The distribution of moral properties supervenes on the distribution of natural properties, and this provides a puzzle for non-naturalism: what could explain supervenience if moral properties are not natural properties? Enoch claims moral principles explain supervenience. But this solution is incomplete without an account of what moral principles and properties are, and what relation holds between them. This paper begins to develop such an account by exploring analogous issues for Realism about Laws of nature (...) in philosophy of science. Appealing to Mumford’s Central Dilemma for Realism about Laws, I argue that for moral principles to explain supervenience, moral properties must be ontologically dependent on the principles. I suggest that moral properties are relations between moral principles and natural properties. I also explore what it would take to adapt this explanation to a pluralistic theory of morality. Contributory reasons avoid the Cartwright Problem for Laws in a way component forces cannot. (shrink)

Normative ethical theories and religious traditions offer general moral principles for people to follow. These moral principles are typically meant to be fixed and rigid, offering reliable guides for moral judgment and decision-making. In two preregistered studies, we found consistent evidence that agreement with general moral principles shifted depending upon events recently accessed in memory. After recalling their own personal violations of moral principles, participants agreed less strongly with those very (...) class='Hi'>principles—relative to participants who recalled events in which other people violated the principles. This shift in agreement was explained, in part, by people’s willingness to excuse their own moral transgressions, but not the transgressions of others. These results have important implications for understanding the roles memory and personal identity in moral judgment. People’s commitment to moral principles may be maintained when they recall others’ past violations, but their commitment may wane when they recall their own violations. (shrink)

After briefly sketching common-morality principlism, as presented in Principles of Biomedical Ethics, this paper responds to two recent sets of challenges to this framework. The first challenge claims that medical ethics is autonomous and unique and thus not a form of, or justified or guided by, a common morality or by any external morality or moral theory. The second challenge denies that there is a common morality and insists that futile efforts to develop common-morality approaches to bioethics limit (...) diversity and prevent needed moral change. This paper argues that these two critiques fundamentally fail because they significantly misunderstand their target and because their proposed alternatives have major deficiencies and encounter insurmountable problems. I argue that moral principles involve the same sort of generalization as ordinary yet elusive generic generalizations in natural language such as ‘Tigers are striped’ or ‘Peppers are spicy’. A notable advantage of the generic view is that it simultaneously allows for pessimism and optimism about the role and status of moral principles in our lives. It provides a new perspective on the nature of moral principles on which principles are not apt for (...) determining the moral status of particular actions while they may be apt, and even fundamental, to our acquisition of moral knowledge. A natural consequence of the view is variation among moral principles, with some regularly warranting exceptions and some appearing arguably exceptionless. I will also argue that this generic conception of moral principles has significant advantages, as a normative model of moral reasoning, over the view of moral principles as defaults advanced in recent years. Political judgments usually combine a normative principle or intuition with an appreciation of empirical facts regarding the achievability of different options and their potential consequences. The interesting question dividing partisans of political idealism and realism is whether these kinds of considerations should be integrated into the normative principles themselves or considered apart. At first sight, if a theorist is concerned with guiding political judgments, non-ideal or realist theorizing can seem more attractive. In this article, however, I argue that ideal (...) theorizing might be considered valuable even by theorists moved by a pragmatic concern because it is less exposed to conservatism. I nonetheless contend that the aim to guide action in the world as it is should not be abandoned. Therefore, I outline a four-step method for proceeding from abstract moral principles to concrete political judgments and apply it to a test case. (shrink)

This paper argues that the function of moral education in the biomedical context should be exactly the same as in a general, philosophical framework: it should not provide ready-to-use kits of moral principles; rather, it must show the history, epistemology and conceptual structure of moral theories that would enable those who have to make decisions to be as informed and as responsible as possible. If this complexity cannot be attained, an incomplete product—i.e. bioethics or bioethical (...) class='Hi'>principles—should not be seen as a viable substitute. This theoretical position is subsequently illustrated by a case study involving research ethics committees. It is argued that within these committees, that are carefully formed multidisciplinary bodies, what makes competent decision-making possible is not a bioethical theory, nor even a sound philosophical ethics, but the dynamics of the discussion of a number of experts coming from different disciplines. This multidisciplinary expertise is necessary and sufficient to undertake the challenges of complex decisions in the biomedical context. (shrink)

We created paired moral dilemmas with minimal contrasts in wording, a research strategy that has been advocated as a way to empirically establish principles operative in a domain‐specific moral psychology. However, the candidate “principles” we tested were not derived from work in moral philosophy, but rather from work in the areas of consumer choice and risk perception. Participants were paradoxically less likely to choose an action that sacrifices one life to save others when they were (...) asked to provide more reasons for doing so (Experiment 1), and their willingness to sacrifice lives depended not only on how many lives would be saved, but on the number of lives at risk (Experiment 2). The latter effect was also found in a within‐subjects design (Experiment 3). These findings suggest caution in the use of artificial dilemmas as a key testbed for revealing principled bases for moral judgment. (shrink)

In recent times, especially in the pages of this journal, the debate between the proponents of the two principal species of legal positivism has gained new vigor. Specifically, some champions of Exclusive Legal Positivism have sophisticatedly challenged the Inclusive Legal Positivists’ claim that moral principles can figure among the criteria by which the officials of a legal system ascertain the law. The present essay attempts to parry the most formidable of those recent challenges. 1.

What are moral principles? In particular, what are moral principles of the sort that (if they exist) ground moral obligations or—at the very least—particular moral truths? I argue that we can fruitfully conceive of such principles as real, irreducibly dispositional properties of individual persons (agents and patients) that are responsible for and thereby explain the moral properties of (e.g.) agents and actions. Such moral dispositions (or moral powers) are apt to (...) be the metaphysical grounds of moral obligations and of particular truths about what is morally permissible, impermissible, etc. Moreover, they can do other things that moral principles are supposed to do: explain the phenomena “falling within their scope,” support counterfactuals, and ground moral necessities, “necessary connections” between obligating reasons and obligations. And they are apt to be the truthmakers for moral laws, or “lawlike” moral generalizations. (shrink)

It's natural to think that the principles expressed by the statements "Promises ought to be kept" and "We ought to help those in need" are defeasible. But how are we to make sense of this defeasibility? On one proposal, moral principles have hedges or built-in unless clauses specifying the conditions under which the principle doesn't apply. On another, such principles are contributory and, thus, do not specify which actions ought to be carried out, but only what (...) counts in favor or against them. Drawing on a defeasible logic framework, this paper sets up three models: one model for each proposal, as well as a third model capturing a mixed view on principles that combines them. It then explores the structural connections between the three models and establishes some equivalence results, suggesting that the seemingly different views captured by the models are closer than standardly thought. DAVID WARD, in his interesting essay, advances a number of propositions: -/- That moral (including evil) behavior must be governed by a principle. That the principles involved in evil actions are unconscious. That these unconscious evil principles may be the product of malignant narcissism. And somewhat tentatively, that evil is driven "independent of any conscious desires" and by implication the evil person may be stripped of moral responsibility for their behavior. -/- To begin with common ground: (...) Those who act in an evil manner, in my experience, do not usually acknowledge that they acted on an evil principle (nor do those who commit good acts, excepting the terminally self-righteous, usually explain their behavior in terms of adherence to principles). Among serious offenders, self-justification in terms of having no choice is more common or the hapless claim that "I don't know why I did that" or even "I can't believe I did that" (which all too often becomes "I can't remember doing that" for as Nietzche (1886) wrote "I have done that—says my memory. I could not have done that—says my pride and remains inexorable. Eventually memory gives in"). Those who do appeal to principle to justify their evil actions almost inevitably cite value systems that have considerable, if not universal, acceptance. I have encountered men who proudly declared their killings to be part of the pursuit of righteous aims, such as protecting children from pedophiles, stopping the killing of the unborn child, reducing AIDS, and cleansing their city of vice. Interestingly the combination of dreadful, and in many cases repeated, violence with self-righteous superiority often attracts from fellow prisoners and prison staff a label of evil. (shrink)

One prominent strand in contemporary moral particularism concerns the claim of "principle abstinence" that we ought not to rely on moral principles in moral judgment because they fail to provide adequate moral guidance. I argue that moral generalists can vindicate this traditional and important action-guiding role for moral principles. My strategy is to argue, first, that, for any conscientious and morally committed agent, the agent's acceptance of (true) moral principles shapes (...) their responsiveness to (right) moral reasons and, second, that if so, then those principles can contribute non-trivially to some reliable strategy for acting well that is available for use in the agent's practical thinking. My defense of these two claims appeals to an account of moral principles as a kind of hedged principles which I defend elsewhere, but my general line of argument should be acceptable to many other forms of generalism as well. I defend the epistemic significance of hedged principles in moral deliberation, and argue that the need for sensitivity to particulars in moral judgment doesn't supplant principles in moral guidance. I finish by arguing that the generalist model of moral guidance developed here isn't undermined by evidence from cognitive science about how we make moral judgments in actual practice, and that it compares favorably to particularism with respect to its capacity to offer adequate moral guidance. Moral properties are explained by other properties. And moral principles tell us about moral properties. How are these two ideas related? In particular, is the truth of a given moral principle part of what explains why a given action has a given moral property? I argue “No.” If moral principles are merely concerned with the extension of moral properties across all possible worlds, then they cannot be partial explainers of facts about (...) the instantiation of those properties, since in general necessitation does not suffice for explanation. And if moral principles are themselves about what explains the moral properties under their purview, then by their own lights they are not needed in order to explain those moral properties’ instantiation—unless, that is, the principles exhibit an objectionable form of metaphysical circularity. So moral principles cannot explain why individual actions have moral properties. Nor, I also argue, can they explain why certain other factors explain why those actions have the moral properties that they do, or in some other way govern or mediate such first-order explanations of particular moral facts. When it comes to the explanation of an individual action’s specific moral features, moral principles are explanatorily idle. (shrink)

Opponents of human embryonic stem cell (hESC) research claim that such research is incompatible with the moral principle that it is always wrong intentionally to end a human life. In this essay, I discuss how that principle might be revised so that it is subject to as few difficulties as possible. I then argue that even the most defensible version of the principle is compatible with the moral permissibility of hESC research.

The epistemology of moral principles should be developed in relation to general epistemology and integrated with a plausible moral ontology. On both counts, it is important to consider the nature of moral properties and, more generally, normative properties. This paper distinguishes two kinds of normative properties, indicates how they are related to one another and to moral properties, contrasts their supervenience on natural properties with their grounding in those properties, and, in the light of the (...) points then in view, argues for a moderately rationalist account of knowledge of moral principles. The paper also considers in detail how one might account for the a priori status of certain moral principles—a status that remains controversial and is in any case difficult to establish. The final section shows how the overall position of the paper may be consistent with moral naturalism but does not depend on it. (shrink)

Two recent high-quality articles, including one in this journal, have challenged the Inclusivist and Incorporationist varieties of legal positivism. David Lefkowitz and Michael Giudice, writing from perspectives heavily influenced by the work of Joseph Raz, have endeavored—in sophisticated and interestingly distinct ways—to vindicate Raz's contention that moral principles are never among the law-validating criteria in any legal system nor among the laws that are applied as binding bases for adjudicative and administrative decisions in such a system. The policy adopted by the Twenty-fifth Congress of the CPSU on raising the quality of work and the effectiveness of social production means that work must be more highly organized and disciplined and that initiative and creative searching must be fostered. "The country sets as its goal enlargement of the real opportunities for citizens to apply their creative powers, abilities, and gifts and for comprehensive development of the individual.".

We discuss ethical aspects of risk-taking with special focus on principlism and mid-level moral principles. A new distinction between the strength of an obligation and the degree to which it is valid is proposed. We then use this distinction for arguing that, in cases where mid-level moral principles come into conflict, the moral status of the act under consideration may be indeterminate, in a sense rendered precise in the paper. We apply this thought to issues (...) related to pandemic influenza vaccines. The main conclusion of the paper is that on a principlist approach some acts may be neither right nor wrong (or neither permissible nor impermissible), and we claim that this has important implications for how we ought to make decisions under risk. A central theme in F. A. Hayek’s work is the contrast between principles and expediency, and the insistence that governments follow abstract general principles rather than pursue apparently expedient social and economic policies that seek to make us better off.2 This is a radical and striking thesis, especially from an economist: governments should abjure the pursuit of social and economic policies that aim to improve welfare and, instead, adhere to moral principles. In this chapter I defend (...) this radical claim. I begin by explicating and defending Hayek’s argument against the pursuit of expediency based on his analysis of economic and social complexity. On a common characterization, moral luck occurs when factors beyond agents’ control affect their moral responsibility. The existence of moral luck is widely contested, however. In this paper, I present a new challenge for deniers of moral luck. It seems that some factors beyond agents’ control—such as moral principles about blame- and praiseworthiness—clearly affect moral responsibility. Thus, moral luck deniers face a dialectical burden that has so far gone unnoticed. They must either (...) point to a relevant difference between factors like moral principles and the kind of factors that according to them do not affect moral responsibility or show how they can avoid having to point to such a difference. I argue that no obvious way to meet the challenge presents itself and that it thus amounts to a serious worry for deniers of moral luck. (shrink)

ABSTRACT:Moral realism entails that there are metaphysically necessary moral principles of the form ‘all actions of nonmoral kind Z are morally good’; being discoverable a priori, these must be logically necessary. This article seeks to justify this apparently puzzling consequence. A sentence expresses a logically necessary proposition iff its negation entails a contradiction. The method of reflective equilibrium assumes that the simplest account of the apparently correct use of sentences of some type in paradigm examples is probably (...) logically necessary. An account is simple insofar as it uses few predicates designating properties easily recognizable in many different kinds of paradigm examples. I illustrate how reflective equilibrium uses these criteria to discover logically necessary nonmoral propositions such as ‘if S remembers doing X, S believes that he did X’ and ‘if it is scarlet, it is red’. I then illustrate how exactly the same procedures can lead us from paradigm examples of apparently true sentences asserting that actions of some kind are good to discovering moral principles. I advance the contingent hypothesis that most contemporary humans, although they initially disagree about moral issues, have derived from different paradigm examples the same concept of moral goodness, which will ensure that the use of reflective equilibrium will lead to eventual agreement about moral issues. That strongly suggests that the moral principles eventually reached by reflective equilibrium are logically necessary ones. (shrink)

This paper is a survey of the generalism-particularism debate and related issues concerning the relationship between normative reasons and moral principles.

In recent years, a number of moral philosophers have held both that there are particular moral truths, and also that there are no general moral principles which explain these particular moral truths--either because there simply are no moral principles, or because moral principles are themselves explained by or derived from particular moral truths rather than vice versa. What is the function of moral principles within the body of moral knowledge? And what must be the nature of moral principles in order for them to carry out this function? A specific set of answers to these questions is widely accepted among moral philosophers – so widely accepted as almost to constitute a sort of orthodoxy. The answers embody a view of the place of principles within the body of morality which crosses (...) the lines between cognitivism and non-cognitivism. Though I have put the question in cognitivist terms and shall discuss it in those terms, I think a similar question and a more or less parallel discussion could be given in non-cognitivist terms. Perhaps the time-honoured debate between the two positions can be suspended, at least temporarily, while we examine, not the nature of morality, but its structure. (shrink)
