Can epistemic luck be captured by modal conditions such as safety from error? This paper answers ‘no’. First, an old problem is cast in a new light: it is argued that the trivial satisfaction associated with necessary truths and accidentally robust propositions is a symptom of a more general disease. Namely, epistemic luck but not safety from error is hyperintensional. Second, it is argued that as a consequence the standard solution to deal with this worry, namely the invocation of content (...) variation, fails. Third, it is considered whether the condition can serve some restricted theoretical role; the hypothesis is rejected. Finally, it is tentatively suggested that epistemic luck’s hyperintensionality derives from its being an explanatory notion, and an analogy is drawn with failures of probabilstic conceptions of explanation in the philosophy of science. As medical technology advances and severely injured or ill people can be kept alive and functioning long beyond what was previously medically possible, the debate surrounding the ethics of end-of-life care and quality-of-life issues has grown more urgent. In this lucid and vigorous book, Craig Paterson discusses assisted suicide and euthanasia from a fully fledged but non-dogmatic secular natural law perspective. He rehabilitates and revitalises the natural law approach to moral reasoning by developing a pluralistic account of just why (...) we are required by practical rationality to respect and not violate key demands generated by the primary goods of persons, especially human life. Important issues that shape the moral quality of an action are explained and analysed: intention/foresight; action/omission; action/consequences; killing/letting die; innocence/non-innocence; person/non-person. Paterson defends the central normative proposition that ’it is always a serious moral wrong to intentionally kill an innocent human person, whether self or another, notwithstanding any further appeal to consequences or motive’. Touch is the first sense to develop in the womb, yet often it is overlooked. The Senses of Touch examines the role of touching and feeling as part of the fabric of everyday, embodied experience. -/- How can we think about touch? Problems of touch and tactility run as a continuous thread in philosophy, psychology, medical writing and representations in art, from Ancient Greece to the present day. Knowledge excludes luck. According to the received view, this intuition reveals that knowing is essentially modal in character. This paper demurs. Either knowledge does not exclude luck, or the entailment reveals nothing about its conceptual character. It is argued that knowledge excludesaccidentality, and that this notion is not modal but causal‐explanatory. There are three central tasks. The first is to explicate the concept of accident. The second is to argue that the concepts of luck and accident are “intensionally distinct,” which (...) is to say that no member of the intension of either holds on both. This paper examines group speech acts to argue against the view, here called speaker intentionalism, that one is a speaker behind a speech act in virtue of having the relevant communicative illocutionary intention. An alternative view is presented called speaker responsibilism according to which one is a speaker in virtue of having certain responsibilities. Complexities are considered which arise from the kinds of responsibilities the speaker has and the specific ways in which they are acquired.

We frequently trust others—even strangers—based on little more than the good word of a third party. The purpose of this paper is to explain how such trust is possible by way of certain speech acts. I argue that the speech act of vouching is the primary mechanism at work in many of these cases and provide an account of vouching in comparison to the speech act of guaranteeing. On this account, guaranteeing and vouching both commit the speaker to certain actions (...) conditional on undesirable events. However, while guaranteeing may generate reliance in someone or something by providing insurance against bad outcomes, vouching may generate trust in another agent by way of the vouching party manifesting their own trust in the party vouched for and enjoining the addressee to trust likewise. In the chapter “A History of Ideas Concerning the Morality of Suicide, Assisted Suicide and Voluntary Euthanasia ” author Craig Paterson explores questions concerning the legitimacy of the practices of suicide, assisted suicide, and voluntary euthanasia. The aim of this article is of identifying some of the main historical protagonists, and delineating some of the key arguments that have been used for the acceptance or rejection of these practices.

A recent widely reported study found that some participants would prefer to self-administer a small electric shock than be bored. This flawed study serves as a departure point to diagram pain and sensation beyond the boundaries of the individual body, consisting of four sections. First, in terms of laboratory-based experimentation and auto-experimentation with pain, there is a long history of viewing pain and touch through introspective means. Second, later theories of pain successively widened the scope of the physiological mechanisms and (...) external influences on the organism, such as Melzack and Wall’s cybernetics-influenced gate control theory. Third, we briefly consider the nervous system as a homeostatic system, which finds an historical parallel in explanations of the milieu intérieur of the organism, via Claude Bernard and Kurt Goldstein. Fourth, pain helps tip the organism as a whole from perception to action, but also operates beyond the organism as a biopsychosocial phenomenon. (shrink)

The ‘man born blind restored to light’ was one of the foundational myths of the Enlightenment, according to Foucault. With ophthalmic surgery in its infancy, the fascination by the sighted with blindness and what the blind might ‘see’ after sight restoration remained largely speculative. Was being blind, as Descartes once remarked, like ‘seeing with the hands’? Did evidence from early cataract operations begin to resolve epistemological debates about the relationship between vision and touch in the newly sighted, such as the (...) famous ‘Molyneux Question’ posed by William Molyneux to John Locke? More recently, how have autobiographical accounts of blind and vision impaired writers and poets advanced the sighted public’s understanding of blind subjectivity? -/- Through an unfolding historical, philosophical and literary narrative that includes Locke, Molyneux and Berkeley in Britain, and Diderot, Voltaire and Buffon in France, this book explores how the Molyneux Question and its aftermath has influenced attitudes towards blindness by the sighted, and sensory substitution technologies for the blind and vision impaired, to this day. Restraint as an intervention in the management of acute mental distress has a long history that predates the existence of psychiatry. However, it remains a source of controversy with an ongoing debate as to its role. This article critically explores what to date has seemingly been only implicit in the debate surrounding the role of restraint: how should the concept of validity be interpreted when applied to restraint as an intervention? The practice of restraint in mental health is critically examined (...) using two post-positivist constructions of validity, the pragmatic and the psychopolitical, by means of a critical examination of the literature. The current literature provides only weak support for the pragmatic validity of restraint as an intervention and no support to date for its psychopolitical validity. Judgements regarding the validity of any intervention that is coercive must include reference to the psychopolitical dimensions of both practice and policy. (shrink)

Recent social theory that stresses the ‘nonrepresentational’, the ‘more-than visual’, and the relationship between affect and sensation have tended to assume some kind of break or rupture from historical antecedents. Especially since the contributions of Crary and Jay in the 1990s, when it comes to perceiving the built environment the complexities of sensation have been partially obscured by the dominance of a static model of vision as the principal organizing modality. This article returns to some prior historical articulations of the (...) significance of motility in perception, retracing pathways across art history, architectural theory and the history of neuroscience to argue for an alternative model based on the movement of the eye. Along with subsystems that deal with balance and orientation, I offer parallels between spatial motifs of the interior spaces of the body – labyrinths, vestibules, chambers – and those in artefacts and the built environment that contribute to the heightened physicality of the oculomotor subject. The paper is, above all, meant to caution or warn providers of subtle but serious harm that can occur in institutional settings. I want to attune providers to the ways in which institutional coercion and violence occur in the ordinary (...) process of following rules and filling of roles. Thus I write that the goal is “to become self-conscious observers of systems of compliance, rather than unconscious conformers.” Institutional coercion is a social process like any other and thus involves intersubjective dynamics. These dynamics do not appear as measurable, physical structures, but rather as invisible patterns in time, made visible only by being named and grasped experientially. I am offering language that can help make these invisible dynamics visible, so that providers can navigate institutions differently.My desire to caution and attune other providers can be explained partly by the conditions in which I wrote the paper: making sense of my time in forensic mental health, where I worked with clients who were mandated mental health treatment upon avoiding or exiting incarceration. I was processing my own experience of submitting monthly “compliance reports” to various agencies. I was concerned with the experiential process of navigating coercive environments. Thus my commenter is correct to try and widen our consideration, as my paper is indeed limited by its focus on the lived experience of censorship, oppression, and institutional coercion.This emphasis means that I am neglecting other dimensions, such as the positive role of rules in organizing communities, and the way in which some mental health institutions are working on creating safe and healing formal environments. I also believe, however, that the fields of psychology, psychiatry, and mental health broadly need to be careful about institutions, rules, and roles. We are not, in my estimation, in danger of providing too many safe spaces in which healing can occur. Quite the opposite, psychiatry and psychotherapy have, since their outset, been intertwined with troubling political motivations, and we continue to struggle with the manipulative tendencies of the field (Carr, 2018; Cabanas & Illouz, 2021).I, therefore, would like to take this opportunity to restate the core argument of my paper, and to situate this argument within the context of my other publications and the overall project they belong to. When commenting on my discussion of schizophrenia, my commenter refers to it as “the seeming central topic of the paper.” This is understandable. Schizophrenia is the topic I discuss that has the most obvious clinical implications. Indeed, I am making an argument about the phenomenological intelligibility of schizophrenia. With both my discussions of schizophrenia and censorship, however, I am making both immanent arguments and transcendent arguments. In other words, although I am making arguments about both schizophrenia and censorship, those arguments need to be understood as an example of a broader problem of coercion within human relationships. My intent is to highlight general dynamics present within human relationships and communities that contribute to institutional violence and the excessive regulation of individuals. My concern is with rules, roles, and coercion in general; schizophrenia and censorship provide exaggerated examples of what is fundamentally an ordinary, daily experience. Mental health institutions are uniquely involved in coercive institutional processes, but almost all human environments carry some danger of coercion and oppression in terms of fitting, belonging, or conforming with rules and roles. My exploration of schizophrenia and censorship is certainly meant to illuminate those particular topics, but the broader point concerns all human experience.The phenomenological or experiential thrust of the paper must be situated within my broader analysis that also includes institutional and epistemological dimensions. My reviewer is correct to point out that with schizophrenia, censorship, or trauma, the crucial dimension is communities in which people feel safe enough to learn, grow, and develop their capacities. Determining appropriate legal responses to the conduct of health care workers who endanger patients continues to provoke fierce debate. This is particularly true in the context of criminal law, which offers punishment as an obvious strategy. In the first of three papers which make up this issue's extended Health Care Law feature, Professor Alexander McCall Smith and Dr Alan Merry argue against the prosecution of health care workers except in circumstances where there is very dear evidence of a culpable frame (...) of mind. They do so against the backdrop of their description of proposed changes in New Zealand legislation on medical manslaughter. The catalyst for this change was a judge's refusal to countenance the prosecution of an anaesthetist for manslaughter for inadvertent error. In the authors' opinion the intervention by the New Zealand judge has given rise to a long overdue review of a harsh penal measure. However, in a commentary on McCall Smith and Merry's paper, Ron Paterson argues that all is not what it seems and that--in the light of New Zealand's 'no fault' system of compensation for medical accident--the present system should be maintained. In this chapter I seek to examine the credibility of Finnis’s basic stance on Aquinas that while many neo-Thomists are meta-ethically naturalistic in their understanding of natural law theory (for example, Heinrich Rommen, Henry Veatch, Ralph McInerny, Russell Hittinger, Benedict Ashley and Anthony Lisska), Aquinas’s own meta-ethical framework avoids the “pitfall” of naturalism. On examination, the short of it is that I find Finnis’s account (while adroit) wanting in the interpretation stakes vis-à-vis other accounts of Aquinas’s meta-ethical foundationalism. I think (...) that the neo-Thomists are basically right to argue that for Aquinas we cannot really understand objective truths about moral standards unless we derive them from our intellective knowledge of natural facts as given to us by the essential human nature that we have. While I find Finnis’s interpretative position on Aquinas wanting, I go on to argue that his own attachment to non-naturalism is justified and should not be jettisoned. Because I think non-naturalism important to the future tenability of a viable natural law ethics (an ethics that is both cognitive and objectivist), I argue that Finnis should, so to speak, “beef up” his “fundamental option” for non-naturalism and more fully avail himself of certain argumentative strategies available in its defense, argumentative strategies that are inspired by the analytical philosophy of G.E. This paper provides an account of anonymous speech treated as anonymized speech. It is argued that anonymous speech acts are best defined by reference to intentional acts of blocking a speaker's identification as opposed to the various epistemic effects that imperfectly correlate with these actions. The account is used to examine two important subclasses of anonymized speech: speech using pseudonyms, and speech anonymized in a specifically communicative manner. Several pragmatic and ethical issues with anonymized speech are considered.

This book critically examines the case for and against the belief in personal survival of bodily death. It discusses key philosophical questions. How could a discarnate individual be identified as a person who was once alive? What is the relationship between minds and their brains? Is a 'next world' conceivable? The book also examines classic arguments for the immortality of the soul, and focuses on types of prima facie evidence of survival: near-death experiences, apparitions, mediumistic communications, and ostensible reincarnation cases.

The article examines from an historical perspective some of the key ideas used in contemporary bioethics debates both for and against the practices of assisted suicide and euthanasia. Key thinkers examined--spanning the Ancient, Medieval and Modern periods--include Plato, Aristotle, Augustine, Aquinas, Hume, Kant, and Mill. The article concludes with a synthesizing summary of key ideas that oppose or defend assisted suicide and euthanasia.

The work of Dan Brock and Helga Kuhse is typical of the current stream of thought rejecting the validity of sanctity of life appeals to instill objective inviolable worth in human life regardless of the quality of life of the patient. The context of a person's life is supremely important. In their systems life can have high value, yet the value of life can be outweighed by the force of other disvalues. The notion of quality of life has increasingly come (...) to signify the measurement of the worth of a person's life itself. Having a life equals personal life. Any objectivity to life resides in 'personal', 'biographical', or 'creative' life, not mere biological life. Personal life represents the minimal threshold for any objective worth. In responding to this challenge, John Finnis has argued extensively that life is an intrinsic good – a basic human good. Following from our grasp of human life as a basic incommensurable good, it cannot be practically reasonable both to affirm that (a) 'human life is a basic human good', and (b) that 'human life qua human life can be intentionally acted against to its destruction'. Yet, if the good of human life can be considered self-evident, the self-evidence of the basic human good qua good does not mean that dialectical reasoning cannot be engaged in to indirectly support the practical reasonableness of respecting the good of human life in the deliberative choices that persons make concerning their actions. It is to the use of such dialectical reasoning, supportive of the status of human life as such a basic human good, that the article is primarily concerned to draw out and articulate. (shrink)

This overview proceeds by outlining, albeit very briefly, something of the historical growth of Thomism, turning then to a brief account of how analytic philosophy in the twentieth century can be viewed in relation to that history, before finally turning to a further consideration of what the phrase “Analytical Thomism,” can be taken to mean in light of this brief historical account.

There are numerous ‘solutions’ to the problem of evil, from which theists can and do freely take their pick. It is fairly clear that any attempt at a solution must involve a scaling-down of one or more of the assertions out of whose initial conflict the problem arises – either by a downward revision of what we mean by omnipotence, or omniscience, or benevolence, or by minimizing the amount or condensing the varieties of evil actually to be found in the (...) universe. And indeed, in one or more of these different ways, the charge of logical inconsistency can no doubt always be vouchsafed at least a formal answer. Unfortunately, the mere ironing-out of formal inconsistencies does not of itself go very far towards providing a solution to this central problem of theism which will be morally, religiously, and intellectually convincing and acceptable as well as logically impeccable. Everything depends on how the inconsistencies are ironed out. For every attempt at a solution of the problem of evil has to be made at a price, in keeping with the scale and type of conceptual or ethical readjustments which it requires of us. And if the solutions which are generally offered seldom seem to carry much conviction, this is because the price they require us to pay nearly always seems far too high. A ‘solution’ to the problem of evil that is to count as a genuine solution must not require us to make any conceptual or ethical readjustments which it would not on independent grounds be entirely reasonable to make. A ‘solution’ that was finally to count as the solution of the problem of evil would presumably need to be that particular one which required us to make only those conceptual and ethical readjustments which were on independent grounds the ones that it was the most reasonable to make. What follows is offered as a solution, in the above sense, of the problem of evil. However, I shall not here attempt to argue that it is the solution. (shrink)

This paper concerns sock puppetry, a practice which involves an individual communicating under multiple pseudonymous identities in a manner that makes it seem as though these personas are distinct conversational participants. I provide a definition of sock puppetry that is more narrow than other definitions, allowing it to be distinguished from related phenomena. I then analyse some of the ways in which sock puppetry can interfere with social tools we use for establishing trust within an online community, evaluating a speaker's (...) credibility, and generally deciding who and what to believe. Both individuals and groups sometimes make use of proxy agents who perform actions on their behalf. Although these kinds of actions are vital to our social and political lives, they raise deep questions about agency and responsibility. One concern is whether and in what ways a principal can be responsible for actions performed by way of their proxy. I argue here that two conditions are necessary if a principal is to be considered responsible for such actions in a deep sense. (...) First the proxy must be properly authorised, and second the action performed must cohere with the principal’s deliberative perspective. A consequence of this is that successful proxies will often be those who learn to adopt and act from the perspective of the principal they represent. The capacity to reason from the perspective of another individual or group is therefore of great importance in the work of spokespersons and other proxies. (shrink)

In this paper, I seek to advance the thesis that if we are to come to a better appreciation of the historical rootedness of philosophical thinking, we must strive to encourage the contextualization of philosophical texts and support this goal by developing methods and tools for research that are facilitative of this contextualist goal.

Adopting a comparative UK/US approach, this article argues for the need to rethink corporate bankruptcy theory in the light of developments in the finance market. It argues that these developments have produced an effective mechanism, in large cases, for selecting between companies which will be worth more if they continue to trade and companies which ought to be allowed to fail, so that corporate bankruptcy law need no longer concern itself with steering creditor choice away from a sale of the (...) business and assets and towards a restructuring. Moreover, it suggests that whilst the automatic stay remains a central tenet of corporate bankruptcy law where the market decides that the business and assets should be sold, in cases where the market sees more value if a company continues to trade, corporate bankruptcy law may operate very well without a stay as a resolution procedure for deadlocked negotiations. The article identifies that in many large restructuring cases the only liabilities that are implicated are financial liabilities, and queries the extent to which the distributional concerns of the progressive movement, and US federal bankruptcy law, apply where losses are shared amongst sophisticated financial institutions. It ends with an explanation of why the analysis is limited to large cases, an indication of areas for further research and a note of caution for the future. (shrink)

All too often in applied ethics debates, there is a danger that a lack of analytical clarity and precision in the use of key terms serves to cloud and confuse the real nature of the debate being undertaken. A particular area of concern in my analysis of the bioethics literature has been the uses to which the key terms “suicide,” “assisted suicide,” and “euthanasia” are put. The modest aim of this article is to render a contribution to the applied ethics (...) debate on these topics by seeking to delimit the scope and meaning of these terms. The criteria of specificity, non-arbitrariness, consistency (between various terms), and the avoidance of strong pejorative presuppositions, supply the main standards guiding my adoption of usages. The first part of the paper, “Foyer: feeling, look- ing, between-us” establishes the role of touch in intersubjectivity. Starting with Irigaray’s notion of the entre-nous, the “between-us,” I use touch as an example of deeply intersubjective communi- cation, an attempt to overcome estrangement. The ambiguity of touching, the physical action of touching and the affective reaction of feeling, is central to this. The second section, “Reception: receptivity, orderings of the sensible,” consolidates this experience of intersubjective touching within the confines of (...) the demarcated spatial divisions of the hotel, which leads to insights concerning the physical and psychical architecture of the archetypal hotel. We return to examine the notion of “estrangement,” questioning how and why it is altered by spatial layout and sequencing. In this section I subject the usual discussion of Freud’s unheimlich or “uncanny” to some affective spatial observations, and suggest Caillois’ idea of “psychasthenia” (1987) as a useful supplement to think about touching and feeling in the unhomely home of the hotel. The third section, “Room: the caress,” of Levinas’ notion of the caress and Irigaray’s reading of this, from which I grasp towards an ethical-affective relation of between-ness, as much through non-touching as through physical touching. Chapter one argues for the important contribution that a natural law based framework can make towards an analysis and assessment of key controversies surrounding the practices of suicide, assisted suicide, and voluntary euthanasia. The second chapter considers a number of historical contributions to the debate. The third chapter takes up the modern context of ideas that have increasingly come to the fore in shaping the 'push' for reform. Particular areas focused upon include the value of human life, the value of (...) personal autonomy, and the rejection of double effect reasoning. Chapter four engages in the task of pointing out structural weakness in utilitarianism and deontology. The thesis argues that major systemic weaknesses in both approaches can be overcome by a teleology of basic human goods. John Finnis' work becomes the underpinning of subsequent applied natural law analysis. Chapter five proceeds to argue for the defence of the intrinsic good of human life from direct attack. The thesis holds out for the proposition "that it is always a serious moral wrong to intentionally kill a human person, whether self or another, regardless of a further appeal to consequences or motive." In support of this, it defends the validity of double effect reasoning as an indispensable part of applied moral decision making. Chapter six critically assesses the arguments of anti-perfectionists that it is not the business of the state to enforce deep or substantive conceptions of the 'good life.' The chapter moves on to argue that the natural law conception of the person in society, centred on the common good, provides a solid framework for assessing both the justification for, as well as the limits on, the role of the state to use its power to legally impose certain moral standards. Chapter seven addresses the concrete relationship between natural law and legal policy by exploring the issue of assisted suicide in the constitutional context of the United States.

The concept of stewardship as resource development and conservation, a shallow environmental ethic, arises out of a domination framework. Stewardship as earthkeeping arises out of a keeping framework and falls somewhere between an intermediate and deep environmental ethic. A notion of agricultural stewardship, based on earthkeeping principles, can be used as a normative standard by whichto judge a range of agricultural economies and practices.

This paper is concerned with situations in which a speaker issues many speech acts at the same time. A common example is the publication of a large text such as a book containing many distinct assertions. It is argued that these cases present a challenge for speech act theory related to how we are to understand sincerity. With reference to the well known paradox of the preface, it is argued that sincerity of such bulk speech cannot be understood as a (...) simple conjunction of the sincerity of the encoded acts. A proposal is given according to which sincere bulk speech requires the speaker explicitly and as precisely as possible mark any subsets of her communication about which she has doubts. (shrink)
