The historical context of body and tissue donation is deeply problematic, with patriarchal and colonial narratives. The contemporary context of molecular and genetic biology further complicates issues of bodily donation through narratives of abstraction and extraction. As practitioners working outside the conventional boundaries of scientific study learn the tools and techniques to extract and use bodily materials, they are also learning and challenging the procedures and processes. This article approaches questions of bodily donation through the edited transcript of a conversation (...) between artists who regularly use body fluids and cellular bodily materials in their practice, moderated by Louise Mackenzie and Ilke Turkmendag as part of the Taboo–Transgression–Transcendence in Art & Science Conference held online with the support of the University of Applied Arts, Vienna, 2020. The panel challenged the ethical and conceptual assumptions made in biotechnological research and reconsidered where the boundaries of the body lie, what ‘authority’ research carries and what choices researchers make when using the bodies of others. The transcribed conversation addresses taboos of the female body, specifically menstruation, the commodification of tissue from female human bodies, human milk politics and questions biopolitical treatment of the female body. This article addresses the child’s right to know their genetic origins in mitochondrial donation. It focuses on the UK’s public debate on mitochondrial replacement techniques and examines the claims-making activities that shaped the donor information regulations. During the public consultation, downplaying the significance of the mitochondria helped distinguish mitochondria donors from gamete donors and determine their relational status with the resulting child. As a result, according to the Mitochondrial Donation regulations, mitochondria donors, unlike gamete donors, will not be required to (...) be identifiable to the resulting child. I argue that, in the UK, similar to donor conception, public understanding of mitochondrial donation is shaped by a “calculus of genes”: simplified accounts of how genes determine the resulting child’s characteristics and identity. While the donor conception regulations ascribe social meaning to the passage of genes, the mitochondria regulations strip the social meaning away from the donation based on the assumption that the genetic contribution made by the donor is quantitatively insignificant in influencing the identity of the resultant offspring. The nature of the genetic material itself should not be considered as a privileged standpoint from which to decide on social meaning of the donation or the rights attached to it. (shrink)

This study focuses on the effects of spatial qualities of the viewing location on the behavior of citizens towards the observation of the skylines. The majority of the existing literature on skyline studies revolves around the discussions of the aesthetic qualities of the skyline per se, and ignores the observation space. Nevertheless, the differences in citizens' behavior towards viewing the skyline stem not only from their diverse personal characteristics and daily emotional states, but also from the spatial qualities of the (...) viewing space. This study addresses this gap in the literature with its concentration on the qualities of the urban spaces from which the city skyline is viewed. The objective of this study, therefore, is to fill this gap by discussing the ultimate behavioral decisions of experiencers in viewing the Izmir skyline from the perspective of the spatial characteristics of the Karşıyaka coastline as an observation location. In doing so, the study first focuses on the atmosphere theories where the reciprocal relationship between the qualities of experienced space and its experiencers become dominant. Through observations in the Karşıyaka coastline, the reciprocal relationship leads to the definition of the spatial factors as layers of analysis, which are based on the transformation of the spatial layers of the experienced space and the behavioral decisions of the experiencers. Then, to better comprehend their relationships, Analytical Hierarchy Process (AHP) is utilized to analyze the observational data. The study by merging the spatial atmosphere and contemplative neuroaesthetic theories provides a new framework for the upcoming skyline-based studies. Moreover, the outcomes of the analysis demonstrate that the contrast between day and night city skyline viewing in the Karşıyaka coastline emerges as a point of reference for lighting, proving to be the most impactful factor among all layers. This paper examines the construction of maternal responsibility in transgenerational epigenetics and its implications for pregnant women. Transgenerational epigenetics is suggesting a link between maternal behaviour and lifestyle during pregnancy and the subsequent well-being of their children. For example, poor prenatal diet and exposure to maternal distress during pregnancy are linked to epigenetic changes, which may cause health problems in the offspring. In this field, the uterus is seen as a micro-environment in which new generations can take shape. Because epigenetics (...) concerns how gene expression is influenced by the social realm, including a range of environmental conditions such as stress, diet, smoking, exercise, exposure to chemicals, pollution, and environmental hazards, the research findings in this area have direct policy relevance. For policy makers, rather than controlling this complex range of determinants of health, isolating and targeting maternal body and responsibilising mothers for the control of this micro-environment might seem feasible. Yet, examining the maternal body in isolation as a powerful environment to shape the health of next generations not only responsibilises women for the environment that they cannot control but also makes them a target for intrusive and potentially exploitative biomedical interventions. Even though ‘social factors’ are increasingly considered in epigenetics writing, the phrase is usually taken as self-explanatory without much elaboration. Drawing on the Covid-19 pandemic, this paper moves the current debate forward by providing consolidated examples of how individuals, including pregnant women, have little control over their environment and lifestyle. As evidenced by the pandemic’s disproportionate effects on people with low socioeconomic or poor health status, some pregnant women bore considerable physical and psychological stress which combined with other stress factors such as domestic violence. In any focus on an aesthetic experience one may find both sensational and cognitive qualities, referred to as the scene and scenario respectively. Hence, an experiencer tries to decipher the scenario —a narration—by sensing the scene —space—through the spatial atmosphere. Thus, space starts to transform into a poetic experience. Japanese architecture, on account of a number of inherent qualities, has the capability to convey such narrations in spaces. In Japanese examples, an experiencer tries to derive the narration that emanates from (...) explicit qualities—sensational, such as textual, visual, audial, or tactile phenomena—with his/her implicit qualities—cognitive/intellectual abilities. The article examines the layer of narration of Japanese architectural structure through haiku 俳句 and haiga 俳画 examples, in doing so, utilizes the layers proposed on behalf of the explicit and implicit qualities: nature-based and feeling-based. Die analytischen Überlegungen zum Neuro- Enhancement machen deutlich, dass aufklärerische Ideale heute noch wirkmächtig bleiben. Vor allem zum Neuro-Enhancement analoge Leitmotive lassen sich - so die These des Beitrags - in den philanthropischen Theorien der Spätaufklärung finden. Und auch die dort angelegten Widersprüche und Ambivalenzen wirken in die heutigen Diskurse um das Neuro-Enhancement. Two major reports in the UK and USA have recently sanctioned as ethically acceptable genome editing of future generations for the treatment of serious rare inherited conditions. This marks an important turning point in the application of recombinant DNA techniques to humans. The central question this paper addresses is how did it became possible for human genetic engineering (HGE) of future generations to move from an illegitimate idea associated with eugenics in the 1980s to a concrete proposal sanctioned by scientists (...) and bioethicists in 2020? The paper uses the concept of a regime of normativity to understand the co-evolution and mutual shaping of technology, imaginaries, norms and governance processes in debates about HGE in the USA and UK. It will be argued that interlinked discursive, institutional, political and technological changes have made proposals for the use of genome editing in the genetic engineering of future generations both “thinkable” and legitimate. Genome editing enables very accurate alterations to DNA. It promises profound and potentially disruptive changes in healthcare, agriculture, industry, and the environment. This paper presents a multidisciplinary analysis of the contemporary development of genome editing and the tension between continuity and change. It draws on the idea that actors involved in innovation are guided by “sociotechnical regimes” composed of practices, institutions, norms, and cultural beliefs. The analysis focuses on how genome editing is emerging in different domains and whether this marks (...) continuity or disruption of the established biotechnology regime. In conclusion, it will be argued that genome editing is best understood as a technology platform that is being powerfully shaped by this existing regime but is starting to disrupt the governance of biotechnology. In the longer term is it set to converge with other powerful technology platforms, which together will fundamentally transform the capacity to engineer life. (shrink)

Tüsterî (ö. 283/896), Sülemî (ö. 412/1021) ve Kuşeyrî (ö. 465/1072) ilk dönem tasavvufî tefsir açısından önemli müfessirlerdir. Tüsterî ve Sülemî tefsirleri Kur’ân’ı baştan sona tefsir eden sistemli eserler değildir. Ancak yapılan yorumların çoğunlukla rivayet tefsiri niteliği taşımalarının yanında ilk dönem tasavvuf ehlinin görüşlerini esas almaları bu tefsirleri önemli kılmaktadır. Kuşeyrî tefsirinin ise Tüsterî ve Sülemî tefsirlerine göre daha sistemli olmasının yanında bazı âyetler dışında Kur’ân’ı baştan sona tefsir eden ilk tasavvufî tefsir olduğu söylenebilir. Bu çalışmada her üç müfessirin Allah korkusu (...) ile ilgili âyetlere yapmış oldukları yorumlar karşılaştırmalı şekilde incelenerek Allah korkusuna bakış açıları ortaya konmaya çalışılmıştır. Konu başlıkları müfessirlerin Allah korkusu ile ilgili âyetlere yaptıkları yorumlar esas alınarak belirlenmiştir. Bu çalışma aynı dönemde yaşamış bu müfessirlerin konuya bakış açılarını ortaya koyması açısından önem taşımaktadır. Çalışmanın amacı ise bu müfessirlerin Allah korkusu ile ilgili ayetleri yorumlama şekilleri ve bu yorumlarda, kabul edilen sufî tefsir normlarına uyum hususunu ortaya koymaya çalışmaktır. Çalışma neticesinde müfessirlerin her birisi açısından Allah korkusunun son derece önemli olduğu, bazı âyetlerin yorumlarında birleştikleri, bazı âyetlere farklı izahlar getirdikleri, yorumlarında zahiri mananın öncelendiği, ele alınan âyetler bağlamında isrâiliyâta yer verilmediği, ilgili her âyet için her müfessirin yorum yapmadığı gibi birtakım sonuçlara ulaşılmıştır. Öz: Bu makale Neolitik döneme ait ve Anadolu’da inşa edilen ilk tapınak olma özelliğine sahip Göbeklitepe’yi ele almaktadır. Arkeologlara göre burası insanlığın en eski tapınaklarından biridir. Göbeklitepe, yerleşik hayattan ve tarımsal üretimden yoksun olan avcı-toplayıcı toplulukların dinsel inanışları hakkında çok önemli bilgiler sunar. Bu tapınak, arkaik insanların dinden ve inançtan yoksun ilkel bir hayat sürmediklerini, aksine bir inanca sahip olduklarını, inançlarını yaşamak için tapınak inşa ettiklerini ve zengin bir dinî sembol kullandıklarını göstermektedir. Göbeklitepe, insanların yerleşik hayata geçip kendisi için konut (...) yapmadan, hayvanları evcilleştirmeden ve tarımsal üretime başlamadan önce dinî ihtiyaçlarını karşılamak için tapınak yaptığının bir göstergesidir. Özet: Bu makale Neolitik döneme ait ve Anadolu’da inşa edilen ilk tapınak olma özelliğine sahip Göbeklitepe’yi ele almaktadır. Şanlıurfa yakınlarında 1995 yılında başlatılan arkeolojik kazılar, insanlık tarihine bakış açımızı değiştirmiş ve geçmiş hakkında sahip olduğumuz bilgilerin doğruluğunu test etme imkânı sunmuştur. Göbeklitepe, arkaik insanın inanç ve düşünce dünyası hakkındaki bilgilerimizin gerçeği yansıtmadığını göstermiştir. Yaşamını avcı-toplayıcı olarak sağlamaya çalışan, din ve soyut düşünceden yoksun olduğu düşünülen, çanak-çömlek yapmasını bile bilmeyen, tarımı ve yerleşik hayatı keşfetmemiş insanların yoğun ve zengin bir sembolik anlatıma sahip tapınaklar yapması, bilim adamlarını derinden etkilemiştir. Toplamda 20 adet olan ve çapı 10 -30 metre arasında değişen dairesel yapılardan oluşan Göbeklitepe tapınaklarının en ilgi çekici unsuru, T biçiminde olan ve üzerinde soyut sembol ve hayvan kabartmalarını bulunduran dikili taşlardır. Dairesel yapının merkezinde iki adet ve çevresinde 10 ile 12 adet arasında T biçiminde yaklaşık 200 tane dikili taş bulunmaktadır. Bu T biçimindeki dikili taşlar üzerinde kapsamlı bir inceleme yapıldığında ve kadim Anadolu ve Mezopotamya uygarlıklarının dinsel inanışları ve tapınak kültü göz önünde bulundurulduğunda, bu dikili taşların tanrıları sembolize ettiği anlaşılmaktadır. Göbeklitepe, çocukları veya daha küçük dereceli tanrılar tarafından çevrelenen ve bu tanrıların oluşturduğu çemberin merkezinde yer alan tanrı ve tanrıça çiftinin oluşturduğu tanrılar panteonunun kutsal alanıdır. Göbeklitepe bir tapınak olmanın ötesinde karanlıkta kalmış bir inanç sisteminin en önemli temsilcisi olarak karşımızda durmaktadır. Yazılı kaynakların bulunmadığı ve sınırlı arkeolojik verilerin elde edilebildiği Neolitik Dönemin erken evresine ait olan Göbeklitepe, bu dönemde yaşamış arkaik insanın inanç ve düşünce dünyasını bize göstermektedir. Bu megalitik yapının yapısal ve biçimsel özellikleri, arkaik insanın sanıldığı gibi ilkel olmadığını kanıtlamaktadır. Göbeklitepe, dinin doğuşu ve gelişimi konusunda çok önemli bilgiler sunmaktadır. Özellikle evrimci ve pozitivist bakış açılarıyla oluşturulmuş ve dinin büyü, ruh, korku, atalara tapma gibi basit ve asılsız yapılardan doğup zamanla karmaşık ve kurumsal inançlar biçimine dönüştüğünü öne süren teorilerin gerçeği yansıtmadığını göstermiştir. Araştırmacılar, avcı-toplayıcı toplulukların yerleşik hayata ve tarımsal üretime geçtikten sonra toplumsal yaşamla birlikte bazı sorunlarla karşılaştıklarını ve bu sorunlara çözüm arayışının dinlerin doğuşunu hazırladığını düşünüyorlardı. Diğer bir ifade ile kurumsal dinler, karmaşık toplumsal yaşamın bir ürünü ve sonucu olarak görülüyordu. Fakat Göbeklitepe dinsel inanışların düşünülenden çok daha eski dönemlerde, kurumsal olarak ve basit olmayan formlarda bulunduğunu göstermiştir. Göbeklitepe’nin, bilinen en eski ve ilk tapınak yapısı olduğu iddia edilmektedir. Kendisinden önce bilinen antik tapınaklardan en az 5000 yıl eski olan bu megalitik yapı, uygarlığın gelişiminde dinsel inanışların ne kadar etkili ve önemli olduğunu açık bir şekilde göstermektedir. Uzun yıllar kazı başkanlığını yapmış olan arkeolog Klaus Schmidt, Göbeklitepe’nin ortaya çıkmasıyla birlikte “.. önce tapınak kuruldu sonra şehir. ” sözleriyle, insanoğlunun genlerinde bulunan inanma ihtiyacının ne kadar öncelikli olduğunu ifade etmiştir. Göbeklitepe insanoğlunun konut, tarım ve çanak çömlek gibi temel ihtiyaçlardan önce görkemli ve karmaşık tapınaklar yaptığını ve bunun arkaik insan topluluklarının güçlü inanç duygusundan kaynaklandığını göstermiştir. İnsanın genlerinde bulunan inanma ihtiyacı insana her şeyden önce tapınak yapmayı ilham etmiştir. Göbeklitepe ile temsil edilen inanç sistemi ve düşünce dünyasının ne kadar zengin ve etkili olduğunu, aynı bölgede en az 5000 yıl sonra ortaya çıkan Anadolu ve Mezopotamya uygarlıkları üzerindeki etkisinden anlayabiliriz. Bu uygarlıkların tapınak yapıları ve dinsel inanışları, bu megalitik yapı ile dikkate değer bir biçimde uyuşmaktadır. Bu uygarlıkların karanlıkta kalmış yönlerini ortaya çıkarmada, Göbeklitepe kaçırılmayacak bir fırsat sunmaktadır. Bu megalitik yapı ortaya çıktığında büyük ses getirmiş ve bilim insanlarının ilgisini çekmiştir. Hakkında yazılı ve görsel basında çok sayıda haberin çıktığı bu tapınak kompleksinin, Aden bahçesi, Babil Asma Bahçelerinin kalıntısı, Şaman tapınağı ve uzaylıların merkezi olduğu iddiaları ortaya atılmıştır. Göbeklitepe üzerinde yapılan arkeolojik kazıların ilerlemesi ve onun hakkında daha fazla bilgiye ulaşılması, onun bir ritüel merkezi olarak tapınak olduğunu göstermiştir. Göbeklitepe’nin yapısal ve biçimsel özellikleri, bu yapının her şeyden önce bir tapınak olduğunu göstermiştir. Gerek dikili taşlardan oluşan dairesel yapıları ve gerekse yerleşim yerlerinden uzak yüksek bir tepede bulunması bu düşünceyi güçlendirmektedir. Göbeklitepe’yi avcı-toplayıcı toplulukların ibadet ettikleri, tanrılara kurbanlar sundukları, yılın belirli dönemlerinde dinî festival ve şölenler gerçekleştirdikleri, tanrıların yaşadığı kutsal mekânlar olarak gördükleri ve kutsalı tecrübe ettikleri bir tapınak olarak düşünmek daha doğru bir yaklaşımdır. Göbeklitepe’nin, tarih boyunca inanç merkezi olarak kalmış ve peygamberler şehri olarak bilinen Şanlıurfa’da ortaya çıkması ülkemiz için önemli bir ekonomik ve kültürel fırsat oluşturmuştur. Anadolu’nun ne kadar kadim ve zengin bir kültürel dokuya sahip olduğunu kanıtlayan bu megalitik yapı, ortaya çıktığı günden beri birçok yerli ve yabancı araştırmacının akınına uğramıştır. Bilimsel literatürün en eski ve ilk tapınağı olan Göbeklitepe, arkaik insanın günümüz insanına miras olarak bıraktığı ve insanlığın ilk dönem sırlarını taşıyan gizemli bir tapınak kompleksidir. İstanbul’un fethinden sonra Avrupalı Hıristiyan güçler, Haçlı Seferi hazırlıklarına başlamış ve bunun için Roma-Germen İmparatorluğu ve Papalık eliyle toplantılar ve kongreler gerçekleştirmişlerdir. Toplantıların haricinde bir birlik çağrısı için Avrupa’nın ilk matbaası olan Gutenberg Matbaasında “Türklere Karşı Hıristiyanlara Bir Uyarı” adıyla dokuz sayfalık bir kitapçık basılmıştır. Yüzlerce yıl varlığından haberdar olunmayan bu tek nüshalık eser, 19. yüzyılda “Türk Takvimi” adıyla ve Avrupa’nın ilk matbu takvimi olma iddiasıyla gün yüzüne çıkartılmıştır. Bu çalışma kapsamında incelenen nüshaya Münih Dijital Kütüphanesi üzerinden ulaşılmıştır. Eserle ilgili (...) ikincil çalışmalar için Avrupa’daki dijital kütüphaneler ve uluslararası veri tabanları taranmıştır. Bu yöntemle elde edilemeyen bir kısım eserler ise Türkiye’deki çeşitli üniversite kütüphanelerinden temin edilmiştir. Bu çalışmada söz konusu takvimin açık bir propaganda metni olduğu görülmüştür. Gerek dönemin Hıristiyan devlet adamları gerekse Avrupa Hıristiyan toplumu takvimin hedef kitlesi, Müslümanlar / Türkler de takvimdeki düşman kabul edilen taraflardır. Dolayısıyla söz konusu takvim dinî referanslar üzerinden kurgulanmış, on iki havariye atfen on iki ay üzerinden bir metin oluşturulmuştur. Her bir ayda Hıristiyanlar için kutsal kabul edilen azizlerin isimleri zikredilerek söz konusu propagandanın etkisi artırılmaya çalışılmıştır. Azizlerin bir kısmının Anadolu coğrafyasından seçilmesi, Müslüman topraklarının dinî köken temellendirmesi üzerinden meşru hedef haline getirme çabası olarak değerlendirilmektedir. Bir Haçlı seferi çağrısı olan bu takvimde başta Roma Germen İmparatorluğu olmak üzere, İngiltere, Fransa, Macaristan, Burgonya, Kastilya, Danimarka, İsveç, Norveç, Polonya, Venedik, Napoli ve Aragon gibi Avrupa’nın etkili tüm Hıristiyan güçlerine yönelik hitaplar bulunmaktadır. Ancak çağrının merkezinde imparator, onun hâkimiyet kurduğu bölgeler ve tebaası olan Alman toplumu yer almaktadır. Doğrudan muhatap alınan halkların başında ise Almanlar bulunmaktadır. Zira takvim hem Alman coğrafyasında hem de Alman dilinde basılmıştır. Almanlar dışında Balkan ülkelerindeki Ragusalılar, Arnavutlar, Bulgarlar, Dalmaçyalılar, Kosovalılar ve Slavlar da bu birliğe davet edilerek, Osmanlı bünyesinde olan veya sınırında yaşayan bu halkların harekete geçmeleri sağlanmaya çalışılmıştır. Üzerine sınırlı sayıda çalışma bulunan “Türk Takvimi”, Türkçe literatürde sadece Türkçeye tercüme edilen bir eserde yer almış, hakkında herhangi bir çalışmaya rastlanmamıştır. Bu çalışmayla, söz konusu eserin oluşum sürecinin ortaya konması, bu eserin Avrupa’nın ilk matbu kitabı olduğu tezinin işlenmesi, eserin tahlili ve dönemi inceleyen araştırmacıların bu takvimin varlığından haberdar edilmesi amaçlanmıştır. Metinde Hıristiyan toplum tarafından kabul gören başat öğelerin özellikle seçilmiş olmasından dolayı, söz konusu hususlar da çalışmamızda dinî referans kaynakları üzerinden tek tek tespit edilerek yorumlanmıştır. : The schools of fiqh applied different methods to eliminate contradictions between narrations. In fact, this difference in methodology directly led to fiqh disagreement. Thus, a school explains within the framework of its own procedural system which of the contradictory narratives it uses as evidence, the reason for using this narrative, how they interpret other narrations about the subject or the reason for not using these reports as evidence. This article aims to chronologically examine the theory that the Ḥanafī developed (...) about antithetical narratives based on ‘Īsā ibn Abān, al-Karkhī, al-Jaṣṣāṣ, al-Dabūsī, al-Pazdawī and al-Sarakhsī. Moreover, the criticisms and contributions made by the scholars of the principles of jurisprudence are determined. Frequently repeated approach in some research that the Hanafis first used the abrogation to fulfill the contradiction between the narrations is questioned within the framework of the aforementioned scholars’ viewpoints Summary: The theory of contradictory narratives, developed as part of the narration theory, has an important position in the sense of the school’s approach to the Sunnah. This is because the system that a school of jurisprudence implements to fulfill the contradiction between narrations has an important influence in scholars’ juridical opinion. In some studies carried out today, the system developed by the Ḥanafī to eliminate the contradiction between narratives is presented in two different ways as abrogation, preference, conciliation and not to use as evidence or abrogation, conciliation and applying principles. The common point of the two hierarchies of solution is placing abrogation in first rank. In order to test the accuracy of this information in this research, we studied the system that the Ḥanafi scholars who lived in the first five centuries of the Hijra followed to eliminate the contradiction between the narrations. The development of this theory in the five centuries of the Hijra was examined on the basis of the views of ‘Īsā ibn Abān, al-Karkhī, al-Jaṣṣāṣ, al-Dabūsī and al-Sarakhsī. It is an indisputable fact that the construction and development of a theory requires a process. In this context, the present study investigated when and on which principles the theory of contradictory narratives on Ḥanafīan theory of narrative/Sunnah is started to be instituted; who and for what reasons contributed to it during this evolution process and how; and how it is instituted the way of solution hierarchy in theearly period which makes a differentiation in comments between Ḥanafīan later. This theory was enriched by principles that were developed with different perspectives during a long process and its comprehensibility was boosted using new concepts and systematic expression. Ḥanafī legal theorists benefited from the opinions of masters of the jurisprudence school to enrich this theory in terms of principles. This suggests that the theory is a scientific effort aimed at discovering how masters of the jurisprudence school are following a method in the face of contradictory narratives. As far as known, Isā ibn Abān is the first theoretician to have detailed methodological explanations related to contradictory narratives between the Hanafi scholars. This shows that the theory related to contradictory narratives was established at the beginning of the third century of the hegira. 'Isā ibn Abān divides the opposite narratives into hadiths that are compatible with consensus and hadiths that are contrary to consensus on the basis of consensus. He accepts the hadith in the first group and he evaluates the hadith in the second group as the abrogated if it is authentic. It must be stated that this solution path which Isā ibn Abān put forth is of high practical value. There is no practical value in fıqh to eliminate the contradiction between the hadith which is compatible with the consensus and the hadith contrary to this consensus by the conciliation method. Moreover, giving an active role to the consensus in the determination of the abrogating and abrogated also prevents easy access to the method of abrogation. ‘Isā ibn Abān divides hadiths that are without consensus about their provisions into two: the appearance date is known and unknown. He first applied the conciliation method to fulfill the contradictions between the narrations in both groups. If the problem is not solved by the conciliation method, Isā applies the abrogation method for narrations whose the appearance date is known. The ones that the date is not known can be acceptable in accordance with the originals, and if this is not possible, he says that both narrations cannot be used as evidence. al-Jaṣṣāṣ, who is one of the people who convey mostly al-Karkhī's views on fiqh methodology, does not convey the views of al-Karkhī on contradictory narratives in integrity that we see in the transmission of 'Isā ibn Abān’s theory and its interpretation. It is understood that al-Jaṣṣāṣ benefited from the views of al-Karkhī to improve the system of Isā ibn Abān. This suggests that al-Karkhī basically accepted the system of contradictory narratives established by Isā ibn Abān. al-Jaṣṣāṣ 's most important role in the theory of contradictory narratives is based on the principles laid down by ‘Isā ibn Abān and al-Karkhī. The person who mostly contributed to this theory after al-Karkhī is al-Dabūsī. It is understood from al-Dabūsī’s accounts that he divides the contradiction into two parts, the truth and the apparent. al-Dabūsī stipulated for evaluating a contradiction as a real contradiction. These conditions are, in essence, solutions for the elimination of the contradiction. When it comes to al-Sarakhsī, he dealt with this issue more precisely with concepts such as “evidence”, “judgement”, “state”, “date is clear in the text”, “date is not clear in the text”. In the system of al-Sarakhsī, the last option is the abrogation to eliminate the contradiction. (shrink)

In his thought, the continuity of knowledge about the truth is based on the sustainability of ijtihād, and in every period, there have been mujtahids to interpret the nass in consistent with the issues. The later scholars have developed the thoughts related to ijtihād on this platform. Wahhābī thought does not describe madhhab as a systematic integrated approach. According (...) to them, the madhhab is the ḥukm that were made within the discretion of mujtahids on the basis of nass on the issues open and free to ijtihād. With this approach, they have tried to explain what refers to the word of “Our madhhab is the one of Ahmad ibn Hanbal ”. It has been suggested that this acknowledgment does not mean taqlīd that the words of madhhab imāms are replaced with the Qur’ān and Sunna just as some other members of madhhab do so. Either Muḥammad ibn ‘Abd al-Wahhāb or his disciples have based their own opinions of such as ijtihād, madhhab, taqlīd, ittibā and ikhtilāf upon the proofs that Ḥanbalī Madhhab, Ibn Taymiyya and Ibn Qayyim used. Our aim in this study is to determine how the issues regarding such as ijtihād,taqlīd, madhhab, ikhtilāf, etc. were examined in the primary sources that formed Wahhābī thought. In the early period Wahhābī sources, it is not possible to find definitions of Islamic law in technical terms. Topics have been dealt with within the framework of the answer to a problem/fatwā or a criticism. For this reason, our method will be based on reaching a conclusion about "The Status of Ijtihād in the Early Period of Wahhābī Thought and The Meaning of Commitment to a Madhhab on Fiqh." in the light of the opinions of the first period thinkers. Summary: The connection and similarity of the Wahhābī movement, which started in the Islamic world at a time close to the time when the reform ideas appeared, have been hesitantly welcomed for a few reasons. The fact that members of the Wahhābī movement are intolerant in terms of reform in people’s beliefs, and they use the concept of takfīr, are chief among these reasons. Another reason is that Muḥammad ibn ‘Abd al-Wahhāb does not accept any religious discipline and individual as an authority. The reactions and discourses developed by Wahhābī thinkers against the established practices of faith, ijtihād, taqlīd and denominationalism has brought many objections and criticism. According to him, in a number of controversial cases where no right path has been declared in the naṣṣ, all the efforts of a believer should be focused on understanding the command of God and his messenger and act accordingly. Muḥammad ibn ‘Abd al-Wahhāb does not seek the condition of being a mujtahid to understand the Qur’ān and the sunna. He therefore opposed those who claimed that it is imperative for non-mujtahids to taqlīd a madhhab to understand the provisions of religion. According to him, everybody who has the ability to understand the Qur’ān and the sunna must make ijtihād. Blind allegiance to man-made law against the teachings of God and the Qur’ān is a type of shirk. Fuqahā’ are human and not infallible. The ‘ulamā’ that followed also developed their thoughts about ijtihād and taqlīd on this ground. The Wahhābīs say that they do not completely reject the taqlīd of the ‘ulamā’, but what they do not accept is no one, except the absolute mujtahid, can perform ijtihād. Differentiating ittibā‘, which means accepting an opinion based on evidence, from taqlīd despite the evidence, the Wahhābī ‘ulamā’ have defined the criteria of issuing or accepting a fatwā as performing ijtihād and ittibā‘ to those who have evidence of the Qur’ān and the sunna, or to the remarks of the scholars who are eligible for the Qur’ān and the sunna. According to the Wahhābīs, neither ijtihād nor taqlīd on the issues of ‘aqā’id is permissible in religion. The individual must learn what God and His messenger commands and forbids in terms of ‘aqā’id and worshipping. Ibn ‘Abd al-Wahhāb accepts that taqlīd in furū‘ al-fiqh is permissible in absolutely necessary situations such as not being able to reach sources from various views, and not having the time to evaluate these sources. According to Muḥammad ibn ‘Abd al-Wahhāb, the notion that the dispute of ‘ulamā’ is a blessing is superstitious. According to him, the alliance and agreement of ‘ulamā’ is a deed, and their unity is a blessing. Despite this, the way to be followed in a matter of dispute is not in the madhhab views but the presentation of the matter in the Qur’ān and the sunna. Defining the field of dispute, Muḥammad ibn ‘Abd al-Wahhāb said that the predecessor and the successor disagreed in the matters of furū‘ al-fiqh that were not declared in the naṣṣ; and in such affairs, the duty of the believer is to investigate what is the covenant of God and His messenger, and to show respect for the ‘ulamā’ even if it is mistaken. However, according to him, showing respect to the ‘ulamā’ is not saying ‘’they know better than us’’ despite the presence of evidence in matters of dispute. Muḥammad ibn ‘Abd al-Wahhāb and his followers emphasize in many places the movement is not a fifth and a new madhhab, they are members of the Ḥanbalī madhhab and they do not direct anyone to any organization in the form of fiqh, kalām, or ṣūfī. However, they say that madhhabs are not religion, and even if a new madhhab is aimed, this is not a problem. Although an emphasis of being part of the Ḥanbalī madhhab is made without sectarian fanaticism, it is stated that it is imperative to take the views of other madhhabs where the evidence is strong. With the emphasis of being part of the Ḥanbalī madhhab, they support their discourse of not being a new madhhab. However, the general description of the Ḥanbalī madhhab has a stricter approach regarding the way of accepting and using mental and transitional evidence than the other madhhabs. Accordingly, the Wahhābīs are described by a stricter version of the description. Muḥammad ibn ‘Abd al-Wahhāb used their methodology to arrive at judgments instead of taking the specific provisions of the madhhabs, and accepted the adoption of provisions and refused bigotry and the madhhabs are authorities almost equal to God. The Qur’ān, the sunna and ijmā‘ were accepted as the primary authorities and the four madhhabs were not denied as long as they were not contrary to majority of Muslim community. The Wahhābīs, who follow Ibn Taymiyya on the matter of practicing according to a judgment of another madhhab in the presence of evidence, believe that changing a madhhab without any reason or for worldly reasons is not permissible in religion. Although the Wahhābīs do not display a clear attitude on denying madhhabs, they have developed a supra-madhhabs approach with the thoughts of direct access to the ḥukms and accepting the ḥukm of any madhhab as long as the ḥukm is in accordance with the evidence. As a matter of fact, one of the criticisms made in this respect is that they take the views from other madhhabs that suit them, and reject the others. The Wahhābī ‘ulamā’ of the first periods shaped their opinions on issues such as ijtihād, taqlīd, madhhab, ittibā‘, and ikhtilāf, based on the evidences used by the Ḥanbalī madhhab, Ibn Qayyim and especially Ibn Taymiyya. For this reason, it is not possible to say that they have a thought system of their own. Taking this fact into consideration, it seems possible to collect the approach of the method of almost all Wahhābī thinkers in issues that are the subject of this article under three items. First, the necessity of those with strength and ability to perform ijtihād to understand religious provisions; second, solving issues of dispute based on the Qur’ān and the sunna; and third, the presence of evidence overruling any kind of madhhab view. Bu hususta, ilk defnedilen sahâbînin Ensar’dan Es’ad b. Zürâre veya Muhacirlerden Osman b. Maz’ûn olduğu şeklindeki rivayetler ön plâna çıkmaktadır. Bu makalede, Osman b. Maz’ûn’un vefat tarihi ile ilgili rivayetler bağlamında onun Bakī’ Mezarlığı’na ilk defnedilen kişi olup olmadığı konusu ele alınmaktadır. (...) Felsefe tarihinin ilk döneminde Grek filozoflar yeni başlangıçlar yapmışlar ve böylelikle felsefenin (...) yeni yönlerinin açığa çıkmasına hizmet etmişlerdir.
