Psychopathy has been theorized as a disorder of emotion, which impairs moral judgments. However, these theories are increasingly being abandoned as empirical studies show that psychopaths seem to make proper moral judgments. In this contribution, these findings are reassessed, and it is argued that prevalent emotion‐theories of psychopathy appear to operate with the unjustified assumption that psychopaths have no emotions, which leads to the hypothesis that psychopaths are completely unable to make moral judgments. An alternative and novel explanation is proposed, (...) theorizing psychopathy as a degree‐specific emotional deficiency, which causes degree‐specific differences in moral judgments. (shrink)

The psychiatric diagnosis of psychopathic personality—or psychopathy—signifies a patient stereotype with a callous lack of empathy and strong antisocial tendencies. Throughout the research record and psychiatric practices, diagnosed psychopaths have been predominantly seen as immune to psychiatric intervention and treatment, making the diagnosis a potentially strong discriminator for treatment amenability. In this contribution, the evidence in support of this proposition is critically analyzed. It is demonstrated that the untreatability perspective rests largely on erroneous, unscientific conclusions. Instead, recent research suggests that (...) practitioners should be more optimistic about the possibility of treating and rehabilitating diagnosed psychopaths. In light of this finding, concrete ethical challenges in the forensic practice surrounding the psychopathy diagnosis are discussed, adding to a growing body of research that expresses skepticism about the forensic utility of the diagnosis. Recent debates in psychopathy studies have articulated concerns about false-positives in assessment and research sampling. These are pressing concerns for research progress, since scientific quality depends on sample quality, that is, if we wish to study psychopathy we must be certain that the individuals we study are, in fact, psychopaths. Thus, if conventional assessment tools yield substantial false-positives, this would explain why central research is laden with discrepancies and nonreplicable findings. This paper draws on moral psychology in order to develop (...) tentative theory-driven exclusion criteria applicable in research sampling. Implementing standardized procedures to discriminate between research participants has the potential to yield more homogenous and discrete samples, a vital prerequisite for research progress in etiology, epidemiology, and treatment strategies. Mental health research faces a suite of unresolved challenges that have contributed to a stagnation of research efforts and treatment innovation. One such challenge is how to reliably and validly account for the subjective side of patient symptomatology, that is, the patient’s inner experiences or patient phenomenology. Providing a structured, standardised semantics for patient phenomenology would enable future research in novel directions. In this contribution, we aim at initiating a standardized approach to patient phenomenology by sketching a tentative formalisation within (...) the framework of an applied ontology, in the broader context of existing open-source Open Biomedical Ontologies resources such as the Mental Functioning Ontology. There have been renewed calls to use phenomenology in psychiatry to improve knowledge about causation, diagnostics, and treatment of mental health conditions. A phenomenological approach aims to elucidate the subjective experiences of mental health, which its advocates claim have been largely neglected by current diagnostic frameworks in psychiatry (eg, DSM-5). The consequence of neglecting rich phenomenological information is a comparatively more constrained approach to theory development, empirical research, and care programmes. Although calls for more phenomenology in psychiatry have been met (...) with enthusiasm, there is still relatively little information on how to practically facilitate this integration. In this Personal View, we argue that phenomenological approaches need a shared semantic framework to drive their innovative potential, thus enabling consistent data capture, exchange, and interoperability with current mental health data and informatics approaches (eg, the Research Domain Criteria project). We show how an applied ontology of phenomenological psychopathology offers a suitable method to address these challenges. (shrink)

This letter addresses the editorial decision to publish the article, “Research on group differences in intelligence: A defense of free inquiry” (Cofnas, 2020). Our letter points out several critical problems with Cofnas's article, which we believe should have either disqualified the manuscript upon submission or been addressed during the review process and resulted in substantial revisions.

Recent contributions in moral philosophy have raised questions concerning the prevalent assumption that moral judgments are typologically discrete, and thereby distinct from ordinary and/or other types of judgments. This paper adds to this discourse, surveying how attempts at defining what makes moral judgments distinct have serious shortcomings, and it is argued that any typological definition is likely to fail due to certain questionable assumptions about the nature of judgment itself. The Hare Psychopathy Checklist (PCL; Hare, Neumann, & Mokros 2018) scales are among the most widely used forensic assessment tools. Their perceived utility rests partly on their ability to assess stable personality traits indicative of a lack of conscience, which then facilitates behavioral predictions useful in forensic decisions. In this systematic review, we evaluate the empirical evidence behind 3 fundamental justifications for using the PCL scales in forensics, namely, that they are empirically predictive of (1) criminal behavior, (2) treatment outcomes, (...) and (3) a lack of conscience. We found the PCL scales can predict criminal behavior to a statistically significant degree, though with important limitations. We found no evidence of PCL psychopathy being predictive of treatment and rehabilitation outcomes. We found no evidence of PCL psychopathy being predictive of a lack of conscience. These findings disprove widespread beliefs about PCL psychopathy among forensic practitioners and questions the current and future role of the PCL scales in forensic settings. (shrink)

We may correctly say that Søren Kierkegaard is one of the most influential Christian-religious thinkers of the modern era, but are we equally justified in categorizing his writings as foundationally religious? This paper challenges a prevailing exclusive-theological interpretation that contends that Kierkegaard principally writes from a Christian dogmatic viewpoint. I argue that Kierkegaard’s religion is better understood as an outcome of his philosophical analysis of human nature. Conclusively, we should appreciate Kierkegaard first as a philosopher, whose aim is the explication (...) of human subjectivity, and not primarily as an orator of Christian orthodoxy. (shrink)

Advances in emotion and affective science have yet to translate routinely into psychiatric research and practice. This is unfortunate since emotion and affect are fundamental components of many psychiatric conditions. Rectifying this lack of interdisciplinary integration could thus be a potential avenue for improving psychiatric diagnosis and treatment. In this contribution, we propose and discuss an ontological framework for explicitly capturing the complex interrelations between affective entities and psychiatric disorders, in order to facilitate mapping and integration between affective science and (...) psychiatric diagnostics. We build on and enhance the categorisation of emotion, affect and mood within the previously developed Emotion Ontology, and that of psychiatric disorders in the Mental Disease Ontology. This effort further draws on developments in formal ontology regarding the distinction between normal and abnormal in order to formalize the interconnections. This operational semantic framework is relevant for applications including clarifying psychiatric diagnostic categories, clinical information systems, and the integration and translation of research results across disciplines. Søren Kierkegaard is often considered to be one of the most vocal critics of German idealism. The present paper analyzes the philosophical similarity between Friedrich Schelling ’s early idealistic work and Kierkegaard ’s existential writings, endeavoring to display Schelling ’s epic 1809 publication Philosophical Investigations into the Essence of Human Freedom as a possible forerunner to Kierkegaard. This juxtaposition reveals concrete similarity that supports the thesis that Schelling ’s work could have been of great inspirational value for Kierkegaard, especially Kierkegaard (...) ’s core concepts such as freedom, morality and God. However, Schelling ’s early work is primarily appreciated as a philosophy of nature, and therefore fundamentally different from Kierkegaard ’s theistic-psychological writings. The present paper tentatively opposes this distinction, concluding that if Schelling really is a forerunner to Kierkegaard, then we ought to appreciate Kierkegaard ’s writings as conveying more than a theological message. The conclusion suggests that Kierkegaard ’s writings should be interpreted in a broader philosophical context, closer to the metaphysical idealism he is often assumed to resist. (shrink)

In this paper, we consider Noël Carroll’s Content Theory (CT) (2015) and argue that a key problem with CT is that it can be interpreted in two distinct ways: as a descriptive theory of aesthetic experience and as a normative prescriptive theory. Although CT is presented as a descriptive theory of experience, much of what Carroll says implies that CT can also be understood as a theory about how one ought to look at artworks. We argue that when understood as (...) a descriptive theory, CT fails to qualify as a meaningful theory of aesthetic experience. We then interpret the theory prescriptively. Ultimately, this second interpretation is also found lacking: if the aim of the theory is to instruct one on how to view art, it is no longer an attempt to characterize the experience of art. We conclude by arguing that the main flaw in CT is its approach: we cannot meaningfully characterize an experience by enumerating the objects that supposedly cause said experience, and any theory that takes such an approach is likely to be unsuccessful. We demonstrate that many philosophers accept the following claim: When an aesthetic object is apprehended correctly, taking pleasure in said object is a reliable sign that the object is aesthetically successful. We undermine this position by showing that what grounds our pleasurable experience is opaque: In many cases, the experienced pleasure is attributable to factors that have little to do with the aesthetic object. The evidence appealed to is a form of Higher-Order Evidence (HOE) and we consider attempts to overcome (...) said evidence. We argue they are unsuccessful. We argue that there is significant evidence for reconsidering the possibility that moral judgment constitutes a distinctive category of judgment. We begin by reviewing evidence and arguments from neuroscience and philosophy that seem to indicate that a diversity of brain processes result in verdicts that we ordinarily consider “moral judgments”. We argue that if these findings are correct, this is plausible reason for doubting that all moral judgments necessarily share common features: if diverse brain processes give rise to what we (...) refer to as “moral judgments”, then we have reason to suspect that these judgments may have different features. After advancing this argument, we show that giving up the unity of moral judgment seems to effectively dissolve the internalism/externalism debate concerning motivation within the field of metaethics. In philosophy of aesthetics, scholars commonly express a commitment to the premise that there is a distinctive type of judgment that can be meaningfully labeled “aesthetic”, and that these judgments are distinctively different from other types of judgments. We argue that, within an Aristotelian framework, there is no clear avenue for meaningfully differentiating “aesthetic” judgment from other types of judgment, and, as such, we aim to question the assumption that aesthetic judgment does in fact constitute a distinctive kind of judgment (...) that is in need of, or can be subject to, distinctive theorizing. We advance our argument primarily through demonstrating that leading contemporary accounts of aesthetic judgment do not successfully distinguish a type of judgment in that they do not tell us how making an aesthetic judgment differs substantially from judging that 2 + 3 = 5, that football is entertaining, or that today is Tuesday. Questionable research practices are a well-recognized problem in psychology. Coding bias, or the tendency of review studies to disproportionately cite positive findings from original research, has received comparatively little attention. Coding bias is more likely to occur when original research, such as neuroimaging, includes large numbers of effects, and is most concerning in applied contexts. We evaluated coding bias in reviews of structural magnetic resonance imaging (sMRI) studies of PCL-R psychopathy. We used PRISMA guidelines to locate all relevant original sMRI (...) studies and reviews. The proportion of null-findings cited in reviews was significantly lower than those reported in original research, indicating coding bias. Coding bias was not affected by publication date or review design. Reviews recommending forensic applications—such as treatment amenability or reduced criminal responsibility—were no more accurate than purely theoretical reviews. Coding bias may have contributed to a perception that structural brain abnormalities in psychopaths are more consistent than they actually are, and by extension that sMRI findings are suitable for forensic application. We discuss possible sources for the pervasive coding bias we observed, and we provide recommendations to counteract this bias in review studies. Until coding bias is addressed, we argue that this literature should not inform conclusions about psychopaths' neurobiology, especially in forensic contexts. (shrink)

Alison Assiter has put together a work that has the potential to create an exciting and stimulating debate in Kierkegaard circles. Mostly because she portrays Kierkegaard as an idealist ontologist, that is, a philosopher of not just human nature (i.e. subjectivity), but also nature in its cosmic totality. Thus, what I find most admirable is that with Assiter we have a thinker who has the philosophical courage to suggest that the purported relationship between Schelling and Kierkegaard leads necessarily to bold (...) philosophical consequences. Since Günther Figal’s 1980 article, Schelling und Kierkegaards Freiheitsbegriff, which gave us the first clue of the Kierkegaardian connection to Schelling’s Freiheitsschrift, scholars have primarily focused on reemphasizing the actual possibility of (the early) Schellingean heritage in Kierkegaard, meanwhile forgetting to ask themselves what consequences this connection might have on our interpretation of Kierkegaard’s corpus. Assiter’s book is an attempt to draw such a long needed consequence. (shrink)

Scientists use models to understand the natural world, and it is important not to conflate model and nature. As an illustration, we distinguish three different kinds of populations in studies of ecology and evolution: theoretical, laboratory, and natural populations, exemplified by the work of R.A. Fisher, Thomas Park, and David Lack, respectively. Biologists are rightly concerned with all three types of populations. We examine the interplay between these different kinds of populations, and their pertinent models, in three examples: the notion (...) of “effective” population size, the work of Thomas Park on /Tribolium/ populations, and model-based clustering algorithms such as /Structure/. Finally, we discuss ways to move safely between three distinct population types while avoiding confusing models and reality. (shrink)

There has been a recent interest in hierarchical generalizations of classic incompleteness results. This paper provides evidence that such generalizations are readily obtainable from suitably formulated hierarchical versions of the principles used in the original proofs. By collecting such principles, we prove hierarchical versions of Mostowski’s theorem on independent formulae, Kripke’s theorem on flexible formulae, Woodin’s theorem on the universal algorithm, and a few related results. As a corollary, we obtain the expected result that the formula expressing “$\mathrm {T}$is$\Sigma _n$-ill” (...) is a canonical example of a$\Sigma _{n+1}$formula that is$\Pi _{n+1}$-conservative over$\mathrm {T}$. In this essay, I undertake a critical phenomenological exposition of the conditions of ethical community as they present themselves in the light of the Anthropocene. I begin by approaching the present human condition by following Arendt in her considerations of what more recently has been termed the Anthropocene. I will take her notion of the process character of action as a lodestar in a so-called anarcheological reading of Aristotle that opens for a thinking of unbounded possibility and unbounded affinity and (...) that shows how Aristotle’s ethics, like so many other ethical and moral theories, is really a project of metaphysical closure in the face of the poignantly sensed, but theoretically marginalized, anarchic apertures of communitary life. To prepare for an ethics capable of perpetually affirming, rather than closing off, these anarchic apertures of the human condition, I bring the insights won in the anarcheological reading of Aristotle into conversation with accounts of the ethical responses presented by the Native American nation of the Crow towards the end of the 19th century, when they – in a sense not-dissimilar to what we now experience in the Anthropocene – faced the end of the world. I conclude by extracting from this some elements for a thinking of ethics at the end of worlds that affirms the unbounded apertures of human community. (shrink)

This paper sets forward a novel theory of temporal binding, a mechanism that integrates the temporal properties of sensory features into coherent perceptual experiences. Specifying a theory of temporal binding remains a widespread problem. The popular ‘brain time theory’ suggests that the temporal content of perceptual experiences is determined by when sensory features complete processing. However, this theory struggles to explain how perceptual experiences can accurately reflect the relative timing of sensory features processed at discrepant times. In contrast, ‘event time (...) theories’ suggest that the temporal content of perceptual experiences reflects the relative event time of external sensory features and that the brain accommodates differential processing times. We can formulate retrodictive and predictive versions of this theory. Retrodictive event time theories propose that we accommodate desynchronised processing retrodictively. Predictive event time theories propose that we accommodate desynchronised processing by predictively modelling the event time of sensory features. I argue that both views have strengths and weaknesses. This paper proposes a new hybrid theory that integrates these theories to accommodate these weaknesses. Firstly, I argue how retrodictions and predictions can interact in mutually beneficial ways to ensure speedy and accurate temporal binding. Secondly, I propose how attention plays a central role in flexibly selecting which contents get to be temporally bound. This theory can explain how prediction and retrodiction differentially affect temporal binding and, in turn, proposes a new way to understand temporal binding and has implications for how we should understand conscious experiences. Evo-Devo exhibits a plurality of scientific “cultures” of practice and theory. When are the cultures acting—individually or collectively—in ways that actually move research forward, empirically, theoretically, and ethically? When do they become imperialistic, in the sense of excluding and subordinating other cultures? This chapter identifies six cultures – three /styles/ (mathematical modeling, mechanism, and history) and three /paradigms/ (adaptationism, structuralism, and cladism). The key assumptions standing behind, under, or within each of these cultures are explored. Characterizing the internal structure of (...) the cultures is necessary for understanding how they collaborate or compete, and how they are fragmented or integrated, in the rich interdisciplinary /trading zone/ (Galison 1997) of Evo-Devo. Evo-Devo is an important example of how science can progress through a radical plurality of perspectives and cultures. (shrink)

A scientific explanatory project, part-whole explanation, and a kind of science, part-whole science are premised on identifying, investigating, and using parts and wholes. In the biological sciences, mechanistic, structuralist, and historical explanations are part-whole explanations. Each expresses different norms, explananda, and aims. Each is associated with a distinct partitioning frame for abstracting kinds of parts. These three explanatory projects can be complemented in order to provide an integrative vision of the whole system, as is shown for a detailed case study: (...) the tetrapod limb. My diagnosis of part-whole explanation in the biological sciences as well as in other domains exploring evolved, complex, and integrated systems (e.g., psychology and cognitive science) cross-cuts standard philosophical categories of explanation: causal explanation and explanation as unification. Part-whole explanation is itself one essential aspect of part-whole science. (shrink)

I analyze the importance of parts in the style of biological theorizing that I call compositional biology. I do this by investigating various aspects, including partitioning frames and explanatory accounts, of the theoretical perspectives that fall under and are guided by compositional biology. I ground this general examination in a comparative analysis of three different disciplines with their associated compositional theoretical perspectives: comparative morphology, functional morphology, and developmental biology. I glean data for this analysis from canonical textbooks and defend the (...) use of such texts for the philosophy of science. I end with a discussion of the importance of recognizing formal and compositional biology as two genuinely different ways of doing biology – the differences arising more from their distinct methodologies than from scientific discipline included or natural domain studied. Ultimately, developing a translation manual between the two styles would be desirable as they currently are, at times, in conflict. (shrink)

Distance, it is often argued, is the only coherent and empirically adequate world-making relation that can glue together the elements of the world. This paper offers entanglement as an alternative world-making relation. Entanglement is interesting since it is consistent even with quantum gravity theories that do not feature space at the fundamental level. The paper thereby defends the metaphysical salience of such non-spatial theories. An account of distance is the predominant problem of empirical adequacy facing entanglement as a world-making relation. (...) A resolution of this obstacle utilizes insights from the Ryu–Takayanagi formula and Susskind and Maldacena’s related ER = EPR conjecture. Together these indicate how distance can be recovered from entanglement and thus carves the way for entanglement fundamentalism. (shrink)

This article advances a tentative theory of skill in relation to eSports. This conjectural theory of skill rests on hypothesizes informed by assumptions from watching 100+ hours of eSport events on Twitch, YouTube, and AfreecaTV and is supported by discussions, reflections and evaluations with eSport players. The case material of this article includes the games Clash Royale (CR), StarCraft 2 (SC2), Counter-Strike: Global Offensive (CS:GO), and online battle arenas (mobas) such as League of Legends (LOL) and Defense of the Ancient (...) 2 (DOTA2). This inferred theory of skill is conjoined and composed of seven strands, which provide a framework for explaining how to understand skill in eSport. These seven strands are presented under the headings: (1) knowledge about game objects, (2) insights into game systems, (3) understanding metagaming, (4), yomi: ‘reading’ the opponent, (5) ability to execute, (6) emotional discipline, and finally (7) team coherency (depending upon whether the skill is associated with a one-versus-one or team-versus-team game). In conclusion, the proposed theory of skill will expose its explanatory power and reach by providing an example of how it can both be implemented to create profiles of players’ skill, and how these profiles in turn can serve as guides to help players improve their skill levels in eSport. In this article, we discuss the practice of conducting research in one's own field, in this case, from a position as a researcher with a nursing background doing fieldwork in a hospital and in one's own organization, an orthopedic surgical department. We show how an “insider” researcher position paves the way for analytical insights about sleep as an institutional phenomenon in the orthopedic surgical infrastructure and how acute and elective patient trajectories differ but build on the same logic, creating the (...) same dynamics of inclusion and exclusion. Through a situated and sociomaterial perspective, we analyze different clinical interactions in which we follow the hospital bed as an example of a central relational element that co‐creates sleep as an institutional phenomenon. Inspired by Karen Barad, we demonstrate how to move diffractively when doing and analyzing fieldwork and argue how moving diffractively as a researcher doing fieldwork “at home” is productive and challenges the concept and demand of “distance” as the phenomenological exercise in fieldwork. Philosophy can shed light on mathematical modeling and the juxtaposition of modeling and empirical data. This paper explores three philosophical traditions of the structure of scientific theory—Syntactic, Semantic, and Pragmatic—to show that each illuminates mathematical modeling. The Pragmatic View identifies four critical functions of mathematical modeling: (1) unification of both models and data, (2) model fitting to data, (3) mechanism identification accounting for observation, and (4) prediction of future observations. Such facets are explored using a recent exchange between two groups (...) of mathematical modelers in plant biology. Scientific debate can arise from different modeling philosophies. (shrink)

Radical naturalized metaphysics wants to argue (1) that metaphysics without sufficient epistemic warrant should not be pursued, (2) that the traditional methods of metaphysics cannot provide epistemic warrant, (3) that metaphysics using these methods must therefore be discontinued, and (4) that naturalized metaphysics should be pursued instead since (5) such science‐based metaphysics succeeds in establishing justified conclusions about ultimate reality. This paper argues that to defend (5), naturalized metaphysics must rely on methods similar to those criticized in (2). If naturalized (...) metaphysics instead opts for the weaker claim that science‐based metaphysics is only superior to other metaphysics, then this is insufficient to establish (4). In this case, (4) might therefore be defeated by (1). An alternative is to replace (1) with the view that we should just approach metaphysical questions with the best means available. While this would recommend a science‐based approach whenever possible, it would also allow for the continuation of science‐independent metaphysics in domains that science has no bearing on and thus reject (3). The paper concludes that none of these alternatives is entirely satisfactory for naturalized metaphysics. (shrink)

G. A. Cohen argues that egalitarians should compensate for expensive tastes or for the fact that they are expensive. Ronald Dworkin, by contrast, regards most expensive tastes as unworthy of compensation — only if a person disidentifies with his own such tastes (i.e. wishes he did not have them) is compensation appropriate. Dworkinians appeal, inter alia, to the so-called ‘first-person’ or ‘continuity’ test. According to the continuity test, an appropriate standard of interpersonal comparison reflects people's own assessment of their relative (...) standing: Person A can only legitimately demand compensation from person B if he regards himself as worse off, all things considered, than B. The typical bearer of expensive tastes does not regard herself as being worse off than others with less expensive tastes. Hence, in the typical case, pace Cohen, compensation for expensive tastes is inappropriate. The article scrutinizes this rationale for not compensating for expensive tastes. Especially, we try to bolster the continuity test by relating it to Dworkin's distinction between integrated and detached values, pointing out that an argument for the continuity test can be built on the assumption that equality has integrated value. In brief, the point is that a metric of equality should be assessed, partly, in virtue of its consequences for related ideals. One of these is the kind of justificatory community promoted by the continuity test. We defend this view against an objection to the effect that equality is a detached value. We conclude that the continuity test constitutes a strong foothold for the resourcist egalitarian reluctance to compensate people for their expensive tastes. (shrink)

In a crucial passage in the Parmenides, Parmenides states that the power of conversation (ten tou dialegesthai dynamin) depends on forms (135b-c) and indicates that this power is a prerequisite for philosophy. In chapter xx Kristian Larsen raises the question what implications this passage has for Plato’s conception of dialectic and argues that the discussion of the thesis that knowledge is perception in the Theaetetus, and in particular the conclusion to this discussion found at 184b3-186e12, provides an explanation of (...) Parmenides’ claims about the power of conversation. The chapter provides a detailed interpretation of the final refutation of Theaetetus’ thesis that knowledge is perception that highlights the way the dramatic features of the Theaetetus accentuate the argument Socrates develops in order to refute the thesis. Larsen argues that a central feature of the drama of the dialogue is Socrates’ attempt at redirecting Theaetetus from mathematics toward dialectic and philosophy. In particular, Socrates aims to make Theaetetus realize that being and the good or the beneficial are things that are what they are, themselves by themselves, that they are on a par, ontologically speaking, and that reaching for them, and attempting to come to grips with them, in thought, is a requirement for knowledge in general and for dialectic in particular. I argue that Merleau-Ponty’s use of the case of Schneider in his arguments for the existence of non-conconceptual and non-representational motor intentionality contains a problematic methodological ambiguity. Motor intentionality is both to be revealed by its perspicuous preservation and by its contrastive impairment in one and the same case. To resolve the resulting contradiction I suggest we emphasize the second of Merleau-Ponty’s two lines of argument. I argue that this interpretation is the one in best accordance both with Merleau-Ponty’s general (...) methodology and with the empirical case of Schneider as it was described by Gelb and Goldstein. Criminal offenders may be offered to participate in voluntary rehabilitation programs aiming at correcting undesirable behaviour, as a condition of early release. Behavioural treatment may include direct intervention into the central nervous system (CNS). This article discusses under which circumstances voluntary rehabilitation by CNS intervention is justified. It is argued that although the context of voluntary rehabilitation is a coercive circumstance, consent may still be effective, in the sense that it can meet formal criteria for informed consent. Further, for a (...) consent to be normatively valid (“take the wronging out of the act”) under a coercive circumstance, the subject to be treated must (1) have the sovereign authority to consent, and (2) the offer-giver must be in the right normative position to make the offer. While I argue that subjects do have the sovereign authority to consent to treatment, I also argue that inappropriate offers yield invalid consents. Considerations on inappropriate offers should therefore inform which kinds of CNS intervention-based rehabilitation schemes the state may propose as part of the criminal justice system. Yet as I conclude in this paper, while there are some intrinsic constraints on voluntary rehabilitation programs, the main constraints on voluntary rehabilitation are likely to be contingent overriders. However, CNS intervention is not ruled out as such in the context of voluntary rehabilitation. (shrink)

Denne artikel undersøger fremkomsten af dansk fremtidsforskning i forbindelse med samtidige prognoser omkring det postindustrielle videns- og informationssamfunds kommen. Artiklen demonstrerer, hvordan postindustriel teori og hertil knyttede opfattelser omkring fundamentale samfundsforandringer dannede baggrund for fremtidsforskernes interventioner i væsentlige samtidige debatter omkring fremtidens planlægning og politiske organisation. De teknologiske og økonomiske udviklinger, der fulgte med overgangen til det postindustrielle samfund, blev opfattet som uundgåelige af de danske fremtidsforskere, hvilket ledte til et narrativ omkring behovet for konstant og planlagt innovation i alle (...) samfundssfærer for at kunne tilpasse sig det nye samfund. Således argumenterer artiklen for, at den danske fremtidsforsknings fremtidsvisioner var styret af en teknologisk og økonomisk determinisme, der resulterede i en form for accelereret og reformbaseret “nødvendighedens politik.” Artiklen bidrager med en dansk case til den voksende internationale litteratur om fremtidsforskningens historie, ligesom den bidrager med nye perspektiver på dansk samfundsdebat i 1960’erne og 1970’erne. According to the ‘integration approach’, interpretations of political concepts should explain that they stand for rights we ought to respect and be both compatible and mutually supporting. I start by clarifying what this means, and proceed to an examination of Ronald Dworkin’s latest argument for value holism. I argue that his argument fails to provide a convincing case for the integration approach. I go on to argue that we nonetheless should accept that interpretations of political concepts should be compatible, because (...) denying it would be inconsistent with, and the fact that ‘ought implies can’. I then provide reasons for thinking that we also cannot really satisfy for any particular concept without giving reasons in term of what fall under other concepts—that is, interpreting the concepts as mutually supporting. We thus have reasons to accept both parts of. Finally, I defend the integration approach from three important objections: First, that it conflates different values; secondly, that it is inconsistent with ordinary language-usage; and thirdly, that it overlooks important telic values. I conclude that none of these compels us to abandon the integration approach. (shrink)
