Rousseau is considered to be at once the most modern political thinker of the 18th century and the most ancient in his allegiance to classical republicanism. These essays address the place of liberty in his moral and political philosophy, and the origins, meaning, strength, weakness and significance of his argument.

Cases of akratic behavior are generally seen as paradigmatic depictions of the knowledge-action gap (Darnell et al 2019): we know what we should do, we judge that we should do it, yet we often fail to act according to our knowledge. In recent decades attention has been given to a particular instance of akratic behavior, which is that of “inverse akrasia”, where the agent possesses faulty moral knowledge but fails to act accordingly, thus ending up doing the right thing. In (...) particular, two literary examples are considered as exemplifying this kind of akratic situation: Huckleberry Finn (Arpaly & Schroeder 1999, Arpaly 2000, Hursthouse 1999, Kleist 2009, Holton manuscript) and Neoptolemus as understood by Aristotle (NE; Arpaly & Schroeder 1999). In this paper I will argue that those of Neoptolemus and Huck Finn are not cases of inverse akrasia (Holton manuscript) but are much better explained as instances of what Williams (1993) called “moral incapacity”. In particular, the reason why they fail to act according to their original judgments is due to a lack of motivation to act accordingly, which is grounded in their moral self-identities (Blasi 1984; Vigani 2016). The paper will unfold as follows: I will, first, argue that neither Neoptolemus nor Huck Finn show akratic behavior; thus, they cannot be legitimately labeled as “inverse akratics” (par 1.); then, I will argue that they act the way they do notwithstanding their faulty judgments because they are effectively motivated to do so. Such motivation originates in their moral self-identities and is experienced through the threat of self-betrayal (par 2); finally, I will argue that when an agent is motivated to act in a way that is integral with her moral self-identity, acting otherwise is experienced as something one cannot ultimately do; that is, as a moral incapacity (par 3). This “cannot” is neither a metaphor for an “I shouldn’t”, nor an instance of what has been recently labeled a “moral impossibility” (Caprioglio Panizza 2020, 2021), since it does not arise from the normative force of deontic judgments, and it is neither physically nor psychologically impossible for the agent to act otherwise. This study of the political philosophy of William Ernest Hocking be gan as a doctoral dissertation at Tulane University. Hocking (1873- 1966) was for many years Alford Professor of Natural Religion, Moral Philosophy, and Civil Polity at Harvard University. Although he is relatively well-known among American philosophers, particularly by students of metaphysics and the philosophy of religion, very little atten tion has been given to his political philosophy. Some general studies of his thought summarize his political writings in a very (...) cursory fashion, but they do not discuss his contributions in detail or relate them to significant issues in political philosophy. Most important general works on modern political philosophy or American political thought do not even mention Hocking; a few note his name in passing. Because he is almost completely unknown in the social sciences, the original purpose of this study was to explore, systematize, and present his extensive writings in political philosophy. It then became apparent that his entire political philosophy is oriented around the concepts of liberty and community. When his thought is analyzed in terms of these themes, its unity and coherence are more obvious. Moreover, his writings become more significant when they are related to liberty and community, for these are focal concepts for important problems in modern political philosophy. This study of Hocking's political philosophy will, it is hoped, help us to see how liberty and community can be more understandable, attainable, and compatible with one another. (shrink)

Most recent discussions of John Stuart Mill’s System of Logic (1843) neglect the fifth book concerned with logical fallacies. Mill not only follows the revival of interest in the traditional Aristotelian doctrine of fallacies in Richard Whately and Augustus De Morgan, but he also develops new categories and an original analysis which enhance the study of fallacies within the context of what he calls ‘the philosophy of error’. After an exploration of this approach, the essay relates the philosophy of error (...) to the discussion of truth and error in chapter two of On Liberty (1859) concerned with freedom of thought and discussion. Drawing on Socratic and Baconian perspectives, Mill defends both the traditional study of logic against Jevons, Boole, De Morgan, and others, as well as the study of fallacies as the key to maintaining truth and its dissemination in numerous fields, such as science, morality, politics, and religion. In Mill’s view the study of fallacies also liberates ordinary people to explore the truth and falsity of ideas and, as such, to participate in society and politics and develop themselves as progressive beings. It is my intention in this paper to highlight the dangers which arise when people appeal to moral intuitions to settle questions in political, and in general in applied, philosophy. But first I want to ask why all or nearly all of us are in favour both of liberty and of equality – why all our intuitions are on their side. In the case of liberty it is easy to understand why. Although philosophers have held diverse theories about (...) the concept of liberty – theories which have been drawn together into two main groups in a famous lecture by Sir Isaiah Berlin – there cannot be much doubt that in the mind of the ordinary man to have liberty is to be under no constraint in doing what one wants to do. This, at any rate, is a main constituent of the concept of liberty as all of us understand it. Since, therefore, it seems self-evidently true that we want to be able to do what we want, we are bound to want liberty and, in general, to be in favour of it. We want it for ourselves; if we universalize our prescriptions, this constrains us to be in favour of it for others as well. That explains why, if any politician can claim that he is fighting for liberty, he is likely to win a large following. In the case of equality the matter is not so clear cut. (shrink)

Pocock on republican liberty and explores the way in which this idea of liberty can be used to illuminate educational practice. It argues that republican liberty is distinct from both positive and negative liberty, and its emphasis on liberty as non-dependency gives the concept of liberty a particularly critical role in contemporary society. Each chapter formulates and expounds the idea that (...) an empire of liberty requires the existence of what are termed 'liberty-bearing agents', and shows how education - with a particular emphasis on knowledge - is needed to foster the human powers which allow people to become liberty-bearing. The subject of this book is how to build institutions of liberty in this hemisphere of the Americas.

John Locke is widely perceived as a foundational figure within the liberal tradition. This book investigates the competing purposes that informed Locke's political philosophy, not all of which resulted in outcomes consistent with what we today understand as "liberal" ideals. Locke himself was unaware that he belonged to a "liberal" tradition. Traditions only acquire meaning in retrospect. But many have perceived the development of Locke's political philosophy as involving a smooth evolution from "authoritarian" origins to "liberal" conclusions, beginning with Locke's (...) Two Tracts on Government (1660-62) and culminating in his later political works, the Two Treatises of Government (1689) and A Letter Concerning Toleration (1689). This book advances an interpretation of this development which reveals how, by the time of his mature political writings, Locke sought to advance three competing imperatives within his political philosophy, only two of which were consistent with ideals of individual liberty. The other imperative sustained purposes much more aligned with the "authoritarianism" with which Locke's political philosophy began. The result is a much more complex and variegated understanding of Locke's political philosophy, focusing on its competing purposes. The paper analyses John Stuart Mill’s harm principle and its proper application in the process of drafting and evaluating laws, political decisions, and measures used to prevent the spread of contagious diseases. By interpreting Mill as an epistemic democrat and an epistemic liberal, the paper focuses on Mill’s thoughts regarding the decision-making procedures appropriate for legislation in a pandemic. Additionally, it discusses the proper division of epistemic and political labor, one of the most important mechanisms Mill uses to filter the (...) public will, and demonstrates how Mill’s arguments can help us balance between epistemic and moral virtues, i.e. between democratic and expert-oriented decision-making. This article assesses to what extent the future of democratic liberty depends upon its citizens employing a proper approach to the past, by analyzing Tocqueville’s views of three kinds of historical consciousness—aristocratic, revolutionary, and democratic. It is argued that democracies require certain aristocratic assumptions about historical dynamics to cultivate a historical consciousness that fosters liberty. Key to this is the belief in the human capacity to influence the trajectory of history. Tocqueville’s historical approach, which blends aristocratic and democratic (...) elements, is identified as the most effective method for tempering the fatalistic tendencies of the democratic point of view. Thus, for democracies to maintain liberty, citizens should recognize the dual role of general causes and human agency in directing the course of historical events. Tocqueville’s insights on the effects of historical consciousness on the future of democratic liberty remain particularly relevant today when Western democracies confront internal polarization and external anti-democratic challenges, whether neoliberal, illiberal, populist, or fascist. In John Stuart Mill on Liberty and Control Joseph Hamburger seeks to dislodge this orthodox interpretation [End Page 308] of Mill. As the title of the work suggests, Hamburger, who died shortly before this work came to press, seeks to convince the reader that a proper understanding of Mill's account of individual liberty needs to be nuanced by an appreciation of those substantial controls that Mill was willing to place upon individuals.Hamburger suggests that the association of Mill with modern liberalism results from viewing the arguments presented in On Liberty in isolation from the context in which they were written. Hamburger argues that Mill's real purpose in writing On Liberty is neither self-evident nor is it one that is easily assimilated to modern libertarian ideals. Hamburger interprets "Mill as making an esoteric argument in On Liberty" (xvii). There are two additional pieces that Hamburger claims one needs in order to properly decipher the puzzle, and thus grasp the true import of Mill's claims concerning liberty. First, Hamburger argues that Mill's desire to bring about cultural reform was dependent upon his rejection of Christianity. Mill's unpublished writings reveal that he was far more antagonistic to the influence of Christian religion than is often recognized. Hamburger argues that for Mill initiating true moral reform depended upon overcoming the old social order of which Christianity was a primary constituent. In order for this to occur, one needed "to establish liberty for those who would implement his plan for moral reformation" (86). Second, Hamburger argues that we must also grasp Mill's view of history if we are to properly understand his project of moral reform and the place of On Liberty within this project. Hamburger claims that Mill's vision of history was strongly influenced by thinkers such as Comte and St. Simon. From them, Mill adopted the view that societies alternate between transitional and natural states, and that the values that are applicable in these states are quite different. Hamburger claims that "Mill easily recognized his own age as being transitional," and that this influences all of his arguments in On Liberty (111).Putting the above together, Hamburger concludes that Mill's arguments are specifically directed toward securing the liberty of those who would combat the influence of Christianity and the old moral order, and that "the liberty recommended in On Liberty was especially valued because it would hasten the undermining of old doctrines and institutions which occurred in transitional periods" (212). Hamburger argues that the liberty that Mill meant to secure in this work was not intended to apply equally to all persons or in all periods. Thus, Hamburger argues that Mill was quite willing to advocate strong forms of social control in other contexts.The latter claim, which Hamburger argues provides a more coherent interpretation of On Liberty, does not necessarily follow from Mill's view of religion and history. Here, I think there is room for two distinct judgments regarding Hamburger's achievement in this book. Hamburger has undoubtedly provided a great service in examining the often neglected areas of Mill's corpus and their relevance to his more prominent works. Philosophers who view On Liberty as an isolated piece of argument, or at best only consider it in relation to Mill's Utilitarianism, thus would profit much from reading this work. I am less convinced, however, of Hamburger's claim that heeding these aspects of Mill's thought will lead one to form a radically different understanding of Mill's claims concerning... (shrink)

This is a very informative and lucid account of the career of a central philosophical topic in eighteenth‐century Britain, the debate between libertarians and necessitarians, from Locke to Dugald Stewart. The work has many strengths, and I learnt much from it. It will be of great interest to historians of the period, but the readership should be wider than that. Those working on the debate today should also read this book. Harris (quite legitimately) does not see his task as that (...) of a historian of philosophy, mining old texts in pursuit of contemporary discussion. Instead he seeks to understand the philosophers and their problems on their own terms. In doing so, however, he offers an alternative perspective that may be enlightening to those in the thick of present‐day trench warfare. He not only discusses some neglected figures but also changes our understanding of those with whom we are familiar, especially Hume. I begin by laying out the main themes of the book and its contents. I then discuss Harris' treatment of Hume in more detail. (shrink)

It is often said nowadays that there has been a great revival of practical philosophy. But the complaint is also sometimes heard that philosophers do not have much practical influence and that, as philosophers, they do too little practical work in public communication and politics. Such statements raise questions about the nature of practical philosophy and about the proper role of philosophers in social and political practice.

This is a short but very interesting book, which repays study. It is essentially a defence and an application to medical ethics of the principle of liberty (page 12), that “the liberty …of competent, well-informed, free agents must be …maximally protected in matters which concern only or mainly themselves”. Adoption of this Millian principle, which is argued for in the introduction, along with the adoption of principles of equality (that the needs and interests of all should be taken (...) into account) and of responsibility for the welfare of one's fellow beings, raises, it may be said, three questions: who is a person (and therefore to be taken into account); when is a person sufficiently competent, and when do people have to sacrifice some liberty to help or protect the welfare of others? Chapter 1 tackles the first of these questions, following the defence of the principle of liberty in the introduction; chapters two to four deal with issues raised by the second question—whether …. The aim of this essay is to clarify the meaning and extent of Kant's liberalism by contrasting some of his key ideas to those of Burke, Hobbes, Machiavelli, Nozick, Rawls, and Schmitt. My claim is that Kant's political philosophy navigates the path between the extremes of liberalism and conservatism, just as his theoretical philosophy tries to navigate between dogmatism and skepticism, and that current liberal claim on Kant has important limitations in Kant's letter, as well as in spirit.

Conceived in Liberty is a cultural, sociological and geopolitical review of the uniquely American notion that the country and its people are "exceptional." While all nations have their own patriotic commitments, no other people have outwardly declared their power as vigorously as have Americans, especially since World War II. John J. Tierney, Jr. advances the idea that liberty is the singular source of the power of the American worldview and all other elements of this society--equality, patience, charity, justice, (...) etc.--are derived from liberty. He argues that this worldview comes from this one source and is responsible for the many movements that may engage the public's interest, such as women's rights, civil rights, and voting rights. I argue that the indifference view of manipulative transparency is not aligned with positive liberty, contrary to Franke’s claim, and even if it is, it is not aligned with the risk that many have attributed to pursuits of positive liberty. Hegel presents significant accounts of “conscience” (Gewissen) at decisive moments both in the early Phenomenology of Spirit and the Philosophy of Right. In spite of some important similarities between these accounts, they present deeply different, perhaps even inconsistent, understandings of the nature and value of individual conscience. Roughly, on the Philosophy of Right account, conscience is fundamentally something inward and individualizing, requiring transformation if it is to be integrated into the social institutions and practices that constitute modern “ethical life.” By (...) contrast, in the Phenomenology of Spirit, conscience is always already fundamentally social, entailing demands that individuals both realize their convictions in actions that are, in principle at least, available to others, and that they be able discursively to articulate, justify, and, in some cases, modify their convictions in relation to others. Drawing on this contrast between two understandings of the nature and value of conscience, I consider two models of the liberty of conscience. On the first model, the liberty of conscience fundamentally entails the need for the protection of an inward sphere over which institutions ought not to attempt to exercise coercive influence. On the second, the liberty of conscience entails acknowledging the discursive and social character of conscience, so that, while individuals should be entitled to a sort of moral autonomy, that autonomy entails an equal demand to be able to justify their convictions to others, and to respond reasonably to the claims that others make on them. I argue that Hegel’s concept of “spirit,” which suggests that selfhood is fundamentally a product of concrete relations among individuals, provides stronger support for the second model of the liberty of conscience.
