper evaluates several recent efforts to interpret the work of Nāgārjuna through the lens of modern symbolic logic. An attempt is made to uncover the premises that justify the use of symbolic logic for this purpose. This is accomplished through a discussion of (1) the historical origins of those premises in the Indian and Tibetan traditions, and (2) how such assumptions prejudice our understanding of Nāgā rjuna’s insistence that he has no “proposition” (pratijñā). Finally, the paper sets forth an (...) alternative interpretation that takes into account the literary dimensions of Nāgārjuna’s writing. (shrink)

The Effect: An Introduction to Research Design and Causality is about research design, specifically concerning research that uses observational data to make a causal inference. It is separated into two halves, each with different approaches to that subject. The first half goes through the concepts of causality, with very little in the way of estimation. It introduces the concept of identification thoroughly and clearly and discusses it as a process of trying to isolate variation that has a causal interpretation. Subjects (...) include heavy emphasis on data-generating processes and causal diagrams. Concepts are demonstrated with a heavy emphasis on graphical intuition and the question of what we do to data. Structural Causal Modeling (SCM) is an approach to causal inference closely associated with Judea Pearl and given an accessible instroduction in [Pearl, J., & Mackenzie, D. (2018). The book of why: The new science of cause and effect. Basic Books]. It is highly popular outside of economics, but has seen relatively little application within it. This paper briefly introduces the main concepts of SCM through the lens of whether applied economists are likely to find marginal benefit in these methods beyond (...) standard economic approaches to causal inference. The most promising areas are those where SCM's causal diagrams alone offer significant value: covariate selection, the development of placebo tests, causal discovery, and identification in complex models. This is an assumption easier to make than to substantiate, and in view of the increasing insistence upon this point, it is now appropriate to inquire whether or not it possesses a tangible foundation. This requires a consideration of the distinctive characteristics of social science, the determination whether or (...) not jurisprudence exhibits these characteristics, and, if not, if it is possible for it to assume them. My dissertation traces key aspects of the conceptual influence of Heidegger's work on feminist poststructuralist theories. This archeology enables me to indicate that poststructualism cannot provide the foundation necessary to forming three normative ideals requisite to a viable feminist theory: personal autonomy, heterogeneous community, and solidarity. I argue that certain versions of poststructuralism repeat Heidegger's abstraction from an hermeneutics of suspicion and his totalizing rejection of modernity. Without a theory of willed ignorance, post-Lacanian feminism undercuts women's agency. And, without tying (...) a vision of Sittlichkeit to ideology critique, feminist ethics falls prey to abstraction and antinormativism. ;In Part I, I recover a dialectical theory of autonomy that can account for the deliberate ways that subjects mediate their environment. In Part II, I flesh out Heidegger's and Irigaray's respective visions of heterogeneous community. In Part III, however, I show how neither Heidegger nor US appropriations of Irigaray yield either a sufficiently complex moral theory or a theory of solidarity. After delineating Heidegger's antinormative tendencies, I reveal similar deficiencies in the works of Irigaray and Drucilla Cornell. I demonstrate that the nominalist underpinnings of post-Lacanian feminism threaten to normalize a fragmented view of pluralism rather than tackle the hard problem of developing interactive models of universalism and of solidarity. ;I conclude by developing features of a feminist methodology that can support solidarity and avoid antinormativism. These features include: a hermeneutic of the symbolic order complex enough to address the overlap between race, class and gender; grounding theory in ideology critique; a model of critical social consciousness rooted in the ability to disdain the immiseration of others and to acknowledge one's own interests; and an interactionist basis for moral theory.
