Philosophical hermeneutics developed by the German philosopher Hans-Georg Gadamer and founded on interpretation as explicit form of comprehension generated a debate on contemporary hermeneutics about texts written at different periods of time from those in which they must then be applied. This debate is necessarily very instructive for the jurist when he interprets texts and creates positive law to produce a determined effect on recipients. Comprehension as participation in truth involves questioning and an interpretation devoid of prejudices. Illustration of hermeneutics (...) in law demonstrates that interpretation related to comprehension is strictly bound to the question of application bearing in mind that application does not only consist in concretizing comprehension, it constitutes his nucleus. It follows that hermeneutics oscillates between a theoretical and practical meaning. Regarding the concept of a presumption it is perceived as an instrumental necessity and a necessary corollary of interpretation in that it anticipates on the meaning found on the possibility. It is specified in a context of legal hermeneutics that it is necessary to distinguish the interpretation of the observer from the one of the player such the judge put in the performative position. The argument of this Article is based on positivist postulates defining law as the union of primary rules and secondary rules. Taking the presence of rules of change to be decisive for the appearance of legal orders, the author first looks for their origins in the Western world. Romans were the first, in the Western world, to develop a legal system with a clear rule of change, the possibility of a new statute abrogating an old one. This Western concept of (...) law has been exported by Western colonialism to America, Asia, and Africa, transforming social rules into laws thanks to the use of a Roman frame. While Jewish, Chinese and Islamic legal systems also fit this definition, their rules of change were not identical to the Roman ones. However, these other systems were not as successful as Roman law, which was linked historically with imperialism and colonialism. (shrink)

In this paper I argue that the rationality of law and legal decision making would be enhanced by a systematic attempt to recognize and respond to the implications of empirical uncertainty for policy making and decision making. Admission of uncertainty about the accuracy of facts and the validity of assumptions relied on to make inferences of fact is commonly avoided in law because it raises the spectre of paralysis of the capacity to decide issues authoritatively. The roots of this short-sighted (...) view are found in primitive mechanical models of relationships in the empirical and social world – those of objective causality and determinism. Insofar as it is believed that if we had sufficient data a clear and unequivocal answer would be available to each question, admission of uncertainty is seen as a sign of insufficiency, incompetence, impotence, and is avoided whenever a decision that must be seen to be based on valid reasons, cannot be avoided. Avoidance of some decisions, duplicity in others, is the result. -/- Decision-making must be restructured to recognize the provisional and context-bound validity and relevance of the models we use to conceptualize and order our understanding of phenomena, and to utilize this awareness as an instrument in the production of legal policies and decisions that will be authoritative precisely because they are honestly accurate and socially responsible. The paper makes a start on such a re-structuring of the legal process by exploring the implications of the observation that if law is to be “just”: 1) legal policy must be based on accurate information and rationally related to social goals; and 2) decisions applying policy to individual fact situations must be based on assumptions that are both relevant and accurate. -/- Reasons for determinations of fact must be given, otherwise the presumption that the trier of fact is “reasonable” is an unconditional licence to use private modes of logic and theories of social and natural science. What is not disclosed cannot be challenged on grounds of invalidity or irrelevance. -/- Use of “objective validity” as a standard to evaluate conclusions made by the trier of fact in contentious cases would only serve to beg all important questions by concealing: 1) fundamental normative conflict, and 2) the limited nature and applicability of many validity claims. -/- Our use of the phrases “undue risk,” “public interest,” “reasonable,” and “necessary,” reflects the weight we choose to give conflicting social values and goals when we must make decisions in relative ignorance of all the consequences. “Objective criteria” are of limited utility in legal decision-making because their social meaning is derivative. Policy generation in the absence of any coherent conceptual-normative framework, use of vague terminology in legislation stating policy, and the absence of rational means to distinguish between individual cases to which decision-makers are required by law to apply policy, make it inevitable that many legal “decisions” made in the guise of determinations of objective fact, are charades, an arbitrary, capricious, intuitive, subjective (and thus private) use of public decision-making power. -/- Law must alter its aspirations and recognize that rational decision-making is a process that can occur only within parameters set by present knowledge and societal preference structures. Only by working with the constraints imposed by these parameters is it possible to achieve “just” decisions. Where no rational basis for differentiating cases exists, “individualized justice” must be avoided and public policy articulated in law applied uniformly to all cases in a class. The terms “reasonable” and “necessary,” used to describe policy and its consequences for specific cases, must be understood to represent provisional societal assessments, attempts to implement societal preference structures in the face of limited knowledge. Juris-Data is one of the largest case-study base in France. The case studies are indexed by legal classification elaborated by the Juris-Data Group. Knowledge engineering was used to design an intelligent interface for information retrieval based on this classification. The aim of the system is to help users find the case-study which is the most relevant to their own.The approach is potentially very useful, but for standardising it for other legal document bases it is necessary to extract a legal classification (...) of the primary documents. Thus, a methodology for the construction of these classifications was designed together with a framework for index construction. The project led to the implementation of a Legal Case Studies Engineering Framework based on the accumulated experimentation and the methodologies designed. This book presents an analysis of global legal history in Modern times, questioning the effect of political revolutions since the 17th century on the legal field. Readers will discover a non-linear approach to legal history as this work investigates the ways in which law is created. These chapters look at factors in legal revolution such as the role of agents, the policy of applying and publicising legal norms, codification and the orientations of legal writing, and there is a focus on (...) the publicization of law. The author uses Herbert Hart's schemes to conceive law as a human artefact or convention, being the union between primary rules of obligations and secondary rules conferring powers. Here we learn about those secondary rules and the legal construction of the Modern state, and we question the extent to which codification and law reporting were likely to revolutionize the legal field. These chapters examine the hypothesis of a legal revolution that could have concerned many countries in modern times. To begin with, the book considers the legal aspect of the construction of Modern States in the 17th and 18th centuries. It goes on to examine the consequences of the codification movement as a legal revolution before looking at the so-called "constitutional" revolution, linked with the extension of judicial review in many countries after World War II. Finally, the book enquires into the construction of an EU legal order and international law. In each of these chapters, the author measures the scope of the change, how the secondary rules are concerned, the role of the professional lawyers and what are the characters of the new configuration of the legal field. This book provokes new debates in legal philosophy about the rule of change and will be of particular interest to researchers in the fields of law, theories of law, legal history, philosophy of law and historians more broadly. In this introductory note I shall meTely outline how the notion of the truth conveyed by faith soon,after it was established in the New Testament, developed a synthesis with Greek philosophy, at first Platonic, later Aristotelian. (...) In the nominalist crisis this synthesis broke down and two modes of " religious truth " emerged: one within faith with relatively little support from reason, and one of faith within a philosophy henceforth detaiched from theology. Since the nineteenth century we notice that philosophy and theology are moving towards a rapprochement while maintaining their relative aiutonomy. Philosophy appears more inclined to accept religious truth on its own terms without reducing it to an unsuccessful formulation of truth as defined in modern philosophy from Descartes to Kant. Theology, from its side, has increasingly stressed the unique experience implied in faith itself, thus allowing philosophy to include it in its own, general reflection on experience. In a more comprehensive study, to appear in a collective work edited by Daniel Guerriere, I intend to review actual and possible overtures in recent philosophical theories of truth which would rendeT such a rappmchement fruitful. First a word about the biblical context in which the New Testament idea emerged. The earliest articulation of truth in the Bible basically consists in a relation of faithfulness (emet) or :firmness-1a moral quality. Not surprisingly, truth also appears as a correspondence between word and fact-a relation that even to the uncritical mind appears problematic from the start. Thus in Prov1 erbs rn, 17 we read: " He who utters the truth affirms that which will stand; but a lying witness that 499 500 LOUIS DUPRE which will bring dis1a.ppointment." 1 But the more fundamental truth consists in God's steadfastness toward his people and in their participation in it by fidelity to a divinely revealed law.2 In some of the Psalms (such as Ps. 119) the correlation between the law and truth appears particulady clear: the law reveals to us God's fidelity (His truth) and its observance enables us to share in that 3 With the idea that truth requires entrusting one-self to a higher authority, a cognitive quality joins the moml one. We remain in the truth to the extent that we heed the revelation of God's truthfulness as expressed in His commands, and that our deeds, values and attitudes correspond to that divine disclosure. The idea of correspondence, then, which came to dominate the later cognitive discussion started out as a morral-practical one. The same could be said about the idea of coherence. Trust in God's providence and obedience in the Covenant unite all aspects of communal and individual exfatence. The sapiential literature in particular stresses the harmony of a life guided the law. In theory, a quorum of registered voters in a small municipality meets annually to decide local public policy. In fact, special interests and the town bureaucracy control the meeting.Like a town meeting, a commission (or committee or council) comes into being, whether on an ad hoc or permanent basis, to (...) direct a government function. Bioethics commissions specialize in one area: the intersection of public policy with developments, either real or anticipated, in the basic and applied sciences.That specialization of commissions carries over into the selection of the members. More often than not commission members are appointed on the basis of expertise in a specific area. Although some commissions are still made up entirely of one kind of expert, usually medical, the majority of these government bodies seek breadth between the fields of law, religion, ethics, and science (including medicine and the social sciences).In the words of Mrs. Rigenbach, the law clerk to Chief Judge Carl B. Rubin of the United States District Court for the Southern District of Ohio, selection of persons “knowledgeable in the field” constitutes a “blue, blue ribbon” jury. Mechanistic models are built using knowledge as the primary information source, with well-established biological and physical laws determining the causal relationships within the model. Once the causal structure of the model is determined, parameters must be defined in order to accurately reproduce relevant data. Determining parameters and their values is particularly challenging in the case of models of pathophysiology, for which data for calibration is sparse. Multiple data sources might be required, and data may not be in a uniform or (...) desirable format. We describe a calibration strategy to address the challenges of scarcity and heterogeneity of calibration data. Our strategy focuses on parameters whose initial values cannot be easily derived from the literature, and our goal is to determine the values of these parameters via calibration with constraints set by relevant data. When combined with a covariance matrix adaptation evolution strategy, this step-by-step approach can be applied to a wide range of biological models. We describe a stepwise, integrative and iterative approach to multiscale mechanistic model calibration, and provide an example of calibrating a pathophysiological lung adenocarcinoma model. Using the approach described here we illustrate the successful calibration of a complex knowledge-based mechanistic model using only the limited heterogeneous datasets publicly available in the literature. For much of the Wrst half of the twentieth century Gilbert Murray was a leading Wgure (...) in British academia, in British theatre, on the British and American lecture circuits and even in British politics. He was admired by the community of scholars as Regius Professor of Greek at Oxford, the most prestigious position in classical scholarship in the English-speaking world. He was also esteemed by a wider reading public as the champion of a magisterial liberalism rooted in classical Greek culture. Finally he was respected by the world at large as a liberal activist who, during World War 1, wrote well-argued pamphlets in support of the war and who later became co-chairman of the League of Nations Union, an organization that in the ’20s and ’30s attracted 400,000 members. Among his companions were George Bernard Shaw and Bertrand Russell, both of whom remained his friends for life. As chief editor of the Home University Library he commissioned Russell’s The Problems of Philosophyz, which is still unsurpassed as an introduction to this subject. Today he is forgotten. Younger classical scholars would endorse the statement by Fowler (quoted in this volume): “in spite of his great fame when he was alive, he might never have written, so far as most scholars are concerned today” (p. 58). His role as the public intellectual who connected modern liberalism with Hellenism has been taken over by the followers of Leo Strauss who view this connection rather diTerently than Murray did. As for his liberal activism, when he died in 1957 Murray was regarded aTectionately as a noble ghost of Victorian liberalism past, whose passionate advocacy of the League of Nations was seen as well meaning and futile as the organization he had championed. In the ’60s and ’70s his words and deeds were swept away in the tides of anti-liberal fervour that inspired the newly emerging leftist revolutionaries and neo-conservatives. At Wrst perusal Gilbert Murray Reassessed zhas the format of festschrifts and other scholarly reviews of the accomplishments of a particular writer. But this volume is more than a summing up of Murray’s contributions to scholarship. The book could have been entitled Gilbert Murray Retrieved for Our Timesz: a contribution to the struggle to Wnd a liberalism that addresses the anti-liberal, anti-intellectual forces that threaten us today. In this spirit the volume is dedicated to those who died in the London terrorist attack of July 2005. The volume opens with two sets of memoirs, one by Murray’s grandchildren Ann Pauladan and Alexander Murray, the other Francis West’s account of Murray ’s reXections on an Australian childhood. The memoirs of his grandchildren, aTectionate and charming, seem less interested in refashioning Gilbert Murray for our time. They still portray Murray as one who inhabited a world that is no more, the proponent of a liberalism that was naively optimistic and top heavy with reason at the expense of the emotions. Murray’s optimism is evident in their anecdote about an encounter between Murray and Sir Edward Grey, during a summer walk in 1914. Murray opened the conversation by scoUng at rumours of impending war in Europe, for him impossible between civilized powers. This paper will begin with a brief account of the mandate and description of the Law Reform Commission of Canada and its Protection of Life Project, secondly, point to a limitation imposed upon it by the nature of health law in Canada and, thirdly propose some basic questions which such commissions have both the luxury and the duty to wrestle with and resolve. Sur ce constat, il faudra donc mesurer ce que cette méthode peut apporter au portait historique de Jésus qui a été l’objectif de la longue histoire des quêtes du Jésus historique. Situé ainsi dans les débats sur le Jésus historique, le travail de Meier conduit à la (...) question théologique des rapports qui existent entre la vérité de la foi et les méthodes exégétiques, entre la vérité théologique et l’histoire. Il s’agira finalement de se demander, sur la base des travaux de Meier, de quel « Jésus » la théologie chrétienne a besoin pour être vraiment chrétienne.Meier’s plea in favor of a coherent method in historico-critical exegesis of the New Testament leads him to attribute an historical authenticity to evangelical texts that other exegesists consider as theological re-readings of the Early Church. On the basis of this assessment, we have to evaluate what this method may contribute to the historical portrait of Jesus which has been the goal of the many different quests for the historical Jesus. Once Meier’s work has been situated in the context of the debates on the historical Jesus, it leads to the theological question of the relationships that exist between the truth of faith and exegetical methods, between theological truth and history. Inλ-calculus, the strategy of leftmost reduction (“call-by-name”) is known to have good mathematical properties; in particular, it always terminates when applied to a normalizable term. On the other hand, with this strategy, the argument of a function is re-evaluated at each time it is used.To avoid this drawback, we define the notion of “storage operator”, for each data type. IfT is a storage operator for integers, for example, let us replace the evaluation, by leftmost reduction, ofϕτ (whereτ is an integer, (...) andϕ anyλ-term) by the evaluation oftτϕ. Then, this computation is the same as the following: first computeτ up to some reduced formτ 0, and then applyϕ toτ 0. So, we have simulated “call-by-value” evaluation within the strategy of leftmost reduction.The main theorem of the paper (Corollary of Theorem 4.1) shows that, in a second orderλ-calculus, using Gödel's translation of classical intuitionistic logic, we can find a very simple type (or specification) for storage operators. Aristotle’s Prior Analytics identifies deductions simpliciter with inferential necessity, so that a deduced conclusion is necessarily inferred from some premises. Modern logical reconstructions claim that inferential necessity in Aristotle corresponds to logical validity. However, this logical reconstruction fails on two accounts. First, logical validity does not highlight Aristotle’s distinction between inferential necessity and predicative necessity, meaning that the inferential necessity of a deduction is not of the same kind as the predicative necessity of a non‑deductive argument. Second, logical validity does (...) not explain the relevance of Aristotle’s distinction between complete and incomplete deductions. Logicians speak of complete deduction by adding the term “obvious” or “transparent” to logical validity, and then criticize Aristotle’s view for being unclear. However, Aristotle’s position is not confronted with this difficulty. There is nothing to add to inferential necessity, which already means complete deducibility, as opposed to incomplete deducibility, deemed to be potentially complete. Accordingly, the Prior Analytics reduces the incomplete deductions to the complete deductions in order to prove the potential, inferential necessity of the incomplete deductions. Logical validity would have been faithful to Aristotle’s text, if it had been possible to coin a notion of potential validity, distinct from both validity and invalidity. (shrink)

This paper shows that Aristotle's De Interpretatione does not separate syntax from semantics. Linguistic sentences are not syntactic entities, and non-linguistic meanings are not semantic propositions expressed by linguistic sentences. In fact, Aristotle resorts to a mental conception of meaning, distinguishing linguistic meanings in a given language from non-linguistic mental contents in relation to actual things: while the former are not the same for all, the latter are shared by everyone. Aristotle is not a modern logician, like Boole, Frege, or (...) Russell, in so far as a mental conception of meaning does not reveal an abstract semantics for a syntactic language. (shrink)

Introduction. Il est bien connu que la correspondance de Curry-Howard permet d'associer un programme, sous la forme d'un λ-terme, à toute preuve intuitionniste, formalisée dans le calcul des prédicats du second ordre. Cette correspondance a été étendue, assez récemment, à la logique classique moyennant une extension convenable du λ-calcul. Chaque théorème formalisé en logique du second ordre correspond donc à une spécification de programme.Il se pose alors le problème, en général tout à fait non trivial, de trouver la spécification associée (...) à un théorème donné; autrement dit, de déterminer le comportement opérationnel commun aux λ-termes associés aux diverses démonstrations formelles du théorème considéré.Cette question est résolue ici pour le théorème de complétude de la logique classique.La première étape consiste à formaliser convenablement ce théorème en logique du second ordre. Ce travail est fait complètement dans la section 1. Il a comme sous-produit, peut-être inattendu, de montrer que ce théorème est prouvable en logique intuitionniste du second ordre. Ceci, toutefois, à condition d'introduire une légère variante de la notion de modèle, en admettant un modèle supplémentaire trivial, où toute formule est satisfaite.On notera, à ce sujet, que des preuves intuitionnistes du théorème de complétude de la logique intuitionniste, utilisant des variantes de la notion de modele de Kripke, ont été données par H. Friedman [7] et W. Veldman [8]. On remarquera également qu'un argument de G. Kreisel [2] montre que le théorème de complétude habituel de la logique intuitionniste n'a pas de preuve intuitionniste. We describe here a simple method in order to obtain programs from proofs in second-order classical logic. Then we extend to classical logic the results about storage operators proved by Krivine for intuitionistic logic. This work generalizes previous results of Parigot.

Les concepts de systéme physique, de mesure, de prévision, sont d’abord précisés. Ils conduisent à faire intervenir un observateur, d’où une « physique du solitaire ». Pour parvenir à une «physique collective », il faut admettre en outre un « principe des signaux » qui établit une solidarité entre les observateurs. Le résultat de cette étude est qu’à l’echelle atomique les notions classiques perdent toute signification, même les notions d’espace et de temps qui n’ont qu’un caractère statistique. It represents an additional intelligence, which in any case can replace the strategic and logic creative insight of the medicinal chemist who remains the architect and molecule master designer. In terms of drug design, artificial intelligency, deep learning machines, and other revolutionary technologies will match with the medicinal chemist’s natural intelligency, but for sure never go beyond. This article, corresponding to a part of the restitution of a financed international research project between France, Brazil, Canada, Italy and Belgium, aims to offer a modelisation and qualitative evaluation of mediation care settings based on an original methodological tool that involves identifying the typical games at the foundations of creativity, following a multidisciplinary perspective. Therapeutic mediations are settings or devices organised around a “pliable medium”, often artistic, like painting, modeling, writing, ​and theatre, which are very widespread in institutional (...) practices, both in France and abroad. The scientific objectives of this research consist in a multi-disciplinary exploration (anthropology, criminology, neuroscience, clinical psychology) of the process of creative symbolisation understood as a process of transformation involving play. According to this orientation, play can be defined as a psychic process whereby a subjective experience can be explored with pleasure, and consequently symbolised and appropriated. Our fundamental and original hypothesis is that play is at the source of the creative process, conceived as a work of metabolisation by the psyche of playful experiences during the different stages of life. The review of the understanding of play in psychoanalysis, anthropology, criminology and neuroscience emphasises the richness of this model and the importance of reflecting on the typical games in the field of psychic care. A clinical example of treatment in a pictorial therapeutic mediation setting of a child with psychotic disorders makes it possible to identify a number of typical games as well as the modalities of interpretation of the therapists through play. These multidisciplinary studies lead to the presentation of a general table of typical games, and these first results highlight the richness of identifying typical games in clinical settings. Ultimately, the multidisciplinary approach shows the interest of the model of play in the evaluation of therapeutic mediation settings, with a convergence of the different disciplines emphasising the pertinence of this model. The scientific impact of this research overlaps with its societal impact, through the development of innovative tools for evaluating therapeutic mediations, in order to take account of the evolution of the different forms of social expression of psychic suffering. Research on teachers’ professional identity integrates many constructs that are treated independently in most cases. This study described the associations between components of teacher professional identity and their association with teachers’ general pedagogical beliefs. Secondary teachers completed a survey about several components of their identity and general pedagogical beliefs. Multidimensional scaling revealed that the components could be mapped on two dimensions: form of motivation and degree of subject specificity. The resulting map revealed four meaningful groups of components. The relation between morality and rationality (in the sense of rational choice and rational behaviour) is a prominent theme in (the tradition of) moral philosophy. D. Gauthier’s account of this relation is an extraordinarily impressive one. He attempts to demonstrate a general coincidence (at different levels) between rationality and morality. His approach is discussed in what follows, and it will be shown that most of his ‘coincidence claims’ are exaggerated.

The biological function of human reasoning abilities cannot be to improve shared knowledge. This is at best a side effect. A more plausible function of argumentation, and thus of reasoning, is to advertise one's ability to detect lies and errors. Such selfish behavior is closer to what we should expect from a naturally selected competence.

Cet article prend d’abord appui sur différents exemples de phénomènes qui semblent susceptibles d’être qualifiés de « langue de bois » pour tenter de caractériser cette notion, qu’il oppose à celle de « parler vrai ». Il montre ensuite que la langue de bois comporte beaucoup de traits communs avec la stéréotypie, dont elle apparaît comme une spécification : la « langue de bois », ce serait des stéréotypes d’un langage spécialisé ou de la parole publique qui permettraient au locuteur (...) de ne pas s’exposer ou se compromettre. Bien que son usage soit essentiel à la construction de l’éthos du locuteur, cette langue est affublée d’une connotation fondamentalement négative : on ne la nomme que pour la stigmatiser, pour dénoncer un manque de clarté ou de transparence. Pourtant, comme la stéréotypie dont elle partage en partie les usages et les fonctions, la langue de bois est susceptible d’une diversité de modes d’énonciation et de réception, qui dépassent de loin la seule négativité.This article takes a variety of examples of usage that could be described as « doublespeak » in an attempt to characterise the meaning of the term, which we contrast with what is known as « straight talk ». We then show that « doublespeak » has many traits in common with stereotyping, of which it appears to be a specific form: « doublespeak » is a stereotype of a form of specialised or public-speaking language that enables the speaker to avoid exposure or discredit. Although its use is essential to the ethos the speaker is attempting to convey, it has fundamentally negative connotations: it is referred to only to stigmatise and denounce its lack of clarity and transparency. And yet, like stereotyping with which it shares a number of uses and functions, doublespeak can be delivered and received in a variety of ways that are by no means confined to the negative register.
