Roughly three years after the creation of his mandate, United Nations Special Rapporteur Maina Kiai reflects on the global state of assembly and association rights. Although the mandate was created against the backdrop of shrinking space for civil society, a massive and growing global protest movement has grabbed most of the headlines since 2011. Kiai argues that the mandate has made a measurable impact – it has helped raise awareness of repressive NGO laws, provided technical assistance to governments (...) to strengthen assembly and association rights and developed soft law. But perhaps, the most important work of the mandate has been its contribution to a better understanding of just how important the rights to freedom of peaceful assembly and association are. Assembly and association rights are a powerful tool to promote dialog, pluralism, broadmindedness, tolerance and civic participation; they satisfy people's fundamental desire to take control of their own destinies. And if anything, the past few years have taught us that the worst turmoil comes when this desire is suppressed. When people are denied something so fundamental, rage inevitably follows. When people have no outlet for that rage, it can ultimately manifest itself as something much more chaotic than a street protest. (shrink)

Sufism has been neglected in the religious discourse and educational practices of modernist Muslims in the Islamic world, including Indonesia, where Kiai Moechtar Boechari (1899-1926) had emerged as an early activist in the Muhammadiyah Surakarta and Sufism. This research aims to examine Kiai Boechari’s religious thought, emphasizing the idea of Sufism as a practice of moral education (_akhlaq_). The data of research comprised mainly documentation and library archives. The findings reveal that Kiai Boechari’s religious thinking was driven (...) by persistence in reformulating Islam to be relevant and able to answer the challenges of the modern era based on purification and dynamization. Boechari emphasized on the problem of purifying faith (_aqidah_), the dynamics of worldly _muamalah_ problems, comparative religions, women’s emancipation, and moral Sufism. Kiai Boechari’s Sufism thought emphasized the purification of _aq__i__dah_, guided by the Quran and Sunnah, respect for the Shari’a, and the practice of individual social moral education, which are characteristics of the typology of Sufism (_transcendental mysticism_), moral Sufism, and orthodox/prophetic Sufism. This was known as neo-Sufism formulated by Kiai Boechari to practice moral education. It requires persistence to carry out the process of purifying oneself from despicable and immoral traits (_takhalli_), such as anger, envy, arrogance, pride, riya, and the urge to lust; which eventually starts the process of internalizing good qualities (_tahalli_), culminating in _mahabbah_, the disappearance of the human hijab (_tajalli_), giving a peak of spiritual experience. This study implicates that, in the prophetic orientation of Sufism, spiritual experience is not an end in itself, for the sake of the experience itself, but to give meaning to actions in history. The development of social media technology makes it easy for people to access information about religious knowledge. Anyone can learn the religion from social media, one of them is Youtube. This phenomenon seems to force young Nahdlatul Ulama _kiai _such as Gus Baha, Gus Miftah, and Gus Muwafiq to be adaptive and familiar to social media like Youtube. It makes them close to being called millennial _kiai_. This paper used a phenomenological approach based on observations on Youtube that examines the (...) educational interaction of millennial kiai in carrying out the process of Islamic proselytization and creating a role model of social education that they do. The educational interaction carried out by millennial _kiai_ on Youtube is very effective in attracting the interest of citizens. The number of their viewers is between four to eight million in one year. The number of videos viewed is around one hundred editions. Whereas the role model of millennial social education of _kiai_ is analyzed through Bandura theory which starts through a process of stimulus, observation, then processed in mental cognitive, then creates motivation so that demands a response by giving likes and subscribing comments. The dehumanisation of women has been recorded in world history. In religions one can easily find interpretations that tend to be discriminatory against women. This research aims to see the humanisation of women in the Tafsir Faidh Ar-Rahman by Kiai Sholeh Darat towards the position of women in Islam. This research is a library research. Data collection was done through documentation. Furthermore, the data were analysed qualitatively by a descriptive method. The results of the study showed that. In terms of inheritance, Kyai Sholeh Darat wanted flexibility in understanding the verse regarding the portion of inheritance 2:1 so that the provisions can adapt according to the situation. In certain contexts, women may get the same share as men. Non-Muslim leadership is still being a political issue and causes polemic in Indonesia. The previous election of Governor of DKI Jakarta was remembering last controversy either probability or prohibition to vote a non-muslim as a chief. The law judgments addressing this issue are NU Congress at Lirboyo in 1999 and Bahtsul Masail Kiai Muda GP Ansor in 2017. According to Congress at Lirboyo, authorizing state affairs to a non-Muslim is not allowed, except in an emergency situation. Meanwhile, Bahtsul Masailof (...) Kiai Muda Ansor in 2017 decided that voting non-Muslim leader in Indonesia is legally and constitutionally legitimate. This paper is trying to examine istinbat method which is used in those two forums considering their position in the theory of al-Sabit and al-Mutahawwil. By conducting a literature study, the author concludes that the outcomes of Muktamar NUat Lirboyo in 1999 using the istinbat Bayani method, belongs to al-Sabit category. Meanwhile, the outcomes of Bahtsul Masail Kiai Muda GP Ansor in 2017 which is using a combination of istinbat Bayani and istislahi, belongs to an al-Mutahawwil category. (shrink)

This paper constructs the teaching of tasawuf as a scientific methods in the higher education in Indonesia. The inclusion of systematic approach is based on the teaching of tasawuf by Kiai Emet Ahmad Khotib from Cirebon West Java Indonesia. This study implemented habitus research method and historical method that centered on library research. Habitus is the mental or cognitive structure through which people deal with the social world. A person is endowed with a set of internalized schemas through which (...) they perceive, understand, appreciate and evaluate the social world. It is through such schemes that people produce their practices as well as perceive and evaluate them. Qualitative approach was applied as the basis of data analysis in this study. Results show that Kiai Ahmad Khatib is the successor of the Islamic boarding school al-Ishlah Bobos 1925-1990 of Cirebon. He set 15 system of tasawuf as the scientific system. Basically, the theory was addressed to declare Allah as the Goal, sincerity as the basis for charity or doing _iqror_ deed declare Allah, the stage of Hub or love. In the promise to Allah a learner avoid the betrayals, primarily Betrayal of Allah, Betrayal of the Prophet, Betrayal to Humans, Betrayal to the motherland. The rule of tarbiyah included in the education system should include among others: Plenary System (Manhaj mutakamilah), Upgrade and Enhancement System, One Way System, Choice System, _Tasykil_ system/form, Humans have character traits that are easy to bend, easy to straighten This trait is used as the basis by experts in fostering human awakening from weakness. This article deals with the Islamic legal reasoning behind the designation of Islamic religious leaders (kiai) in Madura as mustahiq zakat, highlighting the negotiation between fiqh, socio-political dynamics, and cultural interests in Indonesia’s evolving Muslim society. The kiai play a central role in both religious and socio-political domains. This article explores the justification for their eligibility to receive zakat and their responses to this designation. Employing a qualitative approach, data were collected through participant observation, in-depth interviews, and document (...) analysis. The findings reveal that kiai have engaged in an internalization process by interpreting the category of fi sabilillah as a legal basis to include themselves as mustahiq zakat. Their interpretation is constructed through three strategies: externalization, objectification, and internalization. Furthermore, as holders of religious authority, kiai expand this interpretation to legitimize their right to zakat within a broader socio-religious framework. (shrink)

This paper examines character education as discussed through Kitab Adab al-‘Alim wa al-Muta’allim by the founder of the largest Muslim organization in Indonesia, Nahdlatul Ulama, Kiai Hasyim Asy’ari. It tries to locates character education as the transformation of Muslim subjects as the foundation of social piety. The article further argues that Kiai Hasyim Asy’ari through his work had laid a comprehensive Islamic values that are parallel to principles of character education. The core values of Islamic character education centers (...) on the notions of rabbaniyah, insaniyah, wasathiyyah and waqi’iyyah. Therefore, Kitab Adab al-‘Alim wa al-Muta’allim reserves as a pesantren-based character education with a particular reference of creating a Muslim subject with social-piety element. (shrink)

In its early periods, pesantren as a type of Islamic educational institution focused merely on religious teachings. Socio-political pressures and the need to carry out Islamic outreach have pushed kiai as pesantren leaders to negotiate their idealism according to the circumstances in different historical periods. Historical accounts from the Dutch colonial period to Indonesian independence show that kiai leadership becomes the decisive factor as well as the legitimation for pesantren to take certain actions during precarious situations. To examine (...) the institutional development of pesantren in the post-reformation era, a recent ethnographic fieldwork has been carried out in three pesantren in Madura, Java, and Lombok. This paper discusses the development and transformation of pesantren as an institution from the Dutch Ethical Policy Period until today. It demonstrates pesantren’s involvement in anti-Western campaigns and trials of affiliation with oppositions in the colonial period. This paper shows how Islamic virtues remain the heart of pesantren education and examines how innovation in contemporary pesantren regarding pedagogies and values translated in seemingly non-religious areas is substantially based on religious values.
