A reviewer at the time noted the importance of Croce's belief that "the central trend in the evolution of man is the unfolding of new potentialities, and that the task of the historian is to discover and emphasise this trend: the story of liberty". As Croce himself writes, "Even in the darkest and crassest times liberty trembles in (...) the lines of poets and affirms itself in the pages of thinkers and burns, solitary and magnificent, in some men who cannot be assimilated by the world around them." The first edition in English of HISTORY AS THE STORY OF LIBERTY appeared in London in 1941. LIBERTY IN HUME'S HISTORY OF ENGLAND In his own lifetime, Hume was feted by his admirers as a great historian, and even his enemies conceded that he was a controversial historian with whom one had to reckon. On the other hand, Hume failed to achieve positive recognition for his philosophical views. It was Hume's History of England that played an influential role in public policy debate during the eighteenth century in both Great Britain and in the United (...) States. Hume's Hist01Y of England passed through seven editions and was beginning to be perceived as a classic before Hume's death. Voltaire, as an historian, considered it "perhaps the best ever written in any lan guage. " Gibbon greatly admired Hume's work and said, of a letter written by Hume in 1776 praising the Decline and Fall of the Roman Empire, that a compliment from Hume "overpaid the labor of ten years. " After Hume's death on August 20, 1776, the History became a factor in the revolutionary events that began to unfold. Louis XVI was a close student of Hume's History, and his valet records that, upon having learned that the Convention had voted the death penalty, the King asked for the volume in Hume's History covering the trial and execution of Charles I to read in the days that remained. But if Louis XVI found the consolations of philosophical history in the Stuart volumes, Thomas Jefferson saw in them a cause for alarm. (shrink)

ABSTRACTProviding an introduction to this special issue on the ancient notions of liberty and its modern perspectives, this essay contains, first, some reflections about the relation between the fields of ancient history and contemporary political theory. Building on the comments of the final roundtable with Kinch Hoekstra and Quentin Skinner, it then makes an attempt at extrapolating some theoretical understandings of liberty from a wide range of geographical and historical contexts covered in the contributions. ABSTRACTThis paper explores and reevaluates the place of Plato in the history of liberty. In the first half, reevaluating the view that he invents a concept of ‘positive liberty’ in the Republic, I argue for two claims: that he does not do so, insofar as this is not the way that virtuous psychological self-mastery in the Republic is understood, and that the Republic works primarily with the inverse concept of slavery, relying on entrenched Greek ideas about the (...) badness of the status of being a slave and the actions and dispositions associated with it. Turning in the second half to seek Platonic innovation not in the domain of ‘positive liberty’ but in reflection on liberty as a political value, understood as the liberty of action of citizens within the laws, I argue for two further claims: that as such a political value, liberty is limited and reshaped in both the Republic and the Laws to be compatible with obedience to rule / willingness to be ruled, ideally willing obedience; and that for this limited and reshaped value to be secured, such obedience must be manifested not only in regard to a constitution’s laws, but also to the magistrates who hold office within it. This article assesses to what extent the future of democratic liberty depends upon its citizens employing a proper approach to the past, by analyzing Tocqueville’s views of three kinds of historical consciousness—aristocratic, revolutionary, and democratic. It is argued that democracies require certain aristocratic assumptions about historical dynamics to cultivate a historical consciousness that fosters liberty. Key to this is the belief in the human capacity to influence the trajectory of history. Tocqueville’s historical approach, which blends aristocratic and (...) democratic elements, is identified as the most effective method for tempering the fatalistic tendencies of the democratic point of view. Thus, for democracies to maintain liberty, citizens should recognize the dual role of general causes and human agency in directing the course of historical events. Tocqueville’s insights on the effects of historical consciousness on the future of democratic liberty remain particularly relevant today when Western democracies confront internal polarization and external anti-democratic challenges, whether neoliberal, illiberal, populist, or fascist. This article presents a commentary by James Steuart on David Hume’s History of the Tudors, written in the early 1760s. In doing so, the article sketches new aspects of Steuart’s political and historical thought at a time when he was hopeful about returning to Scotland from his long continental exile, following his leading role in the 1745 Jacobite rising. After providing a short biographical context, it establishes that the text was written whilst Steuart was working on his Political Oeconomy, (...) and when the ‘Marian controversy’ dominated Scottish historical debate. It goes on to explore the influence of Steuart’s friend Mary Wortley Montagu on his criticism of Hume’s misogynistic representation of Mary, Queen of Scots. It then reconstructs Steuart’s central argument about the failures of monarchs to adapt from feudal to commercial society, resulting in untrammelled liberties that harmed the lower classes. Concerned with the history of industry and commerce, political judgment, and the spirit of the people, Steuart’s hitherto unpublished commentary is a key source for understanding the ‘late Jacobite’ system of thought which influenced the reign of George III and inspired radicals later in the century. Sagar—rightly, in my view—wants us to recognize Smith as having been a political thinker. Too much work on Smith still assumes that there is not much to say [End Page 323] about his political thought because he regarded all but the most minimal government as an obstacle to the proper functioning of markets. Smith is supposed to be a "classical liberal" bent on preserving as much natural liberty as possible in the face of government's relentless overextension of its powers of regulation. In Adam Smith's Politics: An Essay in Historiographic Revision (Cambridge: Cambridge University Press, 1978), Donald Winch rejected that approach to Smith in favor of a portrait of the author of The Theory of Moral Sentiments and The Wealth of Nations as an eighteenth-century thinker with an eighteenth-century thinker's concerns. Sagar's project is quite different. This is a book on Smith's political thought that does not once deploy the term 'Whig.' Sagar's Smith does not wholly float free of his historical situation—the questions he addresses are those posed by the end of feudalism and the advent of modernity—but situating him in the particular circumstances of Britain in the age of revolutions is not Sagar's concern. As Sagar sees it, the fundamental issues addressed by Smith's political thought concern the distinctive form taken by commercial society in the modern era. Smith, according to Sagar, held that all advanced societies are commercial societies. Commercial society as such needed no vindication. The question, rather, was what kind of commercial society a modern state wanted to be. That was a political question insofar as it was a question about the kind of freedom that mattered and about the kind of institutions needed to make that freedom a reality.Defined in maximally general terms, freedom for Smith was the absence of domination, where domination is understood as a lack of security in respect of one's physical safety and possessions. The condition of the poor and powerless had always been one of subjection to the will of the rich and powerful. What changed that, according to Smith, was implementation of the rule of law. This is in itself not a new reading of Smith, but what distinguishes Sagar's version of it is the care with which he examines both the place of the rule of law in Smith's historical account of the emergence of liberty in modern Europe and the precise nature of the connection between the rule of law and freedom. First, on Sagar's view, there needed to be a comprehensive picture of domination and slavery, which had been the normal condition of almost everyone for almost all of human history. Then there needed to be an explanation of how it was that, at one particular historical moment, domination was slowly but surely challenged by the emergence of law and law courts considered as independent of political power. In England, this was the story of the common law and of judges who held office for life, rather than at the pleasure of traditional possessors of power. It was the story of security in property, of the backing of property by law, and it was a largely urban story, of burghers who managed to enlist monarchs on their side in the battle against the barons. It was, in other words, in large part a medieval story, and one consequence is that there was more to say about the rise of liberty in the modern age than that it was caused inadvertently by... Smith focuses his thematic approach regarding the study of classical liberal political philosophy on both natural-rights philosophers, in what Smith deems the “Lockean Paradigm,” and nineteenth-century utilitarian liberals. Smith does not merely provide an overview of the history of this theory—rather, he attempts to discover how and why liberal theory had faced major challenges in the nineteenth-century with regard to both its theoretical foundations (...) and its level of public support. Annelien de Dijn’s Freedom: An Unruly History is a rich and thought-provoking work in intellectual history, tracing thinking and debating about political freedom in the West from ancient Greece to our own times. The ancient notion of freedom as self-government is referred to as the ‘democratic conception’. The argument is that this conception survived through the renaissance, the early-modern period and the 18th-century Atlantic revolutions only (...) to be deliberately scrapped in the 19th century in favour of liberal freedom – absence of state interference – thus severing the ancient links between freedom and democracy and turning democracy into a threat to freedom. The book is an impressive achievement and the use of sources staggeringly wide. However, though the liberal turn is certainly a fact of history, I am not convinced that it was such a decisive break, nor that the relations between conceptions of freedom and attitudes to democracy are as clear-cut as de Dijn needs them to be. De Dijn claims, with regret, that the liberal view remains our view and is now an essential part of Western civilization, but I find that to be empirically under-substantiated. By using the liberal turn to define an age, de Dijn lets history play out through the lens of the elite. (shrink)

The history of liberalism is the history of an ethical ideal as well as a set of political and social arrangements. In the latter sense liberalism entrenches the juridical equality of all citizens, their equal civil and political rights – including among those rights a set of liberties strong enough to restrict the authority of society over the individual in a fundamental way. How to express in institutions this politically fundamental restriction is an important matter of debate, but (...) that debate will not concern us. For present purposes I assume I can refer to liberalism as a set of political and social arrangements without further examination. Liberty and Law examines a previously underappreciated theme in legal history―the idea of permissive natural law. The idea is mentioned only peripherally, if at all, in modern histories of natural law. Yet it engaged the attention of jurists, philosophers, and theologians over a long period and formed an integral part of their teachings. This ensured that natural law was not conceived of as merely a set of commands and prohibitions that restricted human conduct, but also as affirming a (...) realm of human freedom, understood as both freedom from subjection and freedom of choice. Freedom can be used in many ways, and throughout the whole period from 1100 to 1800 the idea of permissive natural law was deployed for various purposes in response to different problems that arose. It was frequently invoked to explain the origin of private property and the beginnings of civil government. Several kinds of permissive natural law were identified. Permission could be positive or negative, depending on whether it was specifically conceded by a legislator or only tacitly allowed. It could free from sin or merely remit some temporal punishment that was due. It could commend some conduct without commanding it or permit some evil without condoning it. Medieval canonists used the concept of permissive natural law to harmonize the discordant texts that they found in their sources; William of Ockham found it a powerful tool in his defense of Franciscan poverty against papal criticisms; for Richard Hooker it justified both the constitutional structure and the ritual practices of the Anglican church; John Selden used it to uphold the inviolability of contracts, most importantly the contract of government; Hugo Grotius made it a central theme in his treatment of the conduct permissible in waging war; in the eighteenth century Jean Barbeyrac and Jean-Jacques Burlamaqui associated the idea with the emerging doctrine of natural rights. ABSTRACTThis paper proposes an intellectual history of the idea that the later Roman empire and, subsequently, the whole of Byzantium were less ‘free’ in comparison to the Roman Republic. Anxiety over diminished freedom recurred throughout Roman history, but only a few specific expressions of it were enshrined in modern thought as the basis on which to divide history into periods. The theorists of the Enlightenment, moreover, invented an unfree Byzantium for their own political purposes and not by (...) examining the facts about its political culture. The second part of the paper proposes that the Byzantines valorized a model of positive freedom as legal-institutional protection against arbitrary oppressive power, including against both barbarian domination and domestic abuses. In contrast to modern thought, which tends to see the imperial position as the chief threat to liberty, the Byzantines viewed it as its bulwark. Yet they too had remedies for oppressive emperors, suggesting that the otherwise well-attested invocations of freedom were not a mere rhetorical trope for them but an actionable cultural norm. The concept of self-ownership was first articulated in anglophone political thought in the decades between the outbreak of the English Civil War and the Glorious Revolution. This book traces the emergence and evolution of self-ownership over the course of this period, culminating in a reinterpretation of John Locke's celebrated but widely misunderstood idea that "every Man has a Property in his own Person." Often viewed through the prism of libertarian political thought, self-ownership has its roots in the neo-Roman or republican (...) concept of liberty as freedom from dependence on the will of another. As Lorenzo Sabbadini reveals, seventeenth-century writers believed that the attainment of this status required not only a specific kind of constitution but a particular distribution of property as well. It is often assumed that European thought contained several conceptually distinct and equally influential notions of liberty. The article challenges this perception, arguing that European history was dominated by one concept of liberty. It attempts to show that the tendency to dismiss the idea of one concept of liberty is premature. Such an attitude is caused either by misplaced interpretations of ancient texts, by exaggerated historicism, or by an anachronistic reading of early modern political thought. John Locke is widely perceived as a foundational figure within the liberal tradition. This book investigates the competing purposes that informed Locke's political philosophy, not all of which resulted in outcomes consistent with what we today understand as "liberal" ideals. Locke himself was unaware that he belonged to a "liberal" tradition. Traditions only acquire meaning in retrospect. But many have perceived the development of Locke's political philosophy as involving a smooth evolution from "authoritarian" origins to "liberal" conclusions, beginning with Locke's (...) Two Tracts on Government (1660-62) and culminating in his later political works, the Two Treatises of Government (1689) and A Letter Concerning Toleration (1689). This book advances an interpretation of this development which reveals how, by the time of his mature political writings, Locke sought to advance three competing imperatives within his political philosophy, only two of which were consistent with ideals of individual liberty. The other imperative sustained purposes much more aligned with the "authoritarianism" with which Locke's political philosophy began. The result is a much more complex and variegated understanding of Locke's political philosophy, focusing on its competing purposes. ABSTRACT The concepts of liberty and representation reveal tensions in Hobbes's political anthropology that only a study of the development of his philosophical materialism can fully elucidate. The first section of this article analyses the contradictory definitions of liberty offered in De cive, and explains them against the background of Hobbes's elaboration of a deterministic concept of conatus during the 1640s. Variations in the concepts of conatus and void between De motu and De corpore will shed light on (...) ideas of individuality, unity and agency that carry direct political relevance. The second section explains why the concept of representation that Hobbes elaborated at the end of the decade in Leviathan cannot be interpreted within an exclusively political and juridical framework. Rather, I will claim that it should be explained in the light of Hobbes's materialist theory of the power exerted by the sovereign persona on human imagination. (shrink)

Established in 1923, Turkey has been a republic without a dominant republican conception of liberty. A chance to install such a conception was missed in the early republican period and never recaptured. The republic was unable to get rid of vestiges of the authoritarian tradition of the past. Centuries-old authoritarian tradition persisted well into the recent and the contemporary periods. Presenting ample evidence, the article underlines the weight of history and the legacy of authoritarian mentality that promoted the (...) use of authority, not liberty, in political problem-solving. The initial failure to abandon an authoritarian problem-solving approach proved fateful for the chances of the deepening of democracy in Turkey. (shrink)

In this article it is suggested that George Grote’s History of Greece employed a narrative history of Greece in an attempt to resolve the philosophical problem of the compatibility of individual liberty with considerable obligations to society. His philosophical achievement has been largely ignored by modern classical scholarship, even those who follow his lead in treating fifth-century Athens as the epitome of Greek civilization. The present reading of Grote’s History is informed by John Stuart Mill’s use (...) of Athenian examples. Outlining the evidential, moral and spatial parameters of Grote’s fifth-century Athens, it is argued that Grote understood fifth-century Athens to be amodel intellectual and liberal society, in which the performance of obligations by citizens coexisted with individual and political liberty. Grote explained the decline of Athenian power in the fourth century BC by reference to the neglect of obligations, and in doing so, married historical explanation to political theory. (shrink)
