Après avoir traité la question de la reconstruction de la cohérence entre démocratie et droits de l’homme, l’auteur aborde les critiques adressées à cette conception des droits de l’homme, tant dans le discours de l’Occident sur lui-même que dans le discours que d’autres cultures tiennent sur lui. Ces réflexions présentent cependant le type occidental de légitimation comme une réponse aux défis universels auxquels ne sont plus soumis de nos jours (...) uniquement la civilisation occidentale. Die Verständigungsprozesse der Lebenswelt bedürfen deshalb einer kulturellen Überlieferung auf ganzer Breite, nicht nur der Segnungen von Wissenschaft und Technik. So könnte die Philosophie ihren Bezug zur Totalität in einer der Lebenswelt zugewandten Interpretenrolle aktualisieren. Sie könnte mindestens dabei helfen, das stillgestellte Zusammenspiel des Kognitiv-Instrumentellen mit dem Moralisch-Praktischen und dem Ästhetisch-Expressiven wie ein Mobile, das sich hartnäckig verhakt hat, wieder in Bewegung zu setzen.

The favourable social conditions Fechner met at Leipzig with its university and its book industry as well as the close ties to the citizenship of that town were of outstanding importance for G.Th. Fechner (1801–1887), his scientific achievements as natural scientist and philosopher, as the founder of psychophysics and of experimental aesthetics. Since 1825 Fechner had been integrated into its social, scientific and art life in many different ways. His political and theoretical social ideas were obviously influenced by ist bourgeois (...) liberal circles. (shrink)

Ellsberg's (1961) famous paradox shows that decision-makers give events with ‘known’ probabilities a higher weight in their outcome evaluation. In the same article, Ellsberg suggests a preference representation which has intuitive appeal but lacks an axiomatic foundation. Schmeidler (1989) and Gilboa (1987) provide an axiomatisation for expected utility with non-additive probabilities. This paper introduces E-capacities as a representation of beliefs which incorporates objective information about the probability of events. It can be shown that the Choquet integral of an E-capacity is (...) the Ellsberg representation. The paper further explores properties of this representation of beliefs and provides an axiomatisation for them. (shrink)

This review article gives an overview of the two most influential definitions of antisemit­ism in Europe: the non-legally binding working definition by the International Holocaust Remembrance Alliance (IHRA) and the so-called Jerusalem Declaration on Antisemitism. Furthermore, the article explains where the definitions come from and summarises the current debates and discourses on how to define antisemitism in view of the history and politics of Europe. It also gives brief attention to the Nexus Document as a third influential definition, which plays (...) a more important role in the United States. The article ends with a reflection on the definition offered by the historian Helen Fein, which is more action-based, and Amos Morris-Reich’s statement of the importance of reflecting on the role of language and the ability of language to create hate and to hurt. Und eng damit verknüpft die Frage, was ein Kunstwerk ist und was einen Künstler und eine Künstlerin auszeichnet. In diesem Essay wird es aber nicht um die Kunst im Allgemeinen gehen, sondern um die abstrakte Kunst und die abstrakte Malerei im Besonderen. Was zeichnet sie aus und was ist ihr Wesen? Ist es die Freiheit?

Systematic cross-national analyses of political debates on the admission of refugees and asylum seekers require a theoretically coherent and empirically comprehensive typology of frames and arguments used. The paper proposes such a typology of frames and arguments used by governments, opposition parties and social movements in public debates on the admission of refugees. We argue that the collective identity and characteristics of the receiving country on the one hand and refugees’ characteristics on the other constitute the key dimensions to which (...) frames in political discourse about the admission of refugees refer. We distinguish between six different frames – economic, cultural, moral, legal, security-related and international – of how the “we” and the “others” can be interpreted. Furthermore, we specify typical arguments associated with the respective frames for or against the admission of refugees. Given that the typology was developed based on a discourse analysis of a very diverse set of countries, including some of the so-called “Global South”, we claim that it can be used to analyze political debates on the admission of refugees in other countries as well and can thus contribute to an accumulation of knowledge. The present volume contains 14 contributions presented at a colloquium on "Structure and Approximation in Physical Theories" held at Osnabruck in June 1980. The articles are presented in the revised form written after the colloquium and hence also take account of the results of the discussion at the colloquium. It is a striking feature that the problem of approximation in physical theories has only recently found some attention in the philosophy of science, although the working physicist is con stantly confronted (...) with those questions. No interesting theory of exact science exactly fits its experimental data; almost every relation between different theories is an approximate one. There fore an adequate reconstruction of physical theories must take into account and conceptualize the moment of approximation. The majority of the articles in this book is centered around this subject. There are at least two elaborate, 'structuralistic' approaches to the formalization of physical theories in which the aspect of approximation has been incorporated: the approach due to P. Suppes, J. Sneed, W. Stegmuller ("S-approach") and the approach of G. Lud wig and his co-workers ("L-approach"). The articles in this book correspondingly fall into three classes: presentation, elaboration and critique of the L-approach [Hartkamper/Schmidt, Ludwig, Neumann, Werner, Schmidt, Mayr, Kamiah, Majer, Grafe] or of the S-approach [Moulines, Balzer, Cooke], and articles referring to both approaches or concerned with related matters [Scheibe, Pfarr, Castrigiano]. In a series of lectures on German philosophy ‘since Kant’, the names of Fichte, Schelling, and Hegel and their critical reference to Kant are, of course, a must. No less a must, though, would seem to be Wilhelm von Humboldt, a philosopher and linguist who, together with Herder and Hamann, formed the alliterating triumvirate of a romanticist critique of Kant. The response, within the discipline, to transcendental philosophy from this side was, in contrast to the idealistic mainstream, long in the (...) coming but, in the end, rich in consequences. Analogy making from examples is a central task in intelligent system behavior. A lot of real world problems involve analogy making and generalization. Research investigates these questions by building computer models of human thinking concepts. These concepts can be divided into high level approaches as used in cognitive science and low level models as used in neural networks. Applications range over the spectrum of recognition, categorization and analogy reasoning. A major part of legal reasoning could be formally interpreted as an (...) analogy making process. Because it is not the same as reasoning in mathematics or the physical sciences, it is necessary to use a method, which incorporates first the ability to specify likelihood and second the opportunity of including known court decisions. We use for modelling the analogy making process in legal reasoning neural networks and fuzzy systems. In the first part of the paper a neural network is described to identify precedents of immaterial damages. The second application presents a fuzzy system for determining the required waiting period after traffic accidents. Both examples demonstrate how to model reasoning in legal applications analogous to recent decisions: first, by learning a system with court decisions, and second, by analyzing, modelling and testing the decision making with a fuzzy system. Über den trotz ihrer mannigfaltigen Unterschiede und Gegensätze bestehenden inneren Zusammenhang der vier normativen Prinzipien wird ebenfalls in klarer und kompakter Form Auskunft gegeben.

Zusammenfassung Mit der Ultra-Bewegung hat sich in den letzten Jahren eine neue Generation von Fußballfans in den Stadien zu Wort gemeldet, deren erlebnisorientierte und widerspenstige Inszenierungen zugleich als Medium und als Motor von Wandlungstendenzen der Fankultur interpretiert werden können. Die Ultras weisen dabei eine ausgeprägte Tendenz zur Selbstdarstellung und Selbstmediatisierung auf. Sie sind eine ausgeprägt öffentlichkeitsorientierte Subkultur, die nicht nur in der Fankurve des Stadions den Ton angeben, sondern auch von Vereinen, Verbänden und Medien als Sprachrohr der Fußballanhänger wahrgenommen werden (...) will. Im Rekurs auf Goffmans Studien zur Selbstdarstellungspraxis im Alltagsleben versucht der vorliegende Beitrag zentrale Facetten dieser neuen Form des Fantums nachzuzeichnen, wobei das Selbstverständnis der Ultras, ihre Zusammensetzung und Organisation sowie ihre Aktions- und Präsentationsformen im Zentrum stehen. This article argues that a theory of media selectivity needs a theory of attention, because attention to a media stimulus is the starting point of each process of reception. Attention sequences towards media stimuli – pages of newspapers and online-newspapers – were analyzed using eye-tracking patterns from three different perspectives. First, attention patterns were compared under varying task conditions. Second, different types of media were tested. Third, attention sequences towards different forms of news with different design patterns were compared. Attention (...) was seen as a prerequisite for reception: Its selective functions for these processes are especially important. Reception itself was examined within an action-theoretical framework and therefore described as a form of interaction between recipient and the media. Eye-tracking data were used as indicators of attention. Starting with a hypothesis on the impact of different media such as printed newspapers and online newspapers on the agenda-setting process of their audience, the study examined how the type of media and the form of news influences attention and selectivity. Our findings showed that visual cues such as salient photos or graphics and information hierarchies signalled by design and layout guide attention processes, not as an automatic process driven from the bottom up, but as stimuli for an active, intention-driven selection process. The results indicate that the form of news affects these patterns of interactive attention more than the medium itself. (shrink)
