Since its appearance in English translation in 1996, Jurgen Habermas's Between Facts and Norms has become the focus of a productive dialogue between German and Anglo-American legal and political theorists. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work. Habermas's theory of democracy has at least three features (...) that set it apart from competing positions. First, it combines a concern with questions of normative justification with an empirical analysis of the social conditions necessary for the realization of democratic institutions. Second, at the heart of his model is the assertion of an internal relationship between liberalism and democracy. Finally, Habermas defends a conception of universal human rights that is not only sensitive to cultural differences but also calls for legal and political institutions that facilitate the cultivation of cultural and religious identities within pluralistic societies. These essays demonstrate the extraordinary power of Habermas's theory of democracy through a further engagement with Rawls's political liberalism and through original contributions to current debates over nationalism, multiculturalism, and the viability of supranational political institutions. Objective Bayesian epistemology invokes three norms: the strengths of our beliefs should be probabilities, they should be calibrated to our evidence of physical probabilities, and they should otherwise equivocate sufficiently between the basic propositions that we can express. The three norms are sometimes explicated by appealing to the maximum entropy principle, which says that a belief function should be a probability function, from all those that are calibrated to evidence, that has maximum entropy. However, the three norms of objective Bayesianism (...) are usually justified in different ways. In this paper we show that the three norms can all be subsumed under a single justification in terms of minimising worst-case expected loss. This, in turn, is equivalent to maximising a generalised notion of entropy. We suggest that requiring language invariance, in addition to minimising worst-case expected loss, motivates maximisation of standard entropy as opposed to maximisation of other instances of generalised entropy. Our argument also provides a qualified justification for updating degrees of belief by Bayesian conditionalisation. However, conditional probabilities play a less central part in the objective Bayesian account than they do under the subjective view of Bayesianism, leading to a reduced role for Bayes’ Theorem. This paper argues that the normative source of modern basic rights consists in the idea of human dignity. It is this idea through which rights derive a universalistic content of morality. Due to their being rights, human rights can serve to protect human dignity, which in turn owes its connotations of self-respect and social recognition to the intramundane status of democratic citizenship. This is associated with a realistic utopia whose aim at realizing social justice is intrinsic to the very institutions (...) of democratic constitutional states. (shrink)

Charles Taylor argues for a radical redefinition of secularism, and Cornel West defends civil disobedience and emancipatory theology. Eduardo Mendieta and Jonathan VanAntwerpen detail the immense contribution of these philosophers to contemporary social and political theory, and an afterword by Craig Calhoun places these attempts to reconceive the significance of both religion and the secular in the context of contemporary national and international politics. Systematic cross-national analyses of political debates on the admission of refugees and asylum seekers require a theoretically coherent and empirically comprehensive typology of frames and arguments used. The paper proposes such a typology of frames and arguments used by governments, opposition parties and social movements in public debates on the admission of refugees. We argue that the collective identity and characteristics of the receiving country on the one hand and refugees’ characteristics on the other constitute the key dimensions to which (...) frames in political discourse about the admission of refugees refer. We distinguish between six different frames – economic, cultural, moral, legal, security-related and international – of how the “we” and the “others” can be interpreted. Furthermore, we specify typical arguments associated with the respective frames for or against the admission of refugees. Given that the typology was developed based on a discourse analysis of a very diverse set of countries, including some of the so-called “Global South”, we claim that it can be used to analyze political debates on the admission of refugees in other countries as well and can thus contribute to an accumulation of knowledge. Summary The author exemplifies the congruency of essential foundations between the critical realism of the Berlin School of Gestalt Psychology (Gestalt theory) and Nicolai Hartmann’s Critical Ontology. For instance, this congruency manifests in the importance given to critical-realistic epistemology – purified from idealistic prejudices, not least prejudices such as production-theoretical ones – connected with an unconditional phenomenology. Altogether, it results in a shared critical distance from scholars of Brentano, such as Husserl and Meinong, as well as from Neo-Kantianism.

Arming uninhabited vehicles is an increasing trend. Widespread deployment can bring dangers for arms-control agreements and international humanitarian law. Armed UVs can destabilise the situation between potential opponents. Smaller systems can be used for terrorism. Using a systematic definition existing international regulation of armed UVs in the fields of arms control, export control and transparency measures is reviewed; these partly include armed UVs, but leave large gaps. For preventive arms control a general prohibition of armed UVs would be best. If (...) that is unattainable, several measures should be taken. An explicit prohibition of autonomous attack, that is without a human decision, should be added to IHL. Concerning armed UVs remotely controlled by a human soldier, recommendations differ according to type or mission. New kinds of uninhabited nuclear-weapon carriers should be banned. Space weapons should be prohibited in general. UVs smaller than 0.2–0.5 m should be banned. Bigger remotely controlled armed UVs not equipped with weapons of mass destruction should be subject to numerical limitations in various categories. For these the Treaty on Conventional Armed Forces in Europe is an important precedent. (shrink)

Zu stark wirkt die Kritik an der moralischen Weltinterpretation nach, in deren Strudel die ehemals hochgeschätzten Tugenden geraten waren. So überrascht es kaum, daß auch die philosophische Ethik gegenwärtig eine eigene Tugendlehre nicht entwickelt. Doch die weit verbreitete Moralisierung der griechischen aretai und der lateinischen mores sowie deren Kritiker gehen zumeist von falschen Voraussetzungen aus, wenn sie von Tugendhaftigkeit, von Sittlichkeit oder von Moral sprechen. Die griechische arete meinte (...) ursprünglich ebenso wie die althochdeutsche tugund keine moralische Haltung oder Qualität, sondern eine besondere Tüchtigkeit oder Eignung, die einem Werkzeug ebenso zukam wie einem Körperteil oder einem Fachmann. So verstanden ist die Tugendlehre weiterhin ein wesentlicher Bestandteil einer praktischen Philosophie. (shrink)

The favourable social conditions Fechner met at Leipzig with its university and its book industry as well as the close ties to the citizenship of that town were of outstanding importance for G.Th. Fechner (1801–1887), his scientific achievements as natural scientist and philosopher, as the founder of psychophysics and of experimental aesthetics. Since 1825 Fechner had been integrated into its social, scientific and art life in many different ways. His political and theoretical social ideas were obviously influenced by ist bourgeois (...) liberal circles. (shrink)

An operationalist argument criticized. Operationism maintains that the relation between a quantity and its operational criteria is established by definition. The assertion that the relation holds cannot be an empirical hypothesis; it is neither falsifiable nor confirmable, since it is not even testable. With an example concerning the measurement of time it is shown that this argument rests upon an untenable presupposition.

On the example of the activities of the Bielefeld University of Applied Sciences (Fachhochschule des Mittelstands Bielefeld – FHM Bielefeld, Germany) as a key par­ticipant in the UNICOM project, the modern university’s implementation of its Third Mission – its fulfillment of its public purpose and observance of public responsibility – is considered. A comparative analysis of the four missions of a modern university was carried out, thanks to which the necessary relationship between them was re­vealed as an integral prerequisite for (...) the successful functioning and development of a modern university. A modern university implements its Third Mission primar­ily in close interaction with communities and industrial communities – both local (primarily) and quite distant (additionally). At the same time, the university must find a balance between meeting the needs of different social groups, guided both by the principles of social responsibility and the interests of the university and these groups. FHM’s training concept is to be close to practice and compact in the transfer of knowledge. This concept is based on four essential characteristics: application-oriented, profiling, interdisciplinarity and internationalization. Four main organi­zations in the structure of FHM Bielefeld enforce the active networking of people, with the motivation and expertise to enable groundbreaking projects and solutions aimed to strengthen the innovation ecosystem of the city. Applied research and third mission are conceptualized in the steps of preconditions, activities, results and con­sequences. The third mission includes the implementation of a cooperation project with a civil society actor or the implementation of a continuing education program designed together with a company. The close interaction of universities with local communities is primarily aimed at ensuring the interests of university stakeholders from local civil society and should be based on academic virtues and values. This article connects recent work in formal epistemology to work in economics and computer science. Analysing the Dutch Book Arguments, Epistemic Utility Theory and Objective Bayesian Epistemology we discover that formal epistemologists employ the same argument structure as economists and computer scientists. Since similar approaches often have similar problems and have shared solutions, opportunities for cross-fertilisation abound.

What kinds of feasibility restrictions should be taken into account in practically relevant political philosophy? David Estlund argues that “ought” does not imply “can will,” and, hence, that we should be very cautious regarding the inclusion of motivational restrictions in political philosophy. As Nicholas Southwood and David Wiens point out, however, Estlund’s position clashes with the requirement that “ought” implies “feasible.” The present article argues that even though we must accept that “ought” implies “feasible,” this does not settle the question (...) regarding the adequate set of feasibility restrictions to be included in applied normative thinking. Instead, we need to distinguish different kinds of normative theory that require different sets of feasibility restrictions.
