In Ordinatio I, 39 Scotus distinguishes two ways in which the distinction between sensus compostionis and sensus divisionis can be made: According to the first way the „composition and division“ relates to two different (sensus divisionis) or one and the same (sensus compositionis) instants of time; according to the other the distinction is made between an assertion of compossibility of the contradictory predicates in one and the same instant of time (sensus compositionis) and an assertion of actuality of the one (...) and possibility of the other of the contradictory predicates in one and the very same instant of time (sensus divisionis). The author presents a formal logical analysis of all these various senses of modal propositions and shows how Scotus strictly separated modality from temporality, and contingency from mutability. Metaphysical theories are beautiful. At the end of this book, Jiri Benovsky defends the view that metaphysical theories possess aesthetic properties and that these play a crucial role when it comes to theory evaluation and theory choice.Before we get there, the philosophical path the author proposes to follow starts with three discussions of metaphysical equivalence. Benovsky argues that there are cases of metaphysical equivalence, cases of partial metaphysical equivalence, as well as interesting cases of theories that are not equivalent. Thus, (...) claims of metaphysical equivalence can only be raised locally. The slogan is: the best way to do meta-metaphysics is to do first-level metaphysics.To do this work, Benovsky focuses on the nature of primitives and on the role they play in each of the theories involved. He emphasizes the utmost importance of primitives in the construction of metaphysical theories and in the subsequent evaluation of them.He then raises the simple but complicated question: how to make a choice between competing metaphysical theories? If two theories are equivalent, then perhaps we do not need to make a choice. But what about all the other cases of non-equivalent "equally good" theories? Benovsky uses some of the theories discussed in the first part of the book as examples and examines some traditional meta-theoretical criteria for theory choice (various kinds of simplicity, compatibility with physics, compatibility with intuitions, explanatory power, internal consistency,...) only to show that they do not allow us to make a choice.But if the standard meta-theoretical criteria cannot help us in deciding between competing non-equivalent metaphysical theories, how then shall we make that choice? This is where Benovsky argues that metaphysical theories possess aesthetic properties – grounded in non-aesthetic properties – and that these play a crucial role in theory choice and evaluation. Metaphysical theories are often counter‐intuitive. But they also often are strongly supported and motivated by intuitions. One way or another, the link between intuitions and metaphysics is a strong and important one, and there is hardly any metaphysical discussion where intuitions do not play a crucial role. In this article, I will be interested in a particular kind of such intuitions, namely those that come, at least partly, from experience. There seems to be a route from experience to metaphysics, and (...) this is the core of my interest here. In order to better understand such ‘arguments from experience’ and the kind of relationship there is between this type of intuitions and metaphysical theories, I shall examine four particular cases where a kind of experience‐based intuition seems to motivate or support a metaphysical theory. At the end of the day, I shall argue that this route is a treacherous one, and that in all of the four cases I shall concentrate on, phenomenological considerations are in fact orthogonal to the allegedly ‘corresponding’ metaphysical claims. In this book, Jiri Benovsky takes a stand for a variant of panpsychism as being the best solution available to the mind-body problem. More exactly, he defends a view that can be labelled 'dual-aspect-pan-proto-psychism'. Panpsychism claims that mentality is ubiquitous to reality, and in combination with dual-aspect monism it claims that anything, from fundamental particles to rocks, trees, and human animals, has two aspects: a physical aspect and a mental aspect. In short, the view is that the nature of reality (...) is 'phental' (physical-mental). But this does not mean, according to the author, that rocks and photons think or have conscious experiences, in the sense in which human animals have experiences. This is where pan-proto-psychism enters the picture as being a better theoretical option, where the mental aspects of fundamental particles, rocks, and trees are not experiential. Many hard questions arise here. In this book, Benovsky focuses on the combination problem: in short, how do tiny mental aspects of fundamental particles combine to yield macro-phenomenal conscious experiences, such as your complex experience when you enjoy a great gastronomic meal? What makes the question even harder is that the combination problem is not just one problem, but rather a family of various combination issues and worries. Benovsky offers a general strategy to deal with these combination problems and focuses on one in particular – namely, the worry concerning the existence of subjects of experience. Indeed, if standard panpsychism were true, we would need an explanation of how tiny micro-subjects combine into a macro-subject like a human person. And if panprotopsychism is true, it has to explain how a subject of experience can arise from proto-micro-mental aspects of reality. Benovsky shows that understanding the nature of subjectivity in terms of the growingly familiar notion of mineness in combination with a reductionist/eliminativist view of the self, allows us to have a coherent picture, where this type of combination problem is avoided, without throwing the baby out with the bathwater. The article deals with the Buddhist logic and its relation to Aristotle’s logic, in particular, to the principle of non-contradiction and the principle of exluded middle. This article focuses on theoretical reflections on sovereignty and constitutionalism in the context of the globalization and Europeanisation of the nation states, their politics, and legal systems. Starting from a critical assessment of the Kelsen-Schmitt polemic, the author claims that sovereignty needs to be analysed by the sociological method in order to disclose its current structural differentiation. The constitution of society may be imagined as the multitude of self-constituted and functionally differentiated social subsystems. The constitutional pluralism argument subsequently reconceptualizes sovereignty (...) as socially differentiated and divided between specific subsystems. The EU's differentiated constitutional domain and the paradox of divided sovereignty are used as examples of profound structural and semantic changes in contemporary national and transnational societies. While the sovereign nation-state institutions have become marginalized in political structures of European societies, the self-constitutionalization of the functionally differentiated EU legal system proceeds by internalizing the concept of divided sovereignty and using it semantically as its mode of self-reference. Pojednává o Schillerově koncepci hry jako projevu lidské svobody a Huizingově pojetí herního jednání jako zdroji lidské kultury. Je též pokusem zhodnotit typologii her R. Cailloise a posoudit přínos Finkova a Gadamerova existenciálního a kosmologického pojetí hry. K analýze těchto teoretiků přidává typ herní aktivity, kterou představuje "zahrávání si" (s někým).

Un des problèmes persistants pour la philosophie pratique est de découvrir un procédé adéquat pour justifier des lois dont la finalité est de réguler le fonctionnement des démocraties constitutionnelles. Les libéraux partisans de la raison publique nient que cette justification puisse provenir de doctrines substantielles, étant donné que les lois doivent pouvoir être justifiées par tous les citoyens (raisonnables). La tradition de la loi naturelle offre un test utile quant à la plausibilité de cette thèse. L’article montre comment les deux (...) versions du libéralisme de la raison publique diffèrent quant à leur acceptation de raisons tirées du droit naturel, et pourquoi, étant donné l’influence de leurs points de départs disparates sur les critères normatifs par lesquels elles évaluent les lois, les partisans du droit naturel ont de bonnes raisons de les rejeter toutes les deux. The claim that the having of aesthetic properties supervenes on the having of non-aesthetic properties has been widely discussed and, in various ways, defended. In this paper, I will show that even if it is sometimes true that a supervenience relation holds between aesthetic properties and the 'subvenient' non-aesthetic ones, it is not the interesting relation in the neighbourhood. As we shall see, a richer, asymmetric and irreflexive relation is required, and I shall defend the claim that the more-and-more-popular relation (...) of grounding does a much better job than supervenience. The general recognition of the existence of atoms and molecules occurred only at the beginning of the twentieth century. Many researchers contributed to this, but the ultimate proof of the molecular nature of matter that convinced even the last sceptics was the confirmation of Albert Einstein’s statistical-fluctuation theory of Brownian motion, a part of his comprehension of interdisciplinary atomism, by Jean Perrin’s experiments on colloidal gamboge particles. Einstein noticed a difference between the values of Avogadro’s constant derived from Perrin’s experiments (...) and Planck’s calculation from black-body radiation. Einstein assumed the incorrectly evaluated size of the gamboge spherules to be a culprit of the difference and asked Perrin to check the assumption with additional experiments and using the viscosity formula introduced in his own dissertation. The result was a discrepancy that neither Einstein nor Perrin settled any further. In this communication, based on the survey of developments in colloid and polymer science and their comparison with relevant experiments, an explanation of the dilemma is given that now, after more than a century, proves Einstein correct. This paper is about what counts as a photograph and what does not. One way in which this question arises stems from new technologies that keep changing our way of producing photographs, such as digital photography, which not only has now widely replaced traditional film photography but also challenges the very limits of what we count as a photograph. I shall discuss below at some length different aspects of digital photography, but also want to focus here on a new striking (...) type of photographic camera, announced in early 2012 by Lytro, Inc., namely, the so-called ?Light Field Camera?, which is said to represent a revolution in the photographic world. Indeed, unlike in the case of any previously available cameras, the photographs produced by a Light Field Camera can be re-focused after the photograph has been taken, which harbours many interesting consequences with regard to the resulting image and the way we interact with it. But of course, the initial question also arises in the case of traditional film photography as well as ?traditional? digital photography. The question amounts to asking about what the essential features of photographs are ? in short, what their nature is. (shrink)

Their recognizable structural similarity corresponds to the syntax or semantics in the analogy. The concept of analogy has subjective and objective aspects. The explanation in analogies is a dynamic transition from one concept structure to another. The possibility of analogy in the world is a statement about the disposition of the world. The possibility of analogy asserts something about the (...) behaviour of the environment. Analogy is considered as a means of explanation and a dynamic method of cognition. (shrink)

The article presents an overview concerning Heidegger's work and life, especially with respect to the contemporary state of publishing of his texts. The article aims at showing a continuity in Heidegger's Thinking of Being on one hand, but, on the other hand, stresses also necessity of a new assessment of his thought, if we take into consideration some recently published manuscripts (especially vol. 65 and 66). The necessity of a new assessment concerns also his personal standpoints during the time of (...) his rectorate in 1933-34. The new documents are presented in volume 16 (published in 2000). The author is convinced that Heidegger is a philosopher of our future. We are still waiting for a truly philosophical assessment and exploiting of his work. (shrink)

The article focuses on the problem of constitutional symbolism in functionally differentiated societies and its relevance to legal, political, and moral systems. The first part analyses differences between the three systems and their constitutional context. The second part concentrates on the moral symbolic function of modern constitutions and its temporal dimension. It shows that the “good/bad” moral code of constitutions draws on expressive symbolism and transforms it into evaluative symbolism and dogma of morality. The final part analyses the prospective character (...) of modern constitution‐making and its symbolic selectivity regarding the past. The paper concludes by emphasising the systemic pluralisation effect of constitution‐making and the impossibility of constituting systems of “pure” law, morality, and politics. (shrink)

Zatímco v případě otázek rigidity singulárních termínů panuje obecná shoda, v případě rigidity predikátů tomu tak překvapivě není. Záměrem této statě je opřít distinkci rigidní / nerigidní o jasné pojmy, jmenovitě o pojem reference v určité sémantické teorii. V důsledku toho lze podat rigorózní definici pojmu rigidního designátoru individua. Tato definice je pak přímočaře adaptovatelná pro případ pojmu rigidního designátoru třídy individuí (apod.). Tímto je dosaženo nejen obecnosti, ale i vnitřní jednoty teorie rigidity.

Studie je pokusem o zhodnocení klasického filosofického pojetí smíchu. Bergson a jeho předchůdci (Hobbes, Stendhal, Baudelaire) jej zvažovali jako výraz a způsob zakoušení nadřazenosti: smích jako výsměch. Ve srovnání s nimi Karel Kosík odkazuje k dalším antropologickým významům. V této studii se poukazuje k rozmanitosti varietních podob tohoto fenoménu a specifickým možnostem estetické distance v těchto případech.

The successful early acquisition of reading literacy represents a crucial learning process determining the further course of academic development (Stanovich, 2009). During this process, interactions between children and their proximal social environment are of utmost importance. Therefore, we introduce a systemic framework for the development of learning potential (e.g., Mudrak et al., 2015, 2019, 2019b; Ziegler & Stoeger, 2017) and explore the interactions between the social and motivational processes associated with reading literacy development in school-age children. We base our analysis (...) on a representative Czech sample of fourth-grade pupils involved in the Progress in International Reading Literacy study (PIRLS, Martin et al., 2016). On the basis of the systemic framework, we hypothesized hierarchical relationships among family socioeconomic status, related developmental resources (including parental support, expectations, and reading resources), children’s reading motivation (including reading engagement and reading confidence), and manifested learning outcomes (including school grades and reading competence). We implemented three structural equation models to test the hypothesized relationships. The first model tested the direct effect of developmental resources on reading competence. The second model included the motivational variables as mediators between resources and competence. The third model included school grades as mediators between resources and motivational variables. Our analyses indicated the good fit of the proposed models. The final model explained 37.8 % of the variance in children’s school grades and 46.5 % of the variance in reading literacy test scores (compared to 34.8 % in the first model). Moreover, parental socioeconomic status was strongly associated with parental expectations, which were associated with reading confidence, partially through the effect of parental expectations on children’s school grades. Reading confidence was the main predictor of reading literacy within the model, followed by the direct effects of parental resources. The results illustrate complex processes through which the family environment affects the development of learning competencies such as reading literacy by providing children with the relevant social and material resources associated with their motivation and school outcomes. We discuss some of the reasons that these relationships may take place and consider their implications for educational practice. (shrink)

The main aim of this study is to explain passage 35b4-37a2 of Plato’s Timaeus which deals with three main topics: the mathematization of the world’s soul, its movement, and its binding to the world’s body. First, it is argued that the mathematical structure of the world-soul allows it to participate in and be sensitive to harmony, which is essential for the correct workings of its cognitive capacities. Second, the division of the world-soul to the circle of the same and the (...) circles of the different and its self-motion comes in. This allows it to ‘touch’ and cognize the forms and the material things, as well as rule the movement of the corporeal world and care for it. In this aspect, the world-soul continues the process that started with the original creative act of the demiurge. Third, it is argued that the description of the world-soul’s binding to the world-body entails its conception as a spatially extended entity, which, in turn, explains of the possibility of an interaction between the corporeal world and its soul. Mark Siderits has raised a number of interesting issues and objections concerning the "pluralist view" of the self I put forward in "Buddhist Philosophy and the No-Self View." Pavel Materna proposed valuable explications of concept and conceptual system. After their introduction, we contrast conceptual systems with (a novel notion of) derivation systems. Derivation systems differ from conceptual systems especially in including derivation rules. This enables us to show close connections among the realms of objects, their concepts, and reasoning with concepts.

This article discusses a familiar version of trope theory as opposed to a familiar version of the theory of universals, examining how these two rivals address the problem of “attribute agreement”—a problem that has been at the root of the very reason for developing these theories in the first place. The article shows that there is not much of a difference between the ways these two theories handle the problem, and in a more general way it argues that there is (...) little reason for preferring one theory over the other. It is not interested in this claim only for the sake of the debate between trope theory and the theory of universals. Indeed, the reasons why it claims that it is so difficult to choose one theory over the other can be applied to other cases as well (where they might lead to claims of metaphysical equivalence). David Lewis’ modal counterpart theory falls prey to the famous Saul Kripke’s objection, and this is mostly due to his ‘static’ ontology of possible worlds. This paper examines a genuinely realist but different, branching ontology of possible worlds and a new definition of the counterpart relation, which attempts to provide us with a better account of de remodality, and to meet satisfactorily Kripke’s claim, while being also ontologically more ‘parsimonious’.

The study discusses Kant’s doctrine of lasting peace contained in his essay Toward Perpetual Peace (1795). First, the historical-political circumstances surrounding the genesis of Kant’s essay are described. Kant’s preliminary measures, which in his opinion must be accepted if lasting peace is to be ensured, are also discussed. Great attention is paid to the very core of Kant’s essay: his proposal for a comprehensive reform of law, which should apply to state, international, and cosmopolitan law. This is followed by an (...) exposition of Kant’s reflections on the feasibility of his doctrine of lasting peace in history. And finally, Kant’s view of the public as an institution is summarized. The originality of Kant’s approach is seen by the author above all in the fact that, from the point of view of the philosophy of law, the doctrine of lasting peace in Toward Perpetual Peace is connected with a consideration regarding its realizability in history. He also draws attention to the fact that though this detail is known, it is often marginalized in secondary literature. (shrink)

Na úvod připomínám medailon Josefa Zumra k Lubošovým šedesátinám ve Filosofickém časopisu 1995, jako doklad, že našeho tehdejšího vedoucího katedry si vážili nejen filosofové z Brna. Luboš se narodil ve stejném roce jako já, ale středoškolská studia stihl dokončit o rok dříve. Tak se stalo, že jsem se s ním v roce 1950 na Filosofické fakultě setkal jako s učitelem- -asistentem (na jeho přednášce z etiky) a on se mnou jako s jedním ze svých prvních univerzitních posluchačů filosofie. Když jsem (...) s ním od roku 1954 působil na jedné katedře, setkávali jsme se nejen „služebně”, ale i jako kamarádi mimo školu; nezapomenutelné mi zůstávají např. naše zájezdy na slovenskou chalupu k Pavlu Páclovi, kde jsem se utvrzoval v poznání, jak přirozeně Luboš umí být výborným společníkem i v takovém prostředí (nejen při karetních hrách, ale i když jsme se snažili přispět k údržbě Pavlovy chalupy a k její přípravě na zimní období). Pokusil jsem se povědět pár slov o Lubošově vztahu k rodině, v níž se narodil, k jeho vlastní rodině, k rodnému kraji, a ovšem i Lubošovi učiteli, všemi studenty oblíbeném a váženém. Muselo - bohužel - nakonec dojít i na slova obdivu k jeho statečnému zápasu s nemocí, které posléze podlehl. (shrink)

In its jurisprudence relating to Article 267 TFEU, the Court of Justice of the European Union seems to oscillate between two different approaches. According to the jurisprudential mainstream, the preliminary ruling is an instrument of dialogue between national courts and the Court of Justice. This constant dialogue can fulfill the role assigned to the Court to ensure consistency of interpretation and application of Union law. Another line of cases, however, seems to make preliminary rulings means for individuals to ensure their (...) rights which derive from EU law. These two visions of the preliminary references recently have been opposed in discussions about a particular aspect of the preliminary procedure, which is the late withdrawal of the question referred by the national court. In fact, when the national court considered that the response of the Court of Justice was not “necessary to render judgment,” it could, at any time, including both before and after the deliberate publication, date the judgment to the parties and remove this issue. Therefore, the jurisdiction of the Court of Justice became dependent on matters of procedure (dealings between the parties, amicable agreements, etc.) that occurred in extremis before the national court, which sometimes cast doubt on a possible manipulation of the Court by the parties to the main proceedings. It became necessary to find a solution to solve this problem. The two different visions were then compared. If the preliminary ruling is conceived as an additional instrument for the rights that individuals derive from EU law, there is no need for the Court of Justice of the European Union to make a decision when the dispute is resolved before the national court and the defendant has obtained satisfaction. Conversely, if the preliminary ruling is conceived as an instrument to ensure the uniform application and interpretation of EU law, this judgment may be necessary. In fact, without deciding in abstracto, the Court in its judgement will anchor an interpretation that should be applied in all similar cases in the courts of the 27 Member States. In this case, a judgment may still be necessary, even if the dispute before the national court ended off. In order to preserve this approach, the new Rules of Procedure now contain a provision in Article 100 (1) which reads as follows: “The Court shall remain seised of a request for a preliminary ruling for as long as it is not withdrawn by the court or tribunal which made that request to the Court. The withdrawal of a request may be taken into account until notice of the date of delivery of the judgment has been served on the interest persons referred to in Article 23 of the Statute”. Thus, the late withdrawal of a request for a preliminary ruling is clearly limited in time and, even if such removal would occur in extremis, the judgment of the Court will be delivered in the interest of interpretation and uniform application of Union law.
