Proceedings from the ninth International Conference on Artificial Life; papers by scientists of many disciplines focusing on the principles of organization and applications of complex, life-like systems. Artificial Life is an interdisciplinary effort to investigate the fundamental properties of living systems through the simulation and synthesis of life-like processes. The young field brings a powerful set of tools to the study of how high-level behavior can arise in systems governed by simple rules of interaction. Some of the fundamental questions include: (...) What are the principles of evolution, learning, and growth that can be understood well enough to simulate as an information process? Can robots be built faster and more cheaply by mimicking biology than by the product design process used for automobiles and airplanes? How can we unify theories from dynamical systems, game theory, evolution, computing, geophysics, and cognition? The field has contributed fundamentally to our understanding of life itself through computer models, and has led to novel solutions to complex real-world problems across high technology and human society. This elite biennial meeting has grown from a small workshop in Santa Fe to a major international conference. This study explores the reflective processes of Scottish artist, Norman Gilbert, as he created twenty-five drawings depicting his wife, Pat Gilbert, as she lay dying following an Alzheimer’s-related stroke. Norman, ninety-one, had drawn Pat regularly over their sixty-five-year marriage. One week after Pat died, Norman was interviewed by a family friend to chronicle his reflections on the drawings. The drawings along with the interview transcript are analyzed qualitatively as a case study. Norman’s Hospital Drawings of Pat transform what was initially (...) a private experience into a shared comprehension of end of life and bereavement. (shrink)

Questions of how we claim to know the things that we know and whose claims to knowledge are treated as authoritative are inescapable in reaching legal judgments. I want to illustrate this generalization by referring to a pair of hypothetical self-defense cases that, I argue, require fact finders to judge both how “accurately” each defendant understood the situation in which he found himself and how accurately policymakers can assess the consequences of alternative legal rules.The first case I will deal with (...) is one in which the defendant shoots and kills her sleeping husband. The husband had physically abused her over a long period. While the defendant will of course acknowledge that she was in no immediate danger at the moment she killed the man, her preliminary claim is that she needed to act self-defensively at that moment for fear that she subsequently would be incapable of defending herself against life-threatening attacks that she was convinced would inevitably be made.The second case is one in which a white defendant shoots and kills a black teenager who has confronted him on the subway, in a situation in which the teenager’s “threats” were ambiguous. The shooting victim had brandished no weapon and made no physical contact with the defendant, but he had “asked” the defendant for money and, in the defendant’s mind, displayed a generally threatening demeanor. I will presuppose that this defendant—unlike Bernhard Goetz, the defendant in the notorious New York subway vigilante case on which I partly base this hypothetical model—overtly acknowledges that the race of the victim played a substantial role in his assessment of the danger of the situation. My purpose in this paper is to reassert the traditional view that Athenian women of the classical period regularly had an association with phratries. As part of my argument I adduce an overlooked piece of evidence, a much discussed passage from the Donatus commentary on Terence; for this I provide a new interpretation.There is some evidence that Athenian women were introduced to their fathersphrateresat birth, or to their husbands'phrateresat marriage, or both. The speaker of Isaeus 3 repeatedly asserts that (...) a certain Pyrrhus would have presented his daughter to hisphrateresif she had been legitimate. A scholium on Aristophanes,Acharnians146 may refer to such a practice. Euxitheus calls as witnesses of his mother's citizenshipphrateresfor whom his father celebrated the wedding feast, thegamelia, on her behalf ; celebration of thegameliais regarded as proof of the legitimacy of the speaker's mother at Isaeus 8.19. Neither Demosthenes nor Isaeus says that women were formally registered among thephrateresor even present at the feast; but notices in the lexicographers do connect thegameliawith registration among or introduction to thephrateres. Non-human animals (henceforth, “animals”) are typically regarded as moral patients rather than moral agents. Let us define these terms as follows: 1) X is a moral patient if and only if X is a legitimate object of moral concern: that is, roughly, X is something whose interests should be taken into account when decisions are made concerning it or which otherwise impact on it. 2) X is a moral agent if and only if X can be morally evaluated–praised or blamed (...) (broadly understood)–for its motives and actions. Nothing in (1) and (2), of course, rules out one and the same individual being both a moral agent and a patient. Most humans are both. The notion of a moral agent is typically run together with that of a moral subject: 3) X is a moral subject if and only if X is, at least sometimes, motivated to act by moral considerations. However, (2) and (3) are not equivalent: the motivation for an action is one thing, the evaluation of the action quite another; indeed evaluation is often of motivation. As a matter of practice these are, for obvious reasons, run together. But motivation and evaluation are conceptually distinct. This is a claim that many will regard with surprise. In effect, the bulk of this paper can be regarded as an attempt to defend this claim as it applies to the case of animals. In this section, I merely offer some preliminary remarks in its defense. Suppose that my wife, worn down by the domestic squalor that goes with two young boys, a very large dog, and a slovenly husband, has me (unknowingly) hypnotized. Now, whenever she utters the word ‘Rosebud’, I experience an uncontrollable desire to mop the floor. This desire is, it seems, a motivational state, one that when combined with relevant cognitive states (the belief that this is a mop, the belief that this is a floor, and so on) will, ceteris paribus, result in a certain sort of behavior on my part. If we take audax as an epithet expressing a permanent quality of the hero, then timidus unduly limits the range of that quality embodied in audax, a quality that allowed Ulysses to best foes, the Cyclops, for example, who certainly cannot be called timidus. If, on the other hand, we are to interpret the combination of timidus and audax as the speaker's jibe at Ulysses' pretensions to heroic valor,5 it must be pointed out that such a jibe, while appropriate in the mouth of an Ajax, is completely out of place here where suitors, courtship, and sex are uppermost in the speaker's mind, not the ranking of Achaean warriors.6 Moreover, the [End Page 90] epithet phrase timidis audacis, by virtue of its riddling quality (are we to think of the encounter with Dolon? the slaughter of the suitors?) distracts attention from Penelope herself, who is, after all, the exemplum. In short, the addition of timidus either disparages the heroic stature of Ulysses in a context where such disparagement is clearly out of place or undercuts the force of the Penelope exemplum by giving prominence to the husband, when in fact it is Penelope who is the more important of the two.I want, therefore, to suggest that in its original form the line contained an epithet for Penelope, prudens, which can be taken as the equivalent of the Homeric epithet most often applied to Penelope, 7: line 671 would then read "proelia nec coniunx prudens audacis Vlixei." Margaret never ceases to hope that her husband will return. Whenever a stranger passes by her gate, she stops him and asks for news about Robert. Years go by, Robert does not return home, and Margaret pines gradually away. Each time the wandering Armytage comes back to her door, Margaret is more gaunt and distracted. She neglects her children: one goes off to a meager apprenticeship; the other, the younger boy, dies.Armytage is a stoical character, though not a frigid one. He has withdrawn his energies from the world of human things, and dispersed them throughout nature where they cannot, presumably, be betrayed. Nature will always regenerate itself; the world grows older, but returns each spring to its youth. We describe the psychology of moral imagination as composed of the four decision processes identified by Rest (1986), i.e., moral sensitivity, moral judgment, moral intention, and moral behavior. We examine each process in depth, distilling extant psychological research and indicating organizational implications. The conclusion offers suggestions for future research.The majority of men are subjective toward themselves and objective toward all others—terribly objective sometimes—but the real (...) task is in fact to be objective toward one’s self and subjective toward all others. Prompted by the development of the Theory of Challenge and Threat States in Athletes (Jones et al, 2009), recent years has witnessed a considerable increase in research examining challenge and threat in sport. This manuscript provides a critical review of the literature examining challenge and threat in sport, tracing its historical development and some of the current empirical ambiguities. In an attempt to reconcile some of these ambiguities, and utilising neurobiological evidence associated with approach- and avoidance-motivation (cf. Elliot & Covington, (...) 2001), this paper draws upon the Evaluative Space Model (ESM: Cacioppo et al., 1997) and considers the implications for understanding challenge and threat in sport. For example, rather than see challenge and threat as opposite ends of a single bipolar continuum, the ESM implies that individuals could be (1) challenged, (2) threatened, (3) challenged and threatened, or (4) neither challenged or threatened by a particular stimulus. From this perspective it could be argued that the appraisal of some sport situations as both challenging and threatening could be advantageous, whereas the current literature seems to imply that the appraisal of stress as a threat is maladaptive for performance. In drawing upon the ESM, we outline the Evaluative Space Approach to Challenge and Threat and provide several testable hypotheses for advancing understanding of challenge and threat (in sport). We also outline a number of cardiovascular and experiential measures that can be used to examine these hypotheses. In sum, this paper provides a significant theoretical, empirical and practical contribution to our understanding of challenge and threat (in sport). (shrink)

After the ghost (...) of Tlepolemus has exposed to his wife the actual circumstances of his death, the heroine devises a scheme for exacting vengeance on Thrasyllus, both for his cunning in killing her husband in the boar hunt and for his sexual ambitions toward her. The former is revealed in the similarities between Charite’s revenge scheme and Thrasyllus’ plot to bring about Tlepolemus’ death; the latter emerges from Charite’s clever exploitation of aspects of the wedding ritual in her revenge scheme. To be persuasive, the (fictional) marriage ritual, like the hunting scheme before it, requires role playing 3 and a reversal in gender roles such that [End Page 601] the heroine punishes her opponent most appropriately for his actions within the tale’s narrative. The importance of preserving trust in physicians and in medical institutions has received widespread attention in recent years. Primarily, this is due to the threats to trust posed by managed care, but there is a general and growing recognition that trust deserves more attention than it traditionally has received in all aspects of medical ethics, law, and public policy. Trust has both intrinsic and instrumental value. Trust is intrinsically important because it is a core characteristic that affects the emotional and (...) interpersonal aspects of the physician/patient relationship. As an instrumental value, trust is widely believed to be essential for effective therapeutic encounters. It has been hypothesized or shown to affect a host of important behaviors and attitudes relating to care, including seeking care, disclosing private information, complying with treatment, and being satisfied with care. Moreover, trust may be a mediator of measurable clinical outcomes and a key factor in the mind–body interactions that underlie placebo/nocebo effects and the effectiveness of alternative medicine. It is no surprise, then, that preserving, justifying, and enhancing trust is the fundamental goal of much of medical ethics, and is a prominent objective in healthcare law and public policy. Laws in the 20 jurisdictions studied for this project display many similar approaches to protecting privacy in biobank research. Although few have enacted biobank-specific legislation, many countries address biobanking within other laws. All provide for some oversight mechanisms for biobank research, even though the nature of that oversight varies between jurisdictions. Most have some sort of controlled access system in place for research with biobank specimens. While broad consent models facilitate biobanking, countries without national or federated biobanks have been slow (...) to adopt broad consent. International guidelines have facilitated sharing and generally take a proportional risk approach, but many countries have provisions guiding international sharing and a few even limit international sharing. Although privacy laws may not prohibit international collaborations, the multi-prong approach to privacy unique to each jurisdiction can complicate international sharing. These symposium issues can serve as a resource for explaining the sometimes intricate privacy laws in each studied jurisdiction, outlining the key issues with regards to privacy and biobanking, and serving to describe a framework for the process of harmonization of privacy laws. Pike This article seeks to define more precisely the nature of the individual transaction that occurs between reader and text and the potential for aesthetic reading in literature classrooms by relating knowledge of the way pupils engage in literary transactions to theoretical (...) perspectives that address the issue. The validity of Louise Rosenblatt's transactional theory of the literary work, expounded in Literature as Exploration and The Reader, The Text, The Poem, and its relevance for contemporary educators, particularly in the field of English education, has recently been reasserted by Jeanne Connell in her timely and cogent article in this journal. 1 The present article, however, seeks to refocus debate by problematizing and subsequently developing some aspects of key theories such as Rosenblatt's while examining the individual and social nature of reading in schools. Rosenblatt's view that aesthetic experiences can have both social origin and effect certainly deserves further theorizing if aesthetic experience in school communities and classrooms is to flourish.The influence of John Dewey's Art as Experience upon Rosenblatt is evident as this seminal text conceives of our primary task as the restoration of "continuity between the refined and intensified forms of experience that are works of art and everyday events." 2 Such continuity with experience is vital because, for Dewey, "experience is the fulfillment of an organism in its struggles and achievements in a world of things, it is art in germ." 3 Applying such a notion to education in schools, Rosenblatt saw the aim of literature lessons as the growth of experience rather than the acquisition of knowledge. Yet, despite such progress, in the United Kingdom, teachers of English are in the unenviable position of having to deliver an extensive body of knowledge prescribed by the National Curriculum and also to focus explicitly upon the features of certain types of text as they teach the National Literacy Strategy. 4 In Rosenblatt's work the emphasis on our experience of [End Page 61] literary works provides a much needed alternative to positions such as that adopted by New Criticism where "it is never what a poem says which matters, but what it is" because we acknowledge we can only ever gain access to what a poem says as "the sentence that seems to need no interpretation is already the product of one." 5 Clearly, understanding the reader's transaction with texts is where we must begin if we wish to foster aesthetic reading in our classrooms.Transactional theory also appears to be closely related to Martin Heidegger's thought in Being and Time where Dasein (givenness, existence, being) is seen as a distinctive characteristic of the human being as our consciousness projects things of the world and is also subjected to the things of the world which belong to us, in some sense, only as long as our consciousness is projecting them. 6 The validity of Dewey's view, where experience is not separated from art, can be seen when we acknowledge that we can "never adopt an attitude of detached contemplation, looking down on the world as if from a mountain top" for we are "inevitably merged with the very object of our consciousness." 7Such a view reflects Hans-Georg Gadamer's position in Truth and Method in which Heidegger's explanation of situation is applied to literary theory because, for Gadamer, the literary work cannot appear as a packaged and completed artefact in which meaning is neatly wrapped because it is influenced by a particular reader's actions at a particular moment. 8 Rosenblatt's realistic conception that "each reading involves a particular person at a particular time and place" is developed in this article as it seems that, even now, many reader response critics and curriculum designers "write as though people read literature in a vacuum or in a generalized kind of academic setting" which often does not apply... This experiment examined the effects of three elements comprising Jones' (1991) moral intensity construct, (social consensus, personal proximity, and magnitude of consequences) in a cross-cultural comparison of ethical decision making within a human resource management (HRM) context. Results indicated social consensus had the most potent effect on judgments of moral concern and judgments of immorality. An analysis of American, Eastern European, and Indonesian responses also indicted socio-cultural differences were moderated by the type of HRM ethical issue. Goldberg asserts that public health should include all of the root causes of ill health in populations. Such a definition, however, would include within public health war, famine, crime, illiteracy and numerous other conditions on which public health professionals and agencies lack the resources, expertise and public support to act. The appropriate definition explicitly recognizes that public health is a legal term of art referring to specifically authorized activities by public officials to protect, promote and improve population health. In the post-genome world of biomedical research, an increasingly common research strategy is to focus on large repositories of biological specimens. There are now several well-known efforts to compile vast collections of biological materials, reanalyze extant samples, collect new ones, and link the samples to medical records. The significant issues of law, ethics, and policy raised by these research activities usually are heightened when commercial enterprises play a leading role in accumulating and distributing the samples. Emerging companies are not only (...) compiling repositories for their own use, but some companies are positioning themselves to act as intermediaries, developing vast biobanks for sale to a wide range of other researchers. “Unconscionable.” “Outrageous.” “Indefensible.” These are just some of the tamer descriptions for the billing practices of most hospitals, and also many physicians, that have recently come to the public's attention. Earlier this year, Time magazine published an extraordinary 24,000‐word exposé—the longest article it has ever published—detailing how even charitable hospitals routinely price‐gouge their patients.1 With characteristic flare for telling details, journalist Steven Brill documented ten‐fold markups of charges over costs at some prominent hospitals for common services like X rays and (...) lab tests, and one‐hundred‐fold mark‐ups on mundane supplies such as gauze pads and generic aspirin. Just as the buzz from Brill's article was abating, the Centers for Medicare & Medicaid Services released a comprehensive data set in May that galvanized local and national media across the country. This news tsunami caught hospital managers flat‐footed and tongue‐tied. Typical responses conceded that hospitals’ pricing practices are based neither on actual cost structures nor rational marketplace dynamics. Instead, hospitals attempted to deflect blame by noting that hardly anyone actually pays list prices, and they characterized their indefensible pricing as a symptom of a broken system that is beyond them to fix. It was a happy surprise when, overcoming partisan divisions and interest‐group lobbying, Congress enacted the No Surprises Act, which bans unfair out‐of‐network “balance billing.” Although this is only a modest legislative victory, key efforts by the health policy community made a real difference in a time of legislative gridlock.

It has been pending in Congress for twelve years, despite the support of the last two presidential Administrations and the National Institutes of Health. It has been the subject of extensive affirmative lobbying by academic medical centers, pharmaceutical and biotech companies, genetic disease advocacy groups, and civil rights organizations. It has overcome vehement objections by employers and insurers. Its final passage, however, has been thwarted by a few Congressional leaders, who have prevented enactment despite overwhelming bipartisan support in both houses (...) of Congress.Based on this legislative history, one could not help but assume that the Genetic Information Nondiscrimination Act is a revolutionary piece of legislation that, if finally enacted, would provide extensive, effective, and comprehensive protection against genetic discrimination in health insurance and employment Unfortunately, such an assessment would be incorrect. Conventional wisdom and many published histories of “Green Chemistry” describe its start as being a result of governmental and/or regulatory actions at the US Environmental Protection Agency during the early 1990’s. But there were many Real World industrial examples of environmentally friendly commercial processes in the oil and commodity chemicals industries for decades prior to the 1990s. Some early examples of commercial “Green Chemistry” are briefly described in this article. The Boots/Hoechst Celanese Ibuprofen process was one of the earliest multiple-award-winning (...) examples of industrial “Green Chemistry” in the fine chemical/pharmaceutical industry. The author, who conceived the BHC Ibuprofen synthetic strategy in 1984, reveals and documents that the BHC Ibuprofen process was not primarily a result of governmental or regulatory mandates, or environmentalist or political motivations. The BHC ibuprofen process, and probably many other early industrial “green” inventions, evolved from, and their development and commercialization motivated and guided by, a long prior industrial culture of both scientific and technical evolution. The invention and commercialization of these early industrial commercialized processes, and the BHC Ibuprofen process were also guided by both competitive and economic market needs, personal human motivations, and a low waste culture of “Quality” and “Continuous Improvement” that the commodity chemical industry internally promoted in the 1980’s. The author comments on some perceptions of the status of Green Chemistry now, and directions it should consider going in the future. The author recommends that young Green Chemists and/or Green Engineers reconsider “Quality” approaches in order to genuinely lead Society toward a Greener future. (shrink)

This article discusses N. K. Jemisin's Afrofuturist utopian short story entitled “The Ones Who Stay and Fight,” the opening story of her 2018 collection, How Long 'Til Black Future Month? As is suggested by its title, Jemisin's story is a direct reply to Ursula K. Le Guin's “The Ones Who Walk Away from Omelas,” and this article discusses the ways in which Jemisin, one of the most prominent members of a new generation of SF/Fantasy writers, pays homage to, replies to, (...) and reimagines Le Guin's 1973 story in the twenty-first century. In particular, drawing on utopian scholarship, scholars of Afrofuturism, and the work of African American studies scholar-activists, it argues that Jemisin's utopia builds a world that embodies the “revolution of value” as well as the intersectional Black feminist praxis at the foundation of contemporary activist groups such as Black Lives Matter. It also argues for the ways in which Jemisin's text confronts common criticisms of utopia as well as the limits of the utopian imagination. (shrink)
