Los Anales de la Cátedra Francisco Suárez se han ganado a pulso, a lo largo de los años, sobre todo gracias a la tenacidad de Nicolás López Calera y al equipo formado en torno a él en la Facultad de Derecho de Granada, el mérito de ser la principal referencia bibliográfica de la Filosofía del Derecho en España junto al Anuario de Filosofía del Derecho en la etapa en que J. J. Gil Cremades fue su director. Otras revistas se han (...) ocupado menos del filosofar jurídico que, fundamentalmente, de lo que podríamos llamar problemas de teoría general y de interpretación del derecho. Y ahora, por la amistosa pero tenaz compulsión de M. Saavedra, me veo en la obligación de contribuir a esta entrega de una revista prestigiosa, con no poca vergüenza, con la descripción de mi más que modesta aportación a la reflexión jurídico-política en los últimos casi cincuenta años. Las páginas que siguen expresarán pues una autopercepción, que sin duda deberá ser corregida por el lector. No obstante, trataré de introducir datos que puedan rectificar lo que me parecen errores de algunas publicaciones sobre la filosofía del derecho española en general y sobre mi propio trabajo en particular. Me propongo caracterizar brevemente el marco histórico en que se ha producido el fenómeno de la globalización para destacar algunos de sus rasgos. A partir de ellos intentaré describir los principales cambios que ha determinado la globalización en las instituciones políticas de gobierno y apuntar algunos de los interrogantes que eso plantea al filosofar sobre la sociedad y sobre el derecho.

A 68-year-old patient who suffered from gastric cancer diagnosed 8 months earlier presented with multiple peritoneal and hepatic metastasis, despite several rounds of chemo- and radiotherapy. After admission to hospital, his general condition quickly became severely compromised. He was nearly emaciated, despite being on partial parenteral feeding. Four years earlier, due to a cardiac arrhythmia that was refractory to medication, the patient had a cardiac pacemaker implanted, regulated to go off at frequencies of below 70 beats per minute. Given the (...) patient's terminal situation, the team started developing some doubts about the pacemaker's effects during his dying process. The patient had mentioned his intention to donate his pacemaker after his death, but had not asked for its deactivation. The specialists were not sure about the effect of the pacemaker in unnecessarily prolonging the patient's final hour. Nevertheless, they opposed deactivation, which they considered ethically uncertain. The family, who had been initially for the deactivation, decided against it. The patient's condition was progressively deteriorating, as he was falling into a state of sopor and, later, into a coma. (shrink)

Otloh de San Emeramo (Regensburg 1010-1070) accede al pensamiento de Platón a través de los escritos de los (neo)platónicos. Lee a los pitagóricos, a poetas romanos como Virgilio, Horacio, Lucano, Terencio, Juvenal, Fedro, Marciano Capella y, sobre todo, fue admirador y estudioso de Pseudo-Dionisio Areopagita –pretendió trasladar sus restos a San Emeramo, porque allí habría predicado–, a quien aborda a través de la traducción que realizara Juan Escoto Eriúgena. Estos pensadores le permiten distinguir el sentido “móvil” de la (...) dialéctica, en tanto ejercicio de ascenso y descenso al ámbito inteligible para comprender el sensible. Aplica la dialéctica como un arte para aproximarse a la verdad cuyo movimiento veremos ejemplificado en el encadenamiento de razonamientos, el análisis de sus contradicciones y el intento de su refutación para dilucidarlas y aceptar la duda como algo humano, de lo que no se puede escapar. Por ello compartimos fragmentos e interpretaciones en las que se vislumbra que las “ideas” tienen diferentes status ontológicos, motivo por el cual sus argumentaciones revisten el carácter de posible, accesible, opinable, aproximado, sin alcanzar la verdad absoluta. La idealización del diálogo es un gesto característico no sólo del pensamiento filosófico contemporáneo, sino también de las ciencias humanas y de los procedimientos de intervención pedagógica, terapéutica y organizacional. En este artículo revisaremos críticamente ese mito fundacional del diálogo socrático, mediante un análisis conversacional de los movimientos y las funciones discursivas que en él se desarrollan. Además, exploraremos la evolución moderna del género del diálogo filosófico.

Big data has brought about opportunities for landscape architecture, changing the design thinking of layout optimization simulation, expanding the platform for public participation in layout optimization simulation design, reflecting social and humanistic care, and promoting the integration of discipline cooperation and data. At the same time, it also brings about challenges. The proposal of data theory, the acquisition and analysis of data, and the protection of privacy are all issues that we need to face and solve. First, build a layout (...) optimization simulation program under the background of big data. Follow the procedures of conventional layout optimization simulation, add big data analysis technology to the preliminary analysis, layout optimization simulation design, and later evaluation management, introduce new data processing methods, and build a theoretical framework of landscape optimization simulation methods that integrate new and traditional data. Second, studying the evolution of the landscape image layout of the three-dimensional pastoral complex is different: the overall landscape image layout of the three-dimensional pastoral complex shows a trend of fragmentation and heterogeneity. Among them, the arable land is gradually fragmented, the wetland and water area are simplified in form, the woodland and grassland patches are gradually distributed, the fragmentation is reduced by 76.19%, and the connectivity index is gradually increased. From a spatial perspective, the edge area outside the Fourth Ring Road becomes the most obvious area of fragmentation tendency. Finally, by introducing big data into the landscape layout optimization simulation, a layout optimization simulation method based on big data is constructed and used in the layout optimization simulation of the landscape image layout of the three-dimensional pastoral complex to guide the participatory layout optimization simulation. The paper has been written from a philosophical perspective and triggered by the recurrent discussions in psychology about the most suitable methods to study our multifaceted subjectivity. Its main point is that a phenomenological understanding of the human person provides a robust and also flexible philosophical framework for psychology. The first part discusses three classical distinctions –individual/general; explaining/understanding; induction/interpretation– which, in spite of possible deficiencies, are useful to illustrate the specificity of the human sciences relative to the natural sciences. If (...) not understood as an either-or dichotomy these distinctions represent the search of the right balance to reflect the complexity and richness of psychological science. The second part presents the phenomenological notions of ‘vital reduction’ and ‘personalist reduction’, where reductions does not take on an eliminativistic meaning, but of directing the mind’s gaze to attend to what is originally the case. The ‘vital reduction’ reveals a subject of experience at the center of the lifeworld, and the ‘personalist reduction’ sees in rationality –i.e., the power to grasp the meaning of things and to recognize other subjects of experience­– a deeper dimension of the subject, who we can thus call a person. Psychology and phenomenology converge in disclosing the person-centeredness of our lifeworld. (shrink)

Este trabajo analiza ciertas controversias en torno a las interpretaciones biopolíticas de Arendt. Recientemente, algunos de sus comentaristas han enfatizado las nuevas perspectivas teóricas que ciertos conceptos claves de Arendt podrían ofrecer desde el paradigma biopolítico. Sin embargo, estas reinterpretaciones no parecen ser fieles al fundamento original de tales conceptos —la fenomenología—. Intentaré mostrar aquí que es necesario: a) precisar la viabilidad de estas interpretaciones; b) calibrar su alcance; y c) hacer visible el riesgo de operar con ellas una tergiversación (...) del pensamiento aredtiano. Si es plausible mostrar esta incompatibilidad, podremos mostrar también algunos de los límites interpretativos del paradigma biopolítico. (shrink)

En “Computing Machinery and Intelligence”, de 1950, Turing acaba afirmando la posibilidad de procedimientos automáticos computacionales que sustituyan al pensamiento humano. Son reconocidas las críticas de Searle a este artículo, que se han retomado y ampliado a propósito de la actual discusión sobre el alcance y los límites de la inteligencia artificial. Especialmente relevantes al respecto resultan los últimos trabajos de Žižek y Larson, así como la defensa de las propuestas de Turing que ha realizado Daniel Dennett, especialmente en su (...) obra final. De toda esta discusión quiero valerme para esclarecer cuál es exactamente la posición de Turing a partir de 1950. La conclusión a la que llego es que Turing no defiende que los procedimientos automáticos computacionales, tal y como él mismo los define, sustituyen al pensamiento humano, sino que es posible que lo puedan sustituir, y que se trata de una cuestión que solo se puede resolver empíricamente. Extending Aanderaa’s classical result that $\pi ^{1}_{1} < \sigma ^{1}_{1}$, we determine the order between any two patterns of iterated $\Sigma ^{1}_{1}$ - and $\Pi ^{1}_{1}$ -reflection on ordinals. We show that this order of linear reflection is a prewellordering of length $\omega ^{\omega }$. This requires considering the relationship between linear and some non-linear reflection patterns, such as $\sigma \wedge \pi $, the pattern of simultaneous $\Sigma ^{1}_{1}$ - and $\Pi ^{1}_{1}$ -reflection. The proofs involve linking the lengths of (...) $\alpha $ -recursive wellorderings to various forms of stability and reflection properties satisfied by ordinals $\alpha $ within standard and non-standard models of set theory. Entre los textos en los que Tomás de Aquino sostiene que existen muchas ideas en la mente divina, hay uno que no ha recibido hasta ahora demasiada atención por parte de los investigadores y permanece casi inexplorado: el Quodlibet, IV, q. 1. Este escrito, al tiempo que sostiene la unidad de Dios en cuanto ejemplar de todas las cosas, reconoce la presencia de múltiples ideas en su intelecto. Además, por la fecha en que fue redactado, contiene la posición defi nitiva (...) de santo Tomás sobre la pluralidad de ideas divinas. Estas características lo convierten en una pieza ineludible a la hora de abordar dicha temática. Nuestro trabajo ofrece un comentario del cuodlibeto que busca sobre todo examinar sus principios teóricos, abrir las nervaduras internas de la argumentación y mostrar el alcance de sus afi rmaciones. In recent decades, the expansion of economic activity has been accompanied by negative environmental impacts. In response, there have been dramatic changes worldwide in terms of an increased demand for environmentally friendly products and services. To achieve these eco-innovations, firms have sought to acquire knowledge and implement operational flexibility by cooperating with different agents such as universities through a value cocreation system that is also expected to enhance firms’ performance. Using a sample of 250 companies, the present paper examines the (...) role of cooperation with universities in the development of diverse environmental innovations and building operational flexibility and, through this, improving firm performance. Results show that firms that value cooperation with universities develop a wider range of environmental innovations and increase their sales and benefits. (shrink)

When one wants to use citizen input to inform policy, what should the standards of informedness on the part of the citizens be? While there are moral reasons to allow every citizen to participate and have a voice on every issue, regardless of education and involvement, designers of participatory assessments have to make decisions about how to structure deliberations as well as how much background information and deliberation time to provide to participants. After assessing different frameworks for the relationship between (...) science and society, we use Philip Kitcher's framework of Well-Ordered Science to propose an epistemic standard on how citizen deliberations should be structured. We explore what potential standards follow from this epistemic framework focusing on significance versus scientific and engineering expertise. We argue that citizens should be tutored on the historical context of why scientific questions became significant and deemed scientifically and socially valuable, and if citizens report that they are capable of weighing in on an issue then they should be able to do so. We explore what this standard can mean by looking at actual citizen deliberations tied to the 2014 NASA ECAST Asteroid Initiative Citizen forums. We code different vignettes of citizens debating alternative approaches for Mars exploration based upon what level of information seemed to be sufficient for them to feel comfortable in making a policy position. The analysis provides recommendations on how to design and assess future citizen assessments grounded in properly conveying the historical value context surrounding a scientific issue and trusting citizens to seek out sufficient information to deliberate. En este artículo reconstruimos el sentido que asume el problema del orden social en la teoría de los medios de comunicación simbólicamente generalizados de Niklas Luhmann. La hipótesis de lectura que deseamos elaborar es que en esta teorización se evidencia una parcial subordinación del problema sociológico del orden social al de la inquietud por las inciertas condiciones de posibilidad del control y/o la regulación de la acción en contextos de contingencia. Esto es, el problema del poder adquiere una inadvertida preeminencia. (...) En lineamientos generales, consideramos que este desplazamiento se torna reconocible en el marco de las diversas valoraciones que hace Luhmann con respecto a la contingencia de la acción y de sus implicancias para la formulación de una teoría del orden social. La reconstrucción propuesta se torna significativa en tanto muestra una delimitación del problema que se encuentra en tensión con la tradición de reflexión sociológica para la cual el problema conceptual del orden refiere a los modos en que el mismo puede ser concebido o explicado y no a las dificultades ligadas a su formación. Ecological psychology (EP) and the enactive approach (EA) may benefit from a more focused view of lived temporality and the underlying temporal multiscalar nature of human living. We propose multiscalar temporality (MT) as a framework that complements EP and EA, and moves beyond their current conceptualisation of timescales and inter-scale relationships in organism-environment dynamical systems. MT brings into focus the wide ranging and meshwork-like interdependencies at play in human living and the questions concerning how agents are intimately entangled in such (...) meshworks, utilising them as resources for skilful living. We develop a conceptual toolkit that highlights temporality: Firstly, we address lived temporality. We use a case study from psychotherapy to show how a person’s skilful engagement with the world is best described as adaptive harnessing of interdependencies of constraints residing across a wide range of timescales. We call this skill time-ranging. Secondly, the case study provides a proof of concept of the integration of an idiographic approach to human conversing and a more general theory of emergent organisation rooted in theoretical biology. We introduce the existing concept of constraint closure from theoretical biology and scale it up to human interactivity. The detailed conceptualisation of constraint interdependencies constitutes the backbone of the proposal. Thirdly, we present a heuristic mapping of what we call organising frames. The mapping guides the conceptualisation of the emergence of inter-scale relationships and serves as an epistemic tool that brings together nomothetic and idiographic approaches. Finally, we combine new ideas with re-interpretations of existing EP and EA concepts and elaborate on the need of a fresh new look at the implicit and sometimes missing conceptualisations of temporality in the EP and EA literature. IntroductionThe 2019–2020 pandemic COVID-19 has become a global health crisis. While many recent studies on COVID-19 pandemic have focused on disease epidemiology and psychological status of patients, few have explored the multi-facet influential factors or combined perspectives from both the patients and healthcare workers. The purposes of this study were to: analyze the influencing factors of psychological distress of COVID-19 patients; and describe the experience of healthcare workers relieving psychological distress.Materials and MethodsThis study uses a mixed-method cross-sectional design, including a (...) quantitative study and a qualitative study, targeting two populations: COVID-19 patient and health workers, respectively. In the quantitative part, we recruited a convenience sample of patients with COVID-19 from five hospitals in Wuhan, Hubei Province from 10 to 15 April, 2020. Besides, we collected data by using participants’ socio-demographic information sheet, the Connor-Davidson Resilience Scale-10, the Herth Hope Index, the Distress Thermometer, the Revised Chinese Version of Mishel Uncertainty in Illness Scale, and the Chinese Version of Wake Forest Physician Trust Scale. In the qualitative part, the participants were healthcare workers involved in medical aid missions in Hubei Province, China. Meanwhile, we used sampling with convenient and purposive, data collection with a semi-structured online video interview, and text transcription with Colaizzi’s phenomenological method.ResultsThe results reveal that 25.7% of patients reported higher level of psychological distress. After controlling the sociodemographic variables, only severity of COVID-19 and uncertainty in illness shown significant effect on psychological distress in the regression model. The experience of healthcare workers emerged five themes: Particularly needed psychological care, Manifestation of negative emotion, Manifestation of proactive adaptation, Strategies relieving psychological distress, and gains of healthcare workers after delivering effective psychological care.ConclusionThe 25.7% of patients with COVID-19 still suffered from psychological distress, which should receive timely attention from healthcare workers. And the severity of the disease and disease uncertainty have a significant impact on distress. It is critical to train the healthcare workers on detecting the different manifestation of psychological distress, offering timely disease related information, and applying communication strategies. There are different disciplines that make use of reason as an essential element of its work. The most relevant are probably positive science, philosophy and theology. Opening a constructive dialogue between science and theology is very important because of the relevance that science has had in our culture. Unfortunately, the legitimately expected results in this field have not been achieved, mostly because the philosophy has not assumed the pertinent intermediary role as it was expected. Como aporte a un diálogo fructífero, se estudian algunos “pecados” de los ateos positivistas y liberales o socialistas, que identifican la creencia religiosa con la derecha política. Tales “pecados” son fruto de una manifiesta ignorancia sobre la cuestión religiosa. Se muestra la superioridad del ateísmo de F. Nietzsche, quien comprendió que la religión tiene su fundamento en la moral.

This article analyzes the philosophical concept of dwelling from the perspective of a media pragmatics. Media pragmatics is presented here as a method that discloses the circular relation between rule-bound practices and the material and technological substrates that support them. This method is put into practice through a comparative philosophical interpretation of two “canonical” models of dwelling: the Greek oikos and the bourgeois home. Because dwelling, as Heidegger argued, is an interface mediating between the “lifeworld” and the “world” while also (...) organizing relations within the lifeworld, it serves here as a privileged object for articulating this method.
