Though much attention has been paid to different principles of justice, far less has been done reflecting on what the larger concern behind the notion is. In this work, Mathias Risse proposes that the perennial quest for justice is about ensuring that each individual has an appropriate place in what our uniquely human capacities permit us to build, produce, and maintain, and is appropriately respected for the capacity to hold such a place to begin with. Risse begins by (...) investigating the role of political philosophers and exploring how to think about the global context where philosophical inquiry occurs. Next, he offers a quasi-historical narrative about how the notion of distributive justice identifies a genuinely human concern that arises independently of cultural context and has developed into the one we should adopt now. ABSTRACT Every social order depends on a pathway to atonement for those who breach behavioral expectations. However, observers from a variety of fields now agree that the United States has entered an age of non-apology, where the two words “I’m sorry” simply cannot be said, particularly by powerful men facing allegations of sexual misconduct. This essay draws attention to, and comments upon, this trend. We first identify the sociopolitical factors that have inaugurated the era of non-apology, namely growing political polarization. (...) We then explain the consequences of this shift in societal expectations surrounding apology. This state of affairs, which associates genuine apology with emasculation and defeat, is harmful: it foments a toxic culture that will not allow redress for survivors of sexual assault and harassment; and it provides no answers to complex questions of how society can address the guilt of those who engage in sexual misconduct. Truth Be Told explains how truth and falsity result from relations that sentences and their constituents have to the circumstances at which they are evaluated. It offers a precise analysis of truth and a diagnosis of the Liar paradox. Current semantic theory employs generalized quantifiers as the extensions of noun phrases. The book provides simpler extensions for noun phrases. These permit intuitive compositions of truth-values and a diagnosis of the Liar and Grelling paradoxes.

This book takes bold steps in forming much-needed philosophical foundations for restorative justice through deconstructing and reconstructing various models of thinking. It challenges current debates through the consideration and integration of various disciplines such as law, criminology, philosophy and human rights into restorative justice theory, resulting in the development of new and stimulating arguments. Topics covered include the close relationship and convergence of restorative justice and human rights, some of the challenges of engagement with human rights, (...) the need for the recognition of the teachings of restorative justice at both the theoretical and the applied level, the Aristotelian theory on restorative justice, the role of restorative justice in schools and in police practice and a discussion of the humanistic African philosophy of Ubuntu. Frege’s claim that proper names have senses has come to seem untenable following Kripke’s argument that names are rigid designators. It is commonly thought that if names had senses, their referents would vary with circumstances of evaluation. The article defends Frege’s claim by arguing that names have word-reflexive senses. This analysis of names’ senses does not violate Kripke’s noncircularity condition, and it differs crucially from related views of Bach and Katz. That names have reflexive senses confirms Frege’s own solution to (...) his puzzle about the content of identity sentences, solves Kripke’s Pierre and Peter puzzles about belief ascription, and entails that bearerless names have meanings. Furthermore, names’ having reflexive senses explains why they designate rigidly. (shrink)

Theoreticians of names are currently split into two camps: Fregean and Millian. Fregean theorists hold that names have referent-determining senses that account for such facts as the change of content with the substitution of co-referential names and the meaningfulness of names without bearers. Their enduring problem has been to state these senses. Millian theorists deny that names have senses and take courage from Kripke's arguments that names are rigid designators. If names had senses, it seems that their referents should vary (...) among possible worlds. However, the Millians have the enduring problem of explaining the apparent cognitive content of names. I argue that Mill's original theory, when purged of confusion, provides word-reflexive senses for names. Frege failed to notice senses of this particular sort. Moreover, it is these senses that account for names' rigid designation. When the views of Mill and Frege are understood as complementary, the problems that have faced the divided theorists of names vanish. (shrink)

Situating medical and scientific research within a framework or theory of social justice is long overdue. Attempting to extend principles of research ethics beyond the clinic and lab to other affected people or consequences tolerates or obfuscates injustice. While it must be done, the timescales, methodologies, and commitment to real-world impact are quite different in research ethics versus political philosophy.

This chapter provides a broad overview of the relationship between climate change and environmental justice. It provides (1) a brief review of the concept of environmental justice, (2) discussion about how environmental justice applies to climate change, and (3) several examples of how environmental justice has been integrated into climate governance.

In its brief, yet dramatic, moment in time (in Britain in the 1790s), William Godwin's Enquiry Concerning Political Justice enjoyed considerable fame and, indeed, notoriety. While probably best remembered now for its utopian and anarchistic moments, as well as its anticipations of utilitarianism, for a "radical" text Political Justice draws some at first sight puzzlingly conservative political conclusions. In this paper, I explore this apparent conservatism through Godwin's paradoxical views on property, arguing that in the end, and perhaps (...) under the duress of an increasingly polarized political climate, he was unable to reconcile his politics with his philosophy. In this paper, we argue that the Epicurean genealogy of justice and laws presuppose an analysis of the just as a modality of the useful, an approach that denies the conventional character of justice. This genealogical pattern differentiates the origin of justice from that of the law and refers to friendship as a relevant explanatory factor of the origin of justice. We maintain that the interpretations that underline the incoherence of this reference to friendship, in the (...) framework of a hedonistic theory, presuppose a non-Epicurean sharp distinction between altruism and selfishness. Susan Okin has written an important book on justice and the family. Animated by the experiences that contemporary feminism has sought to articulate, and guided by a principled hostility to the subordination of women that continues to disgrace American life, she argues that the current ordering of domestic life in the United States is unjust and that its alteration ought to be made a matter of public policy.Families, according to Okin, are not havens in an otherwise heartless world. Instead (...) the current division of domestic labor marks them as the centerpiece of a broader system of inequalities between men and women. Justice condemns those inequalities and commands their remedy through the transformation of our domestic practices. Because the division of domestic labor is so fundamental to injustice, we need in particular to ‘encourage and facilitate’ equal sharing by parents in the responsibilities of child-rearing, and in the more quotidian chores that provide the material foundation of modern domesticity. The processes associated with globalization have reinforced and even increased prevailing conditions of inequality among human beings with respect to their political, economic, cultural, and social opportunities. Yet-or perhaps precisely because of this trend-there has been, within political philosophy, an observable tendency to question whether equality in fact should be treated a as central value within a theory of justice. The capability approach is one of the main contenders in the field of theorizing social justice. Each citizen is entitled to a set of basic capabilities. But which are these? Martha Nussbaum formulated a set of ten central capabilities. Amartya Sen argued they should be selected in a process of public reasoning. Critics object that the Nussbaum-approach is too perfectionist and the Sen-approach is too proceduralist. This paper presents a third alternative: a substantive but non-perfectionist capability theory of (...) class='Hi'>justice. It presents a two-level concept of individual agency as connected to social practices. It then argues basic capabilities are those necessary to for the agency necessary to navigate freely and autonomously between different social practices. (shrink)

Consensus is lacking among research ethicists on the question of how broadly to understand the requirements of non-exploitation in international clinical research. Two types of principles have been proposed, minimalist and non-minimalist, grounded in two opposing conceptions of exploitation, transactional and systemic. Transactionalists have offered principles, which, it has been argued, are satisfied by minimal gains to vulnerable subjects measured against an unjust status quo. Systemicists have advanced principles with decidedly non-minimal mandates but only by conflating the obligations of clinical (...) research with those of First World citizenship. My aim here is to break this deadlock by offering grounds for a non-minimal requirement of international research ethics grounded in a transactional conception of exploitation. I do this by arguing that a subject's gains must be measured not only within the transaction, relative to her own starting point and to the share of gains enjoyed by her co-transactor, but also across transactions, so as to ensure parity of benefit to trial participants whenever, and wherever, parity of burden is assumed. In this article, I analyze the circumstances of justice, that is, the background conditions that are necessary and sufficient for justice to exist between individual parties in society. Contemporary political philosophers almost unanimously accept an account of these circumstances attributed to David Hume. I argue that the conditions of this standard account are neither sufficient nor necessary conditions for justice. In particular, I contend that both a Hobbesian state of nature and a prisoner’s dilemma are cases in (...) which the conditions of the standard account obtain and yet no justice exists between parties. I propose an alternative set of generic circumstances of justice motivated by examples from game theory. Parties are in these generic circumstances with respect to each other when: (1) they are engaged in a conflictual coordination game with multiple strict Nash equilibrium points where, at any of these equilibria, some parties do not receive their greatest payoffs, and (2) they have common knowledge that each party is rational and follows her end of a strict equilibrium where no party receives her greatest payoff. These two conditions reflect the idea that justice requires all parties to make some sacrifices so that others can have more of the goods they need and want. I argue that these generic circumstances are necessary and sufficient conditions for parties to follow generic norms of justice, that is, mutually beneficial practices that require some sacrifices. Philosophy Lab: An Experiential Approach to Conceptual Analysis gives students the skills and strategies needed to do philosophical work in the Analytic tradition. They are presented with a step-by-step method for performing a preliminary conceptual analysis and practice examples to apply the method to standard philosophical problems. Students are introduced to the work of great thinkers including Descartes, Hobbes, Locke, Wittgenstein, and Ryle. These works are complemented by contemporary empirical findings concerning perception, desire, emotion, moral intuition, and other basic (...) elements of explicit intentional cognition. Each chapter features primary source material, commentary, and activity instructions. The activities are designed to allow students to experience each mode of cognition in relative isolation, and then to see how they combine and interrelate in more complex contexts. Finally, students use the template model of conceptual analysis to explore the material. They identify and isolate the concept to be analyzed, determine whether it is simple or complex, and if complex, identify the constituent parts of the concept. Specific topics covered include causal power, sex and marriage, compassion, ambition, justice, and death. Through presentation and modeling the book not only enables student to do conceptual analysis with precision, it helps them understand and interpret philosophical issues. Philosophy Lab is a comprehensive, carefully designed text for first courses in philosophy. It may be used with first-year undergraduate students, advanced high-school students, or adult learners. Jean Hampton argues that we can detect exploitation in personal relationships by thinking about what we would agree to were we to set aside the emotional benefits we receive from those relationships. Hampton calls her account "feminist contractarianism," but it has recently been critiqued as decidedly unfeminist, on the grounds that it is hostile to women's interests and women's values. Furthermore, Hampton's requirement that we imaginatively distance ourselves from our emotional connections to our loved ones--the key element in her contractarian (...) test--is simply ad hoc. In this essay, I will evaluate these objections and offer a new justification for Hampton's test. I conclude that feminist contractarianism is not only a useful tool for detecting exploitation in the family, it is also deserving of its feminist label. (shrink)

This companion volume focuses on the application and practical ramifications of Indian ethics. Here Indian dharma ethics is moved from its preeminent religious origins and classical metaethical proclivity to, what Kant would call, practical reason–or in Aristotle’s poignant terms, ēhikos and phronēis–and in more modern parlance normative ethics. Our study examines a wide range of social and normative challenges facing people in such diverse areas as women’s rights, infant ethics, politics, law, justice, bioethics and ecology. The article discusses two areas at the intersection of social determinants of health research and social justice theory. The first section examines the affinity between social epidemiology and the capabilities approach. The second section examines how social epidemiology's expansion of the scope of the causal chain and determinants raises questions about epistemology and ontology in epidemiology as well as the field's link to the moral concern for human health.

Saving as many lives as possible while ensuring equity for vulnerable groups through access to triage resources has been the dominant position since the onset of the COVID-19 pandemic in 2020. However, the exact relationship between the principles of social justice and efficiency remains a controversial and unresolved issue. In this paper, we aim to systematically distinguish between different models of this relationship and show that conceptualizing social justice as a ‘moral side-constraint’ or adopting a ‘balancing approach’ that (...) attempt to reconcile social justice with efficiency inevitably lead to significant moral costs that require further justification. Based on this discussion, we propose a novel “threshold model” for trading-off moral costs. According to this model, the structural impact of triage must be considered in order to determine whether one opts for triage with the primary aim of efficiency or social justice. This contextualization further explains why, in some societies and circumstances, social justice can rightly be seen as the primary concern, while in other societies and circumstances, efficiency can be defended as the primary concern. Liberal political theory sees justice as the "first virtue" of a good society, the virtue that guides individuals' conceptions of their own good, and protects the equal liberty of all to pursue their ends, so long as these ends and pursuits are just. But ever since Marx's declaration that "liberty as a right of man is not founded upon the relations between man and man, but rather upon the separation of man from man...,"i liberal society has been frequently criticized (...) for falling seriously short of the conditions of a good society.ii A prominent recent criticism of this sort has been voiced by "communitarians," who charge that the primacy of rights in liberalism reveals a failure to appreciate the value of friendship and community, and tends to undermine their possibility.iii My aim in this paper is to defend liberal political theory, understood as the theory that justifies a polity of individual rights and justice, against this charge.iv My main argument will be directed at the assumption that there is an inherent tension between rights and justice on the one hand, and familial love and friendship on the other. According to the communitarian, two or more individuals constitute a community when they share a common conception of the good, and see this good as partly constitutive of their identities or selves.v Such "constitutive community," in Michael Sandel's words, may be a close friendship or family relationship, or an intermediate association such as a neighborhood organization, or a comprehensive political community. The communitarian charges that in making justice the first virtue of social institutions, liberalism undermines community at all levels, and this for two reasons. First, liberalism demands that we revise or surrender our conceptions of the good - including our attachments and commitments to family and friends - if they should turn out to be unjust. But this demand, the communitarian claims, requires attitudes 2 that are inconsistent with these attachments and commitments.. (shrink)

You cannot have both. Where questions end, liberation begins. In this science of ours, called Akram Vignan (the step less knowledge of the self) there remains no questions. That is why it is so easy for people to follow. Param Pujya Dadashri (master of spiritual science) has given (...) the extraordinary discovery to the world that there is never any injustice in this world. Whatever has happened is justice. Nature has never deviated from justice. Nature is not a person or a God who is under any influences. Nature means scientific circumstantial evidences. The work of Paulo Freire, while remaining important to many educators, has been challenged by some postmodernist arguments. In particular, the pursuit of justice becomes difficult, or at least more complicated, when the concept of difference is taken seriously. This paper reconsiders the Freirean commitment to justice in the light of ideas from Young (1990, Justice and the politics of difference, New Jersey: Princeton University Press) and Pavlich and Ratner (1996 Justice and the Postmodern, In M. (...) Peters, W. Hope, J. Marshall, & S. Webster (Eds.), Critical theory, poststructuralism and the social context, Palmerston North: Dunmore Press). How might the work of Paulo Freire accommodate these ideas and what demands do they place on his philosophy? In addressing this question, I focus on three key themes in contemporary debates over pedagogy and justice: (i) the notion that the individual is produced; (ii) the significance of difference; and (iii) the idea that justice is context dependent and multiple. I argue that given Freire’s emphasis in later publications on the produced and unfinished self and his recognition of the multilayered nature of oppression, Freirean theory continues to have much to offer to these debates. Many important criticisms to the possibility of global justice are advanced following one or another operationalization of the Rawlsian concept of a basic structure. The purpose of this paper is twofold: i) to show that the existence of a global basic structure is irrelevant from the standpoint of justice; ii) to set the stage for a cosmopolitan theory of global justice that employs satisficing sufficientarianism as a distributive principle. One of the main contentions is that the institutional-interactional (...) cut in the recent literature should be transcended. That is, the site of justice should be extended to incorporate both the efficiency of discharging one’s duties through a just institutional scheme and the moral value of promoting a good state of affairs through one’s own efforts. In order to avoid the overdemandingness objection, however, the selected principles of justice ought to belong to the sufficientarian family. Towards the end of the paper I sketch one such theory, satisficing sufficientarianism. (shrink)

Those who argue against physician participation in state mandated executions tend to bracket the question of whether the death penalty should be abolished. I argue that these issues cannot be neatly separated. On the one hand, if justice demands that some criminals be executed for their crimes, then there can be no ethical or moral barrier to the participation of physicians in the execution process. On the other hand, I contend that the testimony and expertise of the medical community (...) is a necessary component of any fruitful reflection on whether capital punishment is, in fact, just. Thus, although the justice of capital punishment may render it permissible for physicians to participate in the execution process, the experience of physicians also sheds important light on whether the death penalty is morally justified.
