Članak pokušava detektirati inicijalno pojavljivanje termina »biopolitika«. Termin, danas najčešće vezan uz filozofsku poziciju Giorgia Agambena , svoj prvi iskaz dobiva kod Michela Foucaulta. Njegova dijagnoza u sedamdesetim godina prošlog stoljeća bila je da je moć znanstveno-tehnologijske proizvodnje života stvarila razdoblje biopolitike. Biopolitika je za Foucaulta ulazak života i njegovih mehanizama u područje svjesnog računanja i reguliranja moći, odnosno znanja svih agenata promjene ljudskog života. Stanovništvo postaje predmetom političkih intervencija već od kraja 18. i početka 19. stoljeća. U savezu sa (...) standardnim institucijama disciplinarnog poretka – ekonomija, politika, vojska – konstantni je sklop biopolitike stanovništvo. S obzirom na kategoriju života kao matricu društvenosti, ovdje se utemeljuje ono što će kasnije formirati »biopolitička teorija«.The article tries to detect the initial appearance of the concept of “biopolitics”. This concept, nowadays usually linked with philosophical position of Giorgio Agamben , first came to an attention by Michel Foucault. His diagnosis in the seventies of the past century was that the power of the scientific-technological production of life created a period of biopolitics. For Foucault, biopolitics is the entrance of life and its mechanisms into the area of conscious calculation and regulation of power that is the knowledge of all the agents of change in a person’s life. The population becomes the subject of political interventions already by the end of the 18th and beginning of the 19th century. In alliance with the standard institutions of the disciplinary order – economics, politics, and the military – the constant framework of biopolitics is the population. With regards to the category of life as the matrix of sociability, here we have the foundation of what is later to be formed into "biopolitical theory". (shrink)

Esse artigo examina a crítica de Hans Jonas à utopia marxista, questionando os limites ecológicos existentes para se atingir o ideal de uma sociedade de abundância e afirma que sua concepção de uma vida módica e respeitadora daqueles limites coincide com as tendências e propostas mais avançadas que surgiram nos últimos tempos como alternativas ao crescimento e ao desenvolvimento.

Law is a system of legal rules and legal principles. The distinction between them is a relative one. Always such definite major and minor premises are to be formed that the case can be subsumed under the rule and a conclusion, which includes the decision, can be drawn. This applies to legal principles that are operationalised by legal rules as well as to statutory forms of legal rules, which are often open as to their meaning and/or contain definitions that comprise (...) elements of principles. The basic characteristic of legal principles is that they are value measures directing the definition of legal rules as to their contents, the understanding of the rules, and the manner of their application. Legal principles aim at a goal, have weight, and define the scope of the meaning within which the legal rules move. The operationalisation of legal principles is the _ratio decidendi_ that the court has to achieve in order to be able to decide in a concrete case. Legal principles live through the rules that are the reasons for the decision in a concrete case. New cases can be solved by a new operationalisation of legal principles or by analogous application of precedents if the new cases, in their essential elements, correspond to cases that have already been decided. Leonid Pitamic was convinced that law could not be understood and explored by a single method aiming at a pure object of enquiry. He argued that it was necessary to employ other methods besides the normative one (especially the sociological and axiological methods), which, however, should not be confounded. Methodological syncretism can be avoided by clearly distinguishing between different aspects of law and by allowing the methods to support each other. By following this guideline, and by arguing according to a (...) clear method, we can also open up a space for dialogue and for the juxtaposition of contrasting points of view. (shrink)

In diesem aufsatz erortert der verfasser die grundlegenden heideggerschen begriffe der "befindlichkeit" und des "verstehens," und auf diese weise bestimmt er sein eigenes verhaltnis zu heidegger. ausgehend von der heideggerschen these uber die destruktion der metaphysik stellt er in diesem zusammenhang die frage nach der destruktion dieser destruktion, namlich der destruktion der vernunft-losigkeit der moderne, um dadurch eine neue stellung zur philosophie und ihrer tradition zu gewinnen.

Ovaj članak propituje socijalno-političke posljedice nasljeđa jednog povijesnog totalitarističkog koncepta. Radi se o fenomenu »fašizma«. Ima li fašizam neku teorijsku, ali i praktičku aktualnost u suvremenom »novom svjetskom poretku«? S unaprijed pretpostavljenim odgovorom da je tomu doista tako, nameću se argumentacijske strategije objašnjenja same pojave fašizma u suvremenosti. Pitanje u naslovu parafrazira naslove dviju važnih knjiga. Radi se o knjizi Giorgia Agambena Ono što ostaje od Auschwitza, te o zbirci tekstova Rastka Močnika, skupljenih pod naslovom Koliko fašizma? Članak pokušava elaborirati (...) samozadanu tematiku preko problematike »biopolitike«. U tu je svrhu kao inspirativan model poslužila teorija imunizacije/imunitarnosti talijanskog filozofa Roberta Esposita. Kroz nju se pokazuje strukturna neizbježnost fašizma u okviru neo-liberalizma u njegovoj imunitarnoj paradigmi. Njegovo »količinsko« smanjenje vezano je uz politiku solidarnosti i javnog prostora .This article examines socio-political consequences of the heritage of one of the historical totalitarian concepts. It is a phenomenon of “fascism”. Does fascism have any theoretical, but also practical actuality in the contemporary “new world order”? With the pre-assumption that it is the matter of fact, certain argumentation strategies of explanation of the appearance of fascism in present days are imposed. Question in the title paraphrases titles of two important books. It is a book by Giorgio Agamben, Remnants of Auschwitz, and a collection of essays by Rastko Močnik, collected under the title How Much Fascism? This article tries to elaborate this selfimposed subject through the issue of “biopolitics”. For this purpose, as an inspiring model, the theory of immunization/immunitarity presented by the Italian philosopher Roberto Esposito is used. Through that theory a structural inevitability of fascism in the framework of neo-liberalism shows itself in the immunitarian paradigm. The “quantitative” reduction of fascism is related to the policy of solidarity and public sphere. (shrink)

English summary: The degree of law will determine how goods are distributed and balanced in legal relationships. The selected essays take up the question of how to understand law, and especially how to behave within the extent of the law. The lawyer is always confronted with the righteousness within and of the law. Justice within the law is not his work. If the lawyer is not satisfied with this kind of justice, he can respond as a moral personality. Justice before (...) the law offers some leeway in which one can make decisions. Therein lies the appeal of the work of the lawyer, and also his considerable responsibility. The legal decision is closely related to legal ethics. This builds on solid traditional values, which must necessarily expand in terms of affairs of time and space, as well as towards the responsibility of future generations. The German and English writings reprinted here are divided into six groups: (I) The equitable allocation as the core of law, (II) probation of law and rule of law, (III) responsible legal decisionmaking, (IV) the correlativity of justice, (V) dialogical nature of jurisprudence, and (VI) from the Slovenian tradition of thought. Recently there has been a rise in the application of concepts and methods from biological evolutionary theory to human cultures and societies where the aim is to explain these by describing them as population-level phenomena reducible to individual-level processes. I argue against this type of view by using Mesoudi's Cultural Evolution as a case study. I claim that Mesoudi’s ontological assumptions about cultures and societies are dubious and his methodological assumptions inadequate when it comes to addressing cultural and social phenomena. (...) The basic question is whether and in what sense it is possible to speak about gaps in the law. If we disagree with Kelsen's thesis that the nature of gaps in the law is that of an ideological formula, then we have to define them legally and to find the criteria regarding how they can be filled. It is also important that incompletenesses as regards contents - Hart treats them as "open texture" - are organic parts of laws. The Slovene (...) Courts Act is in accord with this thesis and for that very reason provides - the provision was written by the author of this paper - that "the judge has to decide in such a way as if he had in front of him an indefinite number of equal cases". In this article, classic game theory and evolutionary game theory are used to explain how social norms might come into existence. The norm of distributive fairness is taken as a case in point, and illustrated by a simple example of dividing a cake.

In a recent article, Kyle Stanford gives an account of what he terms “externalisation”, understood as our tendency to objectify or externalise moral demands and obligations. According to Stanford, externalisation is a distinctive feature of our moral psychology which is adaptive since it enables and preserves cooperation. I claim that the main issue with this account is that it assumes an overly psychological and individualist, inward-to-outward looking perspective. I advocate taking an alternative perspective that turns the spotlight to social practices (...) and the social reality they create. I show how, seen in this light, norm externalisation becomes a side-effect instead of an adaptation deserving of a special explanation. (shrink)

This volume aims to clarify the epistemic potential of applying evolutionary thinking outside biology, and provides a survey of the current state of the art in research on relevant topics in the life sciences, the philosophy of science, and the various areas of evolutionary research outside the life sciences. By bringing together chapters by evolutionary biologists, systematic biologists, philosophers of biology, philosophers of social science, complex systems modelers, psychologists, anthropologists, economists, linguists, historians, and educators, the volume examines evolutionary thinking within (...) and outside the life sciences from a multidisciplinary perspective. While the chapters written by biologists and philosophers of science address theoretical aspects of the guiding questions and aims of the volume, the chapters written by researchers from the other areas approach them from the perspective of applying evolutionary thinking to non-biological phenomena. Taken together, the chapters in this volume do not only show how evolutionary thinking can be fruitfully applied in various areas of investigation, but also highlight numerous open problems, unanswered questions, and issues on which more clarity is needed. As such, the volume can serve as a starting point for future research on the application of evolutionary thinking across disciplines. (shrink)

Low levels of media literacy in Bulgaria have provided fertile soil for anti-vaxxers and spawned disinformation campaigns as a major means of influencing the public opinion. Bulgaria has gained a reputation as the poorest and most corrupt country in the European Union (EU) and the fastest-shrinking nation in the world. The COVID-19 pandemic exacerbated some of the well-known, long-standing problems in the healthcare system in Bulgaria – rising morbidity, an insufficient number of hospital beds, a low rate of COVID-19 vaccination, (...) and, above all, a high mortality rate. Transitionaljustice mechanisms and the International Criminal Tribunal for the FormerYugoslavia (ICTY) have had only a limited success in overcoming ethnic divisionsin Bosnia-Herzegovina. Rather than elaborating upon the role of local politicalelites in perpetuating ethnic divisions, we examine ordinary peoples’ popularperceptions of war and its aftermath. In our view, the idea that elites havecomplete control over the broader narratives about the past is misplaced. Weargue that transitional justice and peace mechanisms supported by externalactors are always interpreted on the ground in context-specific (...) ways, creatingdifferent citizens’ experiences, “memories” of the war, and their respectivehopes and disappointments in regards to the relationship between peace andjustice in Bosnia. We suggest that analyses of the post-conflict developments inBosnia-Herzegovina must take into account what gives the narratives ofexclusion their power, and what are the objective political, social andeconomic constraints that continue to provide a fertile ground for theirwidespread support. The ideas Darwin published in On the Origin of Species and The Descent of Man in the nineteenth century continue to have a major impact on our current understanding of the world in which we live and the place that humans occupy in it. Darwin’s theories constitute the core of the contemporary life sciences, and elicit enduring fascination as a potentially unifying basis for various branches of biology and the biomedical sciences. They can be used to understand the biological ground (...) of human cognition, common behavioral patterns and disorders, and psychopathology more generally in psychology, psychiatry, and neuroscience. Perhaps the best known expression of this fact is Dobzhansky’s famous dictum that “nothing in biology makes sense except in the light of evolution” (Dobzhansky T. Am Zool 4:443–452, 1964: 449; Am Biol Teach 35:125–129, 1973: 125), and given that all human behavior supervenes on some biological basis, evolutionary thinking has a vast scope even just in this regard. Study in the period of coronavirus disease 2019 lockdown and the effect of different exercise training programs on the quality of life dimension are limited. This randomized control study as a part of which the impact of an 8-week neuromuscular training program on the 90 healthy young individuals’ QoL after COVID-19 lockdown was assessed using a short form of the WHOQOL-BREF questionnaire comprising of four domains. The intervention group took part in a neuromuscular training program consisting of dynamic neuromuscular stabilization (...) and whole-body vibration training. In contrast, the control group did not participate in any programmed physical activity. From pre- to post-intervention test, the NT group significantly and substantially improved [mean change ] all the QoL domains, physical for 12.78 scores, psychological for 13.12 scores, social relationships for 20.57 scores, and environmental for 24.40 scores. These results suggest that the NT program could enhance QoL in young and healthy participants following COVID-19 lockdown. (shrink)

Resumo: Conhecer os deveres que temos em relação às gerações futuras é cada vez mais urgente, diante da degradação individual, social e ambiental que a humanidade enfrenta. O presente artigo pretende mostrar, de início, a complexidade filosófica dessa questão, indicando que, nos enunciados sobre o assunto, há três pressuposições filosoficamente problemáticas: 1) haverá gerações futuras; 2) nossas ações são contingentes; e 3) somos responsáveis por nossos impactos sobre as próximas gerações. Discutimos essas suposições, por meio das questões sobre a eternidade (...) do mundo, a existência da liberdade e o significado de dever, e abordamos, em seguida, as ideias convergentes de Hans Jonas e Ulrich Beck, as quais apontam que a singularidade do poder que a tecnologia conferiu ao ser humano requer agora um novo pensamento ético. Na conclusão, argumentamos que é preciso definir deveres em relação às gerações futuras e elencamos quais seriam, a nosso ver, os principais deles, levando em conta a ideia de incerteza, alcançada tanto por meio das discussões filosóficas apresentadas quanto a partir da nova conjuntura tecnocientífica de nosso tempo.: Debates on our duties to future generations are increasingly urgent if we consider the individual, social, and human degradation of the present day. This article points out the philosophical complexity that underlies these debates, first indicating that the following assumptions are present in every statement concerning our duties to future generations: 1) there will be future generations; 2) our actions are contingent; 3) we are responsible for the way our actions impact future generations. The first three sections discuss each of these assumptions by presenting the debates over the eternity of the world, the existence of freedom, and the idea of duty. In the following sections we present the convergent ideas of Hans Jonas and Ulrich Beck, so as to argue that as technology has given humankind an unprecedented power over the world, a new kind of ethical thought is required. Finally, taking into account the idea of incertitude that arises both from the philosophical issues discussed and from our current techno-scientific context, we conclude by arguing that we should formulate our duties regarding future generations and specify those that are our main obligations. Obituary for Marijan Cipra, a most prominent Croatian philosopher. In his essential book "Metamorfoze metafizike" ("Metamorphoses of Metaphysics", 1978), he proposed a metaphysical foundations of the historical development of philosophy, based particularly on his in-depth study of Greek philosophy.
