Among the more significant developments of the twentieth century, the widespread attention given to 'rights issues' must surely justify ranking it somewhere near the top. Never before has the issue of rights attracted such a wide audience or stirred so much controversy. Until very recently 'rights' were traditionally recognized as attributable only to humans. Today, we increasingly are hearing a call to extend 'rights' to the nonhuman animal and, on occasion, to the environment. In this book, James B. Reichmann, (...) S.J., undertakes an investigation of the metaethical grounds of 'rights' theory, with special focus on the controversial issue of whether creatures other than humans can and should be considered true subjects of 'rights.' He contends that before assigning rights to this or that individual or group, whether human or not, we need to be very clear about what it is we are assigning, to whom, and why. The book argues forcefully that the various recent efforts to build a case supporting animal and environmental 'rights' fail in their quest, and that any such effort resting on a Darwinian evolutionary base is likewise condemned to fail. In furtherance of this claim the author first investigates life phenomena, followed by a detailed comparative study of knowing, communicating and doing, as these are observed in the human and the nonhuman animal. This in turn is followed by an overview of diverse views advanced by contemporary environmental ethicists and animal 'rights' advocates, including Peter Singer, Tom Regan, J. Baird Callicott, Laura Westra, and Don E. Marietta, Jr. Representative though doubtless provocative conclusions drawn from this study include the claims that: (1) Classic Darwinian theory provides no admissable premise from which to derive a theory of inherent, inalienable rights. (2) No satisfactory explanation of the origin of rights and obligation can derive save from within the context of natural law theory. (3) The human person alone unqualifiedly possesses rights. This study examined how sales managers react to ethical and unethical acts by their salespeople. Deontological considerations and, to a much lesser extent, teleological considerations predicted sales managers' ethical judgments. Sales managers' intentions to reward or discipline ethical or unethical sales force behavior were primarily determined by their ethical judgments. An organization's perceived ethical work climate was not a significant predictor of sales managers' intentions to intervene when ethical and unethical sales force behavior was encountered.

Logical Form, Probability Interpretations, and the Inductive/Deductive Distinction.

The Covid-19 pandemic provides a real-world context for evaluating the fairness of disability-based rationing of scarce medical resources. I discuss three situations clinicians may face: rationing based on disability itself; rationing based on inevitable disability-related comorbidities; and rationing based on preventable disability-related comorbidities. I defend three conclusions. First, in a just distribution, extraneous factors do not influence a person’s share. This rules out rationing based on disability alone, where no comorbidities decrease a person’s capacity to benefit from treatment. Second, in (...) a just distribution, undeserved luck does not influence a person’s share. This rules out rationing for biologically caused comorbidities that decrease capacity to benefit. This study examined whether scaffolded lesson study might contribute to the emergence of a shared professional teaching knowledge culture among 4th grade social studies teachers. The study reports findings from a three-year lesson study professional development project that sought to develop professional teaching knowledge for problem-based historical inquiry among participating teachers. Participants included six 4th grade State History teachers from three different schools and three different school systems. Using qualitative data collected during three yearlong lesson study cycles, we present evidence (...) that suggests that lesson study can be used to develop a shared professional teaching knowledge culture among 4th grade social studies teachers. We suggest, however, that a combination of factors might contribute to variations in teachers' participation in that shared professional teaching knowledge culture including the degree to which the teachers embraced the public nature of lesson study. These factors include the teachers' idiosyncratic views of teaching and learning, the teachers' individual tolerance for socially constructing curricula, and the degree to which teachers acceded to cultural obstacles within elementary schooling. Where Men Hide is a spirited tour of the dark and often dirty places men go to find comfort, camaraderie, relaxation, and escape. Ken Ross's striking photographs and James B. Twitchell's lively analysis trace the evolution of these virtual caves, and question why they are rapidly disappearing. They find that for centuries men have met with each other in underground lairs and clubhouses to conduct business or to bond and indulge in shady entertainments. James Gilbert has provided fascinating and valuable historical sketches of the interactions of science and religion in American culture in this century, especially those taking place between 1945 and 1962. Yet, taken together, it is unclear what conclusion is to be drawn from these interactions. Ambiguity about the variety of forms of the science‐and‐religion relationship and about the referent of the termreligion make the task of apprehending a coherent pattern among these sketches very difficult.

This paper uses themes from Catholic social teaching to challenge Church and society to prioritize a group that is left behind by social injustice: people with intellectual disabilities. It provides background information on intellectual disability, summarizes moral principles of Catholic social doctrine, describes sociological facts about how people with intellectual disabilities are left behind by social factors, and prescribes actionable solutions for treating them as equal members of society. The goal is to identify how to shape a society at all (...) socio-ecological levels in ways that better protect the dignity, solidarity, and participation of people with intellectual disabilities. Although the analysis references the US and is limited to intellectual disabilities, its lessons apply to other countries and disabilities as well. (shrink)

In this paper I argue that selective abortion for disability often involves inadequate counselling on the part of reproductive medicine professionals who advise prospective parents. I claim that prenatal disability clinicians often fail in intellectual duty—they are culpably ignorant about intellectual disability. First, I explain why a standard motivation for selective abortion is flawed. Second, I summarize recent research on parent experience with prenatal professionals. Third, I outline the notions of epistemic excellence and deficiency. Fourth, I defend culpable ignorance as (...) the best explanation of inadequate disability counselling. Research shows that a high majority of parents receiving prenatal diagnosis of intellectual disability terminate pregnancy. They have reasons for rejecting a child with intellectual disabilities—these reasons are, most commonly, beliefs about quality of life for it or them. Without a negative evaluation of intellectual disability, their choice makes no sense. Disability-based abortion has been critiqued through virtue ethics for being inconsistent with admirable moral character. Parental selectivity conflicts with the virtue of acceptingness and exhibits the vice of wilfulness. In (...) this paper I claim that, beyond failures of moral virtue, disability abortion often involves failures of epistemic virtue on the part of parents. I argue two things: parents believe something false, or at least contested, about life with intellectual disability—and they do so because they are not epistemically conscientious. I first explain why a central motivation for disability abortion—that it prevents harm to the child—is mistaken. I next give a brief account of intellectual virtue and culpable ignorance. I then indicate why many parents fail to be intellectually virtuous when choosing to terminate pregnancy. I focus on elimination of intellectual disability and have little to say about physical and sensory impairments. (shrink)

A key question in disability studies, philosophy, and bioethics concerns the relationship between disability and well-being. The mere difference view, endorsed by Elizabeth Barnes, claims that physical and sensory disabilities by themselves do not make a person worse off overall—any negative impacts on welfare are due to social injustice. This article argues that Barnes’s Value Neutral Model does not extend to intellectual disability. Intellectual disability is (1) intrinsically bad—by itself it makes a person worse off, apart from a non-accommodating environment; (...) (2) universally bad—it lowers quality of life for every intellectually disabled person; and (3) globally bad—it reduces a person’s overall well-being. While people with intellectual disabilities are functionally disadvantaged, this does not imply that they are morally inferior—lower quality of life does not mean lesser moral status. No clinical implications concerning disability-based selective abortion, denial of life-saving treatment, or rationing of scarce resources follow from the claim that intellectual disability is bad difference. ProthroMy essay focuses particularly on the sacrament of reconciliation. I am currently composing a monograph on this sacrament for a series in biblical theology, surveying the Scriptures to see how, within them, the Church's sacraments are prefigured, revealed, and commanded, and to illustrate Scripture's witness in a way that will "strengthen" and "rejuvenate" our theology and (...) practice, following Dei Verbum (DV) §24. My contribution here focuses especially on how to approach writing a biblical theology of penance. Biblical treatments and defenses of the sacrament are often brief, contenting themselves with proving a few conceptual points or doubling down on Jesus's giving his apostles the power and duty of absolution in John 20:19–23. Robert Fastiggi's discussion of the biblical "foundations" of reconciliation, for instance, spans less than thirty pages for both testaments combined, and concludes with a kind of anti-climactic apology: "While it's clear that the Sacrament of Penance has been instituted by Christ, the actual form of the administration of the sacrament will need to develop within the Church's tradition."1 This is a roundabout way of saying that although Scripture clearly attests to the sacrament's theological foundations, it leaves us only with foundations. If this is true, how far can a biblical theology of the sacrament go, and how should one go about it?Approaching a biblical theology of penance, I think, requires us to pause and consider two aspects of the task. First, we should give an account [End Page 1371] of "biblical theology" and our aims in writing one. Secondly, we should consider how to write a theology of this sacrament in particular. What should we be looking for? Such questions will help us gain a clearer vision of what illumination we should expect from Scripture about penance and how we will go about finding it. With our approach and aims discussed, this essay can then conclude with an attempt to follow them in practice by offering a theological, penance-focused exegesis of the sin of Cain (Gen 4:1–16).A Biblical Theology of the SacramentWriting a biblical theology of the sacrament of reconciliation requires us to attend to the notion of "biblical theology." Unfortunately, there continues to be little agreement on exactly what biblical theology is. The phrase is "a wax nose" molded always to the interpreter practicing it.2 Thankfully, however, this lack of consensus allows us to offer our own proposal and tailor it to the task at hand. Rather than offering a requisite Forschungsbericht or haggling with other proposals in detail as though my goal were to dismantle or replace them globally, I can in this brief essay tell you how I think one should go about this task and why.Our task is writing a biblical theology of penance, and we may begin by noting already two small words in that phrase that tell us much. The first is the indefinite article, "a." We are writing a biblical theology. That designates our goal already as an academic product that fits a particular genre, not simply a lens with which I read. Depending on which term one emphasizes—biblical or theology—and depending on what one means the phrase to rule out, the phrase "biblical theology" can be used to indicate exegesis that is "theologically interested"3 (as opposed to exegesis that spurns dogmatic theology) or to indicate theology that is "biblically faithful"4 (i.e., explicitly biblically sourced as opposed to theologies that operate from first principles other than revelation). Both of these uses of the term, I think, have valid interests but cede too much definitional ground: exegesis that is opposed to or not aimed at the theological truth is incomplete, from a Catholic perspective, and theology that is not constantly informed and reformed by God's [End Page 1372] word can only be ancillary to theology.5 To do exegesis that is theological or theology that is exegetical is simply to do exegesis or to do theology; we do not need an added composite term. Many in the informal logic tradition distinguish convergent from linked argument structure. The pragma-dialectical tradition distinguishes multiple from co-ordinatively compound argumentation. Although these two distinctions may appear to coincide, constituting only a terminological difference, we argue that they are distinct, indeed expressing different disciplinary perspectives on argumentation. From a logical point of view, where the primary evaluative issue concerns sufficient strength of support, the unit of analysis is the individual argument, the particular premises put forward to support a given conclusion. (...) Structure is internal to this unit. From a dialectical point of view, where the focus concerns how well a critical discussion comes to a reasoned conclusion of some disputed question, the argumentation need not constitute a single unit of argument. The unit of dialectical analysis will be the entire argumentation made up of these several arguments. The multiple/co-ordinatively compound distinction is dialectical, while the linked/convergent distinction is logical. Keeping these two pairs of distinctions separate allows us to see certain attempts to characterize convergent versus linked arguments as rather characterizing multiple versus co-ordinatively compound arguments, in particular attempts of Thomas, Nolt, and Yanal, and to resolve straightforwardly conflicts, tensions, or anomalies in their accounts. Walton's preferred Suspension/Insufficient Proof test to identify linked argument structure correctly identifies co-ordinatively compound structure. His objection to using the concept of relevance to explicate the distinction between linked and convergent structure within co-ordinatively compound argumentation can be met through explicating relevance in terms of inference licenses. His counterexample to the Suspension/No Support test for identifying linked structure which this approach supports can itself be straightforwardly dealt with when the test is explicated through inference licenses. ABSTRACT The publication of Ta-Nehisi Coates's Between the World and Me has been met with mixed and widespread reviews and reactions. Responses have ranged from a critique of his “pessimism” to a grand celebratory remark announcing him as the next great intellectual and social critic in the mold of James Baldwin. Yet there are few reviews that have acknowledged Coates's project as a materialist cosmology of the body, meaning that while Coates embraces terrestriality over transcendence, he nevertheless sees great (...) possibilities in the body, the greatest of which is the creation and destruction of “galaxies of reality.” More than just examining race and race relations in the midst of one of the highest incidences of black death, Coates's book examines the meaning of this lived reality at the level of the body and its capacities to both open up and close down material possibilities of life and death. This article will investigate the meaning of the body in Coates's book, its relationship to “race,” and will argue that while Coates does not offer us a solution to the problem of racial embodiment, he does offer the idea that one can and must make peace within the chaos of existence. In describing his seven and a half years as a prisoner of war in North Vietnam, the late Vice Admiral James B. Stockdale has said: "In that atmosphere of death and hopelessness, stripped of the niceties, the amenities of civilization, my ideas on life and leadership crystallized." Despite torture, intimidation, and isolation, Stockdale fulfilled his duties as senior officer among the prisoners with intelligence and courage, defining rules of conduct and maintaining morale. He often described the intense pressures of (...) that situation as a "melting" experience, in which preconceived feelings, fears, and bias melt as one comes to realize that, under the gun, you must grow or fail—or, in some cases, grow or die. This collection of his essays and speeches from the 1980s and 1990s reinforces how that experience formed a lifelong basis for his philosophical thought on issues of character, leadership, integrity, personal and public virtue, and ethics. In both aspects, Holmes echoes Dei Verbum (DV, §§2, 13). However, rather than pursuing (...) a revelation-historical organization or beginning with Scripture's texts to derive conclusions about its nature and purpose, the book takes a "top-down" (13) approach to bibliology. In this way, its strength is the theological framing or refraining it gives to common questions.The first three chapters culminate, he claims, in a "definition of Scripture" (11). Beginning with the Trinity and creation, Holmes argues that all things have their being by participating in the inner life (the Word) of the Father, thus reflecting him, and that the Spirit drives creatures "toward the pattern of the Son" (33). God desires creatures to be good and causes of goodness in others, patterned after and in the Son through the Spirit's impulse to return them to God. In the Incarnation, God "reconciles nature with grace" (39) and in Christ perfects these desires. In Christ, man is now "included in the life of the Trinity" (37) and an agent of revelation, reflects God perfectly, and in love sends the Spirit to return humans to God through himself. This leads to reflections on Scripture directly. "Scripture is meant to impress the interior life of the Church on each generation; put another way, it is meant to impress Christ the Head on the members of his Mystical Body" (69). This brings Holmes to the topics of inspiration and canon. In order for human texts to impress Christ on his members, to communicate the divine through human means, "God himself" must be "addressing the [End Page 393] heart of the believer" (72). He makes a case for canon by pointing to the communal nature of humans. Tradition and canon, by which truth as a common good is formulated for a society, order and inform the society regarding its purpose, history, and character. "Tradition," then, "is good for man as man" (57) even in natural society, and all the more so in the supernatural society, the Church. The "texts that embody and transmit the tradition" (63) give continuity and life to the organism that is the Church, while within that tradition these texts can function as a sort of "guide rail" and a "mirror" of its identity (67).This overall view of Scripture lends perspective to particular topics (chs. 4-12). Turning to Scripture's authorship and inspiration, Holmes emphasizes again that God means humans to be real causes of revelation as God "attaches his voice" to their writing (82, 91, and throughout). This may, in differing circumstances, involve endowing them with particular and even unusual graces, many of which God grants to others who hand on revelation (such as Augustine), but in the case of the biblical authors the ("only") difference is that God "intended" biblical texts like Luke "to sound not only Luke's voice but God's voice as well" (91). His "general account of the fact of biblical difficulties" (202), then, depicts the human "author's soul" as "like the body of an instrument, determining the overtones of everything he writes" (208). God writes the notes to be played and selects the instruments, and God "asserts what the human author asserts" (210). But the particularities of an author's soul (and upbringing, assumptions, etc.) can be seen in anything from grammatical infelicities in Paul to the author's assumptions about a geocentric solar system, the goodness of killing the Canaanites, or Qoheleth's unawareness of an afterlife. God attaches his voice to their writing, and these instruments play "only God's note" (219), but God "does not affirm or deny" the assumptions or unasserted views of the author when writing (209). One takes one’s word that p when a source vouches for p and one accepts the word of that source. If the source is reliable in this case, p is acceptable. The reliability of the source is a measure of its plausibility. If a source has the relevant competence, credibility, authority, that word is acceptable. Likewise, the word may be acceptable if accompanied by a cogent argument, but presumption may be misplaced. One may recognize a presumption for a statement when (...) such recognition is not justified, the positive version of the fallacy. One may refuse to recognize a presumption for a statement when there really is a presumption for the statement, the negative version of the fallacy. The essay proceeds to explore various dimensions of when it is justified to take a source’s word for a claim, and when it is justified to reject a claim from a source. The discussion ranges over considerations of sexism and race, cultural differences, and the relationship of presumptions to fallacies. The concept “mind” refers to the human and humanlike features of the brain. A historical review of thinking about the mind contextualizes humanity's search to understand itself by sketching biblical and philosophical perspectives from the Hebrew scriptures through the Greeks and Descartes to the German philosophers Goethe, Kant, and Hegel. These provide an enlarged context for an analytic approach to mind as focusing on the interface between physical signals and experiential symbolic expressions. Drawing on a holistic paradigm, several features are (...) discernible: empathic rationality, imaginative intentionality, meaningful memory, and adaptability. These reflect the evolutionary development of uncommitted cortex that contributes to the brain's explosive capacity for order, complexity, and novelty. In this paper, we explore the effects of certain forbidden substructure conditions on preordered sets. In particular, we characterize in terms of these conditions those preordered sets which can be represented as the supremum of a well-ordered ascending chain of lowersets whose members are constructed by means of alternating applications of disjoint union and ordinal sums with chains. These decompositions are examples of ordinal decompositions in relatively normal lattices as introduced by Snodgrass, Tsinakis, and Hart. Recoverin is a Ca2+-binding protein found primarily in vertebrate photoreceptors. The proposed physiological function of recoverin is based on the finding that recoverin inhibits light-stimulated phosphorylation of rhodopsin. Recoverin interacts with rod outer segment membranes in a Ca2+-dependent manner. This interaction requires N-terminal acylation of recoverin. Four types of fatty acids have been detected on the N-terminus of recoverin, but the functional significance of this heterogeneous acylation is not yet clear.
