The discourse of identity in the Arab context in general and in the Maghrebi context in particular is a modern phenomenon and is of central importance. In the Maghreb this discourse is related to modernization efforts, with the de-colonization struggle and its ideology, and with the nation-state-building genesis, process, and legitimisation after independence. A fundamental part in the developmental process of this discourse, there-fore, is the difference from, as well as the non-negotiable and hegemonic presence of, the "Other". The evolution (...) of a Maghrebi discourse of identity in this instance is a peculiar formation of consciousness or awareness with regard to a self-evident constancy, namely, the own identity, which had not been in doubt up to that point. From the challenging encounter with the western European hegemonic "Other" comes the necessity to bring forth such a discourse. The Difference is thus a fundamental aspect in the beginnings of the Maghrebi discourse of identity. (shrink)

This paper explores ethical issues raised by quadratic voting. We compare quadratic voting to majority voting from two ethical perspectives: the perspective of utilitarianism and that of democratic theory. From a utilitarian standpoint, the comparison is ambiguous: if voter preferences are independent of wealth, then quadratic voting out- performs majority voting, but if voter preferences are polarized by wealth, then majority voting may be superior. From the standpoint of democratic theory, we argue that assess- ments in terms of efficiency are (...) too narrow. Voting institutions and political institutions more generally face a legitimacy requirement. We argue that in the presence of inequalities of wealth, any vote buying mechanism, including quadratic voting, will have a difficult time meeting this requirement. (shrink)

We characterize pairs of monotone generalized quantifiers Q1 and Q2 over finite domains that give rise to an entailment relation between their two relative scope construals. This relation between quantifiers, which is referred to as scope dominance, is used for identifying entailment relations between the two scopal interpretations of simple sentences of the form NP1–V–NP2. Simple numerical or set-theoretical considerations that follow from our main result are used for characterizing such relations. Increasing evidence suggests that corporate sustainability is paradoxical in nature, as corporates and managers have to achieve economic, social, and environmental goals, simultaneously. While a paradox perspective has been broadly incorporated into sustainability research for more than a decade, it has resulted in limited improvement in our understanding of corporate sustainability paradox management. In this study, the authors conduct a systematic review of the literature of corporate sustainability paradox management by adopting the Smith–Lewis three-stage model of dynamic equilibrium. The results (...) reveal the following: Both environmental and cognitive factors manifest tensions arising from the sustainability paradox. While both proactive and defensive strategies are adopted to manage the tensions embedded in the corporate sustainability, the proactive strategy is more extensively studied in the current literature. Management strategies of corporate sustainability paradox are characterized as multi-level, multi-stage, and dealing with multiple paradoxes. Proactive strategies enable organizations to enjoy short-term and long-term sustainability benefits. The authors call for further research explicitly addressing the following areas: the paradoxical nature of corporate sustainability management; corporate sustainability paradox management of for-profit organizations; the micro-foundations of corporate sustainability paradox management; defensive strategies and new proactive strategies; and a unified standard of sustainability outcomes. The practical implications of this review are then elaborated. In practice, the results imply that organizations would best manage the corporate sustainability paradox by understanding the paradox and its equilibrium stages. This review and proposed research agenda are expected to deepen interdisciplinary knowledge and set the stage for interested scholars to undertake in their future inquiries. (shrink)

Background Voluntary assisted dying became lawful in Victoria, the first Australian state to permit this practice, in 2019 via the Voluntary Assisted Dying Act 2017 (Vic). While conscientious objection by individual health professionals is protected by the Victorian legislation, objections by institutions are governed by policy. No research has been conducted in Victoria, and very little research conducted internationally, on how institutional objection is experienced by patients seeking assisted dying. Methods 28 semi-structured interviews were conducted with 32 family caregivers and (...) one patient about the experience of 28 patients who sought assisted dying. Participants were interviewed during August-November 2021. Data from the 17 interviews (all with family caregivers) which reported institutional objection were analysed thematically. Results Participants reported institutional objection affecting eligibility assessments, medication access, and taking the medication or having it administered. Institutional objection occurred across health settings and was sometimes communicated obliquely. These objections resulted in delays, transfers, and choices between progressing an assisted dying application and receiving palliative or other care. Participants also reported objections causing adverse emotional experiences and distrust of objecting institutions. Six mediating influences on institutional objections were identified: staff views within objecting institutions; support of external medical practitioners and pharmacists providing assisted dying services; nature of a patient’s illness; progression or state of a patient’s illness; patient’s geographical location; and the capability and assertiveness of a patient and/or caregiver. Conclusions Institutional objection to assisted dying is much-debated yet empirically understudied. This research found that in Victoria, objections were regularly reported by participants and adversely affected access to assisted dying and the wider end-of-life experience for patients and caregivers. This barrier arises in an assisted dying system that is already procedurally challenging, particularly given the limited window patients have to apply. Better regulation may be needed as Victoria’s existing policy approach appears to preference institutional positions over patient’s choice given existing power dynamics. (shrink)

The current note clarifies why, in committees, the prior probability of a correct collective choice might be of particular significance and possibly should sometimes even be the sole appropriate basis for making the collective decision. In particular, we present sufficient conditions for the superiority of a rule based solely on the prior relative to the simple majority rule, even when the decisional skills of the committee members are assumed to be homogeneous.

Greg Bognar has recently offered a prioritarian justification for ‘fair innings’ distributive principles that would ration access to healthcare on the basis of patients' age. In this article, I agree that Bognar's principle is among the strongest arguments for age-based rationing. However, I argue that this position is incomplete because of the possibility of ‘time-relative' egalitarian principles that could complement the kind of lifetime egalitarianism that Bognar adopts. After outlining Bognar's position, and explaining the attraction of time-relative egalitarianism, I suggest (...) various ways in which these two kinds of principle could interact. Since various options have very different implications for age-based rationing, proponents of such a rationing scheme must take a position on time-relative egalitarianism to complement a lifetime prioritarian view like Bognar's. David Benatar argues that creating someone always harms them. I argue that his master argument rests on a conceptual incoherence.

Some of the problems that Harry Collins has faced in his general framework for theorizing tacit and explicit knowledge are, I will argue, due to an inadequate formulation of the problem. It is this inadequacy that has led to pseudo-problems regarding the ‘tacit’ in general. What-is-more, the vehicle for his theory as objectified in ‘strings’ is symptomatic of the problem that his division of tacit and explicit faces. I will argue that the philosophy of Martin Heidegger will give us adequate (...) conceptual tools to re-think Collins’ general framework, to help us understand the origins of these problems, and possibly indicate a way to solve them. To which ends I suggest that either the tacit Collins has in mind is either not truly tacit or it is not tacit enough. (shrink)

Utilitarianism directs us to act in ways that impartially maximize welfare or utility or at least aim to do that. Some find this view highly compelling. Others object that it has intuitively repugnant results; that it condones evildoing and injustice; that it is excessively imposing and controlling; that it is alienating; and that it fails to offer meaningful practical guidance. In this 'Little Debates' volume, James Lenman argues that utilitarianism's directive to improve the whole universe on a cosmic time scale (...) is apt to lead it down a path of imperious moral overreach. Lenman further maintains that the project ultimately shipwrecks upon an extreme lack of epistemic humility in framing the determinants of what is morally right and wrong beyond the limits of what we can ever hope to know. Utilitarianism thus leaves us morally clueless. In contrast, Ben Bramble seeks to develop and defend an original form of utilitarianism, less vulnerable than other, more familiar versions to a number of important objections (including those raised by Lenman). Bramble's form of utilitarianism aims to avoid other unappealing results by presenting it as a claim about what we have the most reason to do and not as a theory of right action (which Bramble urges we should understand quite differently by referencing what would motivate virtuous people). The two authors debate various forms of this longstanding ethical theory, arguing for very different conclusions, in a way that is sure to leave readers with new views of their own moral thoughts and lives. This article studies the monotonicity behavior of plural determinersthat quantify over collections. Following previous work, we describe thecollective interpretation of determiners such as all, some andmost using generalized quantifiers of a higher type that areobtained systematically by applying a type shifting operator to thestandard meanings of determiners in Generalized Quantifier Theory. Twoprocesses of counting and existential quantification thatappear with plural quantifiers are unified into a single determinerfitting operator, which, unlike previous proposals, both capturesexistential quantification with plural determiners and respects theirmonotonicity (...) properties. However, some previously unnoticed factsindicate that monotonicity of plural determiners is not always preservedwhen they apply to collective predicates. We show that the proposedoperator describes this behavior correctly, and characterize themonotonicity of the collective determiners it derives. It is proved thatdeterminer fitting always preserves monotonicity properties ofdeterminers in their second argument, but monotonicity in the firstargument of a determiner is preserved if and only if it is monotonic inthe same direction in the second argument. A number of authors criticise opt-out (or ‘deemed consent’) systems for failing to secure valid consent to organ donation. Further, several suggest that mandated choice offers a more ethical alternative. This article responds to criticisms that opt-out does not secure informed consent. If we assume current (low) levels of public awareness, then the explicit consent secured under mandated choice will not be informed either. Conversely, a mandated choice policy might be justifiable if accompanied by a significant public education campaign. However, (...) if this entitles us to assume that members of the public are informed, then an opt-out system would also be justified in the same circumstances. The alleged advantages of mandated choice seem to rest on an unfair comparison, between mandated choice with a public education campaign and an opt-out system without one. While it may be that some countries with opt-out systems should do more to inform their publics, I see no reason to assume that this cannot be done. Indeed, advocates of mandated choice seem committed to thinking it possible to raise awareness. If opt-out systems adopt the same methods, such as writing to every individual, this should also address concerns about whether consent is informed. (shrink)

Lethal organ donation is a hypothetical procedure in which vital organs are removed from living donors, resulting in their death. An important objection to lethal organ donation is that it would infringe the prohibition on doctors intentionally causing the death of patients. I present a series of arguments intended to undermine this objection. In a case of lethal organ donation, the donor’s death is merely foreseen, and not intended.

This book subjects the traditional concept of law of nature to critical examination. There are two kinds of reasons that invite this reexamination, one deriving from philosophical concerns over the traditional concept, the other motivated by theoretical and practical changes in science. One of the philosophical worries is that the idiom of law of nature, especially when combined with the notion of laws 'governing' individual events and processes, is no longer as intelligible as it used to be in the theistic (...) context in which the formulation of laws became central to science. The traditional concept is also challenged in various ways by contemporary scientific theories such as quantum mechanics, chaos theory and the general theory of relativity. It is no longer clear that there are any universal laws, laws do not always guarantee predictability, and the border between physical and mathematical considerations is constantly shifting. The most difficult challenge, perhaps, is to come up with a scientific explanation of the origin of laws. Wrestling with these intriguing problems, the papers in this volume broaden both our understanding of the natural order and our desiderata of scientific explanation. (shrink)

According to, when forming complex yes/no questions, children do not make errors such as Is the boy who smoking is crazy? because they have innate knowledge of structure dependence and so will not move the auxiliary from the relative clause. However, simple recurrent networks are also able to avoid such errors, on the basis of surface distributional properties of the input (; ). Two new elicited production studies revealed that (a) children occasionally produce structure‐dependence errors and (b) the pattern of (...) children's auxiliary‐doubling errors (Is the boy who is smoking is crazy?) suggests a sensitivity to surface co‐occurrence patterns in the input. This article concludes that current data do not provide any support for the claim that structure dependence is an innate constraint, and that it is possible that children form a structure‐dependent grammar on the basis of exposure to input that exhibits this property. The stakeholder model of the firm (SMF) was originally conceived as a theory of strategic management, intended to remedy the biases of the stockholder model. As the model became more normative, it effectively turned into a theory of business ethics. This paper reproduces material focusing on the contribution of Professor Ed Freeman to stakeholder theorizing. These portions were extracted from a longer manuscript which argues that: 1. SMF generated a series of new questions which constitute some of the defining problems (...) of business ethics at present; yet 2. its inherent company-centered perspective prevents it from resolving these defining problems. There is currently a theoretical tension between young children’s failure in False Belief Tasks (FBTs) and their success in a variety of other tasks that also seem to require the ability to ascribe false beliefs to agents. We try to explain this tension by the hypothesis that in the FBT, children think they are asked what the agent should do in the circumstances and not what the agent will do. We explain why this hypothesis is plausible. We examined the hypothesis (...) in two experiments, each involving a new task. In the first task, the hypothesised misunderstanding of the question leads to failure without the need to ascribe a false belief, and we show that failure in this new task is correlated with failure in the FBT. In the second task, passing which requires ascribing a false belief to an agent, and for which we have partial yet encouraging results, the children are asked a question which is unlikely to be misunderstood. Children pass this task much more often than they do a standard FBT. The mentioned tension is thus resolved. We conclude that the so-called False Belief Task probably does not check the ability to ascribe false beliefs but rather linguistic development. (shrink)

Questions of responsibility arise at all levels of health care. Most prominent has been the issue of patient responsibility. Some health conditions that risk death or serious harm are partly the result of lifestyle behaviours such as smoking, lack of exercise, or extreme sports. Are patients (...) with such conditions responsible for them? If so, might healthcare providers, be they state-run systems or private entities, be justified in treating such patients differently? And if they are, which forms of differential treatment are justified? Responsibility isn’t just relevant for patients. Even when individuals affect their health through voluntary behaviour, other influences are also at work before, during, and after the patient’s interaction with the health care system. What are the responsibilities of individual clinicians and other medical professionals, when thinking about individual and public health? What about institutions such as governments or national health care services, or society as a whole? This collection brings together work by world-renowned experts in population ethics, distributive justice, philosophy of action, cognitive science, and medical ethics in order to push the debate forward by elucidating our understanding of these questions, their possible answers, and how they are related. John Rawls’s ‘just savings’ principle is among the better-known attempts to outline how we should balance the claims of the present with the claims of the future generations on resources. A central element of Rawls’s approach involves endorsing a sufficientarian approach, where our central obligation is to ensure ‘the conditions needed to establish and to preserve a just basic structure’.1 This engaging paper by Christian Munthe, Davide Fumagalli and Erik Malmqvist (‘the authors’) does not explicitly mention Rawls’s work on this (...) issue.2 Still, there are parallels in their aim to generate a ‘sustainability principle’ for healthcare systems. The authors defend the broadening of our focus to the relations between rounds—particularly, how decisions in one period can affect our choice range in the next, whereas current principles for allocating healthcare resources operate within ‘allocation rounds’. Where Rawls is concerned about future generations, the authors’ concern is with future sets of patients. Our present decisions may generate system ‘dynamics’ which are either positive—where ‘more resources per health need’ become available—or negative—where (otherwise justified) decisions taken now leave us with less bang for our buck in the future. Geophilosophy seeks instead to question the ground of thinking itself, the relation of the inorganic to the (...) capacities and limits of thought. And that may be but clearly in these conversations Socrates concludes, as a negative revelation, that a condition for virtue (Virtue as Knowledge of the Good) requires the realization that one does not know what virtue is, that conceited ignorance (amathia) first must be recognized before proceeding positively toward the unchanging Form of Goodness. This standard, which is based in the immediate perception of pleasure or pain, which directly follows an act, may be developed by training; but certainly Aristotle has more to say about the mean and how to achieve it than he does about training, except for the brief statements that we become virtuous by doing virtuous acts and good by the practically wise choices we make. Thus, for Aristotle, it is possible to evaluate specific, particular acts by invoking the measure of the mean. Essentially for both Plato and Aristotle, the criteria "subsist" independently of the act, person or polis. Hence, both Plato and Aristotle remain predominantly rule-oriented.By contrast, in Homerian ethics—as opposed to Platonic or Peripatetic guidelines—it is the whole person who is admirable, not the act; it is the "being" of Achilles, it is his "substance" that is praiseworthy and not whether or not he weeps for his departed companion. Today appraisal theories are the foremost approach to emotions in philosophy and psychology. The general assumption underlying these theories is that evaluations (appraisals) are the most crucial factor in emotions. This assumption may imply that: (a) evaluative pattems distinguish one emotion from another; (b) evaluative pattems distinguish emotions from nonemotions; (e) emotional evaluations of the eliciting event determine emotional intensity.
