So‐called nudge policies utilize insights from behavioral science to achieve policy outcomes. Nudge policies try to improve people's decisions by changing the ways options are presented to them, rather than changing the options themselves or incentivizing or coercing people. Nudging has been met with great enthusiasm but also fierce criticism. This paper provides an overview of the debate on the ethics of nudging to date. After outlining arguments in favor of nudging, we first discuss different objections that all revolve around (...) the worry that nudging vitiates personal autonomy. We split up this worry into different dimensions of autonomy, such as freedom of choice, volitional autonomy, rational agency, and freedom as nondomination. We next discuss worries that nudging is manipulative, violates human dignity, and prevents more important structural reform. Throughout, we will present responses that proponents of nudging can muster. On the whole, we conclude that the objections fail to establish that the nudge program as a whole should be rejected. At the same time, they give us important guidance when moving towards an ethical assessment of nudges on a case‐by‐case basis. Towards the end, we provide some possible ways forward in debates around the ethics of nudging. (shrink)

How can we be responsible for our attitudes if we cannot normally choose what we believe, desire, feel, and intend? This problem has received much attention during the last decades, both in epistemology and ethics. Yet its connections to discussions about reasons and rationality have been largely overlooked. This book develops the foundations of an ethics of mind by investigating the responsibility that is presupposed by the requirements of rationality that govern our attitudes. It has five main goals. First, it (...) reinterprets the problem of responsibility for attitudes as a problem about the normativity of rationality. Second, it connects substantive and structural rationality by drawing on debates about responsibility. Third, it supports recent accounts of the normativity of rationality by explicitly defending the view that epistemic reasons and other ‘right-kind’ reasons are genuine normative reasons. Fourth, it breaks the stalemate between rationalist and voluntarist accounts of mental responsibility by proposing a hybrid view. Belum begitu lama dua buah berita menggoncangkan dunia (astro-fisika). Yang pertama, CERN, Pusat penelitian atom di Geneva, yang dalam dua eksperimen berturut-turut menemukan bahwa neutrino (bagian mikro paling kecil) bergerak dengan kecepatan sedikit melampaui kecepatan cahaya. Yang kedua, pada minggu kedua Januari yang lalu pengamatan astronomis mutakhir menengarai bahwa dalam Bimasakti kita rata-rata setiap dari 10 milyar bintangnya mempunyai sekurang-kurangnya satu planet yang mirip dengan planet kita, bumi. Berita pertama begitu dahsyat sehingga para ahli fisika yang membuat eksperimen itu belum (...) mau mempercayainya, karena kalau amatan mereka betul, salah satu pilar fisika modern—teori relativitas khusus Einstein— runtuh. Sebuah revolusi baru dalam fisika. Salah satu implikasinya: kemungkinan menjalin komunikasi dengan extraterrestrial intelligence (ETI)—kalau ada—bertambah besar. Berita kedua lebih dahsyat lagi implikasinya. Sampai sekarang banyak astronom berpendapat bahwa probabilitas terjadinya planet dengan ciri-ciri seperti bumi adalah sedemikian kecil sehingga tidak mustahil kalau manusia merupakan satu-satunya makhluk berakal-budi di alam raya. Tetapi kalau di Bimasakti kita saja—satu di antara (diperkirakan) 1011 Bimasakti di seluruh alam raya—terdapat 10 milyar planet mirip bumi, adanya makhluk berakal budi di luar bumi (aliens) merupakan kemungkinan kuat. Dua penemuan ini mengangkat salah satu tantangan paling serius bagi teologi Kristiani: kalau ada makhluk berakal budi di tempat lain di alam raya, apa implikasinya bagi inti iman Kristiani, peristiwa Yesus Kristus? Apakah mereka juga perlu ditebus dari dosa? Dan kalau perlu, apakah karya penebusan Yesus juga berlaku bagi mereka? Kalau penyelamatan ilahi di planet-planet tidak berkaitan dengan Yesus Kristus, apa Yesus Kristus masih mempunyai relevansi universal dalam rencana penyelamatan ilahi? Pertanyaan-pertanyaan ini bukanlah pertanyaan iseng-iseng, melainkan menyangkut hakikat iman Kristiani. Buku ini membahas tantangan bagi teologi Kristiani andaikata ternyata selain manusia ada makhluk berakal budi lain di alam raya......................................... Apakah Kreiner berhasil menjawab pertanyaan-pertanyaan teologis berat yang diajukannya sendiri? Inti masalahnya adalah bagaimana dua keyakinan berikut dapat dipersatukan. Pertama, bahwa kalau ada ETI di alam raya, mereka tidak kurang dicintai oleh Allah dari pada manusia bumi dan karena itu inkarnasi ilahi tidak mungkin merupakan kejadian hanya di planet bumi. Kedua, bahwa dalam manusia Yesus Allah mewahyukan diri sendiri secara unik dengan makna penyelamatan universal. Dan hal itu perlu dijawab tanpa jatuh ke dalam pluralisme relativistik àla Knitter, Hick dan Schmidt-Leukel di mana Yesus hanyalah salah satu dari pewahyuan diri Allah yang pada hakikatnya semua sama derajatnya. Kiranya Kreiner berhasil merumuskan tantangan. Ia menunjukkan arah pemecahannya, tetapi ia belum memecahkannya. Bisa diteliti apakah pemecahan dapat dicari ke arah pemikiran baru tentang Pan-en-teisme sebagai pola yang lebih cocok untuk memahami hubungan antara Sang Pencipta dan ciptaan, sebagaimana akhir-akhir ini diangkat oleh beberapa teolog (Herderkorrespondenz Spezial 2-2011). Yang jelas, kemungkinan adanya aliens menghadapkan teologi Kristiani dengan tantangannya yang barangkali paling berat, yang sampai sekarang pernah dihadapinya. Sebagai catatan penutup, tetap benar bahwa probabilitas adanya ETI, melawan segala tulisan populer dan ilmiah (sampai sekarang), tetap minim! Probabilitas matematis bahwa di sebuah planet dengan kondisi-kondisi seperti bumi kita terjadi evolusi sampai ke kehidupan intelektual adalah kurang dari satu di antara 10100 (bdk. Erbrich, 1988, dll.). Kalaupun dalam setiap dari seluruh 1011 Bimasakti terdapat 10.000 planet mirip bumi, maka jumlah planet di alam raya yang kondisi-kondisinya mirip bumi adalah 1015. Jadi probabilitas adanya ETI tetap teramat rendah. Kemungkinan besar kita tidak pernah akan mengetahui apakah ada ETI. Selama itu pertimbangan-pertimbangan dramatis di atas bisa saja hanyalah sebuah permainan teologis, namun dengan daya tantang yang memang tinggi. The normative force of evidence can seem puzzling. It seems that having conclusive evidence for a proposition does not, by itself, make it true that one ought to believe the proposition. But spelling out the condition that evidence must meet in order to provide us with genuine normative reasons for belief seems to lead us into a dilemma: the condition either fails to explain the normative significance of epistemic reasons or it renders the content of epistemic norms practical. The first (...) aim of this paper is to spell out this challenge for the normativity of evidence. I argue that the challenge rests on a plausible assumption about the conceptual connection between normative reasons and blameworthiness. The second aim of the paper is to show how we can meet the challenge by spelling out a concept of epistemic blameworthiness. Drawing on recent accounts of doxastic responsibility and epistemic blame, I suggest that the normativity of evidence is revealed in our practice of suspending epistemic trust in response to impaired epistemic relationships. Recognizing suspension of trust as a form of epistemic blame allows us to make sense of a purely epistemic kind of normativity the existence of which has recently been called into doubt by certain versions of pragmatism and instrumentalism. Proponents of the reasoning view analyze normative reasons as premises of good reasoning and explain the normativity of reasons by appeal to their role as premises of good reasoning. The aim of this paper is to cast doubt on the reasoning view by providing counterexamples to the proposed analysis of reasons, counterexamples in which premises of good reasoning towards φ‐ing are not reasons to φ.

Cases of heroic supererogation have been taken to suggest that non-moral reasons are morally relevant. While non-moral reasons are unable to make actions morally required, they can prevent moral reasons from doing so. I argue that non-moral reasons are morally relevant in yet another way, since they can also play an essential role in making it the case that an action is morally required. Even though non-moral reasons are not able themselves to make actions morally required, they can prevent reasons (...) that otherwise would prevent moral reasons from making actions morally required from doing so. I elaborate and defend this view, and I show how it can be made the basis of an explanation of moral requirements in terms of reasons that is to be preferred over rival accounts. (shrink)

Danielle Celermajer advocates for reconceptualizing responsibility in light of the climate crisis. I argue instead that we must understand current concepts of responsibility which are implicit in actual responsibility practices. I illustrate this by appeal to the practice of holding each other responsible for our beliefs-a practice in which we are constantly involved, but which is often obscured. It extends our responsibility to involuntary aspects of our own mind and involves socially distributed cognitive duties. Young children interpret some acts performed by adults as normatively governed, that is, as capable of being performed either rightly or wrongly. In previous experiments, children have made this interpretation when adults introduced them to novel acts with normative language (e.g. ‘this is the way it goes’), along with pedagogical cues signaling culturally important information, and with social-pragmatic marking that this action is a token of a familiar type. In the current experiment, we exposed children to novel actions with no (...) normative language, and we systematically varied pedagogical and social-pragmatic cues in an attempt to identify which of them, if either, would lead children to normative interpretations. We found that young 3-year-old children inferred normativity without any normative language and without any pedagogical cues. The only cue they used was adult socialpragmatic marking of the action as familiar, as if it were a token of a well-known type (as opposed to performing it, as if inventing it on the spot). These results suggest that – in the absence of explicit normative language – young children interpret adult actions as normatively governed based mainly on the intentionality (perhaps signaling conventionality) with which they are performed. Borderline personality disorder is a complex psychopathological phenomenon. It is usually thought to consist in a vast instability of different aspects that are central to our experience of the world, and to manifest as “a pervasive pattern of instability of interpersonal relationships, self-image, and affects, and marked impulsivity” [American Psychiatric Association, 2013, p. 663]. Typically, of the instability triad—instability in self, affect and emotion, and interpersonal relationships—only the first two are described, examined, and conceptualized from an experiential point of view. In this context, disorders of self have often motivated analyses of self-experience and the sense of self, affective disorders have been frequently considered in the light of emotional experience and its phenomenological structure. Patterns in the phenomenology of social experience have found comparatively little traction when it comes to the conceptualization of the interpersonal disturbances in borderline. In this paper, I argue that interpersonal instability in borderline consists in much more than fragile and shifting relationships but, most importantly, also involves certain styles in experiencing others. These styles, I suggest, may play an explanatory role for the borderline-typical patterns of interpersonal turmoil and so deserve more attention. To better describe and understand these styles, I explore the phenomenological structure of borderline affective instability and discuss the implications it might have for how a person experiences and relates to other people. Considering core aspects of borderline affective instability, such as alexithymia, emotional contagion, emotion dysregulation, and chronic emptiness, I propose borderline can be interpreted as a disturbance of interaffective exchange, which gives rise to certain ways of experiencing others that imply a social impairment. The objective of this thesis – Reflective Equilibrium as a Form of Life – is to contribute to the deepening of understanding of the method of reflective equilibrium – a method of internal epistemic justification. In the first part of the study, four paradigmatic conceptions of the method will be analyzed in order to carve out a conceptual core: The ones by John Rawls – who coined the name of the method – Norman Daniels, Michael DePaul and Catherine Elgin. I (...) will argue that the conceptual core of the method contains four elementary rules: 1) A minimalistic fallibilism, 2) a moderate holism, 3) a minimalistic rationality, and 4) a weak foundationalism. Compliance with these rules is necessary and jointly sufficient for any epistemic procedure of justification to be in accordance with the method of reflective equilibrium. The second part of the study is intended to answer some of the open questions concerning this definition of the conceptual core of the method. It will be argued that the a minimalistic fallibilism, as a very central element of the method, is justified since there is no belief whose truth is transparent to an epistemic agent. Even if it were the case that such beliefs exist, there would be attractive options of retreat which provide a quasi-universal justification of minimalistic fallibilism. It will also be argued that all alternative methods of justification are either compatible with the method of reflective equilibrium or are not justified. While a metajustification of the method – understood as a justification of the method employing the method itself – is on the one hand not completely satisfactory, as it presupposes the acceptance of the method before it is justified, it is epistemically acceptable on the other hand, since it allows for a critical inquiry and is open-ended. It will be pointed out that a moderate foundationalism can be justified by the method for some specific area of inquiry insofar as basic beliefs can be identified. Yet, the default-position of the method is only a weak foundationalism (often also termed “coherentism”). With regard to the possibility of a formal interpretation of the method with which one could specify key terms used in the definition of the conceptual core, I will sketch general ways such a formalization might take. However, I will argue that the informal interpretation of the method has priority over any formal interpretation. In the third and concluding part of the study, I will present the claim that one should interpret the method of reflective equilibrium as a form of life. This means that the method is at least implicitly accepted by some epistemic agents: they have developed a disposition and ability to act according to the method. This interpretation of the method can be related to the notion of critical thinking, which, as a civic virtue and educational ideal, is subject of empirical research and practical application. A possible misunderstanding with respect to the method of reflective equilibrium as a form of life should be avoided: To interpret the method as a form of life does not indicate that it must be a comprehensive form of life. Acknowledging it in private life is optional. According to the proposed understanding of the method it is primarily a public and political form of life. (shrink)

Peirce is best known as the founder of pragmatism, but his dissatisfaction with how others understood and appropriated it prompted him to rename his own doctrine “pragmaticism” and to compose several variants of his original maxim defining it, as well as numerous restatements and elaborations. This paper presents an extensive selection of such formulations, followed by analysis and commentary demonstrating that for Peirce the ultimate meaning of an intellectual concept is properly expressed as a conditional proposition about the deliberate, self-controlled (...) conduct of its interpreters, not the law-governed behavior of its object. Although he is best known as the founder of pragmatism, the name that Charles Sanders Peirce prefers to use for his comprehensive system of thought is "synechism" because the principle of continuity is its central thesis. This paper arranges and summarizes numerous quotations and citations from his voluminous writings to formalize and explicate his distinctive mathematical conceptions of hyperbolic and topical continuity, both of which are derived from the direct observation of time as their paradigmatic manifestation, and then apply them (...) in normative science and metaphysics, especially logic as semeiotic and cosmology. The resulting conclusion is that the intelligibility of the universe is plausibly explained by conceiving it as one immense sign, a vast inferential process: a semiosic continuum whose connected constituent signs are indefinite until deliberately marked off, with God the Creator as its overall dynamical object in the infinite past and God completely revealed as its overall final interpretant in the infinite future. The results of four experiments provide evidence for controlled processing in the absence of awareness. Participants identified the colour of a neutral distracter word. Each of four words was presented in one of the four colours 75% of the time or 50% of the time . Colour identification was faster when the words appeared in the colour they were most often presented in relative to when they appeared in another colour, even for participants who were subjectively unaware of any contingencies (...) between the words and the colours. An analysis of sequence effects showed that participants who were unaware of the relation between distracter words and colours nonetheless controlled the impact of the word on performance depending on the nature of the previous trial. A block analysis of contingency-unaware participants revealed that contingencies were learned rapidly in the first block of trials. Experiment 3 showed that the contingency effect does not depend on the level of awareness, thus ruling out explicit strategy accounts. Finally, Experiment 4 showed that the contingency effect results from behavioural control and not from semantic association or stimulus familiarity. In this paper, I defend a reasons-first view of epistemic justification, according to which the justification of our beliefs arises entirely in virtue of the epistemic reasons we possess. I remove three obstacles for this view, which result from its presupposition that epistemic reasons have to be possessed by the subject: the problem that reasons-first accounts of justification are necessarily circular; the problem that they cannot give special epistemic significance to perceptual experience; the problem that they have to say that (...) implicit biases provide epistemic. The first problem will be overcome by introducing presentational attitudes that are not in need of justification as basic ways of possessing epistemic reasons. The latter two problems will be solved by introducing epistemic rational capacities of two different kinds, which are exercised in mental states that are ways of possessing epistemic reasons, and by distinguishing these from mental states that are not exercises of epistemic rational capacities. In the past decade, the fields of machine learning and artificial intelligence (AI) have seen unprecedented developments that raise human-machine interactions (HMI) to the next level.Smart machines, i.e., machines endowed with artificially intelligent systems, have lost their character as mere instruments. This, at least, seems to be the case if one considers how humans experience their interactions with them. Smart machines are construed to serve complex functions involving increasing degrees of freedom, and they generate solutions not fully anticipated by humans. (...) Consequently, their performances show a touch of action and even autonomy. HMI is therefore often described as a sort of “cooperation” rather than as a mere application of a tool. Some authors even go as far as subsuming cooperation with smart machines under the label ofpartnership, akin to cooperation between human agents sharing a common goal. In this paper, we explore how far the notion of shared agency and partnership can take us in our understanding of human interaction with smart machines. Discussing different topoi related to partnerships in general, we suggest that different kinds of “partnership” depending on the form of interaction between agents need to be kept apart. Building upon these discussions, we propose a tentative taxonomy of different kinds of HMI distinguishing coordination, collaboration, cooperation, and social partnership. (shrink)

Bonuses, as incentives or rewards for health -related behavior, feature prominently in German social health insurance. Their goal is centered around promoting personal responsibility, but reducing overall health -care expenditure and enabling competition between sickness funds also play a role. The central position of personal responsibility in German health -care policy is described, and a framework is offered for an analysis of the ethical issues raised by policies seeking to promote responsibility. The framework entails seven tests relating to: solidarity; equality (...) and equity; intrusiveness; attributability and opportunity of choice; evidence, rationale, and feasibility; affected third parties; and coherence. It is contended that a focus on tests, in particular from within contractualism, is the most appropriate way of addressing the question of health responsibility in pluralistic societies. However, taken by themselves, the tests also allow an identification of the key ethical issues by particular policies, which are illustrated by applying the framework to particular bonus polices. Can the evidence provided by software systems meet the standard of proof for civil or criminal cases, and is it individualized evidence? Or, to the contrary, do software systems exclusively provide bare statistical evidence? In this paper, we argue that there are cases in which evidence in the form of probabilities computed by software systems is not bare statistical evidence, and is thus able to meet the standard of proof. First, based on the case of State v. Loomis, we investigate (...) recidivism predictions provided by software systems used in the courtroom. Here, we raise problems for software systems that provide predictions that are based on bare statistical evidence. Second, by examining the case of People v. Chubbs, we argue that the statistical evidence provided by software systems in cold hit DNA cases may in some cases suffice for individualized evidence, on a view on which individualized evidence is evidence that normically supports the relevant proposition (Smith, in Mind 127:1193–1218, 2018). Die vorliegende Untersuchung zeigt, warum es vielversprechend ist, das Projekt einer kritischen Gesellschaftstheorie in der Tradition der Frankfurter Schule auf der Grundlage einer Theorie der Anerkennung durchzuführen. Die Kategorie der Anerkennung hat in diesem Zusammenhang besonderen Wert, weil sich mit ihr soziale Verhältnisse sowohl analysieren als auch kritisieren lassen. Als Anerkennungstheorie vermag die Kritische Theorie wesentliche Ziele in den Bereichen der Sozialtheorie und der Sozialkritik zu erreichen. Anhand einer neuen Interpretation einiger klassischer philosophischer und sozialwissenschaftlicher Texte zeigt die vorliegende Untersuchung, (...) warum Hegels Praktische Philosophie das Projekt einer kritischen Gesellschaftstheorie in der Tradition der Frankfurter Schule stärker bereichern kann, als bisher angenommen wurde. In this paper, I discuss the conceptualist claim that we cannot speak of perceptual content unless we assume it is objective content. The conceptualist argues that only conceptual content can meet the requirement of being objective, so that the view that perceptual experience has nonconceptual content is not tenable. I start out by presenting the argument from objectivity as it can be found in McDowell. I then present the following objections: First, perceptual objectivity cannot be due to the perceiver’s conception (...) of objectivity; and second, even nonconceptual capacities of the individual cannot and need not be appealed to in order to account for objective perceptual content. We analyze axioms and postulates as speech acts. After a brief historical appraisal of the concept of axiom in Euclid, Frege, and Hilbert, we evaluate contemporary axiomatics from a linguistic perspective. Our reading is inspired by Hilbert and is meant to account for the assertive, directive, and declarative components of modern axiomatics. We will do this by describing the constitutive and regulative roles that axioms possess with respect to the linguistic practice of mathematics.

We give an overview of the practice of developing and using complex climate models, as seen from experiences in a major climate modelling center and through participation in the Coupled Model Intercomparison Project. We discuss the construction and calibration of models; their evaluation, especially through use of out-of-sample tests; and their exploitation in multi-model ensembles to identify biases and make predictions. We stress that adequacy or utility of climate models is best assessed via their skill against more naïve predictions. The (...) framework we use for making inferences about reality using simulations is naturally Bayesian, and has many points of contact with more familiar examples of scientific epistemology. While the use of complex simulations in science is a development that changes much in how science is done in practice, we argue that the concepts being applied fit very much into traditional practices of the scientific method, albeit those more often associated with laboratory work. Endgame proposals strive for a tobacco‐free (or at least cigarette‐free) society. Some endgame proposals are radical and include, for example, a complete ban on cigarettes. Setting aside empirical worries, one worry is ethical: would such proposals not go too far in interfering with individual freedom? I argue that concerns around freedom do not speak against endgame proposals, including strong proposals such as a ban on cigarettes. I first argue that when balancing freedom with public health goals in tobacco control, the (...) latter win out. But I also argue that, in principle, a concern with freedom itself already justifies endgame measures. First, such measures can increase people's lifetime freedom, that is, the freedom they have across their entire lives. Second, such measures can facilitate a better interpersonal distribution of freedom by increasing aggregate societal freedom and by reducing inequalities. Overall, freedom does not preclude strict tobacco control but supports it. (shrink)

Nanotechnology presents significant challenges in terms of developing a regulatory framework. This is due to a lack of scientific knowledge about the behaviour of the technology in its interactions with biological and ecological processes, the environment and other technologies. Crucially, there is a great deal of uncertainty surrounding the potential environmental and human health and safety impacts of NT. Consequently, the development of NT is a potential test case for framing new models of ‘soft law’ voluntary governance as a substitute (...) for traditional command and control type regulation. Driven by ‘new science governance,’ an approach based on a combination of ideas in anticipatory ethics, future-oriented responsibility, upstream public engagement and deliberation and theories of justice may offer a solution. The uniqueness of the approach can be found in the incorporation of anticipatory approaches via public participation and deliberation as the input into procedural justice approaches with distributional justice as the output. The overarching objective of this work is to contribute to the discussion in relation to the internalisation of responsibility and the building of intellectual and societal capacity to anticipate negative consequences before they arise in the hope that such an approach could be the antithesis of the retrospective imposition of responsibility and liability after the harm is done, which is the outcome of traditional regulatory and ethical approaches. When animal ethicists deal with welfare they seem to face a dilemma: On the one hand, they recognize the necessity of welfare concepts for their ethical approaches. On the other hand, many animal ethicists do not want to be considered reformist welfarists. Moreover, animal welfare scientists may feel pressed by moral demands for a fundamental change in our attitude towards animals. The analysis of this conflict from the perspective of animal ethics shows that animal welfare science and animal ethics highly (...) depend on each other. Welfare concepts are indispensable in the whole field of animal ethics. Evidence for this can be found by analyzing the structure of theories of animal ethics and the different ways in which these theories employ welfare concepts. Furthermore, the background of values underneath every welfare theory is essential to pursue animal welfare science. Animal ethics can make important contributions to the clarification of underlying normative assumptions with regard to the value of the animal, with regard to ideas about what is valuable for the animal, and with regard to the actions that should follow from the results of animal welfare science. This comment raises two worries for Crane’s view of religious beliefs and their contents. First, I argue that his appeal to inferentialism about the contents of dispositional beliefs cannot fully avoid the problem of inconsistent beliefs. For the same problem can be raised for occurrent thought, and the inferentialist solution is not available there. Second, I argue that religious beliefs differ from ordinary beliefs with respect to their justification in cases of peer disagreements. This article critically engages a recent essay Jeffrey Alexander has published on ‘societalization’, whose conceptualization it finds problematic; first, because in contrast to the impression conveyed by the essay, the term itself is anything but new (as shown in a summary of six theories of societalization which precede Alexander’s by decades, in two cases, by more than a century), and, second, because the way Alexander employs the term is highly aporetic, while also being emblematic of much deeper problems that afflict (...) the whole discipline. Following a reconstruction of the term’s morphology and the transmutations it underwent during its gradual incorporation into the English language, the article identifies an undertheorized concept of society as the root cause behind the difficulties into which Alexander maneuvers himself. It concludes with a brief sketch of an alternative that can contribute to overcoming these difficulties. (shrink)

Freedom is among the central values in political philosophy. Freedom also features heavily in normative arguments in ethics, politics, and law. Yet different sides often invoke freedom to establish very different conclusions. Some argue that freedom imposes strict constraints on state power. For example, when promoting public health, there is a limit on how far the state can interfere with individual freedom. Others, in contrast, argue that freedom is not just a constraint but also an important goal of state power (...) and collective action. Good public health policy, for example, promotes people’s freedom. Of course, different arguments often draw on different theories of freedom. So, to evaluate such arguments, we need to analyze these different theories and their implications and assess their plausibility. -/- The broadly liberal tradition views freedom as being about external options. Such theories typically start with an account of when someone has a specific freedom or unfreedom to do something. For example, some argue that only a narrow set of interpersonal interferences count as constraints on freedom. Others argue that a far broader set of factors, including ill health and natural constraints, can reduce one’s freedom. -/- Since the 1980s and 1990s, scholarship has increasingly recognized that to use liberal freedom in normative arguments, one must move beyond specific freedom and unfreedom. Most laws and policies both subtract and add specific freedoms. What matters is how a person’s freedom is affected overall. Philosophers and economists have thus engaged in intricate debates about how to measure overall freedom. Moreover, policies and law affect not only one person at one point in time but also multiple persons across time. So, liberal freedom-based arguments also require distributive criteria for intertemporal and interpersonal distributions of freedom. -/- In the early 21st century, republicanism has developed into a prominent alternative to liberal theories. Republicans argue that being a free person is not just, or not even primarily, about liberal option-freedom. Freedom requires being free from dominating power. Republicans and liberals have engaged in a lively debate on who offers the better theory. In developing the republican ideal, republicans also engage in intramural debates. For example, is domination primarily an interpersonal or structural phenomenon? And what economic institutions does republicanism imply? -/- Theorizing around freedom has become richer and moved from narrower questions regarding specific freedom and unfreedom to overall freedom and to republican theories of nondomination. But recent theorizing also seeks to extend its focus and scope. Historically, theorizing started with the freedom of able-bodied male citizens within nation states. Recent theorizing shifts the focus to include issues around gender, disability, freedom at the international level, and the freedom of nonhuman animals and future generations. Beyond fascinating implications of existing theories, a more inclusive focus is likely to also yield important lessons on how current theories can be improved. (shrink)

Current analytical philosophies of romantic love tend to identify the essence of such love with one specific element, such as concern for the beloved person, valuing the beloved person or the union between the lovers. This paper will deal with different forms of the union theory of love which takes love to be the physical, psychic or ontological union of two persons. Prima facie, this theory might appear to be implausible because it has several contra-intuitive implications, and yet, I submit, (...) it is more coherent and attractive than it seems to be. I shall distinguish three specific models and thereby offer a differentiated account of the union theory which has not previously been provided in the literature. I will claim that two of these models should be rejected. I shall then defend the third model against certain possible objections ; but nevertheless, I shall conclude by showing how this model, too, faces further significant objections which ultimately expose the limits of the union theory of love. In conclusion, I will sketch the outlines of a non-reductive cluster theory of love. (shrink)

Manipulation or manipulative behavior, which is widespread in many life contexts and interpersonal relationships, is mostly associated with a negative connotation. Often considered roughly a form of control over others that cannot be equated with coercion or argumentation, manipulation is an umbrella term for strategies that serve to make another person (or oneself) experience x or do y or induce certain situations and interpersonal constellations. Frequently, the use of manipulative strategies is deemed to result from egoistic or even hostile motives. (...) Such an appraisal has a major impact on the stigma patients with Borderline Personality Disorder (BPD) are confronted with, given that many of their behaviors are often interpreted as manipulative. In the past decade or so, however, researchers and clinicians have pointed out that what is generally identified as manipulation in persons with BPD needs to be seen through the lens of their lifeworld in order to facilitate an empathetic and more positive attitude towards these individuals. In this paper, I discuss the different functions manipulation may have for persons with BPD and argue that instead of seeing it as a clear expression of malevolence or belligerence, a heightened disposition to manipulations should be considered as both the fruit and seed of a painful and isolating social impairment. Wenn wir Peter Singers Konklusion in „Famine, Affluence, and Morality“ (1972) akzeptieren, dann handeln wir im Alltag sehr viel häufiger falsch, als es uns lieb ist. Anstatt über die Natur von Altruismus zu philosophieren, könnten wir auch möglichst effektiv Hungerleidenden helfen. Ist es daher etwa moralisch verwerflich – weil egoistisch – zu philosophieren? In diesem Beitrag beleuchte ich die Gründe, die wir haben, Philosophie in den Mittelpunkt unseres Lebens zu stellen. Ich argumentiere, dass Philosophieren – genauso wie die Beschäftigung mit (...) Kunst und Wissenschaft – nur dann gerechtfertigt sein kann, wenn es praktische Gründe jenseits von Gründen des persönlichen Nutzens und der Moral gibt. Dabei schliesse ich an Susan Wolfs Idee an, dass diese Tätigkeiten ein Leben mit Sinn erfüllen können. Es bleibt jedoch offen, ob in einer Welt voller Ungerechtigkeit die moralischen Gründe gegen das Philosophieren (und für andere Handlungsoptionen) nicht dennoch überwiegen. (shrink)

Whereas in the first half of the 20th century, proclamation was the focal point of pastoral care in Germany, the 1970s witnessed an embracing of the American pastoral care movement. From then on, pastoral care was increasingly understood as accompanying patients whilst adopting the spiritual dimension. Nowadays, Christian chaplains are encountering an increasing number of patients from different religious communities. Various models have been proposed to help Protestant chaplains find an authentic form of pastoral care suitable for all religions. The General Medical Council’s (GMC) Outcome for Graduates, published in 2018,1 is the latest guidance for medical schools on the GMC’s expectations of the undergraduate medical curriculum. One of its three top level outcomes—Professional Values and Behaviours—refers to medical ethics and law, professionalism and patient safety competencies. Furthermore, the recent proliferation of patient safety inquiries in the UK2–4 has elevated the emphasis on ethical medical practice5 and critical medical ethics and law competencies for future doctors. In response to these developments (...) and to ensure an up to date offering, the Institute of Medical Ethics Education Committee has updated the consensus statement on the core curriculum for medical ethics and law for doctors of tomorrow.6 This refined curriculum is the result of a national consultation process. We asked for the views of all lead teachers of medical ethics and law in all UK medical schools, the UK’s chief medical officers, the GMC, and delegates at our annual education conference in 2017 who …. Two different versions of the ending of the first additament to C. S. Peirce's 1908 article, "A Neglected Argument for the Reality of God," appear in the Collected Papers but were omitted from The Essential Peirce. In one, he linked the hypothesis of God's Reality to his entire theory of logic as semeiotic, claiming that proving the latter would also prove the former. In the other, he offered a final outline of his cosmology, in which the Reality of God as (...) Ens necessarium is indispensable to both the origin and order of our existing universe of Signs. Exploring these passages, as well as the unpublished manuscript drafts of the article, provides important insights into the key concepts of instinct and continuity within Peirce's comprehensive system of thought. In March 1986, a public symposium took place in Heidelberg about the “unresolved potential dangers of genetic engineering”. The event was organized by institutions affiliated with the environmental movement. Choosing this symposium as an example, the article shows how the public appearance of scientists can be understood as a form of political activism. The article shows how specialists from fields as diverse as biology, chemistry, physics, law and political sciences tried to place political messages by putting themselves in the limelight (...) as independent scientists. I argue that the symposium was both: a place of science communication intertwined with political agitation that, as should be noted, happened in a time when the West German government was working on the legislation of genetic engineering, legitimated by relying on independent expertise. It can be concluded that the discourse of scientific independence became a strategic tool in the controversial debate about the uses and dangers of genetic engineering. Thus, it draws attention to a dimension of political-scientific activity which cannot be fully grasped by the concept of ‘the expert’ that is established in the history of science. (shrink)

ZusammenfassungIm Rahmen des Modellvorhabens „Patienten als Partner—Tumorpatienten und ihr Mitwirken bei medizinischen Entscheidungen“ wurden zwischen März 2002 und August 2003 272 palliativ behandelte Tumorpatienten nach ihrer Einstellung zur Patientenverfügung und zur gewünschten Beteiligung an medizinischen Entscheidungen befragt. Von den Befragten kannten 30% Patientenverfügungen nicht, darunter signifikant mehr Befragte mit formal niedrigerem Bildungsabschluss. Es hatten bereits 11% eine Patientenverfügung abgeschlossen, 22% wollten wahrscheinlich eine abschließen, und 30% wollten keine abschließen. Es fand sich ein statistisch signifikanter Zusammenhang zwischen dem Abschluss einer Patientenverfügung (...) und dem Wunsch nach mehr eigener Entscheidungsverantwortung. Die Einstellung zur Patientenverfügung und der Wunsch nach partizipativer Entscheidungsfindung stehen in keinem statistisch signifikanten Zusammenhang. Patienten mit schriftlichen Vorausverfügungen haben einen erhöhten Kommunikations- und Rückkopplungsbedarf, auf den Ärzte sensibel eingehen sollten. Bei der Information über Patientenverfügungen sollten Menschen mit niedrigerem Bildungsstand mehr als bisher berücksichtigt werden. (shrink)

In general parlance the term sin has lost its existential meaning. Originally a Jewish-Christian term within a purely religious context, referring to a wrongdoing with regard to God, sin has slowly become reduced to guilt in the course of the secularization process. Guilt refers to a wrongdoing, especially with regard to fellow human beings. It also refers to errors of judgement with what can be tragic consequences. These errors can occur whenever human beings are called upon to act, including the (...) hospital environment. A Christian hospital has to address the issue of how to deal not only with guilt-ridden misdemeanors, but also with wrongdoing unto God, which overshadows every instance of guilt-ridden human behavior. Here, as in every parish, the Church Service is the place to acknowledge sin, confess sin, and forgive sin, beyond the boundaries of the parish itself. Article translated by Sarah L. Hans Jonas’ anti-visionary conservation-oriented environmental philosophy—prominently articulated in his seminal book The Imperative of Responsibility: In Search of an Ethics for the Technological Age —had a tremendous impact on public and philosophical debates throughout the 1980s and the 1990s. Jonas argues that the “environmental crisis” reveals an underlying fundamental “crisis” in the human-nature relation. The crisis challenges the metaphysical foundations of our Western culture—including the dominant way humans view and deal with nature. Environmental ethics, therefore, requires critical reflection on and (...) revision of the underlying philosophy of nature: ethics and philosophy of nature, Jonas argues, are twin sisters. This approach provokes severe criticism: the diagnosis objection, the origin analysis objection, the justification objection, and the problem-solution objection. Most objections are not as sound as they claim to be—although Jonas’ argumentative justification is in fact a bit weak. However, a systematic critique of the objections of the critics from an analytic perspective shows that he developed a political and practical “philosophy of nature” in which anthropology, ethics, and politics are conceptualized as a converging domain as one of the core constituents of environmentals ethics for this century.
