Autonomous artificial intelligence (AI) systems can lead to unpredictable behavior causing loss or damage to individuals. Intricate questions must be resolved to establish how courts determine liability. Until recently, understanding the inner workings of “black boxes” has been exceedingly difficult; however, the use of Explainable Artificial Intelligence (XAI) would help simplify the complex problems that can occur with autonomous AI systems. In this context, this article seeks to provide technical explanations that can be given by XAI, and to show how (...) suitable explanations for liability can be reached in court. It provides an analysis of whether existing liability frameworks, in both civil and common law tort systems, with the support of XAI, can address legal concerns related to AI. Lastly, it claims their further development and adoption should allow AI liability cases to be decided under current legal and regulatory rules until new liability regimes for AI are enacted. A penetrating and freewheeling evaluation of Kant’s magnum opus. A best seller in Italy, Maurizio Ferraris’s Goodbye, Kant! delivers a nontechnical, entertaining, and occasionally irreverent overview of Immanuel Kant’s Critique of Pure Reason. He borrows his title from Wolfgang Becker’s Goodbye Lenin!, the 2003 film about East Germany after the fall of the Berlin Wall, which depicts both relief at the passing of the Soviet era and affection for the ideals it embodied. Ferraris approaches Kant in similar spirits, demonstrating (...) how the structure that Kant elaborates for the understanding of human knowledge can generate nostalgia for lost aspirations, while still leaving room for constructive criticism. Isolating key themes and concerns in the work, Ferraris evaluates Kant’s claims relative to what science and philosophy have come to regard as the conditions for knowledge and experience in the intervening two centuries. He remains attentive to the historical context and ideals from which Kant’s Critique emerged but also resolute in identifying what he sees as the limits and blind spots in the work. The result is an accessible account of a notoriously difficult book that will both provoke experts and introduce students to the work and to these important philosophical debates about the relations of experience to science. This book studies a central but hitherto neglected aspect of Rousseau's political thought: the concept of social order and its implications for the ideal society which he envisages. The antithesis between order and disorder is a fundamental theme in Rousseau's work, and the author takes it as the basis for this study. In contrast with a widely held interpretation of Rousseau's philosophy, Professor Viroli argues that natural and political order are by no means the same for Rousseau. He explores the (...) differences and interrelations between the different types of order which Rousseau describes, and shows how the philosopher constructed his final doctrine of the just society, which can be based only on every citizen's voluntary and knowing acceptance of the social contract and on the promotion of virtue above ambition. The author also shows the extent of Rousseau's debt to the republican tradition, and above all to Machiavelli, and revises the image of Rousseau as a disciple of the natural-law school. (shrink)

According to the interpretation of Hegel, Egyptian religious buildings, and among them especially the temples, represent the beginning of the history of architecture, and so the beginning of the entire history of art.The Egyptian religious architecture has a symbolic character, because its configuration tries to represent the spiritual content without being fully adequate to it. So the Egyptian temple alludes to the divine through its entire structure, but does not have a proper internal space, dedicated to the worship of the (...) image of God.On this point, contemporary Egyptology corrected Hegel’s view, because broadly speaking the Egyptian temple had an interior where the image of the deity was safeguarded. However, Hegel’s thesis paradoxically remains suitable for a particular case of the Egyptian experience that he could not know at that time: in the monotheistic religion of Amarna, the temple of the sun-god Aton has no images and does not have a center, because the Divine is present everywhere, like the sunlight that illuminates equally all over the temple. The doctrines on the goodness or evilness of human nature maintained in ancient China respectively by Mencius and Xunzi has been interpreted mosttly as a contradition within the Confucian school. In this article it is argued that they represent two distinct , yet possible and congruous, modes of interpreting and re-elaboarting Confucius teachings, two opposing yet largerly complementary currents which have developed within the Confucian school.

Mirko Garasic (2021) argued that space travel and, by extension, the colonization of other planets could morally justify using technologies and interventions capable of profoundly modifying the characteristics of astronauts and future Martian generations. According to Garasic, however, the fact that space interventions such as human (bio)enhancement or reproductive technologies such as artificial wombs may be morally justified does not mean that they are morally acceptable technologies to be used on Earth as well. Garasic’s thesis is that we should resist (...) the temptation to establish or reinforce a continuity between the ethical standards that apply to space travel and those that apply on Earth because what applies in space (or on other planets) does not necessarily apply to our planet. Garasic argues that in space, genetic enhancement interventions are morally acceptable, as they are essential for survival. On Earth, however, we can survive even without any form of (bio)enhancement. In a previous article (2022), we presented several arguments against Garasic’s thesis regarding the exceptional morality of what is morally acceptable in space. In this article, we examine and reply to Garasic (2022), showing that he fails to defend his thesis from the objections we previously advanced. Garasic’s mistakes are: (1) assuming nature (and consequently what is “natural”) as a normative point of reference which allows establishing what is moral and what is not moral; (2) defending the choices concerning reproduction as an insufficiently demanding and therefore unsatisfactory moral principle (according to Garasic we should not bring into the world people who can have a quality of life or a condition of well-being superior to mere survival); and finally (3) of not explaining clearly what it means to defend a principle of moral exceptionalism for space travel (Garasic does not explain whether this position applies to any behavior, for which what on Earth is a virtue, in space is a vice or is not a general principle, but he makes this case only for enhancement and reproductive technologies). Through our analysis, we not only refute Garasic’s position but also show that any attempt to address space travel issues as “special” moral issues faces several difficulties and, ultimately, is doomed to failure. Chapter 1st of the book. This chapter explores the fundamental ambiguity of the concept of plasticity – between openness and determination, change and stabilization of forms. This pluralism of meanings is used to unpack different instantiations of corporeal plasticity across various epochs, starting from ancient and early modern medicine, particularly humouralism. A genealogical approach displaces the notion that plasticity is a unitary phenomenon, coming in the abstract, and illuminates the unequal distribution of different forms of plasticities across social, gender, and (...) ethnic groups. Taking a longer view of the plastic body as a ubiquitous belief in traditions predating and coexisting with modern medicine will help contextualize the seeming radicalism of today’s turn to permeability and the exceptionalism of Western findings. By highlighting the complex biopolitical usages of plasticity in the past, the chapter warns against simplistic appropriations of the term in contemporary body/world configurations driven by findings in neuroscience, epigenetics and microbiomics. As space travel and intentions to colonise other planets are becoming the norm in public debate and scholarship, we must also confront the technical and survival challenges that emerge from these hostile environments. This paper aims to evaluate the various arguments proposed to meet the challenges of human space travel and extraterrestrial planetary colonisation. In particular, two primary solutions have been present in the literature as the most straightforward solutions to the rigours of extraterrestrial survival and flourishing: (1) geoengineering, where (...) the environment is modified to become hospitable to its inhabitants, and (2) human (bio)enhancement where the genetic heritage of humans is modified to make them more resilient to the difficulties they may encounter as well as to permit them to thrive in non-terrestrial environments. Both positions have strong arguments supporting them but also severe philosophical and practical drawbacks when exposed to different circumstances. This paper aims to show that a principled stance where one position is accepted wholesale necessarily comes at the opportunity cost of the other where the other might be better suited, practically and morally. This paper concludes that case-by-case evaluations of the solutions to space travel and extraterrestrial colonisation are necessary to ensure moral congruency and the survival and flourishing of astronauts now and into the future. A history of colonization inflicts psychological, physical, and structural disadvantages that endure across generations. For an increasing number of Indigenous Australians, environmental epigenetics offers an important explanatory framework that links the social past with the biological present, providing a culturally relevant way of understanding the various intergenerational effects of historical trauma. In this paper, we critically examine the strategic uptake of environmental epigenetics by Indigenous researchers and policy advocates. We focus on the relationship between epigenetic processes and Indigenous views of (...) Country and health—views that locate health not in individual bodies but within relational contexts of Indigenous ontologies that embody interconnected environments of kin/animals/matter/bodies across time and space. This drawing together of Indigenous experience and epigenetic knowledge has strengthened calls for action including state-supported calls for financial reparations. We examine the consequences of this reimagining of disease responsibility in the context of “strategic biological essentialism,” a distinct form of biopolitics that, in this case, incorporates environmental determinism. We conclude that the shaping of the right to protection from biosocial injury is potentially empowering but also has the capacity to conceal forms of governance through claimants’ identification as “damaged,” thus furthering State justification of biopolitical intervention in Indigenous lives. He shows how this work relates to earlier Romantic tradition and sets it within the wider context of the history and philosophy of the life sciences.

The rise of molecular epigenetics over the last few years promises to bring the discourse about the sociality and susceptibility to environmental influences of the brain to an entirely new level. Epigenetics deals with molecular mechanisms such as gene expression, which may embed in the organism “memories” of social experiences and environmental exposures. These changes in gene expression may be transmitted across generations without changes in the DNA sequence. Epigenetics is the most advanced example of the new postgenomic and context-dependent (...) view of the gene that is making its way into contemporary biology. In my article I will use the current emergence of epigenetics and its link with neuroscience research as an example of the new, and in a way unprecedented sociality of contemporary biology. After a review of the most important developments of epigenetic research, and some of its links with neuroscience, in the second part I reflect on the novel challenges that epigenetics presents for the social sciences for a re-conceptualization of the link between the biological and the social in a postgenomic age. Although epigenetics remains a contested, hyped, and often uncritical terrain, I claim that especially when conceptualized in broader non-genecentric frameworks,. (shrink)

Tomorrow’s politics will be a politics of multiplicity. Contemporary Marxism, in its political and trade-unionist manifestations, appears as a major obstacle, given its inability to escape from totalising categories and to reflect upon the political need for innovation . Maurizio Lazzarato attempts to show that this double inability originates in an ontological view of relations, present in Marx himself, a view which needs to be reconsidered in light of the philosophy of multiplicity developed during the same period. William James’ (...) pragmatism, for instance, allows us to understand how deeply Marx’s ontology of relation is indebted to the idealist philosophy of the 19th century, thus revealing the ontological limits of Marxist politics. What did Thomas Jefferson look like? How did he carry himself? Such questions, reasonable to ask as we look back on a person who lived in an era before photography, are the starting point for this boldly original new work. Maurizio Valsania considers all aspects of Jefferson’s complex conception of "the body," from eighteenth-century clothing and fashion to manners, adornment, posture, gesture, and visual and material culture. Drawing also from the fields of medical science, psychology, and cultural anthropology, the (...) author conjures a vivid and detailed re-creation of the third president as a living, breathing--and pondering--human being. Having situated Jefferson in his own body, Valsania looks at the embodied Jefferson in the world of his fellow humans. Any one of the other people in Jefferson’s society--whether that other person was male or female, free or enslaved, African American or Native American--was a critical counterexample for the eighteenth-century Virginian to define himself against, and Valsania’s explorations here lead to numerous insightful discoveries about race, gender, and structures of power. This article sets the stage for a genealogy of the postgenomic body. It starts with the current transformative views of epigenetics and microbiomics to offer a more pluralistic history in which the ethical problem of how to live with a permeable body – that is plasticity as a form of life – is pervasive in traditions pre-dating and coexisting with modern biomedicine (particularly humoralism in its several ramifications). To challenge universalizing narratives, I draw on genealogical method to illuminate the unequal (...) distribution of plasticity across gender and ethnic groups. Finally, after analysing postgenomics as a different thought-style to genomics, I outline some of its implications for notions of plasticity. I argue that postgenomic plasticity is neither a modernistic plasticity of instrumental control of the body nor a postmodernist celebration of endless potentialities. It is instead closer to an alter-modernistic view that disrupts clear boundaries between openness and determination, individual and community. (shrink)

Our understanding of body–world relations is caught in a curious contradiction. On one side, it is well established that many concepts that describe interaction with the outer world – ‘plasticity’ or ‘metabolism’- or external influences on the body - ‘environment’ or ‘milieu’ – appeared with the rise of modern science. On the other side, although premodern science lacked a unifying term for it, an anxious attentiveness to the power of ‘environmental factors’ in shaping physical and moral traits held sway in (...) nearly all medical systems before and alongside modern Europe. In this article, I build on a new historiography on the policing of bodies and environments in medieval times and at the urban scale to problematize Foucault’s claim about biopolitics as a modern phenomenon born in the European eighteenth-century. I look in particular at the collective usage of ancient medicine and manipulation of the milieu based on humoralist notions of corporeal permeability (Hippocrates, Galen, Ibn Sīnā) in the Islamicate and Latin Christendom between the 12th and the 15th century. This longer history has implications also for a richer genealogy of contemporary tropes of plasticity, permeability and environmental determinism beyond usual genealogies that take as a starting point the making of the modern body and EuroAmerican biomedicine. The case for an unprecedented penetration of life mechanisms into the politics of Western modernity has been a cornerstone of 20th-century social theory. Working with and beyond Foucault, this article challenges established views about the history of biopower by focusing on ancient medical writings and practices of corporeal permeability. Through an analysis of three Roman institutions: a) bathing; b) urban architecture; and c) the military, it shows that technologies aimed at fostering and regulating life did exist in classical antiquity at (...) the population scale. The article highlights zones of indistinction between natural and political processes, zoē and bíos, that are not captured by a view of destructive incorporation of or over life by sovereign power. In conclusion, the article discusses the theoretical potential of this historical evidence for contemporary debates on ‘affirmative biopolitics’ and ‘environmental biopower’. (shrink)

This paper provides an analysis of Aeneas' visit to the "parva Troia" in Epirus , centered on the theme of "substitutes" and "doubles," and beginning with Andromache, the heroine of this encounter. With Helenus as a substitute for her deceased husband, Hector, Andromache is involved in a sort of levirate marriage. Moreover, she reacts to Aeneas and his companions as if they too were "substitutes," living persons who immediately evoke images of the dead, "doubles" for her lost loved ones . (...) This makes Andromache perfectly at home in "parva Troia", which is itself a "double," a "substitute" for the city destroyed by the Greeks. Except that, like all "doubles," "parva Troia" is an insubstantial illusion, the effigy of something that no longer exists. This city and its landscape can only be "seen," not actually "inhabited." These Trojan exiles are thus victims of a syndrome very similar to "nostalgia" . Helenus and his companions are "too faithful" to their vanished city; their destiny, like that of the dead, has been hopelessly fulfilled. Aeneas, however, is not allowed to become a prisoner of the past. Against his will, he must be "unfaithful" to his former city: he will not rebuild Troy. The companions of Helenus and Andromache suffer from an "excess of identity" . Aeneas, on the other hand, submits to the almost total loss of his own identity: except for the Penates, a highly significant, sacred part of the lost patria, which will contribute to the formation of his identity in a way similar to Helenus and Andromache's own nostalgic cult of the image of Troy. The paper takes into consideration the different degrees of power and control that can be exercised by the mediator/arbitrator. This issue is investigated with particular regard to such aspects as the nature of the ADR procedure adopted, the cultural context in which the procedure takes place, and the formulation of specific legal norms. The analysis both of a few arbitration rules and some data from real arbitral proceedings shows great reliance on the arbitrator’s discretion and use of common sense, which (...) is in line with the idea itself of arbitration. Moreover, the high degree of power autonomy enjoyed by the arbitrator during the whole procedure derives from the presupposition that the parties accept the arbitrator’s personal opinion and final judgment and from the fact that the majority of the disputes in international commercial arbitration are of a technical and complicated nature. The analysis also shows that the legal background of most arbitrators tends to surface even when they are involved in alternative dispute resolution proceedings and is clearly visible in the orderly allocation of turns and the strict control over the procedures to be followed. Especially when arbitrators are lawyers or judges, they tend to promote a feeling of belonging to the same professional community, which induces a greater spirit of cooperation and a lowering of the control level. Englober et « passer par l’extérieur », telles sont ses tâches, et elles connaissent deux modalités d’application depuis lors, qui sont aussi deux techniques de normalisation. La première, prédominante, s’occupe du (...) gros : la discipline. La seconde, active et souterraine, s’occupe des détails : la sécurité. Elle cerne de plus près les multiplicités, la vie, les conduites. Une véritable politique des multiplicités supposerait, bien davantage encore, de passer « par l’extérieur » des agents que nous tenons pour naturels ou spontanés, mais qui sont l’objet d’un souci et d’une ré-institution constants : le marché, l’entreprise, le travailleur. The experience of the post-colonial State underlines the transformations of the modern State. In fact, some features of the post-colonial State which were regarded as being overcome or at least inconsistent with the constitutional, democratic and rational form of the State, are now emerging also in those States that never made experience of colonization, or have been colonizers. The essay analyses the transformations of the modern State aiming to articulate the concept of Global State. In this case, the question of (...) origins does not represent a principle of legitimation, as it was with the doctrine of social contract. Rather, the symbolic and historical discontinuity defines a cut between the origin and the functioning of the State, corresponding to a transformation of the legitimating sources of the State itself. Within the global State, sovereignty is not anymore a monopoly, but a widespread practice enacted by several social structures. (shrink)

Dissolution of tradition : the new affiliation -- Jefferson's communitarianism : in search of the affiliated man -- Consequences of communitarianism : the other side of love.

In this paper I first offer a systematic outline of a series of conceptual novelties in the life-sciences that have favoured, over the last three decades, the emergence of a more social view of biology. I focus in particular on three areas of investigation: (1) technical changes in evolutionary literature that have provoked a rethinking of the possibility of altruism, morality and prosocial behaviours in evolution; (2) changes in neuroscience, from an understanding of the brain as an isolated data processor (...) to the ultrasocial and multiply connected social brain of contemporary neuroscience; and (3) changes in molecular biology, from the view of the gene as an autonomous master of development to the ‘reactive genome’ of the new emerging field of molecular epigenetics. In the second section I reflect on the possible implications for the social sciences of this novel biosocial terrain and argue that the postgenomic language of extended epigenetic inheritance and blurring of the nature/nurture boundaries will be as provocative for neo-Darwinism as it is for the social sciences as we have known them. Signs of a new biosocial language are emerging in several social-science disciplines and this may represent an exciting theoretical novelty for twenty-first social theory. (shrink)

The Italian philosopher Maurizio Lazzarato reveals the underpinnings of contemporary subjectivity in the aesthetics and politics of mass media. This book discloses the conceptual groundwork of Lazzarato's thought as a whole for a time when his writings have become increasingly influential.

The theme of human extinction is increasingly at the center of the current debate on moral philosophy and bioethics. We look at space missions and station construction projects capable of accommodating a large population and at the colonization of other planets with great hope. However, solutions are not excluded either, which for now certainly appear to be much more original. One of the most original projects involves launching a spacecraft containing cryopreserved human embryos, which, once they arrive at destination on (...) another planet, must be thawed and birthed by intelligent machines through artificial wombs (ectogenesis). In this paper, I do not intend to analyze whether the embryo space colonization project is indeed feasible. Instead, I will focus on examining the primary moral questions raised by the embryo space colonization project to determine whether, at least prima facie, it can be deemed morally acceptable. I will begin by discussing the objection advanced by Konrad Szocik (2021), according to which any embryo space colonization project is doomed to failure because it cannot offer the hoped-for solution to the problem of the extinction of the human species (second paragraph). In the third paragraph, then, I will ask whether embryo space colonization is able to ensure the people it brings into the world an adequate or at least the morally appropriate quality of life. Finally, in the fourth and last paragraph, I will examine the question of the morality of human reproduction that passes through the guidance and choice of intelligent machines. I will argue that to evaluate the morality of this project we should consider not only the interests and quality of life of the first people who could be born but also the interests of all possible subsequent generations. In this paper, we analyse the most important documents establishing the criteria for the treatment and exclusion of COVID-19 patients, especially in regard to the giving of respiratory support, in Italy and Spain. These documents reflect a tension that stems from limited healthcare resources which are insufficient to save lives that, under normal conditions, could have been saved, or at least could have received the best possible treatment. First, we analyse the healthcare systems of these two countries before the spread (...) of the virus, both of which have seen decreases in the number of intensive care beds and have been marked by financial cuts during the last ten years. It is a fact that a greater number of people, especially those over 70 years of age, have been left without respiratory support treatment, and therefore, there have been a greater number of deaths. It is also a fact that there has been a higher infection rate among healthcare professionals due to the delay in the management of protective measures and the inability to provide adequate care for those in nursing homes, as recognised by WHO. In the context of this health emergency, healthcare professionals have suffered a real ‘moral distress’ because, knowing first-hand the causes of the limitation of resources, they have had to put triage protocols into practice. Finally, we set forth a series of concrete ethical proposals with which to face the successive waves of COVID-19 infection, as well as other future pandemics. (shrink)
