While defining martial arts is not prerequisite to philosophizing about them, such a definition is desirable, helping us resolve disputes about the status of hard cases. At one extreme, Martínková and Parry argue that martial arts are distinguished from both close combat (as unsystematic) and combat sports (as competitive), and from warrior arts (as lethal) and martial paths (as spiritual). At the other extreme, mixed martial arts pundits and Bruce Lee speak of combat sports generally as martial arts. I argue (...) that the fine-grained taxonomy proposed by Martínková and Parry can be usefully supplemented by a broader definition, specifically the following: martial arts are systematic fighting styles and practices as ways of embodying wisdom. A possible difficulty here is that such views face the charge of overemphasizing the “philosophical” aspect of martial arts. My definition can, however, avoid this apparent problem. If martial arts essentially aim to embody wisdom, this applies no less to the (strategic) practical wisdom of The Art of War than to the (ethical) practical wisdom of the Tao Te Ching. In an extended sense, then, any systematic fighting style, including combat sports, may count as a martial art insofar as it embodies wisdom by improving practical fighting skills. (shrink)

Recent scholarship has considered the requirements of justice and economic regimes in the work of John Rawls. This work has not delved into the requirements of justice and liberal socialism as deeply as the work that has been done on property-owning democracy. A thorough treatment of liberal socialism and the requirements of justice is needed. This paper seeks to begin to fill this gap. In particular, it needs to be shown if liberal socialism fully answers the requirements of justice better (...) than property-owning democracy. It will be argued that liberal socialism does significantly better in realizing the two principles. This paper has the following structure, first, an overview of Rawls' position on economic regimes, capitalism, and the requirements of justice will be presented. In particular, how the two principles work in tandem to meet the demands of distributive justice will be considered. Second, a review of property-owning democracy will be conducted. Finally, liberal socialism will be examined and discussed as an economic regime that answers the requirements of justice more fully. (shrink)

Videogames present deep challenges for traditional concepts of sport and games. Cybersport in particular suggests that sport might be transposed into digital arenas, and videogames in general provide apparently striking counterexamples to the orthodox Suitsian theory of games, seeming to lack strictly prelusory goals and perhaps even also constitutive rules. I argue as follows: if any cybersports count as genuine sports, it will be those most closely resembling uncontroversial core instances of sport, those that essentially involve gross motor skill. Even (...) so, we might reject cybersports as sport by distinguishing physical skills’ domain of execution from their domain of application, sport implying the non-virtual status of both. Although, like chess, videogames appear to lack prelusory goals, chess conventions and nominal descriptions of the object of any videogame suggest the possibility of Suitsian compliance, as does the inclusion of ‘cheat codes’ in videogame programming. Ever since its discovery nearly thirty years ago, the phenomenon of blindsight — vision without visual consciousness — has been the source of great controversy in the philosophy of mind, psychology, and the neurosciences. Despite the fact that blindsight is widely acknowledged to be a critical test-case for theories of mind, Blindsight and the Nature of Consciousness is the first extended treatment of the phenomenon from a philosophical perspective. Though animal ethics in sport obviously applies most urgently to cases of animals at mortal risk (e.g., hunting and bullfighting) or vulnerable to various types of abuse (e.g., doping and harmful training practices), less obvious domains bear scrutiny as well. Here I examine whether we can strictly take not just riders but horses to be players in equine sports. There is an apparent tension in the concept of equestrian prowess, a peculiar blend of skills and attitudes, between regarding horses as (...) subjects of persuasion or collaboration and treating them as objects of control. As our understanding of animal cognition and behaviour continues to improve, it becomes increasingly clear that animal intelligence and agential capacities are far greater than we formerly presumed. In this light, using Suits’s theory of games, I argue that horses are game players that sometimes consent (or assent) and sometimes refuse to play equine sports. Drawing on recent accounts of horse-rider partnership and on my own equestrian background, I conclude by sketching a utopian vision of what equine sports could be. (shrink)

A version of this paper was given as the Inaugural Steven Edwards Memorial Lecture at the 25th conference of the International Philosophy of Nursing Society 16th August 2022. Using the literary meaning of ‘whither’, that is ‘to what place’, this paper will explore the role of philosophy in nursing, past, present, and future. The paper will begin with some thoughts on the history of nursing philosophy, its development as a subject and the scholarly activities that have led to where it (...) sits today. The establishment of the journal Nursing Philosophy, the Annual Nursing Philosophy Conference, the International Philosophy of Nursing Society (IPONS) and their influence on nursing both in the academy and in practice will be discussed. The concept of nursing philosophy as a discipline will be considered, and how this fits with nursing theory, and nursing knowledge. Philosophical questions central to understanding contemporary nursing in a globalised world will be explored and the use of analytical philosophy and philosophical method in addressing such questions. The paper will conclude by looking to the future; what the role of philosophy might be in shaping nursing as a discipline and in the preparation of future practitioners. (shrink)

Rawls’s consideration not to include the choice of economic systems as part of a theory of justice is inconsistent with his comments on redistribution and the political effects of economic inequality. When Rawls’s discussion of economic systems and his discussion of economic inequalities is examined, it is apparent that the selection of economic systems is a pertinent topic for a theory of justice. The propensity for the primary social good of self-respect to be satisfied can be affected by the selection (...) of economic systems. Rawls has incorrectly determined the selection of economic systems to be unimportant if different economic systems can be more advantageous to the satisfaction of self-respect than others. When socialism and Rawls’s version of regulated capitalism are compared, socialism is a maximin solution, and accordingly will be selected by people within the original position under the veil of ignorance. This work analyses Marx's philosophy of nature and shows how it is the basis for his practical philosophy. Previous analysis of Marx's philosophy of nature has considered humans as only natural beings and social beings. But, Marx analyzed humans' relationship to the natural world and to themselves as natural, social, and material. This material feature of human action can server as a basis for social critique and as the foundation for a practical analysis. The first chapter of this book analyzes (...) Marx's philosophy of nature from his early to late works and argues that humans are natural begins that use nature to develop new capacities. This consideration is central in Marx's critiques of Hegel and Feuerbach. The second chapter discusses Marx's material critique of social forms and discusses why the distinction between material action and social action is a key component of Marx critique of capitalism. This chapter also discusses industrial history, ideology, wages, justice, and valorization. The third and final chapter builds on Marx's materialist analysis to develop a standard of practical action that takes human's material activity as its basis. This chapter also discusses classical historical materialist claims, liberal ethical theories, and a practical philosophic consideration of socialism. (shrink)

Blindsight is a hot topic in philosophy, especially in discussions of consciousness. Here I critically examine various attempts to bring blindsight to bear on debates about qualia -- the raw constituents of consciousness. I argue that blindsight does not unequivocally support any particular theory of qualia. It does, however, vindicate the view that there are qualia, despite arguments -- most notably by Daniel Dennett -- to the contrary.

This paper will show that Mary Wollstonecraft developed a modern feminist version of virtue ethics. Virtue ethics is an all-encompassing moral theory which holds that the best life for individuals is commensurate with a good society. Simply, self-interest and our public duties are argued as identical and not at odds when we realize what is truly good for ourselves and for others. In the Western philosophic cannon, the most common version of virtue ethics is Aristotle’s, with the Nicomachean Ethics as (...) the definitive presentation. Wollstonecraft’s argument for the political, social, economic, and personal equality of women utilizes ideas that are reminiscent of classical virtue ethics. Her novel and effective addition is to show that the explicit inclusion of women requires a reconsideration of the duties needed for happy lives to be led and for a good society, and good families, to exist. Decommodification is an important support for the development of our excellences and the pursuit of our freedom of conscience. In order to show this, the paper will be structured as follows. First, it will be argued that a decommodified social threshold of goods and services is a necessary part of a free-standing politically liberal conception of justice. The authors to be reviewed in this section are R.H. Tawney and John Rawls. The second section will discuss a compendium of possible decommodified (...) goods and services. Abstract: This paper restates the thesis of 'The Requirements of Justice and Liberal Socialism" where it was argued that liberal socialism best meets Rawlsian requirements of justice. The recent responses to this paper by Jan Narveson, Jeppe von Platz, and Alan Thomas merit examination and comment. This paper shows that if Rawlsian justice is to be met, then non-personal property must be subject to public control. If just outcomes merit the public control of non-personal property and this control is not (...) utilized, then justice has been subordinated to the objectively less important institution of private property. G.A. Cohen attempts to provide a case for socialism that takes into consideration the reasons why socialism is desirable and some of the problems for its feasibility. He finds that the kind of community sentiment that socialism requires is possible, but the devices of social organization that can facilitate the growth of socialist sentiment along with the effective transmission of information are not currently known. In short, Cohen thinks social scientists and philosophers need to find out how to harness the (...) information transmission capacity of market exchange without the motivational encouragement of rapacious self-interest that market exchange fosters. This paper argues that Cohen’s appraisal of the ineffectiveness of informational transmission in socialist planned economies in incorrect. A democratically planned socialist economy can serve as the basis for the fostering of the socialist community sentiment that Cohen advocates along with the required transmission of economic information. In his Republic, Plato argues that self-rulership cannot be widespread enough in a populace due to structural failures of education. This means that rulership by the few with the use of manipulative mythological devices is inevitable. That is, if a populace cannot rule themselves through the use of their reason, then they will be ruled by others through the use of myth, at best, and at worst, violence. Even given this rather grim conclusion, if we closely examine what Plato has (...) to say about politics, we can see that there is no natural impossibility for generalized rule by the many. That is, there is no aristocracy of birth, but there is an aristocracy of the educated. As I will show below, we can develop a more democratic politics out of Plato if we consider the possibility of a democratic education. Before I do that, I will briefly consider Rawls’ comments on the education of citizens for democracy. This will allow for a clearer consideration of the democratic potential of Plato’s political philosophy in his Republic. (shrink)

G.A. Cohen’s critique of the Rawlsian difference principle points out an inconsistency in its presentation. The initial equality decided by the participants in the original position under the veil of ignorance is not preserved by the inequality sanctioned by the difference principle. Cohen shows how the breakdown of the initial equality of the original position prevents the desired results of the Rawlsian system from being realized. Cohen argues that an egalitarian ethos is required within a society for equality preserving economic (...) distributions and Pareto superior outcomes to occur. Nonetheless, Cohen’s analysis of Rawls misses the ultimate cause of inequality, which is the dynamics of capital accumulation. An egalitarian ethos is only possible if there is a socialist mode of production to facilitate its development. Additionally, Cohen’s critique of Rawlsian constructivism through an argument for intuitionism does not address the natural-material existence of human beings. This existence must be considered for any advantageous social formation. (shrink)

This paper will examine the three distributive problems of inequality, social scarcity, and environmental decay. All three of these problems are the result of economic growth that is not properly structured by institutions. It will be argued that each one of these distributive problems exacerbates the other two. Any solution to one of these problems must address the other two as well. This paper will show that these three distributive problems can be minimized through a combination of tax measures, institutional (...) changes, public employment creation, public service provision, and the nationalization of certain industries. Modern money theory is a conjecture concerning fiscal spending and the nature of money. I show that modern money theory provides two interesting insights into distributive justice that have not been addressed in the recent Anglo-American distributive justice literature: (i) that the nature of a sovereign fiat currency allows for some distributive conflicts to be avoided; and (ii) that recent Anglo- American distributive justice theories assume that the economy is at capacity. Stephen Mumford argues that aesthetic and moral values in sport are interdependent, focusing on cases where immorality taints beautiful performance. This interdependence thesis is insightful but, I argue, in need of refinement, as its normative implications are unclear and perhaps implausible. I also challenge Mumford’s perspective on the infamous Dynamo Kiev death match. Whereas Mumford claims that the match’s morally oppressive circumstances detract from it so that ‘it was not something knowingly we should have admired aesthetically’, I argue that, on (...) the contrary, and in light of what Mumford says about other cases, such circumstances actually enhance the game’s aesthetics such that it would be wrong not to appreciate it aesthetically. Hun Chung’s recent article “Rawls’s Self-Defeat: A Formal Analysis” argues that the selection of results equivalent to justice as fairness can be derived by utilitarianism. Chung argues that these results can be achieved through the use of Rawls’s constructed utility function from his work Justice as Fairness. Although Chung’s article is finely argued and presented in great detail, this paper will show that Chung made three mistakes in the fundamentals of his argument. First, Chung mistakes Rawls’s constructed utility function as (...) actually utilitarian. Second, Chung confuses the motivations and the assumptions of those held by agents in the original position and those held by utilitarian agents. Last, Chung’s previous mistakes result in the incorrect conclusion that an equal distribution of resources will be selected by representative agents instead of the unequal distribution prescribed by the difference principle. The purist/partisan distinction has dominated recent discussions of sport spectatorship and sport aesthetics. The focus of such discussions, however, has been sport in general or, often implicitly, team sports in particular. Here, using mixed martial arts (MMA) as a case study, we argue that specific aspects of the sport in question can significantly affect how the purist/partisan distinction plays out for viewers. MMA’s status as an individual combat sport mitigates, in illuminating ways, the partisanship displayed so prominently among fans of (...) team sports. We also examine the role of external attitudes – in both the betting subculture of MMA and purist attitudes toward individual combat sports and martial arts – in shaping MMA spectatorship. (shrink)

This chapter considers The Daily Show's unique capacity to demonstrate, through satire, misuses of reason in politics and the media. It considers examples taken from “Indecision 2004,” more recent examples from “Indecision 2012,” and some from The Colbert Report. The chapter begins by considering The Daily Show's treatment of the more common logical fallacies employed by politicians and their exponents. Next, it discusses various political appeals to emotion exposed by The Daily Show. Then, it considers some of The Daily Show's (...) many forays into the alternative universe of political spin, the systematic, politically motivated use of persuasive language, including “talking points.” The chapter concludes by briefly considering some of the different comedic devices used by Jon Stewart and Stephen Colbert to expose and satirize these kinds of political rhetoric. Jon Stewart's continued criticism of the inconsistency and irrationality of the American media, the notion of truthiness has relevance for any fan of The Daily Show. This chapter looks a little bit more closely at two notions of truthiness. Focusing on the first sense, it draws some parallels between truthiness and paradigm cases of motivated epistemic irrationality like wishful thinking and self‐deception. Every December we are told there is a war on Christmas. Jon Stewart, however, claims that this war is a farce. In 2005, Fox News correspondent John Gibson published The War on Christmas, and Bill O'Reilly complained about businesses such as Walmart saying “Happy Holidays” to their customers instead of “Merry Christmas.” Christmas celebrations were largely illegal in both England and the Americas during the 1600 s and 1700 s. Christmas made a cultural comeback in the early 1800 s, but (...) not because of religious influences. The holiday's religious elements didn't enjoy a resurgence until it was clear that Christmas was here to stay and Christians renewed their efforts Christianize it. There is no war on Christmas. The events that Bill O'Reilly and Fox News think constitute a war on Christmas are actually just efforts to correct the effects of the Christian war for Christmas. (shrink)

Much has been written about the presumed interaction between moral and aesthetic properties in art, about whether moral flaws in a work or its artist can compromise the work’s aesthetic value. In the philosophy of sport, similarly, the beauty of an athlete’s performance may be undermined by moral flaws in the performance itself (e.g., in a case of cheating). Yet to be addressed, however, is a potential analogy between artists and athletes where personal moral flaws failing to register in the (...) work or performance may nonetheless compromise aesthetic response. Along with tracing the conceptual terrain in these debates and drawing on earlier work endorsing pluralism in such matters, I will argue that an athlete’s moral flaws may indeed compromise the aesthetic appeal of their performances, even where such flaws stand apart from those performances. In contrast to creative artists whose presence is immaterial to accessing their work, in the case of performing artists and athletes—since they themselves are the vehicles of their work—it is, and ought to be, harder to avoid having one’s moral response to the person diminish one’s aesthetic response to the work. We want athletes to be moral exemplars, I propose, less because they serve as role models and more because we want to preserve unspoiled the aesthetic rewards they provide. (shrink)

Sport aesthetics historically has been somewhat marginalized in the philosophy of sport, which is itself a marginalized focus in philosophy—to some degree, not.

This chapter examines the real status of the scientific theory of evolution and what people mean by intelligent design. More generally, it explores the proper relationship between science and religion, not to mention politics, in early 21st century America. These concepts are examined through the inquiring minds and sharp tongues of Jon Stewart, Lewis Black of the “Evolution, Schmevolution” series, and former Daily Show “correspondent” Ed Helms.

The authors show that martial arts illustrate how ethical and aesthetic value intersect within and beyond sport. While they do not aim to provide a comprehensive analysis of martial arts in this paper, they do plan to draw parallels between sport and martial arts for the purpose of recognizing how martial arts practice may be both aesthetically pleasing and grounded in ethically relevant aims. The upshot of this paper is not wholly positive, however, since the authors draw attention to ethically (...) repugnant practices connected to ideals of aesthetic beauty and other contentious sport practices as part of the analysis of the connection between aesthetic and ethical value. In light of those shared connections, martial arts might simply reinstate, rather than overcome, troublesome goals and values in sport. (shrink)

The cosmetics, detergents and food industries trial development products using healthy human volunteer studies. They also use human tissue for in vitro investigations. Hitherto, the ethics of such work has not been regulated. The UK Human Tissue Act will have legal implications on current arrangements for such studies within the industry, especially with regards to informed consent and seeking ethical review of research proposals. At present, however, it is unclear who will fund ethical review for use of ‘relevant material’ in (...) non-medical research, and on the required status of ethics committees to review such work. The principles behind the sampling, storage and processing of ‘relevant material’ are largely identical whether it be for medical or non-medical investigations. It is argued, therefore, that this is further justification for industry and professional bodies to adopt best practice of ethical review for all studies in ‘grey areas’ outside the scope of regulations. This would follow closely those standards applied to biomedical research. (shrink)

Throughout the Global North, policymakers invest in large-scale integration of health-data infrastructures to facilitate the reuse of clinical data for administration, research, and innovation. Debates about the ethical implications of data repurposing have focused extensively on issues of patient autonomy and privacy. We suggest that it is time to scrutinize also how the everyday work of healthcare staff is affected by political ambitions of data reuse for an increasing number of purposes, and how different purposes are prioritized. Our analysis builds (...) on ethnographic studies within the Danish healthcare system, which is internationally known for its high degree of digitalization and well-connected data infrastructures. Although data repurposing ought to be relatively seamless in this context, we demonstrate how it involves costs and trade-offs for those who produce and use health data. Even when IT systems and automation strategies are introduced to enhance efficiency and reduce data work, they can end up generating new forms of data work and fragmentation of clinically relevant information. We identify five types of data work related to the production, completion, validation, sorting, and recontextualization of health data. Each of these requires medical expertise and clinical resources. We propose that the implications for these forms of data work should be considered early in the planning stages of initiatives for large-scale data sharing and reuse, such as the European Health Data Space. We believe that political awareness of clinical costs and trade-offs related to such data work can provide better and more informed decisions about data repurposing. (shrink)

The Daily Show has emerged as one of the most influential media sources for political information. The same reliance on satire and parody as a means of social and political critique is on display in the show's spin‐off book, America. Both the book and television show aim to hold up a mirror to the contemporary United States. The lack of meaningful public participation in self‐governance isn't America's only critique of contemporary American democracy. A second theme is the narrow range of (...) demographic groups making up the government. America's final chapter calls attention to some slight imperfections in an otherwise perfect Union—inefficiencies, inequities, injustices, absurdities, hypocrisies, and an overall failure to live up to the lofty ideals expressed in the nation's founding documents. Like America, Earth offers an ironic but impassioned defense of democracy, along with thinly veiled criticism of its historical and contemporary opponents. (shrink)

When America's Thomas Jefferson insists that work hard to perfect the work of the Framers, he exhorts us to carry forth the creative, revolutionary spirit ourselves. In Kevin Bleyer's Me the People: One Man's Selfless Quest to Rewrite the Constitution of the United States, Thomas Jefferson is a constant source of inspiration. Me the People doesn't remain at the level of theory. The chapter on the Judiciary, devoted to Bleyer's improbable lunch with Supreme Court Justice Antonin Scalia, the Justice most (...) closely associated with the controversial constitutional theory of originalism, is the clear climax of the book. Although Scalia a darling of the Tea Party and a conservative Catholic, evangelicalism does not permeate his legal reasoning. Sure Me the People is a fun book on American history, but it prods the reader comically, by exploiting the comedic value of the fact that so few Americans read the Constitution. (shrink)

Although philosophers acknowledge the significance of blindsight for theories of mind---indeed, some try to trade on it---they have not given the phenomenon the extended treatment it deserves. In helping to fill this gap, I argue that despite attempts to use it in undermining qualia , blindsight supports realism about qualia, and an identity theoretic account of them. ;In Chapter 1 I argue against attempts by Dennett and the Churchlands to use blindsight in undermining qualia. I complement this by criticizing their (...) more general arguments against qualia. ;In Chapter 2 I argue that blindsight in fact supports realism about qualia. To do so I bring together four separate points from the literature and add to them a fifth, adapted from an observation by Jerry Fodor. ;In Chapter 3 I argue that blindsight is best explained by saying that the qualia patients conspicuously lack are causally involved in normal vision.
