This article examines the role of experimental generalizations and physical laws in neuroscientific explanations, using Hodgkin and Huxley’s electrophysiological model from 1952 as a test case. I show that the fact that the model was partly fitted to experimental data did not affect its explanatory status, nor did the false mechanistic assumptions made by Hodgkin and Huxley. The model satisfies two important criteria of explanatory status: it contains invariant generalizations and it is modular (both in James Woodward’s sense). In this paper, we explicate an underappreciated distinction between two conceptions of valuing. According to the first conception, which we call the surface-account, valuing something is exclusively a matter of having certain behavioral, cognitive, and emotional dispositions. In contrast, the second conception, which we call the layer-account, posits that valuing is constituted by the presence of certain representational mental states underlying those dispositions. In the first part of the paper, we introduce the distinction in proper detail and show that the (...) accounts have different implications regarding the valuings of agents. In the second part, we situate the accounts within the extant philosophical literature. First, we relate them to the recent debate between so-called dispositionalists and representationalists about the nature of beliefs and point out that this debate can help anticipate some of the main dialectical fault lines to be expected between surface- and layer-theorists. Second, we examine the contemporary meta-ethical debate on conceptualizing valuing, indicate that scholars have largely ignored the distinction introduced here, and outline that this oversight has substantial theoretical costs: as we show, key arguments within the meta-ethical debate require thorough re-evaluation in light of the proposed distinction. The third part of the paper illustrates the theoretical leverage of the distinction for practical research by exploring its implications for behavioral welfare economics. (shrink)

Preventive medicine is sometimes criticised as it contributes to medicalization of normal life. The concept ‘medicalization’ has been introduced by Zola to refer to processes in which the labels ‘healthy’ and ‘ill’ are made relevant for more and more aspects of human life. If preventive medicine contributes to medicalization, would that be morally problematic? My thesis is that such a contribution is indeed morally problematic. The concept is sometimes used to express moral intuitions regarding the practice of prevention and health (...) promotion. Through analysis of these intuitions as well as some other moral concerns, I give an explication of the moral problems of medicalization within the context of preventive medicine. (shrink)

Environmental pollution and greenhouse gas emissions that contribute to climate change have adverse impacts on global health. Somewhat paradoxically, health care systems that aim to prevent and cure disease are themselves major emitters and polluters. In this paper we develop a justification for the claim that solidaristic health care systems should include sustainability as one of the criteria for determining which health interventions are made available or reimbursed – and which not. There is however a complication: most adverse health effects (...) due to climate change do occur elsewhere in the world. If solidarity would commit us to take care of everyone’s health, worldwide, it might imply that solidaristic health system cannot justifiably restrict universal access to their own national populations. In response we explain health solidarity is to be considered as a moral ideal. Such an ideal does not specify what societies owe to whom, but it does have moral implications. We argue that ignoring sustainability in political decision making about what health care is to be offered, would amount to betrayal of the ideal of solidarity. (shrink)

For contagious diseases like measles a successful immunization program can result in herd protection. Small outbreaks may still occur but fade out soon, because the possibilities for the pathogen to spread in the ‘herd’ are very small. This implies that people who refuse to participate in such a program will still benefit from the protection it offers, but they don’t do their part in maintaining protection. Isn’t that a case of freeriding—and isn’t that unfair towards all the people who do (...) collaborate? If so, that might be considered an additional ground for making vaccination mandatory or compulsory.In this paper I argue that vaccination refusal can be considered as freeriding, but that this might not be unfair. The public good of herd protection is a peculiar public good because it supervenes on private benefits that are enjoyed by all who do opt for vaccination. For vaccinated individuals, the additional benefit of herd protection comes about, as it were, for free, and hence they can’t complain that others benefit without sharing in the burdens. There are however still other grounds for making vaccination compulsory or at least for seeing refusal as a morally wrong choice. (shrink)

Le 'Journal métaphysique', qui, primitivement, n'était pas destiné à la publication, est constitué par un ensemble de notes philosophiques rédigées au jour le jour. L'évidente différence de style entre les deux parties tient au fait que sous la pression de la guerre la pensée de l'auteur s'est tournée de plus en plus résolument vers le concret, vers l'existentiel, qui a trouvé dans le Journal métaphysique une des premières expressions qu'il ait revêtues en France. Il ne faut d'ailleurs pas parler de (...) l'existentialisme, mais une thématique de l'existence considérée dans sa spécificité tend à s'y constituer par une réflexion qui se concentre de plus en plus sur le corps propre (par opposition au corps-objet ou instrument), sur la sensation traitée non plus comme message mais comme façon d'être au monde, sur la mémoire, sur la volonté, etc. Des phénomènes métaphysiques tels que la télépathie, la lecture de pensées, etc. sont considérés avec une attention particulière et l'auteur va jusqu'à se demander s'il ne conviendrait pas d'inverser la relation communément pré-supposée entre le psychologique et le métapsychique et si la clef des phénomènes dits normaux ne devrait pas être cherchée dans le supra-normal. One of the societal problems in a new influenza pandemic will be how to use the scarce medical resources that are available for prevention and treatment, and what medical, epidemiological and ethical justifications can be given for the choices that have to be made. Many things may become scarce: personal protective equipment, antiviral drugs, hospital beds, mechanical ventilation, vaccination, etc. In this paper I discuss two general ethical principles for priority setting (utility and equity) and explain how these principles will (...) often point in diverging directions. Moreover, each of these principles can be understood in different, again often competing, ways. Notwithstanding these controversies and conflicts, in the context of pandemic response there are at least some points of convergence: several policies can be justified by appeal to different ethical principles and theories. Convergence may be found with respect to a focus on saving the most lives (instead of other aggregative accounts); giving priority antiviral prophylaxis and therapy for life-saving pandemic responders; and, partly depending on epidemiology of the pandemic, to prioritise vaccination of children. Although decision-making about access to intensive care will involve choices with immediate tragic implications, the ethical complexity of these choices is relatively modest (although decisions will not be easy): there are persuasive moral reasons for giving priority to patients who are expected to benefit most within the shortest time. Finally, in the last section I tentatively argue that constraints on people’s freedom, as necessary for an effective public health approach, may support giving somewhat more weight to saving the most lives, than to concerns of equity. Some screening tests for donor blood that are used by blood services to prevent transfusion-transmission of infectious diseases offer relatively few health benefits for the resources spent on them. Can good ethical arguments be provided for employing these tests nonetheless? This paper discusses—and ultimately rejects—three such arguments. According to the ‘rule of rescue’ argument, general standards for cost-effectiveness in healthcare may be ignored when rescuing identifiable individuals. The argument fails in this context, however, because we cannot identify beforehand who will (...) benefit from additional blood screening tests. On the ‘imposed risk’ argument, general cost-effectiveness standards do not apply when healthcare interventions impose risks on patients. This argument ignores the fact that imposing risks on patients is inevitable in healthcare and that these risks can be countered only within reasonable limits. Finally, the ‘manufacturing standard’ argument premises that general cost-effectiveness standards do not apply to procedures preventing the contamination of manufactured medical products. We contend that while this argument seems reasonable insofar as commercially manufactured medical products are concerned, publicly funded blood screening tests should respect the standards for general healthcare. We conclude that these particular arguments are unpersuasive, and we offer directions to advance the debate. (shrink)

Darwin famously held that his use of the term "chance" in evolutionary theory merely "serves to acknowledge plainly our ignorance of the causes of each particular variation". Is this a tenable view today? Or should we revise our thinking about chance in evolution in light of the more advanced, quantitative models of Neo-Darwinian theory, which make substantial use of statistical reasoning and the concept of probability? Is determinism still a viable metaphysical doctrine about biological reality after the quantum revolution in (...) physics, or dowe have to abandon it in favor of an objective indeterminism? In light of such reflections, what is the relevant interpretation of probability in evolutionary theory? Do biologists use the concept of probability because they are finite cognitive agents or because the evolutionary process is fundamentally probabilistic? In this paper, I will show that we do not yet fully understand the nature of chance in evolution. (shrink)

Many nursing homes have an influenza vaccination policy in which it is assumed that express (proxy) consent is not necessary. Tacit consent procedures are more efficient if one aims at high vaccination rates. In this paper I focus on incompetent residents and proxy consent. Tacit proxy consent for vaccination implies a deviance of standard proxy consent requirements. I analyse several arguments that may possibly support such a deviance. The primary reason to offer influenza vaccination is that vaccinated persons have a (...) significantly reduced risk of getting the flu. This reason however cannot support the assumption that each nursing home resident is ‘better off ’ if she is vaccinated. Neither can it support tacit proxy consent policies. More promising are arguments that take the collective nature of infectious diseases into account. A potentially strong, but ultimately insufficient, argument for non‐express consent is that vaccination contributes to prevention of harm to others. Other arguments emphasise the importance of group protection: herd immunity. I discuss three collective reasons for aiming at herd immunity: solidarity, a common interest in reducing the risk of illness, and a common interest in the prevention of an influenza outbreak. The latter argument appears to be most important. An outbreak is not just detrimental to the health of residents; it is detrimental to their everyday social life as well. Outbreaks can be seen as a collective evil. My analysis shows that there are valid (though not necessarily sufficient) moral arguments for a tacit proxy consent policy. (shrink)

Bergier, un des rares polémistes catholiques de talent face aux « Lumières », publie en 1788 un important Dictionnaire de théologie. Son article « Femme » est un des premiers, dans un dictionnaire « catholique », à prendre la « Femme » comme sujet et non comme simple partenaire de l'« Homme ». Avec esprit critique et logique, il y développe lieux communs (souvent proches des philosophes), points d'apologétique (« ce que le christianisme a fait pour les femmes ») ou (...) de controverse. Vingt autres articles, abordant les questions féminines, manifestent que si Bergier considère la femme comme l'égale de l'homme devant Dieu, il conserve sur sa place dans la société des préjugés de son temps, telle la nécessaire « dépendance ». Cet « inégalitarisme » ne va pourtant pas sans remises en question (paradoxales et rares à l'époque), et il prend souvent la défense des femmes face au sort qui leur est fait. (shrink)

RésuméL'analyse du développement des activités électriques du cerveau chez l'enfant au moyen d'examens électro‐encéphalographiques répétés en série longitudinale nous donne l'occasion d'exprimer quelques considérations générales sur les notions d'organisation, de continuité et discontinuité du développement des fonctions cérébrales. Du point de vue méthodologique, une premihre difficulté provient de ce que la technique utilisée est à la fois objective et subjective: objective en tant qu'elle comporte un enregistrement physique très exact des activités physiologiques du cerveau, exprimées par des variations de potentiel (...) électrique , subjective du fait que les tracCs obtenus doivent être analysCs et interprétés empiriquement par un spécialist.e expérimenté. Même si I'on recourt à certains procédés physiques d'analyse des tracés , on ne peut définir objectivement que certains parametres élémentaires, tels que la fréquence, le voltage et les relations de phase. Ces méthodes d'analyse objectives restent incapables toutefois d'exprimer le 〈pattern〉, c'est‐à‐dire la configuration temporo‐spatiale de l'activité Clectrique dans ce qu'elle à d’〈essentiel〉 et de 〈général〉; elles ne peuvent se substituer entibrement à l'analyse qualitative et subjective. Une autre difficulté technique réside dans le fait que si les examens ne sont pas répétés à des intervalles suffisamment courts et égaux ou si un examen est omis, il peut résulter d'un intervalle trop grand entre deux examens une impression inadéquate de discontinuité du développement.Ces écueils méthodologiques évités, l'analyse des examens EEG en séries longitudinales montre que le développement des activités Clectriques cérébrales s'effectue de faqon continue et progressive, conformément à un plan d'organisation . Ce plan s'exprime partiellement lors dechaque examen, mais de façon compléte seulement dans le pattern définitivement organisé de l'adolescent de 15 ans. Dans cette continuité du développement, on peut distinguer toutefois certaines époques, où I'organisation du 〈pattern〉électrographique paraît s'intensifier, se précipiter et se consolider. Ces époques, qui produisent alors l'impression d'une certaine discontinuité, méritent le nom de stades. On les rencontre chez I'enfant à l'âge de 6 à 7 ans, 9 à 9,6 ans, 11 ans, 13 ans et 15 ans. Le dkveloppement complet exprimé par le 〈pattern〉 electrographique de l'adolescent de 15 ans se caractérise par une différenciation, systématisation, stabilisation et localisation des activités éklectriques cérébrales. II existe en outre une correspondance entre cette conception du développement, baske sur l'analyse d'examens Clectro‐enckphalographiques en série longitudinale et celle de Piaget et Inhelder, basée sur des tests psychologiques des fonctions cognitives: conception du développement sous forme d'une succession de paliers d'équilibre d'extension toujours plus large et de mobilité toujours plus grande en même temps que de stabilité croissante. Enfin, il existe par ailleurs une concordance entre la chronologie des stades du développement électro‐physiologique et celle du développement des fonctions cognitives. (shrink)

It can be argued that there is an ethical requirement to classify correctly what is known and what is unknown in decision situations, especially in the context of biomedicine when risks and benefits have to be assessed. This is because other methods for assessing potential harms and benefits, decision logics and/or ethical principles may apply depending on the kind or degree of uncertainty. However, it is necessary to identify and describe the various epistemic states of uncertainty relevant to such estimates (...) in the first place. Therefore, this paper aims to develop a category system of different epistemic states of uncertainty which, although not exclusively, is primarily intended to be applied to early clinical trials. It is formed on the basis—and various combinations—of three dimensions of uncertainty that represent certain parts of incomplete knowledge: outcome (type of event), probability (of outcome) and evaluation (assessment of outcome). Furthermore, it is argued that uncertainty can arise from three different sources (the structure of the object of research, the state of the evidence, or individual handling of the research and already existing knowledge). The categories developed are applied to actual examples from gene therapy and genome editing to illustrate that they can be helpful for a more precise definition of the respective uncertainties, especially in the context of risk–benefit assessment. The categories allow a differentiated perspective of decision-making situations from the point of view of incomplete knowledge in general, but particularly, for example, in early clinical research, and may thereby support a more acceptable ethical assessment of potential harms and benefits. Klemke en Jaap van Heerden. -/- English: The question of the meaning of life is the subject of a lively scholarly debate both in the Netherlands and abroad. I concentrate on an aspect of this question that has often been mentioned but is still waiting for a careful treatment: the analogy between linguistic meaning and the meaning of life. With respect to linguistic meaning, I distinguish between two types of theories of meaning. According to the first type of theory words are names for concepts and hence also for the structural divisions of reality to which our concepts correspond, and the meaning of a word is the concept (or thing or class of things) to which it refers. According to the second type of theory, words are tools which we use to exercise conceptual skills, and the meaning of a word is the conceptual skill exercised with that word. Corresponding to these theories of linguistic meaning, I distinguish between two types of theories of the meaning of life. According to the first type of theory, externalism, the meaning of life is determined by its relation ("reference") to a transcendent primary determinant of meaning; it is therefore independent of the "use" we make of it. According to the second type of theory, internalism, the meaning of life is determined by the use we make of it: life cannot acquire meaning without our giving meaning to it. Just as the theory which construes words as tools does not imply that we cannot use words to refer to extra-linguistic objects, internalism does not imply that reality does not provide objective grounds upon which to build our meaning. Subjective internalists argue that there is no such ground and that man has to create his own meaning ex nihilo, but objective internalists, most theists among them, argue that there are such grounds. Finally I employ the distinctions made above in a counter-argument against the anti-theistic arguments of two subjective internalists, Jaap van Heerden and Elmar D. Klemke. I show that they mistakenly suppose that the theistic alternative has to be construed along externalist lines, whereas theists themselves construe their theory of meaning along objective internalist lines, which renders it much more plausible.
