How can dispute records shed light on the study of dispute settlement processes and their social and political underpinnings? This volume addresses this question by investigating the interplay between record-making, disputing process, and the social and political contexts of conflicts. The mediation of the performative body raises the question of the re-evaluation of the lived body in relation to phenomena of re-creation or re-composition involving the sensible and somatic body when it is affected by technology and incorporates its effects. To understand this phenomenon, this essay examines the interrelation of the notions of corporality, corporeality, and embodiment through a transdisciplinary approach and as an anchoring to a dynamic of self-eco-organization. Merleau-Ponty’s philosophy underpins the very foundations of this research and will (...) allow us to reflect on the new status of the contemporary body in technological contexts. Two main notions will be used. “Corporeality”, as a form of the lived body and a transdisciplinary concept and embodiment as an act of integration by the body – here in a technological environment. In the evolution of the interrelation between the body and the changing environment, the two are in trans-relation, a trans-formation occurs. To conclude, we propose to analyze these new “realities” in a Merleau-Pontian and Nietzschean interconnected approach, that is, through a philosophy of becoming, a philosophy that flows through the body: being a body, doing, risking and creating – a philosophy that resonates with this trans-formation. BackgroundThe landscape of clinical research has evolved over the past decade. With technological advances, the practice of using electronic informed consent (eIC) has emerged. However, a number of challenges hinder the successful and widespread deployment of eIC in clinical research. Therefore, we aimed to investigate the views of various stakeholders on the potential advantages and challenges of eIC.MethodsSemi-structured interviews were conducted with 39 participants from 5 stakeholder groups from across 11 European countries. The stakeholder groups included physicians, patient organization representatives, (...) regulator representatives, ethics committee members, and pharmaceutical industry representatives, and all were involved in clinical research. Interviews were analyzed using the framework method.ResultsInterviewees identified that a powerful feature of eIC is its personalized approach as it may increase participant empowerment. However, they identified several ethical and practical challenges, such as ensuring research participants are not overloaded with information and offering the same options to research participants who would prefer a paper-based informed consent rather than eIC. According to the interviewees, eIC has the potential to establish efficient long-term interactions between the research participants and the research team in order to keep the participants informed during and after the study. Interviewees emphasized that a personal interaction with the research team is of utmost importance and this cannot be replaced by an electronic platform. In addition, interviewees across the stakeholder groups supported the idea of having a harmonized eIC approach across the European Member States.ConclusionsInterviewees reported a range of design and implementation challenges which needs to be overcome to foster innovation in informing research participants and obtaining their consent electronically. It was considered important that the implementation of eIC runs alongside the face-to-face contact between research participants and the research team. Moreover, interviewees expect that eIC could offer the opportunity to enable a personalized approach and to strengthen continuous communication over time. If successfully implemented, eIC may facilitate the engagement of research participants in clinical research. (shrink)

The paper provides a new critical perspective on the propensity interpretation of fitness, by investigating its relationship to the propensity interpretation of probability. Two main conclusions are drawn. First, the claim that fitness is a propensity cannot be understood properly: fitness is not a propensity in the sense prescribed by the propensity interpretation of probability. Second, this interpretation of probability is inessential for explanations proposed by the PIF in evolutionary biology. Consequently, interpreting the probabilistic dimension of fitness in terms of (...) propensities is neither a strong motivation in favor of this interpretation, nor a possible target for substantial criticism. This article examines how the Kashmiri non-dualistic Śaiva philosophers Utpaladeva (tenth century) and Abhinavagupta (10th–11th centuries) present and criticize a theory expounded by certain Buddhist philosophers, identified by the two Śaiva authors as Sautrāntikas. According to this theory, no entity external to consciousness can ever be perceived since perceived objects are nothing but internal aspects (ākāra) of consciousness. Nonetheless we must infer the existence of external entities so as to account for the fact that consciousness is aware of a variety (...) of objects: just as a mirror takes on a variegated appearance only by reflecting a multiplicity of objects that remain external to it, in the same way, phenomenal variety can be explained only by assuming the existence of various objects external to consciousness. In Īśvarapratyabhijñākārikās I, 5, 8–9 and their commentaries, Utpaladeva and Abhinavagupta endeavour to criticize this theory, which challenges their own idealistic principles: according to them, the Sautrāntikas’ inference is neither legitimate nor even possible. The passage is particularly telling as regards the strategy developed by Pratyabhijñā philosophers with respect to their Buddhist opponents: they make use of certain arguments propounded by Dharmakīrti in defense of Vijñānavāda in order to criticize the Sautrāntikas’ inference, but they also exploit this discussion to underline the superiority of their idealism over that of the Vijñānavādins. New paradigms in the psychology of reasoning have included a consideration for general contextual factors that may impact on the reasoning process, including individuals’ goals and motivations. We suggest that emotions are one such important contextual factor that influences reasoning. The classic literature on thinking and reasoning has typically ignored the possible influence of emotion, except to consider it a source of disruption. We review findings from studies where participants were asked to reason about personally relevant emotional experiences such as (...) sexual abuse, war, and terrorist attacks. While some findings are consistent with the view that incidental emotions have a deleterious effect on reasoning, a number of findings also suggest a beneficial impact of emotion. For instance, veterans reasoned more logically about combat-related syllogisms than structurally identical syllogisms with neutral contents; victims of sexual abuse reporting more negative emotions following the events also reasoned more logically on abuse-related contents, relative to neutral contents. This may be associated with integral emotions, when the affective reaction is relevant to the semantic contents reasoned about. We propose that the positive impact of integral emotions on reasoning can be explained by increased utility of problem content and increased utility of reasoning. (shrink)

The Covid-19 crisis has clarified the demand for an ultra-brief single-session, online, theory-led, empirically supported, psychological intervention for managing stress and improving well-being, especially for people within organizational settings. We designed and delivered “4Ds for Dealing with Distress” during the crisis to address this need. 4Ds unifies a spectrum of familiar emotion regulation strategies, resilience exercises, and problem-solving approaches using perceptual control theory and distils them into a simple four-component rubric. In essence, the aim is to reduce distress and restore (...) wellbeing, both in the present moment through current actions, and through expressing longer-term goal conflicts to discover new perspectives that arise spontaneously after sufficient time and consideration. The intervention is user-led in that it draws on users’ own idiosyncratic and pre-existing experiences, knowledge, skills and resources to help them apply an approach, or combination of approaches, that are proportionate and timed to the nature and context of the stress they are experiencing. In this article we review the empirical basis of the approach within experimental, social, biological and clinical psychology, illustrate the novel and time-efficient delivery format, describe its relevance to sports and exercise, summarise feedback from the recipients of the intervention to date, and describe the directions for future evaluation. An innovative, multifaceted approach to scientific experiments as designed by and shaped through interaction with the modeling process The role of scientific modeling in mediation between theories and phenomena is a critical topic within the philosophy of science, touching on issues from climate modeling to synthetic models in biology, high energy particle physics, and cognitive sciences. Offering a radically new conception of the role of data in the scientific modeling process as well as a new awareness of the problematic aspects (...) of data, this cutting-edge volume offers a multifaceted view on experiments as designed and shaped in interaction with the modeling process. The question of universalism and relativism is often taken to be a matter of critical reflexivity. This article attempts to present the question instead as a matter of practical, political, and always-situated concern. The attempt starts from the consideration of modern experimental sciences. These sciences usually serve as the stronghold for universalist claims and as such are a target of relativism. It is argued that the specificity of these sciences is not a method but a concern. To be able to (...) claim that they have not unilaterally imposed their definitions on the phenomena they study is the leading concern of experimenters and should be understood in terms of the following achievement: the creation of a very particular “rapport” that authorizes claiming that what is operationally defined “lends itself” to this correlation. Linking knowledge production with a creation of rapports entails a pluralization of sciences along with the pluralization of modes of concern associated with the rapport. However, resisting unilaterally imposed definitions is not enough, since with the coming “knowledge economy” the questions that this article raises will soon be part of a romantic past. Thus it concludes with a speculative touch, which may be a requiem, relating the creation of rapports with an ecology of practices akin to William James's always-under-construction pluriverse. As part of his case for emergent dualism, William Hasker proffers a _unity-of-_ _consciousness_ (UOC) argument against materialism. I formalize the argument and show how the warrant for two of its premises accrues from the warrant one assigns to two distinct theses about unified conscious experience. I then argue that though both unity theses are plausible, the materialist has little to fear from Hasker.

The main problems faced by a conception of perception as passive will be introduced through a critical examination of John McDowell's account of 'empirical thinking'. Overcoming these difficulties will lead to a conception of perception as involving an active cognitive participation of the perceiver, and an account of how observational judgment is warranted that is focused on the conditions of experience. In both cases, analogies to inquiry in scientific experimental practice will be explored.

La vie a-t-elle émergé de la matière? Et dans ce cas, comprendre le vivant signifie-t-il le réduire à un ensemble particulier d'interactions physico-chimiques? Et comprendre l'expérience psychique, est-ce la réduire à l'activité de populations neuronales enchevêtrées? Le premier visage proposé par la question de l'émergence de la vie est celui de l'affrontement entre les conquérants de la réduction et les défenseurs de la différence qualitative entre le tout et ses parties. Visage polémique, affichant l'arrogance et les prétentions qui dominent l'écologie (...) des pratiques scientifiques. Avec le thème de l'auto-organisation, l'émergence propose aujourd'hui d'autres visages, plus avenants, car ils annoncent un intérêt nouveau, orienté vers l'exploitation des propriétés en vérité très singulières que l'apparition et l'évolution des vivants pourraient avoir requis de la matière. Une approche pacifique de la question de l'émergence est-elle désormais possible? Ou s'agit-il là d'une opération de pacification, menée à l'encontre de belligérants naïfs par des tiers qui en savent plus? Les différents visages de l'émergence expriment les différents types de liens qui existent ou pourraient s'inventer entre pratiques scientifiques, entre constructeurs de modèles et praticiens de terrain. Mais les protagonistes de la question de l'émergence, qu'ils entendent la réduire, à la manière des sociobiologistes, ou en célébrer la complexité innovante, ne peuvent s'empêcher de rêver, de spéculer sur la possibilité d'une approche enfin scientifique qui permettrait de nous comprendre nous-mêmes et de comprendre les enjeux de nos histoires. Isabelle Stengers prend ici le risque d'accepter que cette composante spéculative est irrépressible. Mais l'enjeu est alors de reconnaître les situations où la spéculation change de nature, parce que les pratiques scientifiques s'y adressent à ces questions posées par d'autres, et qu'elles obligent à une rencontre avec d'autres pratiques humaines, modernes et non-modernes. Experimental modeling is the construction of theoretical models hand in hand with experimental activity. As explained in Section 1, experimental modeling starts with claims about phenomena that use abstract concepts, concepts whose conditions of realization are not yet specified; and it ends with a concrete model of the phenomenon, a model that can be tested against data. This paper argues that this process from abstract concepts to concrete models involves judgments of relevance, which are irreducibly normative. In Section 2, we (...) show, on the basis of several case studies, how these judgments contribute to the determination of the conditions of realization of the abstract concepts and, at the same time, of the quantities that characterize the phenomenon under study. Then, in Section 3, we compare this view on modeling with other approaches that also have acknowledged the role of relevance judgments in science. To conclude, in Section 4, we discuss the possibility of a plurality of relevance judgments and introduce a distinction between locally and generally relevant factors. (shrink)

Participation of the Public in Science: Towards a New Kind of Scientific Practice Participation of the public in science has been the object of an increasing number of social and political philosophical studies, but there is still hardly any epistemological study of the topic. While it has been objected that involvement of the public is a threat to the integrity of science, the apparent indifference of philosophers of science seems to testify to its lack of relevance to conceptions of scientific (...) activity. I argue both that it is not a threat to science and that it is relevant to philosophy of science by showing that it constitutes a new kind of epistemic practice. Two main objections to the idea that the involvement of non-scientists, with their situated perspective and contextual values, can form an epistemic practice will be addressed: the first bears on the epistemic potentialities of the cooperation between scientist and non-scientists; the second on the possibility that this cooperation takes the form of a practice. It is sometimes said that simulation can serve as epistemic substitute for experimentation. Such a claim might be suggested by the fast-spreading use of computer simulation to investigate phenomena not accessible to experimentation. But what does that mean? The paper starts with a clarification of the terms of the issue and then focuses on two powerful arguments for the view that simulation and experimentation are ‘epistemically on a par’. One is based on the claim that, in experimentation, no less than (...) in simulation, it is not the system under study that is manipulated but a system that ‘stands-in’ for it. The other one highlights the pervasive use of models in experimentation. It will be argued that these arguments, as compelling as they might seem, are each based on a mistaken interpretation of experimentation and that, far from simulation and experimentation being epistemically on a par, they do not have the same epistemic function, do not produce the same kind of epistemic results. The Īśvarapratyabhijñā treatise—an important philosophical text composed in Kashmir in the 10th century CE by the Śaiva nondualist Utpaladeva—remains partly unavailable to date: a crucial component of this work, namely the detailed commentary (Vivṛti or Ṭīkā) in which Utpaladeva explained his own verses, is considered as almost entirely lost, since only a small part of it has been preserved in a single, very incomplete manuscript remarkably edited and translated by Raffaele Torella. However, our knowledge of the Vivṛti is quickly expanding: (...) many additional fragments have recently come to light. The article gives an overview of these new findings while highlighting the most interesting of them, i.e. the discovery of the lengthiest Vivṛti fragment known to date in the margins of a manuscript containing Abhinavagupta’s Vivṛtivimarśinī. Background Minimal research has been done to determine how well European nursing students understand the core principles of academic integrity and how often they deviate from good academic practice. Aim The aim of this study was to find out what educational needs nursing students have in terms of academic integrity. Research design A quantitative cross-sectional study in the form of a survey of nursing students was conducted via questionnaire in the fall of 2020. Participants The sample was composed of 79 (...) students in the BScN and MScN programs at Zürich University of Applied Sciences. Ethical considerations An application for a non-competence clearance was approved by the Ethics Committee in Zurich (BASEC No. Req-2020-00868). The survey was anonymous, and informed consent was obtained prior to participation. Results The participants had a high level of confidence in their own knowledge but were in many cases unable to correctly identify clear-cut examples of misconduct and to differentiate them from questionable practices. About 13% of the participants admitted that during their university education they had copied shorter passages from other sources into their own text without marking them as quotes. Conclusions The study documents extensive knowledge gaps among nursing students regarding both academic misconduct and questionable practices and indicates a need for improved academic integrity training. These structures have frequently been taken as contributing factors to Marx’s alleged millenarianism, doctrinaire rigidity, and intolerance. The mature Marx does draw on Romantic ideas at crucial moments; but rather than reinforcing an image of Marx as an intolerant ideologue, the Romantic element in his thought, properly construed, suggests theoretical (...) openness and humility before an unmasterable reality. Should this be thought of, as for Marcion, as a trancendence one cannot know and that excludes in principle all real contact with the world, a fortiori with the flesh? Or, on the contrary, must one say, with Tertullian, that it is “when God is quite small in the eyes of man that He is, in the highest degree, great”? In his polemic against Marcion, Tertullian appeals to reason: he denounces the irrationality of the God of Marcion. However, in order to justify the incarnation, Tertullian does not hesitate to use paradox several times. Comment nos paroles et nos gestes humains pourraient-ils témoigner de façon juste du Dieu parfait? Cet écart est le lieu même de la théologie pratique, sa tâche étant bien sûr d’aider à le réduire. Mais cet écart n’est pas seulement la réalité de la vie ecclésiale, il en est aussi la chance ; car il fait entendre, au sein des institutions ecclésiales, (...) l’appel à vivre dans la confiance en Dieu plutôt que par leurs propres forces. The ancient sources frequently mention heated debates during meetings of the Roman senate under the early empire. Such debates could become so intense they might even threaten to impede the Senate’s decision-making abilities. Nevertheless, senatorial debate in the curia was not necessarily dysfunctional: in fact, it had a crucial instrumental function. Potential dissent among members of the senate could be discussed and settled before voting began, taking it out of the decision-making process proper. The symbolic dimensions of senatorial altercationes were (...) if possible even more important, because the existence of communicative dissent showed that discussions still happened in the curia: proof that the Senate was still a functioning political entity. A combined agent-centred and institutional-historical methodological approach allows us to track not only individual practices of dispute, competition, and raising one’s profile, but to perceive more clearly the impact and the function disputes had for the Senate’s debating culture as a whole. La volonté s’exerce, selon Augustin, soit comme usage soit comme jouissance de ce qu’elle vise. Ces deux modalités sont constitutives de la moralité d’une vie : la vertu chrétienne repose sur un usus mundi qui réfère le créé à Dieu, tandis que le péché consiste à jouir du créé. Que signifie cet « usage du monde »? Faut-il le prendre dans une acception instrumentale? Ce n’est manifestement pas ce que choisit Augustin à propos du rapport droit avec soi-même ou autrui. (...) Cette réserve est souvent analysée comme un effet de la seule prise en considération du statut particulier des êtres rationnels. Ici, on cherchera plutôt à y lire la complexité d’une relation qui, jusque dans le rapport aux corps, ne se borne pas à instrumentaliser le monde en vue de Dieu. (shrink)
