The relations of power between healthcare-related institutions and the professionals that interact with them are changing. Generally, the institutions are gaining the upper hand. Consequently, the intellectual abilities necessary for professionals to pursue the internal goods of healthcare are changing as well. A concrete case is the struggle over sickness benefits in Sweden, in which theSwedish Social Insurance Agency(SSIA) and physicians are important stakeholders. The SSIA has recently consolidated its power over the sickness certificates that doctors issue for their patients. (...) The result has been a stricter gatekeeping of sickness benefits. In order to combat the inroads made by state institutions into sickness certification, and into the sphere of medical practice, some doctors have developed cunning “techniques” to maximize the chance to have their sickness certificates accepted by the SSIA. This article attempts to demonstrate that cunning intelligence—the ability of the weak to “outsmart” a stronger adversary—plays an important role in the practice of medicine. Cunning intelligence is not merely a defective form of prudence (phronesis), nor is it simply an instance of instrumental reason (techne), but rather an ability that occupies a distinct place among the intellectual abilities generally ascribed to professionals. Study on the concept of substance, one of the basic elements in Jaina philosophy.

According to a (once) venerable tradition, our knowledge of the external world is crucially dependent on divine favor: our ability to obtain knowledge of the world around us is made possible by God’s having so ordered things. I argue that this view, despite its unpopularity among con­temporary philosophers, is supported by a certain inference to the best explanation: namely, it provides an effective way of reconciling two widely held beliefs that, on the assumption of naturalism, appear incompatible: (1) that knowledge (...) is incompatible with the kind of luck present in Gettier sce­narios and (2) that arguments for external world skepticism can be effectively rebutted by “shifting” them in the style of G. In my paper I tackle the question of whether the term “philosophy” should be restricted to a specific tradition or whether it could be used also for other traditions. I argue in favor of the latter solution from extrinsic and intrinsic viewpoints. From extrinsic viewpoint, more liberal use of the term could facilitate exchanges between scholars of different traditions of thought. From intrinsic viewpoint, I propose an understanding of philosophy as creation of concepts and concepts as contractions and (...) embodiment of reality, not as abstractions or representations of it. One important version of the problem of divine freedom is that, if God is essentially good, and if freedom logically requires being able to do otherwise, then God is not free with respect to willing the good, and thus He is not morally praiseworthy for His goodness. I develop and defend a broadly Molinist solution to this problem, which, I argue, provides the best way out of the difficulty for orthodox theists who are unwilling to relinquish the Principle of Alternate (...) Possibilities. The solution is that the divine essence includes the property of transworld goodness: i.e., for any possible morally significant choice that God could have faced, if God had actually faced it, God would have chosen to will the good. This view makes coherent the otherwise paradoxical theological intuition that it is within God’s power to do something evil, but He would not ever do such a thing. (shrink)

Gandhi’s writings on moral issues propose an easiest formula to the world to establish harmony and peace in the global society. In a world where people are confronting a psychological fear of sudden terror and violence, the Gandhian formula of ‘non-violence (ahimsa) as a means’ to form a perfect harmonious world is getting strong attention of the world-community. Truth and non-violence are the two most valuable ingredients of Gandhian moral thoughts. For him, Truth or God is the end and non-violence (...) is the mean and the two can not be separated. They are more effective in life when they are used in their united form. This unity can be actualized only through the motive of ‘love to humanity’ without separating one person from another on any ground. He argues that the unity of truth and non-violence is a better way to have a moral and harmonious life. In this paper, I will focus upon the Gandhian formula in wider perspective, which reflects in his political activities and his writings as well, with the contention that it is highly applicable to normalize the violence rooted in different parts of the world at both the levels of religious and political. I will contend that Gandhian notion of truth and non-violence in terms of ends and means may play a medicinal role to harmonize the world suffering from extremism and terrorism. (shrink)

The commonly occurring metaphors and models of the doctor–patient relationship can be divided into three clusters, depending on what distribution of power they represent: in the paternalist cluster, power resides with the physician; in the consumer model, power resides with the patient; in the partnership model, power is distributed equally between doctor and patient. Often, this tripartite division is accepted as an exhaustive typology of doctor–patient relationships. The main objective of this paper is to challenge this idea by introducing a (...) fourth possibility and distribution of power, namely, the distribution in which power resides with neither doctor nor patient. This equality in powerlessness—the hallmark of “the age of bureaucratic parsimony”—is the point of departure for a qualitatively new doctor–patient relationship, which is best described in terms ofsolidaritybetweencomrades. This paper specifies the characteristics of this specific type of solidarity and illustrates it with a case study of how Swedish doctors and patients interrelate in the sickness certification practice. Brian Black's In Dialogue with the Mahābhārata is a brilliant book that exhibits three distinct features which can certainly help an inquiring mind understand not only the structure and nature of the text of the Mahābhārata but also (...) the meanings contained in it, alongside aspects of Hindu historiography. It investigates the text through literary, philosophical, and social perspectives that Black argues emerge in the dialogues over strī-dharma, puruṣa-dharma, and the social identity and status of women (see for example, pp. 117, 124, 130, 140). The work's literary character can be seen in Black's analysis of the text and its epical narratives. In this book, the story of the Mahābhārata is presented by Black as a web of narratives wherein every verbal encounter and dialogue among all the participating interlocutors refers to a specific meaning and (deterministic) role played by these divine and terrestrial characters as interlocutors: "All the main human characters are incarnations and/or descendants of divine figures…and [experience] intense emotional reactions to their own situations and the actions of others" (p. 5). For instance, most male and female characters in the narratives of the Mahābhārata, including Vyāsa (the author), who is said to have "the power of omniscience," and Kṛṣṇa, who is God Himself, help the readers extrapolate how the entire series of trailing events in the Mahābhārata is destined to happen. This is what Black highlights when he writes that "as author of the narrative, [Vyāsa's] appearances within it often move the story along, as well as offer lenses through which to understand its cosmic implications" and that he "draws on his omniscience to provide an explanation of the marriage that transcends the knowledge of ordinary humans" (p. 61). Further, Black emphasizes destiny's (active) role when he writes that "the story of Draupadī's previous birth invites reading the Mahābhārata as a karmic narrative in which the actions and decisions of characters create the conditions for subsequent events in the central story" (p. 76). Perhaps for this reason, Black highlights his methodological approach to the text and its literary character in the beginning of the book to explain that the Mahābhārata is more like a complex narrative than any other Hindu legend or mythology and is difficult to understand without contextualizing its dialogues and [End Page 1] their historical connections. Besides, the temporal aspect of the conversations between the characters is another literary condition to connect various sub-narratives to the main story. Black uses the term "dialogue" in three different ways while examining the text of the Mahābhārata, and this is how he proposes the text should be explored by the inquisitive mind:I understand the term "dialogue" in three main ways: (1) as verbal encounter: the conversations, discussions, and debates between characters within the text; (2) as intra-textuality: the relationship between different dialogues in different sections of the text; and (3) as hermeneutics: my interpretive approach to the text. The implicit activities of the living body in sports (such as heart rate, involuntary gestures, stress, reflex, emotional regulation and interaction expressions) emerge in the consciousness of the lived body without our voluntary control. We demonstrate physiological emersion, and how, including in dramaturgical perception, physiological flows and processes collide with the image of a whole body. In this paper, we introduce corporeal non-property as the missing (?) link between phenomenology and neuroscience, renewed by research on the cerebral unconscious and the (...) perception of their lived body. Rather than mindfulness, physical activity obliges the subject to learn the unconscious and his motor skills from his living body: a new psychoanalysis of sport is thus established by studying what emerges from the activity of the living body up to the level of the conscious description of motor action. In this paper, we explain why that awareness occurs, and why it matters for the understanding of unconscious activity of the athlete’s living body. This is potentially interesting, although it needs, as a theory, to overcome the obvious reliance of the body on unconscious or habitual/automated physiological processes. But the incorporation of body techniques forms a habitus. (shrink)

In this short paper, I argue that legal philosophers ought to focus more than they have done so far on problems of legal reasoning. Not only is this a field with many philosophically interesting questions to consider, but it is also, in my estimation, the field in which legal philosophers can contribute the most to both the study and the practice of law. For even though reasoning and interpretation are at the center of what legal practitioners and legal scholars (...) do, neither legal practitioners nor legal scholars reason with the same care and precision as philosophers do. Against this background, I suggest that the following three types of questions regarding legal reasoning are especially worthy of serious consideration. The first is that of the possible relevance of the theory of reasons holism to legal reasoning in general. The second is the question of how to analyze legal statements in a way that does not undermine the rationality of legal reasoning. And the third is the question of whether legal arguments are to be understood as deductive arguments, or as inductive arguments, or both, and if so how. (shrink)

Adam Smith is the best known among economists for his book, The Wealth of Nations, often viewed as the keystone of modern economic thought. For many he has become associated with a quasi-libertarian laissez-faire philosophy. Others, often heterodox economists and social philosophers, on the contrary, focus on Smith's Theory of Moral Sentiments, and explore his moral theory. There has been a long debate about the relationship or lack thereof between these, his two great works. This work treats these (...) dimensions of Smith's work as elements in a seamless moral philosophical vision, demonstrating the integrated nature of these works and Smith's other writings. Reasonable individuals can disagree about philosophical questions. This disagreement sometimes takes the form of conflicting intuitions; the seminar room provides many examples. Experimental philosophers, who have devoted themselves to the systematic study of intuitions, have found empirical support for what anecdotes suggest. Their data often reveals that a significant minority of subjects have intuitions counter to those of the majority.1 A recent replication of [Knobe, 2003a] discovered three distinct subgroups of subjects with three distinct patterns of response. Only about (...) one-third of subjects gave the expected asymmetric responses to Knobestyle probes. The other two-thirds gave symmetric responses to harm and help probes, with about half judging side-effects were intentional in both harm and help cases and half judging that they were intentional in neither [Nichols and Ulatowski, 2007]. This study examines the logical coherence of the theological claim that Jesus was "truly man and truly God." The primary question dealt with is whether or not it is possible for one person to have all of the properties necessary for being fully divine and all of the properties necessary for being fully human. The philosophical approach is analytic, focusing upon alleged coherence problems generated by applying the Indiscernibility of Identicals to statements about Jesus. Two extended arguments against the coherence (...) of the doctrine of the incarnation are examined and rebutted. The bulk of the study is a presentation and evaluation of five modern philosophical approaches to solving the coherence problems generated by the Indiscernibility of Identicals. These are Relative Trinitarianism, the One-Nature view, the Reduplicative maneuver, kenoticism, and the Two-Minds view. Relative Trinitarianism is rejected because it denies the Indiscernibility of Identicals as a logical principle. The One-Nature view unnecessarily alters the concept of divinity and it, too, is rejected. Traditional kenoticism is judged an inadequate response to the incoherence challenge, but a revised kenoticism does show that many statements about Jesus can be coherently stated. This revised kenoticism eliminates coherence problems concerning many properties of Jesus, but not all. Some statements about Jesus, particularly modal statements, can be coherently stated as reduplicative statements. The problem is that some Steven A. Long incarnational property adjectives do not appear to be logically attributive, hence they cannot be predicated reduplicatively. Though the Two-Minds view is rejected, some features of it are used to show how incarnational property adjectives can be logically attributive and predicated reduplicatively. The conclusion is that there are no convincing arguments against the coherence of the incarnation and that a revised kenoticism and the Reduplicative maneuver together can be used to formulate a coherent interpretation of the doctrine of the incarnation that is possibly true. Philosophers less subtle than those of the Middle Ages feel no difficulty about such words as “and” or such phrases as “member of”; but even to write “man and society” has committed us to an assumption which may not be justifiable, and to say that men are “members” of a community or of a trade union is so alarming a metaphor that it would startle Duns Scotus. It is unwise, however, to ask philosophers what they mean when they feel very (...) passionately about what they say, for the confusion becomes even greater than it was if passion gets into explanation. It is supposed to be obvious that men exist and that States and Trade Unions and Churches exist; and who would be so foolish as to raise difficulties about the difference between existence and essence? Many who claim to be scientists with regard to politics or economics suppose it to be obvious that there is an “essence” called “public opinion” or “the will of the people” or “utility”; and what Occamite would now dare to say that entities are not to be multiplied? Leo Strauss and his alleged political influence regarding the Iraq War have in recent years been the subject of significant media attention, including stories in the _Wall Street Journal _and _New York Times._ _Time_ magazine even called him “one of the most influential men in American politics.” With _The Truth about Leo Strauss_, Michael and Catherine Zuckert challenged the many claims and speculations about this notoriously complex thinker. Now, with _Leo Strauss and the Problem of Political Philosophy_, they turn (...) their attention to a searching and more comprehensive interpretation of Strauss’s thought as a whole, using the many manifestations of the “problem of political philosophy” as their touchstone. For Strauss, political philosophy presented a “problem” to which there have been a variety of solutions proposed over the course of Western history. Strauss’s work, they show, revolved around recovering—and restoring—political philosophy to its original Socratic form. Since positivism and historicism represented two intellectual currents that undermined the possibility of a Socratic political philosophy, the first part of the book is devoted to Strauss’s critique of these two positions. Traditional Plato scholarship, in the English-speaking world, has assumed that Platonic dialogues are merely collections of arguments. Inevitably, the question arises: If Plato wanted to present collections of arguments, why did he write dialogues instead of treatises? Concerned about this question, some scholars have been experimenting with other, more contextualized ways of reading the dialogues. This anthology is among the first to present these new approaches as pursued by a variety of scholars. As such, it offers new perspectives on Plato (...) as well as a suggestive view of Plato scholarship as something of a laboratory for historians of philosophy generally. This paper examines the formation of the philosophical canon in the period immediately after Kant. After a general introduction to the “historiography of philosophy,” it brings together three strands of contemporary scholarship in this area: a historical criticism of the empiricism/rationalism distinction that is often still used to understand early modern philosophy (Vanzo), histories of the exclusion of women from the history of philosophy in the late eighteenth century (O’Neill), and histories of the exclusion of non-European (...) class='Hi'>philosophy (Park). Though these scholars have different agendas, their studies share many conclusions, including the key claim that the little-known Kantian historian of philosophy Wilhelm Tennemann is the central figure in the formation of the standard story. The paper closes by comparing the main outline of Tennemann’s surprisingly familiar narrative of the history of philosophy with the standard text from before the Kantian revolution in the historiography of philosophy. Mandair (bio)Let me begin this response by thanking the editors of Philosophy East and West for generously allowing space for this review forum on my recent book, Sikh Philosophy: Exploring Gurmat Concepts in a Decolonizing World (Bloomsbury, 2022), and thanking the reviewers Monika-Kirloskar Steinbach, Ananda Abeysekara, and Jeffery Long for their careful readings of this work. "Sikh Philosophy" (...) names the modern academic discourse that crystallized in the late nineteenth and early twentieth centuries as a result of the encounter between modern Western philosophy and gurmat, a mode of thought-praxis deriving from and associated with Sikhi (lit. "the path of learning"), a spiritual-philosophical tradition hailing from India, which most readers may only have encountered through the modern knowledge system's categorization of it as the religion known as Sikhism. To avoid complicating the discussion, I will be referring interchangeably to gurmat and Sikh philosophy, even though they represent quite different entities. Gurmat represents a tradition of thought-praxis that goes back to Guru Nanak, the founder of Sikhi, whereas Sikh philosophy is a modern formation that emerged from the encounter between gurmat and European thought, which is why I prefer to regard it as an assemblage. The book examines some of the key concepts of Sikh philosophy and how they inform its vision of life, what they tell us about the nature of reality, and whether it is possible to discern a distinct logic, epistemology, and ontology based on the principles of gurmat. In their reviews, Kirloskar-Steinbach, Abeysekara, and Long have provided critical readings and insightful questions, which I address below.Monika Kirloskar-Steinbach asks about the relationship between Sikh philosophy and Indian philosophy, noting that my book does not explicitly engage Indian philosophy. Specifically, she raises two questions: (1) whether Sikh philosophy should or potentially could be part of the broader field of Indian philosophy, and (2) whether I would be inclined to contribute to that field, particularly in light of recent efforts to diversify philosophical practices within Indian philosophy by scholars like Jonardon Ganeri in his Oxford Handbook of Indian Philosophy (2017) and Purushottama Bilimoria and Amy Rayner in their History of Indian Philosophy (2018). My immediate response would be "yes," but with an important caveat. In that vein, I applaud Ganeri's and Bilimoria/Rayner's efforts to open up philosophical inquiry within Indian traditions and take them beyond darśanic framings that narrowly positioned different thought-practices of South Asia either within or [End Page 364] in relation to the Brahmanical/Vedic/Sanskritic paradigm. Ganeri's "multiperspectival" narrative about practices might well enable discussions about Sikh philosophy to flourish, given that the lexicon of gurmat (the teaching, logic, practice of the Guru) is replete with concepts that have cognate terms in the main Hindu philosophical schools including Sāṃkhya, Yoga, Mīmāṃsā, and Vedānta; the Jain and Buddhist traditions; and perhaps most importantly, within the Islamic, especially Sufi, traditions. It is the seeming parity between cognate terms such as the Punjabi dharam (Skt. dharma), karam (Skt. karma), yoga, śabad (Skt. śabda), guru, hukam, and many more, which has given rise to the misperception that Sikh philosophy is a purely syncretic thought system parasitic on earlier Indic systems. A similar misperception might be that Sikhi is more primarily a mode of lived praxis or dharam than it is a philosophy (Bhogal 2018) and therefore has less to do with thought than with spiritual attainment. But this approach is far too narrow in that it opposes "philosophy"/"thought" to spiritual praxis without asking whether there might be a broader definition of thinking at play within Sikhi or gurmat. Such an approach fails to extricate itself from the legacy of imperial categorizations of Indic traditions as essentially religious and therefore unrelated to what is called "thinking." By doing so, it falls prey to another misconception many have, that the closest Indians have come to philosophical thought are the darśanic schools, not realizing that most Indian philosophers and thinkers were at the same time devotees and spiritual adepts who developed rigorous modes of discipline and practice.Having said this, I would premise any... This article examines some of S. Lem’s statements about his philosophical and worldview positions regarding the mysterious nature of language and the linguistic sign, the connection between language, mind and reality. The main goal of the paper is to understand what texts on the philosophy of language the Polish thinker read and what attitude he has formed towards them. Lem is the follower of an analytical intellectual culture that focuses on the naturalistic worldview and the consequences of the “linguistic (...) turn” in Western philosophy. For Lem, language is not only an interesting philosophical object, but also a complex precise instrument of his own creative thinking. In this regard, the philosophy of language for a writer cannot be based only on logical-linguistic atomistic methodology. Lem seeks in his contemporary interdisciplinary methods ways to combine realistic and anti-realist positions. Many concepts, such as “the effect of semantic transparency”, “polymorphic language model”, “variation model” are quite correlated with modern theories of language and require additional philosophical comments.
