In order to maximize human performance, defence forces continue to explore, develop, and apply human performance enhancement (HPE) methods, ranging from pharmaceuticals to (bio)technological enhancement. This raises ethical, legal, and societal concerns and requires organizing a careful reflection and deliberation process, with relevant stakeholders. We discuss a range of ethical, legal, and societal aspects (ELSA), which people involved in the development and deployment of HPE can use for such reflection and deliberation. A realistic military scenario with proposed HPE application (...) can serve as a starting point for such an iterative and participatory process. Stakeholders can discuss this application, modify its features, and design appropriate processes around it – for instance, procedures for informed consent. We propose that organizing aspects into these three categories – ethical, legal, and societal – can help involve appropriate interlocutors at different moments: legal aspects with people in strategy or management roles, from the start of a project; ethical aspects with people in operations and medical roles, during development; and societal aspects with people in communication and personnel roles, during deployment. This holds especially true for the for the military, as it is one of the few organizations that can legitimately use violence. The evolving nature of armed conflict, characterized by a new emphasis on crisis management and peace support, is bringing morality to the forefront of military leadership. The challenges of today's military operations place a new imperative upon Professional Military Education (PME) to maximize the quality of instruction on ethics in terms of both content and effectiveness. This article explores the religious dimensions of Confucianism during the Ly-Tran dynasties (1009-1400 AD) in Vietnam, a period marked by significant sociopolitical and cultural transitions. Initially introduced as a moral and ethical philosophy from China, Confucianism underwent a complex process of localization, blending with indigenous Vietnamese beliefs and practices as well as Buddhism and Taoism. Through historical records, literary works, and ritual practices documented in “The Complete Annals of Đại Việt” and other classical texts, this study delves into how (...) Confucianism not only served as a guiding principle for governance, education, and social norms but also manifested religious aspects that influenced spiritual and religious life in Vietnam. The religious aspects of Confucianism during this era are evident in several key areas. Firstly, the concept of Heaven (Tian) and the Mandate of Heaven played a crucial role in legitimizing royal authority, with rulers and Confucian scholars frequently invoking divine will to justify political actions and social order. This sacralization of monarchy underpinned by Confucian ideals facilitated the integration of Confucianism into Vietnamese spiritual life. Secondly, the incorporation of Confucian rituals and practices, such as the Heaven Worship Ceremony (Tế Giao) and the veneration of Confucius and other sages at the Temple of Literature, highlights the religious dimensions of Confucian practice, emphasizing reverence, filial piety, and the moral obligations of rulers and subjects alike. Moreover, the article discusses how Confucianism interacted with and was influenced by Buddhism and Taoism, leading to a syncretic religious landscape in Vietnam. This interaction is illustrated through the blending of Confucian principles with Buddhist and Taoist ideals, affecting notions of kingship, governance, and the cosmological order. In conclusion, the religious aspect of Confucianism during the Ly-Tran dynasties significantly contributed to the shaping of Vietnamese identity, governance, and cultural heritage. By examining the religious dimensions of Confucianism, this article provides a more nuanced understanding of its role in Vietnamese society, highlighting the complex interplay between philosophy, religion, and politics in historical Vietnam. It is possible to imagine a successful community, even if such a community does not exist in the empirical world, and to be oriented toward this ideal without ever being able to realize it. According to Kant, human moral self-understanding is developed by human reason, and this explains the (...) structural similarity between the secular republic and the Kingdom of God under the specific conditions of the enlightened consciousness of a person who thinks for herself. ABSTRACTTwo categories of ethical questions surrounding military autonomous systems are discussed in this article. The first category concerns ethical issues regarding the use of military autonomous systems in the air and in the water. These issues are systematized with the Laws of Armed Conflict as a backdrop. The second category concerns whether autonomous systems may affect the ethical interpretation of LOAC. It is argued that some terms in LOAC are vague and can be interpreted differently depending on which (...) ethical normative theory is used, which may increase with autonomous systems. The impact of Unmanned Aerial Vehicles on the laws of war will be discussed and compared to Maritime Autonomous Systems. Terrorism, the use of military force in Afghanistan, Iraq and Syria, and the fatal police shootings of unarmed persons have all contributed to renewed interest in the ethics of police and military use of lethal force and its moral justification. In this book, philosopher Seumas Miller analyzes the various moral justifications and moral responsibilities involved in the use of lethal force by police and military combatants, relying on a distinctive normative teleological account of institutional roles. His (...) conception constitutes a novel alternative to prevailing reductive individualist and collectivist accounts. As Miller argues, police and military uses of lethal force are morally justified in part by recourse to fundamental natural moral rights and obligations, especially the right to personal self-defense and the moral obligation to defend the lives of innocent others. Yet the moral justification for police and military use of lethal force is to some extent role-specific. Both police officers and military combatants evidently have an institutionally-based moral duty to put themselves in harm's way to protect others. Under some circumstances, however, police have an institutionally based moral duty to use lethal force to uphold the law; and military combatants have an institutionally based moral duty to use lethal force to win wars. Two key notions in play are joint action and the natural right to self-defense. Miller uses a relational individualist theory of joint actions to construct the notion of multi-layered structures of joint action in order to explicate organizational action. He also provides a novel theory of justifiable killing in self-defense. Over the course of his book, Miller covers a variety of urgent topics, such as police shootings of armed offenders, police shooting of suicide-bombers, targeted killing, autonomous weapons, humanitarian armed intervention, and civilian immunity. Two famous Russian thinkers Nikolai O. Lossky (1870–1965) and E. Vasilievich Spektorsky (1875–1951) had a lot in common: both were talented intellectuals, lecturers and authors of many works on philosophy, history of philosophy, culture, politics and literature; both had to leave Russia and settle down abroad, and continue academic and creative activities in foreign environments. All these factors contributed to their friendly and intellectual communication which we want to pay attention to in this article. The purpose of the article is (...) to demonstrate similarities in how Lossky and Spektorsky formulated and addressed ethical issues on the grounding of Christianity and Christian-based philosophy. Thus, we have chosen several aspects of their ethical systems which are crucial for understanding the way of their moral thinking and which are representative in terms of comparison of these two authors: general philosophical positions, grounding ethics in Christianity, absolute basis of ethics and the way it can be cognized, human freedom, motives and goals of moral behavior, and moral evolution and the perspectives of humanity. This article takes a step toward filling the gap in the scholarly literature by examining the impact of religious intervention in the military on civil-military relations. Using the case of Israel, I argue that although the subordination of the Israeli military to elected civilians has remained intact, and the supreme command has been mostly secular, external religious authorities operate within the formal chain of command and in tandem with the formal authorities, managing the military (...) affairs. This religious influence is apparent in three major domains: the theological influence on military deployment, the exclusion of women from equal participation in military service, and the role expansion of the Military Rabbinate as a quasi-state agency and its reflection in the socialization of secular soldiers and the development of alternative military ethics. In this volume, four prominent thinkers propose and debate competing approaches to ethical decision-making for military personnel. Deane-Peter Baker presents and expounds the 'Ethical Triangulation' model, an ethical decision-making method he has employed through much of his career as an applied military ethicist. Rufus Black advocates for a natural law-based approach, one which has heavily influenced the framework formally adopted by the (...) Australian Defence Force. Roger Herbert outlines the 'Moral Deliberation Roadmap', the moral reasoning framework recently adopted by the US Naval Academy. Iain King then sets out a model of quasi-utilitarian decision-making developed in several post-conflict settings and refined at the UK's Royal College of Defence Studies. After the opening chapters in which each author outlines their favoured decision-making approach, the four contributors then evaluate each other's proposals, often critically. Philosopher David Whetham offers some concluding thoughts in which he summarises areas of agreement between the authors, identifies key areas of difference, and suggests directions for future research. Jacques Maritain is widely recognized as one of the foremost Catholic philosophers of modern times. He wrote groundbreaking works in all branches of philosophy. Writing initially about Gandhi, whose strategy of non-violence he sought to incorporate within a Christian conception of political action, Maritain proceeded to comment more specifically on the religious aspects of armed force in “On Holy War,” an (...) essay about the civil war then ongoing in Spain. After the outbreak of World War II in September 1939, Maritain penned a series of essays that sought to explain why the Anglo–French declarations of war were warranted on Christian just war principles. While the secondary literature on Maritain’s thought is extensive, thus far there has been little systematic exploration of his writings on war. In what follows I seek to remedy this lacuna, by examining how he conceptualized just war in the three phases outlined above. (shrink)

Democratic societies expect their armed forces to act in a morally responsible way, which seems a fair expectation given the fact that they entrust their armed forces with the monopoly of violence. However, this is not as straightforward and unambiguous as it sounds. Present-day military practices show that political assignments, social and cultural contexts, innovative technologies and organisational structures, present military personnel with questions and dilemma’s that can have far-reaching consequences for all involved – not in the last (...) place for the soldiers themselves. A thorough training and education, in which critical thinking is developed and stimulated, seems therefore a necessary condition for morally responsible behaviour. Leadership and ethics are habitually treated as related to separate spheres. It would be better, perhaps, if leadership and ethics were treated as belonging to a single domain. Ethics is an aspect of leadership and not a separate approach that exists alongside other approaches to leadership such as the trait approach, the situational approach, etc. This holds especially true for the military, one of the few organizations that can legitimately use violence. Today, most militaries opt for (...) a character-based approach for the ethics education of their leaders and espouse leadership theories that want leaders to be strong and visionary. Both the role of character and leadership are increasingly questioned, however, on the basis that situational factors are more influential than leadership and character. A closer look suggests that an interactionist perspective, with leadership, character, and the situation interplaying, is more accurate. It is still good leadership that keeps soldiers from crossing the line between the lawful use of force and excessive violence. (shrink)

Conscience Across Borders aims to map a middle course between an ethics of over-confident deductive reasoning, and an ethics of relativism that treats moral choices as mostly idiosyncratic preferences. It dismantles all rationales for domineering - including one religious Way by another, the voiceless poor by the rich, society by the nation-state, individuals by civil and religious bureaucracies, women by men, the young by their elders, or the natural world by human beings.

In this paper I offer a re-reading of "The Moral Philosopher and the Moral Life," William James's most well known work on ethics. I show that while James defends a naturalistic account of the basis of morality in the essay, he also makes a practical argument for religious faith, one that closely connects the piece to such works as "The Will to Believe" and The Varieties of Religious Experience. After discussing some of the strengths and weaknesses of (...) James's moral theory and metaethical views, I argue that the religious aspect of the essay—which has tended to be either ignored or downplayed by previous interpreters—is of crucial importance for understanding James's ethics, and that his practical argument is valid and worthy of serious consideration. Although euthanasia is seen as the problem of the individual will and as one’s right to privacy, to a better quality of life or to a dignified death, it has major institutional implications. They are closely related to the juridical system, to the way of understanding state involvement in protecting the individuals and respecting their freedoms, to the institutional system of health care, to the government rules that establish social, political or professional practices. The public debate around the topics related (...) to the human condition, like euthanasia, grants a special force to public communication, to organizational communication, to communication in professional environments, to physician-patient communication and, more generally, to interpersonal communication. In this text we emphasize the importance of public debate on euthanasia from the perspective of organizational ethics, of medical deontology, of patients’ rights, but especially of elaborating public policies and national programs, and we underline the importance of the need to establish protocols for health care, as well as to build a framework of democratic communication. Battlefield euthanasia, the purposeful killing of wounded soldiers (or even civi- lians) in order to hasten their foreseeable death, has been an issue in military medicine and in soldiers’ moral codes at all times. During conflicts since anti- quity, there have been severely wounded who would not die immediately but whose fate seemed clear, nevertheless. But can it ever be morally justified to kill those wounded out of mercy in order to end their suffering? Can death ever be the (...) better option? And if so, what conditions have to be fulfilled? This paper investigates some of the moral aspects of battlefield euthanasia. Analogies to physician-assisted suicide in civil settings will be drawn and contrasted with the additional aspects that the military environment adds to the problem. (shrink)

In this new edition of the classic book on the moral conduct of war, Sidney Axinn provides a full-length treatment of the military conventions from a philosophical point of view. Axinn considers these basic ethical questions within the context of the laws of warfare: Should a good soldier ever disobey a direct military order? Are there restrictions on how we fight a war? What is meant by “military honor,” and does it really affect the contemporary soldier? Is (...) human dignity possible under battlefield conditions? Axinn answers “yes” to these questions.
