Em mais de uma ocasião, e em variados escritos, Tarso Mazzotti enfatizou a importância do diálogo e do debate como parte constitutiva do fazer científico e demonstrou a importância da Teoria da Argumentação como ferramenta essencial ao exame das teorias e doutrinas pedagógicas. Podese seguramente identificar como algumas das principais características da filosofia da educação, praticada por este autor, o rigor na apresentação das idéias e construção dos argumentos, além do amplo espectro de temas que aborda. Seu último livro, Doutrinas (...) pedagógicas: máquinas produtoras de litígio, é um testemunho da originalidade inerente ao seu pensamento, que focaliza, dessa feita, o exame de algumas doutrinas pedagógicas, as quais, a partir do século XVII, operam direta ou indiretamente nos discursos a respeito da educação escolar. Climate change involves changes in the climate system caused by polluting human activities and the social and natural effects of these changes. The historical and anthropogenic grounds of climate change play an important role in climate justice claims. Many climate justice scholars believe that principles of climate justice should account for the historical and anthropogenic sources of climate change. Two main backward-looking principles have been proposed: the polluter pays principle (PPP) and the beneficiary pays principle (BPP). The BPP emerged in (...) the literature on climate justice in response to certain objections raised against the PPP. In this paper, I focus on two of these objections: the causation objection and the excusable ignorance objection. Defenders of the BPP have traditionally assumed that this principle is not vulnerable to those objections, which renders the BPP superior to the PPP. In this paper, I challenge this underlying assumption. My argument here is simple: moving from the PPP to the BPP in response to any of these objections might be unjustified because the BPP is affected by at least some of the considerations giving rise to these objections. At other times he tells short stories, in such a way that only a very sensitive (...) person could do. He also reminds us of great historic moments and figures who are pointed out as examples. He contemplates present-day issues that are important, making an objective and independent analysis. All this diversity brings about a pleasant combination of texts that are carefully written and easy to read. Yet they stimulate the mind and provoke reflection. With fascinating simplicity, Luis Portela challenges us to think about the greatest matters concerning the meaning and destiny of man as a spiritual being. (shrink)

In this paper, we study the effects of using an algorithm-based risk assessment instrument (RAI) to support the prediction of risk of violent recidivism upon release. The instrument we used is a machine learning version of RiskCanvi used by the Justice Department of Catalonia, Spain. It was hypothesized that people can improve their performance on defining the risk of recidivism when assisted with a RAI. Also, that professionals can perform better than non-experts on the domain. Participants had to predict whether (...) a person who has been released from prison will commit a new crime leading to re-incarceration, within the next two years. This user study is done with (1) general participants from diverse backgrounds recruited through a crowdsourcing platform, (2) targeted participants who are students and practitioners of data science, criminology, or social work and professionals who work with RisCanvi. We also run focus groups with participants of the targeted study, including people who use RisCanvi in a professional capacity, to interpret the quantitative results. Among other findings, we observe that algorithmic support systematically leads to more accurate predictions from all participants, but that statistically significant gains are only seen in the performance of targeted participants with respect to that of crowdsourced participants. Among other comments, professional participants indicate that they would not foresee using a fully-automated system in criminal risk assessment, but do consider it valuable for training, standardization, and to fine-tune or double-check their predictions on particularly difficult cases. We found that the revised prediction by using a RAI increases the performance of all groups, while professionals show a better performance in general. And, a RAI can be considered for extending professional capacities and skills along their careers. (shrink)

The Polluter Pays Principle (PPP) states that polluters should bear the burdens as- sociated with their pollution. This principle has been highly contested because of the pu- tative impossibility of considering individuals morally responsible for an important amount of their emissions. For the PPP faces the so-called excusable ignorance objec- tion, which states that polluters were for a long time non-negligently ignorant about the negative consequences of greenhouse gas emissions and, thus, cannot be considered morally responsible for their negative consequences. (...) This paper focuses on the concept of moral responsibility as it appears in the excusable ignorance objection. I claim that this objection stems from a narrow notion of moral responsibility and that a more fundamen- tal notion of moral responsibility would pave the way to overcome it. I show that it should be out of the question whether historical polluters should bear some burdens asso- ciated with climate change because of their historical emissions. The relevant question is which kind of burdens they can legitimately be asked to bear. I argue that this notion of moral responsibility allows us to assign burdens of symbolic reparation, which are at the core of ‘Loss and Damage’ policies. (shrink)

La ciencia hoy señala que el cambio climático se ha producido a escalas sin precedentes y, sin una acción decisiva, los costos de estos impactos ambientales serán más costosos y costosos para la vida en el planeta. El ecosocialismo surge como una alternativa energética a la raíz de los problemas ambientales, que reflejan un modelo económico, social y cultural de opresión con la naturaleza, el capitalismo. La alternativa ecosocialista es una propuesta estratégica que resulta en convergencias entre la reflexión ecológica (...) y la reflexión socialista, como corriente práctica y teórica, como los movimientos ecosocialistas internacionales, como foros, congresos y promoción del conocimiento científico sobre el tema. Este trabajo presenta una síntesis analítica de la producción científica sobre ecosocialismo en disertaciones y tesis de posgrado en Brasil. El trabajo utiliza como método la construcción de una Síntesis de Evidencia Cualitativa (SEQ). La selección y perfeccionamiento de la revisión comprendió tres etapas: búsqueda, selección e inclusión de trabajos, a partir de la base de datos disponible en el Catálogo de Tesis y Disertaciones de la CAPES. Los ocho trabajos incluidos fueron tabulados mediante SEQ, utilizando seis elementos de síntesis: (1) autor y año; (2) título y tipo de investigación; (3) objetivo del trabajo; (4) metodología; (5) resultados; (6) consideraciones finales. El ecosocialismo está cada vez más presente en los movimientos sociales, brindando la base para acciones socioambientales, dentro de una base social para un bien común, que es la protección de la naturaleza. Al profundizar aún más en las publicaciones de disertaciones y tesis, se ve que de los 14 trabajos reseñados generaron temas centrales como: Emancipación y Crítica del Capitalismo; Ecosocialismo y marxismo; Justicia Socioambiental en Minería; Movimientos Sociales y Participación Política; Educación Ambiental Crítica y Transformadora; Pensamientos de Michel Löwy. The main problem of the Spanish local finance system derives from the existence of two opposite models: LOFCA model versus Floral system. As a result of this opposition, the Spanish system has moved some distance away from the theoretical principles of sound fiscal federalism. The analysis carried out in the article points out clearly the need to improve the fiscal mechanisms of responsibility and financial autonomy and to introduce a system of interjurisdictional responsibility which should palliate the defects detected in (...) the actual system in order to maximise the political and economic advantages of an authentic fiscal decentralisation.Le problème majeur du système espagnol de finances locales réside dans l’existence de deux modèles opposés: le modèle LOFCA et le système Floral. En raison de cette opposition, le système espagnol s’est considérablement écarté des principes affirmés par la théorie d’un authentique fédéralisme fiscal. L’analyse conduite dans l’article met en évidence la nécessité d’améliorer les mécanismes fiscaux de responsabilité et d’autonomie financière des collectivités locales espagnoles en introduisant un système de responsabilité inter-juridictionnelle capable d’éliminer les incohérences du système ; ce qui permettra de tirer pleinement partie des avantages politiques et économiques inhérents à la décentralisation fiscale. Debates about individual responsibility for climate change revolve mainly around individual mitigation duties. Mitigation duties concern future impacts of climate change. Unfortunately, climate change has already caused important harms and it is foreseeable that it will cause more in the future, in spite of our best efforts. Thus, arguably, individuals might also have duties related to those harms. In this paper, I address the question of whether individuals are obligated to provide compensation for climate related harms that have already occurred. (...) I explore two possible strategies to answer that question. The straightforward strategy answers in the affirmative. Two approaches embrace this strategy: the ‘ecological citizenship’ approach and the benefits-based approach. I challenge those two approaches and rule out an affirmative answer. The alternative strategy answers in the negative but provides a way to respond to why currently living individuals should pay for burdens created for past individuals. Two possible approaches embrace this alternative: the community-based approach and my own state-based benefits approach. I will argue that individual duties do not fall under the realm of compensatory justice, but they have nonetheless a duty to bear compensatory burdens allocated to their states. (shrink)

Desde la perspectiva de las ciencias jurídicas y, en particular, del derecho internacional ambiental, la presente intervención aborda la emergencia de un Derecho internacional contemporáneo y acude a las ideas del cosmopolitismo blando y la vertiente normativa del constitucionalismo global, como debates filosóficos-jurídicos que podrían cimentar un terreno fértil, un sustrato material, para incidir en las fuentes formales de creación de normas internacionales para enfrentar los problemas globales ambientales. En ese sentido, hace mención a la emergencia y reconocimiento del derecho (...) humano al ambiente sano y saludable como un derecho humano autónomo y exigible, desde su vertiente sustantiva y procesal, lo que puede vislumbrase como el embrión de una ciudadanía global ambiental. O dendê, símbolo peculiar e relevante da culinária nacional, tem sido objeto de investigação em diferentes vertentes, e neste trabalho será abordado pelo campo da visualidade e da cultura baiana. Buscou-se evidenciar o histórico do dendê, a tipologia e a classificação da estrutura formal, bem como a sua validação na religião de matriz africana do Candomblé. Nesse sentido, observa-se a existência do dendê na cultura material e imaterial das pessoas, sobretudo da população baiana, que interage nos modos de viver, trabalhar, (...) conceber imagens e repertórios. A metodologia adotada é a revisão de literatura que compreende a identidade cultural, a identidade baiana, a cultura e o cultivo do dendê, e seu simbolismo no âmbito sagrado, que se consolidou com pensadores centrais como Munanga (2020), Mariano (2009), Barreto e Freitas (2008), Bolini (2012), Lody (1992, 2009), Moraes e Pachêco (1985), Correa (2012), Oliveira (2009). Desse modo, conclui-se que o dendê é um elemento interdisciplinar presente em diversos contextos do cotidiano como na cultura, na arte, nas relações de fé, em produtos, as ações efêmeras e o imaginário coletivo. Climate scientists have proposed two methods to link extreme weather events and anthropogenic climate forcing: the probabilistic and the storyline approach. Proponents of the first approach have raised the criticism that the storyline approach could be overstating the role of anthropogenic climate change. This issue has important implications because, in certain contexts, decision-makers might seek to avoid information that overstates the effects of anthropogenic climate change. In this paper, we explore two research questions. First, whether and to what extent the (...) storyline approach overstates the effects of anthropogenic climate change. Second, whether the objections offered against the storyline approach constitute good reasons to prefer the probabilistic approach. Concerning the first question, we show that the storyline approach does not necessarily overstate the effects of climate change, and particularly not for the reasons offered by proponents of the probabilistic approach. Concerning the second question, we show, independently, that the probabilistic approach faces the same or very similar objections to those raised against the storyline approach due to the lack of robustness of climate models and the way events are commonly defined when applying the probabilistic approach. These results suggest that these objections might not constitute good reasons to prefer the probabilistic approach over the storyline approach. (shrink)

Os conceitos que tratam do processo de globalização, originários da economia a partir da década de 1980, se aplicam para a comparação e análise de alguns paradoxos ainda hoje presentes no campo da comunicação internacional. Assim como uma ‘nova ordem econômica’ versou sobre a mundialização dos negócios, na área da comunicação o desequilíbrio na circulação de informação entre países industrializados e em desenvolvimento deu origem a intensos debates internacionais que resultaram no documento oficial que tratava de uma ‘nova ordem da (...) informação e da comunicação’. Assuntos como internacionalização e transnacionalização, analisados inicialmente no domínio dos estudos econômicos e das relações internacionais, migraram para o núcleo das pesquisas comunicacionais na mesma década de 1980. Alguns autores identificam quatro linhas básicas para a interpretação do fenômeno da globalização: “(a) globalização como uma época histórica; b) globalização como um fenômeno sociológico de compressão do espaço e tempo; c) globalização como hegemonia dos valores liberais; d) globalização como fenômeno socioeconômico” (Prado, s/d). É também nos estudos econômicos que está a origem de outro conceito usado para explicar a forma como se estabeleceram as relações entre ‘centro e periferia’, com a divisão do mundo distribuída entre centros econômicos desenvolvidos (como Estados Unidos e países da Europa ocidental) e países periféricos (produtores de economia primária). No setor da comunicação, os primeiros assumiram o papel de geradores de informação e os últimos se transformaram em consumidores da produção midiática dos países industrializados. O impacto da globalização no campo da comunicação é expressivo no âmbito da indústria de mídia, em especial no que diz respeito à propriedade dos meios de massa. Conglomerados midiáticos se expandem em escala global e a audiência cresce de maneira proporcional à padronização gerada pela fusão de empresas que passaram a produzir simultaneamente notícia, entretenimento e conteúdo para a web. O fluxo da informação entre países e culturas se mantém como elemento de pesquisas desenvolvidas pela comunidade internacional de pesquisadores de comunicação. Nesse aspecto se destacam investigadores da Europa e dos Estados Unidos. São poucas as contribuições da América Latina e ainda mais reduzida a participação de pesquisadores do Brasil nessa discussão que é de interesse de todos – produtores, especialistas e público dos meios de comunicação. Os artigos que integram esta edição dedicada ao tema Globalização e Comunicação Internacional expressam o status dos estudos contemporâneos sobre o assunto. Não é por coincidência que os cinco textos, as duas resenhas e os depoimentos dos correspondentes internacionais no Rio de Janeiro, selecionados para este número tragam em comum um mesmo fio condutor: a questão do equilíbrio no fluxo da informação e de produtos midiáticos. A política de comunicação global é o foco do artigo de abertura assinado pelo Dr. Cees Hamelink, da Universidade de Amsterdã, autor com extensa produção teórica, que há vários anos coordena pesquisas e é responsável pela disciplina Comunicação Internacional na sua instituição. A participação da comunidade latino-americana na elaboração do Relatório MacBride no final da década de 1970, representada pelo colombiano Gabriel Garcia Márquez e pelo chileno Juan Somavia, é recuperada no artigo de José Marques de Melo, da Universidade de São Paulo e diretor da Cátedra Unesco no Brasil. A jornalista Sonia Ambrósio de Nelson avalia a influência de poderes políticos, econômicos e culturais na cobertura midiática do terrorismo em três países asiáticos. O artigo do professor Joseph Straubhaar, em co-autoria com estudantes de doutorado na Universidade do Texas em Austin, é uma contribuição importante para os estudos comparados entre o Brasil e os Estados Unidos, ao abordar a questão da inserção digital da população nos dois países. O artigo de Eula Dantas Taveira Cabral, resultados de pesquisa realizada para o doutorado, analisa algumas das estratégias de internacionalização de meios de comunicação brasileiros. A oportunidade de reunir em um único volume a produção científica com autores de origens distintas é uma forma sistematizar uma área de conhecimento que continua dispersa, à espera da contribuição dos investigadores de comunicação no Brasil. Este artigo objetiva compreender a essência antropológica dos conceitos de mediação implícita e explícita, principalmente, com base nas pesquisas de Oswaldo Francisco Almeida Júnior sob um viés fenomenológico. Trata-se de uma pesquisa teórica e bibliográfica de caráter exploratório-descritivo, com uma abordagem qualitativa e procedimento metodológico baseado na construção do conhecimento científico produzido por Telma Cristiane Sasso de Lima e Regina Célia Tamaso Mioto que consubstanciam três fases de análise da pesquisa: investigação das soluções, análise explicativa e síntese integradora, tendo como (...) referencial teórico o que foi produzido por pesquisadores, como Oswaldo Francisco de Almeida Júnior, Sueli Bortolin, João Arlindo dos Santos Neto, Angela Ales Bello e Giovanni Reale. No processo de pesquisa, percebe-se a manifestação do fenômeno estudado de forma teórica pela pesquisa bibliográfica e pela prática exemplificada por meio de relato de contexto didático-pedagógico de estudo de lendas, como ação cultural que se manifesta em uma essência antropológica, pois tanto a mediação da informação, quanto a informação só possuem sua existência e a manifestação fenomenológica do seu ser em uma vivência informacional na interação de pessoas humanas, nos sujeitos envolvidos no processo da mediação da informação. O fenômeno da mediação da informação é apreendido mediante a vivência fenomenológica como um ato antropológico. O trabalho possibilitou identificar o estudo da mediação da informação a partir da análise e da incorporação de elementos da Antropologia Filosófica e da Fenomenologia, compreendendo que o centro das ações informacionais é a pessoa humana. A pesquisa poderá contribuir para o processo de ensino-aprendizagem nos campos da Ciência da Informação e da Biblioteconomia, bem como no desenvolvimento dos processos de mediação da informação para novas e futuras pesquisas. In this article, we argue that contemporary biomedicine is shaped by two, seemingly incommensurable, organizational logics, the ‘regime of truth’ and the ‘regime of hope’. We articulate their features by drawing on debates sparked by the recent clinical trial of a new approach to the treatment of Parkinson’s Disease. We also argue that the ‘self’ is configured in the very same process whereby these two organizational logics interlock and become mutually dependent, so that the ‘self’ might be said to be (...) the effect of a ‘parasitic’ relationship between the regimes of ‘truth’ and ‘hope’. We then bring these two arguments to bear on the contrasting views of the relationship between embodiment and political subjectivity articulated by Michel Foucault and Giorgio Agamben, on the one hand, and Paul Rabinow and Nikolas Rose, on the other hand. Reflection on “the contemporary crisis” must take into account that, beyond financial problems in global capitalist administration, the crisis works over a fall of the human in relation to which every postulation of an affirmative biopolitics seems insufficient. The biopolitical condition responds to a process of nomic self-consecration of technical structures that dramatically increase the capacity to oppress without doing much for the capacity to tolerate it. This essay engages with Heidegger, Keynes, Weber and Schmitt, as thinkers of the “crisis,” (...) in order to understand their apotropaic modulations in the face of the biopolitical fall that they had themselves detected, and for which today we find ourselves without the conceptual apparatus we need to confront it. Are contemporary philosophers to follow Pyrrho of Elis in adopting his skeptic craft or at least core aspects of it as a reaction to the fact that, since immemorial times, persons have been engaged in disputes in metaphysics? Over the last 2500 years or so, most Western philosophers have not done so in being more influenced by Aristotle’s dogmatic craft than by Pyrrho’s skeptic one. Over the last fifty years or so, a few Brazilian neo-Pyrrhonist philosophers, such as Oswald Porchat, (...) Otávio Bueno and Plínio Junqueira Smith, have done the opposite in aiming to spell out the pertinence of Ancient Pyrrhonism to contemporary philosophy. On its part, this essay makes a case for the claim that one is to react to the stated fact by adopting a conflictual craft that promotes a synthesis of Pyrrho’s skeptic craft and the dogmatic craft. This synthesis: brings to light the core features of the skeptic and of the dogmatic craft; problematizes the dogmatic craft by means of the skeptic one and vice-versa so that the shortcomings of these crafts are avoided; and aims to keep certain positive aspects both of the skeptic craft and of the dogmatic one. In _Uncanny Rest_ Alberto Moreiras offers a meditation on intellectual life under the suspension of time and conditions of isolation. Focusing on his personal day-to-day experiences of the “shelter-in-place” period during the first months of the coronavirus pandemic, Moreiras engages with the limits and possibilities of critical thought in the realm of the infrapolitical—the conditions of existence that exceed average understandings of politics and philosophy. In each dated entry he works through the process of formulating a life’s worth of thought (...) and writing while attempting to locate the nature of thought once the coordinates of everyday life have changed. Offering nothing less than a phenomenology of thinking, Moreiras shows how thought happens in and out of a life, at a certain crossroads where memories collide, where conversations with interlocutors both living and dead evolve and thinking during a suspended state becomes provisional and uncertain. Este trabalho tem como principal foco de análise o currículo oficial português relacionado com a componente de História, para o Ensino Básico, em particular as ausências que aí mais sobressaem. Estas podem relacionar-se com os conhecimentos substantivos que se apartam da abordagem preconizada por variadas razões (passados incómodos? temas difíceis? grupos não poderosos? …) ou com as competências de pensamento histórico (multiperspetiva, significância, causalidade, empatia, …) que parecem ter sido esquecidas quando se estruturou certo percurso de aprendizagem para estudantes com (...) idades entre os 6 e os 15 anos. Como considerações maiores, constata-se, naqueles textos curriculares (denominado Aprendizagens Essenciais), uma aparente simplificação genérica da narrativa histórica que se conta aos mais jovens cidadãos do mundo atual. A inevitável seleção de determinados saberes em detrimento de outros, na verdade, contribui, acima de tudo, para o escamotear de uma literacia histórica que podia, e devia, alcançar outros níveis. O processo de ensino (e de aprendizagem) da História, desde o começo da escolaridade obrigatória, tem de orientar-se no sentido de uma formação cidadã, esclarecida, democrática, intertemporal. As inexistências no que concerne aos conteúdos considerados ou ao raciocínio potenciado, por sua vez, somente comprometem aquele desígnio. (shrink)

The COVID-19 pandemic has led to the widespread use of online hearings in arbitral proceedings, raising questions about the impact of such proceedings on the determination of facts underlying a dispute. This article explores the extent to which online hearings may hinder arbitrators’ ability to assess witness credibility by drawing upon the cognitive psychology literature on truthfulness determination and lie detection. A survey of the literature suggests that the ability to differentiate truthful from dishonest statements through verbal and nonverbal cues (...) is limited, leading to the notion that observing behaviors like fidgeting, gaze aversion, vocal pitch, or body posture is not particularly relevant in assessing the credibility of a witness. Instead, focusing on the content of what is reported appears to be the most relevant strategy to determine credibility. Therefore, research does not support the idea that face-to-face contact with witnesses is essential to determine the facts of a dispute. Still, the use of in-person hearings may, in practice, continue to be preferred due to underlying cultural assumptions regarding the nature of hearings, the facilitation of communication between parties, counsel, and the tribunal, and a general sense of _Zoom fatigue_. This essay focuses on the similarities between Nietzsche’s and Carnap’s views on metaphysics, without ignoring their obvious differences. The essay argues that Nietzsche and Carnap endorse but interpret differently an overcoming metametaphysics characterized by the conjunction of the following three claims: an overcoming of metaphysics ought to be performed; this overcoming is to be performed by adopting a method of linguistic analysis that is suspicious of the metaphysical use of language and that interprets such use through a different use of (...) language which aims to avoid metaphysics; and this overcoming contributes to the political task of resisting “diseased” metaphysical practices and promoting “healthy” non-metaphysical practices. The present article aims to present how the different philosophical perspectives have tackled the problem of the foundations of our responsibility to future generations in the context of ecological crisis. The main theories addressed here will be Hans Jonas metaphysical foundation, utilitarianism, communitarianism, the rights theory and contractarian perspectives derived from John Rawls’s theory. By assessing these perspectives, I assert that, against jonasianianism and related perspectives, our responsibilities to future generations must be thought of in terms of “political, not metaphysical”. The foundation of these responsibilities must be based, not on God, nor compassion, nor benevolence, nor identity sentiments, but on a conception of ourselves as rational and reasonable persons. From my point of view, we must find our responsibilities to future generations in our respect for their necessities and interests as well as in the maintenance of their available opportunities. This point of view allows us to point out some of our future challenges in the intergenerational justice scope. (shrink)
