Around the world, unhealthy diets are a leading cause of disease. Shifting population diets in a healthier direction will require downstream policy interventions. This means changing the composition of the processed food supply, particularly reducing salt, sugar and fat. Mandatory nutrient limits imposed by government are one way of achieving this. However, they have been criticized as a particularly intrusive regulatory option, interfering with both free markets and free choices. At the same time, voluntary industry reformulation has become an intervention (...) favoured by national governments, the World Health Organization and the food industry. This article uses a comparison of the two interventions—which share a common public health goal, albeit achieved through different regulatory means—as a basis to evaluate the ethical charges against mandatory nutrient limits. It makes three main findings: that both affect free dietary choice in very similar ways; that dominant public health ethics frameworks are not well equipped to compare mandatory and voluntary forms of regulation; and that food governance is inherently multisectoral, involving markets, governments and the public. Taking these findings into account, the article calls for a more nuanced ethical evaluation of food reformulation policies. (shrink)

The Lancet–O’Neill Institute/Georgetown University Commission on Global Health and Law published its report on the Legal Determinants of Health in 2019. The term ‘legal determinants of health’ draws attention to the power of law to influence upstream social and economic influences on population health. In this article, we introduce the Commission, including its background and rationale, set out its methodology, summarize its key findings and recommendations and reflect on its impact since publication. We also look to the future, making suggestions (...) as to how the global health community can make the best use of the Commission’s momentum in relation to using law and legal tools to advance population health. In the UK, the Recommended Summary Plan for Emergency Care and Treatment (ReSPECT) is a widely used process, designed to facilitate shared decision-making between a clinician and a patient or, if the patient lacks capacity to participate in the conversation, a person close to the patient. A key outcome of the ReSPECT process is a set of recommendations, recorded on the patient-held ReSPECT form, that reflect the conversation. In an emergency, these recommendations are intended to inform clinical decision-making, and thereby (...) enable the attending clinician—usually a general practitioner (GP) or paramedic—to act in the patient’s best interests. This study is the first to explore the extent to which ReSPECT recommendations realise their goal of informing best interests decision-making in community contexts. Using a modified framework analysis approach, we triangulate interviews with patients and their relatives, GPs and nurses and care home staff. Our findings show that inconsistent practices around recording patient wishes, diverging interpretations of the meaning and authority of recommendations and different situational contexts may affect the interpretation and enactment of ReSPECT recommendations. Enacting ReSPECT recommendations in an emergency can be fraught with complexity, particularly when attending clinicians need to interpret recommendations that did not anticipate the current emergency. This may lead to decision-making that compromises the patient’s best interests. We suggest that recording patients’ values and preferences in greater detail on ReSPECT forms may help overcome this challenge, in providing attending clinicians with richer contextual information through which to interpret treatment recommendations. Supererogatory actions must go beyond duty not only by being optional, but also by being good to do. Understanding the evaluative condition that supererogatory actions must meet is vital in order to understand the very concept of supererogation. I argue for two key features of the goodness of supererogatory actions: firstly, that they are comparative, and secondly, that they are relative. Specifically, I argue that an action meets the evaluative condition of supererogation if and only if it is (i) better (...) than some permissible alternative and (ii) better than (or at least as good as) all permissible alternatives that are (a) as costly or (b) less costly; where the sense in which it is better is relative to a particular beneficiary. Seeing why this is so reveals the complexity of our notion of the supererogatory and captures our intuitions on core and complex cases. Furthermore, it makes room for supererogation’s mirror: the suberogatory. (shrink)

Braun explores the use of digital twin technology in medicine with a particular emphasis on the question of how such simulations can represent a person.1 In defining some first conditions for ethically justifiable forms of representation of digital twins, he argues that digital twins do not threaten an embodied person, as long as that person retains control over their simulated representation via dynamic consent, and ideally with the option to choose both form and usage of the simulation. His thoughtful elaboration (...) provides insight into the challenges inherent in interactions between a person and their digital twin, emphasising the modes of control required to respect personal modes of freedom. This individual-centric approach to the question of representation leaves out the important ethical consideration of ensuring that all, not merely some, can be represented. Braun describes dynamic consent as a necessary mode of control, arguing that where a person is unable to give consent, ‘such simulations threaten to become illegitimate representations. They would then shift the kind of interaction from representation to illegitimate forms of prediction or surveillance and thereby could lead to infringements to individual modes of freedom.’ Consequently, the implementation of digital twin technology in healthcare would seem to exclude the most vulnerable members of society from participation in and benefiting from medical innovation, …. Emrah Atasoy, a prolific author who reviewed Turkish speculative fiction in a well-received 2021 (...) Utopian Studies article, is modeling a search for hope in dystopian texts. In this book, derived from his dissertation, he examines three British novels written in three different eras of the twentieth century: Katherine Burdekin's Swastika Night (1937), Anthony Burgess's The Wanting Seed (1962), and P. D. James's The Children of Men (1992). In each novel, Atasoy argues, the protagonists move from an ignorance that served the interest of the dystopian forces to a resistant knowledge that should be read as offering hope, both as resistance and as knowledge.The book is organized in a straightforward way, with an introduction, conclusion, and then three analytical chapters, one for each of the novels. The introduction is expansive, offering both brief surveys of the nature of utopia and dystopia and a recounting of a number of themes taken up by dystopian texts: education, politics, gender roles, family life, and more. Layered onto this is a discussion of theorizing around knowledge and power and the transition from ignorance to understanding. The chapters focused on the individual novels are all similarly expansive. Atasoy offers biographical information about the authors along with considerations of the primary social and political events to which the authors might be responding. The analyses of the novels focus primarily on the motivations of the protagonists, but interspersed in the plot summaries are narrative cul-de-sacs explaining particular textual details (for example, the discussion of Theo's choice of the Greek statue of Diadoumenos as allocation to leave a note for the Warden [James, 37]). These [End Page 519] little detours are often interesting but can be distracting from the primary analytic focus.The analyses themselves also cover a lot of territory. The middle section of the chapter on The Children of Men (118–34) includes discussions of power, eugenics, religion, sexuality, punishment, assisted suicide, and immigration. Each of these is used to elucidate modes of social and political control wielded by the Warden, but the sheer number of issues included in the fast-moving analysis left me wanting more. Atasoy's analysis of Quietus nicely captures the ways in which James has created a world where the elderly are both encouraged and manipulated to end their lives for the good of the whole. This discussion fits especially well with the larger focus of his analysis on modes of social engineering. Fewer themes and more close readings like this one would have deepened the reading experience. But for anyone beginning a project on one of these novels, this book is a good place to start.This book begins and ends with the interesting contention that times of catastrophe diminish the literary production of utopia, and potentially the capacity for hope itself. While the point of this book is not to defend this claim empirically, it is one worth considering for any scholar of utopia, or any person interested in the potential of future change for the better. The book may underplay the fact of twentieth-century literary utopias (there is a brief discussion of the feminist utopias written in the 1970s and 1980s), but it is surely correct that there is an imbalance in the production of utopia in favor of dystopia. Utopias are more challenging to construct and potentially (especially in this day and time) less formulaic than dystopia, which is an increasingly popular (and marketable) genre.Kim Stanley Robinson noted in a recent interview that "[utopias] shape people's conception of what's possible that could be good in the future."1 Atasoy's book offers the possibility that a close reading of dystopian texts might well help us uncover other ways of finding out what future good is possible. In the last few years, justice has emerged as a matter of concern for the contemporary constitution of technoscience. Increasingly, both practicing scientists and engineers and scholars of science and technology cite justice as an organizing theme of their work. In this essay, I consider why “science and justice” might be arising now. I then ask after the opportunities, but also the dangers, of this formation. By way of example, I explore the openings and exclusions created by the recent conjugation (...) of science and justice in the field of personal genomics. Finally, I conclude with reflections on what other forms “science and justice” might take, and what might be gained or lost in fostering them. (shrink)

Visual artists and scientists frequently employ the labour of assistants and technicians, however these workers generally receive little recognition for their contribution to the production of artistic and scientific work. They are effectively “invisible”. This invisible status however, comes at the cost of a better understanding of artistic and scientific work, and improvements in artistic and scientific practice. To enhance understanding of artistic and scientific work, and these practices more broadly, it is vital to discern the nature of an assistant (...) or technician’s contribution to the production of a work, which is difficult as it is uncommon to discuss these workers. To address this, I investigate how different kinds of parallel working arrangements in collective artistic and scientific practices affect the creative potential of individuals involved. Different working arrangements permit different degrees of autonomy for individuals involved in these practices. Significantly, a lack of autonomy precludes the opportunity to act spontaneously and so exercise, what I term, “creative agency”. Evaluating the contribution of an assistant or technician based on the degree of autonomy that they are granted in the production of a work is an approach that I show can be used to precisely determine the nature of their contribution to the production of a work and accordingly, what kind of recognition an agent should receive for this. Importantly, this approach has the advantage of explaining the artistic and epistemic significance of different kinds of contribution to the production of artistic and scientific work. (shrink)

Thomas Reid (1710-1796), comme on sait, réfute toute réduction des opérations mentales à la perception de quelque chose de mental (une image ou une idée par exemple). Ainsi il s’oppose au modèle perceptif des opérations mentales. Mais, pour sa part, comment pense-t-il les opérations mentales? Parce qu’il identifie la conception, que toute opération intellectuelle implique, à l’acte de concevoir, nous pouvons nous demander s’il pense que le pouvoir de l’esprit est celui d’un agent et si, selon lui, les opérations créent (...) l’évidence ou produisent leurs objets. Contre une telle interprétation, cet article établit dans un premier temps en quel sens les opérations mentales peuvent être considérées comme des actions de l’esprit. Dans un second temps, on examine le sens dans lequel elles sont dites avoir un objet. Ces deux points soulignent l’aversion de Reid pour le subjectivisme et expliquent son opposition au modèle perceptif. Le dernier temps de l’article distingue deux cibles : un modèle optique et un modèle tactile (d’où un modèle sentimentaliste fut dérivé). En prêtant attention à leurs motifs scientifiques et philosophiques, Reid se permet d’expliquer leur lien généalogique et de comprendre qu’ils ouvrent la voie à différentes sortes de scepticisme. Given his known predilection for ontological parsimony, Ockham’s ontology of artifacts is unsurprisingly reductionist: artifacts are nothing over and above their existing and appropriately ordered parts. However, the case of artifacts is notable in that they are real objects that human artisans produce by bringing about a real change: they spatially rearrange existing natural thing(s) or their parts for the sake of some end. This article argues that the human contribution to the nature and production of artifacts is two-fold: (1) (...) the artisan’s cognitive grasp of her expertise and her decision to deploy that expertise are the two efficient causes necessary to explain the existence of an artifact, and (2) the purpose that the artisan had in mind when she decided to make an artifact fixes the function(s) of the artifact such that an artisan’s purpose is the final cause necessary to explain what an artifact is. Artifacts indeed exist, owing what they are and that they are to intelligent and volitional human activity, which Ockham never denies. The article submits that a myopic focus on Ockham’s indisputable reductionism does not exhaust what is metaphysically interesting and relevant about artifacts. (shrink)

Two experiments examined similarities and differences in the effects of consciously and unconsciously perceived rewards on the active maintenance of goal-relevant information. Participants could gain high and low monetary rewards for performance on a word span task. The reward value was presented supraliminally or subliminally at different stages during the task. In Experiment 1, rewards were presented before participants processed the target words. Enhanced performance was found in response to higher rewards, regardless whether they were presented supraliminally or subliminally. In (...) Experiment 2, rewards were presented after participants processed the target words, i.e., during maintenance. Performance increased in response to relatively high rewards when they were presented subliminally, but decreased when they were presented supraliminally. We conclude that both consciously and unconsciously perceived rewards boost resources supporting the maintenance of task-relevant information. Conscious processing of rewards can, however, heavily interfere with an ongoing maintenance process and impair performance. (shrink)

Student satisfaction measures serve to provide a measure of ‘quality’ in the current audit culture of universities. This paper argues that the form of satisfaction valued within contemporary Higher Education amounts to a form of settling, where the primary aim is to settle the students’ expectations, and meet their needs. Drawing initially on the etymology of ‘satisfaction’, the paper then turns to the work of Martin Heidegger and his notion of the ‘uncanny’, to discuss how we are ontologically unsettled. The (...) uncanny will be discussed in relation to the Greek play Antigone, and illustrated with examples from the novel Stoner. In provoking angst or anxiety by leaving students ‘unsettled’ in terms of their thinking, this may open students up to a consideration of more ontological concerns – within their Higher Education but also in their lives more generally. It is well-documented that the alteration of portrait photographs can have a negative impact on a viewer’s self-esteem. One might think that providing written disclaimers warning of alteration might help to mitigate this effect, yet empirical studies have shown that viewers continue to feel like what they are seeing is real, and thus attainable, despite knowing it is not. I propose that this cognitive dissonance occurs because disclaimers fail to show viewers how to look at the contents of a photographic (...) image differently. Consequently, viewers have the same perceptual experience, where the picture appears to faithfully resemble a direct visual experience of the subject, which conflicts with their changing sense of warrant. However, I argue that the degree of perceived similarity, and so contact, may be subject to change depending on what a viewer is attentive to during their viewing of an image, including subtle but unrealistic signs of alteration. The paper discusses the publications of the Royal Swedish Academy of Sciences (RSAS) as part of a wider network of publication exchange, linking learned societies, libraries, and archives. The periodicals of the RSAS went through several reorganisations between 1813 and 1903, all to some extent related to their role in publication exchange. Although subject to many of the same deliberations of commercial value and institutional prestige as the expanding book trade, publication exchange offered a means of communication for institutions with (...) widely differing financial, linguistic and scientific status, and a forum for articulating a wide range of values significant in scientific publication. In the context of publication exchange, the roles of producers and consumers, and of publishers and repositories of scientific knowledge overlap, and librarians emerge alongside editors as central actors in scientific communication. Scientific editorship should be viewed not only as a means of disseminating scientific findings to wider audiences, but as designing a product that could be used to forge institutional connections, to acquire publications, and to build collections. The case of the RSAS periodicals highlights the importance of publication, not only for the distribution of scientific knowledge, but for its acquisition. (shrink)

This article presents an interview method which enables us to bring a person, who may not even have been trained, to become aware of his or her subjective experience, and describe it with great precision. It is focused on the difficulties of becoming aware of one’s subjective experience and describing it, and on the processes used by this interview technique to overcome each of these difficulties. The article ends with a discussion of the criteria governing the validity of the descriptions (...) obtained, and then with a brief review of the functions of these descriptions. (shrink)

In the year 2000 the artist Eduardo Kac made TV news by declaring he had ordered the « creation » of a genetically modified bunny. In 2004 the artist Steve Kurtz was detained by the FBI on the suspiscion of bioterrorism, because of the laboratory equipment he uses in installations that demistify biotechnology. The contrast between an artist-publicist who lends a showy allure to biotech and an artist-researcher who critiques its effects serves as the departure point for an examination of (...) the functions of science and art in a neoliberal society. Faced with trade secrets, the privatization of knowledge and ever-tightening control of laboratories, the artist-researcher can intervene to make public the research process and the consequences of commercializing a given discovery, particularly by using installations that allow the participant to manipulate both lab equipment and scientific concepts. But to do so, the artist must also interrupt the normal functioning of the neoliberal art world, where institutions supported by private sponsorship retain exclusive rights over fetishized products, destined to feed financial speculation. The article closes with a look at the work of Brandon Ballangee, an artist-researcher working in the field of ecology. (shrink)

L’analyse d’itinéraires féminins à travers l’histoire du Comité Catholique des Intellectuels Français (CCIF) met en valeur trois profils d’intellectuelles catholiques qui cherchent à résoudre les interrogations posées à l’intelligence croyante par les derniers développements de la connaissance. La majeure partie de ces femmes forment ainsi un groupe d’expertes qui refusent de s’engager au service d’une cause politique ou sociale. Elles sont donc bien éloignées du modèle intellectuel qui prévaut alors et qu’incarne Jean-Paul Sartre.

Dans certains récits poïétiques, des artistes trouvent par hasard au sein de leur expérience perceptive une solution à un problème de réalisation artistique en un moment imprévu, en un lieu inattendu, à la suite d’un temps devenu vacant par un retard ou une circonstance involontaires. De Léonard de Vinci à l’artiste surréaliste Max Ernst, sont analysées les relations entre ces temps vacants de diverses natures psychologiques et circonstancielles avec la capacité, qui leur succède, à saisir une sollicitation imprévue pour l’intégrer (...) à leur démarche artistique. Tournure stylistique et dramatique pour mieux faire ressortir l’instant fertile sérendipien? Rhétorique de l’ironie, qui retourne la durée morne en moment d’intense création? Repos nécessaire pour mieux aiguiser l’attention qui succède? Ou plongée dans l’inconscient riche d’images, qui souffle parfois des solutions époustouflantes de justesse? Ces moments vides, quelle qu’en soit la teneur, tiennent probablement un rôle plus soutenu qu’il n’y paraît dans la temporalité de la démarche sérendipienne chez nombre d’artistes. Aussi, même s’il n’est pas question ici de sacraliser leur activité, faut-il considérer leurs temps apparemment vides, comme une chance d’une possible sérendipité artistique. (shrink)

The early withdrawal of students from healthcare education programmes, particularly nursing, is an international concern and, despite considerable investment, retention rates have remained stagnant. Here, a regional study of healthcare student retention is used as an example to frame the challenge of student attrition using a concept from policy development, wicked problem theory. This approach allows the consideration of student attrition as a complex problem derived from the interactions of many interrelated factors, avoiding the pitfalls of small‐scale interventions and over‐simplistic (...) assumptions of cause and effect. A conceptual framework is proposed to provide an approach to developing actions to reduce recurrent investment in interventions that have previously proved ineffective at large scale. We discuss how improvements could be achieved through integrated stakeholder involvement and acceptance of the wicked nature of attrition as a complex and ongoing problem. (shrink)

For the past two decades, the issue of the body and essentialism has dominated feminist theory. In general, it is assumed that the body has been devalued and repressed by the Western metaphysical tradition. In this article, I make two claims to the contrary. First, as poststructuralist theory has tirelessly demonstrated, Western thought has continually tried to ground thought in some foundational substance, such as the body. Second, the most provocative, fruitful and radical aspects of recent feminism and poststructuralism concern (...) the event of incorporeality. What makes incorporeality such an urgent issue is its tie with anti-foundationalism. If there is not a direct or proper passage between what is and what is thought, then thinking can be considered as a force or event in its own right. By disrupting the traditional philosophical series that ties thought to some grounding body, thinkers as diverse as Deleuze, Derrida, Irigaray and Foucault have opened the possibility of a theory of the incorporeal. Lack of attention to definitions of indigeneity is a problem in both political theory and practice. Defining indigeneity has at least two important consequences: it affects who has access to resources or rights reserved for Indigenous peoples; and it shapes the kinds of privileges and resources available to Indigenous peoples. In this article, I draw on Theodor Adorno’s concept of ‘nonidentity’ as a resource for exploring the power and limits of conceptions of indigeneity. I argue that recognizing the non-identical aspects (...) of indigeneity enables critical engagement with constellations of concepts that attend to the distinctive aspects of indigeneity in particular moments and locations. To illustrate my argument, I draw on one conception of indigeneity that could be characterized as non-identity thinking – a research approach called Kaupapa Māori. I suggest that non-identity is a promising resource for conceptualizing indigeneity as it has potential to respond to some of the key problems with current responses to indigeneity; notably, that universal definitions may not best represent what it means to be Indigenous, and that unreflective acceptance of current definitions fails to produce just outcomes. Du printemps 2020 à l’été 2021, j’ai accompagné Baba Fotso Toukam Junior dans l’écriture de son récit de migration depuis le Cameroun jusqu’au Pays basque ( Sur le chemin de ses rêves, éditions Dacres, 2021). Dans cet article, je reviens sur notre collaboration. J’y soutiens que sa parole invite à être traitée autrement que comme une narration informant sur son expérience migratoire. Elle est également une parole performative qui agit sur les représentations, notamment de la catégorie « migrant·e·s ».
