On 6 September 1966, the prime minister of South Africa, Dr HF Verwoerd was killed by Mr Tsafendas, a Portuguese national of Greek descent, in parliament by stabbing him in the chest. Mr Tsafendas was a messenger in parliament. At the enquiry trial of Mr Tsafendas, he was found unfit to stand trial on the ground that he suffered from schizophrenia. The psychiatric evidence during the enquiry trial was reviewed and discussed under the following headings: Diagnosis of schizophrenia; Consideration of (...) cultural factors in forensic psychiatric settings; Delusional infestation v. extreme overvalued beliefs; Simulation of psychosis; Ethical considerations in criminal capacity and trial competency assessments. Lessons from the Mr Tsafendas enquiry trial for forensic psychiatrists where a defendant previously diagnosed with schizophrenia commits a prominent political murder, are summarised. It is emphasised that the personhood of an accused referred for forensic observation should be respected and protected, instead of focusing exclusively on a specific diagnosis. (shrink)

Cette étude fournit une analyse comparative des politiques liées à la position des personnes handicapées sur le marché du travail en Finlande et en Italie, deux pays où l’écart d’emploi entre les personnes handicapées et non handicapées est relativement faible. Cette étude examine les politiques visant à améliorer la position des personnes handicapées sur le marché du travail et se base sur la littérature existante et des entretiens avec des experts. L’analyse comparative montre que ces deux pays emploient des approches (...) politiques différentes. En Finlande, les compensations sont relativement élevées et les politiques mettent l’accent sur la prévention. Cependant, les mesures d’activation pour les bénéficiaires de compensations d’invalidité font défaut. En Italie, les politiques se concentrent sur l’activation. La loi italienne sur les quotas oblige les entreprises à embaucher des personnes handicapées. En outre, les coopératives sociales offrent des emplois aux personnes handicapées. Les résultats suggèrent que les efforts visant à garantir des mesures de compensation et d’activation adéquates, combinés à des processus créés pour construire une société inclusive, peuvent contribuer à améliorer la situation du marché du travail pour les personnes handicapées. Au-delà d’une bataille écologique tenace pour l’abandon du projet d’aéroport, le bocage de Notre-Dame des Landes a constitué un terrain d’expérimentation pour transformer l’occupation militante en droit pérenne d’usage des terres. Les « zadistes » se sont battus pour devenir agriculteurs et exploiter collectivement la terre au service d’une agriculture « écolo et non Monsanto ». Ils ont parié sur le fait de mener une bataille sur le droit face à l’administration et, en échange de fiches de projets, ont obtenu (...) des baux ruraux individuels de neuf ans, comme les paysans résistants et les paysans cumulards, qui exploitaient les terres avant la préemption. Le rêve éveillé est devenu réalité, même si l’un des principes de base initiaux, « la terre en commun », a subi des altérations. (shrink)

Cette Mineure s’est fixée pour tâche de « refroidir » le débat, de regarder en dessous des idéologies charriées par le mot, de décomposer la polysémie territoriale. L’auteure a voulu ici proposer un point de vue sur les controverses qui agitent les milieux scientifiques autour des formes et des dynamiques territoriales. As scholars have rushed to either prove or refute cultural group selection, the debate lacks sufficient consideration of CGS's potential moderators. We argue that pressures for CGS are particularly strong when groups face ecological and human-made threat. Field, experimental, computational, and genetic evidence are presented to substantiate this claim.

Euthanasia and physician-assisted suicide (PAS) by request and/or based on an advance directive are legal in The Netherlands under strict conditions, thus providing options for patients with Huntington's disease (HD) and other neurodegenerative diseases to stay in control and choose their end of life. HD is an inherited progressive disease characterised by chorea and hypokinesia, psychiatric symptoms and dementia. From a qualitative study based on interviews with 15 physicians experienced in treating HD, several ethical issues emerged. Consideration of these aspects (...) leads to a discussion about the professional role of a physician in relation to the personal autonomy of a patient. Such a discussion can raise awareness that talking about end-of-life wishes with an HD patient is part of the legal, professional and moral responsibility of the physician, and that a letter of intent on behalf of the physician can improve active participation in the process. Discussion of these issues can help to advance the debate on euthanasia and PAS in HD and other neurodegenerative diseases. (shrink)

Le MST a connu de grands succès dans les années 1980 – 450 000 familles dans assentamentos (propriétaires) ou acampamentos (occupants) – et a servi d’exemple à de nombreuses mobilisations et occupations de terres dans le monde. Pendant l’ère Bolsonaro, le mouvement a connu diverses adaptations. Il a adopté le récit de l’entrepreneur agricole, influencé en cela par les évangélistes – de la « théologie de la libération » communautaire à la théologie individualiste de la réussite. Il a, par obligation (...) et répression, délaissé l’action d’occupation des terres pour le développement de l’agriculture biologique et la production d’aliments « sains », largement à destination des villes. Ainsi, il resserre les liens entre le rural et l’urbain et se rapproche stratégiquement du Mouvement des Sans Toit. (shrink)

Un mouvement environnemental sans précédent a pris forme lorsque le gouvernement du Bangladesh a projeté la construction d’une centrale à charbon à 14 km des Sundarbans, la plus grande mangrove du monde. Plusieurs experts, dont certains de l’Unesco, ont indiqué que les déchets et la fumée de la centrale menaceraient la forêt et sa biodiversité. Malgré cela, le gouvernement persiste dans son intention de mener à bien le projet en fonction des intérêts de certains groupes au pouvoir. Le mouvement a (...) débuté discrètement en 2012 et est devenu massif par la suite. En 2017, il a réussi à mobiliser la mouvance du militantisme écologique et certaines organisations internationales. Il s’agissait de faire pression sur le gouvernement pour qu’il abandonne le projet d’usine. Cet article décrit l’évolution du mouvement, ses principaux acteurs, sa portée mondiale ainsi que sa situation actuelle. (shrink)

Cet article analyse les situations d’injustice environnementale au Sri Lanka, en comparant vingt-six conflits socio-environnementaux identifiés dans l’Atlas mondial de la justice environnementale. Ils sont été compilés par l’auteur, en collaboration avec des activistes du Center for Environmental Justice (CEJ) du Sri Lanka. En nous appuyant sur différentes sources (rapports d’ONG, journaux, blogs, sources gouvernementales, déclarations commerciales et articles universitaires), et en privilégiant une approche d’écologie politique, nous analysons quelles sont les activités économiques qui génèrent des affrontements, quels acteurs y (...) participent et de quelle manière les différents groupes se sont mobilisés contre des projets d’investissement. La restitution des artefacts pillés lors des conquêtes coloniales ou abritées dans les musées « coloniaux » suscite des réactions antagoniques. Faut-il « tuer » le modèle du musée ethnographique, comme le préconise le président du Mali, ou bien purifier les collections témoins de pratiques génocidaires, en les radiographiant ou les cachant dans les réserves muséales, à l’abri des regards critiques? La complicité entre le pouvoir académique et le principe d’inaliénabilité de la propriété muséologique rendent le processus de restitution particulièrement (...) lent. Pour éviter que la restitution soit récupérée, des réponses rapides ont été conçues pour mieux correspondre aux imaginaires et pratiques de la jeunesse africaine: musée numérique, muséologie critique, institutions de culture populaire et restitution « en mode rapide ». Plutôt que de se focaliser sur des objets iconiques, la restitution en mode rapide cherche à revisiter l’ingéniosité traditionnelle précoloniale pour développer de nouvelles techniques, de nouvelles œuvres d’art et de nouveaux objets à finalité sociale et spirituelle. Les rapports sociaux de race, de genre, de sexe sont inextricablement mêlés : telle est une idée centrale du féminisme décolonial tel qu’il se déploie depuis Abya Yala, du nom que le peuple kuna donnait au continent américain. L’article situe l’importance de renommer les femmes et féministes d’origine autochtone, une manière de défaire les discours coloniaux (parfois tenus par des universitaires féministes) sur les pratiques de genre avant la colonialité/modernité. Ochy Curiel illustre cette idée à partir de l’expérience du GLEFAS (...) (Groupe latino-américain de formation et d’action féministe) : le décolonial n’y est pas seulement une critique du savoir académique, il est profondément ancré dans des pratiques autogestionnaires de luttes anticapitalistes, dans le lesbianisme politique, dans la rue, dans les associations, dans les organisations communautaires. Cet article s’attaque au manque d’informations sur les nombreux conflits de distribution écologique (EDC) provoqués par l’extractivisme minier en Inde au cours de ces dernières années. Le minerai de fer est le métal le plus extrait en Inde et, par conséquent, les conflits liés à cette activité sont importants. Nous analysons ici neuf conflits majeurs surgis dans différents états de l’Inde. Dans l’analyse de ces cas, nous mettons l’accent que les conséquences de l’extractivisme prédateur dans le secteur de l’exploitation des (...) minerais, ainsi que leurs impacts environnementaux, sociaux et culturels sur les régions minières « périphériques » de l’Inde. Cet article présente une revue des mouvements de justice environnementale en Inde, à partir d’une combinaison d’informations provenant de l’Atlas de la justice environnementale (EJAtlas), de travaux de terrain et d’une analyse de la littérature secondaire. L’auteur souligne ici l’intensité des conflits, les armes judiciaires qui confortent les manifestations et le changement des slogans avec le temps, ainsi que les synergies et les alliances anciennes et actuelles entre ces mouvements indiens. Pour l’analyse sont combinés l’utilisation de statistiques descriptives et quelques (...) exemples concrets. Enfin, il est proposé un débat sur la signification du terme « succès » appliqué à la justice environnementale, sujet sur lequel des recherches plus approfondies s’avèrent nécessaires. (shrink)

According to a recent challenge to Kratzer's canonical contextualist semantics for deontic modal expressions, no contextualist view can make sense of cases in which such a modal must be information-sensitive in some way. Here I show how Kratzer's semantics is compatible with readings of the targeted sentences that fit with the data. I then outline a general account of how contexts select parameter values for modal expressions and show, in terms of that account, how the needed, contextualist-friendly readings might plausibly (...) get selected in the challenge cases. The traditional verbal/nonverbal dichotomy is inadequate for completely describing cerebral lateralization. Musical functions are not necessarily mediated by the right hemisphere; evidence for a specialist left-hemisphere mechanism dedicated to the encoded speech signal is weakening, and the right hemisphere possesses considerable comprehensional powers. Right-hemisphere processing is often said to be characterized by holistic or gestalt apprehension, and face recognition may be mediated by this hemisphere partly because of these powers, partly because of the right hemisphere's involvement in emotional affect, and (...) possibly through the hypothesized existence of a specialist face processor or processors in the right. The latter hypothesis may, however, suffer the same fate as the one relating to a specialist encodedness processor for speech in the left. Verbal processing is largely the province of the left because of this hemisphere's possession of sequential, analytic, time-dependent mechanisms. Other distinctions are special cases of an analytic/holistic dichotomy. More fundamentally, however, the left hemisphere is characterized by its mediation of discriminations involving duration, temporal order, sequencing, and rhythm, at thesensory level, and especially at themotorlevel. Spatial aspects characterize the right, the mapping of exteroceptive body space, and the positions of fingers, limbs, and perhaps articulators, with respect to actual and target positions. Thus there is a continuum of function between the hemispheres, rather than a rigid dichotomy, the differences being quantitative rather than qualitative, of degree rather than of kind. (shrink)

Entre le scénario d’arrivée de nouveaux gouvernements de droite et celui du retour au progressisme, l’Amérique du Sud fait preuve d’une instabilité politique et d’une crise de gouvernement qui montre la fin des structures politiques de consensus qui l’ont gouvernée ces dernières décennies. Alors qu’au Chili et dans d’autres pays, l’année 2019 a offert un panorama de nouvelles protestations, la période post-pandémique pourra peut-être engendrer une nouvelle mobilisation politique contre les formes actuelles de gouvernance et les arrangements politiques qui l’accompagnent.

Tommie Shelby has offered an influential, carefully stated, and well-argued set of objections to any volitional analysis of racism (VAR) as consisting centrally in certain forms of race-based disregard. Here I hope to defend aspects of VAR by analyzing, evaluating, and sometimes countering several of his major contentions, which have stood unchallenged in the literature over more than two decades. First, I sketch and respond to his Methodological objection to VAR, which criticizes VAR's reliance on language and linguistic intuitions; then (...) to a Psychological objection, which suggests that VAR implausibly distances an agent's intentions from her beliefs; and, finally, to a Psychopathological objection, which holds that VAR requires treating as unproblematic some psychological states better seen as aberrant. The following section treats three subtle counterexamples Shelby uses to challenge VAR's core contentions about what's necessary and what's sufficient for racism. I close with some gestures toward what I see as a promising approach, very different from his, to studying these topics. (shrink)

The problem of Divine hiddenness, or the hiddenness problem, is more and more commonly being treated as independent of the problem of evil, and as rivalling the latter in significance. Are we in error if we acquiesce in these tendencies? Only a careful investigation into relations between the hiddenness problem and the problem of evil can help us see. Such an investigation is undertaken here. What we will find is that when certain knots threatening to hamper intellectual movement are unravelled, (...) the hiddenness problem emerges as a contender in its own right—one that may generate serious difficulties for theism regardless of conclusions drawn concerning the force of the problem of evil. When interpreting the meanings of visual features in information visualizations, observers have expectations about how visual features map onto concepts (inferred mappings.) In this study, we examined whether aspects of inferred mappings that have been previously identified for colormap data visualizations generalize to a different type of visualization, Venn diagrams. Venn diagrams offer an interesting test case because empirical evidence about the nature of inferred mappings for colormaps suggests that established conventions for Venn diagrams are counterintuitive. Venn diagrams represent classes (...) using overlapping circles and express logical relationships between those classes by shading out regions to encode the concept of non-existence, or none. We propose that people do not simply expect shading to signify non-existence, but rather they expect regions that appear as holes to signify non-existence (the hole hypothesis.) The appearance of a hole depends on perceptual properties in the diagram in relation to its background. Across three experiments, results supported the hole hypothesis, underscoring the importance of configural processing for interpreting the meanings of visual features in information visualizations. In this second of two essays responding to critical discussion of my " Divine Hiddenness and Human Reason," I show how an ' accommodationist ' strategy can be used to defuse objections that were not exposed as irrelevant by the first essay. This strategy involves showing that the dominant concern of reasons for divine withdrawal can be met or accommodated within the framework of divine - human relationship envisaged by the hiddenness argument. I conclude that critical discussion leaves the argument (...) very much alive and kicking, and indeed strengthened as it moves into its second decade of life. (shrink)

Some Christian philosophers wonder whether a God really would oppose reasonable nonbelief. Others think the answer to the problem of reasonable nonbelief is that there isn’t any. Between them, Douglas V. Henry and Robert T. Lehe cover all of this ground in their recent responses to my work on Divine hiddenness. Here I give my answers to their arguments.

In this brief reply I argue that criticisms of the hiddenness argument recently published in this journal by Imran Aijaz and Markus Weidler are without force. As will be shown, their critique of my conceptual version of the argument misses the mark by missing crucial distinctions. Their critique of my analogical version of the argument misunderstands that argument and also misapplies the work of W. H. Vanstone. And their critique of my view that belief is necessary for a certain kind (...) of relationship with God overlooks both some central features of that kind of relationship and some good reasons for not accepting acceptance or anything similarly nonbelieving as a substitute for belief in this context. This paper is an introduction to topos theory which assumes no prior knowledge of category theory. It includes a discussion of internal logic in a topos, A characterization of the category of sets, And an investigation of the notions of topology and sheaf in a topos.

Only 6 years have passed since I last published a critical survey article on the divine hiddenness discussion. But more than 60 papers and books dealing with hiddenness themes have been published in that time. Not all can be addressed here. Moreover, to enable a reasonable treatment of those that will make an appearance, I shall break the present survey into two parts. I begin in this piece with recent work—including my own—on the argument descended from Schellenberg (), which started (...) the discussion. Part 2, yet to come, will consider ways in which this area of inquiry has recently been enlarged beyond its original parameters. (shrink)

Offered here is Part 2 of a two-part critical survey of recent work in philosophy on divine hiddenness. Part 1 surveyed recent development of the discussion initiated by my 1993 book on the subject. Here, I examine some related work that expands the scope of the hiddenness discussion. Some of the enlargements take further the discussion of Stephen Maitzen's work on the demographics of theism. Others introduce new hiddenness problems and ways of dealing with them. As the sun is the cause both of the becoming of that which is subject to becoming and of our apprehension of it and of its changes through the eye, so the idea of good is the cause of the being of that which is and also of our knowledge of it. As the sun is beyond (...) γxs22EFνεσις, so the Idea of Good is beyond Being. Glaucon says he does not understand. The simile is further elucidated by means of a line, divided into two parts, of which one stands for the νιητxs22EFν γxs22EFνος τε καxs22EF τxs22EFπος, where the Idea of Good bears rule, the other for the xs22EFρατxs22EFν γxs22EFνος τε καxs22EF τxs22EFπος, over which the sun is lord. The line is to be divided unequally , and subdivided in the same proportions. Thus we get a line consisting of four parts in the ratio 4 : 6 : : 6 : 9. Let us call the four parts A B C D respectively, A being the smallest, D the greatest, B and C necessarily equal. 'The genocide in Rwanda showed us how terrible the consequences of inaction can be in the face of mass murder. But the conflict in Kosovo raised equally important questions about the consequences of action without international consensus and clear legal authority. On the one hand, is it legitimate for a regional organization to use force without a UN mandate? On the other, is it permissible to let gross and systematic violations of human rights, with grave humanitarian consequences, continue unchecked?'.
