Patient and citizen participation is now regarded as central to the promotion of sustainable health and health care. Involvement efforts create and encounter many diverse ethical challenges that have the potential to enhance or undermine their success. This article examines different expressions of patient and citizen participation and the support health ethics offers. It is contended that despite its prominence and the link between patient empowerment and autonomy, traditional bioethics is insufficient to guide participation efforts. In addition, the turn to (...) a “social paradigm” of ethics in examinations of biotechnologies and public health does not provide an account of values that is commensurable with the pervasive autonomy paradigm. This exacerbates rather than eases tensions for patients and citizens endeavoring to engage with health. Citizen and patient participation must have a significant influence on the way we do health ethics if its potential is to be fulfilled. (shrink)

The informed consent process for genetic testing does not commonly address preferences regarding disclosure of results in the event of the patient's death. Adults being tested for familial colorectal cancer were asked whether they want their exome sequencing results disclosed to another person in the event of their death prior to receiving the results. Of 78 participants, 92% designated an individual and 8% declined to. Further research will help refine practices for informed consent.

Camp (2009) distinguishes two varieties of conceptual recombination. One of them is full-blown or (as I prefer to call it) spontaneous recombination. The other is causal-counterfactual recombination. She suggests that while human animals recombine their concepts in a full-blown way, many non-human animals are capable of conceptual recombinability but only of the causal-counterfactual kind. In this paper, I argue that there is conceptual space to draw further sub-distinctions on how different animals may recombine their concepts. More specifically, I propose to (...) differentiate between a) narrow causal-counterfactual recombination; b) broad causal-counterfactual recombination; c) lean spontaneous recombination; d) robust spontaneous recombination. Afterwards, I focus on how these distinctions relate to several previous philosophical ideas on the representational capacities of non-human animals. Sometimes, this looks like praying with patients; other times, it looks like sitting in quiet because there are no adequate words. Over time, I have developed ways to help me cope with the intensity I witness daily. Still, cases come up that I must grieve. The case of Ellen is one such example.The first time I met Ellen, she was waiting to hear back about her scans and tests. A quick look at her chart and a conversation with the medical team revealed that she was in her mid-thirties. While she spoke English fluently, she had immigrated to the US, and English was her second language. She, along with her husband, Mark, and their young son, had come to the United States on a work visa.After knocking on the door and entering her dim hospital room, I noticed right away what a beautiful person Ellen was, inside and out. Lying in bed, her long dark hair piled up on her head, her slim figure was visibly pregnant underneath her hospital gown. She smiled and gently greeted me. Mark was at her side. Clearly, Ellen was in physical pain, and while she and Mark still hoped the doctors were wrong in thinking she may have cancer, the emotional strain of waiting lay heavy upon them.Ellen and Mark kindly welcomed me and were attentive as best they could as I introduced myself and explained my role as a chaplain. After further deliberation, however, it was decided that it was riskier to deliver a baby at 29–30 weeks than it was to undergo chemotherapy while pregnant, so Ellen began chemotherapy while still carrying her baby. Although canine identification of body odor (BO) has been widely used as forensic evidence, the concept of nosewitness identification by human observers was only recently put to the test. The results indicated that BOs associated with male characters in authentic crime videos could later be identified in BO lineup tests well above chance. To further evaluate nosewitness memory, we assessed the effects of lineup size (Experiment 1) and retention interval (Experiment 2), using a forced-choice memory test. The results showed that (...) nosewitness identification works for all lineup sizes (3, 5, and 8 BOs), but that larger lineups compromise identification performance in similarity to observations from eye- and earwitness studies. Also in line with previous eye- and earwitness studies, but in disagreement with some studies on odor memory, Experiment 2 showed significant forgetting between shorter retention intervals (15 min) and longer retention intervals (1-week) using lineups of five BOs. Altogether this study shows that identification of BO in a forensic setting is possible and has limits and characteristics in line with witness identification through other sensory modalities. ABSTRACTRecent research suggests that impaired emotion regulation may play an important role in the development of youth psychopathology. However, little research has explored the effects of ER strategies on affect in early adolescents. In Study 1, we examined if early adolescents are able to use distraction and whether the effects of this strategy are similar to talking to one’s mother. In Study 2, we compared the effects of distraction, cognitive reappraisal, acceptance, and rumination. In both studies, participants received instructions on (...) how to regulate their emotions after a standardised negative mood induction. In general, the results indicated that distraction, but also cognitive reappraisal and acceptance, had promising short-term effects on positive and negative affect in early adolescents. Recent work in animal ethics has advanced principles that are too individualistic to be compatible with a holistic environmental ethic such as the land ethic proposed by Aldo Leopold. J. Baird Callicott, on the other hand, has attempted to reconcile the two ethics by suggesting that sympathy, natural among humanity, as he claims on Humean grounds, does not necessarily terminate at the species barrier. His argument shows minimally that it is not necessary that we abandon ecological ethics in order to (...) view nonhuman animals as morally considerable. I argue instead that it is not sympathy, but hostility/indifference that manifests the reality of life in wild nature, and as such forms a better basis for an all-encompassing ethic. If one accepts that the factual realm suggests the limits of norms and establishes the background and context of normative judgments in this context (as Holmes Roiston, III, for instance, does), then a different line of argument can be developed. I argue that intraspecies and interspecies ethics ought to be different for us because behavior in the wild is different within and without a species. Further, I argue that hostility/indifference coupled with respect form the basis of an approach which embraces a holistic environmental ethic as weil as one concemed with nonhuman animals. (shrink)

Drawing on the built environment concept of “inclusive design” and its emphasis on creating accessible environments for all persons regardless of ability, I suggest that a central task for feminist disability theory is to redesign foundational philosophical concepts to present opportunities rather than barriers to inclusion for people with disability. Accounts of autonomy within liberal philosophy stress self-determination and the dignity of all individual persons, but have excluded people with intellectual disability from moral and political theories by denying their capacity (...) for individual autonomy, seen as a chief marker of moral personhood. This paper modifies and extends feminist theories of relational autonomy by arguing for the need to view autonomy as a feature of persons that is manifested only through relations of support, advocacy, and enablement. An “inclusively designed,” relational account negotiates the tensions encountered in attempts to apply autonomy to people with high support needs, and politicizes the concept as an advocacy tool for people with intellectual disability and their allies. Interactions with yellowjackets offer opportunities to reflect on what it is to encounter radical alterity and the conditions that are necessary for the limited empathy such encounters afford us. Effort must be made to set aside automatic judgments, and neither simulation nor theorizing can be sufficient to give us reliable insights, but mindful attentiveness can at least help us attend to the possibilities of interaction and tentative interpretation.

This essay compares Sikh and Christian thought about and practices of hospitality in light of the global refugee crisis. It aims to show how both practices of hospitality, and religious ethical thought about hospitality, can be enhanced by dialogue between traditions. The refugee crisis arises out of a global failure of hospitality, and the type of hospitality refugees most fundamentally need is that which confers membership in a political community. Comparing Christian and Sikh ethics of hospitality provides guidance toward building (...) rooted religious communities that welcome outsiders, including by incorporating them into political communities. In particular, Christians who hold social power and privilege can better fulfill ethical mandates of hospitality by looking to the example of Sikhs and other marginalized groups. Sikhs have often built communities through acts of hospitality and welcomed outsiders without fear, even in contexts where their own belonging is questioned and their own security is under threat. Medical advances in transplantation techniques have driven an exponential increase in the demand for transplantable organs. Unfortunately, policy efforts to bolster the organ supply have been less than effective, failing to provide a stopgap for ever-increasing numbers of patients who await organ transplantation. The number of registrations on waiting lists exceeded 65,245 in early 1999, a 325% increase over the 20,000 that existed 11 years earlier in 1988. Regrettably, more than 4,000 patients die each year while awaiting transplantation.

Philosophers have understood propositional contents in many different ways, some of them imposing stricter demands on cognition than others. In this paper, I want to characterize a specific sub-type of propositional content that shares many core features with full-blown propositional contents while lacking others. I will call them modest propositional contents, and I will be especially interested in examining which behavioral patterns would justify their attribution to non-human animals. To accomplish these tasks, I will begin by contrasting modest propositional contents (...) with primitive feature-placing contents: a kind of content that, according to some philosophers, can explain the behavior of non-human animals. I will examine which cognitive abilities are involved in having mental states with each of these contents and which sorts of behavioral patterns would provide evidence that an animal has one of them or another. This essay is devoted to the study of proper names. Although the view that sees proper names as referential singular terms is widely considered orthodoxy, there is a growing popularity to the view that proper names are predicates. This is partly because the orthodoxy faces two anomalies that Predicativism can solve: on the one hand, proper names can have multiple bearers. But multiple bearerhood is prima facie a problem to the idea that proper names have just one individual as referent. (...) On the other hand, proper names can have predicative uses. But the view that proper names are singular terms arguably does not have the resources to deal with these uses. In this dissertation I argue that the Predicate View of proper names is mistaken. In the first part of the thesis, I analyse this view in its main contentions and offer several arguments to reject it. This critical exercise provides useful insight into the life of proper names that I incorporate in my own view as follows: I argue that the behaviour of proper names should be understood in light of the wider phenomenon I call category change. Thus, I maintain, with orthodoxy, that proper names are fundamentally referential terms, but I also argue that they also have other uses, including the predicative uses highlighted by the predicativist. I also offer a semantic theory according to which proper names are polyreferential, that is, they are terms that can have more than one referent in a way that is distinct from both plural terms and general terms. This theory resolves the problem of multiple bearerhood and provides a base to account for all other uses of proper names that are not referential, i.e., common noun, adjectival and verbal uses, as semantically derived from the more fundamental referential meaning. The inconsistency between pro-environmental attitudes and behaviours, known as the “attitude-behaviour” gap, is exceptionally pronounced in scenarios associated with “green” choice. The current literature offers numerous explanations for the reasons behind the “attitude-behaviour” gap, however, the generalisability of these explanations is complex. In addition, the answer to the question of whether the gap occurs between attitudes and intentions, or intentions and behaviours is also unknown. In this study, we propose the moral dimension as a generalisable driver of the “attitude-behaviour” gap (...) and investigate its effectiveness in predicting attitudes, pro-environmental intentions and subsequent behaviours. We do so by using Hunt–Vitell’s moral philosophy-based framework of ethical decision-making, which conceptualises morality as the central decision-making parameter. The results from 557 US MTurk participants revealed that the manipulation of moral dimensions, specifically deontology and teleology, impacted ethical evaluation of presented dilemmas, however, failed to translate into subsequent intentions and behaviours. This finding suggests (i) that the moral dimension has an effect in shaping attitudes toward environmental issues, and (ii) that gap occurs between attitudes and intentions rather than intentions and behaviours. Further investigation of what strengthens and/or overrides the effects of the moral dimension would help understand the reasons why moral attitudes do not always translate into subsequent intentions and behaviours in the pro-environmental domain. From the earliest application of modern randomized controlled trials in medical research, scientists and observers have deliberated the ethics of randomly allocating study participants to trial control arms. Adaptive RCT designs have been promoted as ethically advantageous over conventional RCTs because they reduce the allocation of subjects to what appear to be inferior treatments. Critical assessment of this claim is important, as adaptive designs are changing medical research, with the potential to significantly shift how clinical trials are conducted. Policy-makers are (...) swiftly moving to encourage greater use of adaptive designs. In 2016, the newly enacted 21st Century Cures Act instructed the Food and Drug Administration to help product sponsors incorporate adaptive methods into proposed clinical trial protocols and applications for investigational drugs and also biological products. In this article, we review the ethical justifications commonly offered for adaptive designs, explore these arguments in the context of actual trials, and contend that clinical equipoise is a useful standard for adaptive-trial ethics. We distinguish between theoretical and clinical equipoise and explain why ethical arguments related to adaptive trials tend to focus on the former. Yet we contend that theoretical equipoise can be an unreliable standard for adaptive ethics. While we contend that clinical equipoise is the most critical principle for the primary ethical concerns posed by adaptive trials, we suggest ethical approaches to deal with some additional concerns unique to adaptive designs. This paper compares Kant's positions on space, time, the relational character of noumena, and the relational character of the self, with the somewhat similar accounts of those things in two philosophers of the Kyoto school: Keiji Nishitani and Nishida Kitaro. I will argue that the philosophers of the Kyoto school had a more coherent and better integrated account of those ideas, that was open to Kant. Public policy on alcohol in the UK relies on health promotion campaigns that encourage individuals who misuse alcohol to make healthier choices about their drinking. Individuals with alcohol-dependence syndrome have an impaired capacity to choose health. As a result, individuals with the worst alcohol misuse problems lie largely outside the reach of choice-based policy. However, such policy has been widely criticized and efforts to reform it are underway. This paper argues that the British Medical Association's recent attempt to improve policy (...) on alcohol in the UK by introducing strategies which have been shown to control drinking within populations still gives insufficient attention to alcohol dependence. Despite the secularization process, popular religion in modern or post-modern societies still retains a central role. In this article, we analyze the worship of Santa Rosalia and Mamma Schiavona. The former is worshiped by Romani and Tamil people; the latter, the Mary of Montevergine Sanctuary, is also venerated by groups of homosexuals and transsexuals. The reworking of religious categories made by these subaltern groups reminds us of the dynamic nature of Catholicism, which changes thanks to continuous contact with external and (...) internal elements. Through Gramsci’s interpretation of popular religion as a symbolic instrument of social recognition and affirmation in opposition to the hegemonic culture, we demonstrate that popular religion plays a central social role in the construction of worldviews, sometimes in contrast with the hegemonic culture, not only as an affirmation of a different identity but as an affirmation of presence. This article places Foucault's 1977 suggestions regarding the reform of French rape law in the context of ongoing feminist debates as to whether rape should be considered a sex crime or a species of assault. When viewed as a disciplinary matrix with both physical and discursive effects, rape and the rape trial clearly contribute to the “hysterization” of women by cultivating complainants' confessions in order to demonstrate their supposed lack of self-knowledge.

Drawing upon lived experiences, this article explores challenges facing feminist academics sharing work in the media, and the gendered, raced intersections of ‘being visible’ in digital cultures which enable direct, public response. We examine online backlash following publication of an article about representations of Meghan Markle’s feminism being co-opted by the patriarchal monarchy. While in it we argued against vilification of Markle, we encountered what we term distortions of research remediation as news outlets reported our work under headlines such as (...) ‘academics accuse Meghan of dropping feminism like a hot potato’. Negative responses were polarised: anti-Meghan, and pro-Meghan. In response, we received accusations of sexist, racist bullying, debate over definitions of feminism, claims feminism has gone ‘too far’, variously worded directives to ‘shut up’, gendered personal insults, and threats of doxxing. This article examines the tenor of public discourse around feminism and visible feminists. It questions the responsibility of institutions benefiting from public intellectuals for the wellbeing of employees in the public eye, particularly in the anti-intellectual socio-political context of Brexit and Donald Trump, where the costs for ‘visible’ women and feminist activism are ever higher. It also considers our responsibility as researchers to ensure our contributions to public discourse do not exacerbate existing harms of a white-supremacist, classist society. This article interrogates the risks – of misrepresentation, hyper-visibility, and reputational, psychological and potentially physical harm – faced by those engaging in acts of public feminism. I examine the dynamics of measure development using two case studies: temperature, and health-related quality of life. I argue, following Bas van Fraassen and Leah McClimans that in each case these dynamics have a hermeneutic structure. Measure development is plagued by epistemic circularity, as is the task of interpreting a text, and similar strategies can be used in both measure development and hermeneutics to overcome that circularity. I show that Hans Georg Gadamer’s philosophical hermeneutics in particular are an effective lens (...) through which to examine the development of the temperature standard as described by Hasok Chang. Despite similar grounding in hermeneutics, I note an important difference between measure development for temperature and for health-related quality of life. Namely, while the meaning of temperature can be standardized, the meaning of health-related quality of life cannot. This standardization of meaning for the temperature concept represents a limit to the analogy with hermeneutics. Finally, I argue that the indeterminacy we find in health-related quality of life measurement is a result not only of analogy with the hermeneutic task, but of full-fledged participation in it. This article examines how on-air conversations between journalists indicate how US television coverage of a race-related crisis can reflect racial ideology. Using critical discourse analysis, we examined interjournalistic discourse about African Americans in national network and cable news programs that aired after Hurricane Katrina reached New Orleans. While we expected conversational semantic items from conservative Fox News to reflect racial ideology, we also found such discursive elements from politically moderate and progressive news organizations such as CBS, CNN, and MSNBC. These (...) findings are consistent with Anxiety Uncertainty Management theory, which predicts that exposure to stressors in unfamiliar settings causes individuals to think in ethnocentric, dichotomous, stereotypical ways. Our research underscores the impact of white privilege on language, communication, and news production, and the need for cultural competence training to enhance journalists’ ability to discuss racial matters with ease. The thesis examines two dimensions of constructivity that manifest themselves within foundational systems for Bishop constructive mathematics: intuitionistic logic and predicativity. The latter, in particular, is the main focus of the thesis. The use of intuitionistic logic affects the notion of proof : constructive proofs may be seen as very general algorithms. Predicativity relates instead to the notion of set: predicative sets are viewed as if they were constructed from within and step by step. The first part of the thesis (...) clarifes the algorithmic nature of intuitionistic proofs, and explores the consequences of developing mathematics according to a constructive notion of proof. It also emphasizes intra-mathematical and pragmatic reasons for doing mathematics constructively. The second part of the thesis discusses predicativity. Predicativity expresses a kind of constructivity that has been appealed to both in the classical and in the constructive tradition. The thesis therefore addresses both classical and constructive variants of predicativity. It examines the origins of predicativity, its motives and some of the fundamental logical advances that were induced by the philosophical re ection on predicativity. It also investigates the relation between a number of distinct proposals for predicativity that appeared in the literature: strict predicativity, predicativity given the natural numbers and constructive predicativity. It advances a predicative concept of set as unifying theme that runs across both the classical and the constructive tradition, and identifies it as a forefather of a computational notion of set that is to be found in constructive type theories. Finally, it turns to the question of which portions of scientifically applicable mathematics can be carried out predicatively, invoking recent technical work in mathematical logic. (shrink)

Lurz and Krachun propose a new experimental protocol designed to discriminate genuine mindreading animals from mere behavior-readers and to give evidence in favor of the claim that chimpanzees are capable of attributing internal goals to others. They suggest that chimpanzees' variety of "internal goal attribution" consists in attributing to others basic intentional representations, baptized by Millikan as "pushmi-pullyu representations". But, what would happen if we tried to differentiate, analogously, between more or less sophisticated mind-readers in virtue of the sorts of PPs that they could attribute to others? What would attributing complex PPs consist in and how would such capacity increase the predictive powers of chimpanzee mind-readers? This paper offers an answer to these questions. Based on Millikan's work, I differentiate two varieties of complex PPs. Then, I examine what a basic mind-reader, only capable of attributing 'pure' PPs, would be able to do. After that, I distinguish two more sophisticated varieties of mindreading, each consisting in the attribution of one of the complex PPs previously presented, and I show how the ability to attribute complex PPs to others comes with more potent and flexible capacities to anticipate their behavior. Finally, I offer some reasons to think that attributing complex PPs is still simpler than full-blown mindreading and I briefly evaluate the prospects of extending this proposal to infant social cognition. In this paper I discuss Heck�s (2007) new argument for content dualism. This argument is based on the claim that conceptual states, but not perceptual states, meet Evans�s Generality Constraint. Heck argues that this claim, together with the idea that the kind of content we should attribute to a mental state depends on which generalizations the state satisfies, implies that conceptual states and perceptual states have different kinds of contents. I argue, however, that it is unlikely that there is a (...) plausible reading of the Generality Constraint under which it is non-trivially true both that conceptual states meet it and that perceptual states do not. Therefore, the soundness of Heck�s argument is dubious. (shrink)

This January‐February 2020 issue marks the start of the Hastings Center Report's fiftieth volume. The issue introduces the column Looking Back, Looking Forward, which we plan to run in this volume only. Conceived by Hastings Center fellows Douglas Diekema and Lainie Friedman Ross, the column will explore the significance of landmark publications from the first fifty years of bioethics. For the first installment, Diekema looks at the unconventional moral position Hans Jonas took in his 1969 essay “Philosophical Reflections on Experimenting (...) with Human Subjects.” In the lead article, “Trust, Risk, and Race in American Medicine,” Laura Specker Sullivan contextualizes patient mistrust within a history of racism in general and in the nation's biomedical research and clinical institutions specifically. Specker Sullivan proposes ways for individual clinicians to improve relationships with distrustful patients and their families. Two commentaries provide additional insights and recommendations about the work of earning patient trust. (shrink)
