Este artículo plantea la necesidad de establecer marcos de integridad ética en el ámbito de las administraciones públicas. Se constata que no resulta suficiente el mero recurso a su divulgación y aprendizaje, sino que se necesita su puesta en marcha práctica. Se analiza la implementación de un Marco de Integridad Ética en la Comunidad Autónoma de La Rioja durante el intervalo de la legislatura autonómica de 2019 a 2023.

Resumen Este trabajo determina algunas percepciones y usos de las redes sociales por parte del clero de la Iglesia católica española en su tarea ministerial. Partiendo de una muestra representativa se plantea un estudio cuantitativo en el que queda en evidencia que los clérigos están presentes mayoritariamente en redes cada vez menos frecuentadas por los jóvenes adolescentes, pero el uso que se hace de las mismas para acciones pastorales es limitado, cuando no insuficiente.This work determines some perceptions and uses that (...) the clergy of the Spanish Catholic Church make of social networks in their ministerial work. Based on a representative sample, a quantitative study is proposed in which it is evident that the clergy are present mainly in networks less and less frequented by young adolescents, but the use made of them for pastoral actions is limited, when not insufficient. La flexibilidad y la mercantilización de lo espiritual ¿son aspectos característicos de la cultura contemporánea? Centrado en los casos de Alemania, Inglaterra y Francia, el artículo detalla cómo el romanticismo literario se articula como un movimiento pionero de la espiritualidad flexible, proceso que se entrelaza con su rol seminal en la formación del campo literario moderno. El crecimiento económico y demográfico sostenidos en Europa desde el s. XV, así como la alfabetización impulsada por el protestantismo, construyen un moderno público lector (...) que da pie —durante el s. XVIII— a la revolución y diversificación de la lectura, lo que promueve la difusión de incipientes tendencias modernas (ciencia, Ilustración, prensa). Oponiéndose parcialmente a estas tendencias y extendiendo la diversificación de lo impreso, surge la tendencia romántica. Sus autores flexibilizan la espiritualidad más allá de las convenciones religiosas de la época —y aportan a la formación del campo literario— (1) caracterizando el desencanto y otras formas de malestar moderno; (2) multiplicando el lenguaje imaginario-trascendente; (3) brindando connotaciones metafísicas al genio artístico; (4) promoviendo la autonomía y libertad expresiva del arte. La evidencia indica que el mercado fue una condición histórica básica para la EF. Se sugiere que esta flexibilidad se muestra como una adaptación de la espiritualidad a las circunstancias empíricas de la modernidad, la cual conlleva nuevas necesidades de sentido y una mayor capacidad para divergir de los relatos religiosos tradicionales. En el artículo se pretende abordar la discusión relativa a la dignidad y a la eugenesia genética, reflexionando si la utilización de métodos como el CRISPR-Cas en la edición genética de embriones humanos para su fecundación constituye una transgresión o una afirmación de la dignidad. Para tal propósito, se esboza un concepto de dignidad y se describe el proyecto del transhumanismo biológico, así como la edición genética en el proyecto de la eugenesia. Tras una revisión teórica y filosófica, se cuestiona (...) la existencia de un deber de mejorar, y se argumenta la necesidad de una deliberación previa a reconocer o no un derecho a mejorar, al tratarse de una cuestión pública y no meramente privada. The Iowa Gambling Task (IGT) is a popular method for examining real-life decision-making. Research has shown gender related differences in performance, in that men consistently outperform women. It has been suggested that these performance differences are related to decreased emotional control in women compared to men. Given the likely role of emotion in these gender differences, in the present study we examine the effect of a humor induction on IGT performance and whether the effect of humor is moderated by gender. IGT performance and parameters from the Expectancy Valence Model were measured in 68 university students (34 men; mean age 22.02, SD = 4.3 and 34 women; mean age 22.3, SD = 4.1) during a 100 trial-IGT task. Participants were exposed to a brief video before each of the IGT decisions available; one half of the sample (17 men and 17 women) was exposed to 100 humor videos, while the other half was exposed to 100 non-humor videos during the task. We observed a significant interaction between gender and humor, such that under humor, women’s performance during the last block (trials 80-100) improved (compared to women under non-humor), whereas men’s performance during the last block was worse (compared to men under non-humor). Consistent with previous work, under non-humor, men outperformed women in the last block. Lastly, our EVM results show that humor impacts the learning mechanisms of decision-making differently in men and women. Humor impaired men’s ability to acquire knowledge about the payoff structure of the decks, and as a consequence they were stuck in suboptimal performance. On the other hand, humor facilitated women’s ability to explore and to learn from experience, improving performance. These findings deepen our understanding of the mechanisms underlying IGT decision-making and differential effects of humor in men and women. (shrink)

This text analyzes the economic and political relations that existed between Latin America and Spain during the period 1990-2020. It is highlighted that, since the 1990s, once Spain joined the European Economic Community in 1986, economic and political relations between Spain and Latin America intensified and deepened, at the same time as the lines of the actions were changing depending on the imprints of the different Spanish governments and the changes in Latin America and on the international scene. In the (...) work, a synthesis balance is made of the strengths and weaknesses generated in these relationships in the investigated period. The main interpretive hypothesis of the work is that, as this balance suggests, some elements of relationships can be transformed, deepened, reoriented or simply modified, without neglecting, of course, the basis of everything built and achieved throughout all these years of relationships. Therefore, the conclusions provide some relevant reflections to take into account for the design of relations between Spain and Latin America in the coming decades. (shrink)

The use of wireless sensor networks and the Internet of things to detect forest fire outbreaks may help to reduce the response time and avoid natural disasters. This work proposes the deployment of WSN to enhance the real-time monitoring of dynamic variables such as polluting gases, temperature or the presence of fire flames by infrared. In addition, the activation of forest fire alerts if environmental status may involve evidence of a recent fire outbreak. A fuzzy-based controller is implemented to manage (...) the uncertainty related to estimating forest fire occurrence and dynamic update of fuzzy sets is developed to distinguish usual and unusual environmental conditions of every monitored forest area. Merkle trees, AES and hash functions are considered to protect the integrity of environmental data. (shrink)

Organ shortage constitutes an unsolved problem for every country that offers transplantation as a therapeutic option. Besides the largely implemented donation model and the eventually implemented market model, a theorized automatic organ procurement model has raised a rich debate in the legal, medical and bioethical community, since it could show a higher potential to solve organ shortage. In this paper, we study the main arguments for and against this model. We show how, in the light of empirical data extracted from (...) countries with a universal health care system, its implementation could lead to a positive impact on organ procurement rates. Three factors are envisioned as fundamental in the comprehension and a possible regulation of the automatic organ procurement model: the lack of recognition of the conscientious objection, the preservation of the right to choose end of life conditions, and the need to avoid incentives for families or healthcare professionals. Huge losses and serious threats to ecosystems are common consequences of forest fires. This work describes a forest fire controller based on fuzzy logic and decision-making methods aiming at enhancing forest fire prevention, detection, and fighting systems. In the proposal, the environmental monitoring of several dynamic risk factors is performed with wireless sensor networks and analysed with the proposed fuzzy-based controller. With respect to this, meteorological variables, polluting gases and the oxygen level are measured in real time to estimate the (...) existence of forest fire risks in the short-term and to detect the recent occurrence of fire outbreaks over different forest areas. Besides, the Analytic Hierarchy Process method is used to determine the level of fire spread, and, when necessary, environmental alerts are sent by a Web service and received by a mobile application. For this purpose, integrity, confidentiality, and authenticity of environmental information and alerts are protected with implementations of Lamport’s authentication scheme, Diffie-Lamport signature, and AES-CBC block cipher. This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. Let's try to recognize the regularity according to the historical fact, give in a certain logical sequence its own vision of those events of the history of Ukrainian nation, which led to the rise of the Union of the Ukrainian Orthodox Church with the Roman Apostolic See in 1596. The reasons for this are seven.

Wil Waluchow’s notion of Community’s Constitutional Morality (CCM) was developed as a tool for the identification of moral norms and considered judgments that are in some way tied to a community’s constitutional law and practices. In this paper I first argue that even though the tool was conceived under a state-based paradigm, it also works on a global scale. Then, I show how by relying on this tool we can achieve two important and clearly differentiable goals. The first goal relates (...) to efforts regarding the construction of global theories of justice. By using Waluchow’s CCM we can overcome what I call the problem of adjudication among differentexisting moral intuitions. That is, the need to choose between different and competing fundamental moral commitments that ought to guide our moral deliberations. Instead, by using CCM, we can identify Embodied Moral Intuitions that hold an epistemic advantage over Personal Moral Intuitions, which are commonly used to ground normative projects. The second goal relates to contemporary efforts to decolonize our perspectives about justice, domestic and global. By relying on Waluchow’s notion of CCM, the reality that Indigenous knowledge, despite it not having been properly acknowledged in most philosophical academic debates, is already a part of our debates about global justice becomes undeniable and a call for action to further expand our understanding of global political morality. In our daily lives, we need to predict and understand others’ behavior in order to navigate through our social environment. Predictions concerning other humans’ behavior usually refer to their mental states, such as beliefs or intentions. Such a predictive strategy is called ‘adoption of the intentional stance.’ In this paper, we review literature related to the concept of intentional stance from the perspectives of philosophy, psychology, human development, culture, and human-robot interaction. We propose that adopting the intentional stance might be (...) a pivotal factor in facilitating social attunement with artificial agents. The paper first reviews the theoretical considerations regarding the intentional stance and examines literature related to the development of the intentional stance across life span. Subsequently, we discuss cultural norms as grounded in the intentional stance, and finally, we focus on the issue of adopting the intentional stance toward artificial agents, such as humanoid robots. At the dawn of the artificial intelligence era, the question of how – and also when – we predict and explain robots’ behavior by referring to mental states is of high interest. The paper concludes with a discussion on ethical consequences of adopting the intentional stance toward robots, and sketches future directions in research on this topic. (shrink)

Resumen: En este artículo sostengo que los planteamientos de Jakob von Uexküll constituyen un apoyo científico decisivo para las reflexiones metafísicas de Martin Heidegger sobre el mundo, más allá de lo que el mismo Heidegger reconoce explícitamente. En particular, los estudios de Jakob von Uexküll enfatizan, de mejor manera que el mecanicismo y el vitalismo, la relación que existe entre el medio ambiente y el mundo interior del animal, lo que es fundamental para que Heidegger sostenga en su lección de (...) invierno de 1929 y 1930 que la esencia del animal es el "perturbamiento".: In this paper I argue that the scientific approaches of Jakob von Uexküll crucially support Martin Heidegger's metaphysical reflections about the world, beyond what Heidegger himself explicitly recognized. In particular, Jakob von Uexküll's studies emphasized, better than mechanicism and vitalism, the relationship between the environment and the inner world of the animal, which is crucial for Heidegger to claim in his winter 1929-1930 lessons that the essence of the animal is "disturbance". Siguiendo las coordenadas conceptuales propuestas por Michel Foucault en su abordaje del tratamiento gubernamental de las pandemias, en este artículo se desarrolla un recorrido genealógico por específicas prácticas de gobierno que se han venido desarrollando en Chile en distintos momentos de su historia; se visibilizan de este modo diversos actores de gobierno que buscarán conducir conductas y subjetividades en contextos de pandemia. Entendida como una propuesta metodológica, establecida en base a la identificación de actores, racionalidades y acciones de gobierno, inscrita (...) en el marco conceptual desarrollado por Foucault en su abordaje del tratamiento gubernamental de las pandemias, buscamos problematizar las fórmulas gubernativas que se han dispensado en el pasado para comprender las estrategias de gobierno de la pandemia del presente. The second law results in the growth of the entropy – in superficial interpretation this principle presumes that the sufficient energy inevitably turns into the substandard energy. Order turns into chaos over time; however, chaos also turns into order under certain circumstances. The first research objective is to establish the possible prescientific ideas about the phenomenon – some philosophical intuitions that have preceded the scientific discovery of the second law and have conformed to it in a certain sense. It is (...) essential because there are always certain bonds and continuity in the history of philosophy and science – the correct interpretation of the phenomenon becomes difficult, if not impossible, without the establishment of such bonds.Moreover, the main task is to understand what the second law is and which significance its principal corollaries have. We need to give the second law a correct interpretation that will allow making assumptions about its connection with time in the context of the initial state problem and about the possible new ways of modern physics development – in particular, the creation of the quantum theory of gravity. Two solutions to the entropy and initial state connection problem are proposed in the context of the time arrow discussion (G. Calender’s approach to solving the problem is disputed). (shrink)

This essay surveys the present position of postmodernism with respect to the effect of its ideas upon historiography. For this purpose it looks at a number of writings by historians that have been a response to postmodernism including the recently published collection of articles, The Postmodern History Reader. The essay argues that, in contrast to scholars in the field of literary studies, the American historical profession has been much more resistant to postmodernist doctrines and that the latters' influence upon the (...) thinking and practice of historians is not only fading but increasingly destined to fade. The essay also presents a critical discussion of the current philosophy of postmodernism in its bearing upon historiography, directed chiefly against its claim that the world has undergone an epochal transition from the modern to a postmodern age; its theory of language and linguistic idealism; its opposition to historical realism and denial of the actuality of the past as a possible object of reference; and its theory of historical narrative as unconstrained fictional construction. This discussion includes a consideration of the work of postmodernist thinkers such as J.-F. Lyotard, of the recent books by David Roberts and Robert F. Berkhofer, Jr. which espouse a postmodernist theory of history, and of the narrativist theory of Hayden White. The essay also notes some of the reasons for postmodernism's appeal; and while it does not deny that postmodernist philosophy may have served a useful purpose in provoking historians to be more self-critical and aware of their presuppositions and procedures, it maintains that its skeptical and politicized view of historical inquiry is deeply mistaken, out of accord with the way historians themselves think about their work, and incapable of providing an understanding of historiography as a form of thought engaged in the attainment of knowledge and understanding of the human past. The paper offers a semantic and pragmatic analysis of statements of the form ‘x is beautiful’ as involving a double speech act: first, a report that x is beautiful relative to the speaker’s aesthetic standard, along the lines of naive contextualism; second, the speaker’s recommendation that her audience comes to share her appraisal of x as beautiful. We suggest that attributions of beauty tend to convey such a recommendation due to the role that aesthetic practices play in fostering and enhancing (...) interpersonal coordination. Aesthetic practices are driven by a disposition towards the attunement of attitudes and aesthetic recommendations contribute to forwarding such attunement. Our view is motivated by an attempt to satisfy the following set of desiderata: to account for the experiential nature of aesthetic judgments, disagreements in aesthetic debates, and the normative aspirations of aesthetic discourse, as well as to avoid appealing to error theory and realist ontological commitments. Recent theological anthropology emphasizes a dynamic and integral understanding of the human being, which is also related to Karl Rahner's idea of active self-transcendence and to the imago Dei doctrine. The recent neuroscientific discovery of the “visual word form area” for reading, regarded in light of the concept of cultural neural reuse, will produce fresh implications for the interrelation of brain biology and human culture. The theological and neuroscientific parts are shown in their mutual connections thus articulating the notion that (...) human beings shape and transcend themselves both at the biological and at the cultural level. This will have relevant implications for the timely topic of human uniqueness in science and theology, and in proposing a new research perspective in which theology may consider culture along with its biological import, but not necessarily in strictly evolutionary terms alone. Ankersmit's postmodernist philosophy of history as fallacious and opposed to some of the fundamental convictions and intuitions historians feel about their discipline. It questions Ankersmit's conclusion that the overproduction of historical writings and continuing generation of new interpretations has obliterated the past as an object of knowledge. It argues that Ankersmit's attempt, in accord with Hayden White, to aestheticize historiography and regard it as a linguistic construction indistinguishable from literature, must sever it from (...) its necessary grounding in reality and truth. It also rejects as groundless Ankersmit's claim to have deconstructed causality, and concludes that the postmodernist conception trivializes historiography and deprives it of its essential function in education and culture.
